BACKGROUND: Due to the resignation of Commissioner Roger Miller and the expiration of Commissioner Don Hanauer's term, the Planning Commission"' currently has two vacancies. The City Clerk has advertised and recruited for interested members of the public to apply. A total of thirteen applications were received. Although I was very busy with my auto repair business I invested time working through these organi- zations to accomplish goals in helping the business community to fit in with the city's general plan. Getting the sign ordinance through was the big- gest project basically because of the money already invested by some = businesses. Making the decision was up to the planning commission but all the businessmen that worked on the recommendation influenced the - final decision. I have become interested In the growth pattern and general plan since in living In Atascadero for the last 4 years. Researching and studying propos- als for development has Interested me since being in Alameda and watch- ing the way things happened there. The problems In that community were far different than here. That community had a finite area and growth was measured In the number of existing homes to be removed and then replaced by others. In this community the underlying concerns are sub- stantially different. I would be very Interested In learning about the general plan and development ideas. I think It would be a worthy challenge work- ing with others to come to decisions regarding recommendations to pass on to the City Council. Further i have no political prejudices in regards to this community, this 1 believe is a significant advantage in rendering good decisions based on facts not feelings. Purpose. The purpose of this resolution is to establish procedures for the City Council to follow in recruiting, selecting and appointing members to the standing committees, commissions or boards created pursuant to statute or by action of the City Council. Section 2. Recruitment and Eligibility. Announcements of openings for any committees, commissions or boards to which members are appointed by the City Council will be through the local news media. All electors of the City of Atascadero, over the age of 18, and meeting any announced additional criteria as established by the City Council shall be eligible to apply. Section 3. Interviews. t All candidates meeting the criteria established in Section 2 will be interviewed by the City Council during a properly noticed meeting. �i Section 4. Selection. a. Council members will vote for the candidate (s) of their choice by placing - their name and circling the name of their selection (s) on a ballot form provided by the City Clerk. Candidates' names will be placed in alphabetical order on the ballot form. b. After the City Council has had an opportunity to make its individual determination, the City Clerk will col- lect the ballots and will announce first the Council member ' s name and second the name (s) of the candidate (s) of that Council member ' s choice (s) . RECOMMENDATION: Staff recommends that the City Council considers for adoption the City Ordinance amendment , to include the additional hunting definition. BACKGROUND: This amendment to the Book of Ordinances of the City Atascadero defines and clarifies hunting and specifically prohibits hunting deer within the city limits . ANALYSIS: Although there is an existing city ordinance prohibiting the use of rirearms within the city limits , there is currently no ordinance which specifically prohibits the hunting of deer with other weapons . FISCAL IMPACT: Nene foreseen. ORDINANCE NO. 272 AN URGENCY ORDINANCE OF THE COUNCIL OF THE CITY OF ATASCADERO AMENDING THE ATASCADERO MUNICIPAL CODE PROHIBITING THE HUNTING OF DEER WITHIN THE CITY LIMITS (CITY COUNCIL INITIATED) WHEREAS, Section 65858 of the Government Code authorizes the adoption by local legislative bodies of interim ordinances as urgency measures to protect the public safety, health and welfare; and WHEREAS, consideration of an urgency measure shall require a 4/5th vote of the legislative body for adoption; and WHEREAS, there is an urgent need, in the interest of public safety, to prohibit hunting within the city limits; and WHEREAS, there is an urgent need, in the interest of the preservation of wildlife to define and prohibit hunting; and NOW, THEREFORE, the Atascadero City Council does ordain as follows : Section 1 . Article 2, Sec. 4-3. 201 of the Public Safety Ordinance text are hereby added as shown in the attached Exhibit "A", which is hereby made a part of this ordinance by reference . Section 2 . The City Council hereby declares that this is an urgency ordinance necessary to preserve the public peace, health and safety due to the facts set forth above . Section 3 . The purpose of thisletter is to remind the city council that such an action would be a preemption of the State's authority to.regulate deer hunting. Section 450, at. seq. and Section. 18011 et. .seq. of: .the-rish and Game Code clearly outline the intent of the legislature -regarding the management of deer in California. Section 200, at. seq. places the authority to regulate the taking or possession of birds, mammals, fish, amphibia and reptiles with the Fish and Game Commission. As used in this chapter "general deer hunting season" means the annual season for the area in question as is set by the commission under • its general regulatory powers,or set by statute,for the taking of male deer. ; 1452. Designation of deer management units,eta. The department shall designate deer herd management units and designate the manager for the units.Such units may encompass a single deer herd or a group of deer herds having similar management and habitat requirements and characteristics. Boundaries of such units, unless appropr'a+ts,need not fallow county boundary lines. 1458. Deer management unit plan development. The department shall develop plans for such deer herd management units.The objectives of such plans shall be the restoration and mainte- nance of healthy deer herds in the wild state and to provide for high quality and diversified use of deer in California. §454. flans--contents. RECOMMENDATION: Direct the City Clerk to advertise and solicit interested applicants to serve the balance of Mr. Kudlac's term on the City Council. BACKGROUND: Mayor Marty Kudlac formally filed his letter of resignation with the City Clerk on July 31, 1993. The effective date of his leaving is August 31, 1993. Mr. Kudlac's council term does not expire until June of 1996. Based on staff's research, the City Council has two options: 1 . Appoint someone to fill the remainder of Mayor Kudlac's council term within thirty days from the date his resignation is effective: August 31, 1993; or by September 30, 1993. 2. Call a special election. If the City Council is unwilling or unable to appoint someone to fill the remainder of Councilmember Kudlac's position, then a special election must be held. The Elections Code is quite clear that a special election must be held at the next regularly established election date. The next election falls on November 2, 1993, but it is too late to consolidate with the County for an election and the nomination period is already underway. Therefore a special election would have to be held on April 12, 1994. (The City's regular municipal election is set for June 7, 1994--just two months later.) Neither the Government Code or the City's Municipal Code specify how the Council proceeds with appointment. This issue has come up once before (in 1987) and the Council followed a similar procedure to that which is done with all advisory body appointments. FISCAL ANALYSIS: The Cit Clerk has consulted with the Count Clerks Office and two election Y Y consultants. The cost of a special election is estimated to be between $12-15,000. This cost is, of course, unbudgeted. Costs for conducting the June municipal election are estimated at $10,000 and funds have already been authorized for this expense. Staff seeks direction about how the City Council wishes to proceed.
