requested for the remainder of this fiscal year.
Most of the above expenditures are a result of last fire season,
with the exception of a few items which will allow start-up funds
for the coming fire season, projected to begin approximately
5-15-85.
There are other accounts that are short, such as telephone , water,
P.G. & E. , etc. , however I recommend we wait and balance these at
the end of the fiscal year.

The only additional item which was to be presented at the mid-year
review is the fire station office addition. This item will be

.SUBJECT: Budget Adjustment Request Plan Checking, Inspection, and
_.� Enforcement
BACKGROUND:
On October 8, 1985 the City Council approved a supplementary budget
request in the amount of $39,700 to fund a part-time building inspec-
tor and to enable greater use of outside plan check services. This
was intended to cover said services through January, 1985 at which
time a comprehensive mid-year evaluation was anticipated. At the
Council' s March 11, 1985 meeting, staff was directed to bring back a
proposal for a contract planner to expedite dealing with the backlog
of enforcement complaints. This request is intended to provide for a
strengthening of our enforcement activities together with covering the
costs of plan check and inspection-related activities through the end
of this fiscal year.
EXISTING SITUATION:
The Fiscal Year 1984/85 budget stands as follows with respect to ex-
penditure categories which cover the cost of plan checking and part-
time inspection:

In calendar year 1984, the total valuation of permits issued by the
City was $27.4 million dollars which was almost double the 1983 valua-
tion of $14.3 million dollars. With respect to revenues, there are
some 29 revenue accounts in the general fund whose income is generated

by Planning and Building Division services. The status of these ac-
counts as of February 28 , 1985 is detailed on the attached table ani
may be summarized as follows:

Thus, revenues to date are $28,066 more than anticipated for the full
year . If this trend continues through June, revenues for the fiscal
year would exceed budget expectations by $151,950.
ENFORCEMENT:
Demands to process development applications have left inadequate staff
time to deal with the mounting problem of land use violations in the
City. Our enforcement policy is to pursue violations on a complaint
basis. However , as action on enforcement is delayed due to the work-
load on development applications, there are numerous calls from those
. whose complaints have not been satisfied which, in turn, interfere
with the processing of development applications. The only way out of
this catch-22 is to set aside resources and commit to an on-going en-
forcement program to protect the quality of life within the City.
Pursuant to Council' s direction at the March 11, 1985 meeting, I would
propose that we hire a contract assistant planner at $8.42 per hour :,, ,
(range . 24) for a total expenditure of $4,400 this fiscal year . As _:
policy determination in the FY 1985--86 budget, the City Council ca
determine whether this function and related planning activities should
be established as a permanent position or continued as a contract
position.
PLANNING INTERN:
Since his completion of class work in December, we have been using
Planning Intern Mike Wixon full-time instead of the 20-hours per week
programmed for this temporary position. His duties have evolved- be-
yond intern level work to entry level staff Planner responsibilities
including business license clearance checks, precise plan report, CDBG
project, enforcement site checks, building permit plan check, and
counter information. His current rate of pay is $5.00 per hour.
Consistent with the recommended action for- an Assistant Planner con-
centrating on enforcement, it is also requested that this position be
made a three-month contract position (range 24) with a decision on
whether to make it a permanent position or a contract position
beyond then decided as part of the 1985/86 budget.
ACTION REQUESTED:
To covercontinuation of overtime, outside plan checking, and part-
time staff costs through the end of June, together with adding a con
tract employee primarily engaged in enforcement, we request the fol'
lowing transfer from the Contingency "Reserve Account:

1. Overtime - Account #01-25-1040. As indicated, the current appro-
priation is $40,000 . As projected during budget hearings for f.y.
1984--85, this account indicates an anticipated shortage of funds.
I estimate an additional requirement of $7, 000 in this account which
should allow us to provide service at our current level (It should
,be noted that we will receive approximately $4 ,000-$5,000 in reim-
bursement from A.U.S.D. for special enforcement and patrols in
expended overtime. )
A recent department analysis of overtime usage over 32 pay
periods revealed 4 ,438 hours of O.T. logged for sworn employees.

Significantly, our sergeants heaviest use of overtime (61%)
was as a result of personnel shortages. These shortages occur due
to scheduled vacations, holidays, comp. time off, military leave,
sick leave, worker' s comp. , mandated training and other authorized
absences.
Noteworthy also, is the use by officers of O.T. for personnel
shortages (30 ..6%) for the same reasons reflected above. The
sergeants, obviously, use comparatively more of their total for
personnel shortages than do the officers. One of the reasons for
this, is that with rare exceptions, we schedule an supervisor
24 hours a day, 7 days per week so as to insure an efficient and
productive delivery of police services. In the officer category,
when there is a shortage for various reasons, we do not always
replace the vacant position with overtime. Typically, we will
"shuffle" the schedule or simply work short handed.
During the first few months of this fiscal year, we were
staffed with all authorized positions. This is in contrast to the
past few months wherein we presently have 3 personnel vacancies
with 1 additional opening as of April 1, 1985. These factors,
coupled with others, impact our total overtime usage requirements.
2 . Portable Radios - Account #01-25-3146. In addition to the $4,900
expended as budgeted, we are requesting the transfer of $2 ,530
for radio equipment to be used by our new Traffic Officer, effective
April 1, 1985 . The amount reflected will be totally reimbursed
by the Office of Traffic Safety Grant which was recently approved.
3. Radar Equipment - Account #01-25-2356 . Our current budget authorizes
$2 , 000 for radar equipment. The Office of Traffic Safety has
authorized $4,500 for the purchase of two radar units to be used
in our Traffic Enforcement/Safety Grant- again totally reimbursed.
4 . Auto Repairs and Service - Account #01-25-2150 . Current appropriation
in this account is $10, 000. Expenditures to Feb. 28 , 1985, amount to
$12, 300 . The amount originally projected in this account was inten-
tionally low as it was anticipated that our City would begin providing
our own automotive services at our Corporation Yard effective
January 1, 1985 . Inasmuch as we continue to contract with private-
enterprise for automotive services, I project a need for an additional
$6 , 000 for the remaining fiscal year over and above the current
expenditure.
5 . Copy Machine - Records Bureau —Account #01-25-3267 . For each of
the past 5 years, I have requested a copy machine for our department.
On each occasion, the City Manager has denied the request with the
rationale that we only need one copy machine for all City services.
For the following reasons, I propose we buy a small unit for the
P.D. .
A. Our department processes more than 10, 000 copies per month
through the City IBM copy machine. This amount comprises
over 1/3 of all copies produced in City Hall. (This count
was verified by thecounteron the machine. )
B. Most of the materials which we reproduce are reports and
complaints which must be prepared for the Courts, D.A. ' s
Office, Probation and other allied agencies. The copies
produced for such purposes must be available each morning
and timing is very important.
During the hours of 12: 00 midnight and 8 :00 am. , we obviously
receive fewer calls for service than on other shifts. It
is felt that this is an ideal time for the on-duty dispatcher
to process necessary copying so that these materials will
be ready for transmittal to the required agencies. Under
the present system, it is impossible to fully utilize our
office staff on "graveyard" shift for copying because they
cannot leave their work station to go to the second floor
copying' roon.
C. The City machine on the second floor is overburdened to
the point that it frequently malfunctions which creates
backlogs for all departments.
D. Much time is wasted by Records personnel in running between
floormor the purpose of .making Opies- Additionally,
the public (insurance companies representatives and
others) is not served in an efficient manner under the
present system. This has led to anger and frustration
in citizens as well as employees who are endeavoring to
serve the public.
E. With a duplicator in the P.D. , the City cony machine
will be free for use by other departments when it is
needed for agendas and other materials.
Purchased outright, the copy machine I propose will cost the
City approximately $4,700. The manufacturer also offers a three
year purchase contract at 11 . 5% interest.
I recommend that the Council authorize the outright purchase
4' of the machine and that $4 , 700 be transferred from reserves to

Engineering
Office Supplies - Account 01-41-2220. An additional $250.,00 is requested in
this account to cover unanticipated expenditures for the rental of a transcribing
machine requested by the Consulting City Engineer. It is suggested that this
amount be transferred from account #01-40-2060 - Conferences which will not be
used this year due to the absence of a Public Works Director.

