RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ATASCADERO, CALIFORNIA APPROVING A LOT LINE
ADJUSTMENT ATAL25-0042 AND CONDITIONAL USE PERMIT
USE25-0069 WITH A PARKING REDUCTION, DRIVEWAY DESIGN
MODIFICATION, AND SIGN EXCEPTION TO AMEND THE HOME
DEPOT CENTER MASTER PLAN OF DEVELOPMENT (CUP 2000-0014)
AND ALLOW A CARWASH, DRIVE-THROUGH RESTAURANT, AND
COMMERCIAL SHELL ON APNS 049-045-036, 049-045-034, 049-045-033,
AND 049-045-035

Amendments to Home Depot Master Plan of Development
WHEREAS, an application has been received from Westar Associates, LLC, applicant,
and Atascadero 101 Associates, LLC, property owner, to consider a lot line adjustment and a
conditional use permit (Master Plan of Development) with a parking reduction, driveway design
modification, and sign exception for the Home Depot Center at 805, 910, 920, and 940 El Camino
Real (APNs 049-045-036, 049-045-034, 049-045-033, and 049-045-035); and
WHEREAS, the site has a General Plan Designation of Commercial Park (CPK); and
WHEREAS, the site is in the Commercial Park (CPK) zoning district and within Planned
Development Overlay Zone No. 9 (PD-9); and
WHEREAS, site development is governed by the existing Master Plan of Development
originally approved by City Council in 1997 and subsequently amended to accommodate various
uses and development; and
WHEREAS, PD-9 allows retail uses and restaurants ministerially, allows drive-through
restaurant uses with a Conditional Use Permit, and does not allow carwash uses; and
WHEREAS, the subject application includes a request for a Conditional Use Permit to
construct a drive-through restaurant, drive-through carwash, and retail shell, necessitating text
amendments to PD-9 to include carwashes as a conditionally allowed use in the overlay zone;
WHEREAS, an application for a Zoning text Amendment has been submitted for
concurrent consideration that will conditionally allow carwash uses within PD-9; and

WHEREAS, the application includes a request for approval of a parking reduction and
driveway design modification pursuant to Atascadero Municipal Code (AMC) § 9-4.115(h); and
WHEREAS, the application includes a request for approval of sign exception pursuant to
AMC § § 9-15.011 to exceed existing standards established by the original sign program; and
WHEREAS, the laws and regulations relating to the preparation and public notice of
environmental documents, as set forth in the State and local guidelines for implementation of the
California Environmental Quality Act (CEQA) have been adhered to; and
WHEREAS, a timely and properly noticed Public Hearing upon the subject conditional
use permit application was held by the Planning Commission of the City of Atascadero at which
hearing evidence, oral and documentary, was admitted on behalf of said use permit; and
WHEREAS, the project was reviewed by the Planning Commission at their regularly
scheduled meeting on March 3, 2026 and the Planning Commission recommended approval of the
Project after receiving the staff report and hearing testimony from the public; and
NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Atascadero
takes the following actions:
SECTION 1. Recitals: The above recitals are true and correct.
SECTION 2. Public Hearing. The City Council of the City of Atascadero held a duly noticed
Public Hearing on March 24, 2026 to consider the Project with testimony and reports from staff,
the applicants, and the public.
SECTION 3. Facts and Findings. The City Council makes the following findings, determinations
and approvals with respect to the project approvals:
A. Findings for Approval of a Conditional Use Permit
1. FINDING: The proposed use is consistent with the General Plan.
FACT: The project provides new dining and service options within the City’s main
commercial corridor, supporting General Plan goals for economic vitality and efficient
land use. The site is served by existing infrastructure and access, and the uses are
compatible with surrounding commercial development.
2. FINDING: The proposed project satisfies all applicable provisions of Title 9 of City of
Atascadero Municipal Code (Zoning Regulations of the City of Atascadero).
FACT: The Project complies with all applicable zoning standards. The uses are
allowed a conditional use permit and comply with relevant height, setback, and
landscaping standards. Drive-through operations meet queueing and design

