WELCOME TO THE ATASCADERO CITY COUNCIL MEETING
The City Council meets in regular session on the second and fourth Tuesday of each month at 6:00 p.m.
Council meetings will be held at the City Hall Council Chambers, 6500 Palma Avenue, Atascadero.
Matters are considered by the Council in the order of the printed Agenda. Regular Council meetings are
televised live, audio recorded and videotaped for future playback. Charter Communication customers
may view the meetings on Charter Cable Channel 20 or via the City’s website at www.atascadero.org.
Meetings are also broadcast on radio station KPRL AM 1230. Contact the City Clerk for more information
(470-3400).
Copies of the staff reports or other documentation relating to each item of business referred to on the
Agenda are on file in the office of the City Clerk and are available for public inspection during City Hall
business hours at the Front Counter of City Hall, 6500 Palma Avenue, Atascadero, and on our website,
www.atascadero.org. Contracts, Resolutions and Ordinances will be allocated a number once they are
approved by the City Council. The minutes of this meeting will reflect these numbers. All documents
submitted by the public during Council meetings that are either read into th e record or referred to in their
statement will be noted in the minutes and available for review in the City Clerk's office .

Recommendation: Council adopt Draft Resolution approving the Final
Map for Tract 3078 and accepting portions of the subdivision public

Roadway systems and authorizing the City Engineer to accept the work as
complete. [Public Works]

C. MANAGEMENT REPORTS:
1. Use of Armory as a Warming Shelter
Fiscal Impact: Fiscal impact will depend on Council direction to staff.
Recommendation: Council provide staff direction on whether to work
through a process to consider using the Armory as a Warming Shelter as
proposed by Transitional Food & Shelter (TFS). [City Manager]
City Manager Rickard gave the staff report and answered questions from the Council.
Wendy Lewis, ECHO President and CEO and Laurel Weir, SLO County Homeless
Services Coordinator also answered questions from the Council.
Ex-Parte:
Council Member Bourbeau reported speaking with Orlando Gallagos, Jerry Clay and a
representative for the National Guard Armory.
Mayor Pro Tem Fonzi reported speaking with both Jerry Clay and Donn Clickard.
Council Member Moreno reported speaking with a number of Atascadero School Board
Members regarding the issue as well as Supervisor Debbie Arnold.
Council Member Sturtevant reported there being some discussion regarding the issue at
the recent City/Schools Committee meeting.
On behalf of Transitional Food & Shelter, Inc., Orlando Gallagos answered questions
from the Council.
At the request of Mayor O’Malley, Deputy City Manager/City Clerk Christensen read
several emails received by the City Council into the record. Copies of the emails were
placed in the public review book as well. Mayor Pro Tem Fonzi read a text message
she had received from Michael Sheerer into the record. Council Member Moreno also
read an email she received from Vicky Morse into the record.

MOTION: By Mayor Pro Tem Fonzi and seconded by Council Member
Moreno to direct staff to reject the Transitional Food & Shelter
proposal for use of the Armory as a warming shelter.
Motion passed 5:0 by a roll-call vote.
2. Declaration of a Shelter Crisis and Authorization of the City of Atascadero’s
Participation in the Homeless Emergency Aid Program (HEAP)
Fiscal Impact: The exact amount of funding would be determined as part
of the HEAP funding award process.
Recommendation: Council adopt the Draft Resolution declaring a shelter
crisis in the City of Atascadero pursuant to SB 850 (Chapter 48, Statutes
of 2018 and Government Code §8698.2) and authorizing the City’s
participation in the newly established Homeless Emergency Aid Program
(HEAP). [City Manager]
City Manager Rickard gave the staff report and answered questions from the Council.
Laurel Weir, SLO County Homeless Services Coordinator also answered questions
from the Council.

Felicia Hammond, Susan Funk, Susan Warren and Dan Ulrich
Mayor O’Malley closed the Public Comment period.
Following the motion by Mayor O’Malley and seconded by Council Member Bourbeau,
Council Member Moreno requested that the motion be modified to declare a shelter
crisis through June 30, 2021.
MOTION: By Mayor O’Malley and seconded by Council Member Bourbeau
to adopt Resolution No. 2018-066 declaring a shelter crisis,
through June 30, 2021, in the City of Atascadero pursuant to
SB 850 (Chapter 48, Statutes of 2018 and Government Code
§8698.2) and authorizing the City’s participation in the newly
established Homeless Emergency Aid Program (HEAP).
Motion passed 5:0 by a roll-call vote.