Street Department
Maintenance Materials - Account 01-41-2170. We are ,requesting an additional
$5,000 in this account due to expenditures in preparation of the overlay
project.
Small Tools - Account 01-41-2210 It is requested that $1,000.00 that was left
over from the purchase of the roller be transferred to this account for the
purchase of additional tools.
Wastewater Treatment
Stand-by— Account 06-42-1080. An additional $3,500 is required for ,this account
for the balance of this fiscal year. The work schedule at the treatment plant
has been changed from the seven day work week as initiated by the County, to a
5 day work week with minimal stand-by on weekends.
Maintenance Materials - Account 06-42-2170. We are requesting a transfer of
$4,484.20 from account #06-42-3807, Generator, ,to the maintenance materials
account. It has been determined that a smaller, less expensive generator is
sufficient and such has been purchased. Therefore, the balance in that account
is available for transfer.
Parks & Zoo
Physicals - Account #01-43-2240-0016. Because of unanticipated turnover in
this division the amount allocated for physicals at the beginning of the year
was insufficient. We are requesting $500.00 to cover the balance of this
fiscal year.

Vertical Plan File —Account ##01-40-3272. $600 has been budgeted for the
purchase of a vertical plan file for the Engineering Division. Due to the
impending renovation, we would like this item to be held over to FY 85/86
for purchase after the Engineering office is relocated.
Street Division
_'N Service Shop Tools and Test Equipment- Account ##04-41-3278. This item will
need to be held over due to the construction schedule of the new corporation
yard.
Service Shop Equipment - Account '##04-41-3279. As above, this equipment cannot
be purchased prior to the construction of the corporation yard.
Parks & Zoo
. -Hospital Equipment Zoo - Account ##01-43-3288. Purchase of this equipment
will be delayed due to the delay in the construction of the new Park buildings.
Renovation: Restroom and Hut Storage —Account ##01-43-3289. In order to to
5 the renovation, on the Hut, the new park buildings will have to be completed.
Recommend hold over until next fiscal year.
Kitchen Equipment Zoo - Account ##04-43-3284. Same as above. Delayed until
construction of new park buildings.
Renovation Irrigation System Administration Building - Account #04-43-3290.
Due to staff shortages in the Engineering Division, construction of curb,
gutter and sidewalk has been delayed. When completed, the irrigation system
will be installed.
Building Division
4th Floor Structural Renovation - Account ##01-44-2240-0101. Delay due to over-
estimate bids. Prospect of grant funding.
Administration Building Renovation - Account ##01-44-3511. As above.

SUBJECT: Mid-Year Budget Review
As per your request, the following information is
submitted for possible adjustment by City Council on March
25th:
Item: Account #08-2501 Alvord Field Grant
The total grant amount, not including interest received,
was $60, 979. Prior to my arrival in November, a total of
$65, 031. 20 had been spent on the project. Recreation Coordinator,
David Catherina explained to me that on two separate occasions
he had talked with the City' s Auditor concerning interest
earned on the account. On each occasion he was informed that
in excess of $11, 000 had been earned on interest on this account,
giving the City approximately $72, 000 in total funds which had
to be spent to be eligible for the 10% retention ($6,097) held
by the State.
As a result of this information, an additional $4 , 886 was
spent on the project, bringing the total expenditures to approxi-
mately $69, 918.
Unfortunately, an error has occurred, and the City does not
have the $11, 000 interest as was reported to As of 6/30/84 ,
a total of $1,415 had been credited to the Alvord Field account.
Due to the error, the total revenue is $62, 394, not the $72, 000
as mentioned earlier.
As a result, $7, 524 is requested from Contingency Reserve.
When the loo retention ($6, 097) is received from the State, this
account is credited with the interest, and if the Council approves
the transfer, the account will no longer show an over-run on
ex endi uses.

The regular meeting was called to order at 7 : 30 p.m. by Mayor Nelson. The
Pledge of Allegiance was recited. Invocation was given by Larry Etter of the

Speaking against the rezoning were Bill Rempel who stated a referendum
petition was being circulated, and Art Cunningham, Dave Grimes and
Joe Nile.
2. Ordinance No. 98 Revise the Zoning Ordinance Text Modifying the
Rear Setback Requirement in Commercial and Industrial Zones Which
are Adjacent to Residential Zones, to allow Waiving the Ten-Foot
Setback for Buildings, or Portions of Buildings , Twelve-Feet- in
Height or Less Within 10-feet of the Real Property Line (Cont'd
from 2/25/85) Second Reading
Staff report was given by Henry Engen, Planning Director.
Allen Grimes, City Attorney, responded to remarks made by Ed
Chidlaw at the previous council meeting regarding a possible
conflict of interest.
Mr. Ed Chidlaw expressed his concerns about this ordinance.
MOTION: By Councilman Molina, seconed by Councilman Handshy to read by
title only. Passed unanimously.
Ordinance No., 98 was read by title only by Mayor Nelson.
MOTION: By Councilman Molina, seconded by Councilman Handshy that this
constitutes second reading and for adoption of Ordinance No. 98 .
Passed 4 : 1 by roll call vote with Councilwoman Mackey voting no.
3. Police Facility Acquisition - Verbal report- McHale
Police Chief Bud McHale gave staff report and suggested that
negotiations for the facility be discussed in closed session.
4 . Historic Restoration Grant - Verbal Report - John Wallace
Bob Best, Recreation Director, stated that the City will receive
grant funds of $300, 000 from Proposition 18 funds.
John Wallace, Contract Engineer, suggested that the City go to
bid by July 1, 1985. and execute the contract with the State for
these funds.

Henry Engen, Planning Director, gave staff report.
MOTION: By Councilwoman Mackey, seconded by Councilwoman Norris to direct
staff to execute the two documents for approval. Passed unanimously.
D. NEW BUSINESS
1. Proposed Resolution 19-85 - Confirming the Appointment of Fire
Chief Mike Hicks as Acting City Manager, Acting Public Works
Director and Acting Finance Director
MOTION: By Councilman Molina, seconded by Councilman Handshy to approve
Resolution No. 19-85. Passed unanimously by roll call vote.
2. Police Car Replacement - Transfer of Funds from Contingency Fund
Police Chief Bud McHale gave staff report. He recommended that
$9,100 be transferred from contingency fund.
MOTION: By Councilman Molina, seconded by Councilwoman Mackey to approve
the transfer .of $9, 100 from contingency fund. Passed unanimously
by roll call vote.
3. Acceptance of Planning Commission Resolution 2-85 - submittal of
resignations.
Councilwoman Mackey read a copy of her proposed resolution regarding
the planning commission.
MOTION: By Councilman Molina, seconded by Councilman Handshy to accept
Resolution 2-85 . Passed 4 : 1 by roll call vote with Councilwoman
Mackey voting no.
4. Proposed Urgency Ordinance No. 102 Council of the City of Atascadero
Designating the City Council to Act as the City's Planning Agency
Pursuant to Government Code Section 65100 (a) .
Henry Engen, Planning Director, gave staff report suggesting that
the City Attorney' s office draft ordinance be revised to have the
Ordinance expire June 1, 1985 .
MOTION: By Councilman Molina, seconded by Councilman Handshy to read by
title only. Passed unanimously.
Ordinance No. 102 was read by title only by Mayor Nelson.
OTION: By Councilman Molina, seconded by Councilman Handshy for adoption
of Ordinance No. 102 . Passed 4 :1 by roll call vote with Councilwoman

