Professor of Architecture. I maintain a part-time practice.
Reason for this application: The public must be involved in the 'regulatory process
in order to assure that the intent of adopted regulations are properly interpreted
for the local community. As a-member of that public, I feel that my expertise
in designing within a regulated context, especially with the I .C.B.O. regulations,

Mayor Mackey presented a proclamation declaring the week of May lst thru
5th as Elks Club Youth Week. Mayor Mackey received a letter from the
National Flag Day Committee asking for someone to help lead a national
cause for the pledge of allegiance through observances in our community
on Flag Day, June 14th, and if any organizationis interested in doing
this she would share this letter with the group. She alsostatedthat
the week of April 23-29 is National Consumers. Week; that the Masonic Order
has .named the month of April as ;Education Month, and that several schools
will be holding open house this week.

B. HEARINGS, APPEARANCES, AND REPORTS -
1. Presentation of the annual Franchise Fee Payment to the City,
from Falcon Cable TV
Thomas Hatcheli presented the city with a check for the 1983
franchise payment in the amount of $25,476.15.
2. Grisanti Request for discussion of downtown parking problems-
Mr. Grisanti did not appear because he was on vacation. Erwin
Manning spoke regarding the parking problem in the downtown •
area. Donna Williams also spoke regarding this problem. Murray
Warden, City Manager, discussed the possibility of establishing a
parking district. He urged the businesses in this area to meet
with Larry McPherson, Public Works Director, to see if some
kind of solution can be reached regarding the parking.
3. Public hearing on Zone Change 4-84 to prezone approximately
80 acres containing the wastewater treatment plant site to
the P (Public)` Zone at 8005 Gabarda - Initiated` by Planning
Commission.
Harold Latel spoke regarding his concerns of well contamination
in this area and the need to have the wells checked periodically
for contamination.
MOTION; By Councilman Wilkins, seconded by Councilman Stover to have
staff prepare an amendment to the zornng ordinance to declare
the wastewater treatment plant site to P (Public') . Passed
unanimously.
4 Consideration of Staff Report on General Plan Amendment applica-
tions for Cycle 2 of 1984
Staff report was given by Interim Planning Director, Wayne Loftus.
MOTION: By Councilman Wilkins, seconded by Councilman Nelson to accept
the General Plan Amendment. Passed unanimously by roll call vote•

5. Public hearing on General Plan Amendment 1B-84 to amend the
General Plan Land Use Element text to encourage the establish-
ment of additional commercial and light, clean industrial uses
on suitable sites.
Wayne Loftus, Interim Planning Director, reviewed the proposed
amendment. Gary Larson of Atascadero Chamber of Commerce strongly
urged the council to approve.
MOTION: By Councilman Wilkins, seconded by Councilman Molina to direct
staff to prepare necessary resolution for amendments to the
general plan. Passed unanimously.
6 . Public hearing appeal of parking requirements on Conditional
Use Permit 3-84 for a 95 unit congregate senior citizens housing
project on a portion of Lot 3 of Block 7 of Eaglet No. 2 at
10165 E1 Camino Real - California Lenders (Young)
Bruce Fraser, of MDW Assoc. , said he would be glad to answer any
questions that anyone had. Gary Larson spoke in favor of this
project. Glen Ferguson expressed his concerns about the number
of parking spaces. Judy Young said that for the first twenty
years the titles may not be transferred and after that time if
it is transferred the loan must be paid off, these are conditions
of the loan. Most of the occupants of this facility will be
frail and impared, therefore they can not drive. Councilman
0 Nelson said he would go along with the 104 parking spaces.
MOTION: Councilman Nelson moved, seconded by Councilman Wilkins to support
the parking requirement of 104 and therefore sustain the appeal
of the applicants conditioned on the use of 104 and direct the
staff to come back with findings of fact and resolutions implement-
ing that decision. Passed by unanimous vote.
C. UNFINISHED BUSINESS
1. Ordinance No. 79 Amending Map No. 11 of the Official Zoning
Maps of the City of Atascadero by changing certain properties
on San Palo Road from RSF-Z (Residential Single Family) to CT
(Commercial Tourist) - second rea ing
MOTION: By Councilman Wilkins, seconded by Councilman Nelson to read

2. Appointment of two members to the Board of Appeals
MOTION: By Councilman Molina, seconded by Councilman Stover to appoint S
Mike Bewsey, contractor, to the Appeals Board. Passed by unanimo-s
vote. Council will interview Terry Hargrave and David Grummitt
at the next Council meeting.

