WHEREAS, the Council of the city of Atascadero is proud of the City's
street park and home garden trees, and recognizes the importance of tree care
and preservation, and the contribution of such to a cleaner and healthier
environment; and
WHEREAS, in 1872, J. Sterling Morton proposed to the Nebraska Board of
Agriculture that a special day be set aside for the planting of trees; and
WHEREAS, this holiday, called "Arbor Day, was first observed with the planting of
more than a million trees in the State of Nebraska, and
WHEREAS, Arbor Day is now observed throughout the United States and in
three other nations; and
WHEREAS, trees can reduce the erosion of our topsoil by wind and water,
cut heating and cooling costs, moderate the temperature, absorb noise, clean our
air and waterways, produce oxygen and provide habitat for wildlife; and
WHEREAS, trees in our city increase property values, enhance the-
economic vitality of business areas, and beautify our community; and
WHEREAS, Atascadero has been recognized as Tree City USA for the past
nine years by the National Arbor Day Foundation, has received special growth
awards for environmental improvement and management of our trees, and desires
to continue its tree-planting ways.
NOW, THEREFORE, 1, Ray Johnson, Mayor of the City of Atascadero, do
hereby proclaim March 11, 1997 as
ARBOR DAY
and urge all residents to recognize the importance trees have in brightening our
dives and protecting our environment, and f urge all citizens to plant trees to
promote the well-being of this and future generations.

Award of Bid for Purchase of Aerator
RECOMMENDATION:
Staff recommends that one 25 horsepower aeratdr be purchased
from Aerators Incorporated.
BACKGROUND:
The nucleus of the City's wastewater`treatment facility is the
Oxidation Basin. Two 25 horsepower, three 15 horsepower and
two 7 1/2 horsepower aerators currently supply air to this
basin. A dissolved oxygen content of at least 2 parts per
million (ppm) must be maintained to insure prop r treatment of
the incoming wastewater. During summer months, the daily level
of dissolved oxygen often measures below 2 ppm. Although
minimal treatment has been maintained, if one of the existing
aerators should fail during a critical period, proper
treatment of the City's wastewater could notj be sustained.
Three of the existing aerators are thirteen years old and
keeping these aerators running is becoming exp nsive. In 1995
aerator repairs cost the City nearly $5000. Last year the cost
of repair increased to $6, 500. In 1991 a Long--Range Plan for
the Wastewater Treatment Facility, which was dommissioned by
the City, called for augmentation of the oxidation basin with
three additional 25 hp aerators. A soon tD be released
Preliminary Upgrade Design Report calls for doubling the
volume of air currently added to our oxidation' basin. Two 25
hp aerators were purchased in 1995 and installled last year.
This third new 25 hp aerator will supplement) the treatment
facility' s aeration capability and allow one of the existing
(original) aerators to be used as a standby uni .

DISCUSSION:
In 1995, when two 25 horsepower aerators were purchased at a
cost of $16, 815, Aerators Inc. was recognized by the City
Council as the low bidder. The next lowest bid at that time
was $20, 775. 62. The Wastewater Division is pleased with the
performance of the aerators manufactured by Aerators Inc. and
would like to purchase an additional aerator identical to
those purchased in 1995. Ten thousand dollars for the purchase
of additional aeration was `an approved portion of the
Wastewater Division's 1996-97 equipment replacement budget.

RECOMMENDATION:
Approve request by amending policy on prohibition of alcoholic bevera yes in City
Administration Building to enable the City Council to waive the restriction at its
discretion. Waivers shall not exceed three (3) events annually.
BACKGROUND:

The Mayor has received a request from the Atascadero Historical Society (attached)to
serve alcohol in the lower Rotunda of the City Administration Building �or a Chamber
Mixer. Currently, the City's existing facilities rental policy prohibits the Pse of alcohol in
the City Administration Building and does not allow for a waiver of the estriction by City
Staff or City Council. The policy reads as follows:
"Alcoholic beverages are allowed in City parks and facilities excluding the City
Administration Building. Authorization to sell alcoholic beverages at all City facilities
(except the City Administration Building) may be requested in coordination with an
application for a special event. Authorization for such permit shall be at the discretion of
the Director or his designee".

The policy goes on to spell out requirements for an A.B.C. License, insurance, security
guards and not selling to minors.
The above policy can be amended to allow for a waiver of the restriction of alcoholic
beverages in the City Administration Building upon the approval of the City Council, not
to exceed three (3) events annually. A restriction on the number of events where alcoholic
beverages is allowed will ensure that alcohol in the City Administration Puilding does not
become commonplace.