Mayor Nelson said he would like the Council to interview for the
positions of Planning Commission within a month. Applications for
this will be made available at the City Clerk' s office and ads will
be placed in the Atascadero News.
MOTION: By Councilman Molina, seconded by Councilman Handshy that Wayne La
Prade act as an advisor to the Council during Planning Commission
Meetings. Passed unanimously.
5. Draft Ordinance No. 101 - Municipal Code Amendment Regarding Re-
organization of the Planning Commission and Recreation Commission
After much discussion by the councilmembers, it was decided to
bring this back as a public hearing at the next council meeting.
6 . Proposed Resolution Number 20-85 - New stop Sign Installation
(Los Gatos/San Marcos and San Gabriel/San Marcos
Staff report was given by John Wallace, Contract Engineer.
MOTION: By Councilman Handshy, seconded by Councilwoman Mackey to approve
Resolution 20-85. Passed unanimously by roll call vote.
E. INDIVIDUAL DETERMINATION AND/OR ACTION
CITY COUNCIL
Councilwoman Mackey asked about the budget review meeting that was
scheduled for Saturday, March 16 . This is being cancelled but the
Council will meet at the next council meeting at 7 p.m. to discuss
budget items. Planning staff was requested to bring forward the cost
of an ordinance enforcement contract employee.
Mayor Nelson asked Bud McHale, Police Chief, about the "sweep" by the
animal services. Mr. McHale said that there were three sweeps done last
week and more to follow in the next couple of weeks. He will have a
report for the Council at the next meeting.
Mayor Nelson requested that the Council set a study session date for
the proposed businesslicenseordinance at the March 25th meeting.
CITY ATTORNEY
Allen Grimes, City Attorney, reported that the city had been involved
in an appeal before the Court of Appeals on the case against the City
by Larrison and 8 other police officers. The City won on every point
that was initiated. So unless the officers decide that they want to
petition for a hearing by the -Supreme Court of California and the
Court would grant it, which is unlikely, the case is closed.
CITY CLERK
Grigger Jones, City Clerk, stated that for the public there are copies
of the conflict of interest forms of all the public officers. These
are available in the City Clerk ' s Office.

1. City Manager Recruitment - Ratification of Contract
Mike Hicks, Acting City Manager, read the contract for the new
City Manager, Michael B. Shelton.
. Allen Grimes, City Attorney, questioned whether the word "renewed" in
the last sentence of Paragragh 4 should be "reviewed" . No amendment
was made.
MOTION: By Councilman Molina, seconded by Councilwoman Norris to approve_
the Contract. Passed unanimously 5 : 0 by roll call vote.
B. NEW BUSINESS
1. Discussion of Interim Finance Director
Mike Hicks, Acting City Manager, stated there is a need for an
interim finance director due to the fact of the budget process
coming up soon. It is anticipated that it will cost from $18-
$25 an hour for this individual plus a per diem of $40 to $50
per day plus mileage. He asked the Council for authorization
to persue this and to enter into some type of agreement.
MOTION: By Councilwoman Norris, seconded by Councilwoman Mackey to
authorize staff to enter into an agreement that the upper limits
are $25. 00 per hour, $50. 00 per diem, plus normal mileage.
Passed unanimously by roll call vote.

Due to the existing slopes on lot 15A, the Lot Line Adjustment of
this parcel will create a more buildable site for this parcel.
C. RECOMMENDATION:

Reconsideration to allow the division of a 9.46 acre parcel into three
lots of 3. 08, 3. 08, and 3.30 acres each.
BACKGROUND:
This application was first heard and subsequently continued from the
Planning Commission of December 3, 1984 in order to allow the applicant
time to prepare the additional information pertaining to a 20% reduction
in minimum lot size standards. At the December 17 , 1984 meeting, the
staff recommended approval upon the condition that the project be re-
designed into a two lot subdivision. The applicant requested a contin-
uance until February 4 , 1985 to allow him time to gather information on
the site' s septic suitability. At the February 4 meeting the Planning
Commission voted unanimously to grant the two-way lot split using the 20%
reduction. This resulted in one lot of 3.2 acres and one lot of 6.26
acres.
At the applicant' s request, staff has rechecked the minimum lot size
standards with respect to neighborhood character and as a result has
lowered this factor from .85 to .70. The total of the lot size factor
now becomes 3. 85 and with the already approved 20% reduction the minimum
permissible lot size becomes 3. 08 acres. Hence, the applicant now pro-
poses three lots of 3. 08, 3. 08 and 3. 30 acres each.
RECOMMENDATION:
Staff recommends approval of Tentative Parcel Map 28-84 , based on the
revised findings and Conditions of Approval in Exhibit A.

FINDINGS:
1. The creation of three lots on this parcel conforms to all appli-
cable zoning and subdivision regulations and is consistent with
the General Plan
2. The creation of three lots in conformance with the recommended
Conditions of Approval will not have a significant adverse effect
upon the environment, and preparation of an Environmental Impact
Report is not necessary.
CONDITIONS:
1. Water shall be obtained from the Atascadero Mutual Water Company
and water lines shall exist at the frontage of each parcel or its
public utility easement prior torecordation of the final map.
2. All existing and proposed utility easements, pipelines and other
easements are to be shown on the final map. If there are other
building or other restricitons related to the easements, they
shall be noted on the final map.
a. A 20 foot offer of dedication along the southeast property
line, for road purposes, shall be shown on the parcel map
extending the right-of-way of La Paz Lane.
b. The La Paz Lane frontage of Lot 20, Block 66 shall be im-
proved to City standards withthe width of the new paving
matching the existing road improvement width.
C. Road improvement plans, designed by a registered civil engin-

d. If the applicant is not able to complete the road improve-
ments prior to recordation of the final map, he may bond for

3. Drainage and erosion control plans, prepared by a registered civil
engineer, shall be submitted for review and approval by the Plan-
ning Department prior to issuance of building permits in conjunc-
tion with installation of driveways, access easements or ,struc-

D. ANALYSIS:
In the RS zone, the minimum lot size is 2 1/2 acres to 10 acres
depending upon performance standards contained in the Zoning Ordi-
nance. The applicant is proposing three lots of 3.00 , 3.00 and
3.46 acres each. When staff originally reviewed this proposal,
the minimum lot size standard was 4. 25 acres. Even with a 20%
reduction, the minimum lot size requirement would be 3 .4 acres,
which is still larger than the proposed lots.
Septic Suitability:
Staff determined a severe soil suitability for septic systems
based on the U.S. Department of Agriculture (USDA) Soil Conserva-
tion Maps and soil surveys. The applicant submitted favorable
percolation tests in an attempt to obtain a consideration for a
20% lot size reduction. However , the ordinance only gives discre-
tion to permit a 20% lot size reduction and creation of a 3.0 acre
lot would require a 29% lot size reduction.
Zoning Ordinance Standards:
The creation of two lots on this parcel conforms to City zoning
and subdivision regulations. In septic system design, all tests,
reports, and designs shall conform to methods and guidelines pre-
scribed by the Manual of Septic Tank Practices and other applica-
ble City ordinances. Where soils reports indicate that conven-
tional soil absorption systems are not acceptable, City approval

of plans for an alternative private sewage disposal system, de-
signed by • a registered civil engineer, shall be required. Fur-
thermore, grading that would be disruptive to the natural topo-
graphy shall be minimized. Grading and tree removal require
appropriate City permits.
E. RECOMMENDATION:
Staff recommends approval of Tentative Parcel Map 28-84 based on
the findings and conditions of approval for a two lot division
contained in Exhibit A.

CONDITIONS•
1. The parcel map shall be redesigned into a subdivision of two lots
to conform to zoning and subdivision regulations.
2. Water shall be obtained from the Atascadero Mutual Water Company
and water lines shall exist at the frontage of each parcel or its
public utility easement prior to recordation of the final map.
3. All existing and proposed utility easements, pipelines and other
easements are to be shown on the final map. If there are other
building or other restrictions related to the easements, they
shall be noted on the final map.
a. A 20 foot offer of dedication along the southeast property
line, for road purposes, shall be shown on the parcel map
extending the right-of-way of La Paz Lane.
b. The La Paz Lane frontage of Lot 20 , Block 66 shall be im-
proved to City standards with the width of the new paving
matching the existing road improvement width.
C. Road improvement plans, designed by a registered civil engin-
eer, shall be submitted to the Public Works Department for
review and approval.
d. If the applicant is not able to complete the road improve-
ments prior to recordation of the final map, he may bond for
the improvements for a period not to exceed one year .

