Atascadero Administration Building
The meeting was called to order at 7 :30 p.m. by Mayor Wilkins
with the Pledge of Allegiance. The Mayor gave the invocation.
ROLL CALL
PRESENT: Councilmen Highland, Mackey, Nelson, Stover and Mayor
Wilkins
ABSENT: None
PUBLIC COMMENT
1. There were some general comments by Ted Munson.
2. Cecil Barrett stated that he was a member of the Beauti-
fication Committee and noted that there seems to be a
question about the Committee ' s official status. He said that
Councilman Mackey had a resolution to present to Council to officially
establish the committee as a City Committee. Councilman Mackey
stated that Mr. Warden had informed her that Council motion was
enough to establish a committee.
MOTION: Councilman Mackey moved that Council create a
Beautification Committee. The motion was seconded
by Councilman Nelson.
Council members discussed the matter at length. Mr. Warden
noted that if �..c Council decided to make this a standing Committee,
the members would be "subject to Conflict of Interest laws and
reporting, as well as all the Brown Act requirements for meeting
place, announcement of time and place of meetings and any other
statutory requirements as apply to the Council, Planning Commission
and Parks and Recreation Advisory Board. It was noted that Council
would also have to decide on the selection process for committee
members.
Council decided that they would like to see a charge for the
Committee before approving it as a standing committee
Councilman Mackey withdrew her motion and Councilman
Nelson his second.
Councilman Highland stated that he would help Councilman
Mackey draw up guidelines for the Committee and the matter would
be scheduled on the next agenda.
A. CONSENT CALENDAR

3. Waiver of curb, gutter, and sidewalk requirements, 7500
Sinaloa, Ray Bugatti (RECOMMEND APPROVAL OF PLANNING
COMMISSION RECOMMENDATION)
Councilman Highland made a correction in the minutes, page
three, last line on the page, the word "rear should be changed
to "side" . Councilman Mackey requested that Item-A-3 be withdrawn
from the Consent Calendar.
MOTION: Councilman Stover moved for the approval of the Consent
Calendar as amended, excluding Item A-3. The motion
wassecondedby Councilman Highland.
Mayor Wilkins reviewed the items on the Consent Calendar.
The motion was unanimously carried by roll call vote.
A-3 Waiver of curb, gutter and sidewalk requirements, 7500
Sinaloa, Ray Bugatti
Councilman Mackey asked if it was possible for the applicant
to post a bond for the curb, gutter and sidewalks Larry Stevens,
Planning Director, stated that it would cost almost as much to
post a bond as it would to construct the improvements. The applicant
had been given that option, , but did not want to post bond preferring
to seek a 'waivc.Lof the requirement.
MOTION Councilman Mackey moved that Council approve the Planning
Commission recommendation in this matter. The motion
was seconded by Councilman Highland and unanimously
carried.
B. HEARINGS, APPEARANCES AND REPORTS
1. Report by City Manager on California Parklands Bond Act,
Proposition 1
Mr. Warden reviewed his memo and the meeting held between the
cities in the County, the County and special districts regarding
allocation of the formula for Proposition .l funds. According to
the population distribution ratio, the City of Atascadero would be
entitled to $57,580. Mr. Warden stated that he would be writing a
letter to the County advising of the City' s interest in participating
unless Council had any objections. Council approved.

C. UNFINISHED BUSINESS
1. Atascadero welcome sign
Mr. Warden stated that the City Attorney had advised that Council
could not waive the fees for a sign permit on this project. The
Council can, however, participate in the project up to the amount of
the fees as a donation. He also wanted to be assured that the Council
did not intend for the City to be responsible for the maintenance of
the sign once it is constructed. Council agreed to both proposals.
D. NEW BUSINESS
1. Boosters Club billboard sign
Mr. Warden reviewed the situation for Council . He suggested
letting the Booster ' s Club and the Chamber of Commerce get together.
and work out the matter as to who would use and maintain the sign
situated in front of the Chamber office. He noted that although the
property does belong to the City, the Booster ' s Club had been
allowed to construct the sign before the City incorporated. He was
unable, however, to find a long,.-term lease between the County and
the Booster' s Club for the sign or property.
Doug Davis, representing the Booster' s Club, stated that Club
members had not been aware that this matter was to come before Council
until they read it in the newspaper. He felt that the Booster ' s Club
and the Chamber had just about come to an agreement and did not see
why the City was involved. Mr. Warden stated that his office had been
in contact with Mrs. McGarvey regarding this matter and she had been
requested to advise Booster' s Club members that this matter was
scheduled for Council consideration. Robert Jones, representing the
Chamber of Commerce, spoke in favor of the Chamber' s use of the sign.
It was noted that the sign was in disrepair and the Booster ' s Club had
not used it for some time.
Mrs. Harris stated that she was the secretary for the Booster 's
Club and asked Council to postpone making a decision on this matter
until she has an opportunity to look for the lease.
Council discussed this at length and decided to give the Chamber
and the Booster' s Club an opportunity to work the matter out them-
selves.
MOTION: Councilman Highland moved that this matter be continued for
two weeks. The motion was seconded by Councilman Mackey
and unanimously carried.

2. Consideration of transfer of funds for Parks and Recreation
Advisory Board to attend 1981 California and Pacific
Southwest Recreation and Park Conference
Mr. Warden advised that only $1, 000 had been budgeted for this
purpose and an additional $1, 800 was needed in order to send all
members of the Advisory Board to the conference. Councilman Nelson' s
fees would come out of the City Council ' s budget.

MOTION: Councilman Stover moved for the authorization to transfer
$1, 800 into the Recreation budget for this purpose. The
motion was seconded by Councilman Mackey and unanimously
carried.
3 . Conversion of street lights, central business district.
Mr. Warden reviewed his memo for Council.
140TION: Councilman Highland moved that Staff be authorized to go
ahead with this project. The motion was seconded by
Councilman Nelson and unanimously carried.
There was discussion regarding the flag standards and Staff was
directed to look into the purchasing off--themrf om-P'. -G"&"'E." .
4 . Award of bid for tractor
Mr. Warden advised that the low bid for this project had been
submitted by ny-n Equipment Company in the amount of $35, 828 .
MOTION: Councilman Highland moved for acceptance of the low bid.
The motion was seconded by Stover and unanimously carried.
MOTION: Councilman Highland moved that Council authorize the
execution of the lease-purchase agreement and authorize the
City Manager to sign. The motion was seconded by Councilman
Stover and unanimously carried.
E. INDIVIDUAL DETERMINATION AND/OR ACTION
1. City Council
(a) Councilman Mackey asked about oil lease sales; some
City Councils were passing resolutions in opposition.
Councilman Stover stated that the Council of Governments had written
letters regarding this matter.
(b) Councilman Mackey asked about the school crossing
guard situation. Mr. Warden stated that the agreement•
is not up until the middle of February. Mayor Wilkins stated that
meetings are going on to resolve this matter.

(c) Mayor Wilkins appointed Ccuncilmen Highland and
Nelson to help the City Manager screen the applica-
tions for Recreation Director.
(d) Payor Wilkins brought up the President' s designation
of Thursday, January 29th, as a national day .of
thanksgiving for the return of the former hostages. Council discussed
this and suggested putting yellow ribbons on the doors to the Admin-
istration Building. Mrs. Harris felt that red, white and blue ribbons
would be more appropriate. Councilman Mackey suggested planting a
tree in honor of the occasion and Mayor Wilkins asked her to talk with
Mr. McPherson about an appropriate place to plant a tree.
2. City Attorney
Mr. Grimes had nothing to report
3 . City Manager
(a) Mr. Warden stated that February 9th was a holiday
according to the City' s personnel rules and regulations,
and also a Council meeting day. In accordance with the ordinance, the
Council meeting will be held on the following day, Tuesday, February
10th.
(b) Mr. Warden reported on the conference he had attended
in San Francisco on employee relations.
(c) Mr. Warden reviewed his meeting with representatives
of the School District regarding crossing guards . They
had reached a tentative agreement regarding the mechanics of the
program, but had stayed away from the subject of who pays for what.
He reviewed the agreement for Council information. He stated that
this would be a subject on the next meeting' s agenda.
Mrs. Harris requested that school children not be allowed to
become school crossing guards.
The meeting adjourned at 8 : 38 p.m.

On February 2 , 1981 the Planning Commission conducted a public
hearing unanimously adopting Findings 1-2 , authorizing a Condi-
tional Negative Declaration and approving the above-referenced
application subject to Conditions 1-14 as listed in the attached
Staff report with the modification of Condition 9 to read:
• 9 . Escondido Road, along that portion of the property
frontage, if any, not improved in a manner similar
to other 3-F Meadows roads leading to the site,
shall be improved. . . . . . .
There was considerable discussion among the Planning Commission
concerning the fire retardant roof requirement and related fire
safety needs, concerning access and circulation in the area of
3-F Meadows, concerning the status of paper and other unimproved
roads in the area, and concerning the existing road connecting
Escondido-Portal to San Marcos .
Alex Kuczynski , applicant, indicated that he preferred that the
hydrant be installed with the first building permit rather than
at the time of recording the Final Map. He stated that all other
conditions were acceptable.
Several area residents spoke inquiring about circulation, road
status, and fire safety.

