RE: 4543 Yerba Ave
It has come to our attention that the Atascadero City Council will discuss potential
litigation regarding Code Enforcement actions at 4543 Yerba Ave, Atascadero, CA (APN
028-151-017). We applaud Council’s actions taken on 27 May 2025 and subsequent
City action that resulted in a clean-up of the property, which was based on a long
history of code violations and citizen complaints; however, many neighbors have
concerns about continued code violations at the property. The following is my summary
of the issues raised by multiple neighbors.
Issues:
1. Debris on property
We believe the property is repeatedly exceeding the outdoor storage limits established
by AMC § 9-6.130(g), and the condition repeatedly returns after enforcement-directed
cleanup. We would like the City to evaluate the property for continuing/repeat violations
of § 9-6.130(g), as well as any applicable solid-waste, nuisance, fire-safety, or vehicle-
abatement provisions.
2. Lack of garbage collection service
We believe the property owner lacks garbage and recycling service and does not have a
valid “Self Haul” permit issued by the City in accordance with AMC § 6-4.104 and §
6-4.112. We would like the City to confirm if the property has a valid “Self Haul” permit
and is in compliance with the requirements of said permit. If no permit exists, require
the property owner to subscribe to and pay for the City's three or more-container
collection services for weekly collection of recyclable materials, organic materials, and
solid waste.
3. Fire Department Access
We believe the property does not have adequate access and requires an unobstructed,
safe means of egress (exit/entry path) from a building as required by the California Fire
Code as adopted by AMC §4-7. We would like the City to evaluate the property for
repeated violations of this requirement.
4. Burning of Residential Trash
We believe the property owner is in violation of AMC § 5-7.02 (b)(2) by disposing of
paper and other residential rubbish through burning. We request the City require
compliance with this AMC section.

5. Unleashed Aggressive Dog
We believe the owners keep aggressive dog(s) on the property in violation of AMC §
4-1.121. The animal has attacked or menaced people and other animals in the
neighborhood. We would like the City to require compliance with the applicable AMC
sections.
Questions for City Staff and City Council:
•Does City Council Resolution 2025-028 remain relevant to the continuing conditions?
•What is the City's procedure for a nuisance that reappears after City-ordered
abatement?
•Can the City initiate another nuisance-abatement proceeding without starting from
the beginning?
•Can the City impose another administrative citation or seek another abatement and
recover the City's costs?
•What documentation does Code Enforcement want from neighboring property owners
to establish that the condition has reappeared?
