Regular Meeting
August 24 , 1981 7: 30 p.m.
Atascadero Administration Building
The meeting was called to order at 7 : 30 p.m. by Mayor Wilkins with
the Pledge of Allegiance. John Cole from the Atascadero Bible Church
gave the invocation .

Mayor Wilkins reviewed all items on the Consent Calendar. Council
man Highland stated that the minutes should be corrected to reflect
that he had been absent at the last meeting. Councilman Highland also
wished item A-6 to be withdrawn from the Consent Calendar and con-
sidered separately. Councilman Mackey asked that item A-9 be with-
drawn.
MOTION : Councilman Stover moved for approval of the Consent Calendar
including the correction of the minutes with the exception of
items A-6 and A-9 . The motion was seconded by Councilman
Nelson and unanimously carried by roll call vote.
A-6 Conditional Use Permit 0810608 : 1 , 5830 Entrada , Mary
Pulsifer , to allow a dog grooming
business with a residencesidence
on the ground floor
Councilman Highland felt that the condition added by the Planning
Commission was too much of a requirement; he felt that the condition
should be deleted . Councilman Mackey was in favoring of leaving 8a as
a listed condition; she felt that some condition requiring the appli-
cant to maintain the yard should be included in the permit.
MOTION: Councilman Highland moved that Council grant the CUP with
the exclusion of condition 8 . The motion was seconded by
Councilman Stover and carried on the following roll call
vote :
AYES: Councilman Highland , Stover and Mayor Wilkins
NOES: Councilmen Mackey and Nelson

Mayor Wilkins stated that this had been withdrawn from the Con-
sent Calendar because Councilman Stover will have to abstain from vot-
ing on this matter since he is the Treasurer for the Senior Citizens .
MOTION : Councilman Highland moved for the approval of the Agree-
ment with the Senior Citizens . The motion was seconded by
Councilman Nelson and carried on the following- roll call
vote:
AYES: Councilmen Highland , Mackey, Nelson , and Mayor Wilkins
NOES: None
ABSTAIN: Councilman Stover
Mr . Grimes asked if the Council ' s intention was also to approve
the City Manager entering into similar agreements with the other
organizations receiving support from the City. Council stated that
that was their intention. Councilman Mackey asked if the other organ-
izations were going to be paid in a lump sum or periodically. Mr .
Warden stated that the smaller donations would be in one lump sum, but
the larger ones would be periodically.
B. HEARINGS , APPEARANCES AND REPORTS
1 . Appearance of North County Contractors Association requesting
adoption of an Appeals Board
Mike Bewsey, a member of the North County Contractors Association ,
made a presentation on behalf of the Association. He stated that they
would like to have an appeals board to hear problems contractors might
have with interpretation of the building code. The board would con-
sist of people who have expertise and knowledge in the building field .
They do not want to have people on the board who are members of the
NCCA or contractors currently operating in Atascadero .
There was considerable discussion regarding this request. Council
was not sure it was necessary since the City Council is currently the
appeals board, however , they indicated that they were willing to give
the process a try and put a limit on its existence so that the Council
could review its effectiveness within a specified period of time. Mr .
Warden stated that an ordinance would have to be enacted to establish
the appeals board and its procedures. Also an appeals fee schedule
would have to be established . Mr . Warden noted that he did not feel
the separate board was necessary at this time , since the current pro-
cedure had not been tested and another layer of hearings could well
slow the process rather than expedite it.
Elliott Stephenson spoke in favor of an Appeals Board .
• MOTION: Councilman Nelson moved that Staff be directed to draft
an ordinance to initiate an appeals board and that a provi-
sion be included in the ordinance which would require it to
be reviewed in three years' time . The motion was seconded by
Councilman Highland and unanimously carried .

2. Report from City Manager on special drainage project •
(Security Bank and Gordon Hunt frontage)
Mr . Warden advised that the work on the drainage in front of
Security Bank and Gordon Hunt Insurance could be a City project if the
property owners completed the curbs , sidewalks and drive approach. It
was his recommendation that the City construct the underground drain-
age pipe and junction structure and that the property owner be respon-
sible for curbs , gutters and sidewalks . Mr . Warden stated there is
money in the budget for this project at the present time, however, it
may be necessary for Staff to request additional funds at a later
date.
MOTON: Councilman Mackey moved that the City participate in this
project. The motion was seconded by Councilman Highland and
unanimously carried by roll call vote .
3 City Attorney Report #15
Mr . Grimes reviewed the main items in his report. He was request-
ing Council approval in amicus participation in three cases . Council
agreed .
C. UNFINISHED BUSINESS
1 . Resolution No. 25-81 adopting a Memorandum of Understanding
with the Atascadero Police Officers Association
Mr . Warden stated that the MOU reflected those items agreed to by
the City and the Association during the meet and confer process. The
Association has signed the agreement .
MOTION: Councilman Nelson moved that Resolution No. 25-81 be read by
title only. The motion was seconded by Councilman Highland
and unanimously carried .
Mayor Wilkins read Resolution No. 25-81 by title only.
MOTION: Councilman Highland moved for the adoption of Resolution
No. 25-81 . The motion was seconded by Councilman Stover and
unanimously carried by roll call vote .
Mr . Warden advised that an agreement , in concept , appeared likely
with the Firefighters Association. He would be coming back with a
final determination in the near future .
D. NEW BUSINESS
1 Consideration of amendments to Salary Classification Plan
Mr . Warden proposed some changes to the Salary Classification •
Plan . One is to create a Maintenance One is to create a Maintenance
Worker VI position which would be responsible for field supervison of
the work force . It is anticipated that Dan Elisarraras would be pro-
moted to that position. Another change is to create a Building Main-