requirements. The zoning ordinance allows modification to driveway and parking
standards, as included in this approval.
3. FINDING: The establishment, and subsequent operation or conduct of the use will not,
because of the circumstances and conditions applied in the particular case, be
detrimental to the health, safety, or welfare of the general public or persons residing or
working in the neighborhood of the use, or be detrimental or injurious to property or
improvements in the vicinity of the use.
FACT: The Project will not be detrimental to public health, safety, or welfare. The
project has been reviewed by the Planning Division, Building Division, Public Works
Department, and Fire Department. Conditions of approval address traffic, queuing, and
noise to reduce impacts to the general public.
4. FINDING: That the proposed project will not be inconsistent with the character or the
immediate neighborhood or contrary to its orderly development.
FACT: The Project fills vacant pads within an established commercial center. Internal
circulation and shared parking maintain orderly development. Conditions have been
added to ensure cohesive architectural design features are incorporated into the overall
project design.
5. FINDING: That the proposed project will not generate a volume of traffic beyond the
safe capacity of all roads providing access to the project, either existing or to be
improved in conjunction with the project, or beyond the normal traffic volume of the
surrounding neighborhood that would result from full development in accordance with
the Land Use Element.
FACT: The Project, as conditioned, is consistent with the traffic projections and road
improvements anticipated within the General Plan. A Traffic and Circulation Study
has been prepared which identifies that existing intersections and roadways are
sufficient to accommodate the proposed uses.
B. Parking and Driveway Modifications
6. FINDING: The characteristics of a use or its immediate vicinity do not necessitate the
number of parking spaces, type of design, or improvements required by this title.
FACT: The Project is part of an existing regional shopping center and will provide for
build-out with complementary uses. Complementary peak demand patterns and on-site
queueing reduce stall demand, and shared parking across the center ensures adequate
capacity. Additionally, the relocated driveway will provide a more compatible point of
access for the anticipated onsite circulation pattern without adverse effects.

7. FINDING: The reduced parking will be adequate to accommodate on the site all
parking needs generated by the use.
FACT: The commercial center will continue to have adequate onsite parking to serve
all existing and proposed uses based on shared parking easements, available queuing
for the proposed drive-through-restaurant, and differences in peak parking periods
between the hotel and restaurant uses.
C. Sign Design Exception
8. FINDING: The sign is consistent with the purposes set forth in Section 9-15.002;
FACT: The intent of the sign code is prevent overwhelming any single development
with commercial signage and detracting from the architectural design. The sign area
requested for the carwash use allows flexibility for the purpose-built building that is
narrower by nature and may have more limited area to install effective signage.
9. FINDING: The opportunity to combine signs for more than one use on a single sign
structure has been considered
FACT: The existing commercial center contains shared monument signs and a freeway
facing sign available for all commercial uses.
10. FINDING: Conformance with all other applicable codes and ordinances of the City,
including, but not limited to, the Zoning Ordinance, General Plan and its several
elements, and the appearance review guidelines.
FACT: The Home Depot Center is subject to a Master Sign Program. The Project will
comply with all other provisions of the Master Sign Program as applicable.
D. Lot Line Adjustment
11. FINDING: The original parcels were legally created.
FACT: All parcels were legally created through various legally recorded subdivision
maps and lot line adjustments as reflected in the proposed Preliminary Lot Line
Adjustment map.
12. FINDING: The parcels resulting from the lot line adjustment will conform to the City's
zoning ordinance and building regulations

FACT: The resulting parcel configuration contains smaller parcels than the existing 2-
acre minimum parcel size in the CPK zone. The municipal code allows smaller parcel
sizes with a Master Plan of Development. The project conforms to existing and
previously approved parcel sizes in the PD-9 overlay zone.
13. FINDING: The lot line adjustment will not result in a greater number of parcels than
originally existed, the lot line adjustment shall be approved.
FACT: No additional parcels will be created as a result of the Lot Line Adjustment.
SECTION 4. CEQA. The City Council finds that the project is Categorically Exempt from the
requirements of the California Environmental Quality Act (CEQA) pursuant to Section 15332 (In-
fill Development) exemptions of the CEQA Guidelines, in accordance with the Notice of
Exemption.
SECTION 5. Approval. The City Council of the City of Atascadero, in a regular session
assembled on March 24, 2026, resolved to approve the Project consistent with the following:

PLANNING DIVISION
1. This approval is for Project No. USE25-0069 which includes:
a. Lot Line Adjustment ATAL25-0042
b. A Conditional Use Permit with a parking reduction, driveway
design modification, and sign exception allowing for the
development of a 5070 SF drive-through restaurant, a 4,200 SF
commercial tenant space, and a 4,000 SF drive-through carwash
at the Home Depot Center (APNs 049-045-036, 049-045-034, 049-
045-033, & 049-045-035)
The Project is approved as depicted and described on the attached
exhibits, and conditioned herein. The approval of these entitlements
project runs with the land, regardless of the owner.
Construction Phasing shall occur so that construction permits for the
car wash are not issued prior to the occupancy of the Drive-Through
Restaurant.