4. Drainage and erosion control plans, prepared by a registered civil
engineer , shall be submitted for review and approval by the Plan-
ning Department prior to issuance of building permits in conjunc-
tion with installation of driveways, access easements or struc-
tures. This shall appear as a note on the final map.
5. Plan and profile drawings of proposed individual driveways and
driveway easements shall be submitted for approval by the Planning
and Public Works Departments in order to determine average grade
and appropriate improvement requirements. This shall appear as a
note on the final map.
6. One fire hydrant shall be required on La Paz Lane.
7. All conditions herein specified shall be complied with prior to
filing of the final map.
8. A final map drawn in substantial conformance with the approved
tentative map and in compliance with all conditions set forth
herein shall be submitted for review and approval in accordance
with the Subdivision Map Act and the City Lot Division Ordinance
prior to recordation.
a. Monuments shall be set at all new property corners created
and a registered civil engineer or licensed land surveyor
shall indicate by certificate on the final map that corners
have been set or will be set by a date specific and that they
will be sufficient to enable the survey to be retraced. 0
b. A recently updated preliminary title report shall be submit-
ted for review in conjunction with the processing of the
final map.
9. Approval of this tentative parcel map shall expire two years from
the date of Planning Commission approval unless an extension of
time is granted pursuant to a written request prior to the expira-
tion date.

We have been informed that you are using the Soil Survey of San Luis
Obispo County, Paso Robles Area, 1983, in your city planning. This pleases
us because that is one of the primary uses of the survey.
However, as detailed as the survey is, it still has limitations as
stated on page 79 of the survey report under Engineering.
Data presented in this section are useful for land-use
planning and for choosing alternative practices or •
general designs that will overcome unfavorable soil
properties and minimize soil-related failures.
Limitations to the use of these data,• however, should
be well understood. First, the data are generally not
presented for soil material below a depth of 5 or .6
feet. Also, because of the scale of the detailed map
in this soil survey. small areas of soils that rl;4�f
from the dominant soil may be included in mapping.
Thus, these data do not eliminate the need for onsite
investigations, testing, and analysis by personnel
having expertise in the specific use contemplated.
When planning small acreage subdivisions and home sites, on site
investigations for such items as septic tanks and foundations are essential.
This will determine any -limitations and corrective measures needed to overcome
them. It will also determine if the site is on a soil inclusion which may

The planning staff•'requested an on site soil investigation
to determine if the building sites would have. good percolation.
As shown in the report from Cheda Engineering, the two new .
sites are both very good, with a rate of 13 minutes per ..inch
on parcel # 3 and 1 minute per inch- on parcel # 1 Boring
to 11 ft. indicates light brown sandstone. Depth to bedrock
is good if it is 6 ft. or more. 'Our septic suitability would
be rated as "well suited" using this data and table 603-10.

BACKGROUND:
This matter was first heard at the Planning Commission on January 3,
1983. At that time the commission concurred with Staff' s recommenda-
tion and denied the request. The main concerns were the site' s steep
terrain and its difficulty in providing adequate access and building
sites. On February 15, 1983, however, the City Council conducted a
public hearing concerning an appeal of the Planning Commission' s de-
cision. Upon review, the Council moved to continue this matter to
March 14 , 1983 directing Staff to prepare Findings and Conditions
which would allow for approval of the Parcel Map. These Findings and
Conditions are included in this report. This two year Tentative Parcel
Map approval will expire on March 14, 1985 unless an extension is
granted.

D. ANALYSIS:
The original approval of this Tentative Parcel Map was granted
under the old Zoning Ordinance in March, 1983. Any time extensions
for the proposed lot divisions must be reviewed for compliance with
the current Zoning Ordinance, adopted July, 1983. In this case,
the minimum required lot size is 4 .82 acres. A 20% reduction results
in a minimum lot size of 3.85. The proposed lot sizes of 2.66 and
2. 79 acres are less than the required minimum lot size standards
in the RS zone and should, therefore, be denied.
E. RECOMMENDATION
Staff recommends denial of the time extension for Tentative Parcel

LOCATION: 7805 Santa Cruz Road (Lot 16, Block 51)

REQUEST: To allow division of a 5.44 acres parcel of land into two
parcels of 2.66 and 2.79 acres each.
BACKGROUND
1. Existing Zoning: A-1-B-V-2
2. General Plan: Suburban Single Family Residential
3. Environmental Determination: The applicant has completed an
Initial Study Environmental Description form. The Planning Direc-
tor has prepared a Draft Conditional Negative Declaration indicat-
ing the project will not have any significant adverse impacts upon
the environment if certain mitigation measures are incorporated
into the project.
4. Site Conditions: The site is located approximately 0.45 miles in
from Garcia Road on Santa Cruz Road, an unimproved dirt road with
a locked gate. Santa Cruz Road runs across a large swale which is
part of a creek in the wintertime. The site contains 5. 44 acres,
Average slope for the entire parcel is 27.5% using the `contour
measurement method. The level portion of the lot is located at
the road frontage and has an average slope of 12. 5%. The site is
densely covered with heavy brush and oak trees. A ranch house is
located on an adjacent lot. There are no utilities available to
this site with the exception of electricity which will entail ex-
tension of overhead lines.
5. Project Description: The applicant requests permission to divide
his 5. 444 acre parcel of land into two lots of 2.659 and 2.785
acres each on unimproved Santa Cruz Road. Each parcel has front-
age on Santa Cruz Road but that road is not improved westerly of
Garcia Road.

STAFF COMMENTS
On Thursday, December 2, 1982 the Subdivision Review Board met with
the applicant, Frank Mecham, and his engineers from Associated Prof-
essions, Inc. Also in attendance at the meeting were: Fred Buss,
Associate ' Planner, and Patience West, Senior Engineering Technician.
Thefollowingitems of concern were discussed:
Minimum lot size consistency with the General Plan (Page 60, Suburban
Single Family Residential) :
1. Slope of the access road to the building site.
2. Availability of services.
3. Distance from the center of the community (Central Business
District)
4. General character of neighboring lands.
5. Percolation
6. Area needed for access road to the building site
Staff is concerned with General Plan consistency regarding lot size.
This site fronts on Santa Cruz Road, a road that is still in the pri-
vate ownership. The road is not improved and continues beyond a
locked gate. Sections of the road pass through major drainage swales
and are susceptible to inundation. Road grades exceed 12% at some of
these swales. The subject property is located almost half a mile from
the nearest improved road (Garcia Road). Water and gas are not avail-
able anywhere on Santa Cruz Road and electric service would require
extension of lines and poles. The site is slightly over three miles
away from the edge of the Central Business District and approximately
one quarter of a mile from the City boundary. of the lots located on
Santa Cruz Road within a half mile of the site in both directions (ex-
cluding the Yeoman tract) , the average lot size is approximately 4.5
acres. Soil Conservation Service maps indicate that this area gener-
ally has severe septic suitability. Building sites on the proposed
parcels would be immediately adjacent to Santa Cruz Road.
The existing zoning designation, A-1-B-V-2, would indicate an average
lot size of two acres for this area, but the B-V-2 designation also
provides for a 3 1/2 acre minimum lot size where slopes are between 25
and 35%. However, this has been superceded by the General Plan. The
General Plan criteria indicates that minimum lot sizes in this area
should be at the upper end of the 2 1/2 to 10 acre range of the Subur-
ban Single Family Residential designation rather than at the minimum
size being requested.

FINDINGS
0 1. The tentative parcel map does not conform with criteria set forth
in the 1980 Atascadero General Plan governing minimum lot size in
the Suburban Services area.
2. The creation of lots near the minimum lot size allowed by the Sub-
urban Single Family Residential land use designation is inappro-
priate due to the site' s location at the westerly City boundary,
due to poor percolation quality in the immediate vicinity and due
to the average lot size now existing in the surrounding area.
3. The tentative parcel map does not conform with existing zoning
regulations governing lot size due to its average slope.
RECOMMENDATION
Based upon the above Findings, the Planning Department recommends
denial of Tentative Parcel Map AT 821108:1.
ACTION
The Planning Commission should, by motion, direct Staff as deemed
appropriate.

