RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF ATASCADERO
ELECTION TO PROVIDE WORKERS' COMPENSATION COVERAGE
FOR AUTHORIZED VOLUNTEERS AND APPOINTED OFFICIALS
PURSUANT TO LABOR CODE§3363.5 AND
REPEAL RESOLUTION NO.7-93
WHEREAS,the City encourages volunteerism in all aspects of City services and recognizes that
insurance coverage in the event of an accident is an important inducement for volunteering; and
WHEREAS,the City has an ongoing need for the services that may be provided by authorized
volunteers and appointed officials; and
WHEREAS, the City Council must specifically authorize access to criminal history for all employees
per Penal Code §11105; and
NOW,THEREFORE,BE IT RESOLVED, by the City Council of the City of Atascadero that:
1. All authorized volunteers and appointed officials are deemed employees of the City,and are entitled to
workers' compensation coverage as provided by law.
2. The City Council does hereby elect to extend workers' compensation coverage pursuant to L.C. §3363.5
to all authorized volunteers and appointed officials while performing beneficial services to the City.
3. Authorization for access to criminal history is given pursuant to Penal Code§11105,as previously
adopted by Resolution No. 31-89,to include volunteers and appointed officials as employees.
4. Resolution No. 7-93 and all resolutions in conflict with the foregoing are hereby repealed. This
Resolution will take immediate effect.
PASSED AND ADOPTED at the regular meeting of the City council of the City of Atascadero held on the
25th of November, 1997.
