The site is currently zoned Commercial Professional with a Planned Development 3 overlay. The zoning is in conformance with the property' s "Office" general plan designation. The PD-3 overlay provides design guidelines to enhance the appearance of projects from Morro Road and to protect residential values on adjacent streets . There is no minimum lot size for parcels in the CP zone. It is the applicant' s intention to pursue general plan and zoning ordinance amendments to allow residential development on the two new lots that will front on Navajoa Avenue. Although the staff analysis of this proposal is not as yet complete, it appears at this point that the proposed amendments to the general plan and zoning maps will receive staff support. Such support would be consistent with a similar amendment affecting commercially zoned property on Navajoa Avenue previously approved by the Planning Commission and City Council. In the event that the general plan is not amended to allow residential development on Navajoa, this tentative map has been has attached conditions of approval that would preclude access from Navajoa. Access for non-residential development would be required to be by easement from Morro Road. In addition, setback standards will be imposed to preclude unnecessary physical and visual intrusion into the adjacent residential neighborhood. CONCLUSIONS: The proposed subdivision appears to be a reasonable precursor to modification of the general plan and zoning ordinance to allow residential development on Navajoa Avenue and a continuation of office development along Morro Road. The tentative map is conditioned to protect residential values along Navajoa if the anticipated general plan amendment is not completed. Water shall be obtained from the Atascadero Mutual Water Company. Water lines shall exist at the frontage of each parcel or its public utilities easement prior to recordation of the parcel map. Engineering Division Conditions: 2 . All public improvements shall be constructed .in accordance with the City of Atascadero Engineering Department Standard Specifications and Drawings or as directed bythe City Engineer. 3. The applicant shall enter into an Plan Check/Inspection agreement with the City. Prior to recordation of the parcel map, all outstanding plan check/inspection fees shall be paid. 4 . The applicant shall be responsible for the relocation and/or alteration of existing utilities. 9 . The applicant shall install all new utilities (water, gas, electric, cable TV and telephone) underground. Utilities shall be extended to the property line frontage of each lot or its public utility easement. 10. The applicant shall overlay any utility trenching in existing streets to restore a smooth riding surface as required by the City Engineer. 11 . The applicant shall construct all drainage facilities to City of Atascadero Standards. Each improvement shall be designed so as to not increase the rate of flow of water onto adjacent properties . 12 . Drainage shall cross lot lines only where a drainage easement has been provided. Drainage from off-site areas shall be conveyed across the project site in drainage easements . 13 . The applicant shall limit storm water discharge from the developed site to the design capacity of the downstream drainage improvements. The applicant shall demonstrate that the design capacity of the downstream drainage improvements, or natural water courses, can adequately convey the total flow of storm water from the fully developed watershed plus the developed project site without adversely affecting other properties . 14 . The applicant shall show both the pre-developed and post- developed 100-year limits of inundation on the grading and drainage plan. Drainage calculations in conformance with Section 5 of the City Standards shall be submitted for review and approval by the City Engineer prior to recordation of the parcel map. 17 . A sedimentation/erosion control plan addressing interim erosion control measures to be used during construction shall be submitted for review and approval by the City Engineer prior to the recording of the parcel map. The sedimentation/erosion control plan shall be prepared by a registered civil engineer. 18 . The applicant shall submit road improvement plans prepared by a registered civil engineer for review and 'approval by the City Engineer prior to recordation of the ';,parcel map. - Road improvement plans shall conform to the requirements of the City Standard Specifications, Section 2 - `Preparation of Plans . R-value testing shall be done, and the pavement section designed by a registered civil engineer to the satisfaction of the City Engineer. Transitions shall be constructed where required to achieve a smooth join with existing improvements. b. Highway 41 shall be improved as required by CalTrans . Slope easements shall be provided on each side of the right-of-way as needed to accommodate cut or fill slopes. 19 . The applicant shall monument all property corners for construction control and shall promptly replace them if disturbed. The applicant shall pay all sewer annexation fees prior to the recordation of the parcel map. 23 . The applicant shall submit a written statement from a registered civil engineer that all work has been completed and is in full compliance with the approved plans and the Uniform Building Code (UBC) prior to the final inspection. 24 . The statement shall provide the date the report was prepared along with the name and address of the soils engineer or geologist who prepared the report. 6 . All public improvements or improvements in the public right- of-way shall be secured with a 100% Performance Guarantee and a 50% Labor and Materials Guarantee until the improvements are deemed substantially complete by the City Engineer. Prior to the final inspection of the improvements, and before the other guarantees mentioned in this condition are released, a 10% Maintenance Guarantee 00002'7 1 EXHIBIT F Conditions of Approval Page 2 shall be posted to cover the improvements for a period of 1 year from the date of the final inspection. The guarantee amounts shall be based on an engineer' s estimate submitted by the project engineer and approved by the City Engineer. The estimate shall be based on City standard unit prices . The Guarantees posted for this project shall be approved by the City Attorney. 