The meeting was called to order at 7 : 30 p.m. by Mayor Wilkins
with the Pledge of Allegiance. Mayor Wilkins gave the invocation.

PUBLIC COMMENT
(1) Mr. Bruno Adamoli addressed the Council concerning alleged
unsanitary conditions at Drake' s Chicken Yard. He had
brought this matter to the attention of the Health Department and
_Planning Commission without results. Mr. Warden suggested an appoint-
ment for Tuesday, June 23 , 1981, at 1 : 30 p.m. , r _

Mayor Wilkins reviewed the Consent Calendar.
MOTION: Councilman Stover moved for approval of the Consent Calen-
dar. The motion was seconded by Councilman Highland and
unanimously carried by roll call vote.
B. HEARINGS, APPEARANCES AND REPORTS
1. Appearance by Richard Summers and Karl Keski regarding
Service Club project to renovate Pavilion
Mr. Richard Summers reviewed tentative plans to renovate the
Pavilion at Atascadero Lake. He was seeking community participation

to help the Rotary Club organize a fund raising campaign to renovate
the Pavilion for use as a multi-purpose facility to accommodate
luncheons, banquets, assemblies, recreation uses, etc. Initial
renderings feature a Spanish style architecture with renovation costs
estimated to be from $350, 000 to $400, 000.
Mr. Summers stated that, at this time, the Rotary Club is seeking
a vote of confidence and conceptual approval from the Council.
Mr. Warden advised that the 5-Year Capital Improvement Program includes
$200, 000 to be used for renovating the Pavilion.
MOTION: Councilman Nelson moved for Council support of this project
and to encourage service club and community involvement.
The motion was seconded by Councilman Stover and unani-
mously carried.
2. Appeal of David McMillan (Chidlaw) from Planning Commission
conditions of approval for Departmental Review R810330 : 1,
8375 Morro Road, to allow conversion of an existing single
family residence to a commercial office use and consideration
of Resolution No. 16-81 approving said use subject to
certain conditions (continued from 6-8-81)
Mr. Stevens reviewed the resolution noting that it formalizes
the Council ' s decision as expressed at the last meeting. In addition
to other factors, access to the property by way of Amapoa was approved.
He stated that the General Plan is explicit about prohibiting access
to Amapoa in conjuction with a commercial development. He noted
that the General Plan should be amended if access by Amapoa was to
be permitted.
MOTION: Councilman Mackey moved that Resolution No. 16-81 be read by
title only. The motion was seconded by Councilman Nelson
and unanimously carried.

MOTION: Councilman Mackey moved for adoption of Resolution No. 16-81 .
The motion was seconded by Councilman Stover and unanimously
carried by roll call vote.
MOTION: Councilman Highland moved that Council adopt a policy that
access be permitted through Amapoa until such time as a
continuous left turn lane is constructed along Morro Road or
the General Plan is amended to remove the prohibition on
Amapoa access. The motion was seconded by Councilman Stover
and unanimously carried.
3. Public hearing on Variance V810408 : 1, 5955 Traffic Way, G.
D. Spradlin (Lindenthaler & Courtney Associates) , to allow

four parking spaces instead of five; one of the four spaces
provided on-site being substandard in width
The original application on this matter had noted the need for
compact car spaces and stated that the size of the site prevented
compliance with the parking space requirement. The application also
noted that the development is desirable for the area. The Planning
Commission had denied the Variance based on Findings 1-3 as listed in
the Staff report dated May 18 , 1981.
Larry Kelley, representing the applicant, spoke on behalf of the
appeal. He pointed out that the applicants have another approved
project located on Traffic Way with 24 parking spaces . Considered
jointly, there would be a significant increase in total parking in the
area with a deficiency of only one space. He felt that the width of
the lot and its size was a hardship justifying a variance. There was
a brief discussion among the Council concerning the problems of
downtown parking.
MOTION: Councilman Highland moved that the appeal be denied. The
motion was seconded by Councilman Stover and unanimously
carried.
• 4 . Public hearing on Zone Change 2810429: 1, 10905 San Marcos
Road, John W. Morris, to allow a change of zone from
A-1-B-V-5 to A-1-2 1/2
The Planning Director presented a brief report outlining the
Planning Commission' s recommendation for denial of the Zone Change.
John Morris, applicant, spoke in support of the Zone Change to
allow future division of the property. Mr. Morris reviewed each of
the General Plan criteria pointing out how his request complied. He
also noted several other similar projects that had been previously
approved.
MOTION: Councilman Stover moved for denial of Zone Change 2810429 :1 .
The motion was seconded by Councilman Mackey and unanimously
carried by roll call vote.
5 . Public hearing on Zoning Ordinance Amendment ZA 810420 :1 ,
Ordinance No. 41, initiated by Planning Commission to
consider zoning ordinance text amendment to establish regu-
lations for mobilehomes in single family residential zones
Mr. Stevens reviewed SB 19-60 which establishes new provisions
allowing mobilehomes in single family residential cones . He stated
• that the Planning Commission had recommended that existing regulations
be revised to allow mobilehomes in some single family zones subject to
additional architectural requirements . The ordinance presented for
Council consideration reflects this recommendation.

MOTION: Councilman Highland moved that Ordinance No. 41 be read by
title only. The motion was seconded by Councilman Stover
and unanimously carried.
Mayor Wilkins read Ordinance No. 41 by title only.
MOTION: Councilman Nelson moved that this constitute the first
reading of Ordinance No. 41 . The motion was seconded by
Councilman Stover and unanimously carried.
6 . Public hearing to consider proposed uses for $165 , 946 of
Revenue Sharing Funds for 1981-82 Fiscal Year Budget
Mayor Wilkins opened the matter to public hearing. Daphne
Fahsing, representing Action for Animal Rights, spoke in support of-
AFAR' s request for $5, 000 of Revenue Sharing monies. Councilman
Mackey suggested, that this request be considered with other requests
for financial assistance in the regular budget.
MOTION: Councilman Mackey moved to accept the Revenue Sharing
allocations as presented by Staff. The motion was seconded
by Councilman Stover and unanimously carried.
7 . Public hearing on Fiscal Year 1981-82 Final Budget .
Mr. Warden advised that the City had received two additional
requests for financial assistance; one from India, Inc . , in the amount
of $400 for supporting cultural arts and one from the Emergency
Medical Services program of San Luis Obispo County for $3 ,426 . Council
considered each request individually as follows :
a. Action for Animal Rights request for $5, 000
MOTION: Councilman Mackey moved for approval of the request of AFAR
for $5, 000. The motion was seconded by Councilman Highland.
Councilman Highland felt that there should be some sort of con-
tractual arrangement with AFAR for these funds.
Councilman Mackey amended her motion to include that these
funds only be used in the City of Atascadero and that
appropriate documents between the City and AFAR be prepared
for use of these funds. The amendment was accepted by
Councilman Highland and the motion carried on the following
roll call vote:
AYES : Councilmen Highland, Mackey, Nelson and Stover

b. India, Inc . , request for $400
MOTION: Councilman Mackey moved that the request of India, Inca be
denied. The motion was seconded by Councilman Nelson and
unanimously carried.
C. Request of San Luis Obispo County Symphony for $400
MOTION: Councilman Nelson moved that the request of the San Luis
Obispo County Symphony be approved. The motion was seconded
by Councilman Mackey and carried on the following roll call
vote:
AYES : Councilmen Mackey, Nelson and Highland
NOES: Councilman Stover and Mayor Wilkins
d. Request of Family Services for $500
MOTION: Councilman Nelson moved for approval of the request of
Family Services in the amount of $400 . The motion was
seconded by Councilman Mackey and carried on the following
• roll call vote
AYES : Councilmen Highland, Mackey, Nelson, and Stover
NOES : Mayor Wilkins
e. Chamber of Commerce' s request for $16 , 500
MOTION: Councilman Highland moved that this matter be deferred until
the Council receives a work program or use designation for
the requested funds . The motion was seconded by Councilman
Mackey and unanimously carried.
f. Request of Self Help Housing for $4 , 000
MOTION: Councilman Stover moved that the request be approved in the
amount of $4 ,000. The motion was seconded by Councilman
Mackey and unanimously carried.
g. Hotline ' s request for $500
MOTION: Councilman Mackey moved for approval of the request from
Hotline for $400. The motion was seconded by Councilman
Nelson and unanimously carried.
h. Senior Citizens, Inc . request for $5, 344
• MOTION: Councilman Highland moved for approval of the request of the
Senior Citizens in the amount of $5 , 344 , or less depending

on transportation needs. The motion was seconded by
Councilman Mackey and carried on the following roll
call vote:

ABSTAIN: Councilman Stover
i. Request of EMS for $3, 426
MOTION: Councilman Highland moved that this matter be deferred and
that Staff attempt to get further information. The motion
was seconded by Councilman Stover and unanimously carried.
MOTION: Councilman Highland moved that Council adopt the Fiscal Year
1981-82 Budget as amended subject to salary negotiations and
reconsideration of the Chamber of Commerce request. The
motion was seconded by Councilman Nelson and unanimously
carried by roll call vote.
MOTION: Councilman Highland moved that salary negotiation settle-
ments be retroactive effective to July 1 , 1981 , providing 18
that negotiations are completed by no later than August 15,
1981 . The motion was seconded by Councilman Nelson and
unanimously carried.
8 . Public hearing on weed abatement protests
Mr. Warden explained the weed abatement procedure. Mayor Wilkins
asked for comments or protests regarding weed abatement. Doug Lewis
had questions regarding the procedure and he was instructed to contact
the Fire Chief for information.
MOTION: Councilman Nelson moved that Council approve the weed
abatement process subject to the exception of Mr. Doug
Lewis working out his problem with the Fire Chief and,
if Mr. Lewis ' problem cannot be worked out, he will be
subject to the abatement process. The motion was
seconded by Councilman Highland and unanimously carried.

D. NEW BUSINESS
1. Ordinance No. 40 modifying the State speed limit on certain •
streets or portions thereof - first reading
Mr. Warden reviewed the survey taken which resulted in the

recommendations set forth in the Ordinance.
MOTION: Councilman Highland moved that Ordinance No. 40 be read by
title only. The motion was seconded by Councilman Stover
and unanimously carried.

reading of Ordinance No. 40 . The motion was seconded by
Councilman Stover and carried on the following roll call

2. Consideration of Fiscal Year 1980-81 Final Budget, Proposi-
tion 4 budget, with resolution specifying expenditure limit
MOTION: Councilman Highland moved that Resolution No. 18-81 be read
by title only. The motion was seconded by Councilman Stover

3. Consideration of Resolution No. 17-91 approving Lease
Agreement with the State of California for State Hospital
property
MOTION: Councilman Nelson moved that Resolution No. 17-81 be read by
title only. The motion was seconded by Councilman Stover
and unanimously carried.

4 . Consideration 'of Agreement with City Attorney for services

motion was seconded by Councilman Highland and unanimously
carried by roll call vote.

5 . Consideration of amending the "Power Plant acrid Industrial
Fuel Use Act of 1978"
MOTION: Councilman Highland moved to direct Staff to draft a reso-
lution supporting P.G. &E. ' s position. 'The motion was
seconded by Councilman Stover and unanimously carried by
roll call `vote.

be needed in e final budget. One was an expenditure
for the telephone system to llow the Fire- Department the capability
for an intercom with other Ci y offices. The other item is a door
speaker connecting with t e Pdlice Dispatch center so that the dis-
patchers could answer th ` door after hours without having to leave
the radios. Also, an acditionl trunk line is needed because of the
number of calls being received.\ The total cost will be approximately
$4 ,531.
MOTION: Councilman„¢Highland moed that $4 ,531 .65 be included in
the Fiscal` Year 1981-82`Nbudget for the purposes outlined
above. The motion was seconded by Councilman Stover and
unanimou°'sly carried by roll call vote.

}has transferred 13 lots of lake property to the City,
at no cost, . prq'vided the property is. used for public recreation
purposes.

5. Consideration of amending the "Power Plant and Industrial
Fuel Use Act of 1978"
MOTION: Councilman Highland moved to direct Staff to draft a reso-
lution supporting P.G. &E. ' s position. The motion was
seconded by Councilman Stover and unanimously carried by
roll call vote.

turned to regular session at 12 : 10 p.m. It was announced that
Council would make a motion regarding the lawsuit brought against
the City of Atascadero by the Firefighters Association and the deci-
sion by the Superior Court Judge.

MOTION: Councilman Highland moved that the decision concerning the
Firefighters Association lawsuit be appealed. The motion
was seconded by Councilman Stover and unanimously carried.

REQUEST: To allow a four unit air space condominium conversion
On July 6 , 1981 the Planning Commission conducted a public hearing
unanimously, with Commissioner Lilley not participating due to a
potential conflict of interest, adopting Findings 1-2 and approving
the condominium conversion subject to Conditions 1-8 , as provided
in the attached Staff Report, with the addition of Condition #9
as follows :
"9. Submit two copies of detailed landscaping and irrigation
plans indicating size, type, and spacing of plant materials
proposed for review and approval by the Planning Department
prior to recordation of the Final Map.
a. Plant materials shall be sized to achieve' a mature
appearance within three years .
b. The type of irrigation system shall depend upon the
plant materials used and the watering needs .
There was some concern expressed by the Commission concerning the
effect of the condominium conversions considered over the past
several months . There was also some discussion concerning the
current appearance and long-term maintenance of the property.
Orville Poler, applicant's engineer, spoke and indicated concurrence
with the recommended conditions.
Joe Blanco, a neighbor, spoke objecting to a weed problem on the
applicant' s property.
Herb LaPrade voiced his objection to condominium conversions for
small projects such as this .
No one else appeared on the matter.

APPLICANT: Bunyea Development Corporation
REQUEST: To allow a four unit air space condominium conversion
BACKGROUND
1. Existing Zoning: R-2-B-2-D
2 . General Plan: High Density Multiple Family Residential
3. Environmental Determination: The Planning Director has deter-
mined the project to be a Class 1 Categorical Exemption
according to the provisions of the California Environmental
Quality Act.
4 . Site Conditions : The site is currently developed with two
duplexes for a total of four units. Two mature walnut trees
front Santa Ynez .
5. Project Description: The applicant is proposing to subdivide
four existing apartment units into air-space condominiums.
The applicant proposes to apply $100 of a tenant' s monthly
rent towards the purchase price of a unit upon approval of
the tentative map.
STAFF COMMENTS
On June 4, 1981 the Subdivision Review Board met with the applicant
to review the project. Also attending the meeting were : Mary
Beatie, Associate Planner; John Kennaly, Assistant Civil Engineer;
Don Sylvia, Fire Chief; and Robert Lilley, Planning Commissioner.
It should be noted that Mr. Lilley did not participate in this
discussion due to possible conflict of interest. The following
items were discussed at the meeting:
1. No fire hydrant is necessary.
2 . Remove temporary power pole south of Unit 4 prior to Final Map.

3 . Install concrete curb, gutter and sidewalk along Navajoa and
Santa Ynez frontages.
4. Require paved driveways.
5. Submit verification of notice to new tenant. This was provided
at the meeting.
6. Provide 5 ' offer of dedication on Navajoa.
7. Submit CC&Rs prior to recordation of Final Map.
8. Continue to show compliance with Sections 66427 . 1 (c) , 66427.1 (d) ,
and 66452. 8 of the Subdivision Map Act,
9. Is any sort of incentive package proposed for tenants to purchase
units or any aide program to relocate? Indication was made at
the meeting that tenants would be allowed to apply $100 of
their monthly rent after approval of the Tenative Map toward
• the purchase of their unit.
10. Consideration given to a possible additional offer of dedica-
tion and sidewalk relocation to save a tree.
11. Possible need for a drainage inlet on Santa Ynez .
FINDINGS
1. The application as presented is exempt from the requirements
of C.E.Q.A.
2. The application as submitted conforms to the applicable zoning
and subdivision regulations and is consistent with the 1980
Atascadero General Plan.
RECOMMENDATION
Based upon the above findings , the Planning Department recommends
approval of Tentative Tract Map AT 810526 :1 subject to the follow-
ing conditions :
1. The applicant shall establish Covenants, Conditions, and Re-
strictions (CC&Rs) for the regulation of land use, control of
• nuisances and architectural control of all buildings and
facilities.

a. These CC&Rs shall be submitted for review and approval by
the City Attorney and the Planning Department prior to
approval of the Final Map.
b. These CC&Rs shall be administered by a Condominium Home-
owner' s Association.
2. The applicant shall comply with the following sections of the
1981 Subdivision Map Act:
a. Section 66427. 1 (c) provision for 180 day written notice of
intention to convert prior to termination of tenancy.
b. Section 66427 .1 (d) right to purchase unit for 90 days at
same or more favorable terms .
C. Section 66452. 8 notice to new tenants that units are being
converted.
3. Remove the existing temporary power pole south of Unit 4 prior
to recordation of the Final Map.
4. Applicant shall install concrete curb, gutter and 5 ' wide.
sidewalks along the Santa Ynez and Navajoa frontages of the
subject property prior to approval of the Final Map.
a. A five foot offer of dedication shall be provided along
the property frontage on Navajoa.
b. Said improvements shall be constructed under an inspection
agreement and encroachment permit issued by the Public
Works Department.
C. The catch basin fronting Santa Ynez to be upgraded to a
12 inch CMP.
d. Provision shall be made to save the walnut tree within the
existing right-of-way on Santa Ynez .
e. The road patch for the sewer lateral in Santa Ynez to be
replaced in order to protect the roadway from infiltration.
f. Improvements may be deferred by improvement bond or similar
guarantee.
5. The driveways and parking areas shall be paved prior to recorda-
tion of the Final Map. A plan showing the paving improvements •
shall be submitted to the Planning Department prior to initiating
the work.