1. Resolution No. 19-84 declaring weeds a public nuisance and com-
mencing proceedings for the abatement of said nuisances
MOTION: By Councilman Wilkins, seconded by Councilman Molina to adopt
resolution No. 19-84 . Passed unanimously by roll call vote.
2. Ordinance No. 80 amending Ordinance No. 67 to readChapter16
to Title 2 of the Atascadero Municipal Code relating to claims

3. Ballfield lighting - recommended hours of use for night lighting*
of ballfields
MOTION: By Councilman Wilkins seconded by Councilman Nelson to shut lights
off by 10: 30 p.m. unless there is an emergency situation such as a
tie game. Then it is left up to the descretion of the official in
charge, but lights should be off no later than 11: 00 p.m. Passed
4 : 1, with Mayor Mackey voting no.
4 . Approval of negotiations team for property tax exchange
MOTION: By Councilman Wilkins, seconded by Councilman Nelson that the
negotiating team for property tax exchange will be the City Manager,
City Attorney and such other person as they agreed was necessary
for a workable team. Passed unanimously.
E. ATASCADERO COUNTY SANITATION DISTRICT
MOTION: By Councilman Wilkins, seconded by Councilman Nelson to recess
as City Council and reconvene as Atascadero County Sanitation
District. Passed unanimously.

the boundaries of Improvement District No. Land establishing con-

SUBJECT: TENTATIVE PARCEL MAP 16-84

REQUEST: To allow modification of condition number 9 requiring road
improvements of Halcon Road.
On May 7, 1984, the Planning Commission conducted -a public hearing on
the modification request unanimously (with Commissioner Sherer absent)
adding Findings 5 and 6 and approving modification to Condition #9 as
contained in the attached Staff Report.
Gary Calkins, applicant, appeared and noted his agreement with the
modifiedcondition but asked that the property owners be allowed to
have some type of involvement of participation in the road assessment.
There was only brief discussion among the Commission concerning the
matter.
No one else appeared on the matter.

STAFF REPORT
SUBJECT: TENTATIVE PARCEL MAP 16-83
LOCATION: 11875 Halcon Road (Lot 17, Block 68)
APPLICANT: Gary Calkins (Twin Cities Engineering)
REQUEST: To allow modification- of Condition Number 9 requiring
road improvements of Halcon Road
BACKGROUND
1. Prior Action: On February 21,- 1984, the Planning Commission ap-
proved Tentative Parcel Map 16-83 with a condition for road im-
provement to residential standards along the frontage of the site.
The applicant has appealed the earlier Subdivision Review Board
determination to require the road improvement. On March 5, the
applicant appealed the road condition as required by the Planning •
Commission approval. Telephone conversation ensued between the
applicant and Staff resulting in a letter on March 14 for clari-
fying information on City participation to road improvements. On
April 5, the applicant withdrew his appeal subject to modification
of the condition.

General Plan': Suburban Single Family Residential
4. Environmental Determination: The Planning Director hasdetermined
that no further environmental review is necessary for this
project.
5. Project Description: The applicant desires to modify the road
improvement condition to conform to thesamecondition applied to
the adjacent two parcel maps. The original condition is as
follows.-
Halcon Road shall be improved to City standards along the frontage
of the property including a minimum paved width of 20 feet with
three foot graded shoulders prior to recordation of the Final Map.
a. Improvements are .to be constructed under an inspection agree-
ment and encroachment permit issued by the Public Works De-
partment.

b. Improvement drawings, including improvements to control grad-
ing and erosion within the road right-of-way, shall be sub-
mitted to the Public Works Department for review and
approval.
6. The modified condition for street improvements reads as follows:
The applicant shall enter into a road improvement participation
agreement with the City of 'Atascadero whereby the applicant agrees
to pay his portion of a residential road. The applicant' s share
shall be determined from a construction cost estimate submitted
to the City by the applicant's engineer. A Certificate of Deposit
or cash deposit for the specified amount shall be furnished to the
City of Atascadero with the stipulation that the money be used to
construct an industrial collector road section within five years.
ANALYSIS
Staff has opted for the change in the condition as evidenced by two
parcel maps approved on adjacent lots on Halcon Road (Rodda - Lot 18,
Bella Vista Investment - Lot 19) . The heavy trucks hauling rock from
the Rocky Canyon quarry use this road for access to main thoroughfare.
It is Staff' s opinion that a residential road section would not stand
up against such abuse. The Public Works Director has indicated, by
approval of this condition, a willingness to budget funds in addition
to the money put forth by the property woners involved to upgrade the
road.
FINDINGS (Findings 1-3 for land division; Staff Report 2-21-84)
4. Street improvements of a heavier nature are necessary for Halcon
Road since it serves as an industrial collector road. Bonding
agreements allow City participation in the road upgrade and per-
mit improvements to be accomplished at the same time.
5. Approval of the change in the condition will modify the road re-
quirements to conform with road requirements of other parcels in
the area along Halcon Road.
RECOMMENDATION
Based on the three original Findings and the additional Findings con-
tained herein, the Planning Department recommends modifying Condition
Number 9 on the original Staff Report of February 21, 1984, as
requested of Parcel Map 16-83 approval of February 21, 1984 to read as
stated in Item 6 of Background in this report.