2. The approval of these entitlements shall become final and effective for
the purposes of issuing building permits (14) days after the City Council
hearing, unless an appeal is made in accordance with the Atascadero
Municipal Code. No building permits shall be issued for the carwash
building until the associated zone change becomes effective. If City
Council denies the request for the associated text amendment allowing
carwash uses in PD9, then the approval of the carwash building shall be
considered null-void and that location shall be reserved as a future
development pad.

3. In accordance with the Atascadero Municipal Code section 9-8.105, any
violation of any of the conditions of approval may be cause for
revocation of this entitlement and subject the applicant and/or future
property owners to the penalties set for in the Atascadero Municipal
Code, as well as any other available legal remedies.

4. All conditions of approval the original Master Plan of Development (CUP
2000-0014) and associated active entitlements amending it will remain
in full force and effect unless otherwise modified herein.

5. Upon request of the applicant, the Community Development
Department shall have the authority to approve the following minor
changes to the project that (1) modify the site plan project by less than
10%, and/or (2) result in a superior site design or appearance.

shall expire and become null and void unless the project has received a
time extension consistent with the Atascadero Municipal Code.
7. The applicant shall defend, indemnify, and hold harmless the City of
Atascadero or its agents, officers, and employees against any claim or
action brought to challenge an approval by the City, or any of its entities,
concerning this conditional use permit.

8. All site development shall be consistent with the attached exhibits. The
following modifications shall be incorporated into the construction
plans and verified during Planning Review of the associated Building
Permits:
• The drive-through restaurant building shall incorporate stone,
or similar material at the base of the building (36” high) on all
4 sides of the building, as approved by Planning Staff.

9. A landscape and irrigation plan shall be approved prior to building
permit issuance. The landscape plan shall be submitted and include the
following:
a. All landscape species identified must be known to thrive in
Sunset Climate Zone 7.
b. All landscape areas shall include mulch.
All landscaping shall be installed consistent with the approved
landscape plans prior to final building inspection. The applicant shall
maintain the approved landscaping for the life of the project. All
required plantings shall be maintained in good growing condition,
and in any case where a required planting has not survived, shall be
replaced with new plant materials. All trees shall be maintained in a
manner that allows trees to grow to their full natural height and
natural canopy. No growth suppressants shall be permitted that
result in stunting or modifying the natural growth pattern of the
tree. Compliance shall be monitored and enforced during
subsequent permitting for the facility.

10. All retaining walls and site walls shall be constructed of earth-toned
color texture block or similar material, unless otherwise specified.

11. All other building and/or free-standing site signs will be consistent with
Master Sign Program (AUP 2000-0001) or as modified by this Project.
The following changes must be incorporated into the proposed signs:
a. The carwash building shall be allowed to install three, 90 SF
signs as shown on the attached Project Plans.

b. The proposed monument sign shall use colors and materials
consistent with the architecture of commercial center and
existing signage.
12. All ducts, meters, air conditioning equipment and all other mechanical
equipment, whether on the ground, on the structure or elsewhere, shall
be screened from public view with materials architecturally compatible
with the main structure and painted to match the color of the
surrounding building area or with landscaping. Gas and electric meters,
electric transformers, and large water piping systems shall be screened
from public view with approved architectural features and/or landscape
plantings to the greatest extent feasible.

13. All outdoor trash enclosures will be constructed of decorative masonry
materials, solid masonry, or split face, with solid metal doors. The
perimeter shall be landscaped. Trash enclosures may utilize stucco
provided the paint colors are compatible with the branding standards of
the selected tenant. All paint shall receive an anti-graffiti coating.