6 . That all conditions of approval herein specified are to be
complied with prior to the filing of the Final Map.
7. Approval of this Tentative Tract Map shall expire 18 months
from the date of this approval unless an extension of time
is granted pursuant to a written request prior to the expi-
ration date.
8. A Final Map in compliance with all conditions set forth herein
shall be submitted for review and approval in accordance with
the Subdivision Map Act and the City Lot Division Ordinance
prior to recordation.
a. Monuments shall be at all new property corners and a
Registered Civil Engineer or licensed land surveyor shall
submit a letter certifying that the monuments have been
set prior to recordation, unless certification is received
that corners are already monumented.
b. A final title policy (CLIA or ALTA) shall be submitted for
• review in conjunction with the processing of the Final Map.
ACTION
The Planning Commission should by motion direct Staff as deemed
appropriate.
TO APPROVE: Motion to adopt findings and set conditions .

Negative Declaration, adopted Findings 1-2 and approved the land
division subject to Conditions 1-14 as provided in the attached
Staff Report. It should be noted that the conditions require re-
duction of the number of lots to three and redesign of the parcel
map.
iThere was some discussion among the Planning Commission concerning
the basis for recommending a reduction in the number of lots , con-
cerning the slope of the driveway easement, concerning zoning and
general plan consistency and concerning the assessment district
to improve San Fernando Road.
Edith Hessick, applicant, and Dan Stewart, applicant' s engineer,
spoke in support of the application requesting four 2 .5 acre lots.
Mr. Stewart pointed to his slope analysis and inquired about the
zoning consistency studies. The applicant did not object to any
of the other conditions .

LOCATION: 2205 San Fernando Road (Lot 17 , Block 46)

REQUEST: To allow subdivision of ten acres into four parcels
of 2. 5 acres each
BACKGROUND
1. Existing Zoning : A-1-B-V-3`-D
2 . General Plan: Suburban Single Family Residential
3 . Environmental Determination: An initial study environmental
description form has been completed. The Planning Director
has prepared a Draft Conditional Negative Declaration indica-
ting the project will not have a significant adverse effect
upon the environment if certain mitigation measures are
incorporated into the project.
4 . Site Conditions: The subject property is generally characterized
by moderately steep slopes. The estimated average slope is
about The vegetation on the site is primarily natural
grasses and several oak trees. The site is also characterized
by two ridge lines trending generally north-south and which
divide ,the property basically into three sections. The prop-
erty fronts on San Fernando. City water is available to the
site and a fire hydrant exists on the northeasterly side of
the road near the northerly corner of the property. Lots on
either side of the subject property are vacant and there are
scattered single family dwellings in the vicinity. Lot 24 in
Block 47 , which is directly across from the subject lot, just
recently received approval for a three-way lot division creating
two parcels at 3 . 0-plus acres and one a five-plus acre. City
sewer is not available.
5. Project Description: The applicant is proposing to subdivide
the subject 10 . 0 acres into four parcels of 2 . 5 acres each.
A private access easement is proposed off San Fernando entering
the property generally at the midpoint of its frontage and ex-
tending straight back to the approximate center of the site.
The site is being divided into four equal parts by division
lines bisecting the length and width of the lot.

. STAFF COMMENTS
On Thursday, June 4 , 1981 the Subdivision Review Board met with
the applicant, Edith Hessick and her engineer, Daniel Stewart,
to discuss this application. Also attending that meeting were :
Mary Beatie, Associate Planner; John Kennaly, Assistant Civil
Engineer; Don Sylvia, Fire Chief; and Bob Lilley, Planning
Commissioner. The following items were discussed:
.1) Provide plan and profile of access easement prior to Final Map.
2) Underground utility lines in the area; building restrictions?
3) Four lots seem to be too dense for the area.
4) Recommendation for a Conditional Negative Declaration concerning :
- fire hazard
- grading
- lot access
• - drainage control and erosion control
5) Improvement of San, Fernando Road.
There was extended discussion regarding the zoning, A-1-B-V-3 , and
the appropriate lot size for this property. It was pointed out
that approval had previously been given to a three-way division
creating two parcels at 3 . 0 acres and one at 5 . 0 on a lot directly
across San Fernando from this property and also in the A-1-B-V-3
zone. The original application had requested one parcel at 2. 8
acres, one at 3 . 0 and one at 5 . 3 . The final recommendation re-
quired the enlargement of the smallest parcel up to at least three
acres to comply with the zoning.
Dan Stewart, this applicant ' s engineer, submitted a slope study for
the subject property which indicated approximately 31,- acres had
slopes greater than 30% and 61-, acres had slopes ranging from 100
to 300 . The Planning Department prepared a separate slope analysis
which revealed that there were roughly 4 . 2 acres with slopes exceed-
ing 30% , 3 . 2 acres having slopes ranging from 20-300, and 2. 6 acres
with slopes ranging from 10-20% slopes. This would -indicate that
almost 75% of the site has slopes which exceed 20 The following
is an excerpt from Section 22 . 70 . 030 of the zoning ordinance regard-
ing the determination of the appropriate lot size in the A-1-B-V-3
zone :

It would be Staff ' s opinion that with three-quarters of the site
exceeding 20% slope that the appropriate lot size according to the
zoning would be at least 3 or 32 acres. Generally only a few
areas along the ridge tops have slopes less than 20% , and in terms
of complying with requirements to minimize grading, these would be
the logical areas to build; these areas constitute only 26% of the
site.
FINDINGS
1. The application as presented will not have a significant effect
upon the environment and the preparation of an Environmental
Impact Report is not necessary.
2. The land division as recommended conforms to the applicable •
zoning regulations and is consistent with the 1980 Atascadero
Plan.
RECOMMENDATION
Based upon the above findings, the Planning Department recommends :
A) Issuance of a Conditional Negative Declaration as follows :
1. That provision shall be made to reduce fire hazard at the
site.
2 . Adequate provisions shall be made for drainage and erosion
control and protection in _conjunction with site development.
3 . That provision be made for adequate access including pro-
vision for improvements and slope protection.
4. That grading and tree removal be minimized during all site
development; and,
B) Approval of the Tentative Parcel Map AT 810430 :1 subject to the
following conditions :
1. Private sewage disposal systems will be an acceptable method
of sewage disposal, if reports, tests, and design are
acceptable. All tests , reports and designs shall conform
, to methods and guidelines prescribed by the Manual of Septic

Tank Practice and other applicable City ordinances . The
following shall appear as a Note on the Final Map :
"Appropriate soils reports including a percolation test,
a test to determine the presence of ground water, and a
log of a soil boring to a minimum depth of ten (10) feet
shall be submitted to the Atascadero Planning Department
prior to the issuance of a building permit on each lot.
Where soils reports indicate that conventional soil ab-
sorption systems are not acceptable, City approval of
plans for an alternative private sewage disposal system,
designed by a Registered Civil Engineer, shall be required.
Depending upon the system, more restrictive requirements
may be imposed. "
2 . Water shall be obtained from the Atascadero Mutual Water
Company and water operable facilities shall exist at the
frontage of all parcels prior to filing of the Final Map.
3 . Other utilities available to the area shall be extended
• to the front of each parcel created prior to recordation
of the Final Map. Any utility easements are to be shown
on the Final Map.
4 . The number of new parcels being created shall be reduced
to three in number and each parcel shall be at least three
acres in gross measurement.
a. A revised tentative map showing lot configuration and
access to each parcel shall be submitted to the Planning
Department for review and approval.
5 . Plan and profile drawings of proposed driveway (s) shall
be submitted prior to recordation of Final Map for approval
by the Public Works and Planning Departments in order to
determine average grade and appropriate improvement require-
ments. If average slope exceeds 120 , paved improvement
would be a requirement at the time of application for
building permit. Otherwise, an all-weather surface would
be required similarly. In no event will driveways be
allowed which exceed 20o in slope . In the event any por-
tion of the driveway shall be shared, improvement of that
shared portion shall be a requirement made in conjunction
with the first building permit. Notes to these effects
shall appear on the Final Map.
6 . With regard to improvement standards for the driveway, the
following note shall appear on the Final Map:

"The private driveway shall be improved to a minimum
width of twelve (12) feet with an unobstructed vertical
clearance of fourteen (14) feet. "
7 . Effort shall be made to minimize grading that would be dis-
ruptive to the natural topography and removal of existing,
mature trees. The following shall appear as a note on the
Final Map:
"No trees shall be removed without compliance with applicable
City ordinances. No grading shall commence without an
appropriate permit and compliance with applicable City
ordinances. "
8 . Drainage and erosion control plans, prepared by a Registered
Civil Engineer, shall be submitted for review and approval
by the Public Works Department prior to recordation of the
Final Map.
a. Drainage and erosion control measures shall be installed
in conjunction with improvement of private access easement (s) t
9 . Prior to recordation of the Final Map, the applicants shall,
in a form acceptable to the City, agree to participate in
an assessment district or similar cooperative effort at an
undetermined future date to provide road improvements in
conformance with City standards on San Fernando Road. Said
agreement shall be noted on the Final Map and said road im-
provements shall be provided within three years from the
date of recordation of the Final Map. An extension of time
to a longer time may be granted by the Planning Commission.
Furthermore, said road improvement condition does not bind
the City to accept, participate in, or fund any such effort.
It shall be the responsibility of the applicants to take
the initiative in compliance herewith.
10 . In conjunction with the issuance of a building permit on any
of the lots, provision shall be made for adequate access
from the nearest paved road. Adequate access shall include
grading as deemed necessary in the road right-of-way to the
closest point already so improved on San Fernando and on
th(" si'Ee (s) ''and `�sTia l-include all-weather surfacing with
the design and materials subject to prior review and approval
by the City Planning and Public Works Department. Mainten-
ance of said adequate access shall be the responsibility
of the property owners. •

11. All pipeline and other easements of record shall be
shown on the Final Map.. A letter shall be submitted
from each utility company indicating the nature and
extent of any building restrictions. A note so stating
such restrictions shall appear on the Final Map.
12 . Roof materials for all structures shall be Class C rating
or better and a note to that effect shall appear on the
Final Map.
13 . A Final Parcel Map in compliance with all conditions set
forth herein shall be submitted for review and approval in
accordance with the Subdivision Map Act and the City Lot
Division Ordinance prior to recordation.
a. Monuments shall be set at all new property corners
created and a Registered Civil Engineer or licensed
land surveyor shall submit a letter certifying that
the monuments have been set prior to recordation.
• b, A Final title Policy (CLIA or ATLA) shall be submitted

25% . The site is heavily vegetated by a mixture of grasses ,

property to the north, south, and west. There is a single
family dwelling across Ardilla to the east from the subject
site. Other lot divisions of 42 and 52 acre parcels have been
recently approved in the vicinity (with the same zoning and
similar land characteristics, A-1-B-V-3) along Balboa Road.
5 . Project Description: The applicant is proposing to divide the
subject 9 .9 acres into two parcels of 5 . 3 and 4 . 6 acres each.
No private easements are shown for access , so it is assumed
access would be directly off each lot ' s frontage on Ardilla
Road.

10 , 1981, award a contract to Tara Construction, Route 3 ,

Phase I of the Administration Building Renovation (Bid No.
81-2) ; and
WHEREAS, the City Engineer has certified that said
work has been completed in accordance with the provisions
of the contract.

RESOLUTION OF THE ATASCADERO CITY COUNCIL SUPPORTING
FEDERAL LEGISLATION REPEALING SECTION 301 OF THE
POWERPLANT AND INDUSTRIAL FUEL USE ACT
WHEREAS, Section 301 of the Powerplant and Industrial
Fuel Use Act contains prohibitions and restrictions on the
use of natural gas as a utility powerplant fuel; and
WHEREAS, in California, enforcement of these restrictions
and prohibitions will mean that existing powerplants will be
required to burn additional amounts of oil since conversion
of California's existing fossil-fueled powerplants to burn
coal faces difficult technical and environmental barriers
and would require extraordinary financial commitments by the
utilities which ultimately would be absorbed by consumers
without resulting in any increase in the State ' s electrical
supplies; and
WHEREAS , the development of alternate fuels technologies
are subject to technical, financial, environmental, site and
social contraints and, as a result, fuels from these projects
may not be available on a commercial basis for several
years; and
WHEREAS, domestic natural gas reserves are estimated to
be sufficient to last for at least several decades at the
current rate of consumption; and
WHEREAS , natural gas is a cheaper, cleaner fuel than
fuel oil; and
WHEREAS, the United States needs to utilize all available
resources in order to achieve energy independence at the
earliest possible time.

NOW, THEREFORE, BE IT RESOLVED that the Atascadero City
Council strongly supports federal legislation which will
repeal Section 301 of the Powerplant and Industrial Fuel Use
Act, thereby permitting the use of natural gas as a transi-
tional utility powerplant fuel until such time as alternate
or renewable sources are available for the commercial genera-
tion of electric energy.
BE IT FURTHER RESOLVED that the City Clerk transmit
copies of this resolution to the President and Vice-President
of the United States; U. S . Senators Alan Cranston, ,S . I .
Hayakawa, and James McClure, Chairman of the Senate Energy
and Natural Resources Committee; and U. S. Congresmen Leon
Panetta and John Dingell, Chairman of the House Energy and
Commerce Committee.

1. REPORT OF THE LEAGUE OF CALIFORNIA CITIES LEGAL ADVOCACY COMMITTEE
The report of the Legal Advocacy Committee of May 7, 1981 indicated that
the Committee reviewed approximately 26 cases of significance to cities
now pending in state trial and appellate courts. The Committee and the
League Board of Directors have recommended amicus participation by all
consenting cities through their city attorneys for the following cases:
a. City and County of San Francisco v. Farrell
This case is an action by which the city seeks to have validated a
post-Proposition 13 increase in its gross receipts and payroll expense
taxes, which are comparable to the typical business license tax imposed
by virtually every city in the state. The city's petition for a hearing
in the California Supreme Court has been granted.
b. City of Watsonville v. Merrill
This is a third attempt by the city to obtain court,approval of its
authority to levy an override property tax to fund the city's pension
system. The trial court invalidated the city's tax. This is an appeal
filed by the city.
c. Collins v. City of Los Angeles
This is an action challenging the procedure by which the city council
arrived at its decision to disapprove a proposed condominium conver-
sion. The conversion was denied on the basis of the insufficiency of
off-street parking to meet the serious parking and traffic circulation
problems in the area. The Appellate Court ruled in,favor of Collins

and, in so doing, created a new test for judging the validity of
administrative decisions. Concluding that the case involves "con-
stitutionally protected private property rights," the court held that
the city council's findings are subject to "stricter scrutiny" where
the property use applied for is denied than where the approval has
been granted. The city has petitioned for a hearing in the California
Supreme Court.
d. Glendora Community Redevelopment Agency v. Demeter
The Redevelopment Agency has filed an appeal following an adverse
decision on an issue of vital importance to not only redevelopment
agencies, but all other public agencies in the state. At issue is
the uncontrollable contingent liability placed upon public agencies
for attorneys' fees of the opposition based on retainer agreements
with said litigants for legal services entered into by these adver-
saries. In this case, the trial court authorized litigation expenses
in the sum of $672,996.80 to be levied against the Redevelopment Agency
following the abandonment and dismissal of a condemnation action to
compensate the attorneys for the adversary party based on their retainer
agreement by which the attorneys were to receive a fee equivalent to
25 percent of the value of the property in the event of abandonment.
The agency contends that "reasonable" attorneys' fees, at least in
this context, cannot be contingent upon a retainer agreement to which
the public agency is not a party, but that the court should indepen-
dently thereof determine the reasonable fee to be awarded.
Unless the City Council expresses its disagreement, this office will notify
the respective agencies of our willingness to participate as an amicus,
without cost to the City.
Other cases to which the Legal Advocacy Committee simply directed the dis-
semination of information with respect to them are:
e. Apto Seascape Corp. v. County of Santa Cruz
This case is pending on appeal following a judgment awarding damages
for inverse condemnation. The question is whether the rezoning of
70 acres out of a 110-acre beach and cliff parcel split the parcel
for valuation purposes.
f. Ryan Outdoor Advertising, Inc. v. City of Carpinteria
This long-standing action involves issues respecting the necessity
of paying compensation under the Highway Beautification Act for bill-
boards within 660 feet of an interstate highway where removal thereof
was required by a city ordinance adopted well prior to the Act and
the amortization period thereof had long since expired.
g. Ventura, et al v. City of San Jose, et al.
This action seeks to have declared invalid and enjoined the enforce-
ment of a city ordinance prohibiting the sale and use of safe and sane