The Atascadero Historical Society has signed up to host a chamber
membership mixer on June 19, 1997 in the lower rotunda museum of city
administration building.
It was suggested Brady Cherry, munity services director, that I contact
the council to se k p rve an alcoholic beverage for that one
evening in conjunction with refreshments for the general public we hope
attends our function.
We are aware of the restriction on serving alcoholic beverages in the city hall,
which is the reason for this request so far in advance of our event. We would
hope that the council would be willing to set aside the ruling for this single
event.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ATASCADERO
AMENDING THE OFFICIAL CITY ZONING MAP BY REZONING CERTAIN REAL
PROPERTY AT 4055 EL CAMINO REAL FROM CR (COMMERCIAL RETAIL) TO

WHEREAS, the proposedzoning text amendment proposes
standards that are consistent with the General Plan as required
by Section 65860 of the California Government Code; and
WHEREAS, the proposed amendment is in conformance with
Section 65800 et seq of the California Government Code concerning
zoning regulations; and
WHEREAS, the proposed amendment will not result in a
significant adverse effect on the environment the Negative
Declaration prepared for the project is adequate as defined by
the California Environmental Quality Act; and
WHEREAS, the Atascadero Planning Commission held a public
hearing on February 4, 1997 and has recommended approval of Zone
Change 96012 .
NOW, THEREFORE, the Council of the City of Atascadero does
ordain' as follows

1 . The proposal is compatible with the surrounding land
use and zoning designations.
2 . The proposal is consistent with the General Plan Land

3. The proposal will not result in any significant adverse

Map number 7 of the Official Zoning Maps of the City of
Atascadero on file in the City Community Development Department is
hereby amended to reclassify the parcels listed below, and shown on
the attached Exhibit A which is hereby made a part of this
ordinance by reference:

Development of said property shall be in accordance with the
standards of the Planned Development Overlay Zone No. 7, any
applicable conditions of approval, and the Master Plan of

ADIALYS I S: .
The project site, on which there is an existing three-bedroom
residence, is located at 7265 Santa Ysabel Avenue (Attachments A
& B) . The applicant wishes to subdivide this site into four (4)
separate parcels and then construct a three-bedroom unit on each
of the new/additional lots created.
As shown by the tentative map, one ( 1) of the proposed parcels
would be 4, 651 square feet, two (2 ) would be 4,764 square feet
and one ( 1 ) would be 10, 138 square feet (Attachment C) . In
addition to the subdivision map, the project includes a proposed
Master Plan of Development, which specifies details with respect
to building design, floor plans, landscaping and fencing
(Attachment D) .
General Plan and Zoning Consistency
Tire subject site is designated for High Density Multiple Family
use by the City' s General Plan and is zoned RMF-16. Within the
RMF-1.6 zone, a minimum lot size of one-half acre is required for
the creation of new lots. However, both the General Plan and
Zoning Ordinance provide for the creation of smaller lots --
through establishment of a Planned Development (PD) Overlay
Zone -- provided the overall residential density within the
project does not exceed that allowed in the underlying zone.
The underlying RMF-16 zoning allows for a maximum of seven 7 •
two-bedroom units or four (4) three-bedroom units on the site
( 0.56 * 8 = 4 .48 ) . The project, which proposes four (4) three-
bedroom units, is therefore allowable from the standpoint of
density.
The City has a generic Planned Development Overlay Zone for
residential projects such as this. Essentially, this generic PD7
Overlay Zone contains a list of minimum development standards.
One of these standards requires that a specific Master Plan of
Development be approved for the site. Thus, once a new PD7
Overlay Zone is approved so too is a Master Plan of Development
to which all future development must conform.
Considering that the creation of lots less than one-half acre are
allowed only through creation of a Planned Development Overlay
zone, approval of the proposed tentative parcel map hinges on the
approval of the proposed zone change. Since the proposed zone
change is essentially a request to establish a Master Plan of
Development for the site, it is appropriate that project review
be focussed on the proposed Master Plan.

