Campaign Whereas, Teen Pregnancy Prevention Month will be honored in communities throughout the United States during the month of Alp '°h, and herea.s, attention to the need for teens pregnancy prevention is being made by increasing-attention to the conscuences of teen sexual behaviors • encouraging and supporting teens in the choice for sexual abstinence • Jrawing awareness to the barrage of mixed sexual messages given to our youth Whereas, the Educaiion Departnen i of EOC Headiii Se es is coordinating a community awareness effort with other local community agencies, service organization, parents, schools, businesses, medical professionals, churches and government; and Whereas, we are willing to demonstrate our commitment toworking together for the well being and health of our youth for a life free of the misuse of sex during this month long campaign; Let it therefore be resolved that the City of Atasacadero doe hereby Proclaim she month of April, 1997 as TEEN PREGNANCY PREVENTION MONTH and encourages the citizens of this city to participate inn teen pregnancy prevention activities and events,for the. sale of all children, born and unborn, and the quality of life for all citizens. This campaign,Don't ICU Yourself!, is `a time to highlight the importance of encouraging teens to postpone early sexual involvernert and to prevent pregnancy. Teen pregnancy affects all of us ' It is estimated that in California, four out of ten teen girls become pregnant before high school graduation. During 1996,130 babies were born to women 13-18 years old in San Luis Obispo county. We wil need 61/2 kindergarten classes to accommodate these babies in the year 2001. , An estimated $3-$7.billion in state and federal funds are spent annually in California on support for families begun by teen parents. With the widespread impact of teen pregnancy, it is the responsibility of the adult community to address this issue. This campaign provides that opportunity. Your declaration will validate to the residents of Atascadero,local organizations and institutions the significance of communicating with teens about their sexual choices and of openly discussing the consequences of those choices. It would encourage activities and events that draw attention to the impact of teen pregnancy on parents, children, extended families,the community and in turn, our country. We thank you in advance for joining us in this important campaign and would appreciate the honor of receiving this proclamation from your council. RECOMMENDATION: Adopt Resolution #21-97 authorizing a softwaie support agreement with Hung Do for the City's computer accounting package(MOM). BACKGROUND: In the past, the City has contracted with CPU Systems (now ESP) for co m uter support for the MOM system. The cost of this support was $500 per month. As of Febj uary 28, 1997, CPU (ESP) canceled our contract, stating that they would no longer provide st pport for our MOM system. Hung Do has been providing support at the rate of$95 per hour,`I owever, as of March 31, 1997, he will no longer offer this option. Two support options are avail a le to us at this time. We can contract with Mr. Hung Do at a rate of$500 per month. This contract includes all phone support, bug fixes and payroll tax updates. The contract may be canceled by either party upon thirty days written notice. The other company that will provide support for the MOM system is Corbin Willits. Corbin Willitts will provide support at the rate of$573.35 per month. This is a minimum of a three year contract and the City would have to do the following things before Corbin Willits will agree to provide the service. 1. The City would have purchase upgrades for the current MOM system. Corbin Willits does offer a deferred purchase plan, whereby the cost of$14,333.50 is forgive i by Corbin Willits at the rate of 10% per year as long as we pay the support costs. Once the City decides to terminate the support agreement, the City would have to pay the remaining balance of the upgrade costs: 2. This means that the City would'have to purchase Pentium PCs for each user anc would have to pay Corbin Willits$3,078 for the PVX interpreter. Do, an individual programmer, hereinafter referred to as "Contractor", and the City of Atascadero of California, hereinafter referred to as "Client". In consideration of the mutual covenants contained herein, the parties hereto hereby agree to the following terms and conditions: 1.0 GENERAL PROVISIONS 1.1 TERM: This agreement shall become effective on the date of acceptance and execution set forth herein, and shall remain in full force thereafter until terminated as provided herein. 1.2 SERVICES AND BENEFITS PROVIDED BY CONTRACTOR: Contractor agrees to perform and/or provide the services and benefits specified in "Description of Services and Benefits" herein incorporated as "Exhibit A". 1.2.1 Contractor shall determine the methods, details and means of performing and providing the above- referenced services and benefits. 1.2.2 Contractor reserves the right, at Contractor's own expense, to employ such assistance or aid as Contractor deems necessary to perform the service required of Contractor by this agreement. Client may not control, direct or supervise Contractor's authorized representatives or employees in the performance of those services. 