The Pledge of Allegiance was recited. Invocation was given by Bob Kanagy of the Berean Baptist Church. ROLL CALL Present: Councilman Molina, Handshy, Councilwoman -Norris and Mackey and Mayor Nelson. PUBLIC COMMENT W e COUNCIL COMMENT Councilman Handshy spoke regarding a need for reviewing traffic control de- vices throughout the city. In addition, bushes and growth should be evaluated regarding the need for trimming. Councilwoman Mackey spoke regarding the drainage problems at Sepparado, Arizona, Estrada, Maninita, etc. and asked the council to think about a mora- torium. Every time a building is built in this area it will compound the problems that are there. There is a potential now for four new houses being built on 50 foot lots. She said this situation should be looked into. Councilman Molina said he did look at this area, and that the plans, drainage plans and grading plans were approved by the City. This area has been looked into by the staff when they approved the plans. Councilwoman Mackey also spoke regarding the situation with the dogs running loose around Atascadero Lake and the number of people who have been attacked by these dogs. She was advised by the Police Department that they are looking into this. Councilwcman Norris asked to have council reorganization committee meetings to be held on Saturdays. 9 ncilman Molina asked if a letter had been sent to the Division of Highways egarding Highway 41. Policies and Priorities Report from City Council Councilman Handshy asked that there be a management study soon, that the council chambers improvements need to be made, as well as business licenses, budget reviews and an ordinance and policy review need to be looked over. Councilwoman Mackey would like staff and council to provide best service to the citizens of Atascadero. She would like to see im- provements at the zoo, public works shop, So. Atascadero Park and new street lights at Santa Rosa. Councilwoman Norris asked for re-organization council study sessions on Saturdays. Also for an employee/citizen in-put box be placed at the City Clerk' s Office and for business licenses to be looked into. Councilman Molina said the city should be looking into more revenue being brought into the city so that some of the above priorities can be carried out. He also complimented the members of the Down- town Revitalization Committe for the good meeting they had. Study session (adjourned meeting) will be held on Saturday, Septem- ber 8, 9-11 a.m. , in room 304 of the Administration Building. D. NEW BUSINESS 1. Consideration of State Community Development Block Grant Agreement MOTION: By Councilwoman Mackey, seconded by Councilman Handshy to approve Resolution No. 47-84 . Passed unanimously by roll call vote. 2. Report of offices of city treasurer and city clerk MOTION: By Councilman Molina to appoint Ralph Dowell to fill out the term of city treasurer. There was no second. The Council decided to wait until the September 8 study session to discuss the offices of City Treasurer and City Clerk. 3. Resolution regarding Annexation No. 4 property tax structure MOTION: By Councilwoman Mackey, seconded by Councilman Handshy to adopt Resolution No. 46-84 . Passed unanimously by roll call vote. 4 . Approval of transfer of funds from Contingency Fund topolice vehicle lease MOTION: By Councilman Handshy, seconded by Councilwoman Mackey to approve transfer of $5, 000 from Contingency Fund to police vehicle lease. INDIVIDUAL DETERMINATION/ACTION City Council Mayor Nelson invited the council members to a meeting Thursday night at 7: 30 p.m. given by the Recreation Department. It will be a social event inviting all agencies involved in this community. Mayor Nelson thanked Skip' Joannes, Recreation Director for the fine work he has done for the City of Atascadero and good luck in the future. City Attorney City Attorney, Allen Grimes, will have a discussion following this meet- ing regarding the Brown Act, for anyone who is interested in attending. Subdivision Review Board: On July 6 , 1984, the Subdivision Review Board met with the appli- cant to discuss the lot split. Member of the Board in attendance was Fred Buss, Associate Planner . Discussion focused upon the fact that under the new Zoning Ordinance the proposed lot sizes are too small. The Board then informed the applicant that it would recommend denial of the time extension for this proposal. E. Analysis: The original approval of this Tentative Parcel Map was granted under the old Zoning Ordinance in 1982. Therefore, any new time extensions for proposed lot divisions must be reviewed for com- pliance with the newly established Zoning Ordinance. Hence, the proposed time extension for this Parcel Map must meet the minimum lot size criteria before the Planning Commission may approve any request. In this case, the minimum lot size, as determined by Staff, is 3.83 acres using the 20% adjustment. The proposed lot sizes, 2. 