Sylvester, City Engineer SUBIECT: Bid award of the State Route 41/Atascadero Avenue Storm Drain Project RECOMMENDATION: 1. Adopt Resolution No. 71-97 awarding a contract to construct th&State Route 41/Atascadero Avenue Storm Drain Project to NFL Construction, 1110 Inc. 2. Revise the adopted FY 97/98 budget DISCUSSION: The project is for the construction of a storm drain along Atascadero Avenue from Atascadero Creek to Morro Road. The storm drain then continues along Morro Road to Curbaril Avenue (see Attachment D). This segment of the storm,drain will provide the vital first link in completing a storm drain system which will ultimately extend along Azucena Avenue. The project will complete Phase 1 and a portion of Phase 2 of the storm drain identified in the Amapoa/Tecorida Master Drainage Study presented to Council on April 25, 1995. Council, at their June 27, 1995 meeting, established construction of the Phase 1 portion of the storm drain as the highest priority project within the Amapoa/Tecorida drainage basin. Based on Council's direction, staff has completed the design, advertised for bid and secured over $400,000 in outside funding to complete the project. In addition, staff has acquired 54 easements for drainage, public utilities and construction along with numerous consents from land owners at no cost to the City. Bids were received and publicly opened on July 11, 1997. The bids have been checked for completeness and accuracy. Staff finds NFL Construction., Inc. to be the lowest responsible bidder. A bid summary prepared by the City Clerk and the itemized bid summary are included in this report for reference. The low base bid was submitted by NFL Construction, Inc. in the amount of $803,163.00. The base bid is the basis of award for the contract. Additive No. 1 was for the construction of an overlay on Atascadero Avenue after construction of the storm drain. Staff is not recommending award of Additive No. 1 to NFL 000001 Bid No. 97-07, Award July 28, 1997 Page 2 Construction in the amount of $40,560.00 due to the high unit costs. The contract requires NFL Construction to maintain the project for a period of one year after acceptance. This year can be used as a settlement period for the trench after which time Atascadero Avenue could be overlayed under a separate contract. Staff feels that rebidding the Atascadero Road overlay one year after completion of the project will result in lower unit costs for the overlay resulting in a significant cost savings. Staff is recommending that the adopted FY 97/98 budget be adjusted in order to proceed with construction of the project. If the contract is not awarded,the City may loose $400,000 in outside funds ($300,000 of CalTrans Minor Project "A" Funds and $100,000 of Regional State Highway Account Funds). These funds may not be available in the future. The proposed adjustments to the adopted FY 97/98 budget are itemized on Attachment E. FOR THE CONSTRUCTION OF THE STATE ROUTE 41/ATASCADERO AVENUE STORM DRAIN PROJECT CITY OF ATASCADERO BID NO. 97-07 WHEREAS, the State Route 41/Atascadero Avenue Storm Drain Project is identified in the current capital budget adopted by the City Council of the City of Atascadero, California; and WHEREAS, on July 11, 1997 sealed bids were publicly opened for the State Route 41/Atascadero Avenue Storm Drain Project and NFL Construction, Inc. was found to be the lowest responsible bidder; and WHEREAS, the public interest and general welfare will be served by construction of the State Route 41/Atascadero Avenue Storm Drain Project. NOW, THEREFORE, the City Council of the City of Atascadero does resolve as follows: 1. The Mayor is hereby authorized to execute an agreement with NFL Construction, Inc. for the construction of the State Route 41/Atascadero Avenue Storm Drain Project base bid in the total amount of $803,163.00 2. The City Manager is hereby authorized to make minor corrections or modifications of a mathematical or clerical nature. 3. The City Engineer is hereby authorized to approve contract change orders up to 5% of the contract amount. 4. The City Accountantis hereby authorized to adjust the FY 97/98 budget and to appropriate, reallocate, release and expend: $300,000.00 in CalTrans' Minor Project "A" Funds (Fund 500); $100,000.00 in Regional State Highway Account Funds (Fund 500); $80,000.00 in Urban State Highway Account Funds (Fund 500); $146,506.00 in Amapoa/Tecorida Fees (Fund 701); $190,444.00 in Drainage Impact Fees (Fund 700); $60,400.00 in Streets and Bridges Fees (Fund 705); $58,350.00 in TDA Non-transit Funds (Fund 732); and issue the necessary warrants to comply with the terms of this agreement. 000004 Resolution No. 71-97 Page 2 5. The San Luis Obispo Council of Governments is hereby authorized to release $100,000.00 in Regional State Highway Account Funds and $80,000.00 in Urban State Highway Account Funds for the construction of the State Route 41/Atascadero Avenue Storm Drain Project. 6. CalTrans is hereby authorized to release $300,000.00 in Minor Project "A" Funds for construction of the State Route 41/Atascadero Avenue Storm Drain Project under their cooperative agreement with the City.
