She requested that the minutes note that the meeting was continued because the room was filled to capacity and people were turned away; secondly, Mr. Austin Carlton, Caltrans , had indicated that he believed individuals could submit written comments to CalTrans on the Hwy. 41 matter until December 10th (not Dec . 1st, as the minutes reflect) . I would like to point out that this item was approved by Council in both the regular 1988-89 Budget, as well as being reflected in • the draft five-year Capital Improvement Program. It is intended that the fire engine be acquired under lease purchase, which is reflected in the actual budgeted amount for this fiscal year of $12 , 500 . With your approval of this item, we will begin the nec- essary paperwork to accomplish lease purchase and will report back to you on the exact details of the financing, including the annual payment, when this is accomplished. Incidentally, the total estimated cost for this equipment is shown in the CIP as $105 , 000 . RW: cw • • M E M O R A N D U M DATE: 1/17/89 TO: City Council VIA: Ray Windsor, City Manager FROM: Mike Hicks , Fire Chief SUBJECT: 4X4 fire engine replacement (Resolution No. 5-89) Background: As approved in the 1988/89 budget, the Atascadero City Fire Department was authorized to replace a 1961 4X4 fire engine which has been out of service as a four-wheel-drive fire engine since August of 1987 , due to equipment failure that cannot be repaired. We have been searching for months for a replacement at an affordable cost and at the same time acquire high quality that would have a lifespan of 20-25 years . While searching for this engine, we discovered we could piggy-back on the State of • California bid with West-Mark Manufacturing of Ceres , California, for a total price of $92 , 083 . 00 plus tax. Recommendation: It is my recommendation that you authorize the purchase of this engine using the State of California bid P.O. #02883 , P.E. #7-EE- -60-11 for the total price of $92 , 083. 00 plus tax. The purchase procedure would be as follows : $47 , 837 . 00 at time of delivery of the chassis to the manufacturer. The chassis delivery would be 90 to 120 days , with balance payable upon delivery of the completed engine, an additional 90 days from receipt of the chassis . We would most likely receive the fire engine sometime in August and would have it in service for the worst part of the next fire season. It is my opinion that this is the best deal we are going to find. The State of California is not expected to go to bid for 4X4 engines in the next budget . We used piggy-back bids for our last two engines , with the City of Delano and the City of Morgan Hill , and found this to be the most economical procedure available . 01"/6b_o • MIRE HICKS MH:pg P. Services Director Date: January 18, 1989 Subject : New Property Insurance Programs BACKGROUND The City ' s current property insurance policy is through the Gordon Hunt Insurance Agency, at a rate of $9,908 per year . Through our participation in the Central Coast Cites Joint Powers Agreement (JPA) , we have the opportunity to insure through the JPA and save slightly over 50 percent of our current premium. If we include the Boiler and Machinery Policy, we still save over one-third of our current amount . The attached proposal provides further detail . • The new policy ' s effective date is March 1 , 1989. Our current agent has been notified of our interest to change policies. An additional benefit of this proposal is that it will provide coverage to the Police Facility and the Pavilion. Council is aware that no insurance coverage exists for the Police Facility. As of January 20, 1989, we were notified that the Pavilion would not be covered , due to its prolonged vacancy. RECOMMENDATION Staff recommends endorsing the new property insurance policy, including Boiler and Machinery coverage, and direct staff to enter into the new coverage, if offered by the JPA, effective March 1 , 1989. \ 1\newjpa • .a s RECEIVED • JAN 0 31989 CITY MGR. James & Company Public Entity Group 505 Sansome Street San Francisco, CA 94111 • SPECIFIC ADVANTAGES TO YOUR CITY: The City of Atascadero is currently purchasing their property insurance on a number of different policies. We can consolidate coverage in one program. We are offering comparable coverage on one policy at a rate of $. 078 compared to your average rate of $ .143 . This rate difference generates an annual savings of $4 ,494 . DISADVANTAGES: The only disadvantage to purchasing coverage through the group program is that you would no longer have a breakout of fire insurance costs by department/location by policy. However, we can provide you with a breakout by department/location specifically to your request. BOILER & MACHINERY: Boiler & Machinery coverage is being offered for an annual premium of $1,108 for a limit of $1 ,000,000 and a deductible of $2,500. This is a very reasonable premium considering the city' s sewer treatment plant exposure. Included in this quote is $25,000 extra expense for business interuption losses. We can increase that limit at your request. RECOMMENDATION: We are recommending that Atascadero cancel their current coverage and purchase property coverage as part of the CCCSIF effective March 1 , 1989 . If the city does not currently purchase boiler & machinery coverage they should bind coverage at the same date. If you currently purchase B & M then we suggest that you compare your current program against our quote. CITY OF: ATASCADERO PAGE 1 OF 1 Schedule of Values 01-Dec-$8 Loc. BACKGROUND: • This amendment was initiated as a "housekeeping item" relative to three public sites . On January 3, 1989 the Planning Commission conducted a