1.3 COMPENSATION: In due consideration of the services to be performed by Contractor, Client agrees to pay Contractor the considerations set forth in the amounts and under the terms provided in "Exhibit B", incorporated herein. 2.0 OBLIGATIONS OF CONTRACTOR 2.1 MINIMUM AMOUNT OF SERVICE BY CONTRACTOR: Contractor agrees to devote the hours necessary to perform the services set forth in this agreement in an efficient and effective manner. Contractor also agrees to respond to Client's call within 24 hours. Contractor may represent, perform services for and be employed by additional individuals or entities, in Contractor's sole discretion, as long as the performance of these extra-contractual services does not interfere with or presents a conflict with Client's business. 2.2 TOOLS AND INSTRUMENTALITIES: Contractor shall provide all tools and instrumentalities to perform the services under this agreement. 2.3 WORKER'S COMPENSATION AND OTHER EMPLOYEE BENEFITS: Client and Contractor intend and agree that Contractor is an independent contractor of Client and agrees that Contractor and Contractor's employees and agents have no right to worker's compensation and other employee benefits. If any worker insurance protection is desired, Contractor agrees to provide worker's compensation and other employee benefits, where required by law, for Contractor's employees and agents. 000017 2.4 INDEMNIFICATION: Contractor hereby agrees to, and shall, hold Client, its elective and appointiv boards, officers, agents and employees, harmless and shall defend the same from any liability for damage 00 claims for damage, or suits or actions at law or in equity which may allegedly arise from Contractor's or any of Contractor's employees' or agents' operations under this agreement, whether such operations be by Contractor or by any one or more persons directly or indirectly employed by, or acting as agent for, Contractor; provided as follows: 2.4.1 That the Client does not, and shall not, waive any rights against Contractor which it may have by reason of the aforesaid hold-harmless agreement, because of the acceptance by Client, or the deposit with Client by Contractor, of any of the insurance policies hereinafter described. 2.4.2 That the aforesaid hold-harmless agreement by Contractor shall apply to all damages and claims for damages of every kind suffered, or alleged to have been suffered, by reason of any of the aforesaid operations of Contractor or any agent or employee of Contractor regardless of whether or not such insurance policies shall have been determined to be applicable to any of such damages or claims for damages. 3.0 OBLIGATIONS OF CLIENT: 3.1 Client agrees to comply with all reasonable requests of Contractor necessary to the performance of Contractor's obligations and duties under this agreement. 3.2 Client agrees to contact the contractor via pager and/or fax to inform problems to the Contractor. 3.3 Client shall make available to Contractor full and free access to Client's computer system for the express* purpose of performing its obligations under this agreement. 3.4 Client shall be responsible for ensuring the archival integrity and duplication (known in the trade as "back-up") of all its files in accordance with the highest standards of the computer industry and shall indemnify Contractor against any failure to do so. 4.0 TERMINATION OF AGREEMENT 4.1 TERMINATION ON NOTICE: Notwithstanding any other provision of this agreement, any party hereto may terminate this agreement, at any time, without cause by giving at least thirty (30) days prior written notice to the other parties of this agreement. 4.2 TERMINATION ON MATERIAL BREACH: This agreement may be terminated by either party upon ten (10) days written notice to the other in the event of any material breach hereunder by the other ply. 4.2.1 Delay or failure of performance by Contractor shall not constitute a breach hereunder where the same is due to any cause or condition beyond the reasonable control of Contractor. 4.2.2 In the event of any controversy, claim or dispute between the parties hereto, arising out of or relating to this agreement, or the breach thereof, the prevailing party shall be entitled, in addition to other such relief as may be granted, to a reasonable sum as and for attorney and counsel fees. 2 00001:8 4.3 TERMINATION ON OCCURRENCE OF STATED EVENTS: This agreement shall be nulled and terminated automatically on the occurrence of any of the following events: 4.3.1 Bankruptcy or insolvency of any party; 4.3.2 Sale of the business of any party; 4.3.3 Death of any party; 4.3.4 The end of the thirty(30) days set forth in Section 4.1; 4.3.5 The end of the ten(10) days set forth in Section 4.2; 4.3.6 End of the contract to which Contractor's services were necessary. 4.3.7 Assignment of this agreement by Contractor without the consent of the Client. 4.4 OBLIGATIONS ON TERMINATION: No termination hereunder shall release Client from its obligation to make payment for services rendered through and up to the date of termination. 