Master Plan of Development.
Although the site is almost large enough to qualify for five (5)
three-bedroom units, the location of the existing residence
dictates the size of the three new parcels. The particular floor
plans desired for the new units then limits building setbacks and
the amount of landscaping that can be provided on the new lots.
Nevertheless, the building footprints proposed do not exceed 35%
of individual lot areas, landscaping does indeed total at least
40% of individual lot areas, and the minimum front, rear and side
setbacks are indeed proposed to be met.
The lot-by-lot summary of proposed building and landscaped areas
in relation to lot sizes has been prepared which provides a
convenient means of confirming the above. It should be noted
that, although only the mere minimums are proposed on Lots 2, 3 &
4 with respect to setbacks and building footprints and
landscaping in relation to lot sizes, Lot 1 would have
substantially greater setbacks and landscaped areas than
required. This is significant because it is Lot 1 that would be
most visible from public view.
Compliance with all other PD7 standards are either evident on
plans or is ensured through recommended conditions of approval.
The proposed six ( 6 ) foot perimeter fencing along the rear and
side lo-L- lines of the "parent" lot meets Zoning requirements for
screening. However, a condition of approval is necessary to
ensure that six (6 ) foot fencing does not encroach into front
setback areas nor closer to Santa Ysabel Avenue than the proposed
new garage. Such conditions, which must also ensure consistency
in fence design throughout the project, are contained in
Attachment H.
Site Design/Architecture/Landscaping
Having established that the proposed project complies with RMF-16
density requirements and meets or exceeds PD7 development
standards, it is appropriate that a more qualitative evaluation
of the project follow.
As shown by proposed floor plans (Attachment D) , each new
dwelling unit would contain at least 1, 150 square feet of
habitable space plus an attached two-car garage. The floor
plans, which would be the same for Lots 3 & 4, contain 3
bedrooms, 2 baths and separate living and dining rooms. There is
space in the garages for laundry facilities and each unit would
have adequate-sized kitchens and ample closet space.

Building elevations provided by the applicant (Attachment D) show
proposed exterior design. Like the units recently approved along
Traffic Way (Gearhart) , the three new dwellings would have stucco
exterior on sides and rear elevations and hardboard horizontal
siding on front elevations with composition shingle roofs. Color
schemes for the proposed units have not been established at this
juncture, so a condition of approval is necessary to ensure
uniformity. Architectural treatment is not as critical in this
case as it might be in others because the new units will hardly
be visible from public view.
Environmental Review
As shown, the project would require the removal of two (2) native
trees -- a 20" Walnut and a 14" Oak. The Tree Ordinance requires
that native trees removed be replaced at a certain ratio,
depending on the size and species of trees removed. In addition,
the Tree Ordinance requires that one native tree be planted for
every new residence regardless of tree removals. A condition of
approval is therefore necessary to ensure landscape plans are
revised to include some combination of replacement trees and in
lieu contributions into the City' s Tree Replacement Fund.
Tree removals notwithstanding, the project does not appear to
have environmental impacts which are potentially significant.
Review by Other Agencies
The project has been reviewed by the City Engineer and conditions
have been drafted to ensure all street and drainage improvements
are installed to City Standards and that proper easements are
established for access, utilities and drainage and that a
maintenance agreement is recorded with respect to the common
access drive.
The project has also been reviewed and conceptually approved by
the Gas Company and Chevron, who have gas line easements near the
project, and the Atascadero Mutual Water Company. An interesting
letter was received from the Atascadero Unified School District
(AUSD) apparently seeking some kind of impact fee beyond normal
school fees (Attachment E) . The City Attorney has advised that
the Citv does not have the legal authority to collect such fees
on behalf of AUSD, nor is does there appear to be nexus to
collect such a fee for this project but not the numerous other
PD' s approved recently. The author of the letter has indicated
he did not expect a change in the City' s process as a result of
this new boilerplate letter either.
Other City departments have reviewed the proposal in addition to
those above, but none of the public agencies reviewing the
project have expressed opposition or concerns regarding the
project that warrant additional conditions.

CONCLUSIONS•
This same basic project, minus the request to subdivide the
property, could be approved administratively through the precise
plan process. That is, all physical improvements being proposed
are consistent with, and could be approved under, existing
zoning.
The desire to create separate parcels not only benefits the
applicant it benefits the City as a whole by increasing the range
of housing options for its residents. Moreover, the "pride of
ownership" that would result from the creation of separate
parcels increases the likelihood that improvements will be
maintained and perhaps enhanced through time. These are benefits
which cannot be derived through present zoning.
Staff believes the project works not only on-site but in the
context of the neighborhood within which it is located and that
all the necessary Findings can be made for the establishment of a
Planned Development Overlay Zone and approval of the project.