REQUEST: To divide a 5,14 acre site into two parcels of equal
size at 2. 57 acres,
BACKGROUND
1. Existing zoning: A-1-112.
2. General Plan: Suburban Single-Family Residential.
3 . Environmental Determination An Initial Study Environmental
Determination has been prepared for this project. The Planning
Director has issued a Conditional Negative Declaration for the
project indicating that no significant adverse environmental
effects are likely to occur if certain mitigating measures are
incorporated into the project.
4 . Site Conditions : The site is generally characterized by slopes
ranging from 10 to 3-0 percent. Elevation of the site range
from 280 feet at the northeast corner of the site to 420 feet
near the southerly property line. Vegetation of the site con-
sists of natural grasses and scattered trees, primarily mature
oaks. Several drainage swales traverse the site; two located
largely in Parcel B, one in Parcel A. Additionally, several
pipelines traverse the property; one, being a gas line, passes
underground in the northerly portion of Parcel ,A, the second
being a pair of Standard oil lines passing underground generally
through the mid-section of both parcels . Access to the site is
currently provided via Escondido Road, a private road in the
3-F Meadows area and by a rough-graded dirt driveway which be-
gins at the northeast corner of the lot. The area around the
site is for the most part undeveloped, with lot sizes being
in the range of five acres Water lines are known to exist
in Escondido Road at the property frontage.
5. Project Description: The application is to divide a 5 .14 acre
site into two lots of equal size, that being 2 .57 acres Access
to Parcel B will be provided by extending the existing driveway
to a logical building area. Access to Parcel A is presently
proposed via- a second driveway beginning just west of the exist-
ing driveway and running_ generally southwest to a logical
building area.

STAFF COMMENTS
On Thursday, January 8 , 1981 the Subdivision Review Board met with
the applicant, Mr. Kuczynski, to review his request. Also attend-
ing the meeting were; Larry Stevens, Planning Director; Mary
Beatie, Associate Planner; John Kennaly, Assistant Civil Engineer;
Don Sylvia, Fire Chief; and Jim Wentzel, Planning Commissioner.
The following is a list of concerns that were discussed at that
meeting:
1) Require preliminary drainage plan.
2) Require plan and profile drawings of proposed driveways in
order to determine average grade and appropriate improvement
requirements, acceptability of slope banks and adequacy of
turning radii for use by emergency vehicles.
3) Slope banks of driveway should not exceed 12:1; 2:1 slopes may
be required.
• 4) Review alternate location of driveway to Parcel A in an effort
to reduce cut and fill and to avoid conflict with pipeline.
5) All pipeline and other easements of record to be shown on
tentative and final maps . All easements should appear in an
updated preliminary title report.
6) Require improvement of Escondido Road along property frontage
to acceptable City standards.
7) Recommend Conditional Negative Declaration addressing the fol-
lowing critical areas of concern:
fire hazard; require fire retardant roof covering per
Section 3202 (e) of U.B.C.
_'\ adequate access; improvements and slope protection
- septic suitability
drainage and erosion control plan
8) Fire hydrant.
With regard to Item 5, the applicant was advised that contact should
be made with the various utility companies to determine any building
. restrictions that might exist over these easements .

FINDINGS
1. The project as presented will not have a significant erect
adverse effect upon the environment and the preparation of
an Environmental Impact Report is not necessary.
2. The application as presented conforms to the applicable zoning
regulations and is consistent with the- 1980 Atascadero General
Plan guidelines .
RECOMMENDATION
Based upon the above findings, the Planning Department recommends :
A. Issuance of a Conditional Negative Declaration as follows :
1. Adequate provisions shall be made for drainage and erosion
control and protection in conjunction with site development.
2 . That provision be made for adequate access including pro-
vision for improvements and slope protection.
3 . That provision be made, through appropriate soils tests,
to assure septic suitability on each lot.
4 . That provision be made to reduce fire hazard at the site.
B. Approval of Tentative Parcel Map AT 801212:1 subject to the
following conditions:
1. Private sewage disposal systems will be an acceptable method
of sewage disposal, if reports, tests, and design are
acceptable. All tests, reports and designs shall conform
to methods and guidelines prescribed by the Manual of Septic
Tank Practice and other applicable City ordinances . The
following shall appear as a Note on the Final Map:
:'Appropriate soils reports including a percolation test,
a test to determine the presence of ground water, and a
log of a soil boring to a minimum depth of ten (10) feet
shall be submitted to the Atascadero Planning Department
prior to the issuance of a building permit on each lot.
Where soils reports indicate that conventional soil ab-
sorption systems are not acceptable, City approval of plans
for an alternative private sewage disposal system, designed
by a registered civil engineer, shall be required. Depend-
ing upon the system, more restrictive requirements may be
imposed.

2 . Water shall be obtained from the Atascadero Mutual Water
Company and water operable facilities shall exist at the
property frontage prior to filing of the Final Map.
3 . The access easement to Parcels A and B shall be indicated
on the Final Map and shall generally be as shown.
4 . Plan and profile drawings of proposed driveway (s) shall
be submitted for approval by the Public Works and Planning
Departments in order to determine average grade and appro-
priate improvement requirements . If average slope exceeds
12% , paved improvement would be a requirement at the time
of application for building permit. Otherwise, an all-
weather surface would be required similarly. In the event
any portion of the driveway will be shared, improvement
of that shared portion shall be a requirement made in con-
junction with the first building permit. Notes to these
effects shall appear on the Final Map.
5. With regard to improvement standards for the driveway, the
following note shall appear on the Final Map:
"The private driveway shall be improved to a minimum width
of twelve (12) feet with an unobstructed vertical clearance
of fourteen (14) feet. "
6. Effort shall be made to minimize grading that would be dis-
ruptive to the natural topography and removal of existing,
mature trees. The following shall appear as a note on the
Final Map:
"No trees shall be removed without compliance with. appli-
cable City ordinances. No grading shall commence without
an appropriate permit and compliance with applicable City
ordinances. "
7. Drainage swales to be shown on Final Map.
8. Drainage and erosion control plans, prepared b{r a registered
Civil engineer, shall be submitted for review and approval
by the Public Works Department prior to recordation of the
Final Map.
9 . Escondido Road, along the entire property frontage, shall
be improved to City standards with a minimum paved width
• of 20 feet prior to recordation of Final Map or the appli-
cant shall enter into an agreement with the Public Works
Department to guarantee installation of frontage improvements
within one year of the date of recordation of the Final Map.

A performance bond, certificate of deposit, or similar
arrangement shall be made in conjunction therewith.
a. Street improvement drawings prepared by a registered
civil engineer shall be submitted to the Public Works
Department for review and approval prior to recordation
of the Final Map.
10. All pipeline and other easements of record shall be shown
on the Final Map. A letter shall be submitted from each
utility company indicating the nature and extent of any
building restrictions. A note so stating such restrictions
shall appear on the Final Map.
11. The applicant shall install one fire hydrant generally in
the vicinity of the subject property of a size and type,
and in a specific location and manner acceptable to the
Fire Department. Said fire hydrant shall be installed in
conjunction with road improvements as set forth in Condi-
tion #9.
12. Roof materials for all structures shall be Class C rating
or better and a Note to that effect shall appear on the
Final Map.
13. A Final Parcel Map in compliance with all conditions set
forth herein shall be submitted for review and approval in
accordance with the Subdivision Map Act and the City Lot
Division Ordinance prior to recordation.
a. Monuments shall be set at all new property corners
created and a registered civil engineer or licensed
land surveyor shall submit a letter certifying that
the monuments have been set prior to recordation.
b. A Final title policy (CTLA or ATLA) shall be submitted`
for review in conjunction with the processing of the
Final Map.
14 . Approval of this Tentative Parcel Map shall expire one year
from the date of final approval unless an extension of time
is granted pursuant to a written request prior to the
expiration date.

On February 2, 1981 the Planning -Commission conducted a public
hearing unanimously adopting Findings 1-2 , authorizing a Negative
Declaration and approving the above-referenced application subject
to Conditions 1-10 as listed in the attached Staff Report.
There was considerable discussion among the Commission concerning
several matters related to the application. These included the
standards used in establishing fire hydrant requirements, the
advantages/disadvantages of extending the water line vs . allowing
wells, the extent of the water line extension, the effect of the
project on an existing easement, and the need to protect the large
oak located near the access easement.
Levi Barrett, applicant, raised objections to Conditions 3 (all
weather curf:c_^g for driveways) , 5 (grading regulations and tree
removal ordinance too restrictive) , 6 (preferred hydrant at Parcel
B) , and 7 (preferred well on Parcel A with water line extended to
Parcel B frontage) .
John Madrid inquired about the effect of the project on his ease-
ment, about future land division of Parcel A, and about problems
with the well water on his property.
George Molina spoke in opposition to the use of wells on the
property.