tenance Worker II position with the current Building Maintenance
Worker position being designated as a I . Chris Lane , now in the
Building Maintenance Worker position , would be promoted to a BMW II
position . This recommendation is because of the City ' s experience
over the last year with this position in that it has required a higher
degree of skill and job performance than originally anticipated .
Chris Lane merits this promotion.
An additional recommendation is for moving Loren Corson from a
Maintenance Worker I to a Maintenance Worker II position because of
the heavy equipment operation that he is doing . Mr . Warden recom-
mended that Council approve a transfer of $3 ,791 from reserve to the
appropriate Public Works accounts to support these recommendations .
MOTION: Councilman Highland moved that Council approve the changes
in the Salary Classification Plan and authorize transfer of
$3 , 971 from reserve to the appropriate Public Works accounts .
The motion was seconded by Councilman Mackey and unanimously
carried by roll call vote.
2 . Consideration of request of City of Santa Maria to support
legislation to allow local governments to have more control
of businesses that sell alcoholic beverages
Mayor Wilkins stated that the cities attending the last Channel
Counties Division meeting in Ventura were asked by the City of Santa
Maria to support this resolution. Council members discussed the
matter and did not feel that Atascadero had that much of a problem
and , therefore, chose not to take any action at this time .
E . INDIVIDUAL DETERMINATION AND/OR ACTION
1 . City Council
(a) Mayor Wilkins welcomed Mike Hicks to the Staff table as
Acting Fire Chief.
(b) Mayor Wilkins commented on damage horses are doing to
the lawns in the Sunken Gardens; he wondered if there
was a way to keep them off the lawns . Police Chief McHale did not
think there was any law prohibiting it , however , he will check it out .
(c) Mayor Wilkins stated that photographer Ron Bast has vol-
unteered to take photographs of the City Council and
donate them to the City. He will take a group photo at the Council
meeting on September 14th , so Mayor Wilkins asked Council members to
come a few minutes early to the meeting.

(a) Mr. Warden reminded Council to get their reservation in
for the League of California Cities Annual Convention
in October . Also, if any of the Council members have any resolutions
they wish to propose , they should Council consideration early enough
to be submitted to the League of California Cities by September 25 ,
1981 .
(b) Mr . Warden requested a closed session to discuss a per-
sonnel matter ; he did not anticipate that there would
be any Council action at the conclusion of the meeting .
The meeting adjourned to closed session at 9 : 46 p .m. and returned
to regular session at 9 :55 p.m. and adjourned .

LOCATION: 8940 San Gabriel Road
APPLICANT : Henry Hohenstein
REQUEST : To allow subdivision of 11 . 96 acres into four parcels
of 2 .7 , 4 . 0 , 2.8 and 2.5 acres each.
On September 8 , 1981 the Planning Commission conducted a public
hearing on the land division unanimously adopting Findings 1-2 ,
adopting a Conditional Negative Declaration and approving the
. request subject to Conditions 1 -16 , as listed in the attached
Staff Report with the following modification to Condition 4 :
114 . The 25 foot wide private access easement shall be
designated a private utility easement and all avail-
able utilities shall be extended therein unless
better utility access is found in which case those
utility easements are to be shown on the Final Map.
There was only brief discussion of this matter by the Planning
Commission .
Henry Hohenstein , applicant , indicated his concurrence with the
recommendation.
No one else appeared on the matter .

SUBJECT: Tentative Parcel Map AT 810721 : 1
LOCATION : 8940 San Gabriel Road (Lot 8 , Block 33)
APPLICANT: Henry J . Hohenstein
REQUEST: To allow subdivision of 11 . 96 acres into four
parcels of 2.7 , 4 .0 , 2 .8 and 2.5 acres each
BACKGROUND
1 . Existing Zoning: A-1 -1 112
2. General Plan: Suburban Single Family Residential
3 . Environmental Determination : An initial study environmental de-
scription form has been completed. The Planning Director has pre-
pared a Conditional Negative Declaration indicating the project
will not have a significant adverse effect upon the environment if
certain mitigating measures are incorporated into the project .
4 . Site Conditions: The site topography varies greatly across the
site from generally level to steeply sloping. The site is charac-
terized by four knolls , which are all designated as building
sites . The most level portions of the site are along the easterly
side with the more steep portions being toward the south and west
sides . The site is heavily vegetated throughout and is traversed
through the central area by a drainage swale. City water is
available to the site , city sewer is not. Access is provided to
the interior of the lot by a dirt trail which runs along the most
easterly property line for about 800-900 ' and then angles inward
for about 300 ' .
5 . Project Description : The applicant is proposing to subdivide the
subject 11 . 96 acres into four parcels of 2 .7 , 4 .0 , 2. 8, and 2 . 5
acres each . Each parcel would encompass a hilltop as a building
site. Access to each parcel would be provided from a common
driveway generally in the location of the existing dirt path .
Separate driveways would come off this main easement and lead to
the individual building sites.