fireworks without obtaining a permit. The trial .court held the ordi-
nance to be valid.
h. S.E.I.U. v. City of Hanford
This action is one by which plaintiff union challenges the validity
of the 25 cents per page cost established by the city for producing
public records.
2. DRUG PARAPHERNALIA ORDINANCE
Sometime ago, the City Council authorized the City Attorney to participate
as an amicus curiae in appellate court cases pending involving the question
of the validity of city ordinances regulating drug paraphernalia. I am
pleased to advise you that in all cases in which the City participated
as amicus curiae, the Appellate Court has sustained the local drug para-
phernalia ordinances. These are Music Plus Four, Inc. v. Merrill Duncan,
Court of Appeal, Fourth Appellate District, Division 2, May 28, 1981 (un-
published) ; and Music Plus Four, Inc. v. Barnet (1980) 114 Cal.App.3d 113.
3. RECENT DECISIONS OF INTEREST
a. Mandatory Prepayment of Connection Fee Upheld
The C.A.4th has held that an ordinance of a municipal water district
establishing the time of payment and charge to connect a completed
dwelling unit for water and sewer services, and the charge for in-
spection and engineering, was neither arbitrary nor capricious and
was supported by substantial evidence. (Carlton Santee Corp. v. Padre
Dam Municipal Water District, C.A.4th)
b. Vulgar Button Grounds for School Suspension
The C.A.lst has held that a provision of the Education Code providing
for the suspension of people for engaging in habitual profanity and
vulgarity does not violate the First Amendment and constitutes grounds
for suspension. (Hinze v. Superior Court (Tamalpais Union High School
District) , C.A.lst, June 2, 1981)
C. Attorney's Fees Valid Under Brown Act
The C.A.4th has held that an award of attorney's fees to a successful
plaintiff in a private action against a public entity under the Brown
Act is appropriate unless "special circumstances would render such
an award unjust." (Common Cause v. Stirling, C.A.4th, May 28, 1981)
d. Sick Leave Benefits
The C.A.2d has held that a city employee cannot be prevented from col-
lecting accumulated sick leave benefits as a result of an industrially
related medical disability merely because the city decides to retire
him as a result of the disability. (Throne v. City of Palos Verdes
Estates, C.A.2d, May 18, 1981)

e. Employee May Sue for Discriminatory Dismissal
The C.A.2d has held that an employee who is discharged for filing an
application with the Worker's Compensation Appeals Board may bring
a civil action to recover for economic and emotional harm resulting
from the discharge. (Meyer v., Byron Jackson, Inc. , C.A.2d, June 3,
1981)
f. Ordinance Banning Live Entertainment Struck Down
The U.S. Supreme Court has held that a zoning ordinance prohibiting
- all forms of live entertainment in commercial establishments violated
the First and Fourteenth Amendments. The Borough of Mount Ephraim
charged the operators of an establishment exhibiting live nude dancing
under a zoning ordinance that prohibited all live entertainment in
commercial zones of the Borough. The court held the ordinance invalid.
(Schad v. Borough of Mount Ephraim, U.S. Sup. Ct. , June 1, 1981)
g. Ban on Election Signs Upheld
The C.A.lst has held that a city may entirely ban the posting of signs
upon public property within the city. (Sussli v. City of San Mateo,
C.A.lst, May 14, 1981)
h. Environmental Impact Report Was Held Improperly Approved
The C.A.5th has ruled that a public agency must make proper findings
and adequately respond to comments made before approving the Environ-
mental Impact Report on an application to amend its zoning regulations.
(Cleary v. County, C.A_5th, April 27, 1981)
4. PENDING LITIGATION
a. City of Atascadero v. Daly, et al.
This case has been fully briefed on appeal by both appellants and
respondents. The next action anticipated is for the Appellate Court
to set the date and time for oral argument in Fresno.
b. Snow, Atascadero Firefighters Association v. City of Atascadero, et al.
Pursuant to direction of the Council, a notice of appeal was filed
on July 1, 1981, together with a request to the County Clerk to prepare
clerk's and reporter's transcripts.
5. MISCELLANEOUS
a. Tri-County City Attorneys Association
The TriCounty City Attorneys Association met for its monthly meeting
in Sant Ynez on June 19, 1981, to discuss matters of mutual interest.

SUBJECT: Reconsideration of AFAR' s funding request
During the budget process, you approved $5,000 supporting
the Action for Animal Right' s request. Subsequent to the budget
hearings, the County Board of Supervisors approved the original
$10, 000 as requested by the AFAR. Consequently, one of the
arguments advanced by AFAR requesting City support no longer
applies; namely that the County was withdrawing its support
this year. With the present City donation, AFAR activities
will, in fact, receive $5, 000 more than originally requested
from the County.
Because these facts were not available to you at the time
of the budget hearing, the matter is being returned to you for
probable reconsideration or reaffirmation of your action.
Bringing the matter to the Agenda is also done by request of a
Council member.
In considering the County action, I suggest that you re-
consider the merits of the AFAR request to determine if you
feel that an increased level of subsidy is still needed.

Dear Mr. Warden:
Action For Animals' Rights (AFAR) respectfully requests the opportunity
to apply for a portion of Revenue Sharing Funds now available to the
City, to help finance the AFAR Spay/Neuter Assistance Program as it
pertains to Atascadero residents. The program has already proved its
good effect on the community with Mr. Dollahite' s recent statement
that the spay/neuter programs have saved him from having to destroy
between 4,000 and 5, 000 cats and dogs at the Animal Regulation Dept.
Together with a good humane education program and enforceable leash
and licensing laws , spay/neuter programs are a vital link in the pre-
vention of diseases due to pet over-population and consequent abandon-
ment, and eventually become cost effective through money saved on
animal control and destruction.
For the past two years the program has been supported through Revenue
Sharing Funds from San Luis Obispo County, and we hope will be again
for the fiscal year 1981-2; however, funding for all such programs
are being drastically cut, as you know, and we will not receive enough
from this source to offer needed expansion of the program, or to con-
tinue on the present level.
As you will see from the enclosed summaries, by far the greater
proportion of money is spent with three Atascadero veterinarians,
compared to the additional 14 which participate in the program through-
out the County, and it would seem appropriate, therefore, that
Atascadero should share a proportionate cost.
AFAR is requesting the amount of $5, 000 from Atascadero Revenue
Sharing Funds to help fund the AFAR Spay/Neuter Assistance Progra
the money to be used for payments direct to veterinarians for
spay/neuter surgeries only. No portion of this money will be
used for administration costs, which are paid from the AFAR 9
general account.

SUBJECT: Parking survey
Attached is a memo from the Traffic Committee recommending
several changes to traffic control in the downtown area. The
proposals have been developed after analysis by the Public
Works Director, the Chief of Police, and the Planning Director
as a Traffic Committee pursuant to our Ordinance. The sug-
gested changes for the area near the Post Office may alleviate
some of the problems in the area, but probably; should only be
considered as interim measures until we see how the situation
develops. Recognizing that there may be other'; approaches
necessary as the City grows, this recommendation by the Traffic
Committee appears to be a step towards alleviating parking
problems. The Traffic Ordinance which you recently adopted
authorizes the Traffic Engineer to determine locations for "No
Parking" zones. If you approve of his recommendations, your
motion to that effect should be passed. We will then prepare
an enabling resolution specifically designating these pro-
cedures.