STAFF REPORT
SUBJECT: TENTATIVE PARCEL MAP 16-83
LOCATION: 11875 Halcon Road (Lot 17, Block 68)
APPLICANT: Gary Calkins (Twin Cities Engineering)
REQUEST: To allow division of 8 . 6 acres into two parcels of 5. 18
and 3.42 acres each, employing the minimum lot size re-
duction adjustment.
BACKGROUND
1. Existing Zoning: RS
2. General Plan: Suburban Single Family Residential
3. Environmental Determination: The applicant has completed an Ini-
tial Study Environmental Description form. The Planning Director
has prepared a draft Conditional Negative Declaration indicating
the project will not have a significant adverse effect upon the
environment if certain mitigation measures are incorporated into
the project.
4. Site Conditions: The site is characterized by hilly terrain. Two
large swales cut through the property from south to north dividing
the site roughly into thirds. These swales are wet season streams.
The existing residence is situated on a hillside at the northeast
corner of the property. The residence is connected to the street
via a driveway that follows the southern property line. Another
hill is located at the southeast corner of the site near the
frontage on Halcon Road. The site is covered with natural grasses
and trees.
5. Project Description: The applicant requests permission to divide
8. 6 acres of land into two parcels of 5.18 and 3. 42 acres each,
employing the minimum lot size reduction adjustment. The proposed
lot design would create two rectangular parcels, one behind the
other , with a 15 foot access and pubic utility easement serving
the parcel in the rear . The applicant must have approval of the
lot size reduction adjustment to attain the requested lot size for
the rear parcel (3. 42 acres) .
Tentative Parcel Map 16-83 (Calkins)
data for the 20% reduction to try and achieve a lot size that is
smaller still for the proposed parcel containing his house. He origi-
nally wanted a lot size that was smaller than that permitted by the
reduction (3.3 acres - refer to the attached maps) . Staff should
point out that the current performance criteria arrangement and
weighting has yet to yield a minimum lot size over 7 acres. In the
case of the previous Summit Hills annexation and subdivision request,
which is probably the most extreme case that will ever occur , the
performance factors yielded a minimum lot size of approximately 6 1/2
acres. The General Plan still endeavors through this zoning ordinance
to create private open space and room for a suburban life style. If
the precedent is started here, then it will be asked for elsewhere.
If that is the intent, then the General Plan and Zoning Ordinance
should be amended to reflect the lower lot sizes. Staff has no objec-
tion to the lot split under the minimum lot size specified by the
performance criteria but cannot recommend approval of the reduction
request.
The applicant has also appealed (see attached letter) the Subdivision
Review Board' s standard requirement of obtaining street improvements
whenever possible. The applicant cites as reasoning that the heavy
trucks working the quarry will quickly destroy any improvements done
these. Staff must take the position that street improvements are nec-
essary along Halcon Road since it is currently only constructed to
all-weather standards (very dusty in summer) and that this is the
method by which the City obtains most all of its street improvements.
It should also be pointed out that street improvements are a require-
ment (condition) of the map for the adjacent parcel to the north
(Tentative Map 18-83) and that Staff has received an application for
division of Lot 19 which is the next lot north of Tentative Map 18-83
(Lot 18) . Together , these three lot split applications total 75% of
the entire length of Halcon Road. Staff does not recommend relaxation
of the road requirement. Bonding for the improvements is always an
available option which could be used here to coordinate improvements
in concert with the other subdividers.
FINDINGS
1. The creation of two lots with a -minimum lot size of 4. 28 acres on
this parcel conforms to all applicable zoning and subdivision
regulations and is consistent with the General Plan.
2. The creation of two lots in conformance with the recommended con-
ditions of approval will not have a significant adverse effect
upon the environment and the preparation of an Environmental Im-
pact Report is not necessary.
3. Approval of the Adjustment to Minimum Lot Size would usurp the
intent of this ordinance section which is to provide flexibility
for borderline lot divisions only and, additionally would create a
precedent that would effectively lower lot size standards further
throughout the community.