public hearing on the above referenced subject. As the County had requested a continuance for the County-owned property at 5575 Capistrano, the Commission recommended approval of the amendments to the General Plan and Zoning Ordinance Map for the properties at 5505 El Camino Real (Police Station site) and 9801 West Front (Fire Station No. 2) . The current land use designations and zoning districts of these properties do not reflect their current or intended uses. • A. SITUATION AND FACTS: 1. ANALYSIS: There are three (3) sites within the City that have been used, or are planned for future use, as government facilities that are not properly designated on the City's Land Use or Zoning Maps. These sites are: (1) the County Hospital property off Capistrano; (2) the old "Benos" site on El Camino Real which is planned for a new City Police facility; and (3) the City' s Fire Station #2 located on West Front. As indicated above, these sites are currently designated for residential or retail commercial use in the General Plan and Zoning Ordinance. Amendments to the General Plan and Zoning Ordinance Maps for these sites will not constitute substantive changes in the General Plan' s Land Use Element. The suggested amendments are seen primarily as "house keeping" items. . Capistrano Site The City of Atascadero has a long-term lease on the property adjacent to the County' s health care facility on Hospital Drive off Capistrano. The City acquired an interest in the property when it appeared that this would be an appropriate site for a new Police facility. Although the Police facility will not be constructed on this property, analysis shows that use of the property for high density multiple family (the currently allowed use) is not appropriate. The property is relatively steep and heavily wooded which renders it less than suitable for any type of high density development. An inspection of this property by the Community Development Director and the Parks and Recreation Director suggested possible use of the site as a satellite parking facility for a future stadium park. In the past, the County has indicated a need for additional parking to serve its facilities. This need could also be partially satisfied by such a lot. In addition to the property the City is leasing, the County' s existing health facility is improperly designated and zoned. This type of use fits within the "P" zoning district and Public land use designations and not the high density multiple family designations. If there is a need in the future to redevelop this site for another use, the Public designation would not prejudice 2 0 future determinations as might the multiple family designation. E1 Camino Real Site The City has purchased the old "Benos" site at the intersection of Rosario and E1 Camino Real for eventual development as a new Police facility. To properly reflect the intended use of this property, the General Plan and Zoning Ordinance should be modified from the current Retail Commercial designations to Public designations. West Front Site The site of Fire Station #2 on West Front is currently designated for moderate density single family residential development. This designation is not consistent with the site' s use for a public facility. As with the Police facility site, this property should be reclassified with a "Public" designation. C. RECOMMENDATION: Staff recommends approval of General Plan Amendment 1B-89. The Commission should recommend that the City Council adopt the attached draft Resolution and Ordinance amending the General Plan and Zoning Ordinance Maps. GENERAL PLAN AMENDMENT 1B-89 AND ZONE CHANGE 1-89: Request initiated by City of Atasca ero for amendments to the General Plan Land use and Zoning Ordinance Maps for certain government owned properties. Said amend- ments will change the current land use and zoning des- ignations to "Public" designations. Subject sites are located at 5575 Capistrano, 5505 E1 Camino Real, and 9801 West Front. Mr. Engen referenced a letter received by the County requesting a continuance for the 5575 Capistrano portion of the application. The County is taking issue as it has future hopes for sale of this property for future multi-fam- ily ultifam- ily development. Mr. Engen noted the exhibit map has a drafting error; the map should show the area encompassing the hospital site and approximately one acre site (which was once considered as a potential police station site) . There was discussion concerning the appropriateness of considering the 5505 E1 Camino Real and 9801 West Front sites with the exclusion of the 5575 Capistrano site. No public testimony was given. MOTION: Made by Chairperson Lochridge, seconded by Commis- sioner Luna and carried 5 :0 to eliminate the 5575 Capistrano site from the general plan and zoning ordinance applications for consideration at this time. MOTION: Made by Commissioner Tobey, seconded by commis- sioner Luna and carried 5 :0 to recommend approval of land use amendments to the General Plan and Zoning Ordinance to change the designation of the 5505 E1 Camino Real and 9801 West Front sites to Public (P) designation. DIRECTOR December 30, 1988 Mr. Henry Engen, Community Development Director City of Atascadero P.O. Box 147 Atascadero, CA 93423 HAND DELIVERED GENERAL PLAN AMENDMENT 1B-89 AND ZONE CHANGE APPLICATION 1-89 (ITEM B.3. ON PLANNING AGENDA DATED 1-3-89) The County of San Luis Obispo owns land consisting of approximately 6.1 acres off Capistrano in the City of Atascadero. This site referenced in a City of Atascadero Planning Staff Report (Item B.3. ) is recommended for amendments to the General Plan Land Use and Zoning Ordinance Maps. The subject site was utilized by the County for