REQUEST: To allow division of 9 . 63 acres into three lots of 4 . 3
acres, 2. 5 acres , and 2 . 5 acres each in an A-1-22 zone.
BACKGROUND
1. Existing Zoning A-1-22 (Light Agricultural District with a
minimum lot size of 22 acres)
2. General Plan: Suburban Single-Family Residential.
3. Environmental Determination: An environmental description form
has been completed. The Planning Director has prepared a Nega-
tive Declaration for the project indicating that no significant
adverse environmental effects are likely to occur if the project
is implemented as proposed,
4. Sitc C=!_'—_ ons : The site is generally flat to slightly sloping
and is basically grass covered with several large live oaks .
The site is bordered on the northeast by Traffic Way, a 40 foot,
two lane right-of-way, on the northwest by vacant property (also
owned by the applicant)-, and on the southwest and east by sparse
rural residential development. Lots 42 and 43 are currently
divided by a pair of dirt driveways which provide access to
parcels in Lot 41 which bounds the subject property to southwest.
At present, run-off is directed towards Traffic Way.
5. Project Description: The applicant is proposing to subdivide
9 . 63 acres into three lots of 4 .3 , 2 . 5 , and 2 . 5 acres each in
an A-1-22 zone. A 30 foot existing easement between Lots 42
and 43 is proposed to provide access to Parcel C. This ease-
ment also provides access to Lot 41. Access to Parcels A and
B could be off Traffic Way.
STAFF COMMENTS
On Thursday, January 8 , 1981, the Subdivision Review Board met to i
review this application. In attendance at that meeting were: Levi
Barrett, applicant; Larry ,Stevens, Planning Director; Mary Beatie,
Associate Planner; John Kennaly, Assistant Civil Engineer; Don Sylvia,

The following items of concern were discussed at that meeting:
1) Require hydrant on Traffic Way at driveway entrance in accord-
ance with requirements of the Fire Department.
2) Require upgrading of improvement of driveway, at least to an
all-weather standard.
3) Revise tentative map prior to scheduling for Planning Commis-
sion hearing to show all existing trees and structures including
fences, poles, etc. , and two foot contour intervals . (This item
was received January 14, 1981. )
4) Consideration of possible refund of monies from former tract
application.
5) Lot Line Adjustment LA 77-211 was never recorded.
• 6) Require percolation tests in conjunction with building permits
applied for on each lot.
7) Require extension of an 8 inch water line from Potrero to a
point just beyond the existing driveway; operable facilities
to be in place before recording of Final Map.
8) Recommend Negative Declaration.
With regard to Item 7 , the applicant expressed a desire to ,use pri-
vate wells on the property in lieu of extending a City water line.
Consideration was given to this request and it was discussed briefly.
Private water wells may be acceptable if results from tests provide
evidence that potable water at sufficient pressure for fire flow is
available at the sites. Currently the County Health Department
issues permits for domestic wells, and an application for domestic
wells would be subject to their requirements .
FINDINGS
1. The application as presented will not have a significant adverse
effect on the environment and the preparation of an Environmental

4 . The westerly lot line of proposed Parcel A shall be con-

. In discussing the matter, it was the consensus of the Commission
that there was no justification to grant a Variance. The reasons
in support of the applicants ' request were found to be based on
the design selected and on economic hardship rather than on the
size, shape, or topographical characteristics of the particular
property.
Don Messer, applicant, appeared on the matter requesting that the
Staff recommendation to deny the Variance be overturned. He stated
that the setback would eliminate a row of parking resulting in
Less floor area for the buildings.
Edward Chidlaw, attorney for the owner of adjacent residential
property, appeared and requested that the Variance not be granted.
The appeal period for the applicant has lapsed. Revised plans for
Departmental Review approval have already been submitted by the
applicant.

3. Environmental Determination: An initial study environmental
description form has been completed. The Planning Director
has prepared a Draft Conditional Negative Declaration which
indicates that no significant adverse effects are likely to
occur if certain mitigating measures are incorporated into the
project at the time of development.
4. Site Conditions : The 1. 5 acre site is presently vacant and is
generally level to slightly sloping. Vegetation consists only
of natural grasses City sewer and water are available to the
site. The subject property is bounded on the north and south
by existing commercial establishments. It is bounded on the
west by El Camino Real and on the east by mixed residential
R-2 zoning fronting on Santa Ysabel. Curb, gutter and sidewalk
are not in along the property frontage on El Camino Real.
5. Project Description: The applicant is proposing to develop a
54 ,333 square foot lot with approximately 18, 600 square feet
of retail commercial shops in three buildings . Also proposed
are 60 parking spaces including 2 handicapped and 2 loading
spaces. and 7, 780 square feet of landscaping. Building One
located along the northerly property line is proposed to be
5280 square feet. Building Two located along the easterly
property line is proposed to be 7, 800 square feet and, Building
Three situated along the southerly property line is proposed at
5, 520 square feet. Sizes of the interior spaces in the build-
ings will vary depending on the occupants ' needs Two enclosed
trash recepticles are also proposed. In order to maximize the

development area of the site, the applicant is also requesting
a variance to the 10 foot rear yard setback as required in
Section 22 . 36 . 050 of the zoning ordinance when commercial
property abuts residential development.
STAFF COMMENTS
The zoning ordinance (specifically Section 22 . 36 .050 from which
the variance is sought) appears quite clear in its setback require-
ments when commercially zoned and developed property abuts residen-
tially zoned and developed property. It would seem that the 10-foot
setback requirement in the C-1 zone fully considers that the resi-
dential development is also subject to a 10 foot rear yard setback
and that the intent therefore is to obtain a total of 20 feet
separation between commercial and residential land uses.
This requirement of the zoning ordinance appears to have been
applied consistently in other commercial development in the vicinity
of the subject property along El Camino Real (e.g. Adobe Plaza).
• It should be pointed out the purpose of a variance: is to allow an
exception where the zoning regulations discriminate against a par-
ticular owner and his property because of its unique size, shape,
topography or location. In other words, a variance allows parity
to occur where the strict interpretation of the regulations would
not. In reviewing the subject property, it seems apparent that
it is no different in size, shape, or topography than similarly
zoned C-1 parcels located on El Camino Real which are required to
comply with the rear yard requirement.
FINDINGS
1. There are no exceptional or extraordinary circumstances or
conditions applying to the subject property or proposed
buildings or uses which do not apply generally to other
land, buildings or use in the C-1 Zone.
2. The granting of the requested Variance is not necessary for
the preservation and enjoyment of substantial property rights
of the applicants.
3 . Approval of the requested Variance would result in the granting
of a special privilege to the applicants and the subject
property.
4. The granting of the requested Variance would adversely affect
and be materially detrimental to the surrounding neighborhood
and property and improvements therein.

RECOMMENDATION
The Planning Director recommends denial of the Variance V801215 :1
requesting elimination of the 10 foot rear yard setback as required

ACTION

I have been working on a development for lots 2 and 3
of Blk JA , about 4 lots south of Adobe Plaza. One
of the problems I have had is complying with the city' s
requirement for a 10 ft. set back at the rear of the
project to buffer the R-2 property behind my project.
I have contacted many retail businesses in Adobe Plaza
and most would prefer to have the 10 ft. space in back
of their buildings moved into the front parking area.
Some of the reasons are :
1. More parking and landscape area.
2. Better security with no back area for
theft, entry or loitering.
3• Less chance of noise from their business
bothering neighbors - cleaning crews
late at night, garbage can noise, custom
noise , etc .
4. Lower rent since the back property is non-
productive but must be added to the cost
of the project.
Example : 350 x 10' x $10 so . ft.
value = $35000 worth of C-l 'pro-
perty wasted.
If .you check my present development plan, I feel ,you
will agree that by using the 10 ft. in front of the
property, I am able to gain one full row of parking
spaces (12 cars) and provide large landscape areas
at each corner of the building. I have tried many
other lay outs for this project and have been unable
to find a better arrangement for retail commercial .
We know from experience in other retail areas that
parking in the rear of retail stores is unappealing
to customers and causes extreme hardships on the
future retail busines (example: Plaza Del Camino) .

I also believe the land behind my property improperly
zoned in the new general plan. You will note the low
density on the parcels from Santa Ysabel west toward
El Camino and high density from Santa Ysabzl east.
This appears backwards to me. If that property were
zoned and developed as high density R-4 , the 10 ft
set back on my project wouldnotbe important, in
fact, the back wall of my building would provide a
screen from El Camino for' the back property and an
ideal parking area for residential or proffessional
uses.
There are some additional things that could be done
to provide a softening effect to the back wall of my
building:
1 Note the landscaped court .yard between
my proposed building on the back of my
property.
2. Additional trees could be planted -on
the back of the neighbors lot with
their approval.
3. The roof line could be altered to re-
duce the height of my building on the
property line.
I hope you will take the time to look at the 10 ft
set back at Adobe Plaza and compare it to my plan
with more parking and landscaping. It seems unnec-
essary to burden developers and future tenants with
requirements that are either impractical or obsolete.
By forcing compliance to this set back ordinance on
small lots like mine, .you will be limiting the park-
ing and building potential on most El Camino lots.
My plan provides ample parking with enough rental
building space to make the project economical . Any
less building space would require higher rents to
sustain the debt service.
I urge ,you to look at all E1 Camino C-1 lots and
consider an ordinance change to eliminate this pro-
blem in the future.