53 and 2. 50 acres, are less than the minimum lot size requirements of the new Zoning Ordinance and must, therefore, be denied. 2 • • Tentative Parcel Map AT 820318:1 (Garlic.k/Stewart) F. Recommendation: Staff recommends denial of a time extension for Tentative Parcel Map AT 810930 :1 based upon the Findings that follow. G. Findings: 1. The proposed lots clearly do not meet the Zoning Ordinance standards for minimum lot size criteria. 2. The applicant does not have a vested right in this project. Therefore, the new Zoning Ordinance and minimum lot size criteria are valid. 3. Granting a time extension for this Tentative Parcel Map would be inconsistent with the current Zoning Ordinance and could be construed as discriminatory. 4. This proposal is generally f inconsistent with the adopted General Plan since it proposes lot sizes inconsistent with the Zoning Ordinance and its provisions for modification, all of which are intended to implement the General Plan. MW: s P 3 c r i97a CITY OF ATASCADERO lsls , q — C Planning Department June 7 , 1982 STAFF REPORT SUBJECT: Tentative Parcel Map AT820318: 1 LOCATION: 6625 Santa Cruz Road (Lot 19 , Block 48) APPLICANT: Elwood Garlick (Dan Stewart) REQUEST: To subdivide an existing 5. 03 acre lot into two parcels of 2 . 53 and 2. 50 acres each BACKGROUND 1. Existing zoning: A-1-B-V-3-D (508) 2. General Plan: Suburban Single Family Residential 3. Environmental Determination: An initial study environmental description form has been completed. The Planning Director has prepared a Draft Conditional Negative Declaration in- dicating the project will not have a significant adverse effect upon the environment if certain mitigating measures are incorporated into the project. 4. Site Conditions: The subject property is bounded on the north by Santa Cruz Road, an unimproved paper street. The site topography can be generally categorized as a bench face with a somewhat flat area above the west property line then sloping somewhat steeply from west to east. Two drainage ways cut the property from west to east, adding additional steep sloped areas. The site is covered with native grasses, mature oak trees and some native shrubs. 5. Property Description: The applicant is proposing to create two parcels of 2. 53 and 2. 50 acres from an existing 5 . 03 acre parcel. Parcel l shall have direct access to Santa Cruz Road, (presently unimproved) . Parcel 2 shall be provided access by way of a 25 foot access easement along the eastern property line. STAFF COMMENTS On Thursday April 8 , 1982 the Subdivision Review Board met to review the proposed Parcel Map with the applicants engineer Dan Stewart. Also attending the meeting were: Larry Stevens, Planning Director; Fred Buss, Associate Planner; Joel Moses, Associate Planner; Jill Kollmann, Planning Intern; Patience West, Engineering Aide and Mike Sherer, Planning Commissioner. Re: Tentative Parcel Map AT 820318 :1 (Garli ,v,) June 7 , 1982 Page Twok'' The following items of- concern were discussed: 1) Correction to the maps certificates 2) Potential fire hydrant requirements and water main extension. 3) Standard road improvements on Santa Cruz 4) Percolation test 5) Minimum lot size in relation to the distance from the center of town. 6) Access to both parcels 7) Location of leach fields 8) 50 foot set back from natural water courses The Applicant was requested tofsubmit additional,.information showing a slope profile of the access and a map showing potential building sites and leach field locations. A review of the plan and profile for the driveway easement indicates that there will be nearly 200 lineal feet of 4 ' (approx) cut with two 2 ' - 3 ' fills about 50 feet in length. This is fairly extensive grading for a private driveway and could result in some adverse visual effects. FINDINGS 1. The application, if revised as recommended, conforms to applicable zoning and subdivision regulations and is consistent with the 1980 Atascadero General Plan. 2. The application as submitted together with the recommended condi- tions will not have a significant adverse effect upon the environ- ment, and therefore the preparation of an Environmental Impact Report is not necessary. RECOMMENDATIONS Based upon the above Findings, the Planning Department recommends the following: A) Issuance-- of a Conditional Negative Declaration as follows: 1. Adequate provisions shall be made for drainage and erosion control and protection in conjunction with site development and road construction; and 2 . Adequate provision shall be made in design of private sewage disposal systems to minimize effects on natural watercourses. Private sewage disposal systems will 'be an acceptable method of sewage disposal, if reports and design are acceptable. All tests, reports, and designs shall conform to methods and guidelines prescribed by the Manual of Septic Tank Practice and other applicable City Ordinances. The following shall