14. All site lighting shall comply with the City’s exterior lighting standards as
outlined in AMC § 9-4.137, including the selection of fixtures with light
sources recessed a minimum of two inches into the shield or installing
equivalent shielding on all sides. New parking lot pole-mounted lighting
shall not exceed the height of the existing parking lot pole-mounted
lights. A photometric plan shall be submitted with building permits to
ensure compliance with Municipal Code standards and ensure no off-
site glare. Existing lighting abutting the railroad right of way shall be
retrofitted for compliance with City Lighting standards.

15. The carwash shall be constructed and outfitted to minimize operational
noise, including through the use of available noise suppression
technology and noise conscious equipment such as:
• Dryer Silencers or Shrouds;
• Variable frequency drives;
• Acoustic baffles for tunnel entries and exits; and
• Run silent vacuums
No dryer units shall exceed a manufacturer-specified operational
noise level of 70 dBA at 30 feet, or equivalent noise level at
specified distance.

16. Operating hours for the carwash shall be limited to 7:00 a.m. to 7:00
p.m. Following 3 months of occupancy and again at 12 months of
occupancy, subject to the receipt of any noise complaints regarding the
carwash, staff will evaluate that the site operates in compliance with the
City’s noise ordinance and recommend additional measures to reduce
operational noise as needed.

17. Prior to issuance of building permits, the property owner shall provide
documentation of shared parking easements/agreements across the
center.

PUBLIC WORKS CONDITIONS
18. Upon request of the applicant, the City Engineer shall have the authority
to approve minor revisions to the conditions below that, in the opinion
of the City Engineer, are not reasonably feasible to complete or
incompatible with the facilitation of the project.

19. The following onsite and public improvements must be completed by
the developer prior to final occupancy of any structure on the property
and approved by the City Engineer:
a. Protect and preserve in place the existing curb, gutter, and
sidewalk on El Camino Real and replace where damaged or
modified during construction.
b. Reconfigure the northbound El Camino Real approach lanes to
the San Ramon Road intersection to a center-though and right
turn lane with intersection lane control signage.
c. Reconfigure the northbound El Camino Real departure from the
San Ramon Road intersection to improve alignment with the
northbound approach reconfiguration and better define a left
turn lane pocket to the southern driveway while maintaining
the through lane alignment. It is expected that the center
median north of San Ramon Road may need to be modified to
accommodate the alignment improvement.
d. The southbound lane on El Camino Real approaching the NB
freeway onramp shall include pavement markings and/or
signage designating that lane as a freeway entrance lane only.
e. Left turns shall be prohibited from exiting the southern
driveway and appropriate signage installed. Lane separation
striping (double-yellow) shall be added to the south driveway
on the west project site to facilitate proper vehicular alignment
for ingress/egress.
f. Evaluate potential improvements to the eastern site driveway
at the main carwash entry to maintain proper vehicle approach
and alignment. This may include, but is not limited to, widening
of the driveway, striping, or other measures to achieve
adequate traffic flow and alignment.
g. Refresh all pavement markings on El Camino Real between NB
101 off-ramp and the bridge over the railroad tracks, including
all markings at the San Ramon Road intersection.
h. The City Engineer will evaluate the site for the addition of
appropriate roadway signs to prevent traffic from entering the
residential neighborhood on to the north

All public improvements shall be constructed in conformance with
the City of Atascadero Engineering Department Standard
Specifications and Drawings, except as noted above or as approved
by the City Engineer.
20. A traffic control/mitigation plan shall be submitted and approved prior
to temporary or final occupancy that details measures to be
implemented during the first month of opening and any other
abnormally high traffic volume event. The plan shall include:
• Queuing plan showing additional volume
• Staffing narrative describing additional staffing measures for
busy times
• Coordination plan with City should back-up occur onto or
within the City right-of-way.
Should the mitigation plan fail to adequately mitigate impacts to the
satisfaction of the City Engineer, a revised plan must be submitted and
approved by the City Engineer prior to continuing operation.

21. The developer shall designate a qualified licensed civil engineer to be
the engineer of work who will provide quality assurance for materials,
workmanship, and compliance with approved site-civil and public
improvement plans during construction of the project. The designated
engineer of work shall complete and sign a certificate of substantial
conformance form that all work has been completed and is in full
compliance with the approved plans.