3. Downtown Watershed Plan Project Status Update

Public Works Director DeBar gave the staff report and introduced representatives of
Rick Engineering who presented the Draft Downtown Watershed Plan. Both Public
Works Director DeBar and the consultants answered questions from the Council.
There was a request to make a motion to go past 11:00 p.m.
MOTION: By Council Member Moreno and seconded by Mayor Pro Tem
Fonzi to continue the meeting past 11:00 p.m.
Motion passed 4:1 by a roll call vote. O’Malley voted “No”.

MOTION: By Council Member Moreno and seconded by Council Member

1. City Clerk – Deputy City Manager/City Clerk Christensen announced that
Commissioner terms expire at the end of the year. There are two at -large
positions for the Planning Commission, one at-large position on the Design
Review Committee, and two Council appointments for the Citizen Sales Tax
Oversight Committee. She asked for Council direction to advertise for
interested citizens to apply for these positions.

City Council 2019 Meeting Schedule
RECOMMENDATION:
Council approve the City Council meeting schedule for 2019.
DISCUSSION:
The City Council, pursuant to Chapter 2, Section 1.01 of the Atascadero Municipal
Code, meets the second and fourth Tuesday of each month. On occasion, the Council
will hold special study sessions and/or joint meetings with one or both of the
Commissions on a fifth Tuesday. Generally, in the summer months, the Council meets
once a month and avoids conflicts with major holidays. Staff has prepared the at tached
schedule for the year 2019 to help in the coordination of these meetings with personal
schedules.

Reciting the Fact of the
November 6, 2018 General Municipal Election
RECOMMENDATION:
Council adopt the Draft Resolution, reciting the fact of the General Municipal Election held
on November 6, 2018, declaring the result and such other matters as provided by law.
DISCUSSION:
The General Municipal Election was held on November 6, 2018. California Elections
Code §10262 states that the City Council shall meet to declare the result s of the election
upon certification of results by the County Election Department. The California Elections
Code §10262 & 10264 also states that the Council shall adopt a resolution reciting the
fact of the election, including a statement of the results.
Total voter registration for the City of Atascadero was 18,665, which is 610 more than the
total voter registration for the year 2016. 13,663 registered voters (73.2%) voted in this
election.
Atascadero voters were asked to vote for a Mayor, two Council Members and Ballot
Measures E-18 and J-18. The final official results are attached to this report.

DRAFT RESOLUTION
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ATASCADERO, CALIFORNIA
RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION
HELD ON NOVEMBER 6, 2018, DECLARING THE RESULT
AND SUCH OTHER MATTERS AS PROVIDED BY LAW
WHEREAS, a General Municipal Election was held and conducted in the City of
Atascadero, California, on Tuesday, November 6, 2018, as required by law; and
WHEREAS, notice of the election was given in time, form and manner as provided by
law; that voting precincts were properly established; that election officers were appointed and that
in all respects the election was held and conducted and the votes were cast, received and canvassed
and the returns made and declared in time, form and manner as required by the provisions of the
Elections Code of the State of California for the holding of elections in general law cities; and
WHEREAS, the County Election Department canvassed the returns of the election and
has certified the results to this City Council, the results are received, attached and made a part
hereof as “Exhibit A.”
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF ATASCADERO:
SECTION 1. That the whole number of ballots cast in the precincts except vote by mail
voter ballots and provisional ballots was 3,595.
That the whole number of vote by mail voter ballots cast in the City was 10,068, making a
total of 13,663 ballots cast in the City.

