The meeting was called to order at 7 : 30 p.m. by Mayor Wilkins
with the Pledge of Allegiance. Councilman Mackey gave the invocation.
ROLL CALL
PRESENT: Councilman Highland, Mackey, Nelson, Stover and Mayor
Wilkins
ABSENT: None
PUBLIC COMMENT
(1) Heinz Drexler stated that he did not feel that an attorney
should be a member of the Planning Commission; he also
stated that there was no way for a citizen to recall a Planning
Commissioner if he felt the individual should not be on the Commission.
(2) Leslie Cannoncommented on the article in the Atascadero
News which accused the Planning Commission of "behind the
scenes"maneuvers to prevent George Molina from becoming a Planning
Commissioner. She stated that no such actions were taking place
and she felt that the article was based solely on a comment which
had been made in jest.

Mayor Wilkins reviewed all items on the Consent Calendar.
Councilman Mackey requested that Item A-9 be withdrawn and considered
separately.
MOTION: Councilman Stover moved for the approval of the Consent
Calendar, Items A-1 through A-8 The motion was seconded by
Councilman Nelson and unanimously carried by roll call vote.
A-9 Departmental Review R801024 :1, East Mall and El Camino Real
Santa Barbara Savings
Councilman Mackey was concerned about the number of requests to
allow excess signing; she felt that either the Council should stick to
the requirements for signing or change the ordinance rather than
allowing exceptions. She was also concerned that the Santa Barbara
Savings building setback requirements at less than ten feet on the
El Camino side were not satisfactory. Council discussed these matters
anddecided that the Planning Commission should review the signing
requirements for possible amendment and should consider the matter of
setbacks on E1 Camino during their discussion of the zoning ordinance.
MOTION: Councilman Highland moved for the approval of Item A-9 as
recommended by the Planning Commission. The motion was
seconded by Councilman Mackey and unanimously carried by
roll call vote.
B. HEARINGS, APPEARANCES AND REPORTS
1. Report from City Manager on denial of Historic Preservation
Grant application
Mr. Warden advised that the City' s application for a grant under
the Historic Building Act for rennovation of the Administration
Building had been denied. At present, grants are mainly going to
those projects which will prevent the destruction of historic buildings,
rather than for rehabilitation.
C. UNFINISHED BUSINESS
1. Election canvass for Measures E and F, November 4 , 1980
General Municipal Election
Mr. Warden explained that the certification by the County Clerk
was for Council information only; the Board of Supervisors is auth-
orized to adopt the canvass since the City consolidated this election
with them. The canvass sets forth the number of votes cast in favor
and against Measures E and F concerning the City Clerk and City
Treasurer offices
MOTION: Councilman Highland moved for acceptance of the canvass. •
The motion was seconded by Councilman Mackey and unanimously
carried.

2. Approval of agreement with Department of Transportation
for grant funds for buses
Mr. Warden explained that he had previously informed Council
that the City had been awarded a grant in the amount of $48 , 800
for the purchase of two handicapped equipped buses. The Agreement
is with the State Department of Transportation to accept this
grant.
MOTION: Councilman Nelson moved for approval of the Agreement
and that the City Manager be authorized to sign on
behalf of the City. The motion was seconded by Council-
man Highland and unanimously carried.
3 . Ordinance No. 34 , Traffic Regulation - final reading
Mr. Warden advised that although the changes made at the
last Council meeting were not entered on their copies of the ordin-
ance, changes had been made on the original copy.
MOTION: Councilman Highland moved that Ordinance No. 34 be read
by title only. The motion was seconded by Councilman
Mackey and unanimously carried.
• Mayor Wilkins read Ordinance No. 34 by title only.
MOTION: Councilman Highland moved for the adoption of Ordinance
No. 34 as amended. The motion was seconded by Council-
man Stover and unanimously carried by roll call vote.
4 . Consideration of Recreation Supervisor position
Mr. Warden reviewed the hiring process which the City had
followed for a Recreation Supervisor. He stated that the situation
had changed somewhat since Mr. Ross, Acting Director from Paso
Robles, has indicated that the job is more than he can handle
with his present responsibilities in Paso Robles. Mr. Warden was
recommending, therefore, that the City advertise for either a
Recreation Director or Recreation Superintendent. Without Mr.
Ross, the City will definitely need someone more qualified to run
the Recreation Department than those recruited in the advertising
process for Recreation Supervisor. Although there was one candidate
qualified, he would not accept the Supervisor' s position at the
salary advertised.
MOTION: Councilman Nelson moved that the City advertise for a
Recreation Director and let the City Manager work out
the salary for someone who is recreation director
qualified. The motion was seconded by- Councilman
Stover and unanimously carried by roll call vote.

Mr. Warden requested that a salary be authorized for this
position somewhere in the area of $1800 per month.
MOTION: Councilman Nelson moved that the salary be set at from
$1750 to $1850. The motion was seconded by Councilman
Mackey and unanimously carried.
D. NEW BUSINESS
1. Consideration of additional payment for pavilion reroofing.
Mr. Warden explained that the contractor for this project
had made a mistake in computing the materials needed. Mr. Warden
felt that the contractor had made an honest error and, since the
total project costs would still be below the second lowest bidder,
he was recommending that Council authorize $1, 068 . 48 for payment of
the materials needed to complete the project.
MOTION: Councilman Stover moved that Council authorize the
additional payment on this project of $1, 068 .48 . The
motion was seconded by Councilman Highland and unani-
mously carried by roll call vote.
2. 1980 Chip Sealing Program over-runs
Mr. Warden explained that the chip seal over-runs were caused
by the differences in type and quantity of materials needed for
the additional chip sealing that was authorized by Council . Mr. Warden
recommended approving Contract Change Order No. l in the amount
of $33 ,265. 03 .
MOTION: Councilman Highland moved that Council approve Change
Order No. 1. The motion was seconded by Councilman
Nelson and unanimously carried by roll call vote.
3. Considerationofallocating funds for street maintenance
equipment
Mr. Warden noted that this item had been withdrawn from the
agenda and will be considered at a later date.
E. INDIVIDUAL DETERMINATION AND/OR ACTION
1. City Council
(a) Councilman Mackey asked if a Uniform Building Code
could be put in the Library. Mr. Warden advised
that a Code is available in the Building Department if someone
wants to look something up. He also suggested that perhaps the
Library could buy a Code

(b) Councilman Mackey asked about the babysitting film
expense on the Treasurer' s Report. Mr. Warden
explained that it was for a program showing babysitters how to
cope with emergencies. The program was conducted by the Fire
Department at the schools. Chief Sylvia stated that the amount
of the film will be reimbursed by the Rotary Club.
(c) Councilman Highland asked if the Planning Commission
had been aware of the number of cul-de-sacs that
are being created by different projects
2 . City Attorney
(a) Mr. Grimes reported that the attorney for the
Firefighters Association had advised that the
hearing scheduled for December 10th had been rescheduled to
February 2, 1981, at 9 :00 a.m. in Department II .
3. City Manager
(a) Mr. Warden reminded the Council to adjourn this
meeting to December 22nd at 6 : 30 p.m. to finish
interviewing applicants for Planning Commissioner.
(b) Mr. Warden advised that Vandenberg Air Force Base
will be hosting the next Channel Counties Division
meeting on January 30th and 31st. They will provide accommodations
for City officials to include four meals at a nominal cost.
Council members should advise him as soon as possible if they are
interested in attending this meeting.
The meeting adjourned at 8 : 30 p.m. to December 22nd at 6 : 30 p.m.

On December 15 , 1980 the Planning Commission conducted a public
hearing unanimously adopting Findings 1-2 , approving a Condition-
al Negative Declaration, and approving Parcel Map AT 79-263 sub-
ject to Conditions '1-8 as listed in the attached Staff Report.
Cliff Dunn appeared on behalf of the applicant and indicated
concurrence with the recommendation. No one else appeared on
the matter.

STAFF REPORT
SUBJECT: Parcel Map AT 800911:1
LOCATION: 8950 Atascadero Avenue (Lot 1, Block 6)
APPLICANT: Harry W. Smith
REQUEST: To divide two acres into two parcels of 1.0 acres each.
BACKGROUND
1. Existing zoning: R-A (Suburban District) .
2 . General Plan: Moderate Density Single-Family.
3 . Environmental Determination: An environmental description
form has been completed. The Planning Director has prepared
a Draft Negative Declaration for the project indicating that •
no adverse environmental effects are likely to occur if the
project is implemented as proposed.
4 . Site Conditions : The site is generally level and is traversed
by a shallow drainage Swale. The proposed Parcel 1 is currently
developed with an existing single family dwelling. Proposed
Parcel 2 is presently vacant. Vegetation of Parcel 2 consists
of several oak trees and natural grasses . City sewer is avail-
able in Portola Road and City water is also available . Access
to Parcel 1 is via an existing private driveway off Atascadero
Avenue.
5 . Project Description: The applicant proposes to divide the
subject property into two parcels; Parcel 1 at 1. 089 acres
and Parcel 2 at 1 . 009 acres. Access to Parcel 2 is proposed
to be from Portola Road. The proposed division line generally
follows the course of the drainage swale.
STAFF COMMENTS
On Tuesday, November 18 , 1980 the Subdivision Review Board met to
review this request with the applicant, Mr. Harry W. Smith. Also
attending the meeting were: Larry Stevens , Planning Director;
Mary E. Beatie, Associate Planner; Larry McPherson, Public Works
Director; John Kennaly, Assistant Civil Engineer; Don Sylvia, Fire
Department; and Leslie Cannon, Planning Commissioner.

STAFF COMMENTS
On Tuesday, November 18 , 1980 the Subdivision Review Board met to
review this application with the applicant, Mr. Hilchey. Also in
attendance at that meeting were : Robert Hilliard, applicant ' s
engineer; Rick Barber of Hilliard Surveys; Larry Stevens, Planning
Director; Mary Beatie, Associate Planner; Larry McPherson, Public
Works Directpr; John Kennaly, Assistant Civil Engineer, ;Don Sylvia,
Fire Department; Leslie Cannon, Planning Commissioner.
The following items of concern were discussed at that meeting:
1) City will not accept Encinal as a City maintained street in
its present condition.
2) May require participation in future assessment district to im-
prove Encinal. A note is to appear on the final map waiving
the right to refuse to participation in future assessment
district.
3) Minimum lot size is one acre, only if served by sewer. If not
served by sewer, minimum lot size would be lz acres.
• 4) City will verify location of nearest sewer line; believed to
be in Sendero Avenue, a paper street.
5) Require a plan and profile of proposed sewer lateral for re-
view and approval by the Public Works Department prior to
acceptance of final map.
6) Require monuments set at new property corners created by lot
division.
7) Tree removal and grading necessary for site development will
be subject to Planning Department approval at time of build-
ing permit.
8) Consideration of Conditional Negative Declaration subject
generally to the following:
a) Sewage disposal to be by connection to the City sewer
system.
b) Grading be minimized for site development.
FINDINGS
• 1. The application as presented will not have a significant effect
upon the environment and the preparation of an Environmental
Impact Report is not necessary.

2. The application as submitted conforms to the applicable zoning
regulations and is consistent with the 1980 Atascadero General
Plana
RECOMMENDATION
Based on the above findings, the Planning Department recommends :
A) Issuance of a Conditional Negative Declaration as follows :
1. Sewage disposal to be by connection to the City sewer system.
2. Grading be minimized for site development.
B) That Tentative Parcel Map AT 79-263 be approved subject to
the following:
1. Provision shall be made for connection to the City sewer
and a Note so stating shall appear on the Final Map.
2. Sewer improvement drawings of the proposed sewer extension,
prepared by a Registered Civil Engineer, shall be submitted
for approval by Public Works Department prior to acceptance •
of the Final Map.
3 . The applicant shall complete the sewer extension prior to
acceptance of the Final Map or shall enter into an agree-
ment with the Public Works Department to guarantee in-
stallation of improvements within one year of the date of
recordation of the Final Map. A performance guarantee
bond, certificate of deposit, or similar arrangement shall
be made in conjunction therewith.
4 . Water shall be obtained from the Atascadero Mutual Water
Company and water operable facilities shall exist at the
property frontage prior to filing of the Final Map.
5 . Effort shall be made to minimize grading that would be
disruptive to the natural topography and removal of ex-
isting, mature trees. The following shall appear as a
Note on the Final Map:
"No trees shall be removed without compliance with appli-
cable City ordinances. No grading shall commence without
an appropriate permit and compliance with applicable City
ordinances. "

6 . Prior to recordation of the Final Map, the applicant shall ,
in a form acceptable to the City, agree to participate in
any future assessment district to improve Encinal and a
Note shall appear on the Final Map which states :
"Recordation of this map shall waive the right of any
owner of Parcel 2 t refuse to participate in any fu-
ture assessment district to improve Encinal to accept-
able City standards . "
7. A Final Parcel Map in compliance with all conditions set
forth herein shall be submitted for review and approval in
accordance with the Subdivision Map Act and the City Lot
Division ordinance prior to recordation.
a. Monuments shall be set at all new property corners
created and a registered civil engineer or licensed
land surveyor shall submit a letter certifying that
the monuments have been set prior to recordation of
the Final Parcel Map.
b. A Final title policy (CTLA or ATLA) shall be submitted
• for review in conjunction with the processing of the
Final Parcel Map.
8. Approval of this tentative Parcel Map shall expire one year
from the date of final approval unless an extension of time
is granted pursuant to a written request prior to the expi-
ration date.
ACTION
The Planning Commission should by motion direct Staff as deemed
appropriate.
TO APPROVE: Motion to adopt findings and set conditions .
TO DENY: Motion setting findings for denial.