many years as a hospital site and is currently used to house North County Regional Offices for County Mental Health, Social Services and Health Clinic. These regional services to the North County residents are anticipated to continue in the future, but the long range plans will most likely not have these services at this site. The County's probable long range plan would consolidate services at the proposed North County Regional Center Site. In 1986, the County, in good faith and as an act of mutual assistance and cooperation, leased 1 .3 acres of the County site to the City of Atascadero for fifty years, without cost, for a Police Station Facility. A portion of this lease site is also the portion of the total Capistrano site containing steep areas that were referenced in the City of Atascadero staff report as not suitable for high density uses. The balance of the Capistrano site is very usable and the present zoning does conform with surrounding uses in the area. County staff feels that the in If the Board of Supervisors should elect to resent zoning should stay tact. P P 9 Y surplus and sell the subject property in the future, the present zoning will facilitate the sale and conforming development that will occur after it is sold. We question after all these years, why change the zoning now? The County received the City of Atascadero Staff report for the above referenced general plan amendment and zone change on December 28, 1988. This does not leave a reasonable amount of time to deal with all the issues relevant to the action proposed by the City of Atascadero on the subject property owned by the County. We request that this action be continued until City and County staff can meet and address the concerns of the County. OCA Mr° `Z MEMORANDUM TO: City Council January 24, 1989 VIA: Ray Windsor, City Manager FROM: Henry Engen, Community Development Director "Ca SUBJECT: GENERAL PLAN CONFORMITY REPORT 3-88 BACKGROUND: On January 3, 1989, the Planning Commission considered the above referenced subject regarding the acquisition by the City of certain real property located in the downtown area for develop- ment and use as a parking lot. on a 7 :0 vote, the Commission determined said property to be in conformance with the General Plan as reflected in the attached staff report. No public testimony was given. RECOMMENDATION: • Concur with Planning Commission' s recommendation that City' s pro- posed acquisition of real property in the downtown area for development and use as a parking lot is in conformance with the General plan. Decamp, Senior Planner File No: GPCR 3-88 SUBJECT: General Plan Conformity Report regarding the acquisition by the City of certain real property located in the downtown area for development and use as a parking lot. BACKGROUND: The California Government Code requires that a city not acquire or dispose of any real property until the planning agency of that city has reported on the conformity of the proposed purchase or sale with that city' s adopted general plan (see Exhibit A - Government Code Sec. 65402 (a) ) . Environmental Status. . . . . . . . .Categorically Exempt - Class 1 (Future development of a parking lot will be subject to separate CEQA review) B. ANALYSIS: A lack of adequate parking has been perceived as an impediment to new development and redevelopment or renovation of existing structures in the downtown area. Although informal surveys have not revealed an areawide parking space deficiency, the on-site parking requirements of the Zoning Ordinance do, in fact, inhibit desirable development patterns in the downtown. Because lots in the downtown area are generally small, the provision of on-site • • parking can reduce building sizes to unmarketable proportions in addition to precluding the ability to build on the front property line. As an alternative to continued reliance on on-site parking, the Business Improvement Association (BIA) has suggested that the City purchase a lot in the downtown for development as a public parking lot. Currently under consideration is a proposal for the development of an in-lieu parking fee which would finance the purchase and development of such a facility. This program would allow a developer or business to "purchase" off-site parking spaces in-lieu of providing parking on-site. Several sites in the downtown area have been identified by the BIA as being desirable for use as public parking lots in the future. Early acquisition of two vacant lots located on Traffic Way between Lewis Avenue and Palma is seen as timely and an important first step in the parking program. In the Land Use Element' s discussion of commercial uses, the General Plan notes that " (o) ff-street parking in the Central Business District is grossly inadequate. " Further in this section, the Plan notes that one of the keys to optimum commercial development is " . . . the provision of convenient and adequate off-street parking. " There are, in addition, two policy proposals that address parking in the downtown: "1. Programs are needed to address traffic congestion, pedestrian circulation and parking problems. 