5.0 MISCELLANEOUS 5.1 NOTICES: Except as otherwise expressly provided by law, any and all notices or other communications required or permitted by this agreement or by law to be served on or given to any party to this agreement shall be in writing and shall be deemed duly served and given when personally delivered or, in lieu of such personal service, when received as a result of deposit in the United States mail, first-class postage prepaid, to the following address for each respective party: 5.1.1 CITY OF ATASCADERO 6500 Palma Avenue Atascadero, CA. 93422 Attention: (Finance) 5.1.2 HUNG Q. Any assignment or attempt to assign by Contractor, whether it be voluntary or involuntary, by operation of law or otherwise, is void and is a material breach of this agreement giving rise to a right to terminate as set forth in Section 4.3. 5.5 SEVEREABILITY: 5.5.1 Should any provision of this agreement in part or in whole be held by a court of competent jurisdiction or by a legislative or rule-making act to be either invalid, void or unenforceable, the remaining 3 000019 provisions unaffected by such holding, ruling or legislation shall remain in full force and effect unimpaired by the holding, ruling or legislation. 5.5.2 The finding of illegality or invalidity of any provision shall affect that provision only and shall not render the remainder of this agreement invalid. 5.6 SOLE AND ENTIRE AGREEMENT: 5.6.1 This agreement constitutes the sole and entire agreement between the parties with respect to the subject matter hereof. 5.6.2 This agreement correctly sets forth the obligations of the parties hereto to each other as of the date of this agreement. 5.6.3 All agreements and/or representations respecting the subject matter of this agreement not expressly set forth or referred to in this agreement are null and void. 5.6.4 This agreement supersedes all contemporaneous and previous agreements and communications, oral or written, between the parties with respect to the subject matter of this agreement. 5.7 DUE AUTHORITY: The parties hereby represent that the individuals executing this agreement are expressly authorized to do so on and in behalf of their respective parties. 5.8 CONSTRUCTION: 5.8.1 The parties agree that each has had the opportunity to have their counsel review this agreement and that any rule of construction to the effect that ambiguities are to be resolved against the drafting party shall not apply in the interpretation of this agreement or any amendments or exhibits thereto. 5.8.2 The captions of the sections are for convenience and reference only, and are not intended to b* construed to define and/or limit the provisions to which they relate. 5.9 AMENDMENTS: Amendments to this agreement shall be in writing and shall be made only with the mutual written consent of all of the parties to this agreement. 6.0 DISCLAIMER 6.1 LIMITATION OF REMEDIES: Contractor makes no guarantee of results under this agreement but merely agrees to use reasonable diligence in attempting to accomplish its objectives and shall be entitled to payment hereunder on this basis. The commitments of Contractor under this agreement are in lieu of all warranties, statutory, express or implied. 6.2 PRECLUSION OF LIABILITY: 6.2.1 Contractor shall not be liable whatsoever for general damages or for loss of profits, incidental, direct or indirect, special or consequential damages, pecuniary or otherwise, even if apprised of the likelihood thereof, arising out of or in connection with Contractor's obligations or performance hereunder or any breach hereof. 6.2.2 In the event of any controversy, claim or dispute in regards to changes made by Contractor to the original software package (referred to in Exhibit A section A.2.2), Client agrees that such changes are at the request and authority of Client, and in no way renders Contractor liable for consequences, directly or indirectly, arising from said changes. 4 000020 0 CAPACITY OF,RESTRICTION ON,AND WARRANTIES BY CONTRACTOR 7.1 CAPACITY: It is agreed and understood that, for the purposes of making modifications (including changes, additions, and correcting errors) to software licensed to Client by Corbin Willits Systems, Inc. (herein "CWS"), Contractor is designated agent of Client as such is described in the System Contract between Client and CWS. 7.2 RESTRICTIONS ON CONTRACTOR: Contractor agrees that it shall not divulge or disclose any code of any CWS software licensed to Client to any third party, nor shall Contractor maintain a copy of any code of any CWS software licensed to Client off of their premises of Client except on a temporary basis for the specific purpose of making modifications to such code pursuant to this Agreement and as allowed in the System Contract between Client and CWS. 7.3 WARRANTIES BY CONTRACTOR: Contractor warrants,and agrees that it will not use any software which it does not have the legal right to use in performing it duties to Client under this Agreement. This warranty and agreement apply to software from all sources, including but not limited to CWS. 8.0 OWNERSHIP OF MODIFICATIONS: Contractor agrees that any modifications made by Contractor to software licensed to Client by CWS shall become the property of Client and shall not be divulged or disclosed to any third party without the prior written permission of Client. BACKGROUND: On August 15, 1995, the Planning Commission held a public hearing on Tentative Tract Map 95002; a subdivision of a 5.24 acre parcel into five one-acre parcels for single family residential use. The project was approved by the City Council (on appeal of the condition