appear on the Final Map. "Appropriate soils reports including a percolation test, a test to determine the presence of ground water, and a log of a soil boring to a minimum depth of ten (10) feet shall be submitted to the Planning Department prior to the issuance of a building permit. Where soils reports indicate that con- ventional soil absorption systems are not acceptable, City approval of plans for an alternative private sewage disposal system, designed by a Registered Civil Engineer, shall be re- quired. Depending upon the system, more restrictive require- ments may be imposed. " €: 2 . Water shall be obtained from the Atascadero Mutual Water Company and water lines shall exist at each parcel frontage prior to filing of the Final Map. A letter from the water company indicating they are willing and able to serve the property shall be submitted to the Planning Department prior to re- cordation of the final Map. 3 . All other available utilities not already in place shall be extended underground to each parcel frontage at the time of building permit. 4 . One fire hydrant of a type and size specified by the City Fire Department shall be installed by the applicant on Santa Cruz Road near the proposed access easement at the easterly corner of the site. Exact location and manner of placement shall be subject to the approval of the Fire Depart- ment. A letter from the Fire Department certifying the in- stallaton of the hydrant shall be received by the Planning Department prior to the recordation of the Final Map. 5. The driveway access shall be improved to at least the following minimum standards: - an improved width of 12 feet - unobstructed vertical clearance of fourteen (14) feet These standards shall appear as notes on the Final Map. All driveways providing access to building sites shall be subject to Planning --Department review and approval at the time of building permit application for each parcel. Plan and profile drawings may be required. If average slope ex- ceeds 12% , paved improvement would be required, otherwise, an all-weather surface would be required similarly. In no event will driveways be allowed which exceed 20% in slope. In the event any portion of a driveway is shared, improvement of the shared portion shall be a requirement made in con- junction with the first building permit. Notes to these effects shall appear on the Final Map. 7. Efforts shall be made to minimize grading that would be dis- ruptive to the natural topography and removal of exisitng mature trees. The following shall appear as a Note on the Final Map: "No trees shall be removed without compliance with appli- cable City ordinances. No grading shall commence without an appropriate permit and compliance with applicable City ordinances 8 . Roof materials for all structures shall be Class C rating or better and a Note to that effect shall appear on the Final Map. 9. Drainage swales shall be indicated on the Final Map and a Note shall appear on the Final Map which states: "Any modification of the ground during site development with- in fifty (50) feet of the drainage swales shall be subject to approval by the Planning and Public Works Departments. " 10 . Final grading and drainage plans prepared by a Registered Civil Engineer for development on each parcel may be re- quired to be submitted for review and approval by the Plan- ning and Public Works Departments prior to issuance of build- ing permits. A note to this effect shall appear on the Final Map. 11. All pipeline and other easements of record shall be shown on the Final Map. A letter shall be submitted from each utility company indicating the nature and extent of any building re- strictions. A Note so stating such restrictions shall appear on the Final Map. 12 . The access easement shall also be designated for use as a public utility easement. 13. An offer of dedication to the public for road purposes for twenty (20) feet along Santa Cruz Road for the entire property frontage shall be made by the actual easement owner. Private sewage disposal systems will be an acceptable method of sewage disposal if reports and designs are acceptable. The pro- posed parcels have few feasible building sites. Careful site selection must be made because of the limitations on these parcels due to their steepness. Septic systems are not allowed on slopes greater than 30% and they must be designed by a Certified Engineer if placed on slopes greater than 20%. Grading for driveways and residences on slopes greater than 30% require a Conditional Use Permit, while Precise Plan ap- proval is needed for grading on slopes of 20 to 30 percent. Public Works requires the applicant to submit the plan and profile of access driveways before Final Map approval. Additionally, the applicant must obtain access approval from Cal Trans onto Morro Road. The Fire Department has indic"atad that there is some difficulty in determining fire hydrant requirements. Identification