CONDITIONS OF APPROVAL:
1. All development shall conform to the Master Plan of
Development contained in Attachment D and subject to the
requirements of this Attachment (Conditions of Approval) and
any other applicable standards,. codes and ordinances of the
City of Atascadero.
2 . Covenants, Conditions and Restrictions (CC&Rs) , or the
functional equivalent, shall be established to regulate land
use, control nuisances and maintain common access/parking
areas, landscaping, architecture and fencing in accordance
with Condition #1 above. Said CC&Rs shall be submitted to
the Community Development Department for review and approval
by the Community Development Department and City Attorney
prior to approval of the final map. The CC&Rs shall be
recorded prior to or in conjunction with the recording of
the final mao.
3. The existing detached garage shall be removed pursuant to an
approved building permit prior to parcel map recordation.
4. All fencing and landscaping within theJ
ro 'ect shall be in

accordance with Attachment D and shall be consistent in
design throughout the project. Proposed fencing in front
yards, and between the proposed new garage and Santa Ysabel
Avenue, shall not exceed three (3) feet in height.
5. Fencing and landscaping details shall be included in the
review of individual building permits for each of the
residences and shall be in place prior to final building
inspections. The landscape plan shall include the planting
of at least one ( 1) native tree on each new lot and shall
specify the manner in which remaining tree replacement
requirements are proposed to be met.
6 . Plans submitted for building permits on each lot shall
clearly indicate means by which utility meters and any other
above-ground mechanical equipment will be screened from
public view. Plans shall also specify exterior colors to be
used on buildings, colors which must me approved by the
Community Development Department prior to permit issuance.
7 . All buildings shall be equipped with low-flow, water
conservation fixtures and devices. Building permits shall
clearly indicate conformance with this condition prior to
their issuance.

Engineer Department Conditions
8 . All public improvements shall be constructed in accordance
with the City of Atascadero Engineering Department Standard
Specifications and Drawings or as directed by the City
Engineer.
S . The applicant shall enter into an Plan Check/Inspection
aGreement with the City. Prior to the recordation of the
parcel map, all outstanding plan check/inspection fees shall
be paid,
10. An encroachment permit shall be obtained from the City
Engineering Department prior to the issuance of building
permits.
11. All public improvements or improvements in the public right-
of-way shall be secured with a 100% Performance Guarantee
and a 50% Labor and Materials Guarantee until the public
improvements are deemed substantially complete by the City
Engineer. Prior to the final inspection of the public
improvements, and before the other guarantees mentioned in
this condition are released, a 10% Maintenance Guarantee
shall be ;posted to cover the public improvements for a
period ot: I year from the date of the final inspection. The
le guarantee amounts shall be based on an engineer' s estimate
submitted by the project engineer and approved by the City
Engineer. The estimate shall be based on City standard unit
?rices. The Guarantees posted for this project shall be
approved by -the City Attorney.
12 . A six ( 6 ) foot Public Utility Easement (PUE) shall be
provided contiguous to all street frontages.
13. The applicant shall be responsible for the relocation and/or
alteration of existing utilities.
14 . The applicant shall install all new utilities (water, gas,
electric, cable TV and telephone) underground. Utilities
shall be extended to the property line frontage of each
parcel or its public utility easement.
15. The applicant shall overlay any utility trenching in
existing streets to restore a smooth riding surface as
required by the City Engineer.
16 . The applicant shall construct drainage facilities to City of
Atascadero Standards. Each improvement shall be designed so
as to not increase the rate of flow of water onto adjacent
properties.

17 . Drainage shall cross lot lines only where a drainage
easement has been provided. Drainage from off-site areas
shall be conveyed across the project site in drainage
easements.
18. The applicant shall submit a grading and drainage plan,
prepared by a registered civil engineer, for review and
approval by the City Engineer prior to the recordation of
"]-ie -parcel map.
19 . ? sedimentation/erosion control plan addressing interim
erosion control measures to be used during construction
shall be submitted for review and approval by the City
Engineer_ if development is to occur between October 15 and
April 15. The erosion/sedimentation control plan shall be
prepared by a registered civil engineer.
20. The applicant shall submit road improvement plans prepared
by a registered civil engineer for review and approval by
the City Engineer prior to the recordation of the parcel
map. Road improvement plans shall conform to the
requirements of the City Standard Specifications, Section
2 - Preparation of Plans. R-value testing shall be done,
and the pavement section designed by a registered civil
engineer to the satisfaction of the City Engineer. Road
_rprovement plans shall include, but not be limited to the
ollowin_g:
a. Santa Ysabel Avenue shall be improved from centerline
to property frontage in conformance with approved plans
on file with the City Engineer for the reconstruction
of Santa Ysabel Avenue contiguous to the entire
property frontage, or as approved by the City Engineer.
The improvements may require the overlaying of existing
pavement to remedy an inadequate structural section or
to remedy a deteriorated paving surface. Transitions
shall be constructed to achieve a smooth join with
existing improvements.
21. The applicant shall monument all property corners for
construction control and shall be promptly replaced if
disturbed. The applicant shall install all final property
corners and street monuments, or bond form them, prior to
acceptance of the improvements.
22 . The applicant shall acquire title or interest in any off-
site land that may be required to allow the construction of
-the improvements. The applicant shall bear all costs
associated with the necessary acquisitions. The applicant
shall also gain concurrence from all adjacent property
owners whose ingress or egress is affected by these
improvements.

