City Council Draft Action Minutes – November 12, 2019  Recommendation: Council approve the November 12, 2019 Draft City Council Meeting Minutes. [City Clerk] 2. October 2019 Accounts Payable and Payroll  Fiscal Impact: $2,646,520.00  Recommendation: Council approve certified City accounts payable, payroll and payroll vendor checks for October 2019. [Administrative Services] 3. September 2019 Investment Report  Fiscal Impact: None  Recommendation: Council receive and file the City Treasurer’s report for quarter ending September 30, 2019. [Administrative Services] 4. Micro Community Project - Grand Oaks Paseo Residential Development (DEV19-0049)  Fiscal Impact: If the project is approved for processing, it shall be required to be annexed into the existing CFD so the added residential units fund impacts to City police, fire, and parks services.  Recommendation: Council adopt on second reading, by title only, Draft Ordinance approving Title 9 Zone Text Amendments to the Planned Development Overlay Zone No. 27 (PD-27), based on findings. Final Map 2947 (8391 Amapoa Avenue) O’Connor  Fiscal Impact: None.  Recommendations: Council: 1. Approve Final Map 2947. 2. Reject, the offers of dedication for public utility easement and for street widening, drainage, and public access purposes without prejudice to future acceptance on behalf of the public. Council Policy Adoption – Drive-Through Businesses and Fuel Stations and Other High Traffic Producing Uses  Fiscal Impact: Adoption of the Council Policy will limit or curtail future development of drive-through businesses, fuel stations, and other high traffic producing uses in the City. Utilization of the existing “Alternative Cost Per Single Trip Method” may increase fees that the City may charge for development of drive-through businesses, fuel stations, and other high traffic producing uses and help the City appropriately mitigate traffic impacts which will reduce potential fiscal impacts.  Recommendation: Council adopt Draft Resolution establishing a Drive- Through Businesses, Fuel Stations, and Other High Traffic Producing Uses Policy to guide development review of drive-through businesses, fuel stations, and other high traffic producing uses applications and ensure orderly development in the City. Page 4 of 55 City of Atascadero WELCOME TO THE ATASCADERO CITY COUNCIL MEETING The City Council meets in regular session on the second and fourth Tuesday of each month at 6:00 p.m. Council meetings will be held at the City Hall Council Chambers, 6500 Palma Avenue, Atascadero. Matters are considered by the Council in the order of the printed Agenda. Regular Council meetings are televised live, audio recorded and videotaped for future playback. Charter Communication customers may view the meetings on Charter Cable Channel 20 or via the City’s website at www.atascadero.org. Meetings are also broadcast on radio station KPRL AM 1230. A. CONSENT CALENDAR: 1. City Council Draft Action Minutes – October 22, 2019  Recommendation: Council approve the October 22, 2019 Draft City Council Meeting Minutes. [City Clerk] 2. Network Switch Replacement Project  Fiscal Impact: $118,820.00  Recommendations: Council: 1. Authorize the City Manager to execute a contract with Helixstorm for a total of $110,779.38 for the purchase of network switching infrastructure, licensing, and implementation and configuration services. 2. Council authorize the Administrative Service Director to appropriate $49,820 from the Technology Fund. [Technology] 3. Zoo Garden Event Center Construction Award  Fiscal Impact: $630,000.00  Recommendations: Council: 1. Award a construction contract for $630,000 to Newton Construction & Management, Inc. for the Zoo Garden Event Center (City Project No. C2016M01). 2. Authorize the City Manager to execute a contract with Newton Construction & Management, Inc. in the amount of $630,000 for the construction of the Zoo Garden Event Center project. 3. Authorize the Director of Administrative Services to appropriate an additional $167,240 in Public Facilities Fees Fund balance for FY19/20 toward the Zoo Garden Event Center project. Housing Element and Inclusionary Housing Ordinance Contract  Fiscal Impact: None.  Recommendations: Council: 1. Authorize the City Manager to execute a contract for $94,000 with MIG to provide planning consultant services for the preparation of the 6th cycle General Plan Housing Element update and Inclusionary Housing Ordinance. 2. Authorize the Administrative Services Director to budget an additional $25,000 in SB 2 grant funds and to appropriate an additional $25,000 in grant funds for the Development of Housing Element and Inclusionary Housing Policy. Motion passed 5:0 by a roll-call vote. C. MANAGEMENT REPORTS: 1. Voter Opinion Survey on Feasibility of Potential Future Tax Ballot Measure  Fiscal Impact: Approving staff recommendations will result in an appropriation of $25,000 in General Fund reserves toward the City Manager budget for professional services.  