7 . A six (6) foot Public Utility Easement (PUE) shall be provided contiguous to all street frontages. 8. The applicant shall be responsible for the relocation and/or alteration of existing utilities. 9 . The applicant shall install all new utilities (water, gas, electric, cable TV and telephone) underground. Utilities shall be extended to the property line frontage of each lot or its public utility easement. 10. The applicant shall overlay any utility trenching in existing streets to restore a smooth riding surface as required by the City Engineer. 11. The applicant shall construct all drainage facilities to City of Atascadero Standards. Each improvement shall be designed so as to not increase the rate of flow of water onto adjacent properties. 12 . Drainage shall cross lot lines only where a drainage easement has been provided. Drainage from off-site areas shall be conveyed across the project site in drainage easements . 13. The applicant shall limit storm water discharge from the developed site to the design capacity of the downstream drainage improvements. The applicant shall demonstrate that the design capacity of the downstream drainage improvements, or natural water courses, can adequately convey the total flow of storm water from the fully developed watershed plus the developed project site without adversely affecting other properties . 14. The applicant shall provide a public drainage easement in conformance with Section 5.03 of the City Standards between Navajoa Avenue and the State Highway 41 right-of-way to o0o0z8 EXHIBIT F Conditions of Approval Page 3 convey storm water discharging from the existing culvert under Navajoa Avenue and other off-site areas `;, across the site or as approved by the City Engineer. 15 . The applicant shall submit a grading and drainage plan, prepared by a registered civil engineer, for review and approval by the City Engineer prior to the recordation of the parcel map. 16. The applicant shall show both the pre-developed and post- developed 100-year limits of inundation on the grading and drainage plan. Drainage calculations in conformance with Section 5 of the City Standards shall be submitted for review and approval by the City Engineer prior to recordation of the parcel map. 17 . A sedimentation/erosion control plan addressing interim erosion control measures to be used during construction shall be submitted for review and approval by the City Engineer if development is to occur between October 15 and April 15. The sedimentation/erosion control plan shall be prepared by a registered civil engineer. 18 . The applicant shall submit road improvement plans prepared by a registered civil engineer for review and approval by the City Engineer prior to recordation of the parcel map. Road improvement plans shall conform to the requirements of the City Standard Specifications, Section 2 - ' Preparation of Plans . R-value testing shall be done, and the pavement section designed by a registered civil engineer to the satisfaction of the City Engineer. Road improvements shall include, but not be limited to the following: a. Navajoa Avenue shall be improved from centerline to the property frontage in conformance with City Standard 405 (Local) contiguous to the entire property frontage, or as approved by the City Engineer. The improvements may require the overlaying of the existing pavement to remedy an inadequate structural section or to remedy a deteriorated paving surface. Transitions shall be constructed where required to achieve a smooth join with existing improvements . b. A 5 ' wide offer of dedication shall be provided along the entire Navajoa Avenue property frontage. Offers of dedication shall be recorded prior to, or in conjunction with, the parcel map. d. Slope easements shall be provided on each side of the right-of-way as needed to accommodate cut or fill slopes . 19 . The applicant shall monument all property corners for construction control and shall promptly replace them if disturbed. The applicant shall install all final property corners and street monuments, or bonded for them, prior to acceptance of the improvements. 24. The applicant shall acquire title or interest in any off- site land that may be required to allow for the construction of the improvements. The applicant shall bear all costs associated with the necessary acquisitions. The applicant shall also gain concurrence from all adjacent property owners whose ingress or egress is affected by these improvements . 21 . The applicant shall provide notice either on the parcel map or by a separate instrument recorded on, concurrently with, or prior to the recordation of the parcel map that there are requirements for off-site and on-site improvements and that construction of the improvements shall be required prior to issuance of building permits or other grants of approval for development of the parcels. 22 . The applicant shall pay all sewer annexation fees, if . required, prior to the recordation of the parcel map. 23 . The applicant shall submit written certification that all survey monuments have been set as shown on the parcel map prior to the final inspection. Fire Department Conditions: 25. A fire hydrant shall be installed to City standards along Morro Road in conjunction with the installation of the other required improvements. The type and exact location of the hydrant shall be as approved by the Fire Marshal during the review of road improvement plans. 