Resolution No. 36-81 requesting the County Board of Supervi- sors to consolidate a City of Atascadero general municipal election to be held on June 8, 1982 with the direct primary election 1 2. Resolution No. 37-81 supporting the application requesting the State of California to designate the Atascadero Adminis- tration and Veteran's Memorial Building as a California State ' Historical Landmark 3. General Plan Conformity Report, Graves Creek Reservation No. 7 (off of Santa Lucia) , Twin Cities Engineering, to consider an offer of fee dedication and its conformity with the Gener- al Plan for approximately nine acres of land within Graves Creek 4. City Manager 2 MINUTES - ATASCADERO CITY COUNCIL Regular Meeting ' December 14, 1981 7:30 p.m. Atascadero Administration Building The meeting was called to order at 7: 30 p.m. by Mayor Wilkins. Councilman Mackey gave the invocation. ROLL CALL PRESENT: Councilmen Mackey, Nelson, Stover and Mayor Wilkins ABSENT: Councilman Highland rPUBLIC COMMENT 1. George Molina asked Council to support a referendum petition protesting the adoption of the redistricting ordinance pro- posed by the Board of Supervisors. Council members discussed this matter; Councilman Mackey stated that she could not endorse Mr. Molina's proposal because she supports the currentredistrictingplan. MOTION: Councilman Nelson moved that Council go on record supporting the concept that the redistricting issue should come before the people for a vote. The motion was seconded by Councilman Stover and carried with Councilman Mackey voting no. Mr . Warden asked if Council wanted this action forwarded to the Board of Supervisors and Council said that they did. A. CONSENT CALENDAR ' 1. MOTION: Councilman Stover moved for the approval of the Consent Cal- endar . The motion was seconded by Councilman Mackey and unanimously carried by roll call vote. B. HEARINGS, APPEARANCES AND REPORTS 1. Police Department quarterly departmental report Bud McHale, Police Chief, compared selected police statistics for burglary, theft, collisions, etc. , for 1981 with the same period in 1980. He also reviewed Departmental involvement in various programs such as the County Youth Services Task Force and the County Narcotics ' Task Force. He reported on the status of the reserve officer program. 2. Report concerning San Luis Obispo County Area Council of Gov- ernments agenda Larry McPherson, Public Works Director, reviewed the agenda for the Area Council meeting to be held Thursday, December 17th. There was discussion regarding the process whereby cities are to receive the agenda two weeks prior to a Council meeting so as to allow City Coun- cils an opportunity to instruct their voting delegate to the Area Council on the City' s concerns. Councilman Nelson requested that he receive a copy of the agenda before Council discussion; he felt uncom- fortable voting on something after a verbal report without having studied the matter. ' Council agreed that Councilman Stover should vote in accordance with the recommendations from Staff. 3. City Attorney's Report No. 16 Mr. Grimes asked Council if they had any questions regarding his report. Councilman Nelson asked what the holdup was with regard to the request for abandonment of appeal from the attorney for the Fire- fighters Association. Mr. Grimes stated that his calls to the Asso- ciation's attorney have not been answered; he doesn't know what the holdup is. Mike Hicks, Fire Chief, stated that he had checked with the Association and they are looking into the matter. 2 MINUTES - ATASCADERAITY COUNCIL- DECEMBER 14 , 981 C. UNFINISHED BUSINESS ' 1. Ordinance No. 45 setting the general municipal election date' on the same day as the statewide direct primary election; the first Tuesday after the first Monday in June of even numbered years - second reading MOTION: Councilman Nelson moved that Ordinance No. 45 be read by title only. The motion was seconded by Councilman Stover and unanimously carried. Mayor Wilkins read Ordinance No. 45 by title only. ' MOTION: Councilman Stover moved that this constitute the second read- ing of Ordinance No. 45 and that it be adopted. The motion ' was seconded by Councilman Nelson and unanimously carried by roll call vote. Mr. Warden advised Council that this ordinance is not operative until it has been approved by the Board of Supervisors. 2. Ordinance No. 46 repealing designated provisions of the Atas cadero Municipal Code - second reading MOTION: Councilman Stover moved that Ordinance No. 46 be read by title only. The motion was seconded by Councilman Nelson and unanimously carried. Mayor Wilkins read Ordinance No. 46 by title only: MOTION: Councilman Stover moved that this constitute the second read- ing of Ordinance No. 46 and that it be adopted. The motion ' was seconded by Councilman Mackey and unanimously carriedby roll call vote. 3. Confirmation of appointment of Michael Hicks as Fire Chief Mr . Warden stated that the Council needs to, by motion, confirm the appointment of Michael Hicks as Fire Chief. ' MOTION: Councilman Macke moved that Michael Hicks be appointed Fire Y PP Chief at a salary of $2,802. 