City Hall Council Chambers 6500 Palma Avenue, Atascadero, California CALL TO ORDER - 6:06 p.m. Chairperson Seay called the meeting to order at 6:06 p.m. and Commissioner Betz led the Pledge of Allegiance. ROLL CALL Present: Commissioners Anderson, Betz, Dariz, Donovan, Wolff, Vice Chairperson Zirk, and Chairperson Seay Absent: None Others Present: Recording Secretary, Annette Manier Staff Present: Community Development Director, Phil Dunsmore Associate Planner, Katie Banister APPROVAL OF AGENDA MOTION: By Commissioner Wolff and seconded by Vice Chairperson Zirk to approve the Agenda. Motion passed 7:0 by a roll -call vote. PUBLIC COMMENT None Chairperson Seay closed the Public Comment period. PLANNING COMMISSION BUSINESS None CONSENT CALENDAR 1. APPROVAL OF DRAFT MINUTES OF AUGUST 21, 2018 2. APPROVAL OF TIME EXTENSION FOR 8391 AMAPOA AVE (TEX18-0089) PC Minutes of 9/4/18 Page 1 of 3 Recording Secretary Manier advised the Commission that there was a clerical error on Item #1. On the Agenda, the Draft Minutes were listed as the Draft Minutes of August 21, 2018, but the Draft Minutes included in the Agenda Packet and before the Commission for approval are the Draft Minutes of August 7, 2018. MOTION: By Commissioner Dariz and seconded by Commissioner Betz to approve the Consent Calendar with the following revision to Item #1. 1. APPROVAL OF DRAFT MINUTES OF AUGUST 7, 2018 Motion passed 7:0 by a roll -call vote COMMUNITY DEVELOPMENT STAFF REPORTS None PUBLIC HEARINGS DISCLOSURE OF EX PARTE COMMUNICATIONS: Prior to a project hearing Planning Commission Members must disclose any communications they have had on any quasi-judicial agenda items. This includes, but is not limited to, Tentative Subdivision Maps, Parcel Maps, Variances, Conditional Use Permits, and Planned Development Permits. This does not disqualify the Planning Commission Member from participating and voting on the matter, but gives the public and applicant an opportunity to comment on the ex parte communication. (For each of the following items, the public will be given an opportunity to speak. After a staff report, the Chair will open the public hearing and invite the applicant or applicant's representative to make any comments. Members of the public will be invited to provide testimony to the Commission following the applicant. Speakers should state their name for the record and can address the Commission for three minutes. After all public comments have been received, the public hearing will be closed, and the Commission will discuss the item and take appropriate action(s).) EX PARTE COMMUNICATIONS Commissioners Anderson and Dariz reviewed this project at the Design Review Committee. 3. CONDITIONAL USE PERMIT FOR 5802 TRAFFIC WAY Property Owner: Kathryn Kleinschmidt Trust Applicant: Kathryn Kleinschmidt Project Title: USE 18-0062 Project Location: 5802 Traffic Way, APN 029-322-012 (San Luis Obispo County) Project Description: The proposed project is a Conditional Use Permit for a parking reduction and a fencing modification for a two -building mixed-use development. The applicant proposes providing five (5) off-street parking spaces where seven (7) are required by the Zoning Ordinance. Environmental Determination: Negative / MND No. 2004-0012, Certified April 7, 2004 City Staff: Katie Banister, Assoc. Planner, kbanister@atascadero.org, (805) 470-3480 PC Minutes of 9/4/18 Page 2 of 3 Recommendation: Planning Commission adopt PC Resolution 2018-A, approving the Conditional Use Permit with conditions of approval. Associate Planner Banister presented the staff report and answered questions from the Commission. PUBLIC COMMENT The following members of the public spoke during public comment: Kathryn Kleinschmidt, Rachel Aljilani, Ken Haggard, Mike Zappas, and Zoe Zappas. Ms. Aljilani answered questions from the Commission. Chairperson Seay closed the Public Comment period. The Commission suggested the City explore more bike racks in general. The applicant stated that they intend to place one bike rack up front near the storefront at the sidewalk in the right-of-way, and the other location will be determined. MOTION: By Commissioner Donovan and seconded by Commissioner Dariz recommending the Planning Commission adopt PC Resolution 2018-A, approving USE 18-0062, approving Conditional Use Permit to allow a reduction in the number of required off-street parking spaces, and a modification of fencing requirements for a mixed- use development in the Downtown Commercial zoning district, based on findings and subject to Conditions of Approval. Motion passed 7:0 by a roll -call vote. COMMISSIONER COMMENTS AND REPORTS None DIRECTOR'S REPORT Director Dunsmore stated there are no items scheduled for the September 18th meeting, so it will be cancelled. Director Dunsmore gave an update on projects in the City. ADJOURNMENT — 7:15 p.m. The next regular meeting of the Planning Commission scheduled for September 18, 2018, will be cancelled. The next regular meeting of the Planning Commission will be on October 2, 2018, at City Hall, Council Chambers, 6500 Palma Avenue, Atascadero.