STAFF COMMENTS
On Thursday, August 6 , 1981 the Subdivision Review Board met with the
applicant , Mr . Hohenstein , to discuss the application. Also attending
the meeting were : Larry Stevens , Planning Director ; Mary Beatie , As-
sociate Planner; John Kennally, Assistant Civil Engineer ; and Bob
Lilley, Planning Commissioner . The following items of concern were
discussed :
1 ) Concern was expressed over what is the appropriate number of par-
cels for this lot given the topography, adequacy of building
sites , area necessary for septic systems and grading necessary for
building development. It was discussed that in the event the
Planning Department feels four lots are appropriate , that a recom-
mendation for approval could be made with the condition that proof
of septic suitability for Parcel 3 be provided prior to final map.
2) Consideration was given to possibly adjusting the line common to
Parcels 3 and 4 in order to provide a larger area for leaching on
Parcel 3 . All easements of record (e. g. across Parcel 1 to Parcel
2) shall be shown on the final map .
3) Fire hydrant required at a point south of driveway entrance across
Parcel 1 to Parcel 2 (approximately 500 feet along the proposed
easement) .
• 4) Standard requirements for driveway improvements; all weather if
less than 12% grade .
5 ) All access easements which are also intended as utility easements
shall be so designated on the Final Map.
6) All available utilities shall be extended to the front of each
parcel created .
7) Recommendation for Conditional Negative Declaration for septic
suitability, , grading and tree removal , and drainage and erosion
control with site development .
8) All lots shall take access off main easement .
FINDINGS
1 . The application as submitted conforms to the applicable zoning and
subdivision regulations and is consistent with the 1980 Atasca-
dero General Plan.
2 . The application as submitted together with conditions of approval
will not have a significant adverse effect upon the environment
• and therefore , the preparation of an Environmental Impact , Report
is not necessary.

RECOMMENDATION .
Based on the above findings , the Planning Department recommends :
A) Issuance of a Conditional Negative Declaration as follows:
1 . Adequate provision shall be made to ensure proper septic suit-
ability on all parcels created .
2 . Adequate provision shall be made to minimize grading and tree
removal on the site.
3 . Adequate provision shall be made to reduce and minimize
drainage and erosion in conjunction with site development; and
B) Approval of Tentative Parcel Map AT 810721 : 1 subject to the
following:
1 . Private sewage disposal systems will be an acceptable method
of sewage disposal , if reports and design are acceptable. All
tests , reports , and designs shall conform to methods and
guidelines prescribed by the Manual of Septic Tank Practice
and other applicable City ordinances . The following shall
appear as a Note on the Final Map:
"Appropriate soils reports including a percolation test ,
a test to determine the presence of ground water , and a log
of a soil boring to a minimum depth of ( 10) feet shall be
submitted to the Planning Department prior to the issuance of
a building permit . Where soils reports indicate that conven-
tional soil absorption systems are not acceptable , City ap-
proval of plans for an alternative private sewage disposal
system, designed by a Civil Registered Engineer , shall be
required . Depending upon the system, more restrictive
requirements may be imposed . "
a. With regard to Parcel 3 , the following informational note
shall appear on the Final Map:
"A percolation test and log of soil . boring has been
submitted for Parcel 3 and found adequate. The results of
this test will be acceptable only in the event the pri-
vate disposal system is installed in the area where the
tests were performed . In the event a private disposal
system is not installed in the area where the tests were
performed , additional tests may be required at the time
of building permit for Parcel 3 . "
2 . Water shall be obtained from the Atascadero Mutual Water Com-
pany and water operable facilities shall exist at each parcel
frontage prior to filing of the Final Map . A letter from the
water company indicating they are willing and able to serve •
the property shall be submitted to the Planning Department
prior to recordation of the final map.

. 3 . All other available utilities shall be extended underground to
each parcel frontage prior to filing of the Final Map.
4 . The 25 foot wide private access easement shall be designated a
private utility easement and all available utilities shall be
extended therein.
5 . One fire hydrant of a type and size specified by the City Fire
Department shall be installed by the applicant generally in
the following location :
- approximately 500 feet into the property along the private
access easement and more specifically being located just
southerly of the driveway easement leading to proposed Par-
cel 2.
Exact location and manner of placement shall be subject to the
approval of the Fire Department. A letter from the Fire De-
partment certifying the installation of the hydrant shall be
received by the Planning Department prior to the recordation
of the Final Map,
6 . Improvements required by Conditions 2 , 3 , and 5 may be de-
ferred for a period not to exceed three years by entering into
an agreement . Any such agreement shall include a bond, cer-
tificate of deposit , or similar improvement guarantee accept-
able to the Public Works Director .
7. The private access easements as shown on the map shall be im-
proved to at least the following minimum standards :
- all-weather surface, if average grade is less than 12%
- an improved width of 12 feet
- unobstructed vertical clearance of fourteen ( 14) feet
These standards shall appear as notes on the Final Map.
8. All parcels created shall take access off the private driveway
easement from San Gabriel Road as shown on the Final Map .
a. Improvement of the driveway shall be required as necessary
to provide access to each parcel as it develops in con-
junction with the building permit for that parcel. A Note
to these effects shall appear on the Final Map .
9 . Effort shall be made to minimize grading that would be disrup-
tive to the natural topography and removal of existing mature
trees . The following shall appear as a note on the Final Map:.
"No trees shall be removed without compliance with applicable
City ordinances . No grading shall commence without an appro-
priate permit and compliance with applicable City ordiances . "