On January 14 , 1981 Hilliard Surveys appealed the decision of the
Planning Commission to deny the road exception request for the
reasons outlined in the prior letter of November 18 , 1980 .
On January 5, 1981 the Planning Commission conducted a public hear-
ing and recommended, with Commissioners Lilley, Oglesby, and Sherer
dissenting, that the road exception not be granted since the find-
• ings set forth in the Lot Division ordinance could not be affirmatively
made.
In discussing the matter the Commission considered the various
alternatives listed in the attached Staff report and the possible
consequences of each. Discussion centered around the responsibil-
ity for irnpr;,.i ny the road, the slope and design of the road, and
the use of the road. There was also consideration of road improve-
ment standards in general.
Robert Hilliard, applicant' s engineer, appeared on the matter and
requested the exception be granted allowing an offer of dedication
to be made without any improvements. He indicated that the appli-
cant would be willing to grade but not improve the road. He
contended that the road improvements were not mentioned at the
beginning of the project.
Don Wyant and Len Gibault appeared in support of the road improve-
ment requirement stating that the steepness of the road made it
difficult to reach their property further up Vega.

A. The parcel map proposes to shift a portion of Vega Avenue
to intersect Ardilla Road at more of a right angle and
thereby change the configuration of the two lots . The
realignment compensates for the error made in constructing
the residence on Parcel B within the Vega Avenue right-
of-way.

B At their meeting on June 9, 1.080 the Atascadero City Coun-
cil, acting on the recommendation of the Planning Commission,
voted to approve Parcel Map AT 79-265 subject to Conditions
1-4 as contained in the Staff Report prepared by County
Staff. Condition 2 of that report states :
"2 . The new right-of-way as shown on the tentative
map at the road intersections to be offered for
dedication. "

STAFF COMMENTS
At the request of the applicant, staff reviewed the file on Septem-
ber 25 , 1980. As a result of this review, a letter was sent to the
applicant requesting two items :
1) Road improvement plans for the realigned portion of Vega
Avenue.
2) Crocker National Bank signature on owners certificate for final
map.
Item 2 was necessary since at that time, Crocker National Bark was
the owner of Vega Avenue. However, the applicant has subsequently
received a Quitclaim Deed for Vega from Crocker Bank.
The request for improved plans and ultimately the road improvements.
for the realigned portion of Vega Avenue was made for two reasons.
First, the proposed alignment would have a slope of 11% , considered
too steep without improvements. It should be pointed out that
while both parcels created by this map are able to take access off
Ardilla Road, Vega Avenue is the only legal access to five other
properties, inasmuch as Vega Avenue deadends at the top of the hill.
Secondly, it is the policy of the Public Works Department not to
reject offers of dedication. Section 66477 .1 of the Subdivision
Map Act states: "At the time the legislative body approves a final
map, it shall also accept, accept subject to improvement, or re-
ject any offer of dedication. " The next section allows the legisla-
tive body, if Liie original offer of dedication was rejected, to
" . . . . . .by resolution at any later date, and without further action
by the subdivider, rescind its action and accept and open the
streets. . . . . "
If an offer of dedication is rejected, there is no longer legal
access by the public until such time as the offer is ultimately
accepted by the legislative body. If the offer is accepted in
an unimproved condition, it becomes part of the City street main-
tenance system and would therefore become the responsibility of
the City of Atascadero.
On November 18 , 1980, the Planning Director received a letter from
Robert Hilliard, acting on behalf of the applicant, appealing the
requirement concerning improvement of Vega Avenue.
On Thursday, December 4, 1980 the Subdivision Review Board met to
review this request with the applicant, Mr. Don Heath, and two
representatives from Hilliard Surveys, Mr. Robert Hilliard and Mr.
Rick Barber. Also attending the meeting were : Larry Stevens,

Planning Director; Mary E. Beatie, Associate Planner; Larry Mc-
Pherson, Public Works Director; John Kennaly, Assistant Civil

Commissioner. The following items concerning Vega Avenue were
discussed:
1. Require the improvements now to the realigned portion.
2. Require participation in a future assessment district to
improve Vega Avenue
3. Accept the road unimproved, realizing potential liability
incurred by the City in so doing.
4. Reject the offer of dedication realizing the potential access
problems for affected property owners.
5. Unresolved encroachment problems.
The available alternatives include:
1. The City may accept the offer of dedication and assume the re- •
sponsibility to improve Vega Avenue.
2. The City may accept the offer of dedication with the road im-
provements completed by the applicant.
3. The Lily may reject the offer of dedication and possibly create
legal access problems as well as physical (11% slope) access
difficulty to the five parcels with no other access available.
RECOMMENDATION
The City Planning Department recommends the proposed realigned
section of Vega Avenue be improved to full City standards by the
applicant and that upon completion of said improvements, the City
shall accept the offer of dedication. It is also recommended that
the applicant be given the option of deferring installa io --
improvements for a time no ne ear after providing
improvement plans and improvement guarantees. --
ACTION
The Planning Commission should by motion direct Staff as deemed
appropriate.

On January 19 , 1981 the Planning Commission conducted a public
hearing unanimously adopting Findings 1-2 , authorizing a Condi-
tional Negative Declaration, and recommending approval of a zone
change as noted in the attached Staff report to R-4-D with the
"D" to mean:
1) Development of the property shall be limited to professional
offices, single family dwellings, public parks and playgrounds ,
home occupations, personal services and public utility offices.
• 2) Provision shall be made to develop a suitable screening buffer
which may include landscaping, fencing, and similar between any
office development and surrounding residential uses .
3) Access shall be provided to the property only from Morro Road.
In brief discussion, it was the consensus of the Planning Commission
that the R-4 was most consistent with the Professional Office land
use designation as long as the D attachment was used.
The applicant, Mr. Barksdale, appeared and stated his agreement
with the recommendation. Tentative plans for an office project
were presented.

BACKGROUND
1. Existing Zoning: R-1-B-2-D.
2. General Plan: Professional office.
3. Environmental Determination: An initial study environmental
description form has been completed for this project. The
Planning Director has prepared a Draft Conditional Negative
Declaration for the project indicating that no significant
adverse effects are likely to occur if certain mitigating
measures are incorporated into the project at the time of
development.
4. Site Conditions : The site is roughly 0. 63 acres and is gen-
erally level to slightly sloping. Vegetation on the site
consists of mostly natural grasses and forbs. The property is
bounded on the north and south by established residential uses .
A real estate office which fronts on Morro Road and a vacant
parcel bounds the property to the east. To the west across
Navajoa is a mixed residential area.
5. Project Description: The applicant is requesting a zone change
from R-l-B-2-D to R-4 to enable the ultimate development of the
site with a two story commercial office building. The applicant
contends that the R-4 zone requested would conform with. the
Professional Office land use designation of the 1980 General
Plan as both would allow the use which he plans to develop on
the site. The parking lot, some lights and a sign are proposed
to be located on the lot adjacent to the property which fronts
on Morro Road. Preliminary development plans have not been
submitted at this point.

STAFF COMMENTS
Since it is the applicant' s intent in requesting this rezoning to
allow construction of a commercial office facility, evaluation of
this request should focus primarily on the consistency of this re-
zoning with the intended use specified in the General Plan. Under
the present zoning ordinance, a specific professional office zone
is not available. Under the present zone, commercial offices are
not a permitted use. However, Section 22.32 . 015 of the R-4 zone
under Departmental Review Uses allows : " (6) Professional offices,
personal services, and public utility offices. "
It would seem reasonable to consider the applicant' s request for a
rezone to obtain consistency with the General Plan, as it is likely
the City would pursue similar zoning in its upcoming City-wide re-
zoning program. The General Plan also suggests access to parcels
be from an arterial.
FINDINGS
• 1. The project will not have a significant adverse effect upon
the environment and preparation of an Environmental Impact
Report is not necessary. However, it will be necessary to
introduce certain mitigation measures into the project to
minimize potential minor adverse effects.
2. The recutmuC,ided rezoning is consistent with the Professional
Office designation by the 1980 Atascadero General Plan.
RECOMMENDATION
Based upon the above findings, the Planning Department recommends
as follows:
1. Issuance of a Conditional Negative Declaration subject to the
following conditions:
a. That a drainage plan be submitted for review and approval
by the Planning and Public Works department prior to issu-
ance of a building permit.
2. Approval of a change of zone from R-1-B-2-D to R-4-D with the
"D to mean:
1. Development of the property shall be limited to professional
offices, single family dwellings, public parks and play-

AMENDING SECTION MAP 12-0-33 OF THE OFFICIAL
ZONING MAPS OF THE CITY OF ATASCADERO BY
PLACING CERTAIN PROPERTY IN THE R-4-D ZONE
THE CITY COUNCIL OF THE CITY OF ATASCADERO ORDAINS as follows:
Section 1. -Council Findings
After conducting a public hearing, the City Council finds and
determines that:
1. Theprojectwill not have a significant adverse effect
upon the environment and preparation of an Environmental
Impact Report is not necessary. However, it will be
necessary to introduce certain mitigation measures into
the project to minimize potential minor adverse effects.
2 . The recommended rezoning is consistent with the Profes-

News, a newspaper of general circulation, printed, published and
circulated in the City in accordance with Section 36933 of the
Government Code; shall certify the adopting and posting of this

together with proof of posting to be entered into the Book of
Ordinances of this City.
Section 5 . Effective Date

A-1 to R-4-B-2-D to bring the zoning of the site into conform-
ance with the 1980 Atascadero General Plan and to enable subse-
quent use of the site for development with multiple family
dwelling units. No specific site development plan has been
submitted at this point.
STAFF COMMENTS
The subject property currently zoned A-1 is one of two remaining
parcels in the area bounded by El Bordo Avenue, El Camino Real and
Musselman Avenue and the Atascadero Regional Park, yet to be zoned
• R-4 . ' This whole area is designated High Density Multiple-Family.
The existing R-4-B-2-D zoning generally encompasses the Ranch Del
Bordo Mobile Home Park, the Nineteenth Hole Motel, and several
single family dwellings.