RECOMMENDATION
Based upon the above Findings, the Planning Department recommends:
A) Issuance of a Conditional Negative Declaration as follows:
1. Adequate provision shall be made in the design of private
sewage disposal systems to minimize effects on natural
watercourses; and,
2. Grading and tree removal shall be minimized during all phases
of site development; and,
3. Adequate provision shall be made for drainage and erosion
control in conjunction with site development.
B) Denial of the Lot Size Reduction Adjustment.
C) Approval of Tentative Parcel Map 16-83 subject to the following
conditions:
1. The Final Map shall be revised so that neither lot is less
than 4.28 acres in size.
2. Private sewage disposal systems will be an acceptable method
of sewage disposal if reports and designs are acceptable.
All tests, reports and designs shall conform to methods and
guidelines prescribed by the Manual of Septic Tank Practice

shall appear on the Final Map:
"Appropriate soils reports including a percolation test, a
test to determine the presence of groundwater, and a log of
a soil boring to a minimum depth of ten (10) feet shall be
submitted to the Planning Department prior to the issuance of
a building permit. Where soils reports indicate that conven-
tional soil absorption systems are not acceptable, City ap-
proval of plans for an alternative private sewage disposal
system, designed by a Registered Civil Engineer , shall be re-
quired. Depending upon the system, more restrictive require-
ments may be imposed. Sewage disposal systems shall be de-
signed and located to minimize deleterious effects on natural
watercourses. "
3. Water shall be obtained from the Atascadero Mutual Water Com-
pany and water lines shall exist at the frontage of each par-
cel or its public utility easement prior to recordation of
the Final Map.
4. All existing and proposed utility easements, pipelines and
othre easements are to be shown on the Final Map. If there
are other building or other restrictions related to the ease-
ments, they shall be noted on the Final Map.

5. Grading that would be disruptive to the natural topography
shall be minimized. Removal of existing, mature trees shall
also be minimized.
6. Drainage and erosion control plans, prepared by a Registered
Civil Engineer, shall be submitted for review and approval by
the Planning Department prior to issuance of building permits
in conjunction with installation of driveways, access ease-
ments or structures. This shall appear as a Note on the
Final Map.
7. Plan and profile drawings of proposed individual driveways
and driveway easements shall be submitted for approval by
Planning and Public Works Departments in order to determine
average grade and appropriate improvement requirements. This
shall appear as a Note on the Final Map.
8. The applicant shall upgrade the existing fire hydrant at the
corner of Viejo Camino and Halcon Road. The applicant may
desire to enter into an agreement with the owner of the adja-
cent parcel to the north to share the cost of the upgrade in
conjunction with Tentative Parcel Map 18-83.
9. Halcon Road shall be improved to City standards along the
frontage of the property including a minimum paved width of
20 feet with three foot graded shoulders prior to recorda-
tion of the Final Map.
a. Improvements are to be constructed under an inspection
agreement and encroachment permit issued by the Public
Works Department.
b. Improvement drawings, including improvements to control
grading and erosion within the road right-of-way, shall
be submitted to the Public Works Department for review
and approval.
10. All drainage swales shall be indicated on the Final Map and
a Note shall appear on the Final Map which states:
"Any modification of the ground during site development with-
in 50 feet of any drainage swale shall be subject to approval
by the Planning and Public Works Departments. "
11. All conditions herein specified shall be complied with prior
to filing of the Final Map.
12. A Final Map in compliance with all conditions set forth here-
in shall be submitted for review and approval in accordance
with the Subdivision Map Act and the City Lot Division Ordi-
nance prior to recordation.

We wish to appeal the Subdivision Review Board' s requirement
of requiring the paving of Halcon Road fronting the subject
lot split. The road is paved and maintained by the City to
a point just north of the existing driveway.
We believe it is unfair to require the applicant to pave this
road when the road is used by heavy-load trucks hauling from
the Rocky Canyon pit.
The improved road would only be damaged in a short period of
time by the heavy truck traffic, without any requirement for
maintainance or repairing of the damaged sections by the pit
operator.
We would appreciate your processing of this appeal with the
Planning Commission.

