Christensen Deputy City Manager / City Clerk APPROVED: Page 5 of 13 ITEM NUMBER: SA C-1 DATE: 09/10/19 Successor Agency to the Community Redevelopment Agency of Atascadero Staff Report – Administrative Services Amendment of Recognized Obligation Payment Schedule 19-20 January 1, 2020 - June 30, 2020 RECOMMENDATION: Successor Agency Board approve the Amended Draft Recognized Obligation Payment Schedule (ROPS) for the period of January 1, 2020, through June 30, 2020 (ROPS 19-20) pursuant to Health and Safety Code. DISCUSSION: The Successor Agency to the Community Redevelopment Agency of Atascadero and the Countywide Oversight Board both approved the Recognized Obligation Payment Schedule (ROPS) for the period of July 1, 2019 through June 30, 2020 (ROPS 19 -20). The ROPS 19-20 was approved by the State Department of Finance (DOF) on April 15, 2019, with some adjustments. The Successor Agency included a Prior Period Adjustment of $97,022 on the ROPS 19 - 20 on Line #1 under “Reserve Balance”, this amount was mistakenly not inclu ded on the 19-20 ROPS Cash Balance worksheet on Line #5. Therefore, when approving the ROPS 19-20, the DOF reduced the Redevelopment Property Tax Trust Fund (RPTTF) amount by ($94,295), assuming that the amount had not yet been subtracted from the requested RPTTF. However, since the Reserve Balance of $97,022 was already accounted for as a reduction in the requested RPTTF in the ROPS 19-20 worksheet, the DOF’s negative adjustment of $94,295 results in an amount of RPTTF that is less than the Successor Agency needs to fulfil its Bond Covenants. Discussions with DOF to correct the oversight and reverse the negative adjustment, without having to amend the ROPS, have been unsuccessful. The Successor Agency is therefore requesting an increase to RPTTF in the amount of $97,022 in order to have sufficient reserves to use toward 2010 Bonds debt service payments. Page 6 of 13 ITEM NUMBER: SA C-1 DATE: 09/10/19 Additionally, the Agency is requesting $30,000 to meet reserve requirements for t he 2004 Bonds. The Agency has two reserve requirements to meet, both of which fluctuate based on variations in the debt service payments, amounts required for reserves and the interest rate. The additional amount of RPTTF requested would cover the expected variation in the bond reserve requirement. Pursuance to Health and Safety Code (HSC) section 34177 (o) (1) (E), once per ROPS period, the agency may submit one amendment to the annual ROPS approved by DOF for the second half of the ROPS period (January 1, 2020 through June 30, 2020). Once approved by the Successor Agency Board, the ROPS 19-20 will be submitted for approval to the Countywide Oversight Board at their regular meeting on September 19, 2019. The Oversight Board must make a finding that the revision is necessary for payment of approved enforceable obligations during the second half of the ROPS period. Once approved by the Countywide Oversight Board, it will be submitted to the County Auditor-Controller, the State Controller, and the DOF. This Amended ROPS is due to the DOF by October 1, 2019. The DOF will make a determination at least 15 days before the date of the property tax distribution to the agencies. FISCAL IMPACT: None for this action. The purpose of approving the Amended Draft Recognized Obligation Schedules is to ensure that the City acting as Successor Agency will be able to make certain payments for obligations of the former RDA.