10 . Individual driveways providing access to building sites may be •
subject to Planning Department review and approval at the time
of building permit application for each parcel . If average
slope exceeds 12% , paved improvement would be required , other-
wise , an all-weather surface would be required similarly. In
no event will driveways be allowed which exceed 20% in slope.
In the event any portion of a driveway is shared , improvement
of the shared portion shall be a requirement made in conjunc-
tion with the first building permit . Notes to these effects
shall appear on the Final Map.
11 . The applicant shall offer for dedication to the public for
future road widening purposes five (5 ) feet along San Gabriel
Road for the full width of Lot 8 . Said offer to be shown on
the Final Map and be made by certificate on the Final Map.
12 . Drainage swales shall be indicated on the Final Map and a Note
shall appear on the Final Map which states:
"Any modification of the ground during site development within
fifty (50 ) feet of the drainage swales shall be subject to
approval by the Planning and Public Works Departments . "

Civil Engineer for development on each parcel may be required •
to be submitted for review and approval by the Planning and
Public Works Departments prior to issuance of building per-

15 . A Final Map in compliance with all conditions set forth herein
shall be submitted for review and approval in accordance with
the Subdivision Map act and the City Lot Division ordinance
prior to recordation .
a . Monuments shall be set at all new property corners
created and a Registered Civil Engineer or licensed
land surveyor shall submit a letter certifying that
the monuments have been set prior to recordation of
the Final Map.
b. A final title policy (CLIA or ALTA) shall be submitted
for review in conjunction with the processing of the
Final Parcel Map.
16 . Approval of this Tentative Parcel Map shall expire one year
from the date of final approval unless an extension of time is
granted pursuant to a written request prior to the expiration
date.

On September 8 , 1981 the Planning Commission considered the matter
adopting Findings 1 -2 and approving the lot line adjustment subject
to Conditions 1-5 as listed in the attached Staff Report with the
addition of the following:
116 . If a review of records indicates that the existing
5 ' wide sidewalk has not been dedicated , the applicant
shall offer for dedication that five foot wide area .
Said offer to be shown on the Final Map and be made by
Certificate thereon .
a . No offer of dedication is needed for future road
widening nor will existing improvements need to

Discussion was limited to the modified condition and the matter
was approved on the Consent Calendar with the added condition .

REQUEST To adjust a property line so as to eliminate a

BACKGROUND
1. Existing Zoning: R-4-D
2. General Plan: High Density Multiple Family Residential
3. Environmental Determination: The Planning Director has •
determined the application as presented to be a Class 5 (a)
Categorical Exemption from the requirements of the California
Environmental Quality Act,
4. Site Conditions: The site slopes moderately down to Santa
Ysabel and is developed with a single-family residence and
appurtenant landscaping. North, behind the residence, is the
Quail Ridge Condominium Tract.. Access to the property is via
a private driveway onto Santa Ysabel.
5. Project Description: The applicant is proposing to eliminate.
the northeasterly line of the existing parcel (developed with
the single family residence) and extending the northerly
property line (common to the Quail Ridge Development) to the
east in a manner that eliminates the 52 ' f 74 ' flag portion
of the Quail Ridge Tract 595. This effectively increases the
size of proposed Parcel A from 5600 square feet to 9448 square
feet (a net increase of 3848 sq. ft. ) . Access to the property
would remain from Santa Ysabel Avenue.
STAFF COMMENTS
On Thursday, August 6 , 1981 the Subdivision Review Board .met with

REQUEST: To adjust lot lines so as to correct inadequate set-
backs for a residence under construction
BACKGROUND
1 . Existing Zoning: R-1-B-3-D(506) '
2 . General Plan: Moderate Density Single-Family Residential
3 . Environmental Determination: The Planning Director has deter-
mined the application as presented to be a Class 5 (a) Categorical
Exemption according to the provisions of the California Environ-
mental- Quality Act.
4. Site Conditions: The subject lots slope moderately from
Barrenda Avenue down to Bajada Avenue. Some grading has been
performed on the southerly half of Lots 12 and 13 to facilitate
the construction in progress of a single family residence. The
residence was inadvertently situated on Lot 12 so as to not
provide adequate side yard separation from Lot 13 which is
currently undeveloped. A retaining wall has been constructed
along the northeast corner of the residence. Many trees are
scattered across both Lots 12 and 13 . There are several
significant tree specimens along a dirt driveway which runs
generally along the property line common to Lots 13 and 14 and
provides a second access to Lot 14.
5. Project Description The applicant is proposing to adjust the
lot line between Lots 12 and 13 in order to correct a non-
conforming side yard setback situation which resulted from
the improper location of the single family residence now under
construction. The line common to Lots 12 and 13 would be ro-
tated 90 degrees and located approximately 18 feet northerly
of the rear wall of the residence. Effectively the adjusted
line would divide Lots 12 and 13 in a northwest/southeast
fashion. The size of the lots is not being altered significantly.
The applicant is also proposing to provide a 15 foot sewer
easement along the line common to Lot 14 and proposed Parcel
B to Parcel A, .and to maintain a driveway easement in Parcel
B to Lot 14 .