BACKGROUND
1. Existing Zoning: A-1-B-V-5 (Light Agricultural, with a slope
combining district overlay which specifies an average building
site area of five acres)
2. General Plan: Suburban Single-Family Residential
3. Environmental Determination: An environmental description form •
has been completed. The Planning Director has prepared a Draft
Conditional Negative Declaration for the project indicating
that no adverse environmental effects are likely to occur if
the project is implemented as proposed.
4 . Site -Conditions : The 10 . 59 acre site is presently undeveloped
and heavily covered with oak trees and low brush. The site
ranges in elevation from roughly 1488 feet at a knoll near
Vista Road and the northerly property line to 1210 feet at
the rear (southeast) corner of the property. A drainage swale
traverses the site generally from the rear of the lot (parcel
1) at the easterly property line to the southwesterly corner
of the property at Vista Road (parcel 2) . Vista Road, a pri-
vate, paved street, serves the property. Water, gas , and
telephone are all known to be available at the site.
5 . Project Descriptions The applicant proposes to divide the sub-
ject property into two parcels: Parcel 1 at 6 . 00 .acres and
Parcel 2 at 4 . 59 acres. Proposed access to the rear parcel,
Parcel 1, is by a 25 foot private access easement which runs
generally along the southerly property line of proposed Parcel
1. Access to Parcel 2 will either be from Vista Road or from
the access easement depending on building site location.

STAFF COMMENTS
On Tuesday, November 18 , 1980 the Subdivision Review Board met to
review this request with the applicant' s representative. In atten-
dance at that meeting were : Dan Stewart, applicant ' s representative;
Larry Stevens, Planning Director; Mary Beatie, Associate Planner,
Larry McPherson, Public Works Director; John Kennaly, Assistant
Civil Engineer; Don Sylvia, Fire Department; and Leslie Cannon,
Planning Commissioner.
The items discussed at that meeting included the following areas
of concern:
1) Provide percolation and soils tests for each lot at time of
building permit.
2) Minimum driveway width to be 12 feet, preferred improvement
is paving, minimum acceptable is all-weather surface.
3) Require frontage improvement of Vista Road from termination
of present improvements to the southerly edge of proposed
driveway easement. A note is to appear on the final map
with indication of willingness to participate in improvements
(including drainage) of remaining lot frontage at such time
as adjacent development`odc _s_an ran s ex ension of
Vista . Road'.-

4) Setting monuments at new property corners.
5) Tree removal and grading subject to Planning Department ap-
proval at time of building permit application.
6) Drainage swale to be shown on final map.
7) Provide "will serve" letters from appropriate utility companies .
8) Recommend Conditional Negative Declaration conditional on ap-
proval of plan and profile of proposed driveway by the Public
Works Department prior to final map. If average slope of
driveway exceeds 12% , paved improvement would be a requirement
of the first building permit. Otherwise, an acceptable all-
weather surface would be required similarly.
FINDINGS
1. The application as presented will not have a significant effect
upon the environment and the preparation of an Environmental
Impact Report is not necessary.
2. The application as submitted conforms to the applicable zoning
• regulations and is consistent with the 1980 Atascadero General
Plan.

RECOMMENDATION
Based on the above findings, the City Planning Department recommends:
1) Issuance of a Conditional Negative Declaration as follows :
a) Provision be made for adequate access to the rear lot,
being Lot 1. Driveway design and location to be
acceptable to the Planning and Public Works Departments.
2) Approval of the Tentative Map subject to the following conditions :
a) Private sewage disposal systems will be an acceptable
method of private sewage disposal, if reports, tests
and design are acceptable. All tests, reports, and
designs shall conform to methods and guidelines pre-
scribed by the Manual of Septic Tank Practice and other
applicable City ordinances . The following shall appear
as a Note on the Final Map:
"Appropriate soils reports including a percolation
test, a test to determine the presence of ground
water, and a log of a soil boring to a minimum
depth of ten (10) feet shall be submitted to the
Atascadero Planning Department prior to the issu-
ance of a building permit on each lot. Where soils
reports indicate that conventional soil absorption
systems are not acceptable, City approval of plans
for an alternative private sewage disposal system,
designed by a registered civil engineer, shall be
required. Depending upon the system, more restric-
tive requirements may be imposed.
b) Water shall be obtained from the Atascadero Mutual Water
Company and water operable facilities shall exist at the
property frontage prior to filing of the Final Map.
c) The access easement to Parcel 1 shall be located in a
manner to be closely aligned with existing topography
in order to minimize grading and tree removal. Said
location shall be subject to approval by the Planning
Department and shall be indicated on the Final Map.
d) Provide plan and profile drawings of proposed driveway
for review by Public Works Department prior to Final Map.
If average slope exceeds 120 , paved improvement would be
a requirement of first building permit. Otherwise, an
acceptable all-weather surface would be required similarly.
A Note to this effect shall appear on the Final Map. •

e) Provision shall be made for improvement of the private
driveway easement. The following Note shall appear on
the Final Map:
"The private driveway shall be improved to a minimum
width of twelve (12) feet with an unobstructed ver-
tical clearance of fourteen (14) feet. "

f) Prior to recordation of the Final Map, the applicants
shall, in a form acceptable to the City, agree to par
ticipate in the improvement of the remaining unimproved °'
frontage on Vista Road including drainage structures at ,
such time as adjacent development occurs and warrants

Said agreement shall be noted on the Final Map and/or
otherwise recorded. An extension of time to a longer
term may be granted by the Planning Commission and/or
the City Council.
• g) Effort shall be made to minimize grading that would be
disruptive to the natural topography and removal of ex-
isting, mature trees. The following shall appear as a
note on the Final Map
"No trees shall be removed without compliance with
applicable City ordinances. No grading shall com-
mence without an appropriate permit and compliance
with applicable City ordinances. "
h) Drainage swale to be shown on final map.
i) A Final Parcel Map in compliance with all conditions set
forth herein shall be submitted for review and approval
in accordance with the Subdivision Map Act and the City
Lot Division Ordinance prior to recordation.
1) Monuments shall be set at all new property corners
created and a registered civil engineer or licensed
land surveyor shall submit a letter certifying that
the monuments have been set prior to recordation of
the Final Parcel Map.
2) A final title guarantee shall be submitted for review
in conjunction with the processing of the Final Parcel
• Map.

j) Approval of this Tentative Parcel Map shall expire one
year from the date of final approval unless an extension
of time is granted pursuant to a written request prior
to the expiration date.
ACTION

SUBJECT: Street maintenance equipment
At the beginning of this fiscal year, we adopted a
rental approach to providing various pieces of street
maintenance equipment rather than purchase. The idea was to
provide us an opportunity to evaluate our more critical
equipment needs and to see if rental could supply those
needs. Over the last six month period, we have found that
the major portion of our maintenance work is being done by
tractor-type equipment utilizing a front-end loader, rotary
sweeper, and backhoe. In order to evaluate the rental vs.
purchase approach, we have acquired some cost information
for this type of equipment. We have arrived at the con-
clusion that, because of the high utilization factor and -
because rental does not provide an equity, we can save
money, in this instance, by purchase.
It is our recommendation, therefore, that Council
authorize the lease-purchase-of a tractor equipped with a
front-end loader and motor, a backhoe, back scraper, rotary
• sweeper and offset flail mower. The money presently in the
budget under the rental account is adequate to cover the
balance of this year' s lease-purchase payments. We estimate
the arrangement would save between $500 and $1,000 per month
in equipment rental costs which would apply to the lease-
purchase costs. However, associated with lease-purchase
approach, is coping with the current escalation of interest
costs which could require, at the time of acceptance of
bids, a decision as to whether the interest costs are so
expensive as to make a lease-purchase undesirable. How-
ever, since we are investing in high interest yield time
deposits , our investment yield will, in fact, offset the
lease-purchase costs.
It is my recommendation that Council authorize going
to bid on the foregoing equipment with the understanding
that bid acceptance would depend upon the analysis of the
financial costs mentioned above at the time of acceptance.

SUBJECT: Salary Review
I have previously provided you copies of a salary and
benefit survey for all non-department head positions in the
City. Please add to that the attached similar survey infor-
mation for department head positions as well as the overall
summary analysis.
Also attached is a chart showing the number of positions
by city which are equal to, behind or ahead of Atascadero
utilizing the non-adjusted salary scales. Some of the
reasons for differences in salary relationships between
cities for a particular job classification can be accounted
for by differing job assignments. Another is because cities
sometimes find it difficult to fill a particular position
and have to make adjustments for that position without
making similar internal adjustments in their overall salary
plan. Consequently, it is often difficult to make one-on-
one comparisons. However, in considering the overall rela-
tionship, you will find that the non-adjusted salaries of
• other cities are generally ahead of those in Atascadero.
Utilizing the 10% increase figure, which effectively is
5% for the fiscal year, places most Atascadero salaries in a
good relationship with the other cities and generally follows
the Council ' s guidance that salary schedules should be behind
that of the City of San Luis Obispo, but ahead of the -
next highest city.
Recognizing that at the time we drafted our salary
plan, we were not yet fully aware of the actual job require-
ments for each individual position, it now appears that
there are a couple of areas requiring some internal adjust-
ments so that the internal job relationships can be retained.
One of the more glaring disparities is the Engineering Aide
position which we placed below Maintenance Worker I in our
original plan. The position responsibilities and job require-
ments have become more defined in the last six months and
suggest that this job classification is not at its proper
salary range. I am recommending, therefore, that we adjust
the Engineering Aide position to be equivalent to that of
Maintenance Worker II.
Another area which has evolved into a much more intense
• and responsible position than anticipated is the Clerical
Assistant III position in the Police Department. The Clerical

Assistant III; is presently.. performing duties of dispatch
supervisor, records maintenance and police statistics analyst `
as well as secretarial functions. Because of the difference
between the position's actual responsibilities and of Clerical
Assistant III positions in other departments, I feel that it
should be converted to a position entitled, "Records and
Dispatch Supervisor" with secretarial duties included. This
new job classification should be placed in the same salary
scale as for the Maintenance Worker II position.
In summary, in addition to the two classification
changes I have talked about above, I recommend the adjusted
salary steps (10% increase) as shown on the salary comparison
charts previously provided to you for all non-department head
positions
With regard to department head positions, the attached
information provides comparisons between Atascadero and
other cities, as does the chart depicting number of positions
by city. Again, the adjusted salary column is based upon a
10% scale, however, in the case of these positions, I recommend
a 7 1/2% increase which will place these positions ahead of
or equal to the next highest city. I would note the difficulty'
in making individual adjustments and still retaining coherence
between positions. You should be aware that adjustments in
salary scales must be made so as to maintain a proper relation- •
ship betweenjobsof varying responsibility so as to avoid
compaction of salaries as well as to avoid dramatic increases
between salary ranges. This, of course, must be tempered with
the need to assure that the salaries being offered are sufficient
to attract, and more importantly, retain the caliber of person
desired for the job. Too low scales can be false economy if
a high turn-over rate results. Then, too, consideration must
always be given to the ability to pay.
As to overall costs of this recommendation, the total:to 60
benefit and salary increase will be approximately 0 for
the balance of this fiscal year. We have sufficient in
reserve to more than accommodate this increase Even with
the increase, our percent of total budget devoted to salaries
and benefits will be considerably less than 50% as contrasted
to a figure for most cities of 60% to 80%.
I have not made any recommendations concerning the City
Manager position, leaving that to you.

Larry Stevens reviewed the seven findings adopted by the Planning
Commission and their recommendation to allow the condominium con-
version ordinance to lapse and that Staff be directed to continue
monitoring the conversion process so as to keep the Planning Commis-
sion and City Council apprised of the situation.
Mayor Wilkins opened the public hearing for comments. Since
• there were no comments, the hearing was closed.

Councilman Highland felt that the holidays set forth in section
4-3. 101 (f) should be amended. Council agreed to, change "the fourth
Monday in October, " to "the eleventh day of November" and to eliminate

Mr. Grimes advised that since these were amendments to the ordin-
ance, the Council would have to hold it over for another reading
rather than adopting it this evening.
MOTION: Councilman Highland moved that the two changes indicated
be made to Ordinance No. 34 . The motion was seconded by
Councilman Nelson and unanimously carried.
MOTION: Councilman Highland moved that the second reading of
Ordinance No. 34 be held over for two weeks. The motion
was seconded by Councilman Nelson and unanimously carried.