of building sites and details -concerning- driveway access is -necessary prior to a determinaion by the Fire Department. Additional concern involves the potential for future division of the subject property. The Zoning Ordinance allows for lots between 22 and 10 acres based on certain performance standards. Division followed by redivision of the proposed parcels limits the potential for a planned circulation system. The Planning Commis- sion, at that time, tabled the matter for a period not to exceed six months in order to allow the applicant to work with adjacent property owners to improve San Marcos Road to Highway 41,, which has since been accomplished. E. Recommendation: Staff recommends approval of Tentative Parcel Map 18-84 based upon the following Findings and Conditions of attached Exhibit "A" . F. Findings: y 1. The creation of four lots on this parcel conforms to all ap- plicable zoning and subdivision regulations and is consistent with the General Plan. 2. Box 747 Atascadero, CA 93423 Dear Mayor: The Office of Traffic Safety, in conjunction with Governor George Deukmejian, is in the process of planning for a Statewide observance of a week-long traffic safety public awareness campaign. On April 23, 1984 the Governor issued a 'proclamation (copy enclosed) designating the week of October 14-20, 1984 as California Traffic Safety Week. The purpose of this week is to highlight the importance of traffic safety and to provide the framework for a continuingpublic awareness of traffic safety; in the 1980•s. The Governor has stated that "public and private institutions, along with concerned individuals, can promote traffic safety by increasing public awarenoss of safety, methods". The issue .of traffic safety has become a'state and national concern through the public demand to reduce the number of deaths and injuries occurring on our streets and highways. The following statistics point out the magnitude of the problems. In 1983, 4,571 persons were killed and 292,538 injured in traffic accidents occurring somewhere along California's 138,350 miles of public roadways. • According to the National Safety- Council, motor vehicle accidents are the 4th leading cause of death for all age groups, and the leading cause of death for persons under age; 45. • Over 748 of California's fatal and injury accidents occur within city limits. • one out of every 5,507 persons living in California were killed in a traffic accident; one, out of every 86 persons were injured.; and one out of every 48 licensed drivers were involved in a fatal or injury traffic accident. • A traffic accident was reported on the average of every l minute, 10 seconds. This office has been designated as the lead department in the planning and implementation phases of traffic safety week. An Executive Committee has been established to provide overall policy and administrative guidance for the program. As outlined in the Governor's proclamation there will be five theme days covering the following areas: Page 2 Monday, October 15 - Railroad Grade Crossing Safety Tuesday, October 16 - Traffic Engineering Wednesday, October 17 - Occupant Protection Thursday, October 18 - Licensing and Education Friday, October 19 - Driving Under the Influence State committees composed of public and private participants have been selected for each of the theme days. These committees have developed a list of proposed activities that can be conducted at the state and local level. A resource kit to assist you in the implementation of suggested activities is presently being developed. It will include fact sheets, resource guides, sample media releases, and other pertinent information. It is anticipated that the kit will be distributed to you by September 1, 1984. In the meantime, we would like to encourage you to issue a proclamation designating the week of October 14-20, 1984 as Traffic Safety Week in your community. We have enclosed a sample proclamation for your convenience. It would be appreciated if you would forward a copy of your proclamation to this office for inclusion in our report to the Governor on the weeklong activities. WITNESSETH: -WHEREAS, the South Atascadero Park Committee is organized to raise support, materials and funds toward the development of the South 'Atascadero Park on behalf of the City. WHEREAS, the City of Atascadero desires assistance in developing, promoting, fund raising and supporting the South Atascadero Park Project. Purchase materials as needed (as approved by the City: Director of Public Works) toward the development of the South Atascadero Park. 3. In the event, in the opinion of the majority of the City Council, the South Atascadero Park Committee is not functioning effectively, then City may give South Atascadero Park Committee notice of this fact, specifying in detail the alleged default or defaults, and the South Atascadero Park Committee must forthwith correct said default or defaults, or the provisions in this Agreement for financial sponsorship of the South Atascadero Park Committee, 'which may be terminated by action of the majority of the City Council . 