SECTION 3. That the number of votes given at each precinct and the number of votes
given in the City to each of the persons above named for the respective offices for which the

SECTION 4. The City Council does declare and determine that: Heather Moreno was
elected as Mayor for the full term of two years; Heather Newsom was elected as Member of the
City Council for the full term of four years; and Susan Funk was elected as Member of the City
Council for the full term of four years.
That as a result of the election, a majority of the voters voting on Measure #E-18 relating
to a cannabis business tax did vote in favor of it, and that the measure was carried, and shall be
deemed adopted and ratified.
That as a result of the election, a majority of the voters voting on Measure #J-18 relating
to the term of office for Mayor, did not vote in favor of it, and that the measure was defeated, and
shall not be deemed adopted and ratified.
SECTION 5. The City Clerk shall enter on the records of the City Council of the City, a
statement of the result of the election, showing: (1) The whole number of ballots cast in the City;
(2) The names of the persons voted for; (3) The measures voted upon; (4) For what office each person
was voted for; (5) The number of votes given at each precinct to each person, and for and against
each measure; (6) The total number of votes given to each person, and for and against each measure.
SECTION 6. That the City Clerk shall immediately make and deliver to each of the
persons so elected a Certificate of Election signed by the City Clerk and authenticated; that the
City Clerk shall also administer to each person elected the Oath of Office prescribed in the

Constitution of the State of California and shall have them subscribe to it and file it in the office
of the City Clerk. Each and all of the persons so elected shall then be inducted into the respective

2019 Community Development Block Grant
Draft Recommendations
RECOMMENDATION:
Council develop and adopt draft recommendations for the 2019 Community
Development Block Grant (CDBG) funds.
DISCUSSION:
Background:
The 2019 CDBG award process began in the fall of 2018. Workshops were held
throughout the County to solicit public comment on community needs. The County
published a request for CDBG proposals and the City received three applications. Total
available funding for the 2019 cycle, based on previous levels, is anticipated to be
approximately $128,031. Final funding amounts are anticipated to be released by the
Department of Housing and Community Development (HUD) in early 201 9.
The City will also receive $52,929 from the City of Morro Bay’s CDBG allocation for a
combined total of $180,960. In 2016 the City of Atascadero reallocated $236,420 to
Morro Bay to complete a shovel ready project. The City of Morro Bay will allocate their
annual CDBG funding to Atascadero on a dollar-per-dollar repayment basis beginning
with the 2017 CDBG year until the balance is paid in full. The City received repayment
from Morro Bay in 2017 ($67,566) and 2018 ($89,463) leaving a balance owed of
$79,367prior to the 2019 CDBG cycle.
CDBG funds are available for community development activities, which meet at least
one of the three national objectives:
1. A benefit to low and moderate-income persons;
2. Aid in the prevention or elimination of blight;
3. Address urgent needs that pose a se rious and immediate threat to the health or
welfare of the community.
In order for a program to qualify under the low and moderate income objective, at least
51% of the persons benefiting from the project or program must earn no more than 80%

of the area median. Additionally, at least 70% of the CDBG funds must be spent toward
this objective.
There is a minimum award threshold of $8,000 per project, meaning the City can only
allocate less than $8,000 for a particular public service activity if another ag ency in the
County commits to programming the remainder to equal a Countywide cumulative total
of at least $8,000.
The following criteria should also be used to guide selection of CDBG programs:
1. The proposal is consistent with the national objectives a nd eligibility criteria of
the HUD CDBG program;
2. The proposal is consistent with the Urban County Consolidated Plan;
3. The proposal is consistent with the General Plan and other City
codes/ordinances.
4. The proposal will achieve multiple community development objectives;
5. The proposal can be implemented in a timely manner, without significant
environmental, policy, procedural, legal, or fiscal obstacles to overcome; and
6. The project is not financially feasible without CDBG funding.
Analysis: The City received the following applications for the 201 9 funding cycle:

There are two applicants this year for the public services funding with the requests
totaling $22,500 – which exceeds the estimated public service allocation of $19,205 by
$3,295. As part of the CDBG process, Council must develop a draft recommendation
for the 2019 grant year that meets the funding criteria while adhering to the categorical
limits.
Copies of all applications, funding regulations and a summary of past awards are
available in the lobby and the library for public review.
The following amounts are proposed to be reallocated from the 2016 and 2017
remaining Administrative funds to the 2019 Santa Rosa Accessibility project.

Additionally, the remaining balance of $2,875 from the 2017 Atascadero Mall project is
also proposed to be reallocated to the 2019 Santa Rosa Accessibility project.