D. NEW BUSINESS
1. Election procedures for City Clerk and City Treasurer
Mr. Warden reviewed the options outlined in his memo. Council
members discussed their preferences; Councilman Nelson felt that
the election should be held as soon as possible, which would be in
March, 1981. Councilman Mackey thought that Council could wait
until the November election, while other members of the Council were
in favor of postponing the election until the March, 1982 general
municipal election.
MOTION: Councilman Stover moved that the City Clerk and City
Treasurer election be held off until the 1982 municipal
election. The motion was seconded by Councilman Highland.
Mike Cox felt that the Council should hold a public hearing on
the matter to see if the public felt the election should be held
sooner.
John Daly stated that the Council should have had the election
for these offices at the same time that the Measures E and F were
• on the ballot and thus saved the City considerable money; they could
also have submitted the Voter' s Fee Approval Ordinance at the same
time.
Mr. Grimes noted that the City Council was not at fault in this
City Clerk/City Treasurer matter; the issue should have been on the
incorporation ballot which was prepared by three County agencies.
The motion carried with Councilmen 111ackev and Nelson
voting no.
E. INDIVIDUAL DETERMINATION AND/OR ACTION
1. City Council
(a) Councilman Highland asked if there was a schedule for
public hearings on the rezoning ordinance to conform
with the General Plan. Larry Stevens stated that he has a tentative .
schedule and planned on beginnning hearings perhaps in January.
Councilman Highland felt that the schedule should be given publicity
so that the public can be aware of the considerations.
(b) Mayor Wilkins asked about the reroofing project and
Larry McPherson stated that it was proceeding as
planned.

3. City Manager
(a) Mr. 'Warden stated that the City had received approval
of the grant application for two additional buses in
the amount of $48, 800 as well as $14 , 502 from the Section 18 grant
application. It may be until June 1981 before the money is actually
in-hand, however, the City may be able to proceed with portions of
the purchases.
(b) Mr. Warden advised that there were four applications
for Planning Commissioner and asked if Council would
like to schedule an interview date and time. Council set December
8th before the regular Council meeting beginning at 6 : 30 p.m. It
was noted that people have until Friday to submit their applications.
(c) Mr. Warden advised that he has a letter from the donor
of the new chimp at .the zoo relieving the City of
responsibility for the chimp in the event of its death or escape.
(d) Mr. Warden reviewed the selection process for the
Recreation Supervisor. He stated that Stu Ross has
indicated that the job is proving more than he can handle and he
would like to be relieved of the reponsibility as soon as is feasible•
Mr. Warden would like to establish a range for the Recreation Super-
visor which is higher than that indicated by the advertised salary.
Mr. Warden stated that he would bring .this matter back at the next
meeting, but he wanted Council to be thinking about the problem.
Council members discussed this briefly.

BACKGROUND
1. Existing Zoning, : C-1-D.
2. General Plan: Retail Commercial. •
3. Environmental Determination: The Planning Director has de-
termined the application to be a Class 11 (a) Categorical
Exemption.
4 Site Conditions The site is presently developed with a tempo-
rary office and small parking lot. Topography of the site is
generally level. Vegetation consists of a lawn area over roughly
the west half of the site, four large mature oak trees along the
East Mall frontage and a variety of induced landscaping around
the existing temporary office. The subject property is bounded
on the northwest by East Mall Avenue and the Sunken Gardens be
yond, on the northeast by the Senior Citizen Center, on the
southeast by an alleyway and the Atascadero Creek beyond, and
on the southwest by El Camino Real. The subject site is included
in the "Atascadero Creekway Schematic Plan and Study. "
5. Project Description: The applicant is proposing a total of
signs with an aggregate area of 92 square feet. The signs pro-

An existing monument sign located on East Mall is proposed

STAFF COMMENTS
The applicant is proposing two new signs in addition to an existing
sign presently located near the corner of East Mall Drive and E1
Camino Real. Both new signs are to be fascia mounted and consist
of text including the words "Santa Barbara Savings" and the bank
logo. The applicant has not proposed any form of signing for the
drive-up teller window or directional signs for the parking lot.
FINDINGS
1. Signs as proposed will adequately identify the building and
use and will be compatible with signs existing on other com-
mercial properties in the vicinity.
• RECOMMENDATION
Based upon the above finding, the Planning Department recommends
approval subject to the following conditions :
1. Approval of Signs A, B, and C as requested. The existing monu-
ment sign located along East Mall shall be removed as proposed.
2. The Planning Director may approve directional signs for the
driveways and drive-up teller windows provided that such signs
are either fascia mounted or, if freestanding, not in excess of
six (6) feet in overall height. No such sign shall exceed
twelve (12) square feet and the number of such signs shall not
exceed three.
3. Approval of this Conditional Use Permit shall expire one year
from the date of final approval unless a time extension is
granted pursuant to a written request prior to the expiration
date.

3 . Environmental Determination: The Planning Director has deter- •
mined the application to be- a Class 5 (a) Categorical Exemption.
4 . Site Conditions: The site is generally level to slightly
sloping and is currently developed, with a single family resi
dence, situated on the proposed Parcel A. Proposed Parcel B
is presently undeveloped. . Access to the site is via a 10 foot
driveway off Atascadero Avenue. A 15 foot sewer easement,
traverses the site and is parallel and adjacent to the south-
west property line. The existing residence is connected to
the- City sewer in this easement. The proposed property line
between Parcels A and B generally follows an existing fenceline.
5. Project Description The applicant proposes to adjust the
property line between Parcels 2 and 3 of Parcel Map CO 75-291
previously approved by the County of San Luis Obispo,. Parcel
2 is currently 0 . 68 acres and is proposed to be increased to
0. 75 acres. Parcel' 3 is currently 1.15 acres and is proposed
to be reduced to 1. 08 acres The existing driveway would re-
main to provide access to both parcels .
STAFF COMMENTS
On Tuesday, November 18 , 1980 the Subdivision Review Board met to
review this application. In attendance at that meeting were:

gorically Exempt from the requirements of CEQA as defined by
Class 5 (a) .

Based on the above findings, the Planning Department recommends

1) The approval of this lot line adjustment as shown on the attach-
ment provided herein shall be submitted in a Final Map format
to be approved by the Planning Department prior to recordation
by the County Recorder' s Office.

this lot line adjustment and a registered engineer shall sub-
mit a letter to the Planning Department certifying that the
monuments have been set prior to recording of the Final Map
and Certificate of Compliance.
3) Any tree removal or site grading necessary for the development
of the lot shall be subject to Planning Department approval
prior to issuance of a building permit. This requirement shall
appear as a note on the Final Map.

On December 1, 1980 the Planning Commission reviewed the matter
unanimously adopting Findings 1-2 andapprovingLot Line Adjust-
ment LA 800728 : 2 subject to Conditions 1-6 as listed in the
attached Staff Report.
This matter was previously reviewed the Commission on October
20, 1980 but was referred back to the Subdivision Review Board
• to resolve conflicting information concerning access to Parcel
1. This review indicates that a driveway with a -slope of 11-140
can be provided to a reasonable building site with a minimum of
topographical modification and tree removal. As a result, it
was the consensus of the Commission that the proposed parcels
conformed to the general plan, complied with zoning regulations,
and could be provided with reasonable access. There was some
discussion concerning the improvement of the driveway to Parcel 1.
Elwood Peterson, Atascadero Mutual Water Company, appeared and
indicated concurrence with the recommendation. No one else ap-

of 37-OR-453 and 1918-OR-183 to resolve encroachment
of water tank presently under construction.
BACKGROUND
1. Existing Zoning: A-1-B-V-5-D (light agricultural, with a slope
combining district overlay which specifies an average building
site area of five acres. )
• 2 . General Plan: Suburban Single-Family Residential
3 . Environmental Determination: The Planning Director has deter-
mined the application to be Categorically Exempt, Class 5 (a) .
4 . Site Conditions : The 10 . 49 acre site is presently divided by
a north-westerly/south-easterly trending line into two parcels
of approximately equal size. Parcel 1 is presently being en-
croached upon by a water tank currently under construction on
Parcel 2. Access to the site is provided off Santa Ana Road
by a dirt driveway which runs approximately parallel to the
existing lot division line. A 15 foot waterline easement which
runs through Lot 12 of Block 53 intersects the subject property
at a point approximately half-way along the Santa Ana frontage .
Site topography ranges from 0-20% slopes with the flatter and
more gently rolling portions being at the higher elevations at
the center of the site.
5 . Project Description: The applicant is proposing to adjust the
division line in order to eliminate the currently existing en-
croachment problem and thereby increasing the size of Parcel
2 to 7 . 02 acres and reducing Parcel 1 to 3 .48 acres . Access
to Parcel 2 will be provided in the present location of the
dirt driveway while access to Parcel l will be via a future
driveway from Santa Ana Road. '

to review this request with the applicant' s representative .
In attendance at that meeting were : Dan Stewart, the appli-
cant' s representative; Larry Stevens, Planning Director; Mary
Beatie, Associate Planner; John Kennaly, Assistant Civil En-
gineer; Jerry Linenkugel, Police Sergeant; and Shirley Summers,
Planning Commissioner. The items discussed at that meeting
included the following areas of concern:
1) Location of existing worn trail for use as access easement.
2) Will both parcels be served by this easement?
3) Driveway should be all-weather surfaced or paved.
4) Width of driveway to be 15 feet wide with 14 feet of un-
obstructed vertical clearance above full width.
5) Location of underground waterline easement.
6) Location of water tank under construction in Parcel 2 . •
7) Monuments should be set at all new property corners created
by adjusted lot line.
8) Would like map submitted with Certificate of Compliance to
be in a Final Parcel Map form for recording purposes.
9) Easement rights across adjacent Lot 6, Block 55 .
2. The Planning Commission at its meeting of October 20 , 1980 ,
referred the matter back to the S.R.B. for additional review
of the access. On November 18 , 1980, the applicant, Elwood
Peterson of the Atascadero Mutual Water Company, and Daniel
J. Stewart, the applicant' s engineer, met with the S.R.B. to
consider the alternative locations for the access to Parcel
1 . Subsequent to the S.R.B. meeting, the Planning Director
met with Gordon T. Davis, the owner of Parcel 1, to assess
in the field a reasonable location for the driveway easement.
This location is indicated on the attached map. The driveway
would include a switch back and has an estimated slope of
11-14 percent.
FINDINGS
1. The application as presented has been determined to be Cate- •
gorically Exempt from the requirements of CEQA as defined by
Class 5 (a) .

form has been filled out. The Planning Director has pre-
pared a Draft Conditional Negative Declaration for the pro-
ject indicating that nosignificantenvironmental effects
are likely to occur if the project is implemented as proposed.
4 . Site Conditions : The site is presently undeveloped and is
generally level to .slightly sloping. Vegetation consists of
natural forbs and grasses and nine oak trees each ranging
roughly 36 inches to 48 inches in diameter. Other structures
on the site consist of a 4 ' X 4 ' abandoned cesspool and a pow-
er pole, both located on proposed Parcel 1. The subject property
is bounded on the west by U.S. 101, on the east by E1 Camino

5. Project Description: The applicant is - proposing to divide

Since that meeting the applicant's engineer has submitted a revised
map in accordance with Item #1. Planning Department staff has de-
termined that, in relation to Item #8 , Parcels 1 and 2 are subject
to the C-2-D zoning regulations and Parcels 3 and 4 are subject to
M-1-D zoning regulations.
FINDINGS
1. The application as presented will not have a significant effect
upon the environment and the preparation of an Environmental
Impact Report is not necessary.
2. The application as submitted conforms to the applicable zoning
regulations and is consistent with the 1980 Atascadero General
Plan.
RECOMMENDATION
Based on the above findings, the City Planning Department recommends :
1. Issuance of a Conditional Negative Declaration as follows : •
1) Adequate provision shall be made for drainage control
in conjunction with road improvements and site develop-
ments.
2) Site design and development shall minimize adverse effects
on existing oaks and maximum effort shall be made to pre-

of fifth (50) feet and a minimum bulb radius of
fifty (50) feet property line-to-property line.
Sidewalks shall have a minimum width of five (5)

d. Sidewalks along El Camino Real shall have a minimum

6) The applicant shall complete all improvements prior to
acceptance of the Final Map or shall enter into an agree

recordation of the Final Map. A performance guarantee
bond, certificate of deposit, or similar arrangement shall
be made in conjunction therewith.
7) The applicant shall offer for dedication to the public the
proposed cul-de-sac and any additional widening necessary
for E1 Camino Real .
8) The existing fire hydrant located on El Camino Real shall
be relocated northerly towards the proposed cul-de-sac to
a location approved by the Fire Department. An additional
fire hydrant, of a type and size specified by the Fire
Department, shall be provided at the westerly end of the
proposed cul-de-sac with the exact location and manner
of placement subject to the approval of the Fire Department.
9) All utilities shall be placed underground.
10) Rough grading plans for the parcels being created, prepared
by a Registered Civil Engineer, shall be submitted to the
Public works and Planning Department for approval prior to
acceptance of the Final Map.
11) Provision shall be made and necessary permits obtained for
• the abandonment of the existing cesspool prior to accept-
ance of the Final Map.