Recommendation: Council authorize the Administrative Services Director to appropriate $25,000 in General Fund Reserves for consulting services with True North Research to conduct a voter opinion survey on the feasibility o f a potential future tax ballot measure. [City Manager] City Manager Rickard gave the staff report and answered questions from the Council. Animal Shelter Services Agreement – Amendment to the Current Animal Services Memorandum of Agreement  Fiscal Impact: The proposed changes to the Agreement will increase costs for the City of Atascadero animal shelter to approximately $166,000 annually.  Recommendation: Council authorize the City Manager to execute Amendment No. 2 to the Agreement for Allocation of Construction and Financing Costs for an Animal Services Shelter. DISCUSSION: On November 12, 2019, the City Council conducted a public hearing to consider approval of a mixed-use planned development at an existing vacant parcel. The Grand Oaks Paseo micro community project consists of a new mixed-use, residential and commercial project on the site of a previously approved mixed-use project. This new development proposal includes an amendment to the previously established Planned Development No. 27, a new Master Plan of Development, and Vesting Tentative Tract Map. The project includes a state density bonus request and is proposing three deed restricted moderate-income units. In addition, an exception to Title 11 of the Municipal Code is proposed to accommodate the small lot subdivision. A total of 30 residential units are proposed in the project, 26 of which will be on individual lots and 4 of them will be above commercial spaces close to El Camino Real. The previous project approval on this site included 40 attached units. At the November 12, 2019 meeting, the Council voted 5-0 to approve the project as conditioned. FISCAL IMPACT: Based on findings from the 2003 Taussig Study, revenue from new residential development including property tax revenues, vehicle licensing fees, sales taxes, and other revenues are insufficient to cover the maintenance and emergency services costs of new development. Based on the revenue projections from the Taussig Study, the City has developed standard conditions of approval for new development projects that require the cost of maintenance and emergency services to be funded by the project through annexation into the existing Page 34 of 55 ITEM NUMBER: A-4 DATE: 11/26/19 community facilities district (CFD). FACT: The PD-27 established development standards that promote a cohesive neighborhood development and ensure that City goals related to traffic mitigation, aesthetic character, inclusionary housing, and pedestrian connectivity, among others, are achieved. Minor modifications to the PD-27 zone text are currently proposed. FACT: The Planned Development 27 overlay text modifies standard development requirements to allow for a mixed-use residential and commercial project. Modified standards for the development enable the unit count and site design as proposed by the applicant. FINDING: Benefits derived from the Planned Development Overlay Zone cannot be reasonably achieved through existing development standards or processing requirements. FACT: The Planned Development Overlay Zone 27 ensures that development within the area provide certain benefit as identified by Council Policy. Development under the PD-27 standards will maintain and enhance neighborhood character and provide transition between commercial and single-family uses. FINDING: Proposed plans offer certain redeeming features to compensate for requested modifications of the Planned Development Overlay Zone. FACT: City Council Planned Development Policy requires project benefits such as affordable inclusionary housing, pocket parks, and high quality landscape and architecture in exchange for modified development standards. As conditioned, the project satisfies these requirements. SECTION 3. Approval. The City Council of the City of Atascadero, in a regular session assembled on November 12, 2019, resolved to introduce for first reading by title only, an Ordinance that will modify PD-27 zoning text consistent with the following: 9-3.672 Establishment of Planned Development Overlay Zone No. 27: (PD-27). Planned Development Overlay Zone No. 27 is established as shown on the Official Zoning Maps (Section 9-1.102). A Planned Development Overlay Zone No. 27 is established on parcel APN 029-271-001 with a combined gross acreage of 1.71 acres. The maximum residential density within the planned development shall not exceed thirty (30) residential units. The development standards contained within the master plan of development document, as conditioned, shall be applied to all future development within the project area, and as follows: (a) All site development shall require the approval of a master plan of development. All construction and development shall conform to the approved master plan of development, as conditioned. (b) The Vesting Tentative Tract Map (TR 3141) and any subsequent amendments for the site shall be consistent with the approved master plan of development. All construction and development shall conform to the approved master plan of development, as conditioned. (c) No subsequent tentative parcel or tract map shall be approved unless found to be consistent with the approved master plan of development. (d) The commercial area, residential dwelling units, landscaping, walls and fencing shall be subject to review under the City’s Appearance Review requirements consistent with the approved master plan of