4. The South Atascadero Park Committee' shall submit to the City an expense and project accomplished list every two months at the beginning of the month beginning on October 1, 1984. 5. In the event all funds are not used by the South Atascadero Park Committee by June 30, 1985, they will once again become City funds and deposited in the City General Fund. 6 . This Agreement may be amended or modified only by written agreement signed by both parties, and failure on the part of either party to enforce any provision of this Agreement shall be construed as a waiver of the right to compel enforcement of such provision or provisions. BACKGROUND: This matter first appeared on the June 4 , 1984 , agenda of the Planning Commission, at which time it was continued at the request of the applicant. Subsequently, on August 13, 1984 , the Commis- sion considered a revised map, heard neighborhood concerns, and acted unanimously (6 : 0) to deny a 20% minimum lot size reduction . request and approved a two-way split subject to ten (10) condi- tions of approval, including a revised condition No. 6 which stressed resolution of drainage flow problems across the property and under San Gabriel Road. The City Council had the matter on its Consent agenda, August 13, 1984. At that meeting, the applicant' s engineer, John Kennaly, advised of his client' s intention to appeal the Commission' s recommendation and this was done in writing on August 16, 1984. BASIS OF APPEAL: In addition to the letter (see attached) , staff met with Mr. Kennaly to review the basis of the appeal. The appealant contends that the Commission erred in its interpretation of lot size factor points with respect to "septic suitability" and "general neighborhood character" (refer to attached Staff Report) . The General Plan de- fines the subject area as Suburban Single-Family Residential, call- ing for lot sizes of from 22 - 10 acres. The Zoning Ordinance (see attached excerpt) implements the General Plan by a formula which sets minimum lot size based on average slopes distance from center of town, septic suitability, road access, and general neigh- borhood character. It was the Commission' s general consensus that a three way lot split would not be appropriate due to the site' s flood hazard and drainage problems. John Kennaly, representing Ms. Davis, spoke in support of approving the adjustment request for allowing creation of three parcels and addressed the technical concerns of this issue. He pointed out that San Gabriel road was built about two' feet above grade with an 18 inch culvert provided under San Gabriel which has caused back-up of the creek. Mr. Kennaly spoke about the original proposal which had been revised due to construction of an adjacent residence. Mr. Kennaly further commented that the main issue is what the policy decision is concerning the 20% reduction factor . Pat Silveira, 8865 San Gabriel Road resident, showed the Commission some photographs on the subject property before and after the rainy season. Bob Brown, San Gabriel Road resident, expressed his opposition to the creation of three parcels due to the extreme water-runoff condi- tions, the drainage swales and the steepness of the subject property. Mr. Brown also noted that a Lot Line Adjustment was approved a year ago on the property to allow four 2 1/2 acre parcels across the way in order to get another parcel on an adjacent cul-de-sac. Mr. Brown further addressed the road issue with regard to sight distance and access, and noted his extreme opposition to the reduction request. Mr. Pitt, addressed two concerns that he had with the project, which included erosion of the roadway due to the water runoff from San Gab- riel Road and concern with nitrate that might affect his well by the water running downstream. w � Commissioner Moore expressed some mixed emotions concerning a two-way lot split even if a 36 inch culvert would be provided under San Gab- riel Road and commented that there needs to be some definite control on the flood plain. Commissioner LaPrade concurred with Commissioner Moore' s comments and noted he had lived in that area forseveral years. He stated that it appeared that the existing culverts were not ade- quate and that if a 36 inch culvert was good enough for three lots, it was surely good enough for two lots. Commissioner Lilley felt that this was not an applicable parcel for a three-way lot split and noted that this issue creates difficulty ,in allowing flexibility with the ordinances to allow development of prime property with the reduction of lot size adjustment and the factors involved with determining this adjustment. Commissioner Wentzel and Chairman Summers concurred with the comments made by the rest of the Commission. There