Upon approval, the draft funding recommendations will be forwarded to the County for
publishing along with recommendations from all participating agencies. A minimum of
30 days after publication, a second workshop will be held to allow questions from
applicants regarding the draft recommendations, after which the draft allocations will be
forwarded to City Council, with comments from the workshop, for final approval and
forwarding to the County Board of Supervisors. The following is a brief explanation of
the funding groups and applications within each:
PUBLIC FACILITIES - Public Facilities are defined as activities relating to real property,
including the acquisition, construction, rehabilitation or inst allation of public
improvements. These activities can be carried out by a grantee, subrecipient or other
nonprofit.
City of Atascadero – Santa Rosa Accessibility - Barrier Removal Project
Funds Requested: $140,000
Funds Available: $147,521 ($83,220 Atascadero 2019, $52,929 Morro Bay repayment,
Administrative Reallocation $11,372)
The Santa Rosa sidewalk, from the northwest corner of El Camino Real to the north
bound Freeway 101 on ramp (adjacent to Motel 6), warrants improvements to increase
accessibility for the traveling public due to its dilapidated and non-compliant condition.
This project proposes to remove and replace approximately 400 linear feet of currently
non-ADA compliant sidewalk, and a curb ramp at the NW corner of El Camino Real and
Santa Rosa Road. In addition, a small (3’-5’) retaining wall, handrail, and associated
curb and gutter work will complete the project. The infrastructure improvements
providing wheelchair ramps and ADA compliant sidewalks will aid those with mobility
impairments.
PUBLIC SERVICES - 15% cap on percentage of award from this category estimated at
$19,205 this cycle.
CDBG regulations allow for a wide range of public service activities, including, but not
limited to: employment services, crime prevention, child care, health services,
substance abuse services, fair housing counseling and recreational services.

City of Atascadero – Youth Activity Scholarship Fund
Funds Requested: $12,500
The City administers the Youth Activity Scholarship Fund to allow the children of very
low and low-income families to participate in recreational and social activities, to keep
children active and engaged. Because this program is limited to very-low and
low-income families, the benefit criteria will be met.
El Camino Homeless Organization – Operation of Homeless Shelter
Funds Requested: $10,000
El Camino Homeless Organization (ECHO) is the only homeless shelter in Northern San
Luis Obispo County providing transitional shelter, a daily meal program, transportation
assistance and referrals for job search workshops and parenting classes. In 2015, ECHO
completed a major renovation that included the expansion of the shelter from 31 to 50 beds
which provided a 60% increase in the number of clients served. The ECHO shelter intake
process and all ancillary services are located at 6370 Atascadero Avenue in Atascadero.
ADMINISTRATION – Limited to 20% of 2019 Allocation ($25,606)
City of Atascadero – CDBG Program Administration- limited to 7% of the 2019
Allocation
Funds Requested: $8,962
Significant City staff time from Administration, Public Works and Administrative Services
is required for CDBG administration, and coordination with County Planning staff. The
City’s administrative portion of the funding cannot exceed 7%, or $8,962 of the total
administrative grant amount.
If administration costs exceed the funding allocation, the remaining cost of administering
the program will need to be paid from the general fund.
County of San Luis Obispo – CDBG Program Administration- limited to 13% of the
2019 Allocation
Allocated Funds: City of Atascadero $16,644
Due to the complexity of grant administration responsibilities and the consequences of
non-compliance, HUD recommends that the County provide all monitoring and oversight
for all CDBG grants. The County will assume the duties of project oversight, and
receive a required 13% of the total grant funds for administration services for
Atascadero in the amount of $16,644.
Conclusion:
There is sufficient CDBG funding for the Public Facilities application for the Santa Rosa
Accessibility project with the Morro Bay payment and reallocation of CDBG balances
from 2016 and 2017. However, there is not enough funding for the two Public Services
application requests from Atascadero Recreation and ECHO. Council will need to
recommend draft allocations. A final recommendation will need to be made by Council
in March 2019 when final CDBG funding amounts are known.

FISCAL IMPACT:
The total 2019 CDBG allocation is estimated to be $180,960.
ALTERNATIVES:
CDBG allocation awards must meet program requirements, providing a minimum of
70% of funding for benefit to low and moderate-income persons, and no more than 15%
can be allocated to the public service category.