It would seem reasonable to consider the applicant' s request for a
, rezonetoobtain consistency with the General Plan, as it is likely
the City would pursue similar zoning in its upcoming City-wide re-
zoning program.
However, Section 22. 70 . 010 indicates the "B-2" specifies ten thou-
sand square feet minimum building site area, and the General Plan
specifies a half-acre minimum lot size for High Density Multiple
Family. In order to ensure potential creation of new parcels con-
sistent ,with the General Plan, the "B-2" part of the requested
zoning could be eliminated and minimum lot sizes could be estab-
lished by provisions of a "D" combining district.
The "D" combining districtshould also be used to ensure conformance
with other general plan criteria such as density (the R-4 zone
allows two units for the first 6000 sq. ft. and one additional
unit for each 1300 sq. ft. of land area) ; mobile home density; and
building height (the R-4 zone allows three stories. Consideration
should also be given to requiring Departmental Review for projects
of less than ten units. )
FINDINGS
1 The project will not have a significant upon the environment
and the preparation of an Environmental Impact Report is not
necessary. However, it will be necessary to introduce certain
mitigation measures into the project to minimize potential
adverse effects.
2. The recommended "D" with the proposed rezoning will provide an
opportunity to ensure that the resulting development will be
an attractive and compatible neighbor to adjacent properties
and public roads.
3. The recommended rezoning is consistent with the High Density
Multiple-Family designation by the 1980 Atascadero General Plan.
RECOMMENDATION
Based upon the above findings, the Planning Department recommends
as follows :
A. Issuance of a Conditional Negative Declaration subject to the
following conditions

ORDINANCE NO. 36
AN ORDINANCE OF THE CITY OF ATASCADERO
AMENDING SECTION MAP 12-0-34 OF THE OFFICIAL
ZONING MAPS OF THE CITY OF ATASCADERO BY
PLACING CERTAIN PROPERTY IN THE R-4-D ZONE.
THE CITY COUNCIL OF THE CITY OF ATASCADERO ORDAINS as follows:
Section 1. Council Findings .
After conducting a public hearing, the City Council finds
and determines that:
1. The project will not have a significant adverse effect
upon the environment and the preparation of an Environ-
mental Impact Report is not necessary. However, it will
be necessary to introduce certain mitigation measures
into the project to minimize potential adverse effects.
2. The recommended "D" with the proposed rezoning will pro-
vide an opportunity to ensure that the resulting develop-
ment will be aln attractive and compatible neighbor to
adjacent properties and public roads
3. The recommended rezoning is consistent with the High i
Density Multiple-Family designation by the 1980 Atascadero
General Plan.
Based upon these findings, a change of zone from A-1 to R-4-D with
the "D to mean:
"l. Departmental Review is also required for multiple family
residential uses totaling less than ten units per building
site.
2. Design review of development proposals with particular
attention given to insuring an attractive apppearance
from El Bordo and adjacent properties by means of archi-
tectural design, landscaping, building and use setbacks;
and signing and lighting limitations.
3. That the minimum lot size for creation of new parcels shall
be one-half _(1/2) acre.
4. That building height shall be limited to two stories .
5. That, in the event the site is developed with mobile homes,
the maximum allowable density shall be eleven (11) units
per acre as provided in the General Plan. •
• 6. That the density shall be calculated on a basis of 36
people per acre or any combination of the following
maxima which when multiplied by standard occupancy
factors, does not exceed 36 individual residents per
acre:
18 one bedroom apartments per acre
12 two bedroom apartments per acre
9 three bedroom apartments per acre
7 four bedroom apartments per acre

Section 2. Zoning Change.

to reclassify the following described property from A-1 to R-4-D:
• Parcel 1 as shown on Parcel Map CO 72-344 in the City of
Atascadero, County of San Luis Obispo, State of California,
as per map recorded February 16 , 1973 in Book 10, Page 69
of Parcel Maps, in the office of the County Recorder of said
County.
Section 3. Zoning Map
Map 12-0-34 of the Official Zining Maps of the City of Atas-
cadero on file in the City Planning Department is hereby amended
as shown on attached Exhibit "A" which is hereby made a part of
this ordinance by reference.
Section 4. Publication
The City Clerk shall cause this ordinance to be published
once within fifteen (15) days after its passage in the Atascadero
News, a newspaper of general circulation, printed, published and
circulated in the City in accordance with Section 36933 of the
Government Code; shall certify the adopting and posting of this
ordinance and shall cause this ordinance and this certification
together with proof of posting to be entered into the Book of
Ordinances of this City.
Section 5. Effective Date
This ordinance shall go into effect and be in full force and
effect at 12 : 01 a.m. on the 31st day after its passage.

SUBJECT: 3-F Meadows Access
Attached is a Staff report concerning 3-F Meadows
access which was developed in response to some comments
offered at a City Council meeting, October 27 1980 . The
report represents a consolidated effort on the part of
Staff and, within the constraints imposed by time and the
availability of adequate data, represents a overall general
evaluation of the problem. The report also serves to
provide at least a perspective from which to judge the
problems involved in the 3-F Meadows circulation access . It
should be pointed out that some of the problems which are
addressed in the Staff report are applicable to other areas
in the City.
One of the underlying difficulties, of course, is
that the City must proceed very carefully in accepting
streets to be maintained in the City system because of the
liability problem involved in poorly designed, engineered or
maintained streets. Many of the streets in question do not
meet accepted standards for municipal streets. This is in
addition to any difficulties which may be encountered in
terms of determining ownership of the streets themselves.
Without presuming to judge the efforts made by the County or
developers to construct adequate streets, I would merely
point rn,+- t-hat the liability issue is underscored in con-
sideration of the law suit now filed and pending because of
an accident occurring on Alturas Road where it intersects
Del Rio. This road is a privately owned road as far as we
can determine and, with, the construction of the Alturas Hill,
it is questionable as to whether its design characteristics
are those which would be accepted as a City street. Never-
theless, acceptance of streets of that nature ', would expose
the City to extreme liability exposures. This liability
factor must be considered in any consideration of the problem.
Along with the liability problem, of course, is one of
straight dollars. How much can the City afford in terms of
solving long-standing problems which were existing as a
consequence of an earlier subdivision which, in this modern
day and age, would not have occurred as subdivision require-
ments have changed since the Colony was originally laid out.
However, there is a larger question involved and that is
should the City, as a whole, be responsible for correcting
problems generated by private development and private owner-
ships?

I am certain that we may be able to discuss alterna-
tives and options other than those presented by the Staff
report given the time and the effort to come in with a very
exhaustive study. However, the Staff report, as presented
to you, does cover the general area rather well and points
out some of the problems. I would caution that the Staff
discussion of alternatives does not necessarily mean that
any one of those alternatives is particularly endorsed from
a Staff' s viewpoint. Rather, the alternatives are presented
to provide a range of options against which you can assess
the extent of the problem. One particular recommendation
seems to me to be worthwhile for consideration, not only in
the 3-F Meadows area but in other areas as well, and that is
the standards for construction of a residence or buildings
with fire retardent or fire resistent materials. The Fire
Chief has been instructed to look into possible options that
we might adopt in our Fire Code to help offset the cost of
buying more and more fire equipment if, in fact, the threat
of loss can be reduced by homeowner installed devices and/or
building materials. I' think this certainly is worthy of
consideration regardless of what the solution to the 3-F
Meadows problem may be. I would add that these recommenda-
tions will be coming to you in specific form at the time
that the zoning and building code revisions are brought to •
you for approval.
Without in any way attempting to disparage the perceived
safety considerations that have been advanced by the property
owners, I would only like to point out that the long-term
solut-4= some of these problems may well rest in the
hands of the property owners themselves with particular
regard to providing better access. As to the problem of
better response times by the fire and police, the response
times that have been demonstrated thus far do not seem to be
dramatically out of line with the present capabilities. The
question then becomes how much more is needed to enhance
those response times to a lower level and that, then, is a
matter of analyzing cost-effective solutions to that reduc-
tion in response times.
At this point I do not feel that we are in a position
to offer those kind of solutions, but certainly acknowledge
that consideration of these problems is an ongoing concern
which is being looked at by the Fire Department and Police
Department.
As to the recommendations of the Staff report, I share
in general the recommendations as contained therein, but
hasten to point out that a great deal more work needs to be
done before any of these can be placed into ordinances or
actual building standards. It might be well for the Council
to consider this report and not take any action at the

present Council meeting, but to digest it, discuss it and
then at a future time come back with some kind of a position;
either that the City policy will help and assist property
owners in the formation and execution of assessment districts
to solve the circulation problem, and/or that the City
Council , as a matter of policy, wishes Staff to develop and
present to Council development standards which will help to
ameliorate the problem in terms of building, zoning and
fire code revisions. Then, of course, there is always the
alternative of doing nothing which is not a very positive
step and not one that I would particularly endorse.
I think the Council must proceed with caution in terms
of adopting any kind of agreement to accept, as dedicated
streets, any roads and streets other than thosethatare
already our responsibility by virtue of the County having
accepted them previously because of the very real exposure
to liability and problems brought about as a consequence of
deficiently engineered roads. Having said this, then, the
solution to the overall problem is a long-term one and
ultimately boils down to an initiative on the part of the
property owners concerned to solve the circulation and
access problems. Some of these concerns can possibly be
• mitigated as large developments occur in the area; by that I
mean lot splits of a minor nature or a major subdivision
nature.

