I TO THE 2014 SUBRECIPIENT AGREEMENT BETWEEN THE COUNTY OF SAN LUIS OBISPO AND THE CITY OF ATASCADERO THIS AMENDMENT NO. 1 is made and entered into this eday of 43�li2 , 2017, by and between the County of San Luis Obispo, a political subdivision of the State of California, hereinafter called "Recipient," and the City of Atascadero, a municipal corporation of the State of California, located in the County of San Luis Obispo, hereinafter called "Subrecipient" (jointly referred to as "Parties"). WITNESSETH: WHEREAS, on June 21, 2011, the Recipient and the Subrecipient entered into a Cooperative Agreement to implement the Housing and Community Development Act of 1974 (herein called the "Act"). The Act is omnibus legislation relating to federal involvement in a wide range of housing and community development activities and is administered by the federal Department of Housing and Urban Development; and WHEREAS, on February 25, 2014, the San Luis Obispo County Board of Supervisors approved the County of San Luis Obispo Program Year 2014 Action Plan of the Consolidated Plan (hereinafter referred to as the "2014 Action Plan") and projected use of funds pursuant to applicable federal regulations (24 C.F.R. Part 570); and WHEREAS, the 2014 Action Plan allocated a total of $75,393 to the Subrecipient's `Barrier Removal Project"; and WHEREAS, on April 14, 2015, the Recipient and the Subrecipient executed a subrecipient agreement (the "Original Agreement") for the use of the 2014 CDBG funds, including use of funds for the "Barrier Removal Project'; and WHEREAS, the term of the Original Agreement expired June 30, 2015, and the Recipient and the Subrecipient wish to amend the Original Agreement to establish a new Term of Agreement of April 30, 2018; and WHEREAS, the Subrecipient and the Recipient wish to amend the Original Agreement to include a provision allowing the Recipient's Department of Planning and Building Director to extend the Tenn of Agreement an additional 90 days upon receiving and approving in writing, a written request from the Subrecipient prior to the end of the Term of Agreement; and WHEREAS, in the letter dated September 1, 2016, attached as Exhibit "A," the Subrecipient's City Manager requested that $20,638 of the $75,393 allocated to the 2014 CDBG funded project `Barrier Removal Project" be reallocated to the "South El Camino Real and San Rafael Road Pedestrian Ramp Replacement Project," hereinafter referred to as the "SECR Project," as allowed in Section V of the Consolidated Plan Amendments of the Urban County of San Luis Obispo Community Participation Plan; and WHEREAS, the City Manager also requested that the Barrier Removal Project be renamed the "Atascadero Mall Sidewalk Infill and Pedestrian Crosswalk Improvements Project," hereinafter referred to as the "Mall Project," and that the $54,755 balance of 2014 CDBG funds be used for that project; and WHEREAS, the Recipient completed the federal environmental review document for both the SECR Project and the Mall Project, and the Subrecipient incurred and obligated SECR Project funds; and WHEREAS, the Subrecipient is ready to implement the "Mall Project," and WHEREAS, on January 25, 2016, the Recipient and the Subrecipient executed a Subrecipient Agreement for the use of 2015 CDBG funds for the SECR Project; and WHEREAS, the Recipient has not drawn down 2014 nor 2015 CDBG funds on behalf of the Subrecipient's SECR Project; and WHEREAS, with the execution of this Amendment No. 1 the Subrecipient agrees to perform the original terms, tasks, obligations, and services set forth in the Original Agreement and as set forth in this Amendment No. 1, and the Statement of Work, attached hereto as Exhibit `B," and WHEREAS, the Recipient shall reimburse the Subrecipient for the services performed by the Subrecipient pursuant to the terms of the Original Agreement and this Amendment No. 1 and in accordance with the terms set forth in the "Schedule of Compensation," attached hereto as Exhibit "C;" and NOW, THEREFORE, IT IS AGREED by and between the parties hereto that the Original Agreement is amended as follows: 1. The term of the Original Agreement is extended to April 30, 2018. 2. The Term of Agreement may be extended an additional 90 days by the Director of Planning and Building upon written request by the Subrecipient prior to the expiration of the Term of Agreement. 