DEVELOPMENT PROJECT REVIEW
2. DESIGN REVIEW OF 5802 TRAFFIC WAY
Business Owner, Kathryn Kleinschmidt, announced that the name of the business should
be corrected to read “The Giving Tree Center dba Sacred Gem, LLC.”
Planner Banister presented the staff report and announced that a correction should be made
in the staff report to state that the site is at approximately 16% slope; not 30% as published.
Planner Banister stated that the applicant is requesting an exception to parking and is
requesting five spaces instead of seven. Staff is recommending that drought tolerant taller
landscaping be installed above the stairs that lead up to the retail area above. Director
Dunsmore and Planner Banister answered questions from the Committee. An email was
received from Melissa Barton (Exhibit A).

The project is a two-building mixed-use development. The front building is a
ground-floor restaurant space with an apartment on the 2nd floor. The rear
building has two residential units over ground floor garages. The applicant
proposes providing five off-street parking spaces, where seven are required by
the Zoning Ordinance. The reduction of parking spaces must be approved by
the Planning Commission at a future hearing.

The following members of the public spoke during public comment: Kathryn Kleinschmidt,
Ken Haggard, and Rachel Aljilani.
Chairperson Fonzi closed the Public Comment period.
The Committee made the following recommendations (in red):
1. Restaurant ducting shafts
The Committee was in support of the applicant providing ducting shafts and
ventilation for the kitchen to facilitate a future restaurant. The applicant agreed to
designate an area for this.
2. Storefront windows
The Committee was in support of the applicant deciding whether or not to widen
the doors, or make the larger door with skylights, within the constraints of the straw
bale design.
3. Parking space reduction to 5 spaces (from 7)
The Committee was in support of approving the parking reduction, and requested
that the applicant enforce parking in the garages. T he Committee asked the
applicant to talk to the City about accessible parking on Traffic Way a nd a place
for customer drop off before the project goes to Planning Commission. The curb
restriction should not allow all day parking in front of the restaurant. The Committee
encouraged the applicant to pursue a parking agreement with El Paseo Plaza. The
DRC recommends that the Planning Commission put in place a parking limitation
on the street in front of this project (designated drop off area, or two-hour
restriction). The Public Works team will evaluate this as well as the Police
Department.
4. Fence/Landscaping
The Committee was in support of tall landscape shrubs that will comply with the
landscape plan. The Committee was in support of screening and landscaping the
property on the east-apartment side. Landscaping on the El Paseo Plaza side is
voluntary.
5. Landscaping
The Committee was in favor of taller landscaping at the back.
6. Commercial Trash
The Committee recommends that the applicant work with staff to address DRC’s
concerns with trash service.
7. Appearance / Signage
The Committee was agreeable with said complex not having a name, and only
having numbers. The Committee was not concerned with signage. Committee
was in support with colors and architecture.
The Committee was in favor of the applicant working with staff on addressing DRC
comments, and then moving the project forward to Planning Commission for approval.

3. DESIGN REVIEW OF OUTDOOR STORAGE YARD AT 6501 VIA AVE.
Director Dunsmore talked about the history of the property. Senior Planner Taylor presented
the staff report. Senior Planner Taylor and Director Dunsmore answered questions from the
Committee.

The following members of the public spoke during public comment: William Holmes and
Jesse Anderson.
Chairperson Fonzi closed the Public Comment period.
The Committee made the following recommendations (in red):
1. Use of Parcel
The Committee expressed concern regarding previous land uses and future
potential of this site.
2. Landscape, street, trees 5% minimum landscape coverage
The Committee was in support of some temporary landscaping behind the fence.
The applicant will work with staff to determine what varieties (maybe Chinese
pistache) would work well in this location.
3. Fences
The Committee was in support of pipe rail fence and recommended the applicant
not replace the slatted fence right now, but replace it in the future. The applicant
stated he does not want to put in a fence along the creek. The Committee would
like added conditions that the applicant move the fence, provide an access
easement (possibly 35’), and look at the parking situation. Staff needs to make a
determination on the width after discussing with Public Works and Fire. With

The project includes a Conditional Use Permit for a 2.6-acre outdoor sales and
storage yard in the industrial zone, including installation of one (1) cargo
container. The site is proposed to be used for contract construction services,
including storage of large equipment and an office, and for the outdoor sale of
building and landscape materials, which would be open to the public.

performance standards and conditions, the Committee felt comfortable forwarding
the item to Planning Commission.
4. Screening for storage yard
The Committee was in support of a screening fence 6’ wood between the parking
area and storage yard.
5. Exterior paint color on existing building
The Committee was in support of staff’s recommendation to paint the existing
building a barnlike (red) or rust red. The applicant prefers to paint the building
green, so the Committee agreed if it’s green, the color shall be more olive or earthy.
The applicant will work with staff to choose a color that has natural tones and is
compatible with the logo.
6. Outdoor storage and Cargo container
The Committee agreed that whatever color is chosen for the existing building, the
cargo container should be the same, whether it’s painted or not.
7. General site appearance/performance standards
The Committee discussed the potential for an annual review to ensure compliance
with the project conditions.
8. Parking
The Committee was in agreement with staff’s recommendation. The applicant
stated that Mitch Frederick is coming out to work on the parking area.
9. Performance Standards – The Committee recommended a condition be placed
on the CUP that states items (RV’s vehicles, storage) not associated with this
business may not be stored on this portion of the property.
10. Environmental Hazard
The Committee recommended a condition be placed on the CUP that states that
items that the County Environmental Health is concerned with be addressed.
The Committee was in favor of the applicant working with staff on DRC’s comments, and
then moving the project forward to Planning Commission for approval.