Discharger Identification (WDID) number provided upon acceptance of
the SWPPP into the State's SMARTS system registration shall be noted
on the Title Sheet of the relevant project plans. A project Qualified
Stormwater Professional (QSP) shall coordinate with the City Inspector
for State mandated storm water inspections and shall provide
verification of QSP inspections, monitoring, SWPPP modifications and
actions throughout project.
24. The property owner of any project constructing on-site stormwater
management facilities improvements shall enter into a Stormwater
Operation and Maintenance Plan/Agreement (OMP) which will be
recorded at the County Recorder’s office. The OMP shall include a
financial plan addressing annual and long-term maintenance as well as
replacement. Specific requirements for stormwater management may
be required to be identified in advance of building permit issuance.

25. All basins must be shown to completely drain within 72 hours, to the
satisfaction of the City Engineer.
a. Retention Basin. Any drainage basin which is used as a terminal
disposal facility shall be classified as a retention basin. If included
in the project, any retention basin shall comply with all applicable
State and local regulations including the following:
i. Percolation Test Required. A minimum of 3 percolation
tests per basin shall be submitted to the City Engineer for
review and approval prior to approval of the plans. The
project engineer shall submit calculations and a report
demonstrating the basin will drain within seven-days of a
single storm event as noted above. Deep soil borings may
be required in areas where there is concern of shallow
depth to groundwater or bedrock. Percolation tests shall
be performed at depths below the basin bottom.
b. Detention Basin. Any drainage basin which has a downstream
outlet designed to meter the outflow shall be classified as a
detention basin. If included in the project, any detention basin
shall comply with all applicable State and local regulations.
c. Subsurface Infiltration Basins. Subsurface basins may be used for
either retention or detention of site runoff, where their
application is suitable for project conditions. If included in the
project, any subsurface basins shall comply with all applicable
State and local regulations. Subsurface basins shall be limited to
locations where the depth to seasonally high groundwater is
greater than 10-feet below the deepest portion of the basin.
d. Drain Rock. Drain rock shall be clean, crushed granite (or clean,
angular rock of similar approved hardness) with rock size ranging
from 1-1/2-inch to 3/4-inch. Rock gradation shall conform to the
Specification of ASTM C-33 #4.

e. Operational Requirements.
i. Water quality of inflow (both sediment and chemical
loading) may require pretreatment or separation
j. Maintenance plan, including provisions for vehicular
access and confined-space entry safety requirements,
where applicable
k. A safe overflow path shall be identified on the plan and
may require easements
f. Overflow Path Required. The design of all drainage basins shall
identify the designated route for overflow. The Project Engineer
shall design the overflow path so that the flow in a 100- year
storm is non-erosive and will not damage downstream
improvements, including other basins. Easements may be
required for concentrated flows across multiple properties.
26. All non-residential uses/buildings must demonstrate that wastewater
effluent composition meets City requirements, or pre- treatment may
be required. Applicant shall provide anticipated wastewater
composition information upon request by City Engineer. For uses that
require pre-treatment, a sampling location shall be provided to sample
effluent prior to discharge to sewer main line.

27. All new and existing utilities (water, sewer, gas, electric, cable TV and
telephone) serving the Project shall be placed underground. Utilities
shall be designed in a manner to accommodate future extensions or
connection where feasible or required by the City.

28. Public utilities shall be installed in all public rights-of-way to the
satisfaction of the City Engineer. This shall include the installation of fiber
optic cable or conduit for such as appropriate.

29. Construction documents submitted for building permits shall portray
and/or depict each building being served with separate services for
water, sewer, gas, power, telephone, fiber/communication, and cable
TV. Utility laterals shall be located and constructed to each building in
accordance with City Engineering Standards and Standard Specifications
and other applicable codes. New and replacement utility distribution
systems and services, including all existing utilities along all project
frontages, shall be constructed underground, to the satisfaction of the
City Engineer. The applicant shall be responsible for the relocation and/or
alteration of existing utilities. The final design shall substantially conform
to the approved plans, unless changes are requested by the applicant
and approved consistent with the procedures identified in the
Atascadero Municipal Code and these conditions of approval.

30. Sewer capacity charges and fees will be due at building permit issuance.
The applicant shall pay sewer fees in effect at the time of Building Permit
issuance. If any unique uses are proposed, specific wastewater
information may be required to be submitted, subject to the request and
approval of the City Engineer.

31. A Fire and site safety plan shall be submitted prior to approval of any
construction permits.

32. The Building/Site Permit application shall provide a plan sheet showing
compliance with fire truck turning radii consistent with fire Standard F-7