3. The SECR Project will receive $20,638 in reallocated 2014 CDBG funds, as reflected in Exhibit B. 4. The "Barrier Removal Projects," will now be known as the "Atascadero Mall Sidewalk Infill and Pedestrian Ramp Replacement Project," and funds for that project are decreased by $20,638 from $75,393 to $54,755, as reflected in Exhibit B. 5. All references to the Uniform Administrative Requirements shall be per the new 2 CFR Part 200 code. 6. Except as expressly amended therein, all provisions of the Original Agreement shall remain in full force and effect. The $54,755 in 2014 CDBG funding will be combined with the $104,883 CDBG funds approved under 2016 Action Plan. Total CDBG allocations to this project total $159,638. The project will eliminate architectural barriers and comply with current ADA requirements, Total project balance for the "South Fl Camino Real Sidewalk Accessibility and Pedestrian Ramp Replacement" is $125,000 using the combined 2014 and 2015 CDBG funds. Sincerely, '-, Rachelle Rickard City Manager EXHIBIT B STATEMENT OF WORK Amendment No. 1 to the 2014 Subrecipient Agreement between the County of San Luis Obispo and the City of Atascadero As part of the Urban County of San Luis Obispo 2014 Action Plan, the Subrecipient amended the following CDBG funded projects as follows: Amendment to the 2014 CDBG allocations by the City of Atascadero City of Atascadero CDBG funded Projects Budget South El Camino Real Sidewalk and San Rafael Road Pedestrian Ramp $20,638 Replacement Project Atascadero Mall Sidewalk Infill and Pedestrian Crosswalk Improvements $54,755 Project Total $75,393 Project Description South El Camino Real Sidewalk and San Rafael Pedestrian Ramp Replacement Project The SECR Project entails the installation of a "missing link" of sidewalk on the east side of El Camino Real from approximately 150 feet north of Jomada Lane to the intersection of San Rafael Road. This new sidewalk will connect an existing 10 -foot wide concrete sidewalk that abruptly ends on the south end of the existing sidewalk at the intersection of EI Camino Real and San Rafael Road. The proposed 10 -foot wide concrete sidewalk is adjacent to State Hospital property, whose entrance is located at San Rafael Road. The SECR Project also includes replacing two pedestrian curb ramps on the east side intersection comers at San Rafael Road as well as upgrading the push button technology and other related work as funding allows. Atascadero Mall Sidewalk Infill and Pedestrian Crosswalk Improvements Proiect The Mall Project includes the removal of architectural barriers to provide improved pedestrian accessibility to include sidewalks, curbs and drainage and provide a pathway from the property at 6320 Atascadero Mall to Highway 101 undercrossing at the intersection of Atascadero Mall and Ardilla Avenue. The Mall Project also includes additional crosswalk striping and pedestrian ramps at comer of Atascadero Avenue and Nacimiento Avenue. Project completion date The City of Atascadero will complete and expend $75,393 in 2014 CDBG funds allocated to the above named projects by April 30, 2018. EXHIBIT C SCHEDULE OF COMPENSATION I. AMOUNT OF COMPENSATION. For performing and completing all work and services described in Exhibit B, and for providing all materials required therefore, Recipient shall pay Subrecipient the total amount of: CDBG Line Item Budget City of Atascadero CDBG funded Projects Budget South El Camino Real Sidewalk and San Rafael Road Pedestrian Ramp $20,638 Replacement Project Atascadero Mall Sidewalk Infill and Pedestrian Crosswalk Improvements $54,755 Project Total $75,393 Approved Line Item Budgets: South El Camino Real Sidewalk and San Rafael Pedestrian Ramo Replacement Proiect CDBG funds budgeted for the SECR Project can be allocated to one or more of the following expenses: 1. Construction of 10 -foot wide concrete sidewalk 2. Remove/construct two pedestrian ramps 3. Upgrade push button technology 4. Engineering and soft costs The above total amount listed shall include all out-of-pocket expenses incurred by Subrecipient in the performance of such services. Atascadero Mall Sidewalk Infill and Pedestrian Crosswalk Improvements Project CDBG funds budgeted for the Mall Project can be allocated to one or more of the following expenses: 1. Construction sidewalks where none currently exist 2. Construct pedestrian ramps 3. Install ADA signage as required 4. Engineering and soft costs 2. BILLING. At the end of each quarter in which the services are performed or expenses are incurred under this Agreement. Subrecipient shall submit an invoice and copies of all original supporting documentation to the Recipient at the following address: County of San Luis Obispo Department of Planning and Building Attn: Soutsida Inpravongviengkham, Accountant 976 Osos Street, Room 300 San Luis Obispo, California 93408 3. METHOD OF PAYMENT. Payment to Subrecipient of the compensation specified in Section 1 of this Exhibit shall be made as follows: A. Subject to the maximum allowable compensation set forth in Section 1 of this Exhibit, the Recipient shall pay the Subrecipient, based on the submittal and approval of an invoice, on the basis determined by this Amendment No. 1.