REQUEST: To allow division of a 5.44 acre parcel into two parcels
of 2.66 and 2.79 aures each.
On February 15, 1983, the City Council conducted a public hearing con-
cerning an appeal of the Planning Commission' s decision to deny the
above-referenced parcel map. Upon review, the Council moved to con-
tinue this matter to the meeting of March 14 , 1983 directing Staff to
prepare Findings and Conditions which would allow for approval of the
Parcel Map.
FINDINGS
1. The Tentative Parcel Map generally conforms with criteria set
forth in the 1980 Atascadero General Plan governing lot size in
the Suburban Services area.
2. The creation of lots near the minimum lot size for the Suburban
Single Family Residential range is appropriate due to the exis-
tence of two relatively flat building sites near Santa Cruz Road
and due to the existence of some lots of similar or smaller size
in the neighboring area.
3. The calculation of average slope does not reasonably reflect the
topographical characteristics of the property and, even though it
is part of existing zoning regulations, should not be used to
determine .minimum lot size.
4. The application as submitted will not have a significant adverse
effect upon the environment and the preparation of an Environmen-
tal . Impact Report is not necessary.

ENVIRONMENTAL DETERMINATION
Issuance of a Conditional Negative Declaration as follows:
1. Adequate provisions shall be made for drainage and erosion control
and protection in conjunction with site development and road con-
struction.
2. Adequate provision shall be made in design of private sewage dis-
posal systems to minimize effects on natural watercourses.
CONDITIONS
1. Private sewage disposal systems will be an acceptable method of
sewage disposal, if reports and designs are acceptable. All tests
and reports, designs shall conform to methods and guidelines pre-
scribed by the Manual of Septic Tank Practice and other applicable
City ordinances. The following shall appear on the Final Map:
"Appropriate soils reports including a percolation test, a test to
determine the presence of ground water, and a log of a soil boring
to a minimum depth of ten (10) feet shall be submitted to the
Planning Department prior to the issuance of a building permit.
Where soils reports indicate that conventional soil absorption
systems are not acceptable, City approval of plans for an alterna-
tive private sewage disposal system, designed by a Registered
Civil Engineer, shall be required. Depending upon the system,
more restrictive requirements may be imposed. "
2. Water shall be obtained from the Atascadero Mutual Water Company
and water lines shall exist ateachparcel frontage prior to fil-
ing of the Final Map. A letter from the Water Company indicating
they are willing and able to serve the property shall be submitted
to the Planning Department prior to recordation of the Final Map.
3. All other available utilities not already in place shall be ex-
tended underground to each parcel frontage at the time of building
permit.
4. One fire hydrant of a type and size specified by the City Fire De-
partment shall be installed by the applicant on Santa Cruz Road
along the frontage of his lots. Exact location and manner of
placement shall be subject to the approval of the Fire Department.
A letter from the Fire Department certifying the installation of
the hydrant shall be received by the Planning Department prior to
the recordation of the Final Map.
5. The driveway access shall be improved to at least the following
minimum standards:
- an improved width of 12 feet

- unobstructed vertical clearance of 14 feet
These standards shall appear as notes on the Fina-1 Map.
6. All driveways providing access to building sites shall be subject
to Planning Department review and approval at the time of building
permit application for each parcel. Plan and profile drawings may
be required. If average slope exceeds 12%, paved improvement
would be required similarly. In no event will driveways be allowed
which exceed 20% in slope. In the event any portion of a drive-
way is shared, improvement of the shared portion shall be a re-
quirement made in conjunction with the first building permit.
Notes to these effects shall appear on the Final Map.
7. Efforts shall be made to minimize grading that would be disruptive
to the natural topography and removal of existing mature trees.
The following shall appear as a Note on the Final Map:
"No trees shall be removed without compliance with applicable City
ordinances. No grading shall commence without an appropriate per-
mit and compliance with applicable City ordinances. "
B. Roof materials for all structures shall be Class C rating or bet-
ter and a Note to that effect shall appear on the Final Map.
9. Drainage swales shall be indicated on the Final Map and a Note
shall appear on the Final Map which states:
"Any modification of the ground during site development within
ie
fifty (50') feet of the drainage swales shall be subject to approv-
al by the Planning and Public Works Departments. "
10. Final grading and drainage plans prepared by a Registered Civil
Engineer for development on each parcel may be required to be sub-
mitted for review and approval by ..the Planning and Public Works
Departments prior to issuance of building permits. A Note to this
effect shall appear on the Final Map.
11. All pipeline and other easements of record shall be shown on the
Final Map. A letter shall be submitted from each utility company
indicating the nature and extent of any building restrictions. A
Note so stating such restrictions shall appear on the Final Map.
12. An offer of dedication to the public for road purposes for twenty
(20) feet along Santa Cruz Road for the entire property frontage
shall be shown on the Final Map and be made by certificate
thereon.
13. Santa Cruz Road shall be constructed along the frontage of the
property to City Standards including a minimum paved width of
twenty (20) feet with three (3) feet of graded shoulder on each
side of the paving prior to recordation of the Final Map.

a. Improvements to be constructed under an inspection agreement
. and encroachment permit issued by the Public Works Department.
b. Improvement drawings, including improvements to control grad-
ing and erosion within the road right-of-way, shall be sub-
mitted to the Public Works Department for review and approval..
14. Santa Cruz Road, between the subject property and the improved
section of Santa Cruz Road, shall be improved with an all-weather
surface. Said improvement is to be maintained by the property
owner (s) .
15. Improvements required by Conditions 2, 4, 13, and 14 may be de-
ferred for a period not to exceed three years by entering into an
agreement. Any such agreement shall include a bond, certificate
of deposit, or similar improvement guarantee acceptable to the
Public Works Department.
16. A Final Map in compliance with all conditions set forth herein
shall be submitted for review and approval in accordance with the
Subdivision Map Act and the City Lot Division Ordinance prior to
recordation.
a. Monuments shall be set at all new property corners created
and a Registered Civil Engineer or licensed land surveyor
shall submit a letter certifying that the monuments have been
set prior to recordation of the Final Map.
b. A recently updated preliminary title report shall be submit-
ted for review in conjunction with the processing of the
Final Parcel Map.
17. Approval of this Tentative Parcel Map shall expire two years from
the date of final approval unless an extension of time is granted

On March 14 , 1983 the City Council considered findings and conditions
for approval set forth in the March 9, 1983 memo but continued the
matter due to the applicant' s request to use wells rather than commu-
nity water. If wells are allowed, the following conditions are
appropriate.
18. Each parcel shall have its own private well or wells for i
domestic water supply approved by the County Health Dept.
19. Evidence of adequate and potable water, satisfactory to the
County Health Department, shall be submitted to the City
prior to the filing of the Final Map, which will include the
followings
a. (Potability) A complete onsite chemical analysis shall
be submitted for evaluation.
b. - (Adequacy) On individual parcels and/or community wells
or test holes a minimum four (4) hour pump test per-
formed by a licensed and bonded well driller or pump
test%ng business shall be submitted for review and
approval.
20 . Individual domestic and/or agricultural wells shall be sep-
arated from private sewage disposal systems as prescribed by
the Uniform Plumbing Code and the Manual of Septic Tank
Practice.
21. Onsite supply facilities for fire-fighting purposes shall be
as follows:
a. A minimum 2500 gallon water storage tank for each parcel
installed in a manner and exact location specified by
the Fire Department prior to filing the Final Map.