STAFF COMMENTS
On Thursday, August 6 , 1981 the Subdivision Review Board met with
the applicant' s representative, Don Heath, to discuss the applica-
tion. Also attending the meeting were; Larry Stevens , Planning
Director; Mary Beatie , Associate Planner; John Kennaly, Assistant
Civil Engineer; and Bob Lilley, Planning Commissioner. The
following items were discussed at that meeting:
1. Submit evidence that encroachment of driveway for Lot 14 has
been satisfactorily resolved with that property owner.
2, A 15 foot sewer easement shall be provided to Parcel A along
the property line common to Parcel B and Lot 14 .
3 . Driveway easement for Lot 14 and sewer easement can overlap.
4 . House will not be finaled until the Final Map has been recorded.
5. Utilities may be released in order for the applicant to obtain
his 4th and 5th bank draws for the residence under construction.
FINDI-NGS
1. The application as submitted has been determined to be cate-
gorically exempt from the requirements of C.E.Q.A. as defined
by Class 5 (a) .
2. The application as presented conforms with the applicable
zoning and subdivision regulations .

Based on the above findings , the Planning Department recommends
approval of Lot Line Adjustment LA 810629 :1 subject to the following
conditions :

on Lot 12. A note to this effect shall appear on the Final
Map.

RE: DESIGNATION OF VOTING DELEGATE FOR LEAGUE ANNUAL CONFERENCE
Dear City Official:
The most important aspect of the League Annual Conference is the General Business
Session at which time the membership takes action on conference resolutions. This year,
consideration of resolutions will include a discussion of the Action Plan for the Eighties,
The Action Plan incorporates a series of far-reaching recommendations for city and
League action which have been developed over the past year through the intensive efforts
of over 100 city officials. These recommendations and other resolutions ',will guide cities
and the League in our efforts to improve the quality, responsiveness and,vitality of local
government within this state. All amities should be represented at the Business Session on
Tuesday morning, October 20 at 9:00 a.m. in the Hilton Hotel, San Francisco.
To expedite this important policy-making meeting, each City Council should designate a
voting representative and an alternate who will be present at the Business Session. The
League Constitution provides that each city is entitled to one vote in mutters affecting
municipal or League policy. A voting card will be given to the city official designated by
the City Council on the enclosed "voting delegate form."
If the Mayor or a member of the City Council is in attendance at the Conference, it is
expected that one of these officials will be designated as the voting delegate. However, if
the City Council will not have a registered delegate at the Conference but will be
represented by other city officials, one of these officials should be designated the voting
delegate or alternate.
Please forward the enclosed "voting delegate form" to the Sacramento office of the
League at the earliest possible time, so that the proper records may be established for the
Conference. The voting delegate may pick up the city's voting 'card in the League
Registration Area, San Francisco Hilton Hotel.
If it becomes necessary for the voting delegate and the designated'alternate to leave the
Conference, the card may be transferred to another official from the same city, providing
the transfer has been cleared with the Credentials Committee, which will be responsible
for distributing voting cards.
It is suggested that the Mavor and all Council Members from a given' city try to sit
together at the Business Session so that, if amendments are considered, there may be an
exchange of points of view and a consensus arrived at before the city's vote is cast.
Your cooperation in returning the attached "voting delegate form" as soon' as possible will
be appreciated.

SUBJECT: Addendum to Joint Powers Agreement to Add Deferred
Compensation Benefits
The adoption of the attached Addendum to JPA to : add De-
ferred Compensation Benefits has been included as part of
the annual representation appointment resolution . The
addendum stipulates that the JPA Self Insurance Fund does
not have any financial responsibility for the Deferred Com-
pensation plans of the participating cities. It does , how-
ever , provide that the Fund will select the Plan Administra-
tor . This has been accomplished by the JPA with the selec-
tion of the Hartford Variable Annuity Company.
The Hartford representaive will meet with all interested
employees on September 16 , 1981 . Purpose of these meetings
is to explain the program and start the initial enrollment
process . The degree of employee interest should be re-
flected by the attendance at these meetings.
Recommend adoption of this Addendum with authority for
the City Manager to sign for the City.