REQUEST: To divide a 10.2 acre parcel into two (2) parcels of 5.1
acres each.
BACKGROUND
1. Existing Zoning: RS
2. General Plan: Suburban Single Family Residential
3. Environmental Determination: The applicant has completed an Ini-
tial Study Environmental Description form. The Planning Director
has prepared a draft Negative Declaration indicating the project .
will not have a significant adverse effect upon the environment.
4. Site Conditions: The site fronts San Fernando Road, currently a
private road with a 40 foot right-of-way width. The site drains
south, southeastward, from the northeast corner of the site to-
wards the street frontage. This is because the site contains a
hill peak in the north corner and` swales south and southeastward
toward the street frontage.
5. Project Description: The applicant desires to divide the existing
10.2 acre lot into two 5.1 acre lots. The lot design will create
two rectangular shaped parcels, both fronting approximately 278
feet each along San Fernando Road.
6 Determination of Minimum Lot Size: The site is in the Residential
Suburban Zone which allows a minimum lot size of two and one-half
acresto ten acres depending upon five performance criteria. The
performance criteria are as follows:

Therefore, the applicant may divide the 10.2 acre parcel into two
5.1 acre lots.
7. Subdivision Review Board: On April 5, 1984, the Subdivision Re-
view Board met with Russ Thompson, the applicant' s engineer , to
discuss the proposal. Members of the board in attendance were:
Vern Elliott, Fire Captain; Patsy West, Senior Engineering Tech-
nician; and Fred Buss, Associate Planner . Discussion between the
Board and applicant centered around road improvements where
necessary.
ANALYSIS
Recent road improvements have been completed along San Fernando Road.
Therefore, Staff does not feel there is a need to further improve San
Fernando Road or the frontage along the site. Staff has no other con-
cerns regarding this proposal.
FINDINGS
1. The creation of two 5.1 acre lots conforms with all applicable
zoning and subdivision regulations and is consistent with the
General Plan.
2. The creation of two lots in conformance with the recommended con-
ditions of approval will not require the preparation of an Envir-
onmental Impact Report.
RECOMMENDATION
Based upon the above Findings, the Planning Department recommends the
issuance of a Negative Declaration and approval of Tentative Parcel
Map 5-84 subject to the following conditions:
1. Private sewage disposal systems will be an acceptable method of
sewage disposal if reports and designs are acceptable. All tests,
reports and designs shall conform to methods and guidelines pre-
scribed by the Manual of Septic Tank Practice and other applicable
City ordinances. The following Note shall appear on the Final
Map:

tentative map and in compliance with all conditions set forth
herein shall be submitted for review and approval in accordance

evidence of insurance as per City requirements. He shall provide a
camera and all the black and white film needed so as to take a picture
of each lot he cleans. The film will not be developed unless a conflict
arises , in which case the contractor must show that he has done the job
as per the charges. If the contractor cannot prove he did the work,
then he is to absorb the cost. Include in your bid the cost of the film
for each parcel .

The Contractor upon being awarded the Abatement contract, shall provide
evidence of insurance as per City requirements. He shall provide a
camera and all the black and white film needed _so as to take a picture
of each lot he cleans. The film will not be developed unless a conflict
arises, in which case the contractor must show that he has done the job
as per the charges. If the contractor cannot prove he did the work,
then he is to absorb the cost. Include in your bid the cost of the film
for each parcel .
LEGAL REGULATIONS AND
RESPONSIBILITIES TO THE PUBLIC
Contractor' s Insurance : The Contractor shall not commence work under this
contract untii he shaii have obtained all insurance required, and such in-
surance shall have been approved by the City as to form, amount, carrier
nor shall Contractor allow any subcontractor to commence work in his sub-
contract until similar insurance required of the subcontractor shall have
been so obtained and approved.
(a) Compensation Insurance : The Contractor shall take out and maintain,
during the life of this contract, workmen' s compensation insurance
for all his employees employed at the site of improvement, and in case
any work is sublet, Contractor shall require subcontractor similarly
to provide workmen's compensation insurance for all of the latter ' s
employees, unless such employees are covered by the protection afforded
by Contractor. Contractor indemnifies City for any damage resulting
to it from failure of either Contractor or the subcontractor to take
out or maintain such insurance.
(b) Public Liability and Property Damage Insurance : The Contractor shall
take out and maintain during the life of this contract, such public
liability and property damage insurance as shall protect the City,
its elective board, officers, agents , and employees, Contractor and
any subcontractor performing work covered by this contract from claims
for damage for personal injury including death, as well as from claims
for property damage which may arise from Contractor' s or subcontractor ' s
operations under this contract, whether such operations be by the Con-
tractor, or by any subcontractor, or by anyone directly or indirectly
emploYed by either Contractor of subcontractor, and the minimum amounts
of such insurance shall be as follows:

1. REPORT OF THE LEAGUE OF CALIFORNIA CITIES LEGAL ADVOCACY COMMITTEE
At its regular meeting on January 6, 1984, the Legal 'Advocacy Committee
reviewed some 35 cases; of significance to cities. The committee urged
city attorneys to consider joining as amici in the following cases:
a. Glendale Redevelopment Agency v. Sardo
This case is now pending in the State Court of Appeal following an
adversetrialcourt decision. The ease involves condemnation of
real property by a redevelopment agency. The most important issues
of the case are: 1) the trial_ judge ruled that CCP 3< 1268.310
granting a property owner the legal interest rate (10%) on his
condemnation award is unconstitutional, and the court granted the
market interest rate (14%) instead; and 2) the judge allowed the
property owners to collect $25,000 in attorneys' fees under CCP
1250.410 in order to punish the redevelopment agency.
b. Huntinaon Park Redevelopment Agencyy. Martin
This case involves a petition for a hearing now pending before the
California Supreme Court after the Court of Appeal ruled that city
officials cannot use their sales tax to help finance redevelopment
agencies without voter approval The Court held that this method
of transferring sales tax revenues from the city to the agency vio-
lates Proposition 13 because 1) the sales tax is a special tax
requiring a two-thirds vote of the electorate and 2) the redevelop-
ment agency is a special district subject to the two-thirds vote
• requirement.

c. Westminster Mobilehome Park :Owner's Associationy. City
of Westminster
This case is now pending before the District Court of Appeal and
involves the validity of the city's mobilehome rent control ordi-
nance. The issue in the case is whether landlords receive a fair
return on their investment in rental property by limiting rental
increases to a formula based on the net operating income of the
landlord. Landlords are arguing for a rate of return based on the
current market value of their property which will generally result
in high rent increases.
d. County of Butte v. Bach
This case is now pending before the State Court of Appeal following
a jury verdict awarding Mr. Bach $650,000 in damages basedon
alleged federal civil' rights vitiations by the county and by a
county supervisor. The case involves a rather complicated factual
situation, but the crux of the case lies inthefact that Mr. Bach
used his single-family house as a professional office contrary to
the zoning laws; and when the county brought an action to compel
Mr. Bach to comply with the R-1 zoning, he complained that his •
civil rights had been violated. The two most important questions
the case raises are: 1) is the Federal Civil Rights Act meant to
apply to zoning legislation? and 2) do supervisors and council-mem-
bers have absolute or at least qualified immunity when making
legislative decisions?
2 RECENT DECISIONS OF INTEREST
a. Prosecutor is Immune From Suit
The U'.S.C.A.9th has held that an attorney, acting within the scope
of his authority and in a quasi-judicial capacity, is absolutely
immune from section 1983 civil rights action. (Ybarra v. Reno
Thunderbird Mobile Home Village, U.S.0 A.9th, Jan. 10, 1984.)
b. City Council Must Consider Timely Protests
The C.A.`2nd has held that where a municipality schedules a public
hearing on a proposed improvement project, and the hearing is not
completed in one 'session, but is continued to a later date, the
municipality must consider citizen protests made during the time
period between the hearings. In this case, the council refused to
consider protests submitted later than the original hearing on the
grounds that they weren't timely. Reversed. (Association of
Citizens Against Undergrounding v. City of Rancho Palos Verdes,
C.A.2nd, Jan. 11, 1984.) •

c. Federal Court Cannot Order Officials to Obey State Law
The U.S. Supreme Court has ruled that federal courts lack jurisdic-
tion to enjoin the actions of state institutions and officials on
the basis of state law. (Pennhurst State School and Hospital v.
Halderman, U.S.Sup.Ct., Jana 23, 1984.)
d. Washington Obscenity Law Held Unconstitutional
The U.S.C.A.9th has held unconstitutional a Washington state anti-
obscenity law which, among other things, included protected
expression in the definition of obscenity and set the basis for
imposition of civil fines. Q.R. Distributors, Inc. v. Eikenberry,
U.S.C.A.9th, Feb. 6, 1984.)
e. Ordinance Banning Placard Poles Upheld
The appellate department of the Los Angeles Superior Court has
ruled that a Los Angeles city ordinance banning the use of large
wooden poles to hold up placards during demonstrations is
constitutional. The law prohibits the possession of any length of
wood that is more than 1/4 inch in thickness and 2 inches in width.
(People v. Dury, L.A.S.C. CR A20434.)
f. Adult Theater Ban Voided
A federal judge in Los Angeles has ruled unconstitutional a
Whittier zoning ordinance that prohibits the location of, an adult
theater within 1,000 feet of a church. The projection of movies
has been held a form of expression protected by the First Amendment
though zoning and other licensing requirements can be imposed,
noted the Appellate Court. (Whittier v. Walnut Properties, 2 Civ.
65777.)
g. Probationary Employee Terminated Without Cause
The C.A.lst has ruled that an appointing power may terminate a pro-
bationary employee without judicially cognizable good cause and
without a hearing. (Johnston v. Trustees of the California State
University and Colleges, C.A.lst, Feb. 14, 1984.)
h. Fireworks Regulation Field Preempted by State Law
The C.A.lst has held that the state Legislature, in enacting the
State Fireworks Law, Health and Safety Code 12500, et seq. , pre-
empted the field of fireworks regulation, thereby precluding a
local ban on the sale of fireworks. (Ventura v. City of San Jose,
C.A.lst, Feb. 16, 1984.)

