DISCLOSURE OF EX PARTE COMMUNICATIONS:
Prior to a project hearing Planning Commission Members must disclose any communications they have had on any
quasi-judicial agenda items. This includes, but is not limited to, Tentative Subdivision Maps, Parcel Maps, Variances,

WELCOME TO THE ATASCADERO PLANNING COMMISSION MEETING
The Planning Commission meets in regular session on the first and third Tuesday of each month at 6:00 p.m. at City
Hall, Council Chambers, 6500 Palma Avenue, Atascadero. Matters are considered by the Commission in the order of
the printed Agenda.
Copies of the staff reports or other documentation relating to each item of business referred to on the Agenda are on
file in the office of the Community Development Department and are available for public inspection during City Hall
business hours at the Front Counter of City Hall, 6500 Palma Avenue, Atascadero, and on our website,
www.atascadero.org. All documents submitted by the public during Commission meetings that are either read into
the record or referred to in their statement will be noted in the minutes and available for review in the Community
Development Department. Commission meetings are audio recorded, and may be reviewed by the public. Copies of
meeting recordings are available for a fee. Contact the City Clerk for more information (470-3400).
In compliance with the Americans with Disabilities Act, if you need special assistance to participate in a City
meeting or other services offered by this City, please contact the City Manager’s Office or the City Clerk’s Office,
both at (805) 470-3400. Notification at least 48 hours prior to the meeting or time when services are needed will

considered to step up to the lectern. If you wish to speak for, against or comment in any way:

Associate Planner Banister presented the staff report and answered questions from the
Commission.
PUBLIC COMMENT
The following members of the public spoke during public comment: Kathryn
Kleinschmidt, Rachel Aljilani, Ken Haggard, Mike Zappas, and Zoe Zappas. Ms. Aljilani
answered questions from the Commission.
Chairperson Seay closed the Public Comment period.
The Commission suggested the City explore more bike racks in general. The applicant
stated that they intend to place one bike rack up front near the storefront at the sidewalk
in the right-of-way, and the other location will be determined.
MOTION: By Commissioner Donovan and seconded by
Commissioner Dariz recommending the Planning
Commission adopt PC Resolution 2018-A,
approving USE 18-0062, approving Conditional
Use Permit to allow a reduction in the number of
required off-street parking spaces, and a
modification of fencing requirements for a mixed-
use development in the Downtown Commercial

DIRECTOR’S REPORT
Director Dunsmore stated there are no items scheduled for the September 18th
meeting, so it will be cancelled. Director Dunsmore gave an update on projects in the
City.

The next regular meeting of the Planning Commission scheduled for September 18,
2018, will be cancelled. The next regular meeting of the Planning Commission will be on
October 2, 2018, at City Hall, Council Chambers, 6500 Palma Avenue, Atascadero.

Background:
The Planning Commission approved Tentative Parcel Map AT 16-0178 (PLN 2016-1590
/ TPM 2016-0103) with Resolution PC 2016-0029 on November 1, 2016. The “Initial
Life” of the tentative map expired on November 1, 2018. The applicant applied for a
time extension on September 17, 2018. Consistent with California Government Code
661452.6(e), when an application for a time extension is received, the map is
automatically extended for 60 days.
Summary:
The proposed project consists of a Tentative Parcel Map to subdivide two (2) existing
parcels (2.36 acres) into four (4) lots ranging from 0.5 to 0.85 acres. The project is
located in the Residential Single-Family (RSF-X) zoning district with a minimum parcel
size of ½ net acre.
Analysis:
The Subdivision Map Act mandates an initial two-year life for a tentative map. The City
may extend or continue to extend, in one year increments, the time at which the map
expires for a period or periods not to exceed a total of six (6) years. The Planning
Commission has discretion on whether they want to extend the map, or they can defer
the decision to the City Council.