RESOLUTION APPROVING AMENDMENT TO THE
CENTRAL COAST CITIES SELF INSURANCE FUND JOINT POWERS
AGREEMENT FOR DEFERRED COMPENSATION AND APPOINTING
CITY REPRESENTATIVE TO BOARD OF DIRECTORS
RESOLVED that the Council of the City of . Atascadero hereby ap-
proves the Addendum to Joint Powers Agreement Establishing the Central
Coast Self Insurance Fund to provide for Deferred Compensation Bene-
fits , which Addendum is attached hereto and incorporated herein by
reference .
FURTHER RESOLVED that the Mayor and City Clerk are hereby author-
ized and directed to execute all necessary documents on behalf of the
City of Atascadero; and
FURTHER RESOLVED that pursuant to the provisions of the basic
Joint Powers Agreement , the City Manager is hereby appointed said
City ' s representative to the Board of Directors , and the Director of
Finance is hereby appointed the alternate.

ADDENDUM
TO
JOINT POWERS AGREEMENT
ESTABLISHING THE CENTRAL COAST SELF INSURANCE FUND
WHEREAS, the Cities of Arroyo Grande, Atascadero, Grover City, Guadalupe,
Lompoc, Morro Bay, Paso Robles, Pismo Beach, Santa Maria, Santa Paula and
San Luis Obispo have entered into a Joint Agreement relating to Workers'
Compensation, Liability and Employee Benefits.
WHEREAS said
Agreement establishes the Central Coast Self Insurance
• Fund and establishes a procedure for the administration of self-insurance
generally.
WHEREAS, said cities intend to enter into agreement to provide Deferred
Compensation Benefits.
WHEREAS, the following state laws, among others, authorize the cities
to enter into this Agreement:
a. Government Code Section 990.4 permitting a city to provide insurance
and self-insurance in any desired combination;
b. Government Code Section 990.8 permitting two or more cities to enter
into an Agreement to jointly fund such expenditures under the authority of
Government Code Sections 6500 - 6515;

C. Government Code Sections 6500 - 6515 permitting two or more cities
to jointly exercise under an Agreement any power which is common to each of
them.
WHEREAS, each of the cities desire to enter into an Agreement with each
of the others for the purpose of insuring against various risks jointly,
rather than individually.
WHEREAS, after obtaining studies and recommendations, each city has
determined that it is economically practical and for its public benefit and
in its interest to do so;

NOW THEREFORE, it is agreed as follows:
All of the terms of the existing Joint Powers Agreement are
incorporated herein and made a part of this Agreement, except for Paragraphs
III, IV, V, VI, VII, VIII, IX, X, XI, XII and XIII.
I. AUTHORITY AND PURPOSE
This Agreement is made under the authority of Government Code Sections
6500 - 6515 between the following cities: ARROYO GRANDE, ATASCADERO,
GROVER CITY, GUADALUPE, LOMPOC, MORRO BAY, PASO ROBLES, PISMO BEACH,
SANTA MARIA, SANTA PAULA, and SAN LUIS OBISPO. The purpose of this Agreement
is to exercise jointly powers common to each city by (a) jointly and
separately negotiating and, purchasing Deferred Compensation coverage; and

(b) providing for inclusion in the future additional cities which desire to
become parties to the Agreement.
II. DEFINITIONS
(1) The "Fund" means the Central Coast Self Insurance Fund. A public
self-insurance fund established by an existing Agreement and separate and
apart from the parties to this Agreement;
(2) "Board" is the governing board of the Fund;
(3) "Plan Administrator" is the company hired by the Board to provide
funding plans, administration and enrollment.
• III. TERM OF AGREEMENT
This Agreement becomes effective upon execution as attested by the
signatures and dates of execution hereof and shall continue in effect until
terminated as provided herein. ARROYO GRANDE, ATASCADERO, GROVER CITY,
GUADALUPE, LOMPOC, MORRO BAY, PASO ROBLES, PISMO BEACH, SANTA MARIA, SANTA
PAULA, and SAN LUIS OBISPO will become participating members effective upon
individual execution of this Agreement. The Board may accept additional
members after consultation with and the concurrence of the majority of the
governing bodies of the member agencies.
IV. DUTIES, POWERS AND RESPONSIBILITIES OF FUND
The Fund, or its designees, shall only be responsible for the selection
and review process to choose an Administrator. The Fund shall not receive,
. collect, invest and disburse any monies paid by employees of member agencies.

The Fund is empowered to take all actions necessary to carry out the purposes
of this Agreement. The Fund may hire or contract with persons or firms as
required to carry out its legal, accounting and administrative duties and
responsibilities.
V. PLAN ADMINISTRATION
The Board shall select a Plan Administrator after consultation with and
concurrence of a majority of the governing bodies of the member agencies.
The Board shall direct the Plan Administrator of the Fund. The initial
Plan Administrator shall be The Hartford Variable Annuity Company. The Board
shall review and report to each of the governing member agencies the
feasibility of continuance of the program annually, but not later than March 1. •
VI. FISCAL YEAR
The "fiscal year" of the Fund is the period from the first day of July
of each year to and including the 30th day of June of the following year.
VII. FUND FUNCTIONS AND RESPONSIBILITIES
(a) Provide selection and review of Plan Administrator.
VIII. CITY RESPONSIBILITIES
Each city has the following responsibilities:
(a) Appoint its representative and alternate to the Fund Board;
(b) Remit to the Plan Administrator Deferred Compensation contributions
at agreed intervals.