SUBJECT: Parking Survey & Public Hearing - Downtown and
El Camino Real Business Areas.
It is recommended that Council accept the following findings
and implement those actions suggested by the Traffic Committee.
These findings and recommendations are the result of numerous
traffic and parking surveys , personal observations, conversations
with property owners and merchants , as well as an advertised public
hearing where notices were mailed to all affected property owners
and hand delivered to all the occupyingbusiness owners. The
Committee' s recommendations are as follows :
Downtown Area Bounded by El Camino Real, Traffic Way, Lewis Avenue,
and West Mall
,,��,,n1. Designate the first 6 parking spaces on the east side of
+''�A Etrada Avenue, south of Palma Avenue as 12 minute limited parking.
Augment the existing , sign at this location with painted green curb
with 12 minute stencils.
2. Remove the remaining 2 hour parking limit signs on some of
the downtown streets.
3. Increase downtown traffic patrols, as police units are available,
to enforce parking restrictions at the Post Office as well as violations
concerning parking in the travelway at that location.
4. Develop plans to utilize existing alleys and other City property
for long term parking.
5. Investigate the benefits of adding another one way street in
the downtown area, namely Palma from Traffic Way to West Mall and pro-
viding diagonal parking on Entrada Avenue from Lewis Avenue to Palma.
If a significant number of parking spaces can be added by this proposal,
then proceed with implementation by contacting affected property owners
and businesses in consideration of any factors this traffic revision
may impact.
6. Continue to monitor the downtown parking availability by use of
parking surveys. If the volume of long term parking increases sub-
stantially, necessary steps will be initiated to place a 2 hour parking
limit in selected areas.
Discussion:
Parking surveys were conducted over several, business days to
determine the availability and term of parking in the study area.
Long term parking is considered any period over one hour in which
a vehicle occupied the same space, while short term is considered
as occupancy of less than one hour.
It was apparent in the survey that motorists were ignoring the
few remaining 2 hour parking limit signs since the same vehicles
were generally parking in the same location on a long term basis
on each of the survey days.
The survey showed approximately 250 of the available parking
spaces in the downtown area are occupied by long. term parking. 500
of the parking was short term while 250 of the available spaces
were vacant.
Although the total study area indicates that adequate parking
is available for short term, business related traffic , the area on
Entrada adjacent to the Post Office continues to present certain
problems. Specifically, vehicles often block traffic lanes either
waiting for a parking space in front of the Post Office or while
double parked. This problem continues to occur even though vacant
parking spaces are available nearby.
It is the Traffic Committee' s opinion that only intensified
• enforcement of existing traffic regulations would have any effect
on this condition, and it is likely to continue to be effective
for only as long as enforcement remains at a high level.
Although the survey identified a number of parking spaces
available. during the business day, these spaces are probably under-
utilized because the individual motorist is searching for a space
as near as possible to his destination. There were numerous
observations of motorists either waiting for an occupied space
near their destination or going around the block until a preferred
space is available, even though parking is available within a block
of the destination. This type of activity will likely continue
so long as there is a fairly high turnover of parking spaces.
12 minute parking is recommended fronting the Post Office in
order to encourage high turnover of these spaces. There presently
is a 12 minute limit sign in this vicinity, however, it is unclear
which spaces this sign relates to. The painted curb with 12
minute stencils will clarify the designated spaces.
Continual monitoring of the parking demand for the downtown
area will indicate any changes in the existing pattern. Remedial
measures will be recommended where considered necessary.
It appears there may be a limited opportunity to increase long
term parking capabilities downtown by more efficiently utilizing
parking in existing alleyways and by creating additional one-way
streets with directional parking. Before these parking alternatives
are implemented, it is recommended that all the impacts affecting
traffic circulation and accessibility to fronting businesses be
explored and considered. Staff is presently examining various
parking alternatives inthe downtown area and will report on its
findings in the near future
As further background to these recommendations, it should
be noted that almost all comments received by staff and parti-
cipants of the public hearing were concerned about the downtown
area. However, it should also be noted that only 12 persons
attended the public hearing the evening of May 27 , 1981, even
though notices were mailed to 134 property owners of record and
180 notices were hand delivered to building tenants. Three phone
calls were received by staff by persons wishing to comment since
they were unavailable for the hearing date.
E1 Camino Real - West Mall to Highway 41
* 1. Recommend to the State Department of Transportation that
No-Stopping zones be established on both sides of El Camino Real.
Discussion:
The above recommendation is based on the following findings :
1. Traffic volumes are higher on this section of El Camino
Real than on any other City street at approximately 15 ,000 vehicles
per day.
2. Existing curb parking does tend to restrict sight distances
from several driveways in this section.
3. The owner of the Rancho Tee Motel has requested parking be
eliminated at his business frontage due to sight distance re-
strictions caused by large trucks parked in front of his business .
4. Over half of the street frontage in this section is presently
posted for No Parking.
5. The existing commercial establishments along this section of
El Camino Real appear to have adequate off-street parking.
El Camino Real Highway 41 to a point approximately 1000 ' South of
Highway 41
1. Eliminate existing on-street parking on both sides of. El
Camino Real in this section.
Discussion:
This recommendation covers the section of El Camino Real that
fronts the Williams Brothers Shopping Center and would include
the area between Highway 41 and the south boundary of Security
Pacific Bank.
Presently the demand here for on-street parking is extremely
limited, being almost exclusively vehicles exhibited for sale. The
concentration of this activity is on the east side of E1 Camino
Real at the intersection of Highway 41.
The above recommendation is based on the following findings :
1. That businesses that front this section of El Camino Real
have adequate off-street parking.
2. Traffic volumes in this area are now around 14 ,000 vehicles
per day.
3. Serious sight distance problems are created by vehicles
parked along the roadway near high volume driveways and especially
next to the freeway offramp on the west side of E1 Camino Real.
4. There appears to be almost no demand for business related
parking on this section of roadway. On the west side of El Camino
Real existing drive approaches eliminate most of the street parking
possibilities.
5. Elimination of parking will permit safer right turn movements
to the businesses fronting this area as well as allowing a free
right turn lane onto Santa Ysabel from northbound E1 Camino Real.
Neither of the sections of El Camino Real mentioned previously
in this report are recommended to receive limited parking zones
to control long term parking due to the fact that enforcement would
create an unusual burden that would be difficult to accommodate with
our present staffing level. By not vigorously enforcing parking
limits, this type of parking control becomes ineffective.
Another important factor to consider here is that the demand for
on-street parking is very low and it appears that the only significant
parking demand is by vehicles parked for periods much exceeding 2
hours.
El Camino Real - 1000 ' South of Highway 41 to Curbaril Avenue
1. Delineate parking stalls in this section on both sides of the
roadway in order to allow for driveway, intersection, and fire
hydrant clearance.
Discussion:
Parking surveys indicate that a majority of the on-street parking
here is long term, probably employees of fronting businesses. This
appears to be due to a shortage of off-street parking along this
frontage, especially in the Adobe Plaza Shopping Center.
The only problem currently observed with this situation is
in providing adequate driveway and fire hydrant clearance. Proper
clearance can be provided by either delineating the spaces with
adequate clear space from the parking stall to the driveway or
by using red paint to mark the clear zones. Where parking con-
tinues to obstruct driveways, in spite of the marked stalls , red
curbs could be used to augment the painted spaces.
Delineating the parking stalls is the less maintenance in-
tensive alternative, and over a long term would cost less than
red curbs.
Summary
It is only realistic to consider that any parking controls
implemented may accomplish a desired goal, however, unwanted side
effects sometimes occur. As an example , placing a time limit on
parking in one location may cause long term parking to move to a
nearby location and cause a similar problem there.
The parking controls suggested in this report are the mi i
murt
that are considered necessary to ameliorate currently observed parking
problems. It may be necessary to recommend more restrictive measures
or modify some of these suggestions in the near future to accomplish
what the community desires. To this end, the Traffic Committee will
continue to observe and survey the areas covered by this report and
make recommendations as necessary. •

to establish regulations for mobilehomes as permanent dwellings in

"Designated zones for permitted use" by deleting Sub-
section (3) which establishes a ten acre minimum lot
size for independent trailers and by adding the
following in lieu thereof:
a) The mobilehome shall be certified under the National
Mobilehome Construction and Safety Standards Act of
1974 ,
b) The mobilehome shall, be placed on an approved perma-
nent foundation system. A foundation system is an
assembly of materials constructed below, or partly
below grade, not intended to be removed from its
installation site, which is designed to support the
structure and engineered to resist the imposition
of external natural forces. An approved foundation
system shall include any foundation system approved
by the State Department of Housing and Community
Development and any foundation designed by an en-
gineer or architect in compliance with applicable
provisions of the Uniform Building Code.
c) Roof overhangs, roofing material and exterior siding,
which shall extend to the ground, shall be compatible
with other dwellings existing within the surrounding
area. At the time of permit application, the Planning
Director shall review the architectural features of
the proposed mobilehome with similar features on
existing dwellings within the area and shall make
a finding of compatibility. Such determination shall
include recommended changes which would make the
mobilehome compatible. The decision of the Planning
Director may be appealed to the Planning Commission
and the decision of the Planning Commission may be
appealed to the City Council, as set forth in
Section 22 . 02. 060 .
d) Mobilehomes shall have a minimum width of twenty (20)
feet.
e) Utility connections including water, sewer, gas, and
electric shall be made permanent in the same manner
as conventional housing. Utility shut-off valves
shall be accessible and shall not be located under
the mobilehome or behind siding or skirting.