was discussion concerning the 20% reduction in that this adjustment has not always been applied in the manner it should be. Commissioner Moore moved to deny the the 20% reduction adjustment and to approve a two-way lot division subject to the Findings and Condi- tions as set forth in the Staff Report with modification to Condition #6 to read: 6. This easement is 5 feet by 25 feet wide and runs along the southwest property line of Parcel 2, AT80-96 , restricting development of that portion of the lot. The applicant is proposing an industrial building and wants to eliminate any setbacks in order to maximize his land use. The vacation of the public utility easement must be completed before he can build on this part of his lot. Our department sent letters to all concerned utilities not- ifying them of our intent to vacate this easement. Their responce was in favor of the vacation. WHEREAS, City is presently renovating an existing City owned building known as the Atascadero Lake Pavilion, to make the said building more usable for public purposes ; and WHEREAS, County desires to arrange for a certain preference for certain public uses of said City building; NOW THEREFORE, in consideration of the mutual covenants and agreements herein contained, the parties hereto agree as follows : 1. County shall pay over to City immediately upon execution of this Agreement by both parties the sum of $6,000.00, payable out of Federal Revenue Sharing account, BU. # 2090-2150. 2. City agrees to allow to County the preferential use of the building known as the Atascadero Lake Pavilion, starting from the date of completion of the improvements to the building which are presently under way in the project known as Atascadero Lake Pavilion improvements. In the event such project is not completed by June 30, 1985 , this priority shall commence on June 30, 1985. The priority use provided for herein shall mean that the City of Atascadero in allowing public use of the said Atascadero Lake Pavilion may not discriminate against nonresidents of the City of Atascadero for the period of ten years from whichever of the aforementioned dates occurs first. In addition, City shall allow use of said premises by the County of San Luis Obispo for County functions for a total cumulative usage time of 600 hours during the said ten year period. County will arrange the scheduling of these hours of use for County functions through the County Director of General Services and through the City Manager of the City of Atascadero. There shall be no charge to the County by the City for these 600 hours of usage, but the City may require the County to provide its own set up, maintenance, and clean up necessary for the County's hours of use. 3. City will be responsible for payment of all utilities in connection with the County' s use of the said premises as aforesaid. 4. City may impose charges on nonresidents using the said building, provided such charges are nondiscriminatory- when compared to charges for use of said premises for City residents for similar uses or activities. 5. In the event the said building is destroyed by fire or any other cause within the ten year period aforesaid, the rights of the County shall .continue in any replacement structure put up within the said ten year period. It is my recommendation that Council appoint a screening committee tonight to reduce this number of applications to a workable amount for the interviewing process and that the screening committee meet no later than Thursday, September 12, 1984. It is further recommended that we conduct our interviews on Saturday, September 22nd, 1984 in order to expedite the selection for this position. As contained in my memoran- dum of August 29, 1984, and concurred with by the City Attorney, it is proposed that we conduct the interviews utilizing the City Manager ' s office in the same manner as for the Planning Director ' s selection. • This September 22 meeting will be legally noticed regarding closed session and the notice will indicate that an announcement providing general guidance to the Manager may be expected at the conclusion of the meeting. At the end of the meeting (interviews) Council will ad- journ to open session, announcing that they have interviewed and ranked an appropriate listing of candidates for the position of Recre- ation Director. They will then pass a motion directing the City Mana- ger to proceed with reference and background inquiries and hiring pro- cedures relative to the provided ranking. The motion will also direct the Manager to advise Council at the next regularly scheduled Council meeting regarding the outcome of the activities. Council will, at the next meeting, pass a motion concurring and confirming the Manager ' s actions of selection. If you have no disagreement in this procedure, I will take the neces- sary steps to provide the scheduling and the proper notices for the September 22nd interviews.