development. (e) Building setbacks, lot sizes, landscape area, and lot coverage shall be as identified within the approved master plan of development. (l) All trees shown to be protected on the approved master plan of development shall be maintained. Any future tree removal shall require approval per the requirements set forth in the Atascadero Native Tree Ordinance. SECTION 4. CEQA. The project was determined to be consistent with previously certified Mitigated Negative Declaration 2005-0063. SECTION 5. Interpretation. This Ordinance must be broadly construed in order to achieve the purposes stated in this Ordinance. It is the City Council’s intent that the provisions of this Ordinance be interpreted or implemented by the City and others in a manner that facilitates the purposes set forth in this Ordinance. DISCUSSION: Background On September 24, 2019, the City Council discussed the impacts of vehicle oriented, drive- through business and the existing municipal code sections that regulate these business. Council directed staff to draft a Council Policy to guide future development of high traffic volume businesses in the City. Analysis The issues identified during discussion at the September 24, 2019 Council meeting were community character, aesthetics, and environmental concerns, particularly traffic impacts. Recent studies have shown that new fast casual restaurants, that serve a higher quality product, may increase queuing time for drive-through businesses and potentially increase transportation and air quality impacts as a result of increased queuing. In the City of Atascadero, there are three types of drive-through businesses: food/coffee service, banks, and pharmacies. There are also fuel stations and uses such as car washes, which have a similar significant traffic volume. The fuel services and food service uses, which are the most common type of drive-through businesses in the City, typically generate the highest traffic volumes, while banks and pharmacies often have longer wait times. The higher traffic volume associated with drive-through businesses and fuel stations has a significant impact on the functionality of nearby intersections. This could potentially reduce the opportunity for other commercial business to expand or develop in the City as these intersections near capacity. This could reduce the amount of floor area that can be dedicated to job or revenue producing commercial uses that may otherwise be located in a commercial node near a highway intersection such as Del Rio Road or San Anselmo Road. Page 47 of 55 ITEM NUMBER: DATE: C-1 11/26/19 As drive-through businesses continue to increase in popularity and traffic volume, City policies need to continue to respond. Such businesses must be appropriately reviewed to ensure that use permit findings are clearly made and that impacts are clearly addressed with appropriate conditions, especially through the use of traffic impact fees. At this time, the Council has decided not to implement a moratorium on drive-through business. A City Council Policy, however, will help guide staff and the Planning Commission towards the appropriate review of and mitigation measures for these types of businesses and their impacts. The Highway 101 overpass area and intersection of El Camino Real and San Anselmo Road is nearing traffic capacity, and the Del Rio Road overpass and intersection at El Camino Real is anticipated to reach capacity if commercial uses are developed as anticipated in the Specific Plan. The area around these two roads is also important as it heavily impacts the traffic in these two areas. In order to ensure that these important commercial nodes can continue to develop consistent with the General Plan, traffic intensive uses such as drive-through restaurants and fuel stations must be carefully reviewed and limited in scope, especially within this corridor. The three objectives of the Council Policy are:  Implement the City’s existing “Alternative Cost Per Single Trip Method” for calculating impact fees. This method will allow the City to appropriately mitigate circulation impacts of commercial uses that generate high traffic counts , including drive-through businesses.  Utilize the City’s discretionary conditional use permit and design review processes to responsibly restrict drive-through businesses in the areas near and between Del Rio Road and San Anselmo Road based on potential traffic impacts and the impacts on the goals and orderly development of commercial nodes in the corridor. This area has been identified as a commercial node along the El Camino corridor that features office park, mixed-use, commercial tourist, and experience retail uses. Drive-through businesses, fuel stations, and other high traffic producing uses are considered incompatible with future corridor goals and will reduce the ability of other retail, lodging, or job producing land uses to locate there.  