f) No additions or other structural modifications
shall be made to the mobilehome without prior
approval from the State Department of Housing
and Community Development.
g) An application shall include all information
necessary to comply with State of California
regulations, as well as other permit information
and fees established by the City for its proces-
sing of a mobilehome application.
h) Prior to turn,-on of utilities and issuance of a
Certificate of Occupancy, the owner of the mobile-
home shall surrender to the City the Certificate
of Ownership, license plates, or decals, and other
Department of Motor Vehicle registration indicia.
If any of these items are not available, the owner
shall submit to the City a "Statement of Facts" on
the appropriate Department of Motor Vehicle form
indicating that these items are missing or lots.
When the mobilehome is new and has never been
• registered with the Department of Motor Vehicles,
the owner shall submit to the City a statement from
the mobilehome dealer selling the mobilehome stat-
ing that the mobilehome is new and has never been
registered.
Section 2 . -Publication,
The City Clerk shall cause this ordinance to be published
once within fifteen (15) days after its passage in the Atascadero
News, a newspaper of general circulation, printed, published and
circulated in the City in accordance with Section 36933 of the
Government Code; shall certify the adopting and posting of this
ordinance and shall cause this ordinance and this certification
together with proof of posting to be entered into the Book of
Ordinances of this City.

SUBJECT: Supervisorial redistricting
Councilman Highland requested this matter be placed on
the agenda in order to determine a Council position concerning
the redistricting issue. The County Board of Supervisors
has not yet adopted a specific redistricting plan, although
they have considered several as presented by `,County Staff.
It is my understanding that in the case of Atascadero, the
proposal is to divide Atascadero along Curbaril and the
extension of San Marcos. The southern portion of Atascadero
would then be in Mr. Jorgensen' s district with the northern
portion in Mr. Diefenderfer' s.
As you are aware, redistricting is required as a result
of the census count dictating adjustments to 'achieve popula-
tion balances between districts. It is my understanding that
the Board of Supervisors would like to have the new boundaries
follow specific geographic features so that demarcation
between districts can be readily achieved. It is also my
• understanding that the Board of Supervisors is considering
several different options and, that in the North County,
there may be other opportunities for redistricting rather
than truncating the City of Atascadero.
Because of the potential for dividing Atascadero,
you may wish to go on record as encouraging the Board of
Supervisors to, if possible under the law, redistrict so as
to avoid this from happening. A motion indicating your
desire would be appropriate to be forwarded to the Board of
Supervisors for their consideration.

SUBJECT: Request of the City of San Luis Obispo for limiting
the expansion of State penal institutions in the
County
The City of San Luis Obispo has been involved in dis-
cussions with the State Department of Corrections to limit
expansion of the San Luis Obispo State Prison. Their position
is basically that increasing the prison population places an
unfair burden on the residents of the City and County of San
Luis Obispo because of the requirement that prison discharges
be discharded at point of imprisonment. Since many prison
families move into the area in order to be near the facility,
and many remain in the area upon discharge of the inmate, in-
creased housing and welfare costs amongst other things are
placed upon the residents of this County without any offsetting
compensation by the State. The question is also raised as to
why San Luis Obispo County should shoulder the burden of a
State-wide problem; particularly when there are other facili-
ties which could be expanded to meet this need. Furthermore,
the City of San Luis Obispo contends that the State must follow
its own laws by completing an Environmental Impact Report prior
to initiation of this project. According to San Luis, the
expansion of the West Facility is already underway even though
an EIR has not been completed.
The City of San Luis Obispo points out that the problems
they are experiencing are not confined to the City of San Luis
Obispo, but that, for example, the City of Atascadero with the
State Hospital has similar problems. San Luis Obispo has been
joined by other cities in the County objecting to the State' s
expansion of the penal facility, and they are seeking an in-
junction prohibiting further work on the facility until the
State complies with the Environmental Protection Act pro-
visions.
If you share the concerns as expressed by the City of San
Luis Obispo, they would appreciate your adopting a motion ob-
jecting to the State' s actions and supporting the City of San
Luis Obispo in seeking an injunction to force the State to
comply with CEQA provisions. Your motion should also authorize
the forwarding of a letter expressing your views to the Depart-
ment of Corrections in Sacramento. I will also forward your
support to San Luis Obispo notifying them as to your actions.

Commissioner
Attached is information concerning Mr. Dorill B. Wright,
Mayor of Port Hueneme, who is being considered for appoint-
ment to the State Coastal Commission. Mr. Wright has been
either on the Regional Commission or the State Commission
since the inception of the Coastal ProtectionAct. He is
thoroughly knowledgable as to the provisions and procedures
of the Act and has consistently taken a balanced view in his
judgments while serving as Commissioner. In addition,
Mr. Wright has a long history of community involvement by
virtue of his service to the City of Port Hueneme and has
been most active in the Executive Committee and other committees
of the League of California Cities. All in all , he is
eminently well qualified to perform the functions of Coastal
Commissioner on the State Commission.
Although Atascadero is not a coastal city, we have an
interest historically, economically, geographically and
esthetically and should, therefore, be very much concerned
as to the representation on the State Commission. - Knowing
Mr. Wright over the past ten years, I have no hesitation in
recommending your consideration in supporting his candidacy
at the State Coastal Commission. If you agree to that, then
your motion supporting his appointment would be appreciated.

On June 30, 1981 the Regional Coastal Commission ceases to exist. The Coastal
Act of 1976 requires that the positions held by the Regional Commission repre-
sentatives on the State Commission be filled by an elected local government
person. The Boards of Supervisors and the City Selection Committees are desig-
nated as the sources of nominees to be recommended to the appointing authority.
The nominees must live in coastal counties and be a councilmember or a Supervisor
in the region for which they are nominated. The regional boundaries remain the
same as in the past. South Central Region is comprised of San Luis Obispo,
Santa Barbara and Ventura Counties.
The process is as follows. The Board of Supervisors in each of these counties
is to submit their nominee(s) to the Governor, who makes the appointment for our
region. Also, the Cit Selection Committee in each of the three counties is to
submit their nominees to the Governor. Boards of Supervisors and City Selection
Committees may nominate any supervisor(s) or councilmember(s) from any of the three
counties.
As a matter of important information, any nominee must be willing to commit to
Coastal Commission activities , three to four consecutive meeting days every other
week plus an average of six to ten hours of preparation time for each full day of
meeting. This time commitment will be necessary until the Local Coastal Plans
are certified which is estimated to be 18 months to two years.
The nomination process should be completed before July 30, 1981. The Governor then
has 30 days in which to make the appointment. Until the appointment is made, I

elementary and high school in Tuscumbia. Married Jacquelyn Shroyer August 9, 1942,
and we have three daughters: Mrs. Jerry Weinberg (Valory), Huntington Beach, CA;
Mrs. WlIIlam Jay (Estelle), Port Hueneme, CA; and Mrs. Ron Arko (Dori Ian), a student
at California State College, Fullerton, CA. Served with the United States Air Force
during World War 11, primarily in the field of electronics. in 1946 1 returned to
the University of Missouri where I received a Bachelor of Science Degree in Electrical
Engineering in June, 1949. Advance studies in Electronics, Management and Human
Relations were pursued at U.C.L.A. and S.C.S.B. From June, 1949 until September,
1975, 1 was employed by the U.S. Navy Department. From 1949 to 1967 as a research
engineer at the Naval Civil Engineering Laboratory, Port Hueneme, California and
from 1967 to 1975 as an Engineering Manager of design, development, and manufactur-
ing and maintenance organizations at the Pacific Missile Test Center, Point Mugu,
California. Prior to retirement in 1975, I was the Director of the Technical Support