i. City Religious Display is Constitutional
The U.S. Supreme Court has held that a nativity scene displayed by
a municipality at Christmas time isnot violative of the establish-
ment clause of the First Amendment. (Lynch v. Donnelly, U.S.

because the apartments did not meet the current standards for con-
dominiums, but did meet the city's existing standards for apartment

k. No-Nepotism Rule Upheld as Valid
The U.S.C.A.9th has upheld a county "no-nepotism" rule as valid
under the due process and equal protection clauses under the U.S.

The C.A.4th has held that under the substantial evidence test, a

m. State Must Reimburse Counties for State-Mandated Spending
The C.A.2nd has ruled that section 2231(a) of the Revenue and
Taxation Code requires California to reimburse local governments
for costs incurred as a result of state-mandated spending. (County

The C.A.2nd has ruled that a city is estopped from denying video
game arcade licenses when it has granted the licenses and imme-
diately thereafter attempted to revoke them, resulting in hardship
to those seeking the licenses and detriment to the public trust in

3. STATUS OF PENDING LITIGATION
a. Larrison v. City of Atascadero
Subsequent to the sustaining of the City's fifth demurrer to peti-
tioners' fourth amended petition for writ of mandate (filed by nine
police officers to obtain merit increases in their salaries since
completion of their probationary periods and to collect the aggre-
gate sum of $19,247 as damages for unpaid back salaries) at a
hearing on February 10, 1984, Presiding Judge Warren Conklin signed
the final judgment denying writ on April 27, 1984, thereby
concluding this case in the Superior Court. Petitioners have now
filed their notice of appeal of the Superior Court decision to the
Appellate Court.
b. Gearhart v. City of Atascadero
The City's demurrer to petitioner's third amended petition to force
the City to grant him a permit to collect solid waste was sustained
on November 10, 1983, and Presiding Judge Warren Conklin signed

the order for entry of judgment in favor of the City on March 5,
1984. Petitioner has filed his notice of appeal of the Superior
Court decision to the Appellate Court.
4. STATUS OF PENDING PROSECUTIONS
a. People v. Latham
The above prosecution is for violation of § 9.3.142 and 19.040.0 of
the Atascadero Municipal Code, establishing a residential use on a
vacant lot by the use of a bus as a residence and building a
structure without building permits. The defendant plead not guilty
at the arraignment, and several pretrial dates have been set and
con . ed on the premise that the defendant hire an attorney to
def nd him. The current pretrial is set for May 17, 1984.

Study. Monday night you will be presented an oral summary of
that study. From the staff' s standpoint, I would like to point
out that some of the internal space allocations made by Quad do
not appear to us to be feasible nor does the staff support the
idea of building a mezzanine in the lower Rotunda.
However, the staff does agree with the analysis that there is
total space available sufficient for our needs in this building,
assuming arrangements are made for the Library. Accordingly, it
is suggested that when you review the Quad recommendations that
you keep in mind the conclusion of space available as to the
analysis of alternative costs and as to the analysis of overall
utilization of the Administration Building.

the Planning Commission for preparation of an implementation
plan on ,February 27, 1984.
Staff is currently working on an implementation plan concerning
the, identified parking problems and alternative solutionsincluded
in the Parking Study dated February 21, 1984.
A draft implementation plan will be provided to the Planning Com-
mission for discussion at their regular meeting of June 4, 1984.

16 TO TITLE 2 OF THE ATASCADERO MUNICIPAL
CODE RELATING TO CLAIMS AGAINST THE CITY
The Council of the City of Atascadero ordains as follows:
Section 1. Ordinance No. 67 entitled Chapter' 6 of Title 2 is
hereby changed to read Chapter 16 of Title 2.
Section 2. The City Clerk shall cause this ordinance to be
published once within fifteen (15) days after its passage in the
Atascadero News, a newspaper of general circulation, printed,
published and circulated in this City in accordance with Section
36933 of the Government Code; shall 'certify the adoption of this
ordinance; and shall cause this ordinance and its certification
to be entered in the Book of Ordinances of this City.
Section 3. This ordinance shall go into effect and be in
full force and effect at 12.01 on the thirty-first (31st) day
after its passage.