SUBJECT: Staff Report - 3-F Meadows Access
Background:
This staff report is in response to comments offered at the
City Council meeting of October 27, 1980. At that meeting a
number of property owners in 3-F Meadows asked for assistance in
solving road maintenance and access problems within that develop-
ment. There appeared to be an equal number in the audience who
wanted no action taken.
Certain areas of the 3-F Meadows development are presently
located on long, dead end streets , a condition which is undesir-
able from the standpoint of ideal circulation and emergency access.
This condition resulted from the sale of lots divided by the original
Colony subdivision prior to current subdivision requirements having
been established, or by subsequent lot divisions where no access
provisions were applied.
iThe Public Works Director has met with spokesmen of several
property owner groups and attended a regular meeting of the 3-F
Meadows Homeowner' s Association. The primary message coming from
these groups is a wish to have road maintenance assumed by the City
with a secondary request that emergency access beimproved. In-
dividually, there have been opposing views to access improvements
since some did not want to allow more casual traffic flows through
the development. In any case, the purchasers of property in 3-F
Meadows should have been aware of the condition when they purchased
their lots and should have been aware that the Final Subdivision
Public. Report indicated that all roads within the development were
private, with minor exceptions, and that each property owner would
be responsible for repair and maintenance of their road frontage.
Following is a list of comments from staff and finally a list
of alternatives and recommendations.
Public Safety
Both the Police Chief and Fire Chief see the limitations on
access as a factor in response time to this area, although the
number of emergency calls has been quite low and access is not the
only problem. This concern, however, is not uncommon to many other
areas of the City.
During the first six month of operation, the Police Department
responded to a total of 29 calls in 3-F Meadows. 24 were non-emergency
with an average response time of 142 mints , while 5 were emergency
calls, with an average response time of 52 minutes.
The Fire Department lists 3 emergency calls with an average
response time of 8-2/3 minutes.
Response time for both emergency services appear acceptable

in consideration of the distance from the point oforigin of those
services. Access via the dry weather crossing of Atascadero Creek
adjacent to Carmelita Avenue is avai a le most o e year, part-

The Fire Chief_ notes that 3-F Meadows is located within an
area designated b the California Department of Forestry as an

extreme fire hazard due 'to potential wildland fires. Because of
this and the travel distance to some areas. of the development, some
building requirements have been suggested which are discussed
later in this report.
Planning
Comments made by the Planning Director relate to development
alternatives and restrictions that are listed further on in this
report. He also indicates that in his judgment, the current cir-
cumstances do not dictate drastic action at this time but, never-
theless, consideration should be given to alternatives which will
encourage eventual improvement of the circulation system while
minimizing any risks associated with current circulation deficiencies.
Public Works
The Public works Director concurs with the other departments ' •
position that lack of access into the 3-F Meadows Development is a
problem which will increase as further development and service re-
quests occur.
It is impossible to project a point where the level of develop-
ment could cause the access deficiencies to be critical to the
general safety of life and property in the area. Certainly the
volume of traffic, even with full development, might not alone be a
major consideration, although the lack of a secondary access to
thedevelopment would be.
Concerning the issue of who owns or controls the road easement ,
the original Colony map reserved the right of dedication to the
Colony Holding Company and Anglo-California Trust Company. It would
appear that only the successors to the original interest have a
clear right to make offers of dedication for public road purposes.
Since the chain of the succession of ownership is in any case,
obscured, unscrambling titles might be extraordinarily complicated.
The original map also' states "They (the Owners) expressly declare
that no other part or portion of said land, and no street, road
boulevard, lane, park, plaza, tract, lot or other place shown or
delineated on said map is dedicated or intended to be dedicated to
any public use whatsoever. "
This last statement seems to indicate that use of roads shown i
on the Colony Subdivision was intended to be private and only the
holders of the rights as designated by the map could offer a street
for public use. Of course, this does not preclude acquisition of
road rights-of-way by proscriptive right, after a number of years
of unrestricted use by the public.

An attempt by the City to force certain property owners to
• open undeveloped streets for public access could lead to lenghty
litigation with uncertain results as well as assumption of a
clear responsibility by the City to improve such roads if they
were acquired.
Unless the Council should find a compelling need to satisfy
public health and safety, then any road construction done under
assessment district proceedings would require a majority of the
benefiting property owners to approve the formation of an im-
provement district. The Council, by 4/5 vote, can impose an
assessment district if findings that public needs outweigh objections
to such assessment. The condition of the present ownership of the
road rights-of-way complicates and tends to limit the number of
assessment proceedings that might be practical. A short form
assessment district such as that outlined in Section 5870 of the
Streets and Highways Code, could not be utilized unless the City
holds the street easement. It is possible that separate improvement
acts would be needed for acquisition of right-of-way and for con-
struction of road facilities.
An evaluation of the costs to provide alternate access into
portions of 3-F Meadows is beyond the scope of this report. It
is noted, however, that the cost to provide a low flow crossing
(a so-called "Arizona Bridge") to Atascadero Creek from Carmelita
would be substantially less than the extension of Carmelita to San
• Gabriel Road, however, the extension of Carmelita would be a much
more satisfactory long-term method of access. Rights-of-way,
grading, and embankment protection would substantially raise the
cost of the Carmelita extension.
Carmelita should not be improved westerly of Barranco to tie
into Highway 41 since this would create a blind intersection on a
high speed, high volume State highway. There is no practical way
of making that intersection safe and acceptable for City use.
The impending subdivision of several large parcels at the west
end of the San Marcos Road leads to the realistic possibility of
requiring that the balance of San Marcos be improved to connect with
Highway 41 to at least serve these subdivisions. Certainly the
travel distance from HIghway 41 to the proposed subdivided areas
is shorter than from any other access point. Since the balance
of San Marcos Road is already graded and building sites exist along
that alignment, this possibility strengthens the view that further
development of subdivisions to the west be required to assure
completion of a San Marcos to the Highway 41 link.
The road plan attached to this report illustrates the area
in 3-F Meadows where access is restricted. Basically, three
distinct areas lack alternative access routes.

They are:
1) Portal and Escondido Roads. Portal provides an extremely •
steep access from San Marcos Road. Portal exists as a paper road
connecting to San Gabriel Road. Although this area is presently
undeveloped, it may well pose the most critical access problem in
3-F Meadows. Access would be vastly improved by extending Portal
to San Gabriel, although this situation may be blocked by an Ag-
ricultural Preserve which surrounds a portion .of the proposed
route.
2) Lucinda Lane, Barranco Heights , Barranco Road, Carmelita
Road, Casanova Road. Either the completion of Carmelita from
Casanova to San Gabriel or a crossing of Atascadero Creek near
Casanova would substantially eliminate access problems to that
area. A dry weather crossing of the creek near Barranco Road pro-
vides limited access during most of the year.
3) Realito, Vista, and San Marcos Road from Portal Road to
the west. A majority of this area is undeveloped and would sub-
stantially benefit from the extension of San Marcos Road to
connect with Highway 41 to the west.
Identification of these three areas is critical in determining
benefits which might result by providing secondary access. Only
those benefiting propertyownerswhose access� is improved should
have any financial responsibility for such improvement. Further
study would be required to more exactly delineate the areas of
benefit.
This same observation is appropriate in considering upgrading
of any roads in the development which have not been accepted by the
City for maintenance. Before the City should accept the existing
road system, upgrading of existing paved roads would be required
and those owners with fronting property should be responsible fin-
ancially for the work necessary to bring these roads to City
Standards.
The attached map shows the status of the roads within the 3-F
Meadows Development.
Alternatives :
The following alternatives are presented for consideration,
however, it must be emphasized that any final selection of any
alternative which financially impacts the property owners in 3-F
Meadows should be acceptable to the majority of those owners. In
other words, if the majority does not want or are unwilling to pay
for ,improved access or City maintained streets, then the City should
take no further action on these matters; unless the Council is , by
a 4/5 majority, convinced that unilateral Council action is needed,
this latter approach would appear undesirable.

