REGULAR SESSION — CALL TO ORDER: 6:00 P.M. Mayor O'Malley called the meeting to order at 6:01 p.m. and Council Member Moreno led the Pledge of Allegiance. Zi1KSJT" Present: Council Members Bourbeau, Moreno, Sturtevant, Mayor Pro Tem Fonzi and Mayor O'Malley Absent: None Also Present: Treasurer Gere Sibbach Staff Present: City Manager Rachelle Rickard, Administrative Services Director Jeri Rangel, Public Works Director Nick DeBar, Lieutenant Jason Carr, Community Development Director Phil Dunsmore, Fire Chief Casey Bryson, City Attorney Brian Pierik and Deputy City Manager/City Clerk Lara Christensen APPROVAL OF AGENDA: MOTION: By Council Member Sturtevant and seconded by Mayor Pro Tem Fonzi to: 1. Approve this agenda; and, 2. Waive the reading in full of all ordinances appearing on this agenda, and the titles of the ordinances will be read aloud by the City Clerk at the first reading, after the motion and before the City Council votes. CONSENT CALENDAR: City Council Draft Action Minutes — November 13, 2018 • Recommendation: Council approve the City Council Draft Action Minutes of the November 13, 2018, City Council meeting. [City Clerk] 2. October 2018 Accounts Payable and Payroll • Fiscal Impact: $2,851,372.35 • Recommendation: Council approve certified City accounts payable, payroll and payroll vendor checks for October 2018. [Administrative Services] 3. Side Letter of Agreement for the Service Employees International Union Local 620 • Fiscal Impact: None. • Recommendations: Council: 1. Approve the Side Letter of Agreement for the Service Employees International Union Local 620. 2. Approve the Salary Schedule for Fiscal Year 2018-2019. [City Manager] 4. Approve Final Map for Tract 3078 - Vieio Camino and Santa Barbara Rd • Fiscal Impact: None. • Recommendation: Council adopt Draft Resolution approving the Final Map for Tract 3078 and accepting portions of the subdivision public improvements into the City of Atascadero Wastewater Collection and Roadway systems and authorizing the City Engineer to accept the work as complete. [Public Works] MOTION: By Council Member Moreno and seconded by Mayor Pro Tem Fonzi to approve the Consent Calendar. (#A-3: Contract No. 2018-013 (A-1), #A-4: Resolution No. 2018-065) Motion passed 5:0 by a roll -call vote. UPDATES FROM THE CITY MANAGER: City Manager Rachelle Rickard gave an update on projects and issues within the City. COMMUNITY FORUM: The following citizens spoke during Community Forum: Dana Holland, Felicia Hammond, Barbie Butz and Geoff Auslen Mayor O'Malley closed the COMMUNITY FORUM period. B. PUBLIC HEARINGS: None. Atascadero City Council November 27, 2018 Page 2 of 5 C. MANAGEMENT REPORTS: 1. Use of Armory as a Warming Shelter • Fiscal Impact: Fiscal impact will depend on Council direction to staff. • Recommendation: Council provide staff direction on whether to work through a process to consider using the Armory as a Warming Shelter as proposed by Transitional Food & Shelter (TFS). [City Manager] City Manager Rickard gave the staff report and answered questions from the Council. Wendy Lewis, ECHO President and CEO and Laurel Weir, SLO County Homeless Services Coordinator also answered questions from the Council. Ex -Parte: Council Member Bourbeau reported speaking with Orlando Gallagos, Jerry Clay and a representative for the National Guard Armory. Mayor Pro Tem Fonzi reported speaking with both Jerry Clay and Donn Clickard. Council Member Moreno reported speaking with a number of Atascadero School Board Members regarding the issue as well as Supervisor Debbie Arnold. Council Member Sturtevant reported there being some discussion regarding the issue at the recent City/Schools Committee meeting. On behalf of Transitional Food & Shelter, Inc., Orlando Gallagos answered questions from the Council. At the request of Mayor O'Malley, Deputy City Manager/City Clerk Christensen read several emails received by the City Council into the record. Copies of the emails were placed in the public review book as well. Mayor Pro Tem Fonzi read a text message she had received from Michael Sheerer into the record. Council Member Moreno also read an email she received from Vicky Morse into the record. PUBLIC COMMENT: The following citizens spoke on this item: Jerry Clay, Dana Holland, Jeff Wilshusen, Jan Masen, Joseph Issac Colanya, Paul Martinez, Mary Kay Mills, Susan Warren, Dan Ulrich, Diane Rehfield, Gere Sibbach, Geoff Auslen, Terri Switzer, Charlotte Burn, Betty Sandry and Jake White Mayor O'Malley closed the Public Comment period. Mayor O'Malley recessed the meeting at 8:31 p.m. Mayor O'Malley reconvened the meeting with all present at 8:42 p.m. MOTION: By Mayor Pro Tem Fonzi and seconded by Council Member Moreno to direct staff to reject the Transitional Food & Shelter proposal for use of the Armory as a warming shelter. Declaration of a Shelter Crisis and Authorization of the City of Atascadero's Participation in the Homeless Emergency Aid Program (HEAP) • Fiscal Impact: The exact amount of funding would be determined as part of the HEAP funding award process. • Recommendation: Council adopt the Draft Resolution declaring a shelter crisis in the City of Atascadero pursuant to SB 850 (Chapter 48, Statutes of 2018 and Government Code §8698.2) and authorizing the City's participation in the