AMENDMENT NO.1
TO THE AGREEMENT FOR 2016 CDBG GRANT FUNDS BETWEEN THE
COUNTY OF SAN LUIS OBISPO AND THE CITY OF ATASCADERO

THIS AMENDMENT NO. 1 is made and entered into this I day of
` < e /'A tai- ' 2018, by and between the County of San Luis Obispo, a
political subdivision of the State of California, hereinafter called "Recipient," and the
City of Atascadero, a municipal corporation of the State of California, hereinafter
referred to as "Subrecipient," jointly referred to as "Parties."
WITNESSETH:
WHEREAS, on July 15, 2014, the Recipient and the Subrecipient entered into a
Cooperative Agreement (herein the "Cooperative Agreement") to implement the Housing
and Community Development Act of 1974, herein called the "Act". Said Act is omnibus
legislation relating to federal involvement in a wide range of housing and community
development activities and is administered by the federal Department of Housing and
Urban Development (herein "HUD"); and
WHEREAS, on April 12, 2016, the San Luis Obispo County Board of
Supervisors approved the County of San Luis Obispo Program Year 2016 Action Plan of
the Consolidated Plan and approved grant agreement number B -16 -UC -06-0508 and
projected use of funds pursuant to applicable federal regulations (24 C.F.R. Part 570)
(hereinafter referred to as the "2016 Action Plan"); and
WHEREAS, on April 12, 2016, the San Luis Obispo County Board of
Supervisors approved funding in the amount of $104,883 from the County's 2016
Community Development Block Grant (hereinafter referred to as "CDBG") Program
(CFDA #14.218) for the Subrecipient to implement the "Atascadero Mall Sidewalk Infill
and Pedestrian Crosswalk Improvement Project," hereinafter referred to as the "Project;'
and
WHEREAS, the Federal Award date identified in the Grant Agreement for the
2016 CDBG funds is September 6, 2016; and
WHEREAS, $54,755 in 2014 and $40,000 in 2015 CDBG funds were previously
approved for the Project; and
WHEREAS, $70,361 in 2017 CDBG funds were approved for the Project but not
contractually committed to the Subrecipient; and
WHEREAS, a total of $269,999 in CDBG funds have been allocated to the
Project; and
WHEREAS, on September 8, 2017, the Recipient and the Subrecipient executed
a Subrecipient Agreement, hereinafter referred to as "Agreement," detailing the Parties'
responsibilities concerning the use of the CDBG funds; and
WHEREAS, during the term of the Agreement the Subrecipient performed
according to the Agreement and completed the Project and expended $178,866.73 in
CDBG funds; and
WHEREAS, the Agreement between the Recipient and the Subrecipient expired
on April 30, 2018; and
WHEREAS, the Agreement expired with a balance of $20,771.27 remaining; and
WHEREAS, the Parties desire to execute this Amendment to the Agreement to
govern the use of the remaining $20,771.27 in CDBG funds for the Project; and
WHEREAS, the Subrecipient is a "Subrecipient' as defined in the Code of
Federal Regulations at 24 CFR 570.500(c); and
WHEREAS, the Data Universal Numbering System number 12-095-9952, is a
"Subrecipient" as defined in the Code of Federal Regulations at 24 CFR 570.500(c); and
WHEREAS, Subrecipient is an eligible entity to act as designated project sponsor
and, as such, Subrecipient will carry out the Project; and
WHEREAS, the Grant Agreement establishes the rights and responsibilities of
HUD and the County of San Luis Obispo.
WHEREAS, with the execution of this Amendment No. 1 the Subrecipient
agrees to perform the original terms, tasks, obligations, and services set forth in the
Agreement and as set forth in this Amendment No. 1, and the Statement of Work; and
NOW, THEREFORE, IT IS AGREED by and between the parties hereto that
the Agreement is amended as follows:
1. The term of the Agreement is extended through December 31, 2018. The
Parties agree this extension shall be retroactive and cover the period from May
1, 2018, through December 31, 2018.
2. The Agreement is subject to the requirements of the Uniform Administrative
Requirements, Cost Principles, and Audit Requirements for Federal Awards
per 2 CFR Part 200, as applicable.
3. Except as expressly amended therein, all provisions of the Agreement shall
remain in full force and effect.
NOW, THEREFORE, the Parties hereto have caused this Amendment No. 1, as
of the day and year first above written.