1. Existing Zoning: C-2-D (Commercial Service District) and

3. Environmental Determination: An environmental description •
form has been filled out. The Planning Director has prepared
a Draft Conditional Negative Declaration for the project in-
dicating that no significant environmental effects are likely
to occur if the project is implemented as proposed.
4 . Site Conditions: The site is presently undeveloped and is
generally level to slightly sloping. Vegetation consists of
natural forbs and grasses. The subject property is bounded on
the west by U.S . 101, on the east by commercial development
and El Camino Real beyond, on the norty by commercial develop-
ment, and on the south by a proposed four lot Parcel Map (Dove
Investments) .
5. Project Description: The applicant is proposing to divide the
subject property into four parcels; Parcel 1 being . 60 acres,
Parcel 2 being . 50 acres, Parcel 3 being . 50 acres, and Par-
cel 4 being . 51 acres . The parcels are proposed to be served
by a 50 foot wide cul-de-sac, which would jointly serve the
four parcels of Parcel Map AT 80-96 adjacent to the south and

On November 17, 1980 , the Planning Commission conducted a public
hearing unanimously adopting Findings 1-2, approving a Negative
Declaration and approving Parcel Map AT 80-109 subject to Condi-
tions 1-8 as listed in the attached Staff Report.
Allen Campbell, representative, appeared on the matter. He objected
to Condition #6 which required installation of a fire hydrant sta-
ting that the cost was excessive. He was in agreement with the
• remaining conditions. Herb LaPrade, applicant, also spoke in oppo-
sition to the fire hydrant requirement and felt that percolation
tests were unnecessary for- 2z acre lots. No one else appeared on
the matter.
The Planning Commission discussed the need for and the cost of
fire hydrants. Staff pointed out the process whereby the Subdi-
vision Review Board evaluated the situation and indicated the
cost to be $600-800 per hydrant. Subsequent review shows the
approximate cost to be $1175 .

2 General Plan: Suburban Single, Family Residential.
3. Environmental Determination: An environmental description form
has been completed. The Planning Director has prepared a Draft
Negative Declaration for the project indicating that no adverse •
environmental effects are likely to occur if the project is im-
plemented as proposed.
4 Site Conditions : The 8 .02 acre site is presently developed
with one single family dwelling located on proposed Parcel B.
The site topography is gently rolling and site elevation
ranges from 875 feet at Graves Creek Road to 930 feet at the
rear of the property. Vegetation consists of natural forbs
and grasses and induced landscaping in vicinity of existing
dwelling. Access to the existing dwelling is served by an
approximately 15 foot gravel driveway which generally follows
the southwesterly property line for a distance of 250 feet
then angles in toward the existing dwelling.
5. Project Description: The proposed project is to divide an
8 . 02 acre parcel, into three parcels of 2. 64 , 2 .64 and 2 .74
acres each for use as building sites for single-family dwell-
ings. A 25 foot private access easement is proposed along the
southwesterly property line beginning at Graves Creek Road and
culminating at the proposed Parcel C.

able. All tests, reports, and designs shall conform to methods
and guidelines prescribed by the Manual of Septic Tank Practice
and other applicable City ordinances. The following shall
appear as a Note on the Final Map:
"Appropriate soils reports including a percolation test, a
test to determine the presence of ground water, and a log
• of a soil boring to a minimum depth of ten (10) feet shall

to the issuance of a building permit on each lot. Where
soils reports indicate that conventional soil absorption
systems are not acceptable, City approval of plans for an

upon the system, more restrictive requirements may be imposed. "
2. Water shall be obtained from the Atascadero Mutual Water
Company and water operable facilities shall exist at the
property frontage prior to filing of the Final Map.
3. The access easement to Parcels B and C shall be indicated on
the Final Map and shall generally be shown. The existing
driveway to the residence on Parcel B shall be shown as an

acceptable all-weather surface to a minimum width of twelve

LOCATION: East Mall and El Camino Real
APPLICANT: Santa Barbara Savings
REQUEST: To construct a new 3600 square foot savings and
loan facility.
On November 17 , 1980, the Planning Commission conducted a public
hearing on Departmental Review R801024 : 1. The Planning Commis-
sion adopted Findings 1-5 (by a 5-1 vote) and approved a Condi-
tional Negative Declaration and approved the Departmental Review
subject to Conditions 1-17 , eliminating Condition #1-B (which
would have required a 10 ' setback from El Camino Real) , and adding
Condition #17 which states:
• 'That the existing fire hydrant located on the corner
of East Mall and El Camino Real be upgraded to a
standard size and type in a manner approved by the
Fire Department. "
Mark Lopez , project architect, appeared and spoke in opposition
to the increased setback along E1 Camino Real. He indicated that
the remaining conditions were acceptable. No one else appeared
on the matter.
In discussing the matter the Commission considered minimum-set
back requirements in the zone and the architecture and design of
the building, and determined the proposed setback of 6 . 5 feet to
be adequate. There was concern expressed that other site plan
revisions intended to better protect the existing oak trees were
necessary.

SUBJECT Historic Preservation Grant
As you are aware, we submitted a grant application
under the Historic Building Act for rehabilitation of the
Administration Building We have been advised that the
application has not been approved. There are several reasons
for this. First and foremost, we do not qualify with
sufficient points to receive a grant. Secondly, there is
limited money available. Third; other agencies- have higher
point qualifications by nature of their particular projects.
From what we have been able to determine, the awards given
this year were limited in number and primarily included
projects to prevent the destruction of historic buildings
rather than rehabilitation.
Despite this lack of funding, we will keep our eyes
open for any potentials that may exist. As of now, I know
of none.

AGREEMENT
Secretary's Discretionary Fund For
Special Public Transportation Needs
Fiscal Year 1979-80
This Agreement is made and entered into this day of
, 19 , in the State of California, by and
between the State of California, acting through the Department of
Transportation (hereinafter referred to as the State) and the City
of Atascadero (hereinafter referred to as the Contractor) .
Article I - Recitals
01. The Legislature appropriated the sum of $10,000, 000 (ten
million dollars) in discretionary funds to the Secretary of
Business and Transportation to allocate for special public
transportation needs which cannot otherwise be met (Chapter161,
Statutes of 1979, Sections 34.5 and 71(c) ( 3) (B) ; S$ 620) .
02. The Contractor has submitted a project proposal for funding
from the discretionary funds.
03. The Secretary of Business and Transportation has selected the •
Contractor' s project proposal for funding pursuant to this
Agreement.
04. The Contractor agrees to carry out the public transportation
project (hereinafter referred to as the Project) described in
Article II inaccordancewith the provisions of this Agreement .
Article II- - Project Description
05. After delivery of the Project equipment, the Contractor
agrees to perform the Project as follows:
The Contractor shall provide dial-a-ride transportation
service no less than six hours per day, Monday through Friday,
within an area generally described as the City of Atascadero and
its vicinity.
06 . For the purpose of carrying out the Project, the Contractor
shall purchase and install as necessary the following described
Project equipment, pursuant to this Agreement:
a. Two new 16-passenger buses including wheelchair lifts
and tie-down equipment.

08. The State agrees to pay the Contractor 80% of the actual
total cost of the Project equipment . In no event shall the
State' s total obligation under this Agreement exceed the amount
of $48, 800. The State and the Contractor recognize that such sum
• may not be sufficient to carry out 80% of the actual total cost
of performing the Project; however, it does constitute the maxi-
mum State contribution toward performance of the Project.
Article III - Payment
09. The Contractor shall submit to the State itemized invoices,
in duplicate, with all information necessary to support payment,
showing actual expenditures for the period. Based upon these
itemized invoices, the State shall pay the Contractor the State ' s
share of the Project costs, but not more frequently than once a
month. All invoices shall be sent and addressed to: State of
California, Department of Transportation, Headquarters Accounts
Payable, P.O. Box 1499, Sacramento, CA 95807 .
10. No payment shall be made for equipment in advance of pur-
chase, but only after execution of this Agreement, delivery of
the equipment, and submission of the final invoice. Only equip-
ment described in Article II of this Agreement procured after
execution of this Agreement will be eligible for payment.
11 . No payment shall be made for equipment purchased after June
30, 1982 unless the State and the Contractor agree in writing to
such an extension.

Article IV - Performance
•
12. This Agreement shall take effect immediately upon approval by
the State and shall terminate upon completion of the Project. The
Contractor agrees to purchase the Project equipment no later than
June 30, 1982.
13. Project equipment shall be procured according to the provi-
sions of Attachment 0 of the Federal Office of Management and
Budget Circular A-102, "Standards Governing State and Local
Grantee Procurement. Allowable program costs and allowable
individual items of cost shall be determined in accordance with
the provisions of Federal Management Circular 74-4, "Cost Princi-
ples Applicable to Grants and Contracts with State and Local
Governments . "
14. No portion of the Project shall be performed by subcontrac
tors unless the State has given its prior approval in writing. ? ?
15 . The Contractor agrees that the: Project equipment shall be
used for the provision of public transportation services as des-
cribed in Article II for a period of five years from the date of
purchase or until such time as the equipment has no further use-
ful life, whichever occurs first. The State shall determine
whether the equipment has further useful life and shall inform the
Contractor in writing of its determination.
16. Upon successful completion of the Project, the Contractor may
retain the equipment purchased under this Agreement only if the
equipment remains in public service similar to that offered during
the Project. If the equipment is not used in similar public ser-
vice, the equipment must be disposed of in accordance with
Article V.
Article V - Termination
17. The State may terminate the Project upon a finding by the
State that the Contractor has not carried out the Project as set
forth in this Agreement, or has otherwise failed to comply with
the provisions of this Agreement. Termination shall be by written
notice specifying the reasons for termination and giving the Con-
tractor thirty days to correct the default. The State shall b e
the sole judge as to whether the Contractor's corrective measures
are adequate.
18. The Project may also be terminated if the State and the
Contractor agree that continuation of the Project would not
produce beneficial results commensurate with the further

expenditure of funds, or if there are inadequate funds to complete.
the Project.
19 . If the Project is terminated prior to its completion under
this Agreement, any nonexpendable property, the acquisition or
construction costs of which were charged to the Project, shall be
disposed of and the proceeds credited to the Project account. The
Contractor may either keep the subject property and credit to the
Project account an amount equal to its fair market value, or sell
such property at the best price obtainable at a public or private
sale in accordance with established State procedures. If the
Contractor elects to keep the property, fair market value shall be
determined on the basis of a competent independent appraisal of
such property. Appraisals shall be obtained from an appraiser
mutually agreeable to the State and the Contractor. If it is
determined to sell the property, the terms and conditions of such
sale must be approved in advance by the State.
Article VI - Insurance and Liability
20. The Contractor shall maintain, throughout the term of this
Agreement, adequate protection against liability for damages for
personal bodily injuries (including death resulting therefrom) and
for damage or destruction of property, whether the property of
• one or more claimants, in amounts not less than the amounts set
forth in the following schedule :

21 . The State may increase the minimums set forth in the above
schedule at any time upon thirty days written notice to the
Contractor.
22 . The Contractor shall furnish the State a certificate of
insurance issued by a company licensed to write such insurance in
the State of California which sets forth the amount of insurance
maintained by the Contractor and states that the following
requirements are met:
a. The State of California, its officers, employees, and
agents shall be named as additional insureds.

b. In the event of cancellation or material change of the
policy, the insurer will provide not less than thirty days
advance written notice of such cancellation or change. The
advance written notice shall be sent and addressed to: State
of California, Department of Transportation, Division of Mass
Transportation, Program Development and Evaluation Branch,
P.O. Box 1499, Sacramento, CA 95807.
c. The State of California will not be responsible for the
payment of premium or assessments .
Article VII - Reports, Records and Audits
23. The State shall review and approve the Contractor' s proposed
bid package, including vehicle specifications, prior to the
Contractor ' s invitation for bid. The Contractor' s proposed bid
package, including vehicle specifications, shall be sent and
addressed to: State of California, Department of Transportation,
Division of Mass Transportation, Program Development and
Evaluation Branch, P.O. Box 1499, Sacramento, CA 95807.
24. The Contractor's accounting and financial reporting system
shall be in accordance with the State Controller's Uniform System
of Accounts for Public Transit Operators, as defined in Title 2,
California Administrative Code, Section 1031.1, et seq. , and in
• the State Controller's Manual of Uniform Accounting System for
Special Districts, Section 5000, et seq.
25. All fiscal and accounting records and other supporting papers
of the Contractor and its subcontractors shall be maintained for a
minimum of three years following the close of the fiscal year of
expenditure and shall be held open to inspection and audit by
State representatives. Actual costs charged to the Project shall
be supported by properly executed payrolls, time records,
invoices, or vouchers, providing evidence in proper detail of the
nature and propriety of the charges incurred by the Contractor and
its subcontractors.
Article VIII - Fare Ratio
26. After delivery of the Project equipment, the Contractor must
maintain, for the fiscal year in which funds are received under
this Agreement, a ratio of fare revenues to operating costs, as
•defined in this Agreement, at least equal to one-tenth.