newly established Homeless Emergency Aid Program (HEAP). [City Manager] City Manager Rickard gave the staff report and answered questions from the Council. Laurel Weir, SLO County Homeless Services Coordinator also answered questions from the Council. PUBLIC COMMENT: The following citizens spoke on this item: Jerry Clay, Eric Gobler, Wendy Lewis, Felicia Hammond, Susan Funk, Susan Warren and Dan Ulrich Mayor O'Malley closed the Public Comment period. Following the motion by Mayor O'Malley and seconded by Council Member Bourbeau, Council Member Moreno requested that the motion be modified to declare a shelter crisis through June 30, 2021. MOTION: By Mayor O'Malley and seconded by Council Member Bourbeau to adopt Resolution No. 2018-066 declaring a shelter crisis, through June 30, 2021, in the City of Atascadero pursuant to SB 850 (Chapter 48, Statutes of 2018 and Government Code §8698.2) and authorizing the City's participation in the newly established Homeless Emergency Aid Program (HEAP). Motion passed 5:0 by a roll -call vote. Mayor O'Malley recessed the meeting at 9:42 p.m. Mayor O'Malley reconvened the meeting with all present at 9:49 p.m. 3. Downtown Watershed Plan Project Status Update • Fiscal Impact: None. • Recommendation: Council provide feedback on Draft Downtown Watershed Plan and authorize submittal to Regional Water Quality Control Board for review. [Public Works] Public Works Director DeBar gave the staff report and introduced representatives of Rick Engineering who presented the Draft Downtown Watershed Plan. Both Public Works Director DeBar and the consultants answered questions from the Council. There was a request to make a motion to go past 11:00 p.m. MOTION: By Council Member Moreno and seconded by Mayor Pro Tem Fonzi to continue the meeting past 11:00 p.m. Motion passed 4:1 by a roll call vote. O'Malley voted "No". MOTION: By Council Member Moreno and seconded by Council Member Bourbeau to authorize submittal of the Draft Downtown Watershed Plan to Regional Water Quality Control Board for review. Motion passed 5:0 by a roll -call vote. COUNCIL ANNOUNCEMENTS AND REPORTS: None. D. COMMITTEE REPORTS: The following Council Members gave brief update reports on their committees since the last Council meeting: Council Member Bourbeau 1. Homeless Services Oversight Council E. INDIVIDUAL DETERMINATION AND / OR ACTION: 1. City Clerk — Deputy City Manager/City Clerk Christensen announced that Commissioner terms expire at the end of the year. There are two at -large positions for the Planning Commission, one at -large position on the Design Review Committee, and two Council appointments for the Citizen Sales Tax Oversight Committee. The Armory is across the street from 2 schools with students 12 years and younger. The Armory is next to the Community Center which exists to attract our youth. It is inconceivable that anyone would consider exposing children to a multitude of unknown adults without any restrictions or consideration to the adults' drug addictions, criminal history, or anger management issues. Even if it were not for the fact that the Armory is located in a spot that provides easy access to hundreds of children, the Armory is in a state of extreme disrepair and is not suitable for human habitation. I have called the PD several times on what appear to be homeless people acting out. Sometimes at 3-4 in the morning. If you go over to the armory at about the time school gets out you will see how the kids congregate and cross the armory property. If I remember correct, there was a recent arrest of a sex offender in the area. Who monitors if the homeless are sex offenders. Again, let me state: "It is a bad idea to bring the homeless into the area around the schools and this part of town." I have provided housing, mentored, counseled and provided guidance for some homeless over the years. I figure there is about 1 in 10 will decide to change. I have that "1" doing well and being a productive member of the community. I've shared with her my serious concerns about student and school safety. I am aware of many calls to the National Guard and left multiple messages that we do not support the Armory being used as warming shelter. -My concerns are as a concerned citizen. . Where are they coming from, where do they go when they wake-up, who cleans up after them, who protects them from themselves, who is liable for their behavior what are the proposed hours of operation? These are just a few of my concerns. The number of students that use the Bus Hub is currently 260 students. I know there is a concern for homeless people in Atascadero and a proposal to use the National Guard Armory for a warming center. Over many years Toys for Tots , Loaves and Fishes, and Coats for Kids have used the armory for its annual Christmas Basket program. We will be using the armory on Monday December 10th through Wednesday December 12 to deliver, organize, and distribute toys, coats and food to the needy of Atascadero. My concern with the use of the armory as a warming center would that this would then proclude our organizations from using that site. Unfortunately there is not another site in town that could hold the services that we provide. Please consider all the local organization that use the Armory that would be affected by this change.
