A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ATASCADERO APPROVING A REIMBURSEMENT AGREEMENT WITH
KELLY V. GEARHART, et all, FOR THE CONSTRUCTION OF SEWER STRUCTURES
ALONG ALAMO AVENUE
WHEREAS, Section 50140 et seq. of the Government Code provides for implementation of a Reimbursement
Procedure; and
WHEREAS, the City Council of the City of Atascadero finds that the sewer structures constructed on Alamo
Avenue and the area of benefit is reasonably related to the cost of such supplemental improvements and the
actual ultimate beneficiaries thereof; and
WHEREAS, the City Council of the City of Atascadero finds that the sewer structures constructed on Alamo
Avenue are not required to serve Tract 2225; and
WHEREAS, the Reimbursement Agreement between Kelly V. Gearhart, et al, and the City of Atascadero on
the form in the City Clerk's office does comply with all the requirements of the Reimbursement Procedures;
NOW, THEREFORE, IT IS HEREBY RESOLVED as follows:
1. The Reimbursement Agreement with Kelly V. Gearhart, et al, for the construction of sewer structures
along Alamo Avenue in the form on file with the City Clerk is hereby approved and the Mayor and
City Clerk are hereby authorized and directed to execute the same on behalf of the City.
2. The City Clerk is hereby authorized and directed to record the Reimbursement Agreement with the
San Luis Obispo County Recorder's office.
3. The Deputy City Attorney is hereby authorized to make minor corrections as to the form of the
Reimbursement Agreement.
4. The Finance Director is hereby authorized and directed to disburse funds per the conditions listed in
the Reimbursement Agreement.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of Atascadero held November
26, 1996.