•27. The term "fare revenues" refers to all revenues recorded in
the following revenue account classes :
a. The term "Passenger Fares for Transit Services" refers to
a revenue account which records revenue amounts collected
from passengers. The revenue may be collected directly at
the point of service or through special passes sold to
passengers.
b. The term "Special Transit Fares refers to a revenue
account which records revenue amounts earned from contracts
in which an agency or organization pays a set amount to the
Contractor in return for unlimited transit service for the
persons covered by the contract . The contract amount is
established at the beginning of the contract period, and does
not vary with the quantity of the service actually provided.
C. The term "School Bus Service Revenues" refers to a
revenue account which records revenue amounts earned from
operating vehicles under school bus contracts.
In the case of a Contractor receiving funds for payment

e entity providing the service, and not transferred to the
Contractor .
The term "fare revenues" includes revenues earned under
contractual arrangements with public or private entities,
either (1 ) for transit fares for a specified group of employees,
members, or clients, or (2) to guarantee a minimum revenue on a
line operated especially for the benefit of, the paying entity
(e .g. , an employer, shopping center, university, etc. ) . The term
"fare revenues" may also include revenues from cash donations made
by individual passengers in lieu of a prescribed fare. However,
the term "fare revenues" does not include other donations or
general operating assistance, whether from public or private
sources .
28 . The term"operating cost" refers to all expenses necessary
and convenient to the operation of the Project recorded in the
following expense account classes:
a. The term "Labor" refers to an expense account which
records the pay and allowances due employees in exchange for
the labor service they render the Contractor.
b. The term "Fringe Benefits" refers to an expense account
which records payments or accruals to others on behalf of

an employee and payments or accruals direct to an employee
arising from other than performance of a piece of work.
c. The term "Services" refers to an expense account which
records labor and other work provided by outside
organizations for fees and related expenses.
d. The term "Materials and Supplies Consumed" refers to an
expense account which records materials and supplies issued
from inventory for use and materials and supplies purchased
for immediate use without going through inventory.
e. The term "Utilities" refers to an expense account which
records payments made to various utilities for utilization of
their resources.
f. The term "Casualty and Liability Costs" refers town
ex ense account which records cost elements covering:
(l� insurance which protects the Contractor from loss;
(2) compensation to others for their losses due to acts for
which the Contractor is liable; and (3) miscellaneous
losses.
g. The term "Taxes" refers to an expense account which
records taxes levied against the Contractor by federal,
• state, or local governments .
h. The term "Purchased Transportation Service" refers to an
expense account which records payments or accruals to other
transit systems for providing transportation service.
i. The term "Miscellaneous Expenses" refers to an expense
account which records expenses which cannot be attributed to
any other major expense account.
j . The term "Expense Transfers" refers to an expense account
which records adjustments and reclassifications of expenses
previously recorded.
k. The term"Interest Expense" refers to an expense account
which records charges incurred by the Contractor for the use
of borrowed capital.
1 . The term "Leases and Rentals" refers to an expense
account which records payments for the use of capital assets
not owned by the Contractor.

29. The provisions of Paragraph 26 shall not apply to an exten-
sion of public transportation services during its first year of
implementation.
30 . If the Contractor currently or in the future receives
revenues from the Local Transportation Fund or the State Transit
Assistance Fund, the Contractor shall not be subject to the
provisions of Paragraphs 26, 27, 28, and 29 above, but shall be
subject to the provisions of the Mills-Alquist-Deddeh Act
(Transportation Development Act) , as amended.
Article IX - Accessibility
31. No person in the State of California shall, on the basis of
ethnic group identification, religion, age, sex, color, or
physical or mental disability, be unlawfully subjected to
discrimination under any program or activity that is funded
directly by the State or receives any financial assistance from
the State.
32. Vehicles purchased pursuant to this Agreement for fixed route
systems shall be accessible to handicapped persons, including, but
not limited to, the physically and mentally disabled.
33. Vehicles purchased pursuant to this Agreement, other than i
vehicles purchased for fixed route systems, shall be accessible to
handicapped persons, including, but not limited to, the physically
and mentally disabled, unless the Contractor' s transportation
system, when viewed in its entirety, is accessible. If vehicles
purchased pursuant to this Agreement are not accessible to
handicapped persons, the State shall determine whether the
Contractor' s transportation system meets the accessibility
requirements of this paragraph and shall inform the Contractor in
writing of its determination.
34. Wheelchair lifts for use in any bus except a school bus shall
comply with the provisions of Title 13, California Administrative
Code, Sections 1090-1095 and 1269.1, as amended.
Article X - Contingent Fee
35. The Contractor warrants , by execution of this Agreement,
that no person or selling agency has been employed or retained
to solicit or secure this Agreement upon an agreement or under-
standing for a commission, percentage, brokerage or contingent
fee, excepting bona fide employees maintained by the Contractor
for the purpose of securing such agreements.

• Article XI - Prohibited Interests
36. During tenure or for one year thereafter, no member, officer,
or employee of the Contractor shall have any interest, direct or
indirect, in this Agreement or the proceeds thereof . The State
and the Contractor agree that to their knowledge no Board member,
officer or employee of the Contractor has any interest, whether
contractual, noncontractual, financial or otherwise, in this
transaction, or in the business of the contracting party other
than the Contractor and that, if any such interest comes to the
knowledge of either party at any time, a full and complete
disclosure of all such information will be made in writing to the
other party or parties, even if such interest would not be
considered a conflict of interest under Article 4 of Chapter 1 of
Division 4 (commencing with Section 1090) or Division 4.5
(commencing with Section 3600) of Title 1 of the Government Code
of the State of California.
Article XII - Minority Business Enterprises
37. The Contractor agrees that minority business enterprises
shall have the maximum opportunity to participate in the perfor-
mance of contracts financed in whole or in part with funds pro-
vided under this Agreement. For the purpose of this provision,
the term "minority business enterprise" refers to a business
enterprise that is owned by or controlled by a socially or
economically disadvantaged person or persons . Such disadvantage
may arise from cultural, racial, or religious background, sex,
national origin, chronic economic circumstances, or other similar
causes . Such persons may include, but are not limited to, blacks,
persons of Hispanic origin, Asians or persons from the Pacific
Islands, American Indians, and Alaskan natives .
Article XIII Fair Employment Practices
38. The Fair Employment Practices Addendum is attached and made a
part of this Agreement.

FAIR EMPLOYMENT PRACTICES ADDENDUM
1. In the performance of this contract, the Contractor will not discriminate against any employee or applicant
for employment because of race, color, religion, ancestry,sex*, age*, national origin, or physical handicap*. The
Contractor will take affirmative action to ensure that applicants are employed, and that employees are treated
during employment, without regard to their race, color, religion, ancestry, sex*,age*, national origin, or physical
handicap*. Such action shall include, but not be limited to, the following: employment, upgrading, demotion
or transfer;recruitment or recruitment advertising;layoff or termination;rates of pay or other forms of compen-
sation; and selection for training, including apprenticeship. The Contractor shall post in conspicuous places,avail-
able to employees and applicants for employment, notices to be provided by the State setting forth the provisions
of this Fair Employment Practices section.
2. The Contractor will permit access to his/her records of employment, employment advertisements, applica-
tion forms, and other pertinent data and records by the State Fair Employment Practices Commission, or any
other agency of the State of California designated by the awarding authority, for the purpose of investigation to
ascertain compliance with the Fair Employment Practices section of this contract.
3. Remedies for Willful Violation:
(a) The State may determine a willful violation of the Fair Employment Practices provision to have
occurred upon receipt of a final judgement having that effect from a court in an action to which •
Contractor was a party, or upon receipt of a written notice from the Fair Employment Practices
Commission that it has investigated and determined that the Contractor has violated the Fair Employ-
ment Practices Act and has issued an order, under Labor Code Section 1426, which has become final,
or obtained an injunction under Labor Code Section 1429.
(b) For willful violation of this Fair Employment Practices provision, the State shall have the right to
terminate this contract either in whole or in part, and any loss or damage sustained by the State in
securing the goods or services hereunder shall be borne and paid for by the Contractor and by his/her
surety under the performance bond, if any, and the State may deduct from any moneys due or that
thereafter may become due to the Contractor, the difference between the price named in the contract
and the actual cost thereof to the State.

• AN ORDINANCE OF THE CITY OF ATASCADE'RO CREATING
CHAPTER 3 TO TITLE 4 OF THE ATASCADERO MUNICIPAL CODE,
ENTITLED TRAFFIC REGULATION
The Council of the City of Atascadero ordains as follows:
Section 1. Chapter 3 of Title 4 is added to the Atascadero
Municipal Code to read as follows :
TITLE 4. PUBLIC SAFETY
Chapter 3 Traffic Regulation
Article 1. Words and Phrases Defined
4-3. 101. Definition of words and phrases.
The following words and phrases when used in this ordinance shall,
for the purpose of this ordinance, . have the meanings respectively
ascribed to them in this Article.
Whenever any words and phrases used herein are not defined herein,
but are defined intheVehicle Code of the State of California and
amendments thereto, such definitions shall apply.
(a) "Coach" - Any motor bus , motor coach, trackless trolly or
passenger stage used as a common carrier of passengers.
(b) "Council" The Council of the City of Atascadero
(c) "Curb" - The lateral boundary of the roadway whether such
curb be marked by curbing construction, or not so marked;
the word "curb" as herein used shall not include the line
dividing the roadway of a street from parking strips in
the center of a street, nor from tracks or rights of way
of public utility companies.
(d) "Divisional island" - A raised island located in the road-
way and separating opposing or conflicting streams of
traffic.
(e) "Gross weight" - The weight of a vehicle without load plus
the weight of any load thereon.
' (f) "Holidays" Within the meaning of this chapter, holidays
are the first day of January, known as "New Year' s Day
the twelfth day of February, known as "Lincoln' s Birthday" ;
the third Monday in February, known as "Washington' s Holi-
day" ; the last Monday in May, known as "Memorial Day" ; the
fourth day of July, known as "Independence Day" ; the first
• Monday in September, known as "Labor_Day" ;

and the twenty-fifth day of December,
known as "Christmas. "
(g) "Loading Zone" The space reserved for the exclusive use
of vehicles during the loading or unloading of passengers
or freight.
(h) "Official time standard" Whenever certain hours are named
herein, they shall mean standard time or daylight-saving
time as may be in current use in this City.
(i) "Ordinance" The ordinance, rule or regulation adopted by
the Council relating to the movement of traffic and enforce-
ment thereof.
(j ) "Parkway - That portion of street right of way other than
a roadway or a sidewalk.
(k) "Passenger loading zone The space reserve for the exclu-
sive use of vehicles while receiving or discharging passengers.
(1) "Police Officer Every officer of the Police Department
of this City or any officer authorized to direct or regulate
traffic or to make arrests for violations of traffic regu-
lations.
(m) "Railroad train" - A steam engine, electric or other motor,
with or without cars coupled thereto, operated upon rails,
except streetcars.
(n) "Traffic Engineer" - The Public Works Director of the City is
designated the Traffic Engineer and charged with the duties
thereof, as hereinafter provided.
(o) "Traffic Enforcement Unit" - A unit within the Police Depart-
ment.
(p) "Traffic Engineering Division" - A division within the
Public Works Department.
(q) "Vehicle Code" The Vehicle Code of the State of California.
Article 2. Traffic Administration
4-3.201. Police Administration Traffic Enforcement Unit.
There is hereby established in the Police Department a Traffic-
Enforcement Unit to be under the control of a police officer appointed
by and directly responsible to the Chief of Police.

4-3. 202. Duty of Traffic Enforcement Unit. '-
It shall be the duty of the Traffic Enforcement Unit with such
aid as may be rendered by other members of thePoliceDepartment to
enforce the street traffic regulations of this City and all of the
State vehicle laws applicable to street traffic in this City, to
make arrests for traffic violations, to investigate traffic accidents
and to cooperate with the Traffic Engineer and other officers of the
City in the administration of the traffic laws and in developing ways
and means to improve traffic conditions, and to carry out those
duties specially imposed upon said division by this Ordinance.
4-3. 203. Traffic Engineer.
The Traffic Engineer shall exercise the powers and duties as
provided in this Chapter. He shall be responsible for all traffic
engineering division functions in the Public Works Department.
4-3. 204. Powers and duties of Traffic Engineer - Delegation.
It shall be the general duty of the Traffic Engineer to determine
the installation and proper timing and maintenance of traffic control
devices and signals , to conduct engineering analysis of traffic acci-
dents and to devise remedial measures, to conduct engineering and
• traffic surveys of traffic conditions and to cooperate with other
City officials in the development of ways and means to improve traffic
conditions , and to carry out the powers and duties imposed by the
laws of this City.
Whenever the Traffic Engineer is required or authorized to place
or maintain official traffic control devices or signals , he may cause
such devices or signals to be placed or maintained.
Whenever, by the provisions of this Chapter, a power is granted
to the Traffic Engineer or a duty imposed upon him, the power may
be exercised or the duty performed by a person authorized by him.
4-3. 205. Traffic accident studies.
Whenever the accidents at any particular location become numerous ,
the Traffic Enforcement Unit shall cooperate with the Traffic Engineer
in conducting studies of such accidents and determining remedial
measures .
4-3. 206 . Traffic accident reports.
The traffic enforcement unit and/or the traffic engineering divi-
sion shall maintain a suitable system of filing traffic accident reports.
Such reports shall be available for the use and information of the
supervising officer of the Traffic Enforcement Unit and the Traffic
Engineer.

