HomeMy WebLinkAboutResolution 2020-064RESOLUTION NO. 2020-064 IRESOLUTION OF THE CITY COUNCIL OF THE CITY OF ATASCADERO, CALIFORNIA, IDENTIFYING THE TERMS AND CONDITIONS, INCLUDING PORTAL-TO-PORTAL PAY FOR CITY PERSONNEL RESPONSE AWAY FROM THEIR OFFICIAL DUTY STATIONS AND ASSIGNED TO AN EMERGENCY INCIDENT WHEREAS, the City of Atascadero is a public agency located in the County of San Luis Obispo, State of California; and WHEREAS, it is the City of Atascadero's desire to provide fair and legal payment to all its employees for time worked; and WHEREAS, the City of Atascadero has in its employ full time City personnel that may be assigned by City management to respond to emergency incidents inside and outside the City limits; and WHEREAS, the City of Atascadero will compensate its employees portal-to-portal while in the course of their employment and away from their official duty station and assigned to an emergency incident, in support of an emergency incident, or pre -positioned for emergency response; and WHEREAS, City of Atascadero employees, while in the course of their employment and away from their official duty station and assigned to an emergency incident, in support of an emergency incident, or pre -positioned for emergency response, continue to be City employees and are not employees of any other agency or entity; and WHEREAS, the City of Atascadero will compensate its' non-exempt employees overtime in accordance with their current Memorandum of Understanding while in the course of their employment and away from their official duty station and assigned to an emergency incident, in support of an emergency incident, or pre -positioned for emergency response; and_ WHEREAS, the City of Atascadero will compensate its' exempt ei�oyees themregular straight time rate for hours worked over their normal work period heurs ingccordance ,%$a their current Memorandum of Understanding or Resolution while in the course o€their eV- loyuaht and away from their official duty station and assigned to an emergenp_y inci$ent, in supporFof an emergency incident, or pre -positioned for emergency response; and WHEREAS, exempt personnel are not subject to payment of abehi.me, ,tQ payments under this Resolution will not affect the exempt status of such positions; and - WHEREAS, the City Council has previously adopted Resolutions No. 2015-041 and 2015-042 and desires to supersede said Resolutions with this one Resolution; and WHEREAS, the City Council desires that this Resolution become effective as of July 1, 2020. City of Atascadero Resolution No. 2020-064 Page 2 of 2 NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of Atascadero: 1. Personnel shall be compensated according to Memorandum of Understanding (MOU), Resolution, Personnel System Rules and/or other directives that identify personnel compensation in the workplace. 2. In the event a personnel classification does not have an assigned compensation rate, a "Base Rate" as set forth in an organizational policy, administrative directive or similar document will compensate such personnel. 3. The Atascadero Fire Department and the Atascadero Police Department will maintain a current salary survey or acknowledgement of acceptance of the "base rate" on file with the California Governor's Office of Emergency Services, Fire Rescue Division. 4. Personnel will be compensated (portal—to-portal) beginning at the time of dispatch to the return to jurisdiction when equipment and personnel are away from their official duty station and assigned to an emergency incident, in support of an emergency incident, or pre - positioned for emergency response. PASSED AND ADOPTED at a regular meeting of the City Council held on the 8th day of September. 2020.