The proposed time extension would extend the amount of time the subdivider has to
satisfy conditions of the tentative map and request acceptance of the parcel map from
the Planning Commission. The parcel map must be accepted by the Planning
Commission on or before November 1, 2019, unless an additional time extension has
been granted, or the map approval shall expire.
Conclusion:

The applicant is working to develop plans for subdivision and public improvements for
the project. No significant factors have changed to warrant reconsideration of project
conditions or entitlements. Staff recommends the Planning Commission approve the
time extension as requested.
ENVIRONMENTAL DETERMINATION:
The proposed project is Categorically Exempt (Class 15) from the provisions of the
California Environmental Quality Act (California Public Resources Code §§ 21000, et
seq., “CEQA”) and CEQA Guidelines (Title 14 California Code of Regulations §§ 15000,
et seq.) pursuant to CEQA Guidelines Section 15315, because it consists of the division
of property into four or fewer parcels “when the division is in conformance with the
General Plan and zoning, no variances or exceptions are required, all services and
access to the proposed parcels to local standards are available, the parcel was not
involved in the division of a larger parcel within the previous 2 years, and the parcel
does not have an average slope greater than 20 percent.” This exemption is included
as Attachment 3.
FINDINGS:
To approve this time extension, the Planning Commission must make two findings.
These findings and the facts to support these findings are listed below:
Finding #1
There have been no changes to the provisions of the General Plan or zoning
regulations applicable to the project since the approval of the entitlement (AMC 9-
2.117(a)(1));
There have been no applicable changes to the General Plan or zoning regulations
since the project was entitled. All conditions of approval and required mitigation
measures are to be completed in addition to all applicable zoning requirements
and General Plan requirements.

Finding #2
There have been no changes in the character of the site or its surroundings which affect
how the standards of the General Plan or zoning regulations apply to the project (AMC
9-2.117(a)(2)).
The applicant is working with City staff to have his grading plan approved in order
to install subdivision improvements in accordance with approved entitlements. No
new structures have been constructed on the surrounding properties adjacent to
the subject properties. There have been no changes in the character or its
surroundings which affect how the standards of the General Plan or zoning
regulations apply to the project.
ALTERNATIVES:
1. If the subdivider voluntarily agrees, the Planning Commission may include
modifications to the conditions of approval for the project. Any proposed
modifications, should be clearly re-stated in any vote on the attached resolution.
2. The Planning Commission may determine that more information is needed on
some aspect of the project and may refer the item back to the applicant and staff
to develop the additional information. The Commission should clearly state the
type of information that is required. A motion, and approval of that motion, is
required to continue the item to a future date.
3. The Planning Commission may deny the project. The Commission must specify
what findings cannot be made, and provide a brief oral statement, based on the
Staff Report, oral testimony, site visit, correspondence, or any other rationale
introduced and deliberated by the Planning Commission.

Planning Conditions
1. The approval of this application shall become final, subject to the completion
of the conditions of approval, fourteen (14) days following the Planning
Commission approval unless prior to the time, an appeal to the decision is
filed as set forth in Section 9-1.111(b) of the Zoning Ordinance.

5. The subdivider shall defend, indemnify, and hold harmless the City of
Atascadero or its agents, officers, and employees against any claim or action
brought to challenge an approval by the City, or any of its entities, concerning
the subdivision.

impact fees at the time of building permit issuance.

7. An Arborist Report shall be prepared and submitted to the Community
Development Department in conjunction with improvement plans for the

13. The flag portion of Parcel 2 shall be blanketed with an easement for private
access, public & private utilities and private drainage for the benefit of parcels
1, 3, and 4. An extension of this easement shall be extended northwesterly,

approximately 20 feet more or less to adequately serve Parcel 1.

included in the subdivision improvement plans as follows:
a. Each Post-Construction Requirement (PCR) identified in the
Storm Water Control Plan (SWCP).
b. A list of each Structural Control Measure (SCM) associated with

c. The area (in SF) of the impervious surface associated with each

development run-off and post-development run-off (at complete build-out) and
detain or retain (on-site) the post-development storm water run-off in a
manner so as to not impact adjacent and downstream properties, to the
satisfaction of the City Engineer. Detention or retention basins and associated
drainage improvements shall be privately owned and maintained by the
property owner(s).

Background:
This project was brought before the Design Review Committee on August 15 and
September 26. The applicant originally proposed a 3,000 square foot detached metal
garage with a simplistic design and no additional vegetation. Neighbors and the Design
Review Committee were concerned about the size of the structure and its neighborhood
compatibility. The applicant revised plans to reduce the size of the structure down to
2,000 square feet, increase setbacks, alter the design and include vegetation for
screening. The project was brought back to the Design Review Committee. Neighbors
again expressed concerns about the size and neighborhood compatibility of the revised
structure. The Design Review Committee forwarded the project to the Planning
Commission and recommended alterations to the design to make the structure appear
more residential and that additional landscaping be added to screen the structure and
improve neighborhood compatibility.