4-3.206. Traffic accident reports.
The traffic enforcement unit and/or the traffic engineering divi-
sion shall maintain a suitable system of filing traffic accident reports.
Such reports shall be available for the use and information of the
supervising officer of the Traffic Enforcement Unit and the Traffic
Engineer.

4-3.207. Annual traffic safety report.
The Traffic Enforcement Unit and Traffic Engineering Division
shall jointly submit an annual traffic report to the City Manager.
Such a report shall contain information on traffic matters as follows :
(a) The number of traffic accidents, the number of persons
killed, the number of persons injured, and other per-
tinent traffic accident data.
(b) The number of traffic accidents investigated and other per-
tinent data of the safety activities of the police.
(c) The plans and recommendations of the Traffic Enforcement
Unit and the Traffic Engineering Division of future traffic
safety activities.
4-3.208. Emergency and experimental regulations.
(a) The Traffic Engineer may test traffic control devices under
actual conditions of traffic.
(b) The Chief of Police may authorize the temporary placing of
• official traffic control devices when required by an
emergency. The Chief of Police shall notify the Traffic
Engineer of his action as soon thereafter as is practicable.
4-3.209. Traffic committee.
The City Manager may establish an advisory traffic committee to
serve without compensation, consisting of the Chief of Police or his
representative, the supervising officer of the Traffic Enforcement
Unit, the Traffic Engineer, the Planning Director or his representative,
and other such technical representation as may be required. The chair-
man of the committee shall be the Traffic Engineer.
4-3. 210. Duties of traffic committee.
It shall be the duty of the traffic committee to suggest the
most practicable means for coordinating the activities, of all officers
and agencies of this City having authority with respect to the admin
istration and enforcement of traffic regulations; to stimulate and
assist in the preparation and publication of traffic reports ; and to
recommendto the City Manager means for improving traffic conditions
and the administration and enforcement of traffic regulations.
Article 3. Enforcement and Obedience to
Traffic Regulations
• 4-3. 301. Authority of Police and Fire Department officials.
Officers of the Police Department and such officers as are
assigned by the Chief of Police are hereby authorized to direct all

a •traffic by voice, hand, audible or other signal n conformance with.
traffic laws, except that in the event of a fire or other emergency
or to expedite traffic or to safeguard pedestrians, officers of the
Police Department or members of the Fire Department may direct traffic
as conditions may require, notwithstanding the provisions to the con-
trary contained in this Chapter or the Vehicle Code.
4-3. 302. Obstruction or interference with police or authorized
officers.
No person shall interfere with or obstruct in any way any police
officer or other officer or employee of this City in their enforce-
ment of the provisions of this Chapter. The removal, obliteration
or concealment of any chalk mark or other distinguishing mark used
by any police officer or other employee or officer of this City in
connection with the enforcement of the parking regulations of this
Ordinance shall, if done for the purpose of evading the provisions
of this Chapter, constitute such interference or obstruction.
4-3. 303. Exception of certain vehicles.
(a) The provisions of this section regulating the parking or
standing of vehicles shall not apply to any vehicle of a
City department or of a public utility while necessarily
in use in construction or repair work, or any vehicle
owned or operated by the United States, Postal Service while•
in use for the collection, transportation, or delivery of
United States mail.
(b) The foregoing exception shall not, however, relieve the
operator of any such vehicle from the obligation to exer-
cise due care for the safety of others, or the consequences
of hia willful disregard for the safety of others.
4-3. 304. Removal of vehicles from streets.
Any regular sworn police officer of the Police Department may
remove or cause to be removed any vehicle:
(a) That has been parked or left standing upon a street for
seventy.-two (72) consecutive hours.
(b) Which is parked or left standing upon a street between any
specified hours when such parking or standing is prohibited
by the Municipal Code or by authorization of the Traffic
Engineer and signs are posted giving notice of such prohi-
bition and removal.
(c) Which is parked or left standing upon a street where access
to such street or a portion thereof is necessary for cleaning,
repair, or construction thereof or therein, or when the use
of the street or portion thereof is authorized for a purpos•
other than for the normal flow of traffic, or when the use

of the street or portion thereof is necessary4f-or the movement of
equipment, articles, or structures of such size that such movement
would be impeded by parked vehicles, provided that signs giving
notice of prohibition of parking and removal of vehicles are posted
at least twenty-four (24) hours prior to the beginning of the period
of prohibition.
Article 4. Traffic Control Devices
4-3. 401. Authority to install traffic control devices.
The Traffic Engineer, as authorized by the Council, shall place
and maintain or cause to be placed and maintained official traffic
control devices upon streets and highways as required under the
Vehicle Code or the traffic laws of this City to make effective the
provisions of the Code or the laws and may place and maintain or
cause to be placed and maintained, such appropriate official traffic
control devices as may be deemed necessary to properly indicate and
to carry out the provisions of the Vehicle Code or the Municipal
Code or to warn or guide traffic.
4-3. 402 . Official traffic control devices required for enforcement
purposes
• No provision of the Vehicle Code (unless expressly stated therein)
or of the Municipal Code which require official control devices shall
be enforced against an alleged violator unless appropriate official
traffic control devices are in place giving notice of such provisions
of the traffic laws.
4-3. 403. Installation of traffic signals.
(a) The Traffic Engineer, as authorized by the Council, shall
install and maintain official traffic signals.
(b) The Traffic Engineer shall ascertain and determine the
locations where such signals are required by an engineering
and traffic survey and his determinations therefrom shall
be made in accordance with those traffic engineering and
safety standards and instructions set forth in the California
State Department of Transportation Traffic Manual.
4-3. 404 . Traffic Engineer to establish crosswalks.
(a) The Traffic Engineer as authorized by the Council shall
establish, designate and maintain crosswalks at intersec-
tions and other places by appropriate devices , marks or
lines upon the surface of the roadway where, in his opinion,
it is essential to the effective and safe flow of vehicular
and pedestrian traffic.
• (b) The Traffic Engineer is authorized to install signs at or
adjacent to an intersection in respect to any crosswalk_

directing that pedestrians shall not cross in the cross-
walk so indicated.
4-3. 405. Traffic lanes.
The Traffic Engineer shall have authority to mark traffic lanes
upon the roadway of any street or highway where a regular alignment
of traffic is necessary.
4-3. 406. Distinctive roadway markings.
The Traffic Engineer is authorized to place and maintain upon
highways distinctive roadway markings as described in the Vehicle
Code.
4-3. 407 . Authority to remove, relocate and discontinue traffic con-
trol devices.
The Traffic Engineer, as authorized by the Council, may remove,
relocate or discontinue the operation of any traffic control device
not specifically required by the Vehicle Code or this Chapter when-
ever he shall determine in any particular case that theconditions
which warranted or required the installation no longer exist or apply.
4-3. 408. Traffic control devices: Hours of operation. •
The Traffic Engineer, as authorized by the Council, shall deter-
mine the hours and days during which any traffic control device shall
be in operation or be in effect, except in those cases where such
hours or days are specified in this Chapter.
4-3. 409 . Unauthorized painting of curbs.
No person or agency, other than the City, unless authorized by
the Traffic Engineer, shall paint any street or curb surface.
4-3. 410. Construction of traffic control devices.
Any person or agency performing construction or maintenance work
within a roadway shall provide and maintain temporary traffic control
devices as set forth in the California State Department of Transpor-
tation Traffic Manual. The traffic control devices are to be main-
tained during such time that construction or maintenance work creates
a hazardous or unsafe condition in the vehicle or pedestrian travelway.
Article 5. Speed Regulations
4-3. 501. State speed laws applicable.
The State traffic laws regulating the speed of vehicles shall be
applicable upon all streets within this City except where the Traffic•

mine and designate streets , parts of streets or specific lanes thereon
upon which vehicular traffic shall proceed in one direction during
one period and the- opposite direction during another period of the
day and shall place and maintain appropriate markings, signs, barriers
or other devices to give notice thereof. The Traffic Engineer may
erect signs temporarily designating lanes to be used by traffic
moving. in a particular direction, regardless of the centerline of
the roadway. '
Article 8. Stop and Yield Intersections
4-3. 801. Authority for stop signs and yield signs.
The Traffic Engineer, as authorized may erect and maintain stop
signs, yield signs, or other official traffic control devices to
designate through streets or to designate intersections or other
roadway junctions at which vehicular traffic on one or more of the
roadways should yield or stop and yield before entering the inter-
section or junction.
Article 9. Miscellaneous Driving Rules
4-3. 901. Stop when traffic obstructed.
No driver shall enter an intersection or a marked crosswalk
• unless there is sufficient space on the other side of the intersection
or crosswalk to accommodate the vehicle he is operating without
obstructing the passage of other vehicles or pedestrians, notwith-
standing any traffic control signal indication to proceed.
4-3. 902. Driving through funeral or other procession.
No driver of a vehicle shall drive between the vehicles comprising
a funeral or other authorized procession while they are in motion and
when such vehicles are conspicuously designated as required in this
ordinance. This provision shall not apply at intersections where
traffic is controlled by traffic control signals or police officers.
4-3. 903 . Driver in a procession, ,
Each driver in a funeral or other procession shall drive as near
to the right-hand edge of the roadway as practicable and shall follow
the vehicle ahead as close as is practicable and safe.
4-3. 904 . When permits required for parades and processions .
No procession or parade shall occupy, march or proceed along any
street except in accordance with a permit properly issued by the City.
4-3. 905. Obedience to barriers and signs.
• No person, public utility, or City employee shall erect or place
any barrier or sign on any street unless of a type approved by the

.Traffic Engineer or disobey the. instruction, or remove, tamper with,
or destroy any barrier or sign lawfully placed on any street.
4-3. 906. Shrubbery obstructing visibility of intersections.
Whenever the Traffic Engineer finds that any hedge, shrubbery,
or tree growing in a parkway obstructs the view of any intersection
or any traffic upon the streets approaching such intersection, he
shall give written notice to the owner of the property to remove or
trim such obstruction together with an appropriate time limit for
such actions and, if not properly performed in the time limit, he
shall cause the hedge, shrubbery, or tree to be immediately removed
or reduced in height and the cost of such removal or trimming shall
be collectable in the manner provided by law.
Article 10. Regulations for Bicycles
4-3. 1001. Effect of regulation.
(a) The parent of any child or guardian of any ward shall not
authorize or knowlingly permit any such child or ward to
violate any of the provisions of this Chapter.
(b) Regulations applicable to bicycles shall apply whenever a
bicycle is operated upon any street within the City or •
upon any path therein set aside for the exclusive use of
bicycles , subject to the exceptions stated therein.
4-3. 1002. Bicycle license optional.
The licensing of bicycles shall be at the option of bicycle
owners within the City.
4-3. 1003. License application.
Application for a bicycle license shall be made upon a form
provided by the City and shall be made with the Fire Department. -A
license fee as prescribed by the City Council- shall be paid before
each license or renewal thereof is granted.
4--3. 1004 . Issuance of license.
(a) Upon receiving an application, the Fire Department is auth-
orized to issue a bicycle license.
(b) Licenses shall be effective for one (1) calendar year from
date of issuance.
(c) A license shall not be issued when reasonable grounds exist
to believe that the applicant is not the owner of or entitl�
to the possession of such bicycle.