b. Fire-fighting systems shall be provided with any of the
following devices to enable connection to fire pumping
trucks, provided that such devices are to be located
within a maximum of two hundred (200) feet from any
structure served, in a manner accessible to a fire
vehicle. Where water supply is provided by electric
pump, an electric service drop shall be installed from
service pole, to pump, to the structure, to prevent a
structural fire from disrupting access to water. Work
connections are to be provided as follows:
i) A 2 1/2 inch National Standard fire thread fit-
ting from a water distribution system or stor-
age facility; or,
ii) A wharfhead hydrant with piping, of a size and
type specified by the Fire Department, from an
approved storage facility; or,
iii) Any other means approved in writing by the Fire
Chief.
There is a policy issue that needs to be addressed concerning the use
of wells in lieu of community water. It seems clear that wells for
agricultural uses are appropriate but wells for domestic use in areas
that can reasonably be served by community water may be another mat-
ter. The following concerns should be considered:
- Adequacy of fire protection - The water storage tanks are not
considered to be effective protection because of the limited
supply although, in remote areas devoid of community water,
these provide at least some protection.
- Completion of community water system - When community water is
eventually intended to serve an area according to the Atasca-
dero Mutual Water Company Master Plan) , system improvements can
be accomplished more rapidly by requiring water line extensions
with discretionary projects.
- Equitable cost-sharing for infrastructure Both community
water and hydrants will eventually serve a area but this owner
could avoid his fair-share of at least the hydrant costs by not
connecting to community water while still receiving some bene-
fit. Since the Water Company provides for a recovery charge,
the water line extender can receive back part of his outlay as
others connect. Furthermore, the Water Company and City cooper-
ate by getting "paper roads" to final grade and proper alignment
when water lines are extended.
In this case, the water line in Garcia Road is approximately 2400 feet
from the Mecham parcel although this distance would be lessened quite
a bit if the Yeomans Tentative Tract Map approval is finalized.

It should also be pointed out that having reasonable development
standards for roads, utilities and other infrastructure minimize pre-
mature, speculative land divisions in remote areas.
'RECOMMENDATION
The Planning Commission recommends denial of Tentative Parcel Map AT
821108:1. If approved, the Planning Director recommends adoption of
Findings 1-4 and Conditions 1-17 as set forth in the March 9 memo
(Note: This would preclude a private well for domestic purposes) .
If onsite wells are allowed, then Conditions 2 and 4 (from March 9
memo) should be replaced with Conditions 18-21 (from March 23 memo)
and Condition 15 (from March 9 memo) should be revised to delete ref-
erence to Conditions 2 and 4 and include reference to Condition 21.

ANALYSIS:
There is no mirimun lot size in the CR. (Commercial Retail) zone. Staff
review focuses on the design and accessiblility of each of the four
lots for Commercial uses.
Staff' s main concern in this regard is that Parcel B requires access
off of Portola Road in the submitted design. Portola Road is primarily
residential in this area and is not adequate or appropriate for commer-
cial access. By either combining Parcels B and C or providing access
to Parcel B from West Front, this problem can be corrected.
The other main issue of this proposal concerns the abandoned gas sta-
tion at the corner of West Front and Portola. This structure is a
nuisance and the City presently has an open enforcement case on the
building. This structure is defined as a dangerous building under Sec-
tion 302 of the Uniform Code for the Abatement of Dangerous Buildings.
The structure needs to be either demolished or adequately upgraded at
this time.
RECOMMENDATION:
Staff recommends approval of Tentative Parcel Map 3--85 based on the
Findings and Conditions contained in Exhibit A.

FINDINGS:
1. The creation of three or four lots on these two parcels conforms
to all applicable zoning and subdivision regulations and is con-
sistent with the General Plan.
2. The creation of three lots in conformance with the recommended
conditions of approval will not have a significant adverse effect
upon the environment, and preparation of an Environmental Impact
Report is not necessary.
CONDITIONS OF APPROVAL:
1. Parcel Map shall be modified to either combine Parcels B and C or
provide appropriate access easements from West Front to Parcel B.
2. Curb, gutter, sidewalk, drainage structures, and street paveout
shall be constructed along the full property frontage on West
Front Road and Portola Road. Road improvement plans shall be
designed by a registered Civil Engineer and submitted to Public
Works for review and approval.
3. An in-lieu sewer connection fee of $26.35 per fixture unit as
defined in the U.P.C. , shall be due in addition to the usual fees
at the time of connection to the public sewer.
4. Additional fire hydrants shall be required. Exact number and lo-
cation shall be determined by the Fire Department when development
plans are submitted.
5. Abandoned gas station at the corner of Portola and West Front
shall either be demolished in accordance with City ordinances or
brought into a state where it is no longer an attractive nuisance,
prior to the filing of the final map. Underground gas tanks, if
present, shall be removed prior to recordation of "Final Map.
6. Drainage and erosion control plans, prepared by a Registered Civil
Engineer, shall be submitted for review and approval by the Plan-
ning Department prior to issuance of building permits in conjunc-
tion with installation of driveways, access easements or structures.
7. Plan and profile drawings of proposed individual driveways and
driveway easements shall be submitted for approval by the Planning
and Public Works Departments in order to determine average grade
and appropriate improvement requirements.

a) Special assessment/maintenance district - will require con-
siderable involvement of the Department of Public Works staff.
Hence, fulfilling of the department head and associate engineer
positions will be necessary.
b) Downtown Improvement Association - Planning staff could provide
mapping assistance in defining alternative boundaries for D.I.A.
Establishment of D. I .A. as a legal entity with taxing powers, '
etc. will involve the City Manager, Finance Director,' .City
Attorney, and City Engineer.
c) Lewis Avenue Bridge - There is a need to establish an equitable
bridge financing formula to determine participation require-
ments of Bank of America, Century Plaza Shopping Center, and
other future private developers. This will require preparation
of estimates for its construction and review of alternative
methods of funding. Again, the City Engineer ' s office would
be orivotal in this analysis. Planning staff could assist in
preparing up-to-date information on development and activity
in the corridor which would be utilizing the bridge.
STAFF RECOMMENDATION:
Predicated on your conceptual acceptance of the Task Force ' s rec-
ommendations, it is recommended that positive staff action be held
in abeyance pending the hiring of the City Manager and Public Works"
Director. Should Council desire to initiate a consultant study
on the cost and funding alternatives for the Lewis Avenue Bridge,
staff could bring back a cost estimate for such consultant services
and necessary budget action to transfer funds .
Councilman Molina said that he agreed with the staff recommendations
but thinks that the Council should put in a "line item" for budget
so that money can be appropriated to enact these three recommendation

sultant in regards to the Lewis Avenue Bridge. Also Henry Engen w

could start looking at the zone changes for the downtown area in
regards to parking and other developmental standards . In other
areas we need to wait to see what the business peopleinthe area
are willing to do.
Gary Larson from the Chamber of Commerce Office said now is the
time to go through a series of steps if we want to create a down-
town improvement association.
Mayor Nelson said he thought we should wait until recruitment for

Allen Grimes, City Attorney, said that many cities have informal
written ballots of the property owners to ascertain if there is
a majority or. not before you incur the expense and before you
go ahead with a formal hearing.
Ralph Dowell, Acting City Manager, said he would like to come back
to the Council with a completely laid out program of what can be
done and how we intend to do it. He said he still has some ques-
tions in his mind of the exact boundaries of this district and
things what have to be looked at, including the possibility of a
ballot of property owners to get a feel for .the district.
Mayor Nelson said he would like to give items A, B, and C to
staff and let them bring it back to the council and give an idea
on cost and how it is going to be achieved.
MOTION: By Councilman Molina, seconded by Councilwoman Mackey to conception
ally accept the Revitalization Task Force recommendations andto
go along with staff recommendations and start immediately on the
Lewis Avenue Bridge. Passed 4 :1 with Councilman Handshy voting no.
Mayor Nelson thanked Maggie Rice and Gary Larson of the Chamber
of Commerce Office and George Molina for all of their work on this
project.