Alternatives that deal with building or development standards ,
should be considered for application throughout the City and not
just for the 3-F Meadows area.
The following is a list of mitigating alternatives which seem
responsive to the problems identified for 3-F Meadows. They may
be applicable to other areas as well. No particular priority or
preference is intended, merely an exposition of alternatives.
1) Moratorium prohibiting further building. This would limit
the number of residences to those now existing until a solution has
been developed. It should be pointed out that building activity
in this area is fairly strong at the present time and that additional
development can increase the magnitude of the problems with the
current circulation system by increasing the traffic thereon and by
increasing the demand for demand-response services (i.e. fire, police,
ambulance) .
2) Moratorium prohibiting future land divisions. This would
limit the number of building sites to those now existing until a -
solution has been developed. This alternative would then place a
lid on the number of possible building sites which is more restrictive
than is possible under current General Plan policies and zoning re-
gulations. This lid would become the maximum build-out resulting
from the existing circulation system.
• 3) More restrictive development standards. These could serve
to minimize the need for the demand-responsive services or would
make their access less difficult. Several of the standards could
also be applied to existing structures. These include higher fire
resistive construction standards for exterior walls but especially
for roofs ; brush clearance standards around all structures;
driveway standards designed for emergency vehicles (minimum width
and vertical clearance paving for excessive gr es • de
or length turnaround areas) ; better site i entification (more road
r-Signs , addresses visa Z—"at the street) ; increased smoke detector
requirements; and more fire hydrants. For new structures many of ,
the standards could be imposed during the building permit process.
Those applicable to existing structures could be phased in. Further-
more, some of these may be appropriate for application outside of
3-F Meadows.
4) Road construction fees. This might be similar to the former
County road deposit program (hopefully, an adjustment would be work-
able) in that fees would be collected in conjunction with permits
and, when adequate funds are collected roads could be built.
5) Road improvement standards. This could include an evaluation
of when and what should be imposed. For example, frontage road
improvements could be required in conjunction with building permits.
• Review could be made of road requirements for land divisions. While
major road extensions may be appropriate for larger subdivisions , the
equitability problem cannot be ignored.

6) Residential fire sprinklers. This would apply for both
new construction and for existing development where combustible •
roofing and wall materials were used.
7) Increase access into development. This may be accomplished
by the City, by the property owners, or both the City and property
owners co-operatively. The areas where access may be extended are
shown on the attached map.
8) Acquisition of rights-of-way. Obtain rights-of-way from
property owners where road extensions may be made to improve access.
9) Implement City-wide assessment district to improve roads.
This action could be utilized to improve deficient areas throughout
the City, although it would be time consuming and expensive to im-
plement.
Recommendations :
The following recommendations are made concerning the findings
made in this report.
1) The City should not actively pursue having the affected pro-
perty owner open access to San Marcos Road Between San Gabriel Road
and Vista Road. If this unimproved roadway were to be opened as a
second access into 3-F, serious intersection problems would be created
at San Marcos and San Gabriel as the result of the vertical and
horizontal alighment of the intersection. Additionally, access at
this location does not materially affect travel time into the development.
2) The City should not pursue acquiring an interest in the private
road rights-of-way without assuring that the roads within these rights-
of-way have been constructed to City standards.
3) The City should lend its offices in the administration of an
assessment district to improve access only at the instigation of a
majority of the benefitting property owners. If, during a series of
hearings on the access problem, it is determined that a clear majority
of the affected property owners are not willing to proceed with needed
work, then the City should take no further steps to form an assessment
district to solve the access problem.
4) Before any further subdivisions are approved that require access
from San Marcos Road in 3-F Meadows, San Marcos should be extended and
improved to City standards to its westerly junction with Highway 41.
This would create a back door to a significan��j ung tion of the development.
The responsibility for improving this access�`°'f i�g beshared by the
prospective subdividers and any action on t -final map would be con-
tingent upon an access improvement.
5). To encourage secondary access to lots in the Casanova Road,
Barranco Road and Lucinda Lane area as well as lots fronting on Carmel?,
either Carmelita should be extended from Casanova to San Gabriel Road
or an improved crossing of Atascadero Creek from Carmelita between
Barranco and Casanova should be constructed. The choice of these two
options should be based on an indepth feasibility study and the costs
should be borne by the benefiting property owners.

6) T ncourage access to the Portal and Escondido Road area,
Portal be extended to San Gabriel Road.
7) All associated costs to prepare feasibility reports ,
acquire right-of-way, construct road or bridge facilities , prepare
plans and specifications, and obtain financing should be the re-
sponsibility of the benefited property owners or prospective sub-
dividers.
The following development standards should be considered to
mitigate the effects of wildland fires , and may apply to other areas
of the City as well as to 3-F Meadows :
1) Require adequate fire restrictive roofing material.
2) Establish and enforce brush clearance standards around
building and encourage landscaping which will reduce fire hazards.
3) Require adequate fire restrictive exterior walls , or
develop standards for increased clearance zones around the building. _
4) Develop driveway standards which will allow access for
emergency vehicles. This could include minimum width and vertical
clearance as well as maximum grade and minimum turning radius. It
is recommended that driveways with less than a 12% slope be improved
with an all weather surface while those with more than a 12% slope
• be asphalt pavement or concrete. Maximum grades shall be defined
and established. 4
5) Establish appropriate fire hydrant spacing.
6) Develop and implement appropriate smoke detector requirements.
7) Develop and require a conspicuous address numbering system
along with improved and standardized street identification.
Again it should be emphasized that any of the above measures
used to improve 3-F Meadows access should be at the benefiting
property owners expense and not at the expense of the general tax
payer.

• a. Record on Appeal Must Include Trial Transcripts
The U.S.C.A. 9th has held that a party to a lawsuit in federal court
who attacks the trial judge's findings must include in the record on
appeal transcripts of all the testimony relevant to her contention
that the evidence was insufficient to support these findings.
(Thomas v. Computax Corp. , U.S.C.A. 9th, October 27, 1980)
b. Policeman's Wife Held Eligible for Death Benefits
The U.S.C.A. 9th has ruled that the wife and children of a police
officer killed while en route from the police station to his home
are eligible for benefits under the Federal Public Safety Officer's
Death Benefits Act. (Russell v. Law Enforcement Assistance Adminis-
tration, U.S.C.A. 9th, October 31, '1980)-
C. Civil Rights Act
The U.S.C.A. 9th has held that to establish a prima facie case of
racial discrimination under the 1870 Civil Rights Act, the plaintiff
must prove the same elements as required to prove a 'Title VII case
of employment discrimination. (Phiffer v. Proud Parrot Motor Hotel,
Inc. , U.S.C.A. 9th, November 24, 1980)
d. Appeal of Tentative Map OK After Final Map Approved
The C.A. 4th has held that neither the recording of the final sub-
division map nor the completion of land preparation for a proposed
project made mute an appeal of the tentative map for the project.

e. County Ordinance Banning Off-Road Traffic Upheld
The C.A. 4th has upheld a San Bernardino County ordinance which pro-
vides that no person may drive a motor vehicle over land belonging to
another without that person's written permission. (Sports Committee
District 37 v. County of San Bernardino, C.A. 4th, December 11, 1980)
f. Late Dues Not Basis for Dismissal
The U.S.C.A. 9th has held that before a union takes the drastic step
of causing a member to be discharged from his employment for delin-
quent dues payments, it must take whatever steps are necessary to be
certain that the delinquency was not due to the member's ignorance
or inadvertence. (NLRB v. Construction and Building Materials
Teamsters Local 291, U.S.C.A. 9th, December 11, 1980)
g. Termination of Civil Service Employee Held Justified
The C.A. 3rd has ruled that a civil service employee who has been
absent from work for five consecutive working days without leave is
deemed to have voluntarily resigned and may not attack his termina-
tion on due process grounds. Government Code Section 19503 provides
for automatic resignation when an employee misses five consecutive
working days without leave. (Willson v. State Personnel Board, C.A.
3rd, December 15, 1980) •
h. Employment Discrimination
The U.S.C.A. 9th has held that a necessary element of an employment
discrimination claim brought under the 1870 Civil Rights Act is that
the party must have applied for the job. (Tagupa v. Board of Direc-
tors, U.S.C.A. 9th, December 12, 1980)
i. Special Assessments Not in Tax Limitation Provision of Article XIII-B
The C.A. 3rd has held that a county's assessments on real property to
collect funds to pay for improvements on the property are not subject
to the tax limitations prescribed by Proposition 13. (County of
Placer v. Corin, C.A. 3rd, December 17, 1980)
j. Rehabilitation Programs
The California Supreme Court has held that an employer who has failed
to inform an injured employee of his potential right to rehabilitation
may be liable for payment of temporary rehabilitation benefits before
the employee has actually chosen to enroll in a rehabilitation program.
(Webb v. Workers Compensation Appeals Board, Sup.Ct. , September 22,
1980)
k. No Free Transcript of Administrative Hearing
The C.A. lst has held that a general prerequisite to judicial review •
of a property tax assessment is an application for and a denial of
relief by the County Board of Equalization or Assessment Appeals