(d A record shall be kept of the number,_ of each license, the
date issued, the name and address of the person to whom
issued, and a record of all bicycle license fees collected.
4-3. 1005. Attachment of license.
(a) Licenses shall be affixed to the front of the seat tube
of the bicycle frame.
(b) No person shall remove a current license from a bicycle
except upon a transfer of ownership or in the event the
bicycle is dismantled and no longer operated upon any
street or bicycle path in the City.
4-3. 1006. Riding on sidewalks prohibited.
No person shall ride a bicycle upon and along a sidewalk, or in
violation of any of the provisions of the Vehicle Code.
4-3. 1007. Bicycle parking.
A person shall not park a bicycle on a roadway or on a public
sidewalk in such a manner as to obstruct the movement of a legally
parked motor vehicle.
Article 11. Stopping, Standing or Parking
Prohibited in Specified Places
4-3. 1101. Traffic Engineer to designate no stopping zones and no
parking areas.
(a) The Traffic Engineer, as authorized to determine the loca-
tion of no stopping zones and no parking areas, shall
place and maintain appropriate signs or markings indicating
the same and stating the hours during which the provisions
of this Article are applicable.
(b) No stopping zones and no parking areas shall be indicated
by red paint upon the top of all curbs in said zones and
areas.
4-3. 1102. Prohibited stopping, standing or parking.
No person shall stop, park, or leave standing any vehicle whether
attended or unattended, except when necessary to avoid conflict with
other traffic or in compliance with the directions of a peace officer
or offical traffic control device, in any of the following places:
(a) Within any division island unless authorized and clearly
indicated with appropriate signs or markings.
• (b) In any area established as a no parking area, when such

area is indicated by appropriate sigmas or by red paint upon*
the curb surface.
(c) Within any parkway.
(d) On any street or highway where the use of such street or
highway or a portion thereof is necessary for the cleaning,
repair or construction of the street or highway or the
installation of underground utilities or where the use of
the street or highway or any portion thereof is authorized
for a purpose other than the normal flow of traffic or
where the use of the street or any portion thereof is
necessary for the movement of equipment, articles, or struc-
tures of unusual size, and the parking of such vehicle
would prohibit or interfere with such use or movement;
provided that signs giving notice of such no parking are
erected or placed at least twenty-four (24) hours prior to
the effective time of such no parking.
(e) At any place within twenty (20) feet of a crosswalk at an
intersection when such place is indicated by appropriate
signs or by red paint upon the curb surface except that a
bus may stop at a designated bus stop.
(f) Within twenty (20) feet of the approach to any traffic
signal, boulevard stop sign, , or official electric flashing •
device.
(g) Within any appropriately designated fire lane and access
roads as established by the City Fire Code when appropriate
signs or markings are posted.
4-3. 1103. Parking in alleys.
No person shall stop, stand, or park any vehicle for any purpose
other than the loading or unloading of passengers or freight in any
alley. No person shall position any vehicle in any alley in such a
manner or under such conditions as to leave available less than ten
(10) feet of the width of the roadway for the free movement of vehi-
cular traffic, while that vehicle is being loaded or unloaded. No
person shall position any vehicle in any alley in such a manner as
to block or restrict access to any driveway entrance.
4-3.1104. Parking adjacent to schools.
The Traffic Engineer is authorized to place signs or markings
indicating no parking upon either or both sides of any street adjacent
to any school property when such parking would, in his opinion, inter-
fere with traffic or create a hazardous situation.
4-3. 1105. Parking prohibited on narrow streets. •
The Traffic Engineer is authorized to place signs or markings

indicating no parking upon any street when the width of the roadway
does not exceed twenty (20) feet, or upon one side of a street as
indicated by such signs or markings when the width of the roadway
does not exceed thirty (30) feet.
4-3. 1106 . Standing or narking on one-way streets.
The Traffic Engineer is authorized to erect signs upon the left-
hand side of any one-way street to prohibit the standing or parking
of vehicles.
4-3. 1107. Standing or parking on one-way roadways .
In the event a highway includes two or more separate roadways
and traffic is restricted to one direction upon any such roadway, no
person shall stand or park a vehicle upon the left-hand side of such
one-way roadway unless signs are erected to permit such standing or
parking. The Traffic Engineer is authorized to determine when standing
or parking may be permitted upon the left-hand side of any such one-
way roadway and to erect signs giving notice thereof.
4-3.1108. Parking on grades.
No person driving, or in control of, or in charge of, a motor
• vehicle shall permit it to stand on any highway unattended when upon
any grade exceeding three percent (30) within any business or resi-
dence district without blocking the wheels of the vehicle by turning
them against the curb or by other approrpiate means.
4-3. 1109. Unlawful parking - Peddlers, vendors .
Except as otherwise provided in this section, no person shall
stand or park any vehicle, wagon, or pushcart from which goods, wares,
merchandise or foods are sold, displayed, solicited or offered for
sale or bartered or exchanged, or any lunch wagon or eating car or
vehicle, on any portion of any street except that such vehicles,
wagons, or pushcarts may stand or park only at the request for a bona
fide purchaser for a period not to exceed fifteen (15) minutes at
one place. The provisions of this subsection shall not apply to
persons delivering such articles upon order of, or by agreement with
a customer from a store or other fixed place of business or distribution.
4-3. 1110. Emergency parking signs.
Whenever the Traffic Engineer determines that an emergency traffic
congestion is likely to result from the holding of public or private
processions or assemblages, he shall place temporary signs indicating
that the operation, parking or standing of vehicles is prohibited on
such streets and alleys. Such signs shall remain in place only during
the existence of such emergency and the Traffic Engineer shall remove
• such signs thereafter.

Article 12. Stopping for Loading or Unloading Only.
•
4-3.1201. Traffic- Engineer to designate loading zones and passenger
loading zones.
(a) The Traffic Engineer is authorized to determine the loca-
tion of loading zones and passenger loading zones and
shall place and maintain appropriate signs or markings
indicating the same and stating the hours during which the
provisions of this Article and the Vehicle Code are applicable.
(b) Loading zonesshall be indicated by yellow paint upon the
top of all curbs in said zones . Yellow shall mean no
; stopping, standing or parking at any time between 7 : 00 a.m.
and 6 :00 p.m. of any day except Sundays and holidays for
any purpose other than the loading or unloading of passengers
or freight, provided that the loading or unloading of passen-
gers shall not consume more than thirty (30) minutes and the
loading or unloading of freight more than twenty (20)
minutes.
(c) Passenger loading zones shall be indicated by white paint
upon the top of all curbs in said zones. White shall mean
no stopping, standing or parking for any purpose other than
loading or unloading of passengers, or for the purpose of
depositing mail in an adjacent mail box, which shall not •
exceed three (3) minutes and such restrictions shall apply
between 7:00 a.m. and 6 : 00 p.m. on any day except Sundays
and holidays and except as follows:
When such zone is in front of a hotel or in front of a mailbox,
the restrictions shall apply at all times. When such zone is in
front of a theater, the restrictions shall apply at all times except
when such theater is closed.
4-3. 1202 . Effect of permission to load or unload.
(a) Permission herein granted to stop or stand a vehicle for
purposes of loading or unloading of. freight shall not
extend beyond the time necessary therefor, and in no event
for more than twenty (20) minutes.
(b) Permission herein granted to stop or park for purposes of
loading or unloading of passengers shall include the
loading or unloading of personal baggage, but shall not
extend beyond the time necessary therefor and in no event
for more than three (3) minutes.
(c) Within the total time limits above specified, the provi-
sions of this section shall be enforced so as to accommo-
date necessary and reasonable loading or unloading but •
without permitting abuse of privileges hereby granted.

4-3. 1203. Standing in any alley.
No person shall stop, stand or park a vehicle for any purpose
other than the loading or unloading of passengers or freight in any
alley.
4-3.1204 . Traffic Engineer to designate public carrier stops and
stands.
The Traffic Engineer is authorized to establish bus stops, bus
stands, taxicab stands and stand for other passenger common-carrier
motor vehicles on such streets in such places and in such number as
he shall determine to be of the greatest benefit and convenience to
the public, and every such bus stop, bus stand, taxicab stand or
other stand shall be designated by appropriate official traffic con-
trol devices .
4-3.1205. Restricted use of bus and taxicab stands .
No person shall stop, stand or park a vehicle other than a bus
in a bus stop, or other than a taxicab in a taxicab stand when any
such stop or stand has been officially designated and appropriately
signed, except that the driver of a passenger vehicle may temporarily
stop therein for the purpose of and while actually engaged in loading
• or unloading passengers when such stopping does not interfere with
any bus or taxicab waiting to enter or about to enter such zone.
Article 13. Stopping, Standing or Parking Restrictions
4-3.1301. Time limit parking.
(a) The Traffic Engineer is authorized to designate by appro-
priate signs or curb marking, locations where it shall be
unlawful for the operator of any vehicle to stop, stand,
or park said vehicle adjacent to any such legible curb
marking or signs for a period of time in violation thereof.
(b) Time limit parking zones shall be indicated by green paint
upon the top of all curbs in said zones . Green shall mean
no standing or parking for a period longer than indicated
at any time between 9 : OO a.m.- and 5:00 p.m. for any day
except Sundays and holidays.
4-3.1302 . Handicapped parking.
(a) The Traffic Engineer is authorized by the Council to deter-
mine and mark, w1th blue curb and appropriate signing, loca-
tions- on public streets and in publicly, owned, leased,, or
controlled cuff-street parking facilities for the exclusive
use of physically handicapped persons.
• (b) The privately owned and operated parking facilities in
the City may reserve parking stalls for exclusive use by

physically handicapped persons.
(c) No person shall stop, stand, or park any vehicle in any
parking space marked by blue curb and appropriate signing
unless said vehicle bears a special license or displays
a special placard issued under the provisions of the
Vehicle Code.
4-3. 1303. Commercial vehicles street parking prohibited.
(a) No person shall stop, stand or park a commercial vehicle
on any street except a designated truck route except when
such vehicle is parked temporarily in connection with the
performance of a service or for loading and unloading.
(b) When the Traffic Engineer determines that the parking of
commercial vehicles constitutes a public nuisance or
safety hazard in any street, the Traffic Engineer shall
install appropriate signing or markings prohibiting the
stopping, standing or parking' of commercial vehicles in
the areas so designated.
4-3. 1304 . Parking of non-motorized vehicles.
No person shall park or leave standing a non-motorized vehicle •
or camper, regardless of width or length, when it has been detached
from its motor vehicle on any street or highway in the City.
Article 14 Regulating Classes and Kinds of Traffic on
Certain Highways
4-3.1401. Gross weight limits.
The Traffic Engineer is authorized, on the basis of an engi-
neering and traffic survey, to erect and maintain official traffic
control devices on any streets or parts of streets to impose gross
weight limits as prescribed by the Vehicle Code.
4-3. 1402. Size restrictions.
The Traffic Engineer is authorized, on the basis of an engi-
neering and traffic survey, to erect and maintain official traffic
control devices on any streets or parts of streets to impose vehicle
size restrictions as prescribed by the Vehicle Code.
Section 2. The City Clerk shall cause this ordinance to be pub-
lished once within fifteen (15) days after its passage in the Atas-
cadero News, a newspaper of general circulation printed, published
and circulated in the City in accordance with Section 36933 of the
Government Code; shall certify the adoption of this ordinance and
shall cause this ordinance and this certification to be entered into •

Section 3. This ordinance shall go into effect and be in full
force and effect at 12: 01 a.m. on the 31st day after its passage.

SUBJECT Recreation Supervisor position
If you will recall, I noted at the last Council meeting
that Mr. Ross was finding that the demands of the recreation
jobs , for Paso Robles and Atascadero were more than he had
anticipated. As a consequence, he has notified me that he
would like to make other arrangements . He also told me that
he would be willing to help in every way possible during the
time it would take us to develop our recreation program. Because
of this change, I recommend that we reconsider our approach
to Recreation Department manning. With Mr. Ross in the
picture, we had thought that a Recreation Supervisor with
clerical help would be satisfactory for the foreseeable
future.
When we advertised for the position, we advertised for a
• salary range less than what we should have. Although we
received approximately 65 applications, after screening and
interview, only four persons were considered to meet the
requirements of job. Of these, the number one choice wanted
a salary considerably greater than our advertised offer I
could not recommend to you an increase of the amount necessary
to hire this individual without, at the same time, re-adver-
tising the position. I suspect that, had we advertised at a
higher salary, we would have received an entirely different
caliber of applicants in terms of experience and training.
Additionally, to do so would have been contrary to fair hiring
practices. With Mr. Ross' change of plans, the criteria for
the position has taken a different turn requiring someone of
different experience, background and initiative to form the
new department. In our judgment, the remaining applicants
did not meet the changed circumstances. Without Mr. Ross, a
great deal of independent work will be required.
As a consequence of these considerations and after having
reviewed the current salary and functional structure, I
recommend that we consider hiring a person with the title of
Recreation Superintendent at a higher salary range than origin-
ally contemplated, somewhere comparable to a Police Sergeant
salary, and that we readvertise for this position. With
Mr. Ross' s departure, we would continue with a two-person
• operation consisting of the Recreation Superintendentandthe
present clerical assistant until we have fully developed our
-
overall recreation programs. The increased salary is more than

justified sincewewill place a great deal of responsibility
on this individual to develop recreation functions. If the
growth of the activity justifies it, a different manning
structure could evolve after the passing of the next few months.
We could expect that the person hired as the Recreation Super-
intendent could move into a Director' s job if that was later
appropriate. In the meantime, a two-person department could
function.
As far as budgetary considerations are concerned, there
is sufficient money in `the budget to accommodate this change
since we did not hire a person early in the year and since
Mr. Ross will be departing prior to the fiscal year.. You will
note that I am not, at this point, recommending a department
head status for this position and, therefore, that the salary
is not compared to other directors in the County. One reason
for this is that unlike some in other areas of the County, our
recreation department is solely responsible for recreation and
not park maintenance. - A salary comparable to a police sergeant' s
should attract a professional person trained in recreation with
experience. If it turned out that we wanted to upgrade the
position, then this same person should be qualified to move
into that higher position.
If you concur in these observations, then I would request •
your approval to readvertise the position as a Recreation
Superintendent with a salary comparable to whatever the police
sergeant' s salary evolves to with the understanding 'that' we
could upgrade the position subsequently if justified. There
is little doubt that we will need a person .with wide recreation
experience, beyond just athletics, in this position. Contrary
to what may be popular belief, a recreation director must
possess a wide variety of managerial skills beyond 'just program
scheduling. Knowledge of grants, liabilities, equipment, as
well as public relations and general recreation or leisure time
services is needed.
In consideration of these factors, I recommend that we
proceed as outlined above.