WHEREAS, the proposed zoning ordinance amendment proposes standards
consistent with the General Plan as required by Section 65860 of the
California Government Code; and
WHEREAS, the proposed amendment is in conformance with Section 65800

tions; and
WHEREAS, the proposed amendment will not have a significant adverse

WHEREAS, Atascadero Planning Commission has held a public hearing and
has recommended approval of Zoning Ordinance Text Amendment 2-85.
NOW, THEREFORE, the City Council of the City of Atascadero does ordain
as follows:
Section 1. Council Findings.
1. The proposed zoning ordinance text amendments propose standards
consistent with the General Plan as required by Section' 65860 of
the California Government Code.
2. The proposed Code Amendment is in conformance with Section 65800
et seq. of the California Government- Code concerning zoning regu-
lations.
3. The proposed amendment will not have a significant adverse effect
upon the environment, and the preparation of an Environmental Im-
pact Report is not necessary.
Section 2. Zoning Text Change:
Zoning Ordinance Text Amendment 2-85 is approved to change the text as
follows:
1. Modify Subsection (a) to 9-4 .141 (Grading Permit - Application
Content) as follows:
(a) Minor Grading: Where Section 9-4.140 requires a grading permit
and the grading will move less than 5,000 cubic yards and is
located on slopes less than 200; the application for a grading
permit is to include the following:

2. Revise the wording of ,Section 9-4.143 (b) to read as follows:
(b) Creation of Building Sites - Slope Limitations: Grading
for the purpose of creating a site for a building or structure
shall be prohibited on slopes of TWENTY PERCENT (20%) or
greater except where authorized through PRECISE PLAN
approval.
Section 3. Publication.
The City Clerk shall cause this ordinance to be published once, within
fifteen (15) days after its passage in the Atascadero News, a news-
paper of general circulation, printed, published and circulated in this
' City in accordance with Government Code Section 36933; shall certify
the adoption of this ordinance; and shall cause this ordinance and its
certification to be entered in the Book of Ordinances of this City.
Section 4 . Effective Date.
This ordinance shall go into effect and be in full force and effect
at 12 :01 a.m. onthethirty-first (31st) day after its passage.
The foregoing ordinance was introduced on March 11, 1985, and adopted

The attached Resolutions 58-84 and 59-84 are presented to you for
your consideration of accepting portions of Los Altos Road and
San Marcos Road into the City of Atascadero Street Maintenance
System.
Both roads were constructed by Dick Davis (Consulting Engineer
is Twin Cities Engineering) and inspected throughout the con-
struction by Public Works personnel and the engineer. The Public
Works Engineer .did a final inspection and approved the roads on
February 21, 1985. The as-built plans have been found to be
satisfactory.
Staff recommends Council APPROVE Resolutions 58-84 and 59-84 and
ACCEPT Los Altos Road and San Marcos Road into the City of
Atascadero Street Maintenance System, subject to the road con-
struction agreement previously executed on August 30, 1982.. This
agreement provides for st"reet maintenance by Mr. Dick Davis for
a period of one (1) year after acceptance.

. ACCEPTING PORTIONS OF LOS ALTOS ROAD INTO THE CITY
S'T'REET MAINTENANCE SYSTEM
The Council of the City of Atascadero resolves as follows:
1. Pursuant to the provisions of Section 1806 of the California Streets
and Highways Code, the following street is hereby accepted for maintenance
into the City Street system.
That portion of Los Altos Road running between Highway 41 and San Marcos
Road more particularly described as follows:

NEW ZONING SECTION 9-3.649. ZC 7-84 (YEOMANS)
WHEREAS, the proposed zoning ordinance amendment is consistent with
the General Plan as required by Section 65860 of the California
Government Code; and
WHEREAS, the proposed amendment is in conformance with Section 65800
et seq. of the California Government Code concerning zoning regula-
tions; and
WHEREAS, the proposed amendment will not have a significant adverse
effect upon the environment and preparation of an Environmental Impact
Report is not necessary; and
WHEREAS, the Atascadero Planning Commission has held three (3) public
hearings and has recommended approval of Zoning Ordinance Amendment
7-84 on February 12, 1985.
NOW, THEREFORE, the City Council of the City of Atascadero does ordain
as follows:
Section 1. Council Findings.
1. The proposed revision will not have a detrimental effect upon the
community' s health, safety and welfare.
2. The proposed revision is consistent with City ordinances and the
General Plan.
3. Pursuant to the California Environmental Quality Act, the Negative
Declaration granted the project by the Planning Commission is
appropriate.
Section 2. Zoning Text Change:
Zoning Ordinance Amendment 7-84 is approved to add the following
Section 9-3. 649 to read as follows:

1. That the zoning text be changed to include the establishment of
Planned Development Overlay Zone No. 5 as follows:
9-3. 649 . Establishment of Planned Development Overlay Zone
No. 5 CPD-5) . The Planned Development Overlay Zone No. 5 is
established as shown on the Official Zoning Maps (Section 9-1.102) .
The following conditions of development are established:
(a) Development shall conform to the approved Summerfield Devel-
opment Plan as modified by applicant' s letter of February 7,
1985. (Exhibit "B")
(b) Development shall be subject to any City-wide development fee
schedule which may be adopted by the City Council.
Section 3. Zoning Map Change
Zoning Ordinance Map Amendment 7-84 is approved to change Zoning Map
No. 19 as indicated in Exhibit "A" .
Section 4 . Publication.
The City Clerk shall cause this ordinance to be published once, within
fifteen (15) days after its passage in the Atascadero News, a news-
paper of general circulation, printed, published and circulated in this
City in accordance with Government Code Section 36933; shall certify
the adoption of this ordinance; and shall cause this ordinance and its
le
certification to be entered in the :Book of Ordinances of this City.
Section 5 Effective Date.
This ordinance shall go into effect and be in full force and effect
at 12 : 01 a.m. on the thirty-first (31st) day after its passage.

This is to inform you that I, on behalf of the neighborhood, am appealing the City Council's
decision to certify a Negative Declaration on the Environmental Impact Study for the Yeomans/Lindsey
Project located on lot 24, block 4 of tract Eaglet #1. The reasons for this appeal are as cited below:
1. From the first Planning Commission hearing, and through all four subsequent hearings, there has
been a very large and vocal opposition, both from neighborhood and city residents, objecting to the
negative environmental impact which this project will have on our neighborhood and the city itself.
2. The project will seriously disrupt the ecology of a particularly beautiful piece of property
within the neighborhood. Specifically, it will: disrupt a seasonal stream & bog, destroy many large
natural Oaks, and aggravate a serious drainage problem already in the neighborhood.
3. Problems with school overcrowding, neighborhood traffic safety, main traffic artery access,
water & sewege capacity, road& culvert maintenance, police crime control, and adequate fire protection
make City Services marginal under current conditions. The addition of 24 new homes in the proposed
configuration will make the situation totally unreasonable.
When considering these and other lesser issues, it is incomprehensible to us that the City Council
would choose to remove the requirement for a full Environmental Impact Study on the project in
question.

AN ORDINANCE OF THE COUNCIL OF THE CITY OF ATASCADERO
AMENDING CHAPTER 9 OF TITLE 2 OF THE ATASCADERO

AND AMENDING CHAPTER 13 OF TITLE 2 OF THE ATASCADERO
MUNICIPAL CODE RELATING TO THE RECREATION COMMISSION
The Council of the City of Atascadero does ordain as follows:
Section 1. Sections 2-9.01 through 2-9.07 of Chapter 9 of Title 2
of the Atascadero Municipal Code, relating to the Planning Commission,
are repealed, effective immediately, but said repeal shall not opera-
tive until June 1, 1985.
Section 2. Chapter 9 (Reorganized) is added to Title 2 of the
Atascadero Municipal Code, relating to the Planning Commission, to
read as follows, to become operative on June 1, 1985 :
CHAPTER 9. PLANNING COMMISSION (Reorganized)
Sec. 2-9.01 . Creation: Composition.
There is created a Planning Commission for the City which
shall consist of five (5) members who shall not be officials
or employees of the City, but who shall be residents of the
City.
Sec, 2-9.02 . Members: Anointment: Terms of office.
The City Council shall appoint the members of the Plan-
ning Commission. Two (2) members shall be appointed for terms
commencing June 1, 1985, which terms shall expire on August 1,
1986. Three (3) members shall be appointed for terms commenc-
ing June 1, 1985, which terms shall expire on August 1, 1988.
Thereafter, all terms shall be for four (4) years and shall
expire four (4) years after August l of the date of the ap-
pointment, except those appointments made after the commence-
ment of the term to fill a vacancy or removal, in which case
the term of office shall be for the balance of the unexpired
term.
The terms of each of the existing members of the Planning
Commission shall expire on June 1, 1985.
Sec, 2-9.03 . Absence from meetings: Running for office
on City Council .
Absence of a member of the Planning Commission from three
(3) consecutive meetings, or from four (4) meetings during a