Summary:
The applicant proposes building a detached metal garage that would be forty (40) feet
by fifty (50) feet, for a total of 2,000 square feet. The lot has one existing single-family
residence that is 1,650 square feet. The proposed height of the structure would be
fourteen (14) feet at the eaves and twenty (20) feet at the peak of the roofline. The
applicant is proposing the garage for storage of personal vehicles and has agreed that
the space will not be leased for storage of commercial vehicles. The structure would be
set back approximately thirty-six (36) feet from the northern property line and twenty
(20) feet from the eastern property line. The existing driveway is currently eleven (11)
feet wide and is proposed to be widened to twelve (12) feet by adding a Class 2 Base
gravel shoulder. An existing covered parking structure is located on the parcel. Staff
could not locate permits for this structure and a condition has been added that this
structure be removed or permitted before finalization of building permits. The applicant
is also proposing the removal of three (3) native trees near the structure and is
proposing to plant seven (7) new oak trees in addition to tall vegetation such as Flannel
Bush that would screen the garage from neighboring properties.
Analysis:
Atascadero Municipal Code 9-6.106 conditionally allows oversized accessory
structures, including garages which exceed 50% of the size of the main residence, in
single-family zoning districts. Since the existing residence on the site is 1,650 square
feet, the new structure exceeds the 50% requirement and therefore would require a
Conditional Use Permit approved by the Planning Commission.

ENVIRONMENTAL DETERMINATION:
The proposed project is Categorically Exempt (Class 3) from the provisions of the
California Environmental Quality Act (California Public Resources Code §§ 21000, et
seq., “CEQA”) and CEQA Guidelines (Title 14 California Code of Regulations §§ 15000,
et seq.) CEQA pursuant to CEQA Guidelines Section 15303, because it is a new
accessory structure and will not require any grading on slopes over 20%. This
exemption is included in Exhibit A.
FINDINGS:
To approve the Conditional Use Permit, the Planning Commission must make the
following findings. These findings and the facts to support these findings are included in
the attached PC Resolution 2018-A.

WHEREAS, an application was received from Kenneth Klassen, 16482 Quails Covey Lane,
Clovis, CA 93619 (owner) for a Conditional Use Permit to construct an oversized detached garage; and
WHEREAS, the property is in the Residential Suburban zoning district; and
WHEREAS, detached accessory structures in excess of fifty percent (50%) of the primary
residence are subject to the approval of a minor Conditional Use Permit; and
WHEREAS, the proposed project qualifies for a Categorical Exemption consistent with CEQA
guidelines Section 15303; New construction or conversion of small structures; and
WHEREAS, the laws and regulations relating to the preparation and public notice of
environmental documents, as set forth in the State and local guidelines for implementation of the
California Environmental Quality Act (CEQA) have been adhered to; and
WHEREAS, a timely and properly noticed Public Hearing upon the subject Minor Conditional
Use Permit application was held by the Planning Commission of the City of Atascadero at which hearing
evidence, oral and documentary, was admitted on behalf of said Conditional Use Permit; and
WHEREAS, the Planning Commission reviewed the proposed Conditional Use Permit
application on November 6, 2018, at 6:00 p.m. and considered testimony and reports from staff, the
applicants, and the public.
NOW THEREFORE, the Planning Commission of the City of Atascadero, California, takes the
following actions:
SECTION 2. Findings of Environmental Exemption. The Planning Commission finds as
follows:
1. The proposed project is Categorically Exempt (Class 3) from the provisions of the California
Environmental Quality Act (California Public Resources Code §§ 21000, et seq., “CEQA”) and
CEQA Guidelines (Title 14 California Code of Regulations §§ 15000, et seq.) CEQA pursuant to
CEQA Guidelines Section 15303, for new construction of small structures including accessory