to install full frontage improvements) on September 26, 1995. Condition #23 of the approval required that an approved street name for the new City standard cul-de-sac be established prior to recording of the map. The name, Cynthia Court was selected and approved. The final map, verifying that this and all the other conditions had been satisfied, was approved by the City Council on October 8, 1996. ANALYSIS: Whereas, the subdivision created five new parcels, the new cul- de-sac will serve nine parcels, including four existing single family residences. A majority of residents in a neighborhood may petition to have a street name changed. In December, 1995, residents of the four existing homes on the cul-de-sac submitted a letter (Attachment D) requesting that the name Cynthia Court be changed to one of several suggested alternatives . Three of the four signed the petition for a majority of the neighborhood. Staff has been in contact with the fourth - they are not opposed to Cynthia Court or Maya Lane; they just want the matter settled. The residents do not believe they received adequate notification, nor did they all agree to the chosen name. 1 i©U902S The purpose of this report is not to assess blame for the misunderstanding among the subdivider, staff, or the neighborhood. The first choice of the neighborhood, Maya, is acceptable to the City safety departments and Postmaster. (Note: Upon further review, cul-de-sacs of this length should be termed "lanes", as opposed to "courts" to maintain consistency with road name standards throughout the County. ) In addition to identifying the Mayan people of Mexico and Central America, maya translates to "daisy" or "flower". The name is short, easy to pronounce, and does not conflict with other road names in the City. The name change is in conformance with the City' s road naming policies as contained in Attachment C. Lastly, the City has not expended any public funds yet for street sign making or any other items . There is no minimum lot size in the CP zone. The PD3 Overlay provides design guidelines to enhance the appearance of projects along Morro Road and preserve the residential character of neighboring residential area. It is the applicant' s intention to pursue general plan and zoning ordinance amendments to allow residential development on the two new lots which front on Navajoa Avenue; the existing Office designation will remain on the two new parcels fronting Morro Road. Staff supports this approach as a reasonable one to reflect the established neighborhood development pattern. Such support is consistent with action on other similar requests, most recently, the identical process which was completed for the adjacent parcel. (Tentative Tract Map 96003 at 7350 Morro Road was approved by the City Council on July 23, 1996 and the subsequent Resolution and Ordinance to change the land use designations were adopted by the Council October 8, 1996) . In the event that the land use changes to allow for future residential development are not forthcoming, the tentative map has been conditioned to preclude access from Navajoa. Access for any commercial development will be by easement from Morro Road. In addition, the typical residential setback of 25 feet is proposed in order to soften the physical and visual intrusion into the residential neighborhood. CONCLUSIONS• The proposed subdivision is a reasonable precursor to modification of the general plan and zoning ordinance to allow residential development on Navajoa Ave. and continuing the pattern of office development along Morro Road. The tentative map is conditioned to protect the residential character if the anticipated general plan amendment is not completed. All public improvements shall be constructed in accordance with the City of Atascadero Engineering Department Standard Specifications and Drawings or as directed by the City Engineer. 2 . The applicant shall enter into an Plan Check/Inspection agreement with the City. Prior to recordation of the parcel map, all outstanding plan check/inspection fees shall be paid. 3. An encroachment permit shall be obtained from the City Engineering Department and Caltrans prior to the issuance of building permits. 4 . A Preliminary Soils Report shall be prepared for the property to determine the presence of expansive soil or other soil problems and shall make recommendations regarding grading of the proposed site. A final soils report shall be submitted by the soils engineer prior to the final inspection and shall certify that all grading was inspected and approved and that all work done is in accordance with the plans and the preliminary report. The parcel map shall state that a soils report has been prepared for the project. The statement shall provide the date the report was prepared along with the name and address of the soils engineer or geologist who prepared the report. 5. All public improvements or improvements in the public right- of-way shall be secured with a 100% Performance Guarantee and a 50% Labor and Materials Guarantee until the improvements are deemed substantially complete by the City Engineer. Prior to the final inspection of the improvements, and before the other guarantees mentioned in this condition are released, a 10% Maintenance Guarantee shall be posted to cover the improvements for a period of 1 year from the date of the final inspection. The guarantee amounts shall be based on an engineer' s estimate submitted by the project engineer and approved by the City Engineer. The estimate shall be based on City standard unit prices. The Guarantees posted for this project shall be approved by the City Attorney. 