HomeMy WebLinkAboutOrdinance 036 ORDINANCE NO. 36 AN ORDINANCE OF THE CITY OF ATASCADERO AMENDING SECTION MAP 12-0-34 OF THE OFFICIAL ZONING MAPS OF THE CITY OF ATASCADERO BY ' PLACING CERTAIN PROPERTY IN THE R-4-D ZONE. THE CITY COUNCIL OF THE CITY OF ATASCADERO ORDAINS as follows: Section 1. Council Findings . After conducting a public hearing, the City Council finds and determines that: 1. The project will not have a significant adverse effect upon the environment and the preparation of an Environ- mental Impact Report is not necessary. However, it will be necessary to introduce certain mitigation measures into the project to minimize potential adverse effects. 2. The recommended "D" with the proposed rezoning will pro- vide an opportunity to ensure that the resulting develop- ment will be an attractive and compatible neighbor to adjacent properties and public roads. 3. The recommended rezoning is consistent with the High Density Multiple-Family designation by the 1980 Atascadero ' General Plan. Based upon these findings, a change of zone from A-1 to R-4-D with the "D„ to mean: "1. Departmental Review is also required for multiple family residential uses totaling less than ten units per building site. 2 Design review of development proposals with particular attention given to insuring an attractive apppearance from El Bordo and adjacent properties by means of archi- tectural design, landscaping, building and use setbacks; and signing and lighting limitations. 3. That the minimum lot size for creation of new parcels shall be one-half (1/2) acre. 4. That building height shall be limited to two stories . ' 5. That, in the event the site is developed with mobile homes, the maximum allowable density shall be eleven (11) units per acre as provided in the General Plan. 1 r 6. That the density shall be calculated on a basis of 36 people per acre or any combination of the following r maxima which when multiplied by standard occupancy factors, does not exceed 36 individual residents per acre: 18 one bedroom apartments per acre 12 two bedroom apartments per acre 9 three bedroom apartments per acre 7 four bedroom apartments per acre Occupancy Factors Studio l person One bedroom 2 persons Two bedrooms 3 persons Three bedrooms 4 persons Four or more bedrooms 5 persons" Section 2. Zoning Change. Map 12-0-34 of the Official Zoning Maps of the City of Atas- cadero on file in the City Planning Department is hereby amended to reclassify the following described property from A-1 to R-4-D: rParcel 1 as shown on Parcel Map CO 72-344 in the City of Atascadero, County of San Luis Obispo, State of California, r as per map recorded February 16 , 1973 in Book 10 , Page 69 of Parcel Maps, in the office of the County Recorder of said County. ' Section 3. Zoning Map Map 12-0-34 of the Official Zining Maps of the City of Atas- cadero on file in the City Planning Department is hereby amended as shown on attached Exhibit "A" which is hereby made a part of this ordinance by reference. 1 Section 4. Publication The City Clerk shall cause this ordinance to be published once within fifteen (15) days after its passage in the Atascadero News, a newspaper of general circulation, printed, published and circulated in the City in accordance with Section 36933 of the Government Code; shall certify the adopting and posting of this ordinance and shall cause this ordinance and this certification together with proof of posting to be entered into the Book of r Ordinances of this City. r r 0 Section 5. Effective Date This ordinance shall go into effect and be in full force and effect at 12 :01 a.m. on the 31st day after its passage.