SECTION 2. Findings for approval of Conditional Use Permit. The Planning Commission
finds as follows:
1. The proposed project or use is consistent with the General Plan; and
Fact: detached accessory structures are consistent with the Rural Estates land use designation of
the General Plan. Land Use, Open Space and Conservation Element Program 1.1.6 requires the
size, use and appearance of accessory structures in the residential zoning districts to be
compatible with the surrounding neighborhood. The proposed structure has an agricultural
appearance in keeping with the area. While the proposed structure is over 50% of the size of the
primary residence, it will serve a residential use, including vehicle storage and a workshop.
2. The proposed project or use satisfies all applicable provisions of the Zoning Ordinance; and
Fact: as proposed, the project will meet the property’s setback, height and other site design
requirements. The use of the structure will be limited to uses permitted by the Zoning Ordinance.
The project, with Planning Commission approval of this Conditional Use Permit, satisfies all
applicable provisions of the Zoning Ordinance related to residential accessory structures.
3. The establishment, and subsequent operation or conduct of the use will not, because of the
circumstances and conditions applied in the particular case, be detrimental to the health, safety or
welfare of the general public or persons residing or working in the neighborhood of the use, or be
detrimental or injurious to property or improvements in the vicinity of the use; and
Fact: the use of the accessory structure on the property includes the storage of vehicles. This is a
typical use in residential single-family neighborhoods. The proposed structure will be
constructed to meet the standards of the building code.
4. The proposed project or use will not be inconsistent with the character of the immediate
neighborhood or contrary to its orderly development; and
Fact: the proposed structure will be located at the rear of the property. Landscaping and other
architectural features shall be implemented to reduce the impact the structure could have on the
neighborhood. The proposed use of the structure is compatible with the neighborhood.
5. The proposed use or project will not generate a volume of traffic beyond the safe capacity of all
roads providing access to the project, either existing or to be improved in conjunction with the
project, or beyond the normal traffic volume of the surrounding neighborhood that would result
from full development in accordance with the land use element; and
Fact: the addition of a residential garage will not contribute additional traffic in the
neighborhood. The use of the structure will be similar to uses currently onsite. No additional
residential units will be added.
6. The proposed project is in compliance with any pertinent City policy or criteria adopted by
ordinance or resolution of the City Council; and
Fact: detached accessory structures are permitted in the residential districts. Consistent with City
policy, the accessory structure may not be used as an additional residential unit.

Planning Services Conditions
1. This Conditional Use Permit shall allow the accessory structure described in the
attached exhibits and located on APN 049-073-016.

2. The approval of this use permit shall become final and effective for the purposes of
issuing building permits fourteen (14) days following the Planning Commission
approval unless an appeal to the decision is filed as set forth in Section 9-1.111(b) of
the Zoning Ordinance.

3. The Community Development Department shall have the authority to approve the
following minor changes to the project that (1) modify the site plan project by less
than 10%, (2) result in a superior site design or appearance, and/or (3) address a
construction design issue that is not substantive to the Master Plan of Development.
The Planning Commission shall have the final authority to approve any other changes
to the Master Plan of Development and any associated Tentative Maps unless
appealed to the City Council.

4. Approval of this Conditional Use Permit shall be valid for twenty-four (24) months
after its effective date. At the end of the period, the approval shall expire and
become null and void unless the project has received a building permit.

5. The applicant shall defend, indemnify, and hold harmless the City of Atascadero or its
agents, officers, and employees against any claim or action brought to challenge an
approval by the City, or any of its entities, concerning the construction or use of the
detached accessory structure.

6. Architectural elevations shall be consistent with Exhibit D. Exterior building and roof
colors and materials shall be consistent with Exhibit E as approved by the Design
Review Committee.

7. All utilities servicing the accessory structure shall be installed underground. BP
8. Building Height shall comply with the standards of the Zoning Ordinance. BP
9. The proposed structure shall not be used as a secondary residential unit. The
accessory structure shall not have cooking facilities including a kitchen or wet bar. No
overnight stays are permitted.

10. The applicant shall apply for and finalize a building permit for the existing unpermitted
carport or remove the carport shown in Exhibit C before the building permit for the
proposed garage may be finalized.

11. A Storm Water Control Plan will be required upon submittal of construction plans. BP
Fire Department Conditions
12. The detached accessory structure shall comply with all Fire Department standards
and requirements including for fire sprinklers; driveway length, width, surface and
slope; dry line; and fire truck turnaround.