In order to approve a high traffic volume use within the area outlined in Exhibit A, the new use must not: a. Generate a volume of traffic beyond the safe capacity of all roads providing access to the project, either existing or to be improved in conjunction with the project. b. Generate a volume of traffic beyond the normal traffic volume of the surrounding neighborhood that would result from full, cumulative development in accordance with the land use element and Del Rio Specific Plan. c. Generate a traffic volume that would be contrary to the anticipated orderly development of the area. Additionally, all other findings necessary for approval of a conditional use permit will be carefully analyzed in light of the Council’s goals of preserving community character and aesthetics, future development of high-quality commercial nodes, and Page 48 of 55 ITEM NUMBER: DATE: C-1 11/26/19 environmental concerns. Since both the San Anselmo and Del Rio Road overpasses and intersections at Highway 101 and El Camino Real are approaching capacity based on anticipated development, new drive through land uses are not likely to meet findings. FISCAL IMPACT: Adoption of the Council Policy will limit or curtail future development of drive-through businesses, fuel stations, and other high traffic producing uses in the City. Utilization of the existing “Alternative Cost Per Single Trip Method” may increase fees that the City may charge for development of drive-through businesses, fuel stations, and other high traffic producing uses and help the City appropriately mitigate traffic impacts which will reduce potential fiscal impacts. NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of Atascadero: SECTION 1. Recitals. The above recitals are true and correct. SECTION 2. CEQA. The proposed text amendments are exempt per section 15061(b)(3) in accordance with the California Environmental Quality Act (CEQA) because the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on th e environment, the activity is not subject to CEQA; and, SECTION 3. The City Council has noted that certain businesses are characterized by significant traffic volumes. These include but are not limited to drive-through restaurants, fuel stations, car washes and coffee shops. The City Council identified issues posed by the approval of these high traffic volume businesses in the City including the preservation of community character and aesthetics and environmental concerns, particularly traffic impacts. In discussing a policy, the City Council determined that consistent application of the City’s existing Alternative Cost per Single Trip Method for the calculation of circulation impact fees will allow the City to appropriately mitigate for circulation impacts of commercial uses that generate high traffic counts, including drive-through businesses and fuel stations. It is the intent of the Council to guide the development of the El Camino Real corridor, near and between San Anselmo Road and Del Rio Road, and the adopted Del Rio Specific Plan area into high-quality commercial nodes that feature office parks, mixed- use, commercial tourist, and experience retail uses. The higher traffic volume associated with drive-through and fuel station business may potentially reduce the opportunity for other commercial business to expand or develop in the City because the traffic generated by these uses tends to significantly impact intersections especially in a commercial node. This means that additional high traffic volume businesses may be contrary to the orderly development of the area. Drive-through and fuel station businesses are considered incompatible with future corridor goals and will reduce the ability of other retail, lodging, or job producing land uses to locate there due to potential traffic impacts. Council recognizes that the overpass area and intersection of El Camino Real and San Anselmo Road is nearing traffic capacity, and the Del Rio Road overpass and intersection at El Camino Real is anticipated to reach capacity if commercial uses are developed as anticipated in the Specific Plan. The El Camino Real corridor between these two roads is also impacted and the areas near these two Highway 101 overpasses also contribute to the impact of these areas. Since these areas are approaching capacity based on anticipated development, new drive-through land uses are unlikely to be permitted due to traffic impacts. When calculating Circulation Impact fees, staff will utilize the City of Atascadero’s existing “Alternative Cost Per Single Trip Method” for drive-through business applications including fuel stations, car washes, restaurants and coffee shops, in order to account for the higher than average vehicle trips. 2. Utilize the City’s discretionary conditional use permit and design review processes to responsibly restrict new drive-through businesses, including drive-through food and beverage services, drive-through banks, drive-through pharmacies, fuel stations, car washes, and similar land uses that contribute to vehicle trips within the area outlined in Exhibit A. 3. In order to approve a high traffic volume use within the area outlined in Exhibit A, the new use must not: a. Generate a volume of traffic beyond the safe capacity of all roads providing access to the project, either existing or to be improved in conjunction with the project. b. Generate a volume of traffic beyond the normal traffic volume of the surrounding neighborhood that would result from full, cumulative development in accordance with the land use element and Del Rio Specific Plan. c. Generate a traffic volume that would be contrary to the anticipated orderly development of the area.