MEMORANDUM
With reference to the process for to replacing the
Treasurer as a consequence of Mr. Rizzuto' s resignation, the
State statutes are quite clear as follows:
The Council must, within 30 days from commencement of the
vacancy, either fill the vacancy by appointment or call a
special election. The election must be held at the next
regularly scheduled election, which in this case would be
result in November 1984.
In either event, if the vacancy is filled by appointment of
special election, the person filling it will hold office for
the unexpired term of the former incumbent. In this case
until June 1986. It is the Council's responsibility to make
these decisions. The City Treasurer cannot appoint his own
successor.

As part of the weed abatement process", the City Council is
required to hear objections to the proposed removal of'weeds,
rubbish, and other combustible material. This hearing allows
any affected property owners to protest the proposed abate-
ment of hazards on their property
After hearing the objections, the City Council overrules or
allows any objection. This can be done by resolution or motion.
I recommend action by motion, i.e. "I move we (allow - overrule)
the objections to the proposed removal of noxious or dangerous
weeds on the lots posted. "
After disposing of the objections, or if no objections are made,
• the Council orders the abatement of the nuisance. This also can
be done by motion or resolution. I recommend action by motion,
i.e. "I move that the Fire Chief or his authorized representatives ;
are ordered to abate the nuisance of noxious or dangerous weeds
on the lots ;posted. "
As of this date, we have not received any written protests.

MENDING APPROVAL OF GENERAL PLAN AMENDMENT 13-84
TO INCLUDE A STATEMENT WHICH ENCOURAGES ESTABLISH-
MENT OF ADDITIONAL COMMERCIAL AND LIGHT, CLEAN
INDUSTRIAL USES ON SUITABLE SITES.
WHEREAS, the Atascadero City Council conducted a public hearing
on the subject matter; and,
WHEREAS, Government Code Section 653040.5 provides that a general
plan be amdended by theadoptionof a resolution; and,
WHEREAS, the proposed General Plan Text Amendment is consistent
with the existing General Plan Land Use Text and the whole of the Gen-
eral Plan as per Section 65300.5 of the State of California Government
Code.
WHEREAS, the 'General Plan Text Amendment has been processed in ac-
cordance to Section 65350-65361 of the State of California Government
Code regulating the amending of the General Plan.
• WHEREAS, the proposed Text Amendment has been determined to have
no adverse environmental impact.

NING COMMISSION REQUIRING 168 PARKING SPACES
FOR A 95 UNIT SENIOR CITIZENS RENTAL PROJECT
AT 10165 EL CAMINO REAL (YOUNG)
WHEREAS, the'Atascadero City Council did on April 23, 1984 conduct
a properly noticed public hearing to consider an appeal submitted by
Edward - and Judy Young a condition of Conditional Use Permit 3-84 as
approved by the Planning Commission at their regular meeting of April
2, 1984; and,
WHEREAS, the condition appealed relating to the requirement of 168
parkng spaces for a 95 unit Senior Citizens congregate rental housing
project is one of many established by the Planning`Commission; and,
WHEREAS, the 'appellant did submit information concerning said ap-
peal` and did request that the required aprking be reduced to 82 'spaces
based upon the characteristics of the future residents as being essen-
tially non-driving adults; and,
• WHEREAS, no one spoke against the appeal and one person spoke in
favor except for the applicant.
NOW, THEREFORE, BE IT RESOLVED that the Atascadero City Council
does hereby GRANT the appeal to Condition No. 9 of Conditional Use
Permit 3-84< with the findings of fact noted below and subject to the
.following:
Parking shall be provided as set forth in Sections 9-4.114
through 9-4. 119 with the number of required parking stalls
to be reduced to 104 stalls with eight (8) to be handicapped
stalls. This condition shall be substituted for Condition
No. 9 of Conditional Use Permit 3-84
Findings of Fact to grant appeal of Conditions establish for ap-
proval of Conditional Use Permit 3-84:
1. The , reduced parking at a rate of one per unit plus Nandi-
capped stalls and employees will be able to accommodate the
needs of the congregate senior housing; and,
2. The proposed use of senior housing has characteristics that
are different than those of a standard multifamily project.
On motion by Councilman and seconded by Coun-
cilman , the foregoing resolution is adopted in
