Staff recommendation is for the Hearing Officer to approve the AUP. (Lee’s Signs-Metro PCS) (Mariah Gasch, Assistant Planner) PLEASE NOTE: Any court challenge to the actions taken at the public hearing may be limited to considering only those issues raised at the public hearing described in this notice or in written correspondence to the City of Atascadero at, or prior to, the public hearing. Any decision of the Hearing Officer is final unless a ppealed to the Planning Commission within 14 days of the action. Any person aggrieved by the decision may file an appeal. Appeal forms are available in the Community Development Department or on the City’s website (www.atascadero.org). The fee for filing an appeal is $762 and must accompany the appeal documentation. t:\~ administrative use permit\agendas\2018\ nov 1, 2018.doc C ITY OF A TASCADERO COMMUNITY DEVELOPEMENT Administrative Hearing Agenda Report ITEM # 1 FROM: Mariah Gasch MEETING DATE: November 1, 2018 FILE NUMBER: USE 18-0196 PROJECT ADDRESS: 8300 El Camino Real #C-1 SITUATION: The applicant is proposing one (1) rear-facing building mounted wall sign consisting of channel letters. The proposed sign is for MetroPCS in the Food 4 Less shopping center and would face the adjacent shopping center. The Food 4 Less Center has a Master Sign Program that states the following regulations for rear signage on Building B (facing the adjacent shopping center):  Each tenant in Building B is allowed one rear-facing building mounted wall sign  The signs shall be square box cabinet signs  All rear facing signs on Building B shall be 40 square feet in size with identical dimensions of 4 feet (height) by 10 feet (width)  All rear-facing signs shall be installed at the same height along the back of the building, at three (3) feet below the roofline The applicant is proposing to amend AUP 2010 -0047 to eliminate the square box sign requirement and modify the size standards to allow a maximum of 40 square feet of signage with no standard dimensions. EVALUATION: The proposed sign is 20 feet long and 1’ 4.5” tall with a maximum square footage of 12.43 feet. The center’s Master Sign Program states that the sign shall be a square box cabinet sign. Wall cabinet signs are now a prohibited sign type as stated in Atascadero Municipal Code (AMC) 9-15.006. Wall mounted channel letters are consistent with the City’s current standards. Commercial signs that do not have specific Master Sign Program regulations are subject to standards in AMC 9-15.008.This allows one (1) sign per building face with a public street or parking lot frontage and allows a maximum of one (1) square foot of signage per linear foot of building frontage. The proposed sign complies with the regulations set by this code section. RECOMMENDATION: Staff recommends the Administrative Hearing Officer approve Use 18-0196 to approve the request to amend the Food 4 Less Master Sign Program to eliminate the requirement that all signs on the rear of Building B (facing the adjacent shopping center) shall be square box signs. Staff also recommends approval of the request to change the Master Sign Program to allow a maximum of 40 square feet of signage with no standard dimensions. Page 2 ENVIRONMENTAL DETERMINATION ☒ Categorical Exemption CEQA – Guidelines Section 15301 ☐ Statutory Exemption §§ 21000, et seq & ________________________ ☐ No Project – Ministerial Project Findings AMC 9-15.011 requires the Hearing Officer to make the following 4 findings: 1. The need for such signing is based on the purposes set forth in Section 9 - 15.002; This proposed sign accomplishes three of the required purposes. Section 9 -15.002(a) describes the purpose of maintaining and improving “the aesthetic environment and overall community appearance to foster the City’s ability to attract sources of economic development and growth.” Section 9-15.002(c) describes the purpose of implementing “quality sign design standards that are consistent with the City’s General Plan, Zoning Ordinance and Appearance Review Guidelines.” Finally, Section 9 -15.002(e) describes the purpose of minimizing “possible adverse impacts of signs on private and public property in order to maintain property values and to maintain a positive City image.” 2. The opportunity to combine signs for more than one (1) use on a single sign structure has been considered; The business will have only two signs: the existing wall on the front of the building, facing the Food 4 Less shopping center and one on the rear side of the building facing the adjacent shopping center. 3. For freeway-oriented signs, the sign area and height are the minimum needed to achieve adequate visibility along the freeway due to highway ramp locations and grade differences; and The proposed sign is not freeway oriented. 4. Conformance with all other applicable codes and ordinances of the City, including, but not limited to, the Zoning Ordinance, General Plan and its several elements, and the appearance review guidelines. (Ord. 604 § 2, 2016) Exceptions to the Master Sign Program are permitted based on criteria listed above. Improving the appearance and character of Atascadero, including signage, is a Framework Principle of the General Plan. This sign in this zoning district is appropriate for the desired appearance and character of the City. Conditions 1. Building permits shall be obtained prio r to installation of the sign.