2. The downtown area shall be specifically planned for human activity rather than car storage. Parking shall be provided in lots that are convenient to commercial uses. There shall be buffering and circulation patterns within the total parking lot area. " The Circulation Element of the General Plan also addresses downtown parking concerns. The following excerpts are from that element: "Traffic circulation and attendant parking problems are severe in the Central Business District north of Atascadero Creek. " "Off-street parking is currently required of any new commercial construction. The more recently developed areas of the Central Business District, namely from Atascadero Creek south to the southern border of the Thrifty Drug complex, have adequate off-street parking. But the core of the Central Business District has severe parking problems. " This section of the Plan continues to list several locations in 2 0 0 the downtown area which might be suitable locations for a parking lot. Some of these sites may not be practicable alternatives today, but the concept of public off-street parking in the downtown area is still relevant. Although the site selected by the BIA is not specifically listed in the Plan, its general location and size suggests that its use as a parking lot would be appropriate. C. RECOMMENDATION: Staff recommends that the Planning Commission determine that the City's proposed acquisition of real property in the downtown area for development and use as a parking lot is in conformance with this City' s adopted General Plan. CAT 1TEMI M E M O R A N D U M TO: City Council Members FROM: Ray Windsor, City Manager SUBJECT: B.I.A. Property Acquisition DATE: October 11, 1988 BACKGROUND In accordance with my recommendation to you at your joint meeting with the Planning Commission, I would like to move ahead with a formal appraisal on the two lots identified in the attached memo from Henry. As indicated to you earlier, I believe it is in the best inter- ests of the community to begin to improve portions of the downtown and, even though this should not be done without a comprehensive master plan, I don' t believe that the acquisition of the parcels identified by .Henry will affect the outcome of that planning process. At your neat meeting, staff will be prepared to make recommen- dations for the development of a master plan. Included in the requirements was a tree protection plan. Subsequently, the applicant has applied for building • permits for two buildings which have not been accepted for pro- cessing pending issuance of an overall site grading permit. In reviewing the proposed grading permit, staff decided to seek a second opinion from Jack Brazeal, arborist, as to whether the eight trees being proposed for retention would survive the site improvements being proposed. As indicated in his analysis, he does not believe so. A meeting of the Council ' s tree subcommittee was held on December 8th, 1988 and the decision was to require conformance with the originally approved precise plan calling for protection of these trees . The applicant has, in his letter of December 15th, appealed staff' s denial letter of December 9, 1988 to the City Council . The appellant has indicated that they are developing supporting rationale for their appeal , and have requested a continuance to your next Council meeting (February 14, 1989 ) . ISSUE: The issue before the council is whether a grading permit should be issued on this site given a second arborist' s opinion that tree protection measures being proposed would not spare the trees . The secondary issue, albeit one receiving far more • publicity, is the value attached to the trees . The current tree ordinance would enable bonding in cases where there is a question as to whether trees proposed for protection would survive the development process . The value attached by Mr. Brazeal is $1 . 3 million for the eight trees in jeopardy. As we' ve noted in r - • • • communications with Mr. Messer, the question of bonding maximums is a matter that is being discussed in the context of amendments to the tree ordinance. STAFF RECOMMENDATION: Continue the appeal to February 14, 1989 to permit receipt of technical arguments from the appellant. The existing trees on this site could not survive the cuts and fills proposed. I highly recommend that this plan be rejected completely. In order for the pre- servation and guaranteed survival of these trees, no cut or fill would be permitted within more than 25% of the dripline. Mr. Don Messer P.O. Box 1958 Atascadero, Ca. 93423 SUBJECT: Issuance of Grading Permit 5805 Capistrano Ave. (Hotel Park) Dear Mr. Messer: We have received and reviewed your request for a grading permit at the above-referenced site. Our determination is that the proposed grading plan does not conform to the approved Precise Plan, and thus, cannot be approved. Precise Plan 30-87 included approval for tree removal and required protection for the trees to remain as shown on the site plan. At City expense, a second certified arborist was hired to analyze the impact of the proposed grading on the trees to be protected. In his opinion, "the majority of trees proposed to be retained on this site cannot be preserved due to the cuts and fills proposed. " The project development was approved on the basis of these trees remaining and condition #2c. was imposed to ensure this. Condition #5 required approval of an engineered grading and drainage plan prior to issuance of building permits. The Precise Plan is a conceptual approval; an environmental determination which considers the effects of a project on surrounding property. The detailed review of grading/drainage plans, tree protection methods, and planting materials are undertaken during building permit plan check. This decision may be appealed to the City Council upon receipt of a written request accompanied by a $100 fee. A revised site plan proposing removal of oak trees in excess of 20 inches in diameter also requires approval from the City Council. Alternatively, you may wish to develop modifications to the site plan to assure preservation of those trees. If you should have any questions regarding this matter, please call the office for assistance. Box 1958 Atascadero, CA 93423 (805) 466-0549 Henry Engen-City Planning