HomeMy WebLinkAboutMinutes 022883MINUTES - ATASCADERO CITY COUNCIL Regular Meeting February 28, 1983 7:30 p.m. Atascadero Administration Building The meeting was called to order at 7:30 p.m. with the Pledge of Allegiance. Reverend John Cole of the Atascadero Bible Church gave the invocation. ROLL CALL ' Present: Councilmen Mackey, Molina, Stover, and Mayor Nelson Absent: Councilman Wilkins ' STAFF ' Present: Murray Warden, City Manager; Allen Grimes, City Attorney; Patsy Hester, Deputy City Clerk; Ralph Dowell, Finance Director; Mike Hicks, Fire Chief; Larry Stevens, Planning Director; Richard McHale, Police Chief; Larry McPherson, ' Public Works Director; and Skip Joannes, Recreation Director. PUBLIC COMMENTS 1. John Larsen requested Council to reconsider his request for ' a business license. The consensus of the Council was to reconsider the matter on March 14, 1983. 2. Arthur Armstrong presented information regarding International Day of Peace, which was declared on September 21, 1982. He also read a letter which was addressed to the Secretary-General of the United Nations. COUNCIL COMMENTS 1. Councilman Mackey stated that Spring Clean Sweep will be April 9-16, 1983, and asked that everyone be involved. She stated that there will be a meeting on March 17, 1983, 2:OO p.m., at the Historical Society. 2. Mayor Nelson stated that he had received correspondence regarding drainage problems at the intersection of San Andres and Navarette and on San Marcos Road. Larry McPherson stated that the problem of excessive buildup has been partially solved and a fully satisfactory solution requires property owner correction for proper drainage. 3. Mayor Nelson stated that a letter was received from the Chamber of Commerce regarding Hospitality Night on December 12, 1983. He stated that they were requesting Council to change MINUTES - ATASCADERO CITY COUNCIL - February 28, 1983 their meeting on that night so they could have the use of the Rotunda Room.. The matter will be brought up at the next Council meeting. 4. Councilman Molina commented that the Council is too indecisive due to lack of leadership. He stated that there need to be new ideas, positive thinking, and a change in leadership. MOTION: Councilman Molina moved fora vote of no -confidence against the City Manager. The motion was seconded by Mayor Nelson and defeated on the following roll call vote: AYES: Councilman Molina and Mayor Nelson NOES: Councilmen Mackey and Stover CONSENT CALENDAR 1. Minutes of the regular meeting of February 15 1983 (RECOMMEND APPROVAL) 2. Resolution No. 8-83 amending Deferred Compensation Plan (RECOMMEND ADOPTION) 3. Resolution No. 9-83 designating agent for Federal Disaster Assistance (RECOMMEND ADOPTION) 4. Resolution No. 10-83 accepting work and given notice of completion for the 1983 Overlay Project (RECOMMEND ADOPTION) 5. Tentative Parcel. Map AT 79-263, 7345 Encinal Avenue, Gordon Hilchey (Hilliard Surveys) to extend the time allowed to complete requirements for an approved tentative map (REC- OMMEND APPROVAL OF PLANNING COMMISSION RECOMMENDATION) 6. Acceptance of Parcel Map AT 79-263, 7345 Encinal Avenue, Gordon Hilchey (Hilliard Surveys) (RECOMMEND APPROVAL OF PLANNING COMMISSION RECOMMENDATION) Mayor Nelson reviewed the items on the Consent Calendar. MOTION: Councilman Stover moved to approve Items 1-6 of the Consent Calendar. The motion was seconded by Councilman Molina and unanimously carried. B. HEARINGS, APPEARANCES AND REPORTS 1. Draft Zoning Ordinance, Chapter Three MINUTES ATASCADERO CITY COUNCIL— February 28, 1983 LarryStevens reviewed the "no animal" Commercial Professional, , Industrial Park, Industrial, and Special Recreation Zones. Mr. ' Stevens requested that the hearing be continued to March 14, 1983, for the remainder of Chapter 3. Councilman Molina questioned the Limited Single Family Resi- dential Zone and asked to look at the criteria of the "no -animal zone. ' MOTION: Councilman Molina moved to direct the Planning Commission to look into animal zoning, specifically within the sewer district. The motion was seconded by Councilman Mackey and unanimously carried. MOTION: Councilman Mackey moved to continue the Chapter 3 draft ordinance to March 14, 1983. The motion was seconded by ' Councilman Stover and unanimously carried. 2. General Plan Amendment GP 821206:1, initiated by Planning Commission, to consider text amendments to the Open Space Element which would revise specific standards for creek setbacks ' Larry Stevens stated that the Planning Commission had recom- mended approval of a text amendment to the Open Space Element which would eliminate specific standards for creek setbacks. ' MOTION: Councilman Molina mored to approve the General Plan Amend- ment and directed Staff to prepare the appropriate ' resolution. The motion was seconded by Mayor Nelson and passed on the following roll call vote: AYES: Councilmen Molina, Stover, and Mayor Nelson NOES: Councilman Mackey ' Doug Lewis commented that the General Plan is not very specific and was concerned with the access to the Atascadero Creek. ' Grigger Jones, attorney for Mr. Haun, encouraged the adoption of the plan. 3. General Plan Amendment GP 820930:1 - Colima -E1 Camino Real Residential Study Area; area bounded by El Camino Real, San Benito, Colima and San Anselmo/3555 E1 Camino Real; Pentecostal Church of God (Cullen) Planning Commission; to ' change the land use designation from Suburban Single Family Residential to Moderate Density Single Family Residential -3- MINUTES - ATASCADERO CITY COUNCIL - February 28, 1983 Larry Stevens stated that the Planning Commission directed preparation of a resolution denying the General Plan Amendment to change the land use designation from Suburban Single Family Residential to Moderate Density Single Family Residential. Clayton Cullen, representing the Pentecostal Church of God, requested approval of the application. Bob Smith, also repre- senting the applicant, stated that the motion of the Planning Commission was not portrayed appropriately and requested consid- eration of these matters. Bill Graham favored the higher density. Walter Hare, Harry Russell, and Joe Wolders supported the Planning Commission's decision. MOTION: Councilman Molina moved to instruct Staff to prepare a resolution denying the General Plan Amendment. The motion was seconded by Councilman Mackey and unanimously carried. RECESS 9:20 p.m. RECONVENE 9:30 p.m. 4. City Attorney Report No. 23 Allen Grimes reviewed Report No. 23. The Council supported four cases which. Mr. Grimes presented as being of significance to cities by the League Legal Advocacy Committee. Doug Lewis asked if the Retirement System item in Mr. Grimes' report and the Deferred Compensation item on the Consent Calendar related. Mr. Warden stated that there was no relationship between the two items 5. Fire Department Quarterly Report Nike Hicks presented the Fire Department Quarterly Report. He stated that the present fire station location is serving very well. C. UNFINISHED BUSINESS 1. Ordinance No. 59 - Amapoa-Tecorida Area Development ' Standards - first reading Larry Stevens stated that a building moratorium had been maintained pending adoption of adequate development standards. He stated that the project has taken longer than anticipated. However, an ordinance has been prepared establishing standards which will eventually be incorporated into the new Zoning and Building Ordinance. Mr. Grimes stated that he approved of the ordinance. -4- MINUTES - ATASCADERO CITY COUNCIL February 28, 1983 Shirley Summers requested consideration of an assessment district and lifting of the moratorium. Glen Lewis, Grigger Jones, Tom Ezell, Mike Dorrell, and Frank Welsh encouraged an assessmentdistrict. Gary Kirkland and Ralph Belchi opposed the ordinance without an assessment district to solve the problems. By Council consensus, the assessment district process will be discussed at the next Council meeting. MOTION: Councilman Mackey moved to read Ordinance No. 59 by title only. The motion was seconded by Councilman Stover and unanimously carried. Mayor Nelson read Ordinance No. 59 by title only. MOTION: Councilman Molina moved to constitute this as the first reading. The motion was seconded by Councilman Stover and unanimously carried by roll call vote. 2. Volunteer Coordinating Committee Mayor Nelson Mayor Nelson requested a Volunteer Coordinating Committee. Council agreed that Mayor Nelson pursue the matter. 3. Community Development Block Grant Nonentitlement Program Larry Stevens stated that some possible projects discussed for CDBG grant were flood improvements at Amapoa-Tecorida, housing rehabilitation_, and sewer line extentions. He indicated the basic objectives of the Federal legislation are to benefit low and moder- ate income families, aid in the prevention or elimination of slum and/or blight, or meet other community development needs having a particular urgency. Doug Lewis suggested additional funding possibilities as bus stop seat and shelter, acquisition of creek property, acoustical modification of the Rotunda Room, and energy conservation. By Council consensus, Staff was requested to prepare an appli- cation for hearing on March 14, 1983. D. NEW BUSINESS 1. Selection of consultant - Construction documents - South Atascadero Park and Alvord Field -5- 0 MINUTES - ATASCADERO CITY COUNCIL - February 28, 1983 Larry McPherson stated that in an effort to complete construc- tion and renovation of South Atascadero Park and Alvord Field, he recommended Council accept the proposal submitted by Dennis Bethel and Associates of Santa Maria. Dennis Bethel stated he has had experience with similar projects and assured the Council he can handle this project. MOTION: Councilman Mackey moved to approve the proposal as submitted by Dennis Bethel and Associates, with Alvord Field being the priority. The motion was seconded by Councilman Molina and unanimously carried. 2. Priority list - Mayor Nelson Mayor Nelson requested ideas for priorities. Councilman Molina suggested bringing zoning in conformance with the General.Plan, permanent police facilities, city-wide road improvement, second fire station, expansion of sewer situation, and recreational parks. Councilman Mackey suggested drainage. Mayor Nelson suggested fee structure, county and property taxes, and improve the building permit process for residential and businesses. 3. Preliminary information on Atascadero-SLO bus test Mr. Warden stated that there are 13 people currently riding the bus and that at present Staff is not convinced that this ridership constitutes implementing a similar system on -a full-time basis. Staff will return with a final recommendation in March or April. E. ATASCADERO COUNTY SANITATION DISTRICT` None F. INDIVIDUAL DETERMINATION_AND/OR ACTION 1. City Council a. Councilman Molina expressed concern that all areas desig- nated for High Density Single Family Residential use by the General Plan are outside the sewer district. He felt that higher densities should be allowed inside the sewer district. Mr. Stevens MINUTES - ATASCADERO CITY COUNCIL - February 28, 19$3 responded that these existing high density were probably designated as such due to their existing lot size. The Planning Director also pointed out that any major review of density policies should be done as part of a complete update of the Land Use Element. ' b. Mayos Nelson requested the 4th of July Committee, police location, Larsen reconsideration, and assessment district be on the next agenda. It was decided that the establishment of a priority list would be discussed also. ' 2. City Attorney Nothing 3. City Clerk Nothing 4. City Treasurer Nothing 5. City Manager a. Mr. Warden stated that the mobilehome park negotiations are still underway and he will come back with more information as it becomes available. b. Mr. Warden stated that there has been no reply from school authorities regarding the request for police attendance at school functions. c. Mr. Warden stated that the CPI will be distributed when it is finished. d. Mr. Warden: requested names for the vacancy of the Citizens Transportation Advisory Committee. Council will submit names. e. Mr. Warden requested a closed session for personnel matters. The meeting adjourned to closed session at 11:00 p.m. and returned to regular session at 11:55 p.m., at which time the Council adjourned.