DIRECTOR’S REPORT
Director Dunsmore stated that the next meeting is scheduled for July 11, 2018, however,
there are no items scheduled for that meeting so it may be cancelled. Director Dunsmore
gave an update on LaDonna’s, a new Vietnamese Restaurant, Santa Maria B rewing, and
La Plaza, as well as other properties in Atascadero.

DISCUSSION:
Project Description / Summary
The applicant proposes building a detached metal garage that will be forty (40) feet by
seventy-five (75) feet, with a total square footage of 3,000 feet. The parcel is 0.98 acres
and located in the Residential Suburban zoning district. The lot has one existing single-
family residence that is 1,650 square feet. The proposed height of the structure includes
sixteen (16) feet at the eaves and twenty-one (21) feet at the peak of the roofline. The
applicant is proposing the garage for storage of their personal car collection and has
agreed that the space will not be leased for storage of commercial vehicles. The
existing driveway is currently eleven (11) feet wide and is proposed to be widened to
twelve (12) feet by adding a Class 2 Base gravel shoulder. An existing covered parking
structure is located on the parcel. Staff could not locate permits for this structure and a
condition will be added to the CUP that this structure be removed or permitted before
finalization of building permits.
Analysis
Oversized accessory structures, including garages which exceed 50% of the size of the
main residence, are conditionally allowed in single-family zoning districts. Design review
is required to ensure compatibility with the single-family neighborhood. The DRC’s
recommendations will be presented to the Planning Commission when they consider a
Conditional Use Permit for this project.

DRC DISCUSSION ITEMS:
1. Architectural Design and Scale
The applicant has proposed a detached garage with a total square footage of
3,000 square feet and a maximum height of twenty-one (21) feet. Atascadero
Municipal Code 9-6.106 limits the gross floor area of a detached accessory
structure to less than fifty percent (50%) of the gross floor area of the principal
structure. The proposed accessory structure is 82% larger than the existing
primary residence of 1,650 square feet. The structure is set far back off of La Luz
on a downward slope, keeping it almost entirely hidden from La Luz Road. The
size and height of the proposed structure will make it visible from Del Rio Road
when looking between the houses behind the subject parcel.
The proposal is being presented to DRC for consideration of the scale and
character of the structure as it would be visible from the nearby neighboring
properties and from Del Rio Road. The structure is proposed to be painted a
green color, which will blend with the surrounding trees. Staff recommends
including a Condition of Approval requiring the applicant to plant vegetation
behind the structure to screen the view of it from Del Rio Road. The graded slope
in front of the structure will also need to be revegetated with drought tolerant
plants prior to final. If the DRC has concerns regarding the visibility of the
building, a flag test may be completed to test the visibility of the project from
surrounding neighborhoods. The applicant could install temporary indicators to
show the height and corners of the building with poles and flags.

2. Setbacks
The applicant is proposing a side setback of ten (10) feet from the neighbor’s
property to the east. The proposed setback exceeds the City’s requirement set in
Atascadero Municipal Code 9-4.107 as five feet minimum from side property
lines. The two properties are currently separated by a chain link fence, making
the proposed structure highly visible from the neighboring back yard.
The DRC should consider if this setback is adequate given the size of the
structure proposed near neighboring single-family residences. The minimum side
setback on the eastern side of the property could be increased through the CUP
requirements if there are neighborhood concerns.
3. Grading and Driveway Improvements
The proposed area of development has existing slopes which range from 13% to
21%. An existing rock wall would be removed to the south of the proposed
structure and replaced with a retaining wall that will be stepped to match existing
and proposed topography. The applicant is proposing a 2:1 cut slope on this side
of the structure adjacent to the driveway. Another retaining wall is proposed to
the northwest of the structure that will also be stepped to match topography with
a maximum height of approximately 18-inches. The structure will have a
perimeter stem wall on the rear side to minimize grading at this location. The
structure would sit 5.5 feet above the current grade on the northeast portion of
the parcel.
The existing paved driveway is currently eleven feet wide. The applicant is
proposing widening the driveway to twelve feet by adding a Cla ss 2 Base Rock
gravel shoulder. The existing driveway steeply slopes downhill along the edge of
the driveway, and may not support a gravel base given the steep terrain along
the hillside. The driveway will be required to comply with Fire Department road

standards for width, surfacing, and slope to ensure emergency access at this
location.
4. Native Trees
The subject site has dense native tree coverage over most of the parcel. The
applicant is proposing to remove three (3) native live oak trees for construction of
the proposed garage. The following trees are requested for removal to
accommodate the proposed garage:
One 32” live oak
A three prong 30” live oak
A two prong 28” live oak
An 18” stump also remains in the proposed building footprint after a tree was
removed recently. The existing trees currently provide significant shade and
covering to the backyard. According to the arborist report, the proposed project
impacts a total of twenty-seven (27) native oak trees. Twenty-five (25) of these
are live oak trees and two (2) are valley oak trees.
The DRC should consider the potential effects of this loss of tree coverage. The
proposed retaining wall can be relocated further to the south to prevent tree
removals. This will increase the height of the wall of up to six (6) feet. Larger
retaining walls also require larger footing which may still impact existing root
systems of nearby trees.
5. Utilities
The applicant is proposing to run the water and electricity lines in a direct route
from the existing residence to the proposed garage. The utilities run under the
dripline of a large, three prong Live Oak with 36”, 28” and 18” trunks.
Staff is recommending moving the utility line closer to the western property line or
along the driveway to minimize disturbance to the tree’s root system.