Director Atascadero City Council Planning Commission These two reports indicate the discrepancy between the Paso Robles published tree value chart and the report recently paid for by the city of Atascadero on the Hotel Park Project. According to the Paso Robles report, the same eight trees that were valued at $1,300,000., after a fifty percent reduction for condition, would be worth $139,000. using the same fifty percent.condition reduction. That much variation clearly explains our concerns about the proposed bonding requirement and the wording in the tree ordinance. A $1,300,000. bond would be impossible to obtain without putting up cash. A $139,000. bond would be prohibitive and expensive. Bonds that require the bonding company to provide their cash instead of using the funded cash for a project are almost impossible to obtain, and if available, require security of twice the bond amount. Most of us don't have the capability of providing excessive bonds. A typical performance bond for roads or other offsite improvements is secured by: 1. The value of the project that benefits from the improvements. (A completed subdivision is considerablely more valuable than new 1 and). 2. The loan on the property to make required improvements. 3. The credibility of the developer. A bond that guarantees the value of the trees does not provide improvements that increase the value of the property-infect-often the land used by the trees reduces the building density value of the land. A large tree could occupy 10,000 square feet of land from drip line to drip line and at $10 per square foot equals $100,000. worth of buildable land. At some point economics must be considered or property will be rendered useless by excessive fees and requirements. The Atascadero City Fire Department has concern over this fuel being added to the present fuel bed, and feels that where possible this fuel should be disposed of . We have tried to obtain State funds through the Office of Emergency Services and have been denied, as this would be dealing with a future problem (wildland fire) and not an immediate threat to life or property. With the denial of State emergency funds, it is most likely going to become the burden of local government • and property owners to deal with the problem. Recommendation It is my recommendation that property owners accept the responsibility for clean-up since there are no outside funds available . The property owner has the following options available for disposal : 1 ) Cut, pile and burn, in accordance with City backyard burning regulations ( see attached) . 2 } Haul to landfill . 3 ) Chip and haul to landfill, or mulch. 4 ) City weed abatement program. This option would be very expensive to the property owner as City weed abatement is done during the time of year when burning would not be permitted and hauling would be the best alternative . T20 I would further iYecommend the e of Youth Authority anU California Conservation Corp crews to clean debris in the public right-of-way and creeks . This program would be administered through the Public Works Department. An equipment repair fund of $3 , 000 . 00 would be required for the project . MIKE HICKS t/ MEETIN faENDA2DA Ma .._1_. • M E M O R A N D U M TO: City Council FROM: Ray Windsor, City Manager r SUBJECT: Storm Damage Clean-up ,, AN DATE: January 24 , 1989 This memo is intended to supplement the attached report from Chief Hicks . I concur, as does the City Attorney, with the recommendation as stated, but I would like to add some thoughts which lead up to our conclusion. • As a result of the last Council meeting, we were asked to esti- mate the cost to the City to implement a clean-up program to remove fallen branches and other combustible debris created by the storm. Unfortunately, without exhaustive lot-by-lot surveys , it is virtually impossible to come up with an accurate figure. But, our best guess is that it' s somewhere in the neighborhood of $50, 000-$100, 000, assuming that the City would accept total res- ponsibility for renting various equipment (primarily chippers, bucket and dump trucks, etc. ) and providing necessary manpower (C.C.C. , Youth Authority, etc . ) . Such monies are, of course, not readily available and would be a severe drain on our reserves . Perhaps the key factor in our recommending that private property owners be responsible for their own lots is the fact that, sub- sequent to the last Council meeting, we determined that the dump, which we had been told would not accept this kind of material , will accept such. Further, burning restrictions are perhaps not going to be as severe as we had originally thought. So, together these new measures can assist the property owner' s flexibility in this clean-up. Beyond that, we are concerned that, without a mass informational campaign (mailing of flyers, door-to-door contact, etc . ) , many property owners will not know of the pro- gram. As a result, some people would not take advantage of assistance, thus creating inequities in the use of public funds . Finally, of course, is the whole question of liability on private property, which could be a logistical headache when attempting to • use or explain hold-harmless agreements , etc . RW: cw w,. Background: Resolution 100-88 recently established new development fees on the basis of Ordinance 119 . Ordinance 119 refers to sections of the • 50c Tax ordinance that must be added to Ordinance 119 prior to tree repeal of the 50c Tax ordinance . Additionally, the new ordinance allows the use of non-residential fees, as well as residential fees , for parks and recreation facilities . The only other change is the deletion of the reference to the school development fