DISCLOSURE OF CAMPAIGN CONTRIBUTIONS: California Government Code section 84308 (“Levine Act”) requires a party to or participant in a proceeding involving a license, permit, or other entitlement, including all contracts other than competitively bid, labor, or personal employment contracts, to disclose any contribution of more than $500 that the party or participant (or their agent) has made to a member of the City Council within the prior 12 months. The City Council Member(s) who receive such a contribution are disqualified and not able to participate in the proceedings and are also required to disclose that fact for the official record of the subject proceedings. Disclosures must include the amount of the campaign contribution and identify the recipient City Council Member and may be made either in writing to the City Clerk before the agenda item or by verbal disclosure during consideration. The Levine Act also prohibits, during the proceeding and for 12 months following a final decision, a party to or participant in (or their agent) a proceeding involving a license, permit, or other entitlement, including all contracts other than competitively bid, labor, or personal employment contracts, from making a contribution of more than $500 to any member of the City Council or anyone running for City Council. Authorize the City Manager to execute a sales agreement with Sean Knoph for the purchase of a vacant property at the entry area for Stadium Park (APN 029-105-014) in the amount of $375,000 for the preservation and improvement of a parking area and trail access to Stadium Park Open Space. 2. Recommendation: Council provide direction on options presented for regulation of sidewalk vending within the City. General Municipal Election – November 3, 2026 Fiscal Impact: The cost to the City is determined by the number of registered voters on Election Day, and the number of Candidate Statements included in the Voter Pamphlet. The County’s estimate for the 2026 election of officials in Atascadero is $77,000 and the City currently has $75,030 in budgeted general funds for election costs. Recommendation: Council 1. Adopt the following Draft Resolutions for the purpose of electing a Mayor, two members to the City Council, and a City Treasurer: A. Draft Resolution A, calling and giving notice of the holding of a General Municipal Election to be held on Tuesday, November 3, 2026, for the election a Mayor, two Council Members, and a City Treasurer. Adopting Sewer Service Charges to be Added to the 2026-2027 Property Tax Rolls Fiscal Impact: The City will collect an estimated $6,960,340 in sewer service charges for Fiscal Year 2026-27 if Council adopts the Draft Resolution. Revenue from sewer service charges is paid to the City twice each year. An additional two dollars are added to each property on the tax roll to cover the County fee to administer the levy process. Recommendation: Council: 1. Conduct a public hearing to receive verbal testimony regarding the proposed sewer service charges to be levied onto property tax rolls. 2. Adopt Draft Resolution approving sewer service charges to be added to the Fiscal Year 2026-2027 property tax rolls. Authorize the City Manager to execute a sales agreement with Sean Knoph for the purchase of a vacant property at the entry area for Stadium Park (APN 029-105-014) in the amount of $375,000 for the preservation and improvement of a parking area and trail access to Stadium Park Open Space. 2. Authorize the Administrative Services Director to appropriate $385,000 in Open Space Acquisition Fees Funds for the purchase of the property including any escrow/transaction fees. DISCUSSION: BACKGROUND A triangular shaped lot, roughly one-half acre in size at the entry to Stadium Park is currently zoned for Multi-Family residential uses and is privately owned. The lot includes an unpaved area that is currently used for parking and access to Stadium Park adjacent to Capistrano Road. A large portion of the lot is steeply sloped and also connects to land owned by the Historical Society to the south. If the site were to be developed with residential land uses, it would infringe on the existing parking and access area and potentially hinder the Stadium Park open space access. The land is an important control point for the trail system and the City has contemplated purchasing the site for many years. If purchased, the City could improve the parking and access for Stadium Park by enlarging the parking area, installing new road base, and installing a simple split rail or similar fence to outline the edge of the parking area. A simple trail could also be improved to link the Stadium Park trail to the property owned by the Historical Society. The purchase and related costs are proposed to be funded through the City’s Open Space Acquisition Fees Fund (Open Space Fund). The Open Space Fund is for the purpose of acquiring Page 48 of 115 6/23/26 | Item D6 | Staff Report available land for the preservation and maintenance of open space as an important amenity to the residents of the City, and can be used for trailheads, trails, and bikeways. PURCHASE AGREEMENT City staff, with the support of the City Attorney’s Office, completed negotiations with the seller for the price of $375,000. An appraisal was completed in August of 2025, estimating the property value to be $420,000 (attachment 2). The purchase agreement (Attachment 1) requires the City to split the transaction fees with the current owner. Additionally, the City will need to pay for a phase one environmental study, which will cost approximately $2,600. NEXT STEPS The City would like to enter into a purchase agreement as soon as feasible. Environmental Review The City intends to review the proposed acquisition of the Property in accordance with the California Environmental Quality Act (Public Resources Code § 21000 et seq.) (“CEQA”) and the State CEQA Guidelines (14 Cal. Code Regs. § 15000 et seq.) prior to the Close of Escrow. This Agreement shall be a legally binding contract for the purchase and sale of real property. RECITALS A. The Seller is fee owner of a parcel of real property, commonly referred to as 5655 Capistrano Avenue, Assessor’s Parcel Number 029-105-014, located in the City of Atascadero, more particularly described in Exhibit A attached to this Agreement (the “Property”). B. The City desires to purchase the Property for public purposes, including the conservation of open space and park lands in the City. C. The City intends to review the proposed acquisition of the Property in accordance with the California Environmental Quality Act (Public Resources Code § 21000 et seq.) (“CEQA”) and the State CEQA Guidelines (14 Cal. Code Regs. § 15000 et seq.) prior to the Close of Escrow. NOW, THEREFORE, in consideration of the mutual covenants contained in this Agreement, the City and the Seller (collectively, the "Parties") agree as follows: Section 1. Purchase and Sale of the Property. Subject to the terms and conditions set forth below, the City agrees to buy, and the Seller agrees to sell, the Property. Section 2. Purchase Price. (a) The purchase price for the Property shall be three hundred seventy-five thousand Dollars ($375,000.00) (the "Purchase Price"). (b) Upon the Effective Date of this Agreement, Seller shall establish an escrow (the "Escrow") with _________ (the "Escrow Holder"). The "Effective Date" of this Agreement shall be the date upon which the Seller and the City have executed this Agreement as reflected by the last signature date shown on the final page of this Agreement. (c) City shall deposit into Escrow an amount equal to the Purchase Price (“Deposit”). The Deposit and all accrued interest (if any) shall be fully refundable to the City in the event that the City timely exercises its rights to terminate the Agreement under Section 4 below. (d) The City understands and agrees that its willingness to purchase the Property is conditioned on the Seller performing all obligations required under this Agreement. Section 3. Payment of Purchase Price. City shall deposit the sum set forth in Section 2(c), as well as all costs payable by the City pursuant to Section 12, in one lump sum via wire transfer, cash, or cashier’s check no later than one (1) business day prior to the Close of Escrow. Section 4. Physical Inspection Contingency Period: Right of Entry. The City’s obligation to purchase the Property is contingent on the City making a determination, within sixty (60) calendar days following the Effective Date (the "Physical Inspection Period") that the City is satisfied with the physical conditions of the Property. This time is intended to allow the City to perform a Phase I environmental study and to conduct any other due diligence on the Property. (a) During the Physical Inspection Period, the City shall have the right to: (1) Conduct such engineering, feasibility, seismic surveys and other studies regarding the condition of the Property that the City deems prudent. (2) Conduct such environmental audits and studies regarding the environmental conditions of the Property that the City deems prudent. (b) The Seller hereby grants the City and its employees, representatives, and agents, a right of entry to enter the Property for the purposes of conducting examinations and investigating the Property. During regular business hours, the Seller will provide the City reasonable access to the Property, including any improvements that may exist on the Property, for the purpose of conducting examinations. The City shall notify the Seller and obtain Seller’s approval, which approval shall not be unreasonably withheld, prior to inspecting the Property or conducting any invasive testing of the Property. The City shall reasonably repair any damage to the Property caused by its inspections and tests and shall restore the Property to the condition existing as of the date of the inspection; provided, however, the City shall have no obligation to repair any damage to the Property which is revealed (but not caused by) such inspection. The City shall not have any liability to the extent incurred by the Seller as a result of the discovery by the City of any existing state of facts relating to the Property. Any reports generated pursuant to this Section shall be given to the Seller if the City elects to terminate this Agreement pursuant to this Section 4. (c) Within five (5) business days following the Effective Date (and in addition to any documents previously provided to the City by the Seller), the Seller shall deliver or make available to the City the following information related to the Property (all of which may be duplicated by the City in its discretion) for the City’s review and approval: (i) any and all third party reports, studies and investigations related to the Property's physical condition or the physical condition of any structure on the Property including environmental conditions, soils reports, seismic reports or inspection reports; (ii) the two (2) most recent Property tax bills, including all information on any tax assessments, (iii) any architectural plans and drawings, record of survey, and specifications for the Property (if available), (iv) all service and maintenance contracts, (v) any public sector notices regarding or relating to the Property, (vi) all leases and rent rolls related to the Property and (vii) any records relating to any lawsuits pending against the Seller, its agents or employees in connection with the ownership, operation, or management of the Property. (d) The Seller shall complete and deliver, within five (5) business days after the Effective Date, a Property Information Sheet in the form attached hereto as Exhibit C, all legally required disclosures regarding the Property. Page 52 of 115 6/23/26 | Item D6 | Attachment 1 Purchase and Sale Agreement and Joint Escrow Instructions 5655 Capistrano Ave., Atascadero CA Page 3 (e) At least five (5) business days prior to the expiration of the Physical Inspection Period, Seller shall provide the City with a current survey of the Property showing the boundaries and certain points specified by the City, prepared by a licensed land surveyor, at Seller’s expense. (f) Promptly after opening Escrow, Seller shall cause Escrow Holder to deliver to the City a preliminary report for an ALTA Owner’s Extended Coverage Policy of Title Insurance for the Property, setting forth all liens, encumbrances, easements, restrictions, conditions, pending litigation, judgments, administrative proceedings and other matters of record affecting Seller’s title to the Property (the “Title Report”). The City shall approve or disapprove in writing of each exception and any other matters shown on the Title Report prior to the expiration of the Physical Inspection Period (but not less than five (5) business days after the City’s receipt of the Title Report). The City’s failure to object in writing prior to the expiration of the Physical Inspection Period shall be deemed to be an approval of the Title Report. If the City objects to the Title Report, the City may further elect to terminate this Agreement by sending written notice of termination to Seller prior to Close of Escrow. (g) The City shall have until 5:00 p.m. PST on the expiration date of the Physical Inspection Period to notify the Seller of the City’s dissatisfaction with the Property in the City’s sole discretion by providing written notice to the Seller pursuant to this Section. In the event that any documents, survey, or other items to be delivered by Seller to the City are delivered later than as is required by this Section 4, then the Physical Inspection Period shall be extended to the date that is five (5) business days from the date the City receives any late delivered item. Such timely notice to the Seller shall terminate this Agreement; should the City fail to provide Seller such notice, the City shall be deemed to have accepted the condition of the Property. Upon timely notice by the City to the Seller of the City’s dissatisfaction with the Property under this Section 4, the Deposit, and any interest earned thereon, shall be immediately refunded to the City and this Agreement shall be terminated without further action by the Parties, and thereafter no party shall have any further duties, obligations, rights, or liabilities under this Agreement, except for those provisions specified to survive the termination of this Agreement. Section 5. Representations and Warranties of the Seller. The Seller hereby represents and warrants the matters set forth below to be true to the best of the Seller’s knowledge as of the date hereof and as of the Closing Date. Such representations shall survive the closing and conveyance of title to the Property. If requested by the City, prior to the Closing Date, the Seller shall deliver to the City a certificate dated as of the Closing Date, signed by the Seller, certifying that the representations and warranties are true to the best of the Seller’s knowledge as of the Closing Date. (a) The Seller has the legal power, right and authority to enter into this Agreement and the instruments and documents referenced herein, and to consummate the transaction contemplated hereby. The individuals executing this Agreement and the instruments referenced herein on behalf of the Seller hereby represent and warrant that they have the power, right and authority to bind Seller. Except as otherwise disclosed in writing by Seller, no person or entity other than Seller is currently occupying the Property or has any lease, rental agreement, or other right to occupy the Property, or portion thereof. In the event the foregoing warranty is breached, the Seller shall indemnify and hold harmless the City for all damages sustained or incurred by the City in connection with the City’s acquisition of that person or entity’s interest in the Property and relocation from the Property. There will be no management agreements, contracts, warranties, guaranties, bonds or other agreements which will affect or will be obligations of the City relating to the Property which cannot be terminated on thirty (30) days prior notice, including without limitation, maintenance contracts, design services contracts, construction contracts, architects agreements, or parking agreements, other than as disclosed to the City pursuant to Section 4 or as specifically approved by the City in writing. (b) Neither the execution of this Agreement nor the consummation of the transaction contemplated hereby shall result in a breach of or constitute a default under any agreement, instrument, or other obligation to which the Seller is a party or by which the Seller or the Property may be bound. Page 53 of 115 6/23/26 | Item D6 | Attachment 1 Purchase and Sale Agreement and Joint Escrow Instructions 5655 Capistrano Ave., Atascadero CA Page 4 (c) There will be no substantial alterations or repairs made or undertaken on the Property (except for those required in an emergency) without the prior written approval of the City which shall not be unreasonably withheld or delayed. As of the Closing Date, there will be no personal property located on the Property excepted as disclosed to and approved by the City. If personal property remains on the Property following the Closing Date, it shall be deemed to belong to the City without further compensation to Seller, and the City may dispose of such personal property in its sole discretion. (d) The Seller has no knowledge of the existence or prior existence in, on or under the Property of any hazardous substance, nor the existence of or prior existence of any above or below ground storage tank. The Seller has no knowledge that any generation, transportation, storage or discharge of any hazardous substance in, on or under the Property has not been in compliance with all applicable laws. Notwithstanding the foregoing, the Seller makes no representations regarding the existence or prior existence of any hazardous substance, or above or below ground storage tanks on the Property. The City acknowledges that the Property may contain lead paint, asbestos, radon gas or other hazardous materials and that the City shall rely on the City’s inspection of the Property when determining if hazardous materials exist on the Property. In the event of any Seller misrepresentation (including omissions) regarding hazardous or toxic materials or conditions on the Property, the Seller shall indemnify, hold harmless, and defend with counsel as reasonably selected by the City, the City, its officers, employees, and agents, any successors to the City’s interests in the chain of title to the Property or any portion thereof, and such successors’ directors, officers, employees, or agents (collectively the "Indemnitees"), against any and all claims, and causes of action arising from any dispute (including, but not limited to, a lawsuit, an administrative proceeding, arbitration, or an enforcement action of any kind) and any and all damages (direct or consequential), costs, losses, injuries, fines, penalties, liens, encumbrances, charges, liabilities, demands, judgments, remedial action requirements, obligations, and all costs and expenses incurred in connection therewith (including, but not limited to, attorneys' fees and costs), imposed upon or accruing against the Indemnitees as a result of investigatory or remedial action required by any public entity or agency having jurisdiction in connection with the hazardous or toxic materials or conditions on the Property that were the subject of the misrepresentation, or as damages to third persons for personal injury or property damage arising from the hazardous or toxic materials or conditions on the Property that were the subject of the misrepresentation. The provisions of this subsection shall survive termination of this Agreement and the Closing. (e) The Seller makes no representations or warranties to the City with respect to the precise property size, zoning, entitlement or compliance with current building codes. (f) The Seller is not a "foreign person" under Section 1445 of the Internal Revenue Code. (g) The Seller is not the subject of bankruptcy, insolvency or probate proceedings. (h) During the term of this Agreement, the Seller shall have a continuing duty to notify the City of any material facts in Seller’s knowledge that would render any of the representations set forth above false or materially misleading. Such duty shall not, however, abrogate nor limit the City’s independent obligation to perform its own investigation into the Property. Section 6. Representations and Warranties of Buyer. City’s obligation to consummate the transaction contemplated by this Agreement, is subject to the satisfaction of or waiver by the City of the following conditions on or prior to Close of Escrow: (i) Seller shall have timely performed all of the obligations required by the terms of this Agreement to be performed by Seller. (ii) All of the representations and warranties made by Seller to the City in this Agreement shall be true and correct as of Close of Escrow. (iii) The willingness of Escrow Holder to issue the Title Policy in accordance with Section 11. (iv) There shall have been no material change with respect to the Property, as reasonably determined by the City, since the Effective Date. (v) The City Council shall have authorized the purchase of the Property. (vi) The City shall have delivered to Escrow sufficient funds to pay the Purchase Price and all other costs payable by the buyer in this transaction. (b) Conditions to Seller’s Obligations. Seller’s obligation to consummate the transaction contemplated by this Agreement, is subject to the satisfaction of or waiver by Seller of the following conditions on or prior to Close of Escrow: (i) The City shall have timely performed all of the obligations required by the terms of this Agreement to be performed by the City. (ii) All of the representations and warranties made by the City to Seller in this Agreement shall be true and correct as of Close of Escrow. (iii) The willingness of Escrow Holder to issue the Title Policy in accordance with Section 11. (c) Failure of Conditions. Both the City and Seller agree to use good faith, reasonable efforts to satisfy each of the foregoing conditions in this Section. If a condition for the benefit of either the City or Seller is not satisfied by the Close of Escrow or earlier individual satisfaction date as set forth in the above conditions, then the party which was to be benefited by the condition may elect to (a) terminate this Agreement or (b) waive the condition. In the event this Agreement is terminated pursuant to this Section 7(c), the Deposit, and any interest earned thereon, shall be immediately refunded to the City. Section 8. "As Is" Sale. The Property shall be transferred to the City "as is." The Seller shall not be liable to the City for any conditions of the Property, except to the extent of Seller’s misrepresentation or failure to disclose. If, prior to the Close of Escrow, the Seller becomes aware that all or any material portion of the Property has been destroyed or substantially damaged, then the Seller shall promptly give the City notice thereof, and the City, at its option, may terminate this Agreement upon written notice Page 55 of 115 6/23/26 | Item D6 | Attachment 1 Purchase and Sale Agreement and Joint Escrow Instructions 5655 Capistrano Ave., Atascadero CA Page 6 to the Seller not later than seven (7) business days after receipt of Seller’s written notice thereof, which notice shall contain an estimate of the repair costs and an estimate of insurance payments to be made to the Seller. For purposes of this Agreement, a “material portion” of the Property shall mean a casualty in excess of one percent (1%) of the Purchase Price of the Property. If this Agreement is terminated, notwithstanding any other provision of this Agreement, the Deposit, if made, including any interest thereon, shall be returned to the City, and no party shall have any further rights or obligations hereunder, except for payment of any escrow and title cancellation fees which shall be borne equally by the Seller and the City and those provisions specified to survive the termination of this Agreement. If the City fails to deliver timely notice of its election to terminate this Agreement, then this Agreement shall remain in full force, without adjustment in the Purchase Price and at the Close of Escrow, the Seller shall assign to the City all of the Seller’s right, title, and interest in and to any insurance proceeds resulting from any casualty. Section 9. Buyer’s Remedies. In the event of a breach of this Agreement by the Seller, including, but not limited to, the Seller’s failure to deliver title to the Property in accordance with Section 10, below, the City may pursue any and all remedies at law and equity, including specific performance. Section 10. Close of Escrow. Subject to the other provisions of this Agreement, Escrow shall close on a date mutually agreeable to the parties but in no event later than 60 days after the Effective Date of this Agreement. Upon Close of Escrow, the Seller shall convey the Property to Buyer by grant deed in form attached hereto as Exhibit B (the "Grant Deed"). The "Closing Date" or "Close of Escrow" hereunder shall be the date that the Grant Deed is recorded with the office of the Recorder of San Luis Obispo County. If, for whatever reason, Seller is unable or unwilling to convey title to the Property to the City, the City shall be entitled to a complete refund of all funds deposited by the City into Escrow and Seller shall be responsible for any escrow and title cancellation fees. Section 11. Condition of Title. At Close of Escrow, the Seller shall deliver insurable title to the Property, free and clear of all liens, encumbrances, clouds and conditions, rights of occupancy or possession except: (a) applicable building, subdivision and zoning laws and regulations; (b) any liens, encumbrances, clouds, conditions, or exceptions arising due in whole or in part to the actions of the City; (c) utility easements and rights of way of record; and (d) any exceptions set forth in the Title Report. As a condition to the Close of Escrow, Escrow Holder shall be committed to issue a ALTA Owner’s Extended Coverage Policy of Title Insurance (the “Title Policy”) to the City in the insurable amount of the Purchase Price and showing only those exceptions to title described in this Section 11. Escrow Holder's willingness to issue the Title Policy, subject to Seller paying the applicable premium, shall be conclusive evidence of Seller's satisfaction of his obligations of the title conditions reflected in this Section 11. Section 12. Costs of Escrow and Closing. The Seller shall pay transfer taxes, if any, the premium for the Title Policy, and all normal closing costs generally attributed to sellers of real property. The City shall pay recording fees and all normal closing costs generally attributed to buyers of real property. The Seller and the City shall evenly pay any escrow costs. The Seller shall maintain the Property prior to the Closing Date in a condition consistent with its current condition and shall make at its own expense, all repairs necessary to maintain the Property in such condition; provided, however, that the Seller shall make no material alterations in the Property without the City’s prior written consent, which shall not be unreasonably withheld. The Seller also agrees that no leases, rental agreements, or other agreement affecting the Property shall be made or entered into prior to the Close of Escrow. Section 14. Broker's Commission. The City represents to the Seller that it has not engaged or used the services of any person, firm or corporation that may claim a broker’s commission or finder’s fee upon execution of Agreement. The Seller represents to the City that he has not been represented by any person, firm or corporation that may claim a broker’s commission or finder’s fee upon execution of Agreement. The Seller and the City (each, reciprocally, as an "Indemnitor") agree to indemnify and hold the other (as "Indemnitee") harmless from all expense, loss, damage and claims, including the Indemnitee’s attorneys’ fees, if necessary, arising out the Indemnitor’s breach of the foregoing representation. Section 15. Notices. All notices required or permitted hereunder shall be in writing. Unless otherwise provided herein, any notice, tender or delivery to be given pursuant to this Agreement by either party may be accomplished by personal delivery, by first class certified mail, return receipt requested, or by delivery via an overnight courier which guarantees next day delivery. Any notice delivered by certified mail, return receipt requested shall be deemed received on the date of delivery reflected on the return receipt. Any notice delivered by overnight shall be deemed received one (1) business day after deposit thereof with the overnight courier. Notices shall be addressed as set forth below, but each party may change its address by written notice in accordance with this Section 15, on not less than ten (10) days prior written notice. Buyer's Cooperation. During the term of this Agreement, the Seller may seek certain governmental permits or other approvals related to the transfer of the Property, if any. The City shall cooperate with Seller to pursue applications, government permits, and related requirements provided that such cooperation shall be at no cost, liability or prejudice to the City. Section 17. Prorations and Adjustments. The Parties shall meet three (3) business days prior to the Close of Escrow, or cause their agents or the Escrow Holder to apportion or prorate, as of 11:59 pm PDT, of the day preceding the Closing Date, the following in respect of the Property and the net amount thereof shall be added to (if such net amount is in Seller’s favor) or deducted from (if such net amount is in the City’s favor) the Purchase Price with respect to the Property: Page 57 of 115 6/23/26 | Item D6 | Attachment 1 Purchase and Sale Agreement and Joint Escrow Instructions 5655 Capistrano Ave., Atascadero CA Page 8 Subject to the specific provisions of this Section 17, all items of income and expense shall be prorated between the Seller and the City as of the Closing Date. Income and expenses shall be prorated on the basis of the actual number of days in the particular month and on the basis of the accrual method of accounting. All such items attributable to the period prior to the Closing Date shall be credited to the Seller; all such items attributable to the period on and following the Closing Date shall be credited to the City. The Seller shall be credited in the Purchase Price with any refundable (or otherwise creditable) deposits or bonds held by any utility, governmental agency or service contractor with respect to the Property, to the extent the same are assigned to the City in connection with the sale of the Property. General and special real estate and personal property taxes and assessments (other than those taxes and assessments required to be paid directly by any tenant under its lease) payable for the tax year in which the Closing Date occurs shall be prorated as of the Closing Date, with Seller responsible for paying such taxes and assessments attributable to the period preceding the Closing Date. As a California general law city, the City is exempt from real property taxation under California Revenue and Taxation Code § 202, and no taxes or assessments shall be due or prorated with respect to the period on or following the Closing Date. Unless otherwise provided in this Section 17, all prorations shall be made on the basis of the actual days in a month and a 365-day year. Section 18. General Provisions. (a) Headings. The title and headings of the various sections hereof are intended as a means of reference and are not intended to place any construction on the provisions hereof. (b) Invalidity. If any provision of this Agreement shall be found by a court of competent jurisdiction to be invalid or unenforceable, the remaining provisions shall not be affected thereby, and every provision hereof shall be valid and enforceable to the fullest extent permitted by law. (c) Attorneys' Fees. In the event of any litigation between the Seller and the City to enforce or interpret any of the provisions of this Agreement, the prevailing party therein shall be entitled to recover from the unsuccessful party all costs and expenses, including reasonable attorneys’ fees, all of which may be included as part of the judgment rendered in such litigation. (d) Entire Agreement. This Agreement supersedes all prior negotiations and agreements between the Parties, and is intended by the Parties as a final expression of their agreement and may not be contradicted by evidence of any prior or contemporaneous agreement. The Parties further intend that this Agreement constitute the final and exclusive statement of its terms and that no extrinsic evidence whatsoever may be introduced in any judicial proceedings involving this Agreement. The Parties have read and reviewed this Agreement and agree that any rule of construction to the effect that ambiguities are to be resolved against the drafting party (including, but not limited to, Civil Code Section 1654, as may be amended from time to time) shall not apply to this Agreement. No provision of this Agreement may be amended except by an agreement in writing signed by the parties hereto or their respective successors in interest. This Agreement shall be governed by and construed in accordance with the laws of the State of California. (e) Successors. This Agreement shall be binding upon and inure to the benefit of the heirs, executors, administrators, successors and assigns of the Parties hereto. (f) Time of the Essence. Time is of the essence in this Agreement. (h) Business Days. The term “business days” in this Agreement shall mean days on which the city offices of the City of Atascadero are open for business. (i) Counterparts: Multiple Originals. This Agreement may be executed in counterparts, and multiple originals, each of which shall be deemed an original but all of which together shall constitute one and the same agreement. Geographically, San Luis Obispo County is one of the larger counties in the state with an area of over 3,000 square miles and roughly 80 miles of Pacific Ocean coastline. Terrain varies from level, interior, small grain and grape growing regions to the 2,500 foot Santa Lucia Mountains. Agriculture, and specifically cattle ranching, has played a major role in the county's economic development since first settled. Grapes and strawberries are the top production crops of county agriculture. Other important economic entities include tourism, education, government, retail, and agriculture. The four largest employers in the county are The County of San Luis Obispo, California Polytechnic State University, Atascadero State Hospital for the Criminally Insane, and the California Men's Colony. Tourist related services have seen substantial growth over the last 30 years, particularly along the coast. Coastal cities such as Pismo Beach, Morro Bay, Cayucos, Cambria, and San Simeon are popular tourist serving communities that attract recreational users and retirement bound individuals alike. Important inland recreation areas include Lake Nacimiento and Lopez Lake. San Luis Obispo County has typically grown at a consistently moderate population growth rate. The county growth rate is expected to remain constant at 1 to 2+/-% annually. This growth can be attributed to the area's lure as a retirement and recreational area as well as its central location between Los Angeles and San Francisco and close proximity to the Central Valley. Major transportation corridors servicing the county include Highway 101 to the north and south, and Highways 46 and 41 to the east. To a lesser degree, Highway 1 is the primary coastal route for the communities of Morro Bay, Cayucos, Cambria and San Simeon and to the scenic Big Sur coastline. The short term outlook for the county appears positive. The county unemployment rate is better than most areas of the state. The county designed a project that will bring Nacimiento Lake water to Paso Robles, Templeton, Atascadero, and San Luis Obispo. Construction began in 2007 and was completed in 2011. Potential constraints on growth include limited water supplies in some communities, high housing costs, and the limited growth of manufactured goods and high paying jobs. The entire county is within Seismic Zone 4 per the Uniform Building Codes due to the San Andreas Fault that runs north/south 50+/- miles east. The county is also within a Nuclear Emergency Response Zone due to the Diablo Canyon Nuclear Power Plant which is located 8+/- miles to the southwest of San Luis Obispo. Neither of these factors have been shown to negatively affect property values. CITY OR TOWN INFORMATION: Atascadero is a suburban community located along Highway 101 in the northern part of San Luis Obispo County. It is located approximately 20 miles north of the City of San Luis Obispo, the county seat, and 18 miles to the east of Morro Bay and the Pacific Ocean via Hwy 41. It’s Spanish name which, loosely translated means "a place of much water," was originally home to the Salinas Indians. In the half century between 1769 and 1823 the Spanish Franciscans established 21 missions along the California coast, including the nearby Mission's San Miguel Arcangel, and San Luis Obispo de Tolosa. In 1821, Mexico won its independence from Spain, and California became a Mexican province. The settling of Atascadero began with the Franciscan clergy who managed the 60,000 acre Rancho Asuncion until 1833, when the Mexican government secularized the mission lands. Governor Rio Pico then granted Pedro Estrada nearly 40,000 acres, part of which would eventually be a portion of the 23,000 acre Rancho Atascadero. Ownership of 61,000 acres was held, at one time, by Patrick Washington Murphy. Eventually, J.H. Henry became the owner of the Atascadero Ranch. The community of Atascadero was founded in 1913 as a utopian, planned colony by Edward Gardner Lewis, a successful magazine publisher from the East. He had previously created such a community at University City, Missouri. When he saw the Atascadero Ranch in 1912, Lewis put together a group of investors from across the country, paid J.H. Henry $37.50 an acre, and celebrated acquisition of the Rancho on July 4, 1913. In 1913 Edward Gardner Lewis purchased a large piece of land situated 20 miles north of San Luis Obispo and 10 miles south of Paso Robles in order to build a planned utopian colony. This land had previously been home to the Franciscans, and before that, to the Salinas Indians. In 1914 the land was surveyed and subdivided. Thousands of acres of orchards were planted, a water system was installed and construction began on an 18 mile road (Highway 41 West) through the rugged Santa Lucia Mountains to the ocean, where Lewis built cottages and a beach front hotel called the Cloisters. Edward Gardner Lewis and his group of investors lived in tents while they developed the planned colony. In 1979 Atascadero was incorporated. According to public information, the City now has a population of approximately 28,438, and is the third largest city in San Luis Obispo County. San Luis Obispo to the south and Paso Robles to the north via Hwy 101 offer regional shopping. The City's business district spans the incorporated length of El Camino Real and offers typical local amenities such as shopping, schools and libraries. Twin Cities Hospital and the clinics associated with it are located 4+/- miles north of the City limits. Parcels range in size from 6,000 Sq. Ft. to 10+ acres with city water, sewer and natural gas being typical for the neighborhood but wells, septic, and propane are not unusual. Schools are within the Atascadero Unified School District, which includes eight elementary schools, one junior high school, one comprehensive high school, one continuation school, one alternative school (K-12), the Fine Arts Academy, independent studies and home schooling opportunity classes. The top ten employers for the City of Atascadero employ between 2,100 and 87 workers, with the top three employers being Atascadero State Hospital, Atascadero Unified School District, and Home Depot. Self-employed workers are a significant portion in the breakdown of the workforce in Atascadero. This zone is intended for higher density residential development, including apartments, condominiums, and townhouses, where higher density housing is desired within the urban services line. Highest and best use of site is for development of (three single family homes on three separate 8,100+/- Sq Ft. lots each) or as many units as allowable SB684 also known as the "Starter Homes Act," is a California law that streamlines the approval process for small residential development projects with 10 or fewer units on qualifying lots in multifamily zones and vacant lots in single-family zones. It aims to increase housing supply and affordability by expediting the development of smaller-scale projects. ) GENERAL COMMENTS REGARDING THE APPROACHES TO VALUE: The appraiser has three methods of analysis, namely, the Cost, Market or Comparative Sales, and the Income Approaches. Each method may be more or less appropriate for the valuation problem due to the availability of data, buyer's motivation or expectation, nature of the appraisal assignment, or inherent nature of the subject property. A brief description of each method follows. Cost Approach: This is a summation method wherein the existing improvements are surveyed as to quality and quantity, expensed at a reproduction or replacement cost new, less any accrued depreciation, and then summed with the vacant site value. The cost approach has the greatest validity when the improvements are new, the site is properly developed to its highest and best use, and building costs and site values are readily known. This method assumes ability to develop a substitute property with similar amenities as the subject and within a reasonable development time. In today's market, costs are increasing due to government user-developer fees which are not reflected in cost manuals such as Marshall and Swift. Site values and development times are also difficult to determine during times of economic change and especially in areas having water shortages or building moratoriums. In addition, in older properties, depreciation becomes more difficult to estimate. These combined factors weaken the reliability of the cost approach as an indicator of value. Market or Sales Comparison Approach: This is a comparative sales analysis wherein sales of similar properties are located and then examined as to the differences existing at the time of sale between the comparable sale and the subject. When properties of similar style, neighborhood, and amenities as the subject are recently sold, the appraiser can obtain strong evidence of the most probable selling price of the subject. A grid is often utilized in order to adjust each sale on a percentage or lump sum basis so that the resulting modified sales price of each sale becomes a potential value of the subject. Other methods of analysis involve calculation of so called unit indicators. For example, the sales price could be expressed as price paid per square foot. Unit indicators can be useful in displaying a pattern not readily apparent to the analyst at first glance. This is the most preferred method of analysis due to ease of comprehension and ready acceptance by the courts, particularly when good comparative sales are available in sufficient quantity and require minimal adjustments. When this method is emphasized in the final decision of value, a reasonable exposure time, in the appraiser's opinion, will be developed and stated in this report. Lack of good comparable sales weaken this approach. If this is the case, the appraiser will usually give more weight to the cost approach in the final decision process. Income Approach: This approach is only applicable to the valuation of income producing properties. Income properties are usually purchased for the right to receive future benefits in the form of cash flow or required return on the capital outlay. In this approach, the appraiser is trying to imitate the rationale of the prudent investor/buyer. In this area, single family houses are generally not purchased for rental, or with pure investment motives in mind, therefore the income approach is not used. GLOSSARY OF TERMS APPRAISAL:An unbiased estimate of the nature, quality, value or utility of and interest in, or aspect of, identified real estate and personal property. The highest and best use of a property as improved refers to the optimal use that could be made of the property including all existing structures. DISCUSSION: BACKGROUND Currently the City of Atascadero regulates sidewalk vendors as “Mobile Eating and Drinking Vendors” under AMC § 9-3.500. That phrase is defined as follows: Any vehicle, wagon, or pushcart that is self-propelled or can be pushed/pulled down a street or sidewalk, on which food is displayed, prepared, or processed for the purpose of selling food or drinks to a consumer. Under Table 3-2, mobile eating and drinking vendors are permitted in some non-residential zones as allowed uses. Footnote 6 to Table 3-2 states: Mobile food vending permitted on private property with owner's permission and City review of parking and access on site. Mobile food trucks used as part of an event may be permitted in the right-of-way with the issuance of an Event Permit. Other than the zones set forth in Table 3-2, there are currently no regulations imposed on mobile eating and drinking vendors. In January 2019, Senate Bill 946 (Government Code Sections 51036-51039) went into effect and established statewide governance of vending in public parks and rights-of-way, limiting cities in Page 90 of 115 6/23/26 | Item G1 | Staff Report their regulation of sidewalk vending unless a city adopts specific regulations “directly related to objective health, safety and welfare concerns.” Violations of these regulations are only punishable by administrative fines, not as infractions or misdemeanors. Under SB 946, the Legislature requires local jurisdictions to both support and properly regulate sidewalk vendors. The stated intent of the legislation is to create entrepreneurial and economic development opportunities for immigrant and low-income communities. The Legislature found: 1. Sidewalk vending increases access to desired goods, such as culturally significant food and merchandise; 2. Sidewalk vending contributes to safe and dynamic public spaces; and 3. The safety and welfare of the public is promoted by encouraging local authorities to support and properly regulate sidewalk vending and decriminalizing sidewalk vending. SB 946 defines a sidewalk vendor as “a person who sells food or merchandise from a pushcart, stand, display, pedal-driven cart, wagon, showcase, rack, or other nonmotorized conveyance, or from one’s person, upon a public sidewalk or other pedestrian path.” A sidewalk vendor may be stationary or roaming. Effective January 1, 2023, Senate Bill 972 amends certain Health and Safety Code provisions applicable to some sidewalk vendors who prepare food. Under the amended code, compact mobile food operations are not required to obtain a health department permit from the County if they have “25 square feet or less of display area from which only prepackaged non-potentially hazardous food and whole uncooked produce is sold.” Effective January 1, 2026, Senate Bill 635 adds significant vendor privacy and data protection requirements that supersede conflicting local ordinances. Key provisions of an SB 635-compliant ordinance include: • Cities are prohibited from collecting criminal history, background information, immigration status, or requiring fingerprints or LiveScan as part of a sidewalk vending permit or business license application; • Cities may not share vendor personally identifiable information (PII) with federal law enforcement or immigration enforcement agencies; • Any ordinance or permit program that previously required fingerprinting or background checks must be amended by January 1, 2026, and any such records collected prior to that date must be destroyed by March 1, 2026; and • If enforcement is contracted to a nonpublic entity, the contract must require that entity to comply with SB 635's provisions. Cities adopting a new ordinance after January 1, 2026 must incorporate SB 635 compliance from the outset. Any new ordinance should expressly prohibit collection of PII for immigration Page 91 of 115 6/23/26 | Item G1 | Staff Report enforcement purposes. To meet the mandated regulations as defined by Government Code Sections 53036-53039, the City must amend its current regulations. The City has experienced very few issues with sidewalk vendors since SB 946 went into effect. However, staff has seen an increased interest in street vending in recent months. As such, staff requests direction from the Council on areas of permissible regulation under SB 946. To highlight some of the matters on which the Council may wish to have more detailed discussion, ordinances from Solvang and Pismo Beach are attached as examples of two cities which have approached regulation of sidewalk vendors slightly differently. Both ordinances reflect similar baseline regulations derived from the permissible areas of regulation under SB 946. The two cities differ somewhat, however, in the administrative structure, penalty specificity, privacy protections, and geographic restrictions tailored to each city's unique situation. Solvang's ordinance (Chapter 4-4) was most recently amended April 27, 2026, and reflects updated SB 635 compliance language, including explicit personally identifiable information (PII) protections. Pismo Beach's ordinance (Chapter 12.22), adopted in 2020, predates SB 635 and would require updating to comply with SB 635. Under Government Code Section 51038(c)(1): A local authority may, by ordinance or resolution, adopt additional requirements regulating the time, place, and manner of sidewalk vending if the requirements are directly related to objective health, safety, or welfare concerns…. Among the permissible requirements are limitations on hours of operation that are not unduly restrictive, and requirements to maintain sanitary conditions. Both Pismo Beach and Solvang have limited the number of permits issued city-wide, and both cities have also restricted locations for vending based on objective health, safety and welfare concerns. For example, both cities cap stationary vendor permits in parks at five concurrent permits. However, the overall restriction on the number of permits must be directly related to objective health, safety, or welfare concerns. Pismo Beach also distinguishes between food sales and merchandise sales, allowing up to five permits for each category. Pismo Beach also excludes its Pier Zone from any stationary vending due to pre-existing exclusive concession agreements. Solvang prohibits all sidewalk vending in its central business district, citing extreme congestion and pedestrian safety concerns, which is a permissible restriction under SB 946, if supported by objective health, safety or welfare findings. This is among the most restrictive approaches a city may take. Pismo Beach, by contrast, identifies specific street segments where vending is prohibited by name and block range, allowing vending to continue in other downtown areas. Solvang requires vendors to sign an explicit indemnification and release of liability as a permit condition and requires an acknowledgement that sidewalk use is at the vendor's own risk. This provides additional protection to the city against personal injury claims arising from vending activities. Pismo Beach's ordinance relies on the insurance requirement for this protection without a separate waiver. Regardless of the options selected above, any SB 946-compliant ordinance should include all of the following: • A permitting process that accepts state- or locally-issued identification in lieu of a Social Security Number, where the vendor provides the name and current mailing address of the sidewalk vendor, a description of the merchandise offered for sale or exchange, a certification by the vendor that to their knowledge and belief, the information contained on the form is true, and if the sidewalk vendor is an agent of an individual, company, partnership, or corporation, the name and business address of the principal. • Requirements necessary to ensure compliance with Americans with Disabilities Act and other disability access standards; • Requiring the sidewalk vendor to possess a valid California Department of Tax and Fee Administration seller’s permit and City business license; • Violations punishable only by administrative fines, not as infractions or misdemeanors; • An appeal process for permit denials and revocations; • Prohibition within the immediate vicinity of a permitted certified farmers' market or swap meet during operating hours, or within the immediate vicinity of an area designated for temporary special events under permit from the City; • Food vendor health permit requirements consistent with applicable County of San Luis Obispo health authority standards, unless the vendor has 25 square feet or less of display area and sells only prepackaged, non-potentially hazardous food or whole uncooked produce; • Trash and cleanup responsibilities; • Prohibition on leaving carts unattended; • Safety buffers from intersections, fire hydrants, driveways, transit stops, and signalized intersections; • Permitted operating hours; • Prohibition on stationary vending in residential zones; and • Full SB 635 compliance: no collection of criminal history, background checks, fingerprints, or immigration status; PII protection from disclosure. ENVIRONMENTAL REVIEW Adoption of a sidewalk vending regulatory ordinance is categorically exempt from environmental review under the California Environmental Quality Act (CEQA) as an organizational or administrative activity of government that will not result in direct or indirect physical changes in the environment. (CEQA Guidelines Section 15378(b)(5).) ALTERNATIVES: 1. Request more information from staff regarding similar sidewalk vending ordinances in other cities 2. Decline to proceed with sidewalk vending regulatory ordinance, leaving current regulations in place. This option is not recommended, as the current zoning provisions regulating sidewalk vending should be updated to conform to SB 946/635. FISCAL IMPACT: The fiscal impact for drafting the final ordinance is expected to be within the current budget for legal services. Administrative costs for regulating the sidewalk vending program should be limited by the number of permits obtained, and enforcement costs will depend on any non-permitted sidewalk vendors. The city council hereby finds that, to promote the health, safety and welfare, restrictions on sidewalk vending are necessary in part to. Provide reasonable access for sidewalk vending activities in portions of the city while preserving the use and maintenance of parks, sidewalks, pathways, poles, posts, traffic signs or signals, hydrants, restrooms, trash receptacles, firefighting apparatus, mailboxes, public benches and/or planters, as well as access to locations used for public transportation services. Ensure no interference with pedestrian or vehicular traffic including ingress into, or egress from, any residence, public building, or place of business, or from the street to the sidewalk, by persons exiting or entering parked or standing vehicles. Ensure no interference with barriers designed to stop vehicles and prevent injury to people. Ensure no interference with the performance of public safety officers including police, firefighters, lifeguards, and emergency medical services personnel. Reduce exposure to the city for personal injury or property damage claims and litigation. Prevent unsanitary conditions and ensure trash and debris in the areas vending is taking place are removed by sidewalk vendors. Ensure that visibility, sight lines, and accessibility for vehicular and pedestrian traffic on sidewalks and other rights of way are protected while accommodating sidewalk vendor equipment. Ensure that proper social distancing can be maintained as much as possible on sidewalks and other pedestrian paths in accordance with the county of Santa Barbara public health department guidelines. Mitigate the impacts of sidewalk vending activity and protect the unique characteristics of the city by maximizing public access to parks and other recreational spaces in the city. The city council hereby finds that the unique characteristics of the city require certain restrictions on sidewalk vending activities as follows. The city council finds that congestion is extreme in the central business district, on public streets, public sidewalks and parkways and that the existence in the city of sidewalk vendors seek to and do draw patrons to their food and merchandise. This can create serious safety problems by impacting the ability of pedestrians to move safety on sidewalks and through crosswalks and impeding the response time of safety personnel, particularly in the central business district, in city parks and in residential areas. Sidewalk vendors can also impact access to and egress from businesses. This chapter imposes reasonable time, place, and matter restrictions on sidewalk vendors to the extent necessary to ensure the safety of sidewalk vendors, their patrons, the general public and to prevent unreasonable interference with residents' enjoyment of peace and quiet in the city. City parks provide passive and active recreational opportunities, and restrictions on sidewalk vending activity are necessary to safeguard access to and to protect the natural resources, recreational and sport opportunities and scenic and natural character of these parks. The city council finds that many of the sidewalk areas of the city are narrow and that unregulated and uncontrolled sidewalk vending affects the health, safety and welfare of the city by unreasonably interfering with the flow of pedestrians and disrupting access for persons with disabilities. Central Business District.Central business district shall be as defined in section 8-3-1. Fixed Place of Business.A fixed business place, location, building, room, stand or enclosure separate and distinct from any other business, in which goods, wares, merchandise, fruit or vegetables are kept, displayed or offered for sale to the public, regularly kept open with an agent in exclusive attendance for at least six hours per day, for at least five days per week. Person.Any person, firm, corporation, association, club, society, or other organization. Personally Identifiable Information.An individual's name, business name, home address, business address, birthdate, telephone number, business location, California driver's license or identification number, individual taxpayer identification number, municipal identification number, government-issued identification number, consular identification, social media identifiers, employer identification number, business license number, seller's permit number, social security number, vending registration certificate or license number, known place of work, income and tax information, and any other information that would identify the individual. Roaming Sidewalk Vendor.A sidewalk vendor who moves from place to place and stops only to complete a transaction. Selling or Sales.Wherever these terms are used herein, "buying" and "purchasing" shall be deemed included. Sidewalk Vending Activity.The sale of food, good, wares or merchandise, or solicitation of orders for the sale of goods, wares or merchandise to be delivered at some future time or date, upon a public sidewalk or other public pedestrian path or on a public street, including any adjacent parking spaces, from a pushcart, stand, display, pedal-driven cart, wagon, showcase, rack, or other non-motorized conveyance, from one's person, or from a motor vehicle as defined in the California Vehicle Code. Notwithstanding the foregoing, sidewalk vending activity includes going upon the premises of any private residence in the city, not having been requested or invited by the owner or occupant thereof, for the purpose of taking offering for sale or for soliciting orders for future delivery of goods, wares, merchandise, or personal property of any nature, or for services to be performed in the future. A sidewalk vendor does not include a merchant (including any employees thereof) having a fixed place of business within the city engaging in sales or solicitations of food, goods, wares or merchandise after a prior approval, either oral or written, from the vendee. Stationary Sidewalk Vendor.A sidewalk vendor who engages in sidewalk vending activity from a fixed location. (Ord. 09-281, 2009; Ord. 21-0348 § 2; Ord. 26-0394, 4/27/2026) § 4-4-3. Sidewalk vendor permit required. No person, either for themselves or any other person, shall engage in any sidewalk vending activities within the City without first applying for and receiving a sidewalk vendor permit from the City Manager or the City Manager's designee. Hereinafter in this chapter, references to the City Manager shall include the City Manager's designee. Each person who desires to engage in any sidewalk vending activity in the City shall file with the City Manager a sworn permit application on a form furnished by the City. The applicant shall provide the following information. Name and description. Permanent home address and local address. An address where the applicant consents to receive service of process. Acceptable addresses for this purpose shall include a post office box or private mailbox that complies with Business and Professions Code Section 17538.5. If employed, the name and address of the employer, together with credentials establishing that relationship. A brief description of the nature of the business and the goods to be sold. If the applicant does not hold a valid identification card issued by Santa Barbara County Tax Collector or Santa Barbara County Sheriff's Department, the City Manager shall furnish the applicant with the necessary information to obtain such an identification card. A California Department of Tax and Fee Administration seller's permit. A valid business license issued pursuant to Chapter 4-9 of this code. Proof of insurance with policy limits not less than $1,000,000 per occurrence and $2,000,000 aggregate, where the City has been named as an additional insured on the applicant's insurance policy. A signed waiver of release and indemnification on a form acceptable to the City consistent with the requirements of subsection C of this section. Indemnification and Waiver. As a condition of issuance of a permit pursuant to this chapter, the applicant shall: Agree to waive and release the City and its officers, agents, employees, contractors and volunteers from and against any and all claims, costs, liabilities, expenses, or judgments including attorneys' fees and court costs arising out of any sidewalk vending activities or any illness or injury resulting therefrom; Agree to indemnify and hold harmless the City, its officers, agents, employees, contractors, and volunteers from and against any and all claims, costs, liabilities, expenses, or judgments including attorneys' fees and court costs arising out of any sidewalk vending activities or any illness or injury resulting therefrom, whether caused by negligence or otherwise, except for illness and injury resulting directly and solely from the gross negligence or willful misconduct on the part of the City, its officers, agents, employees, contractors and volunteers; and Acknowledge that the use of any sidewalk is at the applicant's own risk and the City will not take any steps to ensure any sidewalk is safe or conducive to the sidewalk vending activities. A. processing of an application pursuant to this chapter in such amount as established by resolution of the City Council. Nontransferable. A sidewalk vendor permit is nontransferable and any change in ownership or operation of the business of a sidewalk vendor requires a new permit. Term. A sidewalk vendor permit shall be valid for the time period specified in the application or for 12 months from the date of issuance, whichever is shorter. A sidewalk vendor permit shall expire and become null and void after expiration of the period specified in the application, or on the anniversary of its issuance, whichever is shorter. Notwithstanding the foregoing, no sidewalk vendor permit shall be valid after the expiration date appearing on the Santa Barbara County identification card provided in the application for such sidewalk vendor permit. Provided such renewal is consistent with Sections 4-4-6 and 4-4-7 of this code, a permit holder may renew the permit by filing an application for renewal and meeting all of the requirements as prescribed in this section. Such application shall be submitted prior to expiration of the current sidewalk vendor permit. Disclosure. The City shall not disclose or provide in writing, verbally, or in any other manner, personally identifiable information of any sidewalk vendor obtained pursuant to this chapter that is requested, except pursuant to a subpoena or a valid judicial warrant. Any personally identifiable information collected by the City pursuant to this chapter shall be exempt from disclosure under the California Public Records Act (Division 10 (commencing with Section 7920.000) of Title of the Government Code). Solicits orders from retail dealers on behalf of a wholesaler, jobber or manufacturer; Solicits for a bona fide political or religious purpose; Is a resident of the city under 18 years of age. (Ord. 09-281, 2009; Ord. 21-0348 § 2) § 4-4-5. Issuance of permit. The city manager may issue the sidewalk vendor permit if the city manager finds based on all of the relevant information that. The conduct of the sidewalk vendor will not unduly interfere with traffic or pedestrian movement, or interfere with or endanger the public health, safety or general welfare. The conduct of the sidewalk vendor will not unduly interfere with normal governmental or city operations, threaten to result in damage or detriment to public property, or result in the city incurring costs or expenditures in either money or personnel not reimbursed in advance by the sidewalk vendor. The conduct of such sidewalk vending activity will not constitute a fire hazard. The sidewalk vendor has paid all previous administrative fines and completed any other alternative disposition associated in any way with a previous violation of this chapter. The sidewalk vendor has not had a permit revoked within the past 12 months. The sidewalk vendor application contains all required information and the sidewalk vendor has not made a materially false, misleading or fraudulent statement of fact to the city in the application process. The sidewalk vendor has obtained a business license pursuant to title 4, chapter 9 of this code. The sidewalk vendor has obtained a valid California Department of Tax and Fee Administration seller's permit. The sidewalk vendor has provided adequate insurance as determined by the city Attorney to protect the city from liability associated with sidewalk vending activities, with policy limits not less than one million dollars ($1,000,000.00) per occurrence and two million dollars 6/23/26 | Item G1 | Attachment 1 Page 101 of 115 B. C. D. A. B. C. D. ($2,000,000.00) aggregate, where the city has been named as an additional insured on the sidewalk vendor's insurance policy. To prevent an undue concentration of commercial activity that unreasonably interferes with the scenic and natural character of the city's parks, the city manager shall authorize no more than five concurrent sidewalk vendor permits for stationary sidewalk vendors in the city's parks. This restriction shall not apply roaming sidewalk vendors. To ensure the public's use and enjoyment of the city's public spaces and to prevent an undue concentration of activities in public sidewalks or other public pedestrian paths, and to ensure adequate social distancing during such times as public health orders are in effect recommending such social distancing, no sidewalk vendor permit shall be issued for sidewalk vending activities in the central business district. To ensure the availability of sufficient sidewalk vendor permits for small businesses for whom sidewalk vending is a primary occupation, any person or entity that maintains a fixed place of business within the city shall be ineligible to apply for a sidewalk vendor permit under this chapter. (Ord. 09-281, 2009; Ord. 21-0348 § 2) § 4-4-6. Denial of sidewalk vendor permit— Appeal of denial. Denial. If the city manager finds that the requirements set forth in section 4-4-5, as applicable, have not been met, the city manager shall deny the application for the sidewalk vendor permit. The decision is final 10 days from the date the notice of denial is served in conformance with this section. Notice of Denial. The city manager shall provide written notice of such denial within 15 days after the application is filed, specifying the ground or grounds of such denial. Notice of denial of the application for the sidewalk vendor permit shall be deemed to have been served upon the date it is personally served on the applicant or when deposited in the United States mail with postage prepaid and addressed to the applicant at the applicant's residence as set forth in the application for the sidewalk vendor permit. No person whose permit is finally denied shall be eligible to apply for a new sidewalk vendor permit for a period of one year following such final denial. Appeal. A. appeal the decision pursuant to the provisions of title 1, chapter 6 of this code. (Ord. 21-0348 § 2) § 4-4-7. Revocation of permit—Appeal of revocation. The City Manager may revoke a sidewalk vendor permit for good cause, including, but not necessarily limited to, any of the following reasons. Falsification of any information supplied by the sidewalk vendor upon which issuance of the sidewalk vendor permit was based; Fraud, misrepresentation or false statement made in the course of engaging in sidewalk vending activities; Failure of the permittee, or any employees or subcontractors of the permittee, to comply with the regulations set forth in this chapter. The revocation takes effect three days after the city manager mails notice of revocation to the applicant or upon personal delivery, whichever first occurs. No sidewalk vendor whose permit is revoked shall be eligible to apply for a new permit for a period of one year following such revocation. Appeal. A person aggrieved by the decision of the City Manager in revoking a registration permit may appeal the decision pursuant to the provisions of Chapter 1-6 of this code. During the pendency of the appeal, the permit is suspended and the sidewalk vendor shall not conduct any sidewalk vending activities in the City. (Ord. 21-0348 § 2; Ord. 26-0394, 4/27/2026) § 4-4-8. Operating conditions. Every sidewalk vendor is subject to the following operating conditions when conducting sidewalk vending activities. All food, good, wares and merchandise shall be stored either inside or affixed to the sidewalk vendor's motor vehicle, pushcart, stand, display, pedal-driven cart, wagon, showcase, rack, or other non-motorized conveyance, or carried by the sidewalk vendor. Food, goods, wares and merchandise shall not be stored, placed, or kept on any public property. If affixed to the motor vehicle, pushcart, stand, display, pedal-driven cart, 6/23/26 | Item G1 | Attachment 1 Page 103 of 115 B. C. D. E. F. G. H. I. J. K. wagon, showcase, rack, or other non-motorized conveyance, the overall space taken up by the cart shall not exceed the size requirements provided in this section. Sidewalk vendors may only sell food and/or merchandise. Sidewalk vendors shall not sell or provide services. Each sidewalk vendor shall conspicuously display the identification card issued by the Santa Barbara County tax collector and the business license, if any, required by this code, at all times while engaged in sidewalk vending activities. Each sidewalk vendor shall carry and display in a conspicuous place the sidewalk vendor permit issued pursuant to this chapter at all times while engaged in sidewalk vending activities. All signage and advertising related in any way to the sidewalk vendor shall comply with the city's sign laws. For purposes of verification of compliance with this chapter, all sidewalk vendors shall allow a police officer, firefighter, code enforcement officer, health inspector, or other government official charged with enforcing laws related to sidewalk vending activities, at any time to inspect the sidewalk vendor's pushcart, stand, display, pedal-driven cart, wagon, showcase, rack, or other non-motorized conveyance, the sidewalk vendor's person, or motor vehicle (as defined in the California Vehicle Code). Any a pushcart, stand, display, pedal-driven cart, wagon, showcase, rack, or other nonmotorized conveyance used for sidewalk vending activities on a public sidewalk or other pedestrian path shall not exceed a total height of four feet, a total width of four feet, and a total length of four feet. No cart shall contain or use propane, natural gas, gasoline or other explosive or hazardous materials. No cart shall use electrical power furnished by a generator using any of these substances. Sidewalk vendors selling food shall have in their possession at all times they are conducting sidewalk vending activities, all applicable food vending licenses and permits issued by the county of Santa Barbara or other regulatory agency. All sidewalk vendors shall provide a trash receptacle readily accessible to persons making purchases from such sidewalk vendor and shall deposit or cause to be deposited therein, all liter and garbage in the immediate vicinity of the place of sale resulting from any sidewalk vending activities. A. removing, and disposing of all trash or refuse from their operation. Sidewalk vendors shall immediately clean up any food, grease or other fluid or item related to sidewalk vending activities that falls on public property. Sidewalk vendors shall ensure that all required insurance is in effect prior to conducting any sidewalk vending activities and maintained for the duration of the permit. Sidewalk vendors shall not leave their pushcart, stand, display, pedal- driven cart, wagon, showcase, rack, or other non-motorized conveyance or motor vehicle (as defined in the California Vehicle Code) unattended. Any pushcart, stand, display, pedal-driven cart, wagon, showcase, rack, or other nonmotorized conveyance or motor vehicle used by a sidewalk vendor shall not touch, lean against or be affixed at any time to any building or structure including, but not limited to, lampposts, parking meters, mailboxes, traffic signals, fire hydrants, benches, bus shelters, newsstands, trashcans or traffic barriers. (Ord. 21-0348 § 2) § 4-4-9. Prohibited activities and locations. Sidewalk vendors shall not engage in any of the following activities. Renting merchandise to customers. Displaying merchandise or food not available for immediate sale. Selling of alcohol, cannabis, adult oriented material, weapons, tobacco products, products that contain nicotine or any product used to smoke/vape nicotine or cannabis. Using an open flame on or within any cart. Using an electrical outlet or power source that is owned by the city, or by any other person or entity without the permission of such person or entity. Conducting sidewalk vending activities anywhere in the city between the hours of eight (8:00) p.m. on one day and seven (7:00) a.m. the next day, unless businesses in nonresidential zones on the same street are permitted to remain open during those hours, in which case sidewalk vending activities shall be conducted no later than the closing hour for such business, nor earlier than the opening hour for such business. 6/23/26 | Item G1 | Attachment 1 Page 105 of 115 7. 8. 1. a. b. c. d. 2. 3. 4. 5. 6. 7. 8. 9. B. Providing or selling any service to any person. Conducting sidewalk vending activities on private property without first obtaining written permission from the property owner or person having control of said property. Any such written permission must be in the possession of the sidewalk vendor at all times while engaging in sidewalk vending activities on private property. Sidewalk vendors shall not engage in sidewalk vending activities in any of the following locations. On any street or any city property that does not meet the definition of a sidewalk under California Vehicle Code section 555 or is not a pedestrian path. Due to the narrow width of sidewalks and pedestrian paths, to ensure adequate social distancing during such times as public health orders are in effect recommending such social distancing, and to ensure compliance with the Federal Americans with Disabilities Act of 1990 and other disability access standards, on sidewalks bordering the following streets or sidewalks or pedestrian paths bordering or crossing the following parks: The central business district. Solvang Park. Copenhagen Drive. Mission Drive. For stationary sidewalk vendors, in any residential zone in the city. Within a 500 foot radius of a permitted certified farmers' market during the limited operating hours of that certified farmers' market. Within a 500 foot radius of an area designated for a temporary permit issued by the city pursuant to section 8-3-5(B) during the limited duration of the temporary permit. Within fifty feet (50) of any street intersection. Within 15 feet of any fire hydrant, or other emergency response equipment or facility. Within 25 feet of any driveway or driveway apron. Upon an outdoor area that is unpaved or unimproved (i.e., is not made from concrete, asphalt, or similar material). Within 250 feet of any property on which a school building or facility is located during the following times: An hour before school is in session; and An hour before and an hour after school dismissal. Within 250 feet of any public picnic area, playground area, or playground equipment. Within 100 feet of any signalized intersections or in any manner that blocks traffic signal equipment and cabinets. In any place where such sidewalk vending activities will create a traffic hazard or other safety hazard. In any area for which the city has entered into an exclusive agreement for vending of food, goods, wares or merchandise. In any area where the owner, occupant, or person legally in charge of the premises has posted, at the entry to the premises, or at the entry to the principal building on said premises, a non-illuminated flat sign of not more than one square foot bearing the words "No Solicitors," or words of similar import. (Ord. 09-281, 2009; Ord. 21-0348 § 2) § 4-4-10. Penalty for violation—Citation appeals. Penalty for Violation. Violations of this chapter shall not be prosecuted as infractions or misdemeanors under title 1, chapter 3 and shall only be subject to administrative citations pursuant to title 6, chapter 5, article A. Citation Appeals. Administrative citations for violations of this chapter may be appealed pursuant to Title 6, Chapter 5, Article A. (Ord. 09-281, 2009; Ord. 21-0348 § 2) 6/23/26 | Item G1 | Attachment 1 Page 107 of 115 Chapter 12.22 SIDEWALK VENDING 12.22.010 Purpose. The purpose of this chapter is to establish a sidewalk vendor permitting and regulatory program. The provisions of this chapter allow the city to encourage small business activities by removing total prohibitions on sidewalk vending and providing regulation and enforcement of unpermitted sidewalk vending activities to protect the public health, safety, and welfare. A. The City Council hereby finds that, to promote the health, safety, and welfare, restrictions on sidewalk vending are necessary in part to: 1. Provide reasonable access for sidewalk vending activities in portions of the city while preserving the use and maintenance of parks, sidewalks, pathways, poles, posts, traffic signs or signals, hydrants, restrooms, trash receptacles, firefighting apparatus, mailboxes, public benches and/or planters, as well as access to locations used for public transportation services. 2. Ensure no interference with pedestrian or vehicular traffic including ingress into, or egress from, any residence, public building, or place of business, or from the street to the sidewalk, by persons exiting or entering parked or standing vehicles. 3. Ensure no interference with barriers designed to stop vehicles and prevent injury to people. 4. Ensure no interference with the performance of public safety officers including police, firefighters, lifeguards, and emergency medical services personnel. 5. Reduce exposure to the city for personal injury or property damage claims and litigation. 6. Ensure the safe sale of food and merchandise in the public right-of-way, by providing the public a simple way to ensure sidewalk vendors prepare food safely and according to San Luis Obispo County Department of Public Health requirements. 7. Prevent unsanitary conditions and ensure trash and debris in the areas vending is taking place are removed by sidewalk vendors. 8. Ensure that visibility, sight lines, and accessibility for vehicular and pedestrian traffic on sidewalks and other rights-of-way are protected while accommodating sidewalk vendor equipment. 9. Mitigate the impacts of sidewalk vending activity and protect the unique characteristics of the city by maximizing public access to and along the coast. B. The City Council hereby finds that the unique characteristics of the city require certain restrictions on sidewalk vending activities as follows: 1. The City Council finds that the existence in the city of sidewalk vendors seeks to and does draw patrons to their food and merchandise. This can create serious safety problems by impacting the ability of pedestrians to move safely on sidewalks and through crosswalks and impeding the response time of safety personnel, particularly in downtown Pismo Beach, at the 6/23/26 | Item G1 | Attachment 2 Page 108 of 115 beach, in city parks, and in residential areas. Sidewalk vendors can also impact access to and egress from businesses. This chapter imposes reasonable time, place, and manner restrictions on sidewalk vendors to the extent necessary to ensure the safety of sidewalk vendors, their patrons, the general public and to prevent unreasonable interference with residents' enjoyment of peace and quiet in the city. 2. City parks provide passive and active recreational opportunities, and restrictions on sidewalk vending activity are necessary to safeguard coastal access, and to protect the natural resources, recreational and sport opportunities, and scenic and natural character of these parks. 3. The city seeks to preserve the peace and quiet of the residential zones of the city, by prohibiting commercial activities such as sidewalk vendors. Many of the sidewalks and pathways in the city are less than eight (8) feet wide, and sidewalk vending activity in these areas would unreasonably interfere with the flow of pedestrians and disrupt access for persons with disabilities. (Ord. O-2020-005 § 2 (part), 2020) 12.22.020 Sidewalk vendor permit required. A. No person, either for themselves or any other person, shall engage in any sidewalk vendor activities within the city without first applying for and receiving a sidewalk vendor permit from the Administrative Services Department. B. A written application for a sidewalk vendor permit shall be filed with the Administrative Services Department on a form provided by the city. Such application shall be accompanied by a nonrefundable application fee in such amount as established by resolution of the City Council. Until such time as the City Council amends its fee schedule to provide for this fee, the combined business license fee and sidewalk vendor permit shall be $100, in addition to the business license application fee and SB 1186 fee. A permit shall be valid for the business license year from October 1st through September 30th of each year, and shall expire and become null and void on the anniversary of its issuance. A person may apply for a permit renewal on a form provided by the city prior to the expiration of their active permit and corresponding business license. Sidewalk vendor permit(s) are non-transferable and any change in ownership or operation of a sidewalk vendor business requires a new permit. C. The written application shall provide an address where the applicant consents to receive service of process. An acceptable address for this purpose shall include a post office box or private mailbox that complies with California Business & Professions Code Section 17538.5. (Ord. O-2020-005 § 2 (part), 2020) 12.22.030 Issuance of permit. A. The Administrative Services Director may issue the sidewalk vendor permit if the Director finds based on all of the relevant information that: 1. The sidewalk vendor has provided adequate insurance as determined by the City Attorney to protect the city from liability associated with sidewalk vendor activities, with policy limits not less than $1 million per occurrence and $2 million aggregate, where the city has been named as an additional insured on the sidewalk vendor's insurance policy. 6/23/26 | Item G1 | Attachment 2 Page 109 of 115 2. The conduct of the sidewalk vendor will not unduly interfere with traffic or pedestrian movement, or interfere with or endanger the public health, safety, or general welfare. 3. The conduct of the sidewalk vendor will not unduly interfere with normal governmental or city operations, threaten to result in damage or detriment to public property, or result in the city incurring costs or expenditures in either money or personnel not reimbursed in advance by the sidewalk vendor. 4. The conduct of such sidewalk vending activity will not constitute a fire hazard. 5. The sidewalk vendor has paid all previous administrative fines and completed any other alternative disposition associated in any way with a previous violation of this chapter. 6. The sidewalk vendor has not had a permit revoked within the past twelve (12) months. 7. The sidewalk vendor application contains all required information and the sidewalk vendor has not made a materially false, misleading, or fraudulent statement of fact to the city in the application process. 8. The sidewalk vendor has obtained a business license pursuant to Chapter 5.04. 9. The sidewalk vendor has obtained a valid California Department of Tax and Fee Administration seller's permit. B. To prevent an undue concentration of commercial activity that unreasonably interferes with the scenic and natural character of the city's parks, the Administrative Services Director shall authorize no more than five (5) concurrent sidewalk vendor permits for stationary food sales in all (not each) city parks, or no more than five (5) concurrent sidewalk vendor permits for merchandise sales in all (not each) city parks. C. Because the city has entered into exclusive agreements for vending of merchandise and food in city parks in the Pier Zone defined in Section 12.20.185(a)(4) of this Code, no sidewalk vending permit shall be issued for stationary sidewalk vending activities in city parks in the Pier Zone. D. To ensure the public's use and enjoyment of natural resources, coastal access and recreational opportunities at the City Pier, to prevent an undue concentration of commercial activity that unreasonably interferes with the scenic and natural character of the City Pier and boardwalk, and to ensure adequate social distancing during such times as public health orders are in effect recommending such social distancing, no sidewalk vending permit shall be issued for sidewalk vending activities on the City Pier or boardwalk adjacent to the City Pier. (Ord. O-2020-005 § 2 (part), 2020) 12.22.040 Denial of sidewalk vendor permit. A. If the Administrative Services Director finds that the requirements set forth in Section 12.22.030 as applicable have not been met, the Director shall deny the application for the sidewalk vendor permit. The Administrative Services Director shall provide written notice of such denial specifying the ground or grounds of such denial. Notice of denial of the application for the permit shall be deemed to have been served upon the date it is personally served on the sidewalk vendor, when deposited in the United States mail with postage prepaid and addressed 6/23/26 | Item G1 | Attachment 2 Page 110 of 115 to the sidewalk vendor at the vendor's residence address as set forth in the application for the permit, or when notified by city email to the sidewalk vendor's email address provided to the city when the business license and permit were issued. B. Any sidewalk vendor whose application for a sidewalk vendor permit has been denied by the Administrative Services Director may appeal such denial to the City Manager by filing a written notice of appeal with the Administrative Services Director within ten (10) days following the date of service of the decision and payment of the appeal fee prescribed by resolution of the City Council. The date of filing of said notice of appeal shall be the date the Administrative Services Director receives the notice and appeal fee. C. To ensure the availability of sufficient sidewalk vendor permits for small businesses for whom sidewalk vending is a primary occupation, any person or entity that maintains a physical location for a business within the city shall be ineligible to apply for a sidewalk vendor permit under this chapter. D. No person whose permit is finally denied shall be eligible to apply for a new sidewalk vendor permit for a period of one year following such final denial. (Ord. O-2020-005 § 2 (part), 2020) 12.22.050 Revocation of permit. Any sidewalk vendor permit may be revoked by the Administrative Services Director for good cause shown including but not necessarily limited to any of the following reasons: A. Falsification of any information supplied by the sidewalk vendor upon which issuance of the permit was based. B. Failure of the permittee, or any employees or subcontractors of the permittee, to comply with the regulations set forth in this chapter. C. No sidewalk vendor whose permit is revoked shall be eligible to apply for a new permit for a period of one year following such revocation. (Ord. O-2020-005 § 2 (part), 2020) 12.22.060 Appeal process for revocation of a permit. Upon receipt of a timely appeal, the City Manager or their designated representative shall hear such appeal within twenty (20) days following the date of such appeal and shall give the sidewalk vendor not less than five (5) days' advance notice of the date of such hearing. The decision of the City Manager shall be based upon the criteria applicable to the issuance or revocation of such permit. The sidewalk vendor shall be notified of the decision of the City Manager by mailed, written notice. The decision of the City Manager shall be final. No revocation of a permit pursuant to this section shall be deemed effective during the pendency of a timely filed appeal until the date of mailing of the City Manager's decision; provided, however, no permit holder shall operate during any period of time in which the insurance coverage required by this chapter is not in full force and effect. Every sidewalk vendor is subject to the following operating conditions when conducting sidewalk vending activities: A. All food and merchandise shall be stored either inside or affixed to the sidewalk vendor's cart or carried by the sidewalk vendor. Food and merchandise shall not be stored, placed, or kept on any public property. If affixed to the cart, the overall space taken up by the cart shall not exceed the size requirements provided in this section. B. Sidewalk vendors may only sell food and/or merchandise. Sidewalk vendors shall not sell or provide services. C. The business license and sidewalk vendor permit shall be displayed conspicuously at all times on the cart or on the person of the sidewalk vendor. If multiple sidewalk vendors are staffing a cart, each person shall obtain and wear their vendor permit on their person in a conspicuous manner. D. All signage and advertising related in any way to the sidewalk vendor shall comply with the city's sign laws. Sidewalk vendors shall not use any electrical, flashing, wind-powered, or animated sign. E. All sidewalk vendors shall allow a police officer, firefighter, lifeguard, code enforcement officer, health inspector, or other government official charged with enforcing laws related to sidewalk vendor activities, at any time, to inspect their carts for compliance with this chapter. F. Carts and any attachments thereto shall not exceed a total height of four (4) feet, a total width of four (4) feet, and a total length of four (4) feet. G. No cart shall contain or use propane, natural gas, gasoline, or other explosive or hazardous materials. No cart shall use electrical power furnished by a generator using any of these substances. H. Sidewalk vendors selling food shall have in their possession at all times they are conducting sidewalk vending activities, all applicable food vending licenses and permits issued by the County of San Luis Obispo or other regulatory agency. I. Sidewalk vendors that sell food shall maintain a trash container in or on their cart and shall not empty their trash into public trashcans. The size of the sidewalk vendor's trash container shall count as part of the size limit of a cart. J. Sidewalk vendors shall not leave any location without first picking up, removing, and disposing of all trash or refuse from their operation. Sidewalk vendors shall immediately clean up any food, grease, or other fluid or item related to sidewalk vending activities that falls on public property. K. Sidewalk vendors shall ensure that all required insurance is in effect prior to conducting any sidewalk vendor activities and maintained for the duration of the permit. L. Sidewalk vendors shall not leave their cart unattended. M. Cart(s) shall not touch, lean against, or be affixed at any time to any building or structure including, but not limited to lampposts, parking meters, mailboxes, traffic signals, fire hydrants, 6/23/26 | Item G1 | Attachment 2 Page 112 of 115 benches, bus shelters, newsstands, trashcans or traffic barriers. Providing or selling any service to any person. B. Sidewalk vendors shall not engage in sidewalk vending activities in any of the following locations. 1. On any city property that does not meet the definition of a sidewalk including, but not limited to, any multi-modal path, paved or unpaved park pathway, bicycle path, alley, beach, the City Pier, Pier Plaza, boardwalk adjacent to the City Pier, street, street end, or parking lot. As used in this chapter, "sidewalk" shall have the same meaning as the definition of "sidewalk" under California Vehicle Code Section 555. 2. Due to the narrow width of sidewalks, to ensure adequate social distancing during such times as public health orders are in effect recommending such social distancing, and to ensure compliance with the federal Americans with Disabilities Act of 1990 and other disability access standards, on sidewalks bordering the following streets: a. Shell Beach Road from Cliff Avenue to Terrace Avenue. b. Pomeroy Street from Dolliver Street to the Pier Parking lot. c. Hinds Avenue from Dolliver Street to the Pier Parking lot. d. Main Street from Dolliver Street to the city beach. e. Price Street from Bay Street to Ocean View Avenue. f. Dolliver Street from Bay Street to Ocean View Avenue. 6/23/26 | Item G1 | Attachment 2 Page 113 of 115 g. Cypress Street from Main Street to Ocean View Avenue. 3. For stationary sidewalk vendors, in any residential zone of the city. 4. Within a five hundred (500)-foot radius of a permitted certified farmers' market during the limited operating hours of that certified farmers' market. 5. Within a five hundred (500)-foot radius of an area designated for a temporary special permit issued by the city pursuant to Chapter 12.16 during the limited duration of the temporary special permit. 6. Within fifty (50) feet of any street intersection. 7. Within fifteen (15) feet of any fire hydrant, or other emergency response equipment or facility. 8. Within twenty-five (25) feet of any driveway or driveway apron. 9. Within fifty (50) feet of a transit stop. 10. Upon or within any roadway, median strip, or dividing section. 11. Upon an outdoor area that is unpaved or unimproved (i.e., is not made from concrete, asphalt, or similar material). 12. Within two hundred fifty (250) feet of any property on which a school building or facility is located during the following times: a. An hour before school is in session; and b. An hour before and an hour after school dismissal. 13. Within two hundred fifty (250) feet of any public picnic area, playground area, or playground equipment. 14. Within one hundred (100) feet of any signalized intersections or in any manner that blocks traffic signal equipment and cabinets. (Ord. O-2020-005 § 2 (part), 2020) 12.22.090 Violation—Penalty. A. Violations of this chapter shall not be prosecuted as infractions or misdemeanors and shall only be subject to administrative citation pursuant to Chapter 1.24. The amount of such fines shall be as set forth in Section 1.24.080. B. Notwithstanding anything to the contrary in Section 1.24.080, if a sidewalk vendor violates any portion of this chapter and cannot present the citing officer with proof of a valid sidewalk vending permit, the sidewalk vendor shall be assessed administrative fines in the following amounts: 1. A fine not exceeding two hundred fifty dollars ($250.00) for a first violation. 2. A fine not exceeding five hundred dollars ($500.00) for a second violation within one year 6/23/26 | Item G1 | Attachment 2 Page 114 of 115 of the first violation. 3. A fine not exceeding one thousand dollars ($1,000.00) for each additional violation within one year of the first violation. Upon proof of the existence of a valid permit issued under this chapter, the fines set forth in this subsection shall be reduced to the fines set forth in Section 1.24.080. (Ord. O-2020-005 § 2 (part), 2020) 12.22.100 Citation appeals. Administrative citations may be appealed pursuant to Chapter 1.24. If the hearing officer finds the person meets the financial criteria described in Government Code Section 68632(a) or (b), and the hearing officer upholds the citation, the hearing officer shall, as part of the notice of decision required under Section 1.24.120, impose an administrative fine equal to no greater than twenty percent (20%) of the administrative fine imposed pursuant to this chapter. The hearing officer may allow the person to complete community service in lieu of paying the total administrative fine, may waive the administrative fine, or may offer an alternative disposition.