IX. TERMINATION AND WITHDRAWAL
This Agreement may terminated upon the consent of all the parties
to it. A city may withdraw as a party to the Agreement at the end of any
fiscal year upon the giving to the Fund three months prior written notice
of its intent to withdraw.
X. NOTICES
Notices to cities under this Agreement shall be sufficient if delivered
to the office of the City Clerk. Notices to the Fund shall be sufficient if
deleivered to the office of the Chairman of the Board of Directors
• XI. MISCELLANEOUS
(a) The section headings in this Agreement are for convenience only
and are not to be construed as modifying or governing the language in the
section referred to.
(b) Whenever in the Agreement consent or approval is required, the
same may not be unreasonably withheld.
XII. AMENDMENT
This Agreement may be amended by resolution of the city councils of
two-thirds of the then participating cities.
XIII. BOARD MEETINGS AND RECORDS
(a) By-laws and Regulations: The Board may adopt by-laws, procedures
• and regulations which are not inconsistent either with applicable law or with
this Agreement. The risk manager shall send to each city each by-law and
regulation and amendment promptly after its adoption by the Board.

SUBJECT: Ordinance No. 42 , amending Animal Ordinance
Attached Ordinance No. 42 is for first reading and will ac-
complish changes to the previously adopted Animal Control Ordi-
nance. As you will recall , the Animal Control Ordinance is ad-
ministered by the County for all the cities in the County.
Changes were recently made in the overall ordinance , _thereby ne-
cessitating the attached changes .
One of the more significant changes increases the redemption
fees , Section 4-1 . 208 . This section increases the impound fees
ifrom $10 to $15 for the first time a dog is impounded , from $25
to $50 for the second impound and from $50 to $100 for the third
impound .
The changes appear to be responsive to some of the deficien-
cies of the previous ordinance. Recommend your adoption as a
first readng. It will be rescheduled in two weeks for a second
reading and final adoption .

ORDINANCE NO. 42
AN ORDINANCE OF THE CITY OF ATASCADERO AMENDING
TITLE 4 OF THE ATASCADERO MUNICIPAL CODE ENTITLED ANIMALS '
The Council of the City of Atascadero ordains as follows:
Section 1 . Section 4-1 . 112 is amended to delete any reference
to "poultry" and shall read as follows :
4-1 . 112. Disposition of dead animals , dogs , cats, and household
pets upon request.
It shall be the duty .of the Animal Control Officer upon request of
any owner of any dead animal , dog, cat, or household pet which was
kept or maintained in the City immediately prior to its death, or upon
the request of any person or persons discovering a dead animal , dog,
cat , or household pet upon his premises or •upon any public road , high-
way , street , alley, square , park , school ground or other public place ,
or in or upon any lot or premises ,to forthwith bury or dispose of such
animal , dog, cat, or household pet in such a manner as may be pre
scribed by law. The Animal Control Officer may charge and collect
fees for the transportation and disposal of the animal , dog, cat , or
household pet from the owner or person having had the possession or •
control of the animal , dog, cat, or household pet if such owner or
person can be ascertained.
Section 2 . Section 4-1 . 113 (d) is amended to eliminate the phrase
"except dogs kept for the owners use in herding livestock or hunting"
and shall read as follows :
4-1 . 113 . Definitions .
(d) "Dog kennel" shall mean any lot , building, structure , enclo-
sure or premises whereon or wherein four (4) or more dogs
four (4) months of age or older , are kept or maintained for
any purpose whatsoever provided , however , that if other ani-
mals or birds or fowl are bought , sold or bartered , the clas-
sification to apply shall be that of a pet shop; and pro-
vided , further , that this definition of "dog kennel" shall
not be construed as applying to a duly licensed veterinary
hospital or any public pound.
Section 3 . Section 4-1 . 113 (g) is amended to read as follows :
4-1 . 113 . Definitions .
(g) "Non-commercial kennel" shall mean any dog kennel in which
four (4) or more dogs are kept for non-commercial reasons ,
including hunting and herding livestock. The sale of animals •
from such a kennel shall be limited to one litter per year ,
and shall be considered an accessory residential use and will
not be construed as a commercial use or activity. Each dog