1. Medical Group's Complaint on City Tax Without Merit
The C.A. 2nd has ruled that the Los Angeles Municipal Code requirement
that every person engaged in business pay a business tax is enforce-
able against a medical group, whether their bookkeeping employs the
accrual or the cash method. (City of Los Angeles v. Wilshire Crest
Medical Group, C.A. 2nd, December 23, 1980)
M. Pedestrian in Crosswalk
The C.A. lst has held that a motorist who hit a pedestrian within a
crosswalk is not negligent if the pedestrian has failed to take ade-
quate precautions for her own safety and the actions of the motorist
are reasonable under the circumstances. (Bryne v. San Francisco, -
C.A. 1st, December 22, 1980)
n. No Free Transcript of Administrative Hearing
The C.A. 3rd has held that an indigent is not entitled to a free
transcript of a civil administrative hearing involving his economic
• interests in order to appeal an administrative agency's decision.
(City of Sacramento v. Superior Court (Lambert) , C.A. 3rd, December
23, 1980)
o. Fireman Denied Claim for Injuries Sustained in Fire
The C.A. lst has ruled that a professional fireman may not sue for
injuries sustained in fighting a fire, despite the fact that the fire
was the product of alleged negligence. The Court held that the fire-
man's claims were barred by the time-tested "Firemen's Rule." The
Court noted that the rule provides that negligence in causing a fire
furnishes no basis for liability to a professional fireman injured in
fighting it. (BART v. Superior Court, C.A. 1st, December 24, 1980)
p. Voting Rights in Annexation
The C.A. 2nd has upheld the validity of Section 3228(b) of the Govern-
ment Code. This section and Section 35231 restrict the opportunity
for residents in the annexing area to vote on the issue to the situa-
tion iri which the annexation would increase either the voting popula-
tion or the assessed value of land in the city by 50 percent or more.

q. Proposition 13
The C.A. has held that regulatory fees related to costs are not "spe-

The Supreme Court has held that a municipal ordinance requiring early
morning closure of a picture arcade is unconstitutional. (People v.
Glace, 27 C.3d 841)
s. School Facility Fees
The C.A. 2nd has recently upheld an ordinance of the City of Oxnard
which imposes school facility fees. The Court held that such fees
did not constitute a "special tax" within the meaning of Proposition
13. (Trent-Meredith, Inc. v. City of Oxnard, C.A. 2nd, January 6,
19 81)
2. PENDING LITIGATION
a. City of Atascadero v. Daly, et al.
Appellants' motion for judicial notice has been denied without preju-
dice for the reason that Appellants failed to submit with their motion
certified copies of materials of which they wanted theCourtto take
judicial notice. Appellants' request that their case be given priority
has been denied without prejudice to a new request which adequately
briefs the issue of whether said action comes within the category of
"contested election cases."
b. Snow, Atascadero Firefighters Association v. City of Atascadero, et al. •
The hearing on Petitioners' writ of mandamus to require the City to
honor the MOU between the Firefighters Association and the former
Atasc ero Fire Prevention District has been reset by the Court for
Frida February 27, at 8:45 A.M. in Department III of the Superior
Court f 'San Luis Obispo County.

SUBJECT: School Crossing Guard Agreement
The attached draft agreement appears to be the only
areas which School District staff representatives feel they
can be committed. During our discussions of this problem
with the School District staff members, it was apparent
that hiring of part-time contract personnel becomes too
costly because of Education Code requirements, which place
such personnel into the school bargaining unit for wages,
salaries, and conditions of employment. The City does not
have these same constraints and can, therefore, administer
part-time contract people in a less expensive way than can
the school.
The essence of the attached draft agreement is that the
City has established conditions, as required by the Govern-
ment Code, for the placement and use of school safety devices
through adoption of the School Area Pedestrian Safety Manual
as published by Cal Trans. The agreement however, means that
the City has become, in all respects, the primary and major
participant in the school pedestrian safety program. The
draft agreement represents the extent of participation that
the school staff members felt they could recommend to the
Board.
^urs_-ant to your instructions, we did not address the
funding aspects of this program. That remains as it did
when the issue was first raised. Short of transferring some
of the attached obligations to the School District, I do not
know of any other options available to us. I believe it is
now a matter for the two governing bodies to determine a
program which they can mutually endorse and to address the
problem of cost sharing. As presently constituted, the City
is assuming the burden for the entire program.

SCHOOL CROSSING GUARD SERVICES AGREEMENT
BETWEEN
THE CITY ,OF ATASCADERO
AND
ATASCADERO UNIFIED SCHOOL DISTRICT
WHEREAS, Education Code Section 45452 requires an agreement
between the City of Atascadero and the Atascadero Unified School
District to establish the terms, conditions and procedures for
providing school crossing guards
NOW, THEREFORE, the parties do agree as follows:
1. The location, type and numbers of school crossing
protective devices or of crossing guards shall be
considered in accordance with criteria established by:
(a) the School Area Pedestrian Safety Manual published
by the California Department of Transportation
(1979 edition) and
(b) by the City Advisory Traffic Committee (established
by Ordinance No. 34) .
2. The Cu erintendent of Schools shall appoint a repre-
sentative of the School District as a member of the
City Advisory Traffic Committee in matters dealing with
traffic conditions of concern to the School District.
Meetings shall be at the call of the City Traffic
Engineer.
3. The City shall be responsible for the general adminis-
tration of the school crossing guard program to include:
(a) Hiring, administration of payroll, scheduling,
supervising and disciplining;
(b) Provision of relief guards when necessary; .
• 0
(c) Provision of training for guards as required;
• (d) The provision of equipment such as portable
stop signs, vests or other distinguishing items
of clothing as may be necessary for the conduct
of crossing guard tasks.
4 . The School District and the City, through the Traffic
Advisory Committee established by Ordinance No. 34 ,
shall develop and maintain a "safest route to school
plan which will minimize the exposure of elementary
school students to vehicular traffic hazards. The
School District shall ensure dissemination of informa-
tion
nforma tion concerning safe routes to the school population.
5 . Pay scales for crossing guards shall be as established
by the governing entity responsible for funding the
school pedestrian safety program.
6 . Funding of School Crossing Guards shall be as mutually
agreed by the School Board and City Council .
IN WITNESS WHEREOF, City and School District have executed
this Agreement on the day of 1981.

Background: -
This is the first phase renovation work in the Admin-
istration Building and includes structural renovation of
the first and part of the second floor, major electrical
renovation, and replacing cold water mains along with minor
plumbing work.

SUBJECT: National Flood Insurance Program
The City Council, by Resolution No. 2-81 agreed to
participate in the Federal low cost flood insurance program.
This program allows property owners to secure flood insur-
ance in flood prone areas at a lesser cost than possible on
the commercial market. In some cases, the commercial market
will not provide any insurance.
Attached is Ordinance No. 37 which is the next step
necessary for achieving participation in the National Flood
Insurance Program. Available for your inspection in my
office and also available at the Council meeting Tuesday
night are some draft flood hazard boundary maps. These maps
illustrate the extent of the flood areas in Atascadero
as determined by HUD.
After your adoption of Ordinance No. 37, HUD will
proceed to the next step which will be p presentation to you
• of a series of regulations which we must adopt in order to
participate in the program. These will be presented at a
subsequent date. The regulations are consistent with good
flood plan management and do not affect any appreciable
developable areas within the City. In any event, if you do
not approve of the regulations, you do not have to endorse
them ana, consequently, the flood insurance program would
not be applied to Atascadero.
In the meantime, I recommend your consideration of
Ordinance NO. 37 tonight for its first reading.

AN ORDINANCE OF THE CITY OF ATASCADERO
ESTABLISHING REQUIREMENTS IN ACCORDANCE WITH THE
NATIONAL FLOOD INSURANCE PROGRAM
WHEREAS, the Council adopted Resolution No. 2-81 approving
participation in the National Flood Insurance Program; and
WHEREAS, pursuant to this resolution certain regulations
are necessary for effective enforcement of the National Flood
Insurance Program.
NOW, THEREFORE, the Council of the City of Atascadero does
ordain as follows:
Section 1. The City Engineer shall be the responsible person
and shall enforce Section 1910.3 (b) of the Federal Insurance
Administration regulations as Section 1910 .3 (b) appeared in the
Federal Register, Volume 41, No. 207, Tuesday, October 26 , 1976 .
Section 2. The Flood Hazard Boundary Map issued by the
Federal Insurance Administration for this community, dated September
16 , 1980, with Panel Numbers 060700 0001-002, and any officially
published revisions to this map, is adopted as the official map
for the enforcement of this Ordinance. Zone A on this map delineates•
the area within which the requirements of this ordinance will be
enforced.
Section 3 . The City Clerk shall cause this ordinance to be
published once within fifteen (15) days after its passage in the
Atascadcrc TIc::� , a newspaper of general circulation printed, pub-
lished and circulated in the City in accordance with Section 36933
of the Government Code; shall certify the adoption of this ordinance
and shall cause this ordinance and this certification to be entered
into the Book of Ordinances of this City.
Section 4 . This ordinance shall go into effect and be in
full force and effect at 12 :01 a.m. on the 31st day after its passage.
The foregoing ordinance was introduced on February 10, 1981
and adopted at a regular meeting of the Council held on