By letter dated April 9 , -19 81 , you asked our opinion. on several
questions conce_ning the intepretation of Public Resources Code
section 30301 , 2 , The questions and our answers are below.
1 , First , you ask whether a.Board of Supervisors may
include a sunervisor from another Ccunty ' s Board on its list of
nominees to be submitted to the arprepriate appointing authority ,
where the other County is located in the same region . We believe
that the answer must be yes . Section 30301 . 2 contains no
provision limiting nominations b17 a Board of Supervisors to
members of that Board only. The only limitation which could be
implied on the power of the Board is a requirement that the
nominee be a Co=ty Sunervi sor or City Council- member from the
fame re7ion in which the Counj- is located , since the section
clearly indicates that future representation on the State
Coastal Commission is to be representative of the region served
by the former Regional Co=.issions , Thus , so long as the County' s
nominee comes from another Board of Supervisors within the
same region, the requirements of the section are satisfied.
2 . For the sage reasons , however , we conclude that a
Board of Supervisors may not nominate a member of a Board of
Supervisors of a County outside the region in which the nominating
County is 'Located.
3 . For the sarne reasons , a Board of Suoervisors may
.ominate a city council -:ember from a city located within the
same region —eve though the City may be Outside the Darticuiar
Com out may not nominate a city council member from a city
board outside the region .
4. Our answers are t-e Sa—e 'tiith respect to the no'.ina-

(3) Upon the termination of the third regional commission,
the Speaker of the Assembly shall appoint the third
member under this subdivision.
(4) Upon the termination of the fourth, fifth, and
sixth regional commissions , the process of appointment
of the members of commissions under paragraphs (1) , (2)
and (3) of this subdivision shall be repeated in that
order.
(5) In the event any two or more regional commissions
terminate simultaneously, the appointments to the
commission shall be made in the same manner as set forth
in Section 30301. 2 , and the respective regional
commissions shall be deemed , for purposes of appointment
to the commission, to have terminated in the following
order: first, the North Coast Regional Commission;
second, the North Central Coast Regional Commission; third,
the Central Coast Regional Commission; fourth, the South
Central Coast Regional Commission; fifth, the South Coast
Regional Commission; and sixth, the San Diego Coast
Regional Commission.
In any event, each regional commission' s representative
on the commission shall continue to serve until the new
member has been appointed pursuant to this subdivision.

Section 30301. 2.
(a) The appointments of the Governor, the Senate Rules
Committee, and the Speaker of the Assembly, pursuant to
subdivision (e) of Section 30301, shall be made in the
following manner: Within 30 days after the termination
of a regional commission, the boards •of supervisors and
city selection committee of each county within the region
shall nominate supervisors or council members from which
the Governor , Senate Rules Committee or Speaker of the
Assembly shall appoint a replacement. In regions composed
of three counties , the boards of supervisors and the city
selection committee in each county within the region
shall each nominate one or more supervisors or council
members. In regions composed of two counties , the boards
of supervisors and the city selection committee in each
county within the region shall each nominate no less
than two supervisors and two council members. In
regions composed of one county, the board of supervisors
and city selection committee in the county shall nominate
no less than three supervisors and three council members.
Immediately upon selecting the nominees , the board of
supervisors and city selection committee shall send the
names of the nominees to either the Governor, the
Senate Rules Committee, or the Speaker of the Assembly
whoever will appoint the replacement.
(b) Within 30 days after receiving the names of the
nominees pursuant to subdivision. (a) , the Governor, the
Speaker of the Assembly, or the Senate Rules Committee,,
whoever will appoint the replacement, shall either
appoint one of the nominees or notify the boards of
supervisors and city selection committees within the region
that none of the nominees are acceptable and request the
boards of supervisors and city selection committees to
make additional nominees. Within 60 days after receipt of
a notice rejecting all the nominees , the boards of
supervisors and city selection committees within the
region shall nominate and send to the appointing authority
additional nominees pursuant to subdivision (a) . Upon
receipt of the names of the nominees , the appointing
authority shall appoint one of the nominees.
Section 30301. 5.
(a) Members of the commission serving under sub
• c'ivision (a) , (b) , or (c) of Section 30301 shall be non-
voting members and may appoint a designee to serve at his
or her pleasure who shall have all the powers and duties
of such member pursuant to this division.
(b) Any county supervisor or city councilperson
appointed to the commission pursuant to subdivision (e)
of Section 30301, may, subject to the confirmation of his
or her appointing power, appoint an alternate member to
represent him or her on the commission. The alternate
shall serve at the pleasure of the county supervisor or
city councilperson who appointed him or her and shall have
all the po@Wers and duties of a member of the commission.
F..pplicable provisions of Section 30314 shall apply to
alternates appointed pursuant to this subdivision.
Section 30302 .
The six regional commissions shall be constituted as
follows:
(a) The North Coast Regional Commission for Del Norte,
Humboldt, and Mendocino Counties shall consist of the
following members :

The attached agreement is needed in order to utilize the
collection capabilities of the County for special taxes and
assessments. Please note this refers only to special assess-
ments or special taxes other than property taxes. At this
time, we do not have any special taxes except possibly for
weed abatement.

AGREEMENT FOR COLLECTION OF SPECIAL
TAXES AND ASSESSMENTS
THIS AGREEMENT is made and entered into this day of
1981 , by and between the COUNTY OF SAN LUIS
OBISPO, a political subdivision of the State of California, '
hereinafter referred to as "County," and the CITY OF ATASCADERO,
referred to as "City."
WITNESSETH:
WHEREAS, Government Code Sections 29304 and 51800 authorize
the County to recoup its collection costs when the County col-
lects taxes or assessments for any city, or zone or improvement
district thereof; and
WHEREAS, when requested by City, it is in the public in-
terest that the County collect on the County tax rolls the
special taxes and assessments for City.
NOW, THEREFORE, IT IS AGREED by and between the parties
hereto as follows :
1. County agrees , when requested by City as hereinafter
provided, or as required by law, to collect on the County tax
rolls the special taxes and assessments of City, and of each zone
or improvement district thereof.
2 . When County is to collect City' s special taxes and
assessments ., City agrees to notify the Auditor-Controller of the
County on or before the 10th day of August of each fiscal year of
the Assessor' s parcel numbers and the amount of each special tax
to County, and including, but not limited to, any act or omission
or assessment to be so collected. Provided, however, to be
effective , the notice must be received by the Auditor-Controller
by said date.
3. County may charge the sum of One Dollar ($1. 00) per
Assessor' s parcel number for each parcel for which a special tax
or assessment is to be collected on the County tax rolls by
County for City, and County may collect such charge by adding it
to the special tax or assessment on the County tax rolls to be
collected for each parcel.
4. City hereby releases and forever discharges County and
• its officers , agents and employees from any and all claims ,
demands , liability, costs and expenses , damages , causes of
action, and judgments, in any manner arising out of this agree-
ment or out of the performance or attempted performance of the
provisions hereof, including, but not limited to, any act or
omission to act or active negligence by County or its officers,
agents, employees or independent contractors directly responsible
to County.
S. City agrees to and shall defend, indemnify and save
harmless County and its officers , agents and employees from any
and all claims, demands , liability, costs , expenses , damages ,
causes of action, and judgments , in any manner arising out of

this agreement or out of the performance or attempted performance
of the provisions hereof, including, but not limited to, any act
or omission to act or active negligence by County or its officers ,
agents , employees or independent contractors directly responsible
to County, and including, but not limited to, any act or omission
to act or active negligence by City or its officers , agents ,
employees , or independent contractors directly responsible to
City.
6 . City agrees that its officers , agents and employees
will cooperate with County by answering inquiries made to City by
any person concerning City' s special tax or assessment, and City
agrees that its officers , agents and employees will not refer
such individuals making inquiries to County officers or employees •
for response.
7 . City shall not assign or transfer this agreement or any
interest herein and any such assignment or transfer or attempted
assignment or transfer of this agreement or any interest herein
by City shall be void and shall immediately and automatically
terminate this agreement.
8. This agreement shall be effective for the 1931-82
fiscal year and shall be automatically renewed for each fiscal
year thereafter unless terminated as hereinafter provided.
9 . Either party may terminate this agreement for any
reason for any ensuing fiscal year by giving written notice
thereof to the other party prior to May lst of the preceding •
fiscal year.

10. County' s waiver of breach of any one term, covenant, or
other provision of this �
a reement is not a waiver of breach of
agreement,
any other term, nor subsequent breach of the term or provision
waived.