6. A six (6) foot Public Utility Easement (PUE) shall be provided contiguous to all street frontages. 000046 7 . All existing and proposed utility, pipeline, open space, scenic or other easements are to be shown on the parcel map. If there are building or other restrictions related to the easements, they shall be noted on the parcel map. 8 . The applicant shall be responsible for the relocation and/or alteration of existing utilities . Utilities shall be relocated into the public utility easement, or as directed by the City Engineer. 9. The applicant shall install all new utilities (water, gas, electric, cable TV and telephone) underground. Utilities shall be extended to the property line frontage of each lot or its public utility easement. 10. The applicant shall overlay any utility trenching in existing streets to restore a smooth riding surface as required by the City Engineer. 11 . The applicant shall construct all drainage facilities to City of Atascadero Standards. The applicant shall demonstrate that the design capacity of the downstream drainage improvements, or natural water courses, can adequately convey the total flow of storm water from the fully developed watershed plus the developed project site without adversely affecting other properties. Otherwise, the applicant shall detain storm water on site in conformance with City standards or as approved by the City Engineer. 14 . The applicant shall submit a grading and drainage plan, prepared by a registered civil engineer, for review and approval by the City Engineer prior to the recordation of the parcel map. 15. The applicant shall show both the pre-developed and post- developed 100-year limits of inundation on the grading and drainage plan. Drainage calculations in conformance with Section 5 of the City Standards shall be submitted for review and approval by the City Engineer prior to recordation of the parcel map. Finish floor shall be at least one foot above the 100-year flood elevation. 00004 16. A sedimentation/erosion control plan addressing interim erosion control measures to be used during construction shall be submitted for review and approval by the City Engineer prior to the recording of the parcel map. The sedimentation/erosion control plan shall be prepared by a registered civil engineer and address erosion control measures to be undertaken between October 15 and April 15. 17 . The applicant shall submit road improvement plans prepared by a registered civil engineer for review and approval by the City Engineer prior to recordation of the parcel map. Road improvement plans shall conform to the requirements of the City Standard Specifications, Section 2 - Preparation of Plans . R-value testing shall be done, and the pavement section designed by a registered civil engineer to the satisfaction of the City Engineer. Road improvements shall include, but not be limited to the following: a. Navajoa Avenue shall be improved from centerline to the property frontage in conformance with City Standard 405 (Local) contiguous to the entire property frontage, or as approved by the City Engineer. In lieu of the concrete curb, gutter, and sidewalk, the applicant shall construct a City standard A.C. dike and five (5) foot wide decomposed granite walkway. The improvements may require the overlaying of the existing pavement to remedy an inadequate structural section or to remedy a deteriorated paving surface. Transitions shall be constructed where required to achieve a smooth join with existing improvements. b. Highway 41 shall be improved as required by CalTrans. Plans for the Highway 41 improvements shall be approved by CalTrans prior to the recordation of the parcel map. Copies of the plans approved by CalTrans shall be submitted to the City Engineer prior to recordation of the final map. C. A 5' wide offer of dedication shall be provided along the entire Navajoa Avenue property frontage. Offers of dedication shall be recorded prior to, or in conjunction with, the parcel map. d. Slope easements shall be provided on each side of the right-of-way as needed to accommodate cut or fill slopes . 18. The applicant shall construct the improvements necessary to convey storm water from Navajoa Ave. to State Highway 41 in conformance with City standards, or as approved by the City Engineer. Plans for the drainage improvements shall be submitted for review and approval by the City Engineer. If • required for the construction of the drainage improvements, the applicant shall provide a public drainage easement between Navajoa Ave. and State Highway 41 . 000048 19. The applicant shall monument all property corners for construction control and shall promptly replace them if disturbed. The applicant shall install all final property corners and street monuments, or bonded for them, prior to acceptance of the improvements. Monuments shall be set at all property corners created and a registered civil engineer or licensed land surveyor shall indicate, by certificate on the parcel map, that corners have been set or shall be set by a date specific and that they will be sufficient to enable the survey to be retraced. 20. The applicant shall submit a black line clear Mylar (0.4 mil) copy and a blue line print of the parcel map to the City upon recordation. 21 . The applicant shall submit a Mylar copy and a blue line print of as-built improvement plans, signed by the registered engineer who prepared the plans to the City Engineer prior to the final inspection. A certification shall be included that all survey monuments have been set as shown on the parcel map. 22 . The applicant shall submit a parcel map in substantial conformance with the .approved tentative map and in compliance with all conditions set forth in the City of Atascadero Subdivision Ordinance and the Subdivision Map Act to the City Engineer for approval. The parcel map shall be signed by the City Engineer prior to it being placed on the agenda for City Council approval. 23. The applicant shall acquire title or interest in any off- site land that may be required to allow for the construction of the improvements. The applicant shall bear all costs associated with the necessary acquisitions. The applicant shall also gain concurrence from all adjacent property owners whose ingress or egress is affected by these improvements. 24 . The applicant shall provide notice either on the parcel map or by a separate instrument recorded on, concurrently with, or prior to the recordation of the parcel map that there are requirements for off-site and on-site improvements and that construction of the improvements shall be required prior to issuance of building permits or other grants of approval for development of the parcels. 25. The applicant shall pay all sewer annexation fees prior to the recordation of the parcel map. 26. The applicant shall submit a written statement from a registered civil engineer that all work has been completed and is in full compliance with the approved plans and the Uniform Building Code (UBC) prior to the final inspection. 000049 27 . Environmental Status-------------------Categorically exempt BACKGROUND: Tentative Parcel Map 95001 was ultimately approved on appeal at the City Council on July 9, 1996 (Attachment B) . This approval allowed the subdivision of two lots, 7 . 50 and 10. 42 acres in size, into three parcels of 5. 60, 5. 96, and 5. 96 acres each. Condition # 27 required abandonment of the portion of San Cayetano Road right-of-way within the subdivision prior to recording the map. 1 D00061 ANALYSIS: Road abandonments (vacations) are accomplished by resolution of the City Council. The procedure is governed by the Streets and Highways Code, under which the Planning Commission must make the following two findings: 1 . That the abandonment is in conformance with the City' s General Plan; and 2 . That the right-of-way is unsuited as a non-motorized transportation facility, i.e. primarily for the use of pedestrians, bicyclists, or equestrians; or that adequate easements have been retained for such purposes. These Findings can clearly be made. The abandonment does not conflict with any goals of the General Plan. The circulation goals and policies of the Circulation Element are not affected by the proposed abandonment. The Fire Department is concerned about the emergency implications of having two San Cayetano roads with the Lindsay property preventing any connection between them. In the event that the remaining portions of the San Cayetano right- of-way are developed, one section, probably the shorter section toward San Marcos to the south, would be renamed. Alternately, this section could be abandoned and a private road (driveway) was constructed to provide access to the three parcels owned by Davis (Lots 20, 21, 22, Block 59) . Lastly, given the terrain of the . area, the San Cayetano right-of-way is not suitable for construction of a City standard street, nor appropriate for alternative means of transportation. Under the Streets and Highways Code, this application qualifies as Summary Vacation (short form abandonment) as opposed to a General (long form) procedure. If the road has not been previously constructed and the provision of utilities is not impacted, a Summary procedure is the proper course. This does not require the preparation of a separate notice of intent to abandon. Lot Line Adjustment (LLA) 94005 has major implications for circulation in the 3-F Meadows subdivision and surrounding areas. (This project has received EIR certification and approval of the associated entitlements - the conditions of approval have not been completed and thus the map, road dedications, and abandonments have not recorded. ) Attachment D shows the proposed San Cayetano road abandonment in light of the 3-F meadows project. Cabazon Road, Puente Road, and the connection road to the San Cayetano would be dedicated and constructed in conjunction with recording the LLA. Likewise, the open space lots would be owned by the City on behalf of the public upon recording the map. The subject request, however, should be i 2 000062 reviewed with the existing circumstances in mind (Attachment C. There is no guarantee if or when the Davis 3-F Meadows resubdivision will record. In order to meet the Tentative Parcel Map condition of approval, the proposed abandonment is only for the portion of the San Cayetano right-of-way abutting the three existing Lindsay parcels . The half road right-of-way adjacent to Lot 18, Block 59 (Davis) would be combined with this parcel upon abandonment. Access to this parcel or any other in the vicinity is not changed as a result of this action. All parcels in the vicinity would continue to have frontage on the San Cayetano (or San Marcos Road) right-of-way. The abandonment will allow the private driveway to be constructed to serve the two building sites created by the Lindsay parcel map. CONCLUSIONS• The abandonment of this portion of the San Cayetano Road right- of-way will accomplish one of the conditions of approval for Tentative Parcel Map 95001 . To construct San Cayetano Road within the existing right-of-way would necessitate enough significant earthwork to permanently alter the hillside character of the area - other access possibilities will probably be looked at upon development of the area. However, the abandonment will not cut off existing, legal access to any property in the vicinity, nor interfere with provision of utilities in the area. San Cayetano Road) WHEREAS, Streets and Highways Code 8330 permits summary vacation of a street right-of-way, or portion of a right-of-way, by adoption of a resolution of summary vacation; and WHEREAS, this portion of the San Cayetano Road right-of-way, as shown on the attached Exhibit, has been impassable for vehicular travel for at least five consecutive years and no public money was expended for its maintenance during that time; and WHEREAS; the vacation of this portion of the San Cayetano Road right-of-way now will not eliminate access to any person' s property which prior to relocation adjoined the street or highway to be vacated; and WHEREAS; the vacation of this portion of the San Cayetano Road right-of-way will not affect any in-place, in-use public utility facility or will not terminate a public service easement; and WHEREAS; the Planning Commission of the City of Atascadero conducted a public hearing on the subject amendment on January 21, 1997 and pursuant to Government Code 65402 has recommended to the Council that the vacation of this portion of the San Cayetano Road right-of-way is in conformance with the General Plan; and WHEREAS, pursuant to Streets and Highways Code 2381, the Planning Commission has recommended to the Council that this portion of the San Cayetano Road right-of-way is not suitable or useful as a non-motorized transportation facility, or that adequate easements have been retained for such purposes . BACKGROUND: Attached is a copy of a report from the meeting dated April 10, 1990 At this meeting, the City Council adopted Resolution No. 36-90 and established the Risk Review Committee. The old report also includes the form for the Committee Operating Manual and some other suggested forms. Staff can find no current record of a Councilappointee to the Risk Review Committee: The Council should appoint one member and we should begin monthly meetings of that Committee to review claims, deal with them expeditiously, and additionally, to explore risk management opportunities an J make appropriate recommendations for action to the City Council. FINANCIAL IMPACT: The City Manager and the City Attorney are the only non-Council E ppointees to the Risk Review Committee. Neither of these two contracts allow for increaE ed cost to the City by, participation in the Risk Review Committee. Therefore, there should be no increased cost to the City from making the appropriate appointment and continuing the Committee with a more active and pro-active approach. It is difficult to calculate th a potential savings to the City, and for that reason staff will not include a dollar figure of potential savings. However, this Committee can only save money. The purpose of the Committee will be two-fold: (1) To manage risks to lessen potential losses to the Ci y; and (2) To review claims, and deal expeditiously with claims that can be settled for unc er$10,000. This will give the City the opportunity to make appropriate payments to s the legitimate claims early, before significant expenses through the Joint Powers Insurance Association are incurred. Since that time, the Committee has met and prepared a brief set of procedures for handling claims as well as policy issues arising from liability claims. The manual is attached to this report As can be seen, Council Members will receive a copy of all claims and can be kept informed of the status of any particular cases. In addition, the resolution repealing Resolution 3-81 and instituting the Committee is also attached . RESOLUTION N0. 36-90 RESOLUTION OF THE ATASCADERO CITY COUNCIL RESCINDING RESOLUTION 3-81 AND AUTHORIZING THE ADJUSTMENT AND SETTLEMENT OF CLAIMS AGAINST THE CITY WHEREAS, the City of Atascadero is a member of the Central Coast Cities Joint Powers Agreement (CCCJPA) for insurance purposes; and WHEREAS, as a result , the City receives the services of an independent CCCJPA adjustor and investigative service and will defend claims filed against it ; and WHEREAS, for the expedient settlement of claims necessary to minimize costs of the City, it is necessary that the Staff and the Adjustor have specified authority on behalf of the City to immediately enter into Settlement Agreements without prior authorizations of the Council .