SUBJECT: Additional payment for pavilion reroofing
Attached is a memo from the Public Works Director
concerning an error in the -bid costs for the Pavilion reroofing
job. It is not unusual to have bids submitted in which
errors in calculations have been made. As indicated by the
Public Works Director' s memo, however, the errors are normally
found by the contractors prior, to actual work starting.
The City could adopt a hard line and say the error is
solely the fault of the contractor and, hence, he should be
• forced to absorb the loss. On the other hand, this appears
to be an honest mistake and, if adjusted, would still result
in an overall job cost within the low bid category.
I concur with the Public Works Director' s recommendation
that we adjust the payment so as to include materials costs
in the sum of $1, 068 .48 , but that the remainder be at the
contractor' s expense.

tractor' s error in the bid.
Also included are what the contractor purports ,to be his original
notes in preparing the job bid. I have circled those areas where the
error was made in the composition roofing material
Normally an error of this type is discovered before any work starts
and may be basis for voiding the contract if proper justification is
presented. In this case, the work was substantially under way before the
contractordiscoveredhis error and after conferring with this office , •
he indicated he would complete the project regardless of the disposition
of his claim.
Should the contractor' s claim be approved, the total cost for the
job would come to $4 , 798. 48, still below the second low bid of $4 , 880 . 00.
My recommendation is that this request be presented to Council for
their direction with a further suggestion that only the addedmaterials
be considered for payment. The total materials cost needed to complete
the project is shown as $1, 068. 48.
Council should be aware that it is my opinion they have no legal
obligation to honor this claim, however, the City has received benefit
from the Contractor' s work.

The attached memo from the Director of Public Works
explains a situation with our chip sealing program which was
unforeseen. The type and quantity of the materials needed
for the additional chip sealing work was different than for
other streets in the program, thereby resulting in higher
costs than had been anticipated. You previously approved,
in the budget, $255, 809 for this year' s street maintenance
contract work. The additional work has been satisfactorily
• completed, it was needed and the materials were of a greater
quantity and type than required for other streets. I con-
cur with the Public Works Director' s assessment.
I am notifying you of this Change Order for your infor-
mation and, unless there are any specific objections, will
enter into the Change Order as attached.

SUBJECT- Quantity Over-runs 1980 Chip Sealing Program
I have attached a contract change order showing substantial
increases in the materials used on the 1980 Chip Sealing Program.
Based on City Council action, I included 25 percent more
street area to the original contract in the 'form of additional
streets to be chip sealed. Along with the supplimental streets ,
the deft turn project at the Rancho Del Bordo� Mobile Home Park
was added to this contract. Even with these additions the quan-
tities were substantially higher than anticipated. Following are
some factors that affected the final contract quantities
1) We have not had previous projects of this nature locally
to establish accurate contract estimates, therefore the
contract was written around specific streets to be seal
coated with a cautionary note that the contract quantities
were estimates only and could be adjusted accordingly. •
2) Because of the condition of the roads , substantially higher
quantities of emulsion and chips were needed to provide a
quality finish.
3) 3/8" rock was used instead of 1/4" due to the condition of
the roads and also to provide a more durable surface The
Contractor agreed to supply the 3/8" rock at $1, 00 per ton
less than the bid price
4) The 3/8" rock is placed on the roadway heavier than 1/4
rock and generally takes more emulsion to bond it to the
roadway. The project required 20 lbs, per square yard in-
- stead of 16 lbs per square yard as estimated.
5) Finally, the roads are not well defined by width, and a check
of the streets where the work was performed indicates that
there was a larger area involved than had been originally
anticipated due to the width variation.
The work performed under this contract is a portion of the overall
program this year for street maintenance contract work whichis Pre-
sently budgeted at $255 , 809. The balance not utilized in the Chip Seal
Contract will be used next spring to do, pavement repairs, overlays ,
and additional chip sealing. Although Council has not reviewed_ specific
programs. under this budget item, it has approved a dollar amount for
street maintenance contract services for this fiscal year.
• Certainly, while we spent more than intended on this phase of
our maintenance program, the streets receiving the work received
necessary repairs which would have had to be done sooner or later.
In total , I am well satisfied with the condition of the streets
that were completed under this contract and will continue this pro-
gram taking into account that new estimates of materials weights
will be used for future projects.

LOCATION: East Mall and El Camino Real (Lots 1-A, 1-B, 1-C, 1-D,
1-E, 2, 3,4, 5 and south half of Lot 6 of Block OL)
APPLICANT: Santa Barbara Savings
REQUEST: To construct new 3600 square feet savings and loan
facility.
BACKGROUND
1. Existing Zoning: C-1-D
2. General Plan: Retail Commercial
3. Environmental Determination: An environmental description form
has been filled out. The Planning Director has prepared a Draft
Conditional Negative Declaration for the project indicating that
no significant environmental effects are likely to occur if the
project is implemented as proposed.
4 . Site Conditions : The site is presently developed with a tempo-
rary office and small parking lot. Topography of the site is
generally level. vegetation consists of a lawn area over rough-
ly the west half of the site, four large mature oak trees along
the East Mall frontage and a variety of induced landscaping
around the existing temporary office. The subject property
is bounded on the northwest by East Mall Avenue and the Sunk-
en gardens beyond, on the northeast by the Senior Citizen
Center, on the southeast by an alleyway and the Atascadero
Creek beyond, and on the southwest by E1 Camino Real . The
subject site is included in the "Atascadero Creekway Schematic
Plan and Study. "
5. Project Description The project consists of the construction
of a new 3600 square foot savings and loan office with 26 park-
ing spaces including one handicap space. Elements of the bank
include four teller windows with two more for future use; one
drive-up teller window; two "new accounts" desks; three general
service/management desks; conference room; public lounge; staff
lounge; vault; and restrooms. Two drive-up aisles are proposed
along the northeast side of the building; one served by the •
teller window under the roof overhand, the other served by a
drive-up kiosk. Each drive-up aisle is proposed to accommodate

approximately four cars waiting in tandem. The applicant
proposes to retain the four large oak trees . The primary
architectural element of the building design consists of
an approximately 20 foot roof overhang on the northeast; and
soutwest sides of the building with each overhang supported
by five 8 foot cement plaster columns, with an extended 4
foot soffit. Each overhang is pierced by four rectangular
openings in the roof to allow some light passage into the
building. Additional amenities proposed include tile entry-
ways from East Mall Avenue and Creek sides of the building,
a turf block exit onto East Mall from the drive-up teller
aisles, bike rack and extensive landscaping.
Circulation for the site consists of an ingress/egress drive-
way at the northerly corner of the property on East Mall, an
ingress/egress driveway on the .opposite side of the property
from the alleyway, an egress only driveway from the alleyway
serving both the parking lot and the drive-up teller aisles,
an an egress only onto East Mall Avenue.
• STAFF COMMENTS
A note appearing on the site plan indicates, the typical parking
stall to be 9 feet X 19 feet with a 2 foot overhang. The minimum
acceptable parking stall dimension as required in Chapter 22 . 86
of the Zoning Ordinance is 9 feet X 20 feet. Additionally, staff
suggests a 3 foot overhang, a suggestion easily met by simply
moving the curbing back one foot. Meeting the 9 foot X 20 foot
minimum stall requirement would reduce the turning radius within
the double aisle parking lot to 26 feet. Staff would find no ob-
jection to this. The alignment of the outer drive-up teller lane
in relation to the existing oak tree is undesirable and protection
of the tree is not maximized. It would appear that measures neces-
sary -to adequately protect this oak tree may involve some minor
fications to the parking layout. Staff also feels the setback
as proposed along El Camino Real is minimal and should be increase

1. The -site of the proposed savings and loan facility is adequate
in size and shape to accommodate said construction and all
yards, parking, landscaping and other features required by
the Atascadero Municipal Code.
• 2. Streets in the vicinity of the proposed use are adequate to
carry the quantity and kind of traffic generated.

3. The proposed use will have no adverse effect on abutting
property or the permitted use thereof.
4. The establishment and conduct of the savings and loan facili-
ty for which the Departmental Review is 'sought will not be
detrimental to the public welfare or be injurious to property
or improvements insaidneighborhood.
5. The project will not have a significant effect upon the environment.
RECOM14ENDAT I ON
The Planning Director recommends :
A) Issuance of a Conditional Negative Declaration as follows :
a. Site design and development shall minimize adverse effects
on the four existing mature oak trees and maximum effort
shall be made to preserve and protect the oaks .
b. Site design and development shall be in accordance with •
the "Atascadero Creekway Schematic Plan - Scheme I
Modification. "
B) That Departmental Review R801024:1 be approved subject to the
following conditions :
1. Site development including buildings, parking, landscaping
and other features shall be consistent with site plans
submitted including the following revisions which shall be
approved by the Planning Department:
a. Revise the site plan by adjusting planter widths and
turning radii in order to align the drive-through
island with the nearby existing oak tree to better
protect the tree and eliminate potential traffic
hazards .
b. Revise the site plan to increase the setback to approxi-
mately 10 feet along El Camino Real .
2 . Submit two copies of detailed landscaping and irrigation
plans indicating size, type and spacing of plant materials
proposed for review and approval by the Planning Depart-
ment prior to issuance of building permits.
a. Plant materials shall be sized to achieve a mature
appearance within three years.

b. The type of irrigation system shall depend upon the
plant materials used and the watering needs .
C. Provision shall be made for 6" raised concrete curb,
asphalt beams or similar to border planter areas
which abut parking areas .
3 . All existing oak trees shall be retained and adequate pro-
tection shall be provided during construction. Paving
materials that allow air and water movement to occur shall
be used within the driplines . No harmful herbicides shall
be used within the driplines . No black 6 mil . plastic
shall be increased in width with a corresponding reduction
in planter widths adjacent to the alley to minimize dis-
turbance within the driplines .
4 . Appropriate approval shall-be obtained for planting, bike
racks, etc. , shown on the easterly side of the building
from the property owner.
5. Lighting fixtures shall be designed to minimize on-site and
• off-site glare.
6 . All new utilities and utility connections shall be placed
underground.
7 . Submit two sets of grading and drainage plans indicating
grade of building pads, pavement elevations , flow lines
at top of curb, etc. for review and approval by the City
Public Works Department prior to issuance of building
permits .
a. Drainage from the site shall not be allowed to flow
drivectly across public sidewalks and driveways.
8 . Parking areas shall be provided as shown on site plans .
Parking and access areas shall be paved with a minimum
2" AC on adequate base and spaces shall be striped.
Wheel stops or approved functional equivalent shall be
provided.
a. The existing power pole shall be relocated.
b. Documentation shall be provided to the Planning
Department verifying the access rights to the alley-
way.
9 . The project shall be connected to community water and sewer
• systems. Submit evidence from the Atascadero Count; Sani-
tation District and Atascadero Mutual Water District indi-
cating that the agencies are willing and able to provide
service to the project prior to issuance of any permits.

10. Building architecture shall be consistent with elevations
submitted.
11. Any roof-mounted mechanical equipment shall be screened
from view from adjacent streets and properties in a manner
approved by the Planning Department.
12 . Provision shall be made for paved and enclosed trash storage
area in a location approved by the Planning Department.
13 . The existing temporary trailer and all related appurtanences
shall be removed from the premise in conjunction with the
occupancy of the new building.
14 . In the event that archeological resources are discovered on
the subject site during construction of this pro-ject, said
resources are to remain undisturbed after discovery and
construction activity shall cease immediately. The Planning
Department is to be notified so that proper disposition of
the resources may be accomplished. Construction may resume
only upon authorization by the Planning Department. .
15 . All conditions of approval established herein shall be •
complied with prior to occupancy.
16 . If the use authorized by any Departmental Review approval
is or has been unused, abandoned, discontinued and use has
not been established or has ceased for a period of twelve
(12) months, or the conditions have not been complied with,
said Departmental Review approval shall become null and
void and of no effect. The Planning Director may continue
the Departmental Review approval for additional periods of
six (6) months if, for reasons beyond the control of the
applicant, the use has not been established. A written
request to extend the date and sufficient evidence show-
ing the applicant' s inability to comply must be filed
with the Planning Department ten (10) days prior to the
expiration date of approval .
ACTION
The Planning Commission should by motion direct staff as deemed
appropriate.