56 monthly with all existing ben- efits and obligations. The motion was seconded by Councilman Nelson and carried on the following roll call vote: AYES: Councilman Mackey, Nelson and Mayor Wilkins NOES: Councilman Stover Councilman Stover read a statement regarding the process the City used to select a Fire Chief. He stated that certain requirements set forth in the job announcement were not met; the City should not tailor its requirements to fit local applicants, but should always attempt to secure the best qualified person for the job. He stated that his re- marks were not directed at the abilities of the new Chief, but only to 3 MINUTES - ATASCADERAITY COUNCIL - DECEMBER 144, C81 indicate his concern that the City not depart from the policy of hir- ing the best possible personnel. He had voted no on the appointment for these reasons, however, he will do all he can to support the new Chief. D. NEW BUSINESS 1. Resolution No. 36-81 requesting the County Board of Supervi- sors to consolidate a City of Atascadero general municipal election to be held on June 8, 1982 with the direct primary election MOTION: Councilman Stover moved that Resolution No. 36-81 be read by title only. The motion was seconded by Councilman Mackey and unanimously carried. tMayor Wilkins read Resolution No. 36-81 by title only. MOTION: Councilman Stover moved for the adoption of Resolution No. ' 36-81. The motion was seconded by Councilman Mackey and unanimously carried by roll call vote. 2. Resolution No. 37-81 supporting the application requesting the State of California to designate the Atascadero Adminis- tration and Veteran' s Memorial Building as a California State Historical Landmark Mr . Warden stated that the Historical Society was making applica- tion for this designation and it was necessary for them to receive the approval of the City as property owner . MOTION: Councilman Stover moved that Resolution No. 37-81 be read by ' title only. The motion was seconded by Councilman Mackey and unanimously carried. Mayor Wilkins read Resolution No. 37-81 by title only. MOTION: Councilman Mackey moved for the adoption of Resolution No. 37-81. The motion was seconded by Councilman Stover and unanimously carried by roll call vote. 3. General Plan Conformity Report, Graves Creek Reservation No. 7 (off of Santa Lucia) , Twin Cities Engineering, to consider an offer of fee dedication and its conformity with the Gener- al Plan for approximately nine acres of land within Graves Creek Mr . Warden stated that a portion of Graves Creek has been offered by the property owner for transfer of ownership to the City. The Planning Commission has found this to be in conformance with the Gen- eral Plan and recommends acceptance. 1 4 MINUTES - ATASCADERAITY COUNCIL - DECEMBER 14981 MOTION: Councilman Nelson moved that Council concur with the Planning Commission' s recommendation and request Staff to provide the legal documents to process the offer . The motion was second- ed by Councilman Mackey and unanimously carried. ' 4. Ordinance No. 47 establishing requirements in accordance with the National Flood Insurance Act of 1968 - first reading Mr. Warden explained the the ordinance was an interim measure only until the City' s zoning ordinance is adopted. MOTION: Councilman Stover moved that Ordinance No. 47 be read by ' title only. The motion was seconded by Councilman Nelson and unanimously carried. Mayor Wilkins read Ordinance No. 47 by title only. 11 MOTION: Councilman Nelson moved that this constitute the first read- ing of Ordinance No. 47. The motion was seconded by Council- man Mackey and unanimously carried by roll call vote. 5. Consideration of Amendment No. 2 to Joint Powers Agreement, North Coastal Transit Mr . Warden stated that approval of this document would allow the City to enter into a demonstration bus system between Atascadero and San Luis Obispo. If, at the end of the demonstration, it does not appear that the San Luis Obispo/Atascadero transit system is satis- fying a reasonable unmet transporation need, then the project could be terminated. Councilman Nelson was not in favor of the project; he felt that once the demonstration project is approved, the City would be commit- ted to supporting the San Luis Obispo/Atascadero route. MOTION: Councilman Mackey moved for approval of the amendment. The motion was seconded by Councilman Stover and carried with Councilman Nelson voting no. 6. Consideration of Jaycees' par course project Mr . Warden stated that the Jaycees' have requested permission to construct a par course around Atascadero Lake. Staff was recommending 1- approval on the conditions that the Jaycees use metal signs and submit a schedule and construction plan to the Public Works Director . Councilman Nelson stated that the Parks and Recreation Advisory Board was requesting that the Jaycees postpone their project for a short while so that the Board can consider a master plan for the Atas- cadero Lake area; probably only until mid-January. MOTION: Councilman Nelson moved that Council approve the par course in concept subject to the approval of a Lake Park master plan by the Advisory Board and Council. The motion was seconded by Councilman Stover and unanimously carried. 5