• in such kennel shall be individually licensed as provided for
in Section 4-1 .224 .
Section 4 . Section 4-1 . 114 is amended to read as follows :
4-1 . 114 . Dog Kennels , Pet Shops , Regulations .
It shall be unlawful for any person , firm, corporation or associa-
tion to erect , establish or -maintain any boarding kennel , commercial
kennel , non-commercial kennel , or pet shop as herein defined , without
first obtaining the permit from the Chief Animal Control Officer . The
granting of such permit shall be in the discretion of the Chief Animal
Control Officer , who shall take into consideration the type of con-
struction to be employed as it relates to sanitation , and the manner
in which the animals , birds or fowl are to be housed . Prior to
issuing such permit , the Chief Animal Control Officer shall receive
the approval of the Planning Director so as to assure compliance with
such zoning regulations as may be in effect. The permit shall be for
a calendar year , with a permit fee due and payable on January 1st of
each year . The amount of said fee shall be set by Resolution of the
City Council .
Section 5 . Section 4-1 . 115 is amended to read as follows :
4-1 . 115 . Requirement of Business License - Posting of emer-
gency notices .
It is unlawful for any person , firm, corporation , or association
to erect , establish or maintain any boarding kennel , commercial ken-
nel, or pet shop , as defined in this Title , without first obtaining a
license from the City Tax Administrator . After approval by the Chief
Animal Control Officer of the permit that is required by this Chapter ,
the Tax Administrator , upon the payment of the required annual license
fee for the privilge of maintaining such dog kennels or pet shops ,
shall issue to the applicant a license in such form as he may pre-
scribe . Such license shall be for the calendar year or any part
thereof during which the dog kennel or pet shop shall be maintained ,
and shall be due and payable in advance on January 1st of each year ,
provided the above mentioned permit has not been revoked. Every per-
son , firm, or corporation maintaining a boarding kennel , commercial
kennel , or pet shop shall post a notice in a conspicuous place where
it may be seen outside the locked premises , listing names , addresses
and telephone numbers of persons who may be contacted in the event of
an emergency.
Section 6 . Section 4-1 . 116 (a) and (d) is amended to read as
follows:
4-1 . 116 . Kennel and Pet Shop Permits - Refusal , Suspension
Revocation Thereof.
• (a) The permit for the maintenance and operation of a boarding
kennel , commercial kennel , non-commercial kennel or pet shop
shall be refused by the Chief Animal Control Officer upon a
finding that any provisions of any health law of the State of

California, or any of the applicable provisions of this Chap- •
ter have not be complied with.
(d) All office hearings referred to herein shall be conducted in
accordance with procedures adopted by the Animal Regulation
Department. The applicant or permittee may call and examine
witnesses , introduce exhibits , question city officials and
opposing witnesses on any matter relevant to the issues , and
may rebut evidence against him. The hearing shall not be
conducted according to technical rules relating to procedure ,
evidence or witnesses . All relevent evidence shall be ad-
mitted . The Chief Animal Control Officer shall insure that
an informal record of the proceedings is maintained .
Section 7 . Section 4-1 .208 (b) , (c) and (d) is amended to read
as follows :
4-1 .208 . Redemption fees .
(b) Impound fee of fifteen dollars ($15. 00) for the first
occasion of any dog impounded within a calendar year ;
(c) Impound fee of fifty dollars ($50 .00 ) for the second occasion
of any dog impounded within a calendar year;
d) Impound fee of one hundred dollars ($100 .00) for the third
and each such subsequent occasion of any dog impounded within
a calendar year .
Section 8 . Section 4-1 .220 (e) is amended to read as follows :
4 . 1 .220 . Vaccination Rerformance.
(e) Name and address of owner of dog;
Section 8 . Section 4-1 . 301 is amended to read as follows :
4-1. 301 . Impounding and disposition of stray or abandoned
cats.
It shall be the duty of the Poundmaster to receive and impound all
cats believed to have been abandoned by their owners. The Poundmaster
shall provide proper care and attention , food and water , for all cats
impounded and shall keep such cats for a period of three (3) days un-
less the cats be sooner reclaimed or redeemed by the owner or person
having control thereof. Such redemption shall be made by paying the
Poundmaster chargesimposedto recover actual costs of feeding and
caring for the impounded cat.
No fees whatsoever shall be charged or collected for or on ac-
count of any cat which has been unlawfully taken up or impounded. The
owner of a cat who believes the cat has been unlawfully seized may •
request a hearing in accordance with the procedure set forth in Sec-
tion 4-1 . 207 .

At any time after the expiration of the period of three (3) days,
the Poundmaster may, without notice and without advertising in any
manner , sell , give away, or dispose of the cats ; provided, however ,
the Poundmaster may not sell , give away, or transfer title to any cats
for any purposes as set forth in Section 4-1 .209 ; provided further ,
however , the Poundmaster may not sell or give away any female cat ,that
has not been spayed , or any male cat that has not been neutered , un-
less the cost of spaying or neutering such cat , as determined and pro-
mulgated by the Department of Animal Regulation, has been deposited
with the pound .

Poundmaster .
Every person taking up any cat under the provisions of this chap-
ter and every person finding any lost , strayed or stolen cat shall , 11101
within twenty-four hours thereafter , give notice thereof to the Pound-
master and every such person in whose custody such cat may, in the
meantime , be placed shall surrender such animal to the Poundmaster
without fee or charge and the Poundmaster shall thereupon hold and
dispose of such cat in the above described manner .
Section 8 . The City Clerk shall cause this ordinance to be pub-
lished once within fifteen ( 15 ) days after its passage in the Atasca-
dero News , a newspaper of general circulation printed , published and
circulated in the City in accordance with Section 36933 of the Govern- '
ment Code; shall certify the adoption of this ordinance and shall
cause this ordinance and this certification to be entered into the
Book of Ordinances of this City.
Section 3 . This ordinance shall go into effect and be in full
force and effect at 12 : 01 a .m. on the 31st day after its passage.