23. The applicant shall provide notice either on the parcel map
or by a separate instrument recorded on, concurrently with,
or prior to the recordation of the parcel map that there are
requirements for off-site and on-site improvements and that
construction of the improvements shall be required prior to
issuance of building permits or other grants of approval for
development of the parcels.
24 . The applicant shall pay all sewer annexation fees prior to
L.he recordation of the parcel map.
25. Each of the proposed parcels shall be served by individual
sewer and water line laterals extending along the proposed
access and utility easement and connecting to existing mains
in Santa Ysabel Avenue, rather than new main extensions on
private property as shown on the tentative map.
26 . The applicant shall submit a Driveway Maintenance Agreement
nor the driveway which serves each of the parcels. The form
and content of the Agreement shall be reviewed by the City
Attorney and City Engineer. The Agreement shall be recorded
prior to, or in conjunction with, the recording of the
parcel map.
27 . The applicant shall provide an access and utility easement

or the driveway which serves each of the parcels. The
easement shall be submitted for review and approval by the
,�..ity Enaineer. The easement shall be recorded prior to, or
conjunction with, the recording of the parcel map.
23. The applicant shall submit a written statement from a
registered civil engineer that all work has been done and is
in full compliance with the approved plans and Uniform
Building Code (UBC) prior to the final inspection.
29 . The applicant shall submit written certification that all
survey monuments have been set as shown on the parcel map
prior to the final inspection.
30. All existing and proposed utility, pipeline, open space,
scenic or other easements are to be shown on the parcel map.
if there are building or other restrictions related to the
easements, they shall be noted on the final map.
31. A parcel map drawn in substantial conformance with the
approved tentative map and in compliance with all conditions
set forth herein shall be submitted for review and approval
in accordance with the Subdivision Map Act and City of
Atascadero Subdivision Ordinance prior to recordation. The
map shall be signed by the City Engineer prior to it being
placed on the agenda for City Council acceptance.

32 . A preliminary subdivision guarantee shall be submitted for
review in conjunction with the processing of the parcel map.
33. A blackline clear Mylar ( 0.4 mil) copy and a blue line print
of the parcel map shall be provided to the City upon
recordation.
34 . A Mylar copy and a blue line print of as-built improvement
plans, signed by the registered engineer who prepared the
plans, shall be provided to the City Engineer prior to the
final inspection. A certification shall be included that
all survey monuments have been set as shown on the parcel
map.
35. This tentative map approval shall expire two (2 ) years from
the date of final approval unless an extension of time is
granted pursuant to a written request received prior to the
expiration date.

ORDINANCE NO. 322
AN ORDINANCE OF THE COUNCIL OF THE CITY OF
ATASCADERO AMENDING MAP 7 OF THE OFFICIAL ZONING MAPS
BY REZONING CERTAIN REAL PROPERTY AT 7265 SANTA YSABEL AVENUE
FROM RMF/16 TO RMF/16 (PD7)
(ZC 96016: SHANNON)
WHEREAS, the proposed zoning map amendment is consistent with
the General Plan in effect at the time of application acceptance,
as required by Section 65860 of the California Government Code; and
WHEREAS, the proposed amendment is in conformance with Section
65800 et seq. of the California Government Code concerning zoning
regulations; and
WHEREAS, the proposed amendment will not have a significant
adverse impact upon the environment. The Negative Declaration
prepared for the project is adequate; and
WHEREAS, the Atascadero Planning Commission held a public
hearing on February 18, 1997, and has recommended approval of Zone
Change 96016 .
NOW, THEREFORE, the Council of the City of Atascadero does
ordain as follows:
Section 1. Council Findings.
1. The proposal is compatible with surrounding land uses and
the zoning in effect at the time of application
acceptance.
2. The proposal is consistent with the General Plan
in effect at the time of application acceptance.
3. The proposal will not result in any significant adverse
environmental impacts. The Negative Declaration
prepared for the project is adequate.
4 . Modification of development standards or processing
requirements is warranted to promote orderly and
harmonious development.
5. Modification of development standards or processing
requirements will enhance the opportunity to best utilize
special characteristics of an area and will have a
beneficial effect on the area.

