Atascadero City Council at a regular meeting thereof held on February 8, 1994 and

ORDINANCE NO. 276
AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF ATASCADERO, CALIFORNIA
ADDING SECTION 4-2.1008 TO ARTICLE 10 OF TITLE 4
REGULATING SKATEBOARDING ON PRIVATE PROPERTY
The City Council of the City of Atascadero does ordain as follows:
SECTION 1. Section 4-2.1008 is added to Article 10 of Title 4, to read
as follows:
(a) It is unlawful for any person on a skateboard or similar device to
go on any privately owned sidewalk, parking lot or pedestrian walkway
that is generally held open for public use to serve a facility which serves
the public, including, but not limited to, shopping centers, professional
offices, malls, movie theaters, restaurants, hotels, motels, retail stores,
bowling alleys and other business establishments, if properly posted as
set forth in Subsection (b).
(b) To be properly posted, as required by Subsection (a) of this
section, the property must have signs, conspicuously posted and clearly
visible in areas where skateboarding is prohibited in order to provide
reasonable notice, which read as follows:

SECTION 2. The title of Article 10 of Title 4 is amended to read as
follows:
Article 10. Regulation of Bicycles and Skateboards
SECTION 4. Publication.
The City Clerk shall cause this ordinance to be published once within fifteen
(15) days after its passage in the Atascadero News, a newspaper of general circula-
tion, printed, published and circulated in the City in accordance with Section 36933
of the Government Code; shall certify the adopting and posting of this ordinance and
shall cause this ordinance and this certification, together with proof of posting, to be
entered into the Book of Ordinances of the City.

SECTION 5. Effective Date.
This ordinance shall go into effect and be in full force and effect at 12:01 a.m.
on the 31 st day after its passage.
On motion by Councilmember Borgeson , seconded by Councilmember Luna
the foregoing ordinance is approved by the following roll-call vote:
AYES: Councilmembers Borgeson, Bewley, Luna and Mayor Nimmo
NOES: None
ABSENT: One seat vacant