26. The existing wharf head hydrant located at the property corner on Navajoa Avenue shall be upgraded to City standards . Caltrans Conditions : 27 . An encroachment permit shall be obtained prior to commencement of work within the State right-of-way. Planning Division Conditions: 28. No access for non-residential development of Parcels 1 and 2 shall be taken from Navajoa Avenue. Access for non- residential development on Parcels 1 and 2 shall be provided by easement extending to Morro Road. If this `map records prior to approval of a general plan amendmentchanging the designation of the parcels fronting on Navajoa Avenue to a residential designation, said access easement(s) shall be shown on the final map. 29 . A 25 foot building setback from the right-of-way of Navajoa Avenue shall be established on Parcels 1 and 2 . A note regarding this building setback shall appear on the final map or be recorded as a separate instrument prior to or simultaneously with the recordation of the final map. 30. It is a natural outdoor amphitheater which was used by city residents for various gatherings until 1926. ALPS has pledged to raise $65,000 as part of the purchase through fund raising events. BACKGROUND: Council adopted Ordinance No. 269 on May 11, 1993, which allows the City to place delinquent solid waste bilis on the property tax roll, provided: 1) That the charges were over 60 days delinquent 2) That the charges could be assessed only after a Public Head g, and 3) That each effected property owner would receive written noti ten days prior to the hearings. Notices have been mailed to the property owners prior to this scheduled meeting. DISCUSSION: The total amount of outstanding bills to be placed on the tax rolls is$8,8 0.75. Council has the discretion to remove individual accounts from the listinj 3 in Resolution No. 67-96, based on circumstances presented at the hearing. However, C uncil's decision to remove an individual account would. not necessarily preclude Atascadero Waste Alternatives from pursuing other means of collection. Atascadero Waste Alternatives representatives will be present to respond to individual questions. It should be noted that some accounts may have been paid in full or res Ived in some other manner prior to the hearing. Atascadero Waste Alternatives is tracking I hese accounts and will be able to report any accounts that should be removed from the listir g for that reason. FISCAL IMPACT: The total$8,870.75 will net the City an additional $443.54 in franchise fee revenues. 000039 RESOLUTION NO. 67-96 A RESOLUTION OF THE COUNCIL OF THE CITY OF ATASCADERO PLACING DELINQUENT SOLID WASTE CHARGES ON THE 1996-97 PROPERTY TAX ROLL WHEREAS, Government Code' Sections 38790.1 25831 allows -cities to place delinquent solid waste bills onto the annual property tax roll, under certain conditions, and WHEREAS, the City Council adopted Ordinance 269 on May 11, 1993, applying the provisions of said Government Code to the City of Atascadero; and WHEREAS, all property owners with delinquent solid waste fees of at least sixty(60) days were duly notified in writing that their delinquent fees would be placed on the FY 1996-97 property tax rolls, after a public hearing scheduled for July 9, 1996; and WHEREAS, Council had duly held a public hearing concerning the placement of delinquent solid waste fees on the FY 1996-97 property tax rolls; and WHEREAS, at said hearing the attachT report marked "Exhibit K containing the delinquent fees by Assessor's Parcel Number was duly received by said Council; and WHEREAS, at said public hearing opportunity was given for filing objections and protests inpresentation of testimony or other evidence concerning same; and WHEREAS, it is in the public interest that this body confirm the report presented at the hearing. BACKGROUND.- On ACKGROUND:On April 23, 1996, Council adopted a resolution declaring that all noxious or dangerous weeds or other flammable material that create a fire hazard and/or constitute a public nuisance and authorize the Filt Chief to proceed with abatement: During the period from April 26th to May 14th, notices were mailed to property owners informing them of weed abatement requirements. A public hearing regarding appeals was held on May 28 1996. The weed abatement contract was awarded at that meeting to.Jack Bridwell to abate parcels which were not abated by property owners. Abatement work began on June 6, 1996 and continued through July 17, 1996. An itemized list of weed abatement assessments was posted with the City Clerk and at the Fire Station on_July, 19, 1996. 1 A total of 171 parcels were abated. FISCAL IMPACT: No direct fiscal impact. (2) Introduce Ordinance No. 307 by title only. (3) Refer to the Traffic Committee staff proposals for posting the downtown BACKGROUND: The City Council held a public hearing on a skateboard/skating ordinance at its July 7, 1996, City Council meeting. Staff was directed to revise the ordnance proposed on July 7, 1996. This ordinance attempts to reflect the City Council' direction. This ordinance prohibits skateboarding and skating on public alld private property (business establishments, parks and public buildings) where posted. In addition, the ordinance authorizes the seizure of the skateboard or skates by the police as evidence. Violations may be cited by the police officel, or charged by the City Prosecutor as an infraction or misdemeanor. A proposal for posting the downtown has been submitted by the Police Department. Staff is suggesting it be referred to the Traffic Committee with di ction to work with the local skating community. If referred as proposed, staff wolild request that the Traffic Committee's recommendation be sent to the City Council prior to the effective date of this ordinance (9/12/96). Section 4-2.1008 is amended to read as follows: 4.2.1008. Skateboards prohibited where posted. (a) It is unlawful for any person on a skateboard, roller skates or similar-device to go on any public or privately owned sidewalk, parking lot or pedestrian walkway that is generally held open for public use to serve a facility which serves the public, including, but not limited to, shopping centers, professional offices, malls, movie theaters, restaurants, hotels, motels, retail stores, bowling alleys, awl' other business establishments, school sites and administration building, parks and public buildings, if properly posted as set forth in subsection (b) of this section.