calendar year, without formal consent of the Planning Commis-
sion noted in its official minutes, onstitutes the voluntary
resignation of such absent member, and the position shall be
declared vacant._ If a member of the Planning Commission files
for�electon as a member of any elective City office, his term
as Planning Commissioner shall terminate as of the date of
filing.
Sec. 2-9.04 . Members: Removal from office.
A member of the Planning Commission may be removed by a
majority vote of all of the members of the Council.
Sec. -9.05 . Vacancies.
A vacancy on the Planning Commission occurring by death,
resignation, removal, or any other cause before the expiration
of the term of the member shall be filled by appointment for
the unexpired term by the Council.
Sec, 2-9.06. Expenses.
Planning Commission members shall be entitled to remunera-
tion for expenses in accordance with the procedure approved by
resolution of the Council.
Sec. 2-9.07 . dowers, duties. and functions.
The powers, duties, and functions of the Planning Commis-
sion shall be all those powers, duties, and functions of a
Planning Commission and Board of Zoning Adjustment as provided
in Chapters 3 and 4 of Title 7, . commencing with Section 65100
of the Government Code of the State (the Planning and Zoning
Law) , as the same may be hereafter amended. The Planning Com-
mission shall perform such other duties and functions as may
be directed or designated by the Council not inconsistent with
State law.
Sec, 2-9.08. Chairman: Rules: Records and meetings.
As of August l annually, or as soon thereafter as is fea-
sible, the Planning Commission shall elect a chairman and a
vice chairman from among its members, shall adopt rules for
the transaction of business, shall keep a public record of its
resolutions, transactions, findings, and determinations, and
shall hold at least one (1) regular meeting each month.
Section 3 . Sections 2-13 .01 through 2-13.12 of Chapter 13 of
Title 2 of the Atascadero Municipal Code, relating to the Parks and
Recreation Advisory Board, are repealed, effective June 1, 1986,
and shall become operative thereafter.

Atascadero Municipal Code, relating to the Parks and Recreation Com-
mission, to read as follows:
CHAPTER 13. PARKS AND RECREATION COMMISSION (Reorganized)
Sec. 2-13.01. Established.
There is created a Parks and Recreation Commission com-
posed of five (5) members.
Sec. 2-13.02. Oualifications.
The regular members of the Commission shall be qualified
electors of the City.
Sec. 2-13 .03 . Membegs: Agc_ointment: Terms of office.
The City Council shall appoint the members of the Parks
and Recreation Commission. Two (2) members shall be appointed

Absence of a member of the Commission from three (3) con-
secutive meetings, or from four (4) meetings during a calendar
year, without formal consent of the Commission noted in its

Sec. 2-13 .10. Duties and responsibilities.
The duties and responsibilities of the Parks and Recrea-
tion Commission shall be to:
(a) Act in an advisory capacity to the City Council in
all matters pertaining to parks and public recreation and to
cooperate with other governmental agencies and civic groups in
the advancement of sound park and recreation planning and pro-
gramming;
(b) Formulate policies and parks and recreation services
for consideration by the City Council;
(c) Meet with the City Council at least once each year to
discuss policies, programs, future needs, or other matters
requiring joint deliberations. More frequent meetings may be
held if deemed necessary by a determination of a majority of
members of the City Council and Parks and Recreation Commis-
sion. All such meetings shall be held in accordance with
statutory requirements governing public meetings;

(d) Recommend to the City Council the development and
improvement of parks, recreational areas, facilities, pro-
grams, and recreation services;
(e) Make periodic surveys of parks and recreation ser-
vices that exist or may be needed and ascertain the needs of
the public for such services;
(f) Assist in coordinating parks and recreation services
with the programs of governmental agencies and voluntary or-
ganizations;
.(g) Disseminate to the public information concerning the
policies and functions of the Parks and Recreation Department;
(h) Advise the Recreation Director in the development and
operation of the parks and recreation programs and facilities
(i) Suggest rules and regulations governing the use of
parks and recreation areas and facilities.
Sec. 2-13.11. _Recreation Director: Meetincgattendance:
Reports.
The Recreation Director shall attend the meetings of the
Parks and
Recreation Commission and shah make such reportsto
the Commission, the City Manager, or to the City Council as
may be required.
Sec 2-13 .06. Expenses.
Commission members shall be entitled to remuneration for
expenses in accordance with the procedure approved ,by resolu-
tion of the Council.
Section 5. The City Clerk shall cause this ordinance to be pub-
lished once within fifteen (15) days after its passage in the Atasca-
dero News, a newspaper of general circulation, printed, published and
circulated in this City in accordance with Government Code Section
36933; shall certify the adoption of this ordinance; and shall cause
this ordinance and its certification to be entered in the Book of
Ordinances of this City.
Section 6. This ordinance shall go into effect at 12:01 A.M. on
the thirty-first (31st) day after its passage, but shall become opera-
tive only as specifically provided therein.

MEMORANDUM
TO: Atascadero City Council

SUBJECT: Recommendations regarding City Ordinance No. 101 as it
relates to the Parks and Recreation Advisory Board
DATE: March 15, 1985
Members of this advisory body during; a regular meeting on March
14 reviewed a draft copy of City Ordinance No . 101 which in part would
amend Chapter 13 of Title 2 of the Atascadero Municipal Code relating
to the Parks and Recreation Advisory Board.
Ater extensive discussion of the proposed ordinance the advisors
directed me to forward the following recommendations to you:
.Sec . 2-13. 01 This board believes the community would be better
served if the makeup of the Parks and Recreation Commission were to
remain at 7 members. The seven members represent a broader range of
public interest and input and enhance the effectiveness of this body.
Sec . 2-13. 03: Lle recommend that the council appoint three members
in June of 1986 for two pears and four members appointed in June of
1986 for four year terms. After that all terms will be for four years.
The majority of the advisors believe that if the council does not
concur with our recommendation for a seven-member board, then the terms
of the existing members should expire on June 1, 1985 to coincide with
the new planning commission appointments. If the council believes it
still wants a five-member recreation commission, the advisors feel June 13
1985 is the time to make such a change . Extending this board for one year
would, in a sense, result in a "lame duck" atmosphere.
Sec . 2-13. 04 : We believe that an ex-officio member from the city
council should also be represented on this body as has been the case
since we were first organized in the summer of 1980.
Sec . 2-13 . 05: The advisory board agrees with the intent of this
section. It is recommended however, that the language be cleared up
in reference to " . ..formal consent of the commission noted in its
official minutes. . . "
Sec . 2-13. 09: This board believes the city should provide a clerk
to cover and record the minutes of our meetings, just as clerical
support is afforded the planning commission. It reduces the ability of
a member to participate in the discussions if he or she must write notes
for accurate minutes. Trlhether the board remains at 5 or 7 members, the
need for a clerk remains the same.

Sec . 2-13. 11: This board is unanimous in its desire to have the
city' s public works director attend the meetings of this board along
with the recreation director. It is virtually impossible to discuss both
recreation and parks if the respective heads of those departments are
not present to answer our questions or react to our suggestions. If the
city council concurs with this board' s decision to combine parks and
recreation into a single department, then this section should read:
" . . .Parks and Recreation Director shall attend. . . " This body has been
less than effective in the past because there has been no consistent
input to this group from public works, which currently is in charge of
all parklands.
This board urges the city council give the fullest consideration
to its recommendations for City Ordinance No. 101. 1e believe that our
role is to bring to the city council the broadest form of public input
and interests which should result in the best programs affordable for
the greatest number of citizens .

Rotunda Room, of the Administration Building, Atascadero, California.