6 . Benefits derived from the overlay zone cannot be
reasonably achieved through existing development
standards or processing requirements.
7 . The proposed plans offer certain redeeming features to
compensate for requested modifications.
Section 2 . Zoning Map.
Map number 7 of the Official Zoning Maps of the City of
Atascadero on file in the City Community Development Department is
hereby amended to reclassify the parcels listed below, and shown on
the attached Exhibit A which is hereby made a part of this
ordinance by reference:
Portion of Lot 4 in Block K-A, Atascadero Colony
Assessor' s Parcel No. 030-011-008
Development of said property shall be in accordance with the
standards of the Planned Development Overlay Zone No. 7, any
applicable conditions of approval, and the Master Plan of
Development shown on the attached Exhibit B.
Section 3. Publication.
The City Clerk shall cause this ordinance to be published once
within fifteen ( 15) days after its passage in the Atascadero News,
a newspaper of general circulation, printed, published, and
circulated in the City in accordance with Section 36933 of the
Government Code; shall certify the adopting and posting of this
ordinance and shall cause this ordinance and this certification
together with proof of posting to be entered into the Book of
Ordinances of the City.
Section 4 . Effective Date.
This ordinance shall go into effect and be in full force and
effect at 12 : 01 a.m. on the 31st day after its passage.

Chairman Hageman - was c cerned if the appl ant understood Condi-
tion #2 which require that all business act'vities be conducted
inside the building Mr. Bauer responded that he understood the
condition. He exp ined that he didn't do repair ork on expensive
motorcycles outs 'de where there are leaves, dirt, wind blowing,
etc. He said at in the day time the motorcycle that aren't
being worked n would be pushed outside in the yard ' n order to
give them m e room to work inside. He repeated that 1 repair
work is do a inside and that there will be no outside dis ays .

Consideration of a request to establish a Master Plan of
Development (Planned Development Overlay Zone No. 7 ) and
subdivide an existing 0.56-acre (net) lot into four (4)
parcels for single family residential use. Subject site
is located 7265 Santa Ysabel Avenue. (Richard
Shannon/Sholders Land Surveys) .

STAFF RECOMMENDATION: (Gary Kaiser)
Staff recommends the following:
1 . That a Finding be made that the project would not have a
significant adverse effect on the environment and that the
Negative Declaration prepared for the project is adequate;
2 . That Zone Change #96016 be approved based on the Findings and
land use provisions contained in the Draft Ordinance
(Attachment I) ; and
3 . That Tentative Parcel Map #96016 be approved based on the
Findings contained in Attachment G and subject to the Condi-
tions of Approval 'contained in Attachment H.
Gary Kaiser provided the staff report pointing out that all the
PD(7) standards are met by this project; some are even exceeded.
He then responded to questions from the Commission.
Commissioner Sauter - asked for clarification of minimum lot sizes
versus density. Gary responded that one of the requirements for a
Planned Development is that the density that' s allowed in the
underlying zone cannot be exceeded.
Discussion continued regarding purpose of PD Standards and whether
flag lot standards applied to this planned development.
TESTIMONY:
Richard Shannon, applicant - informed the Commission that he and
his partner (Chuck Voorhees) worked extensively with staff to make
sure that this project met all the PD(7) Standards . He told the
Commission that he could build condominiums or apartments on this
property but that it had been his experience that people liked to
own the land under their unit and the application of PD Standards
allow just that.

RECOMMENDATION: j
It is recommended that the City Council schedule a publicworkshop to discuss Pavilion
issues prior to budgeting process ending in late spring.
DISCUSSION:
On January 28, 1997, the City Council was presented with a staff report outlining finance
options and recommendations to operate the Lake Park Pavilion. The City Council
determined at that time due to the complexity of the issues and potential mpact to the
community, that a public workshop on the Pavilion was needed,

Staff is requesting that a workshop date be set to give time to incorporate decisions
affecting the Pavilion funding into the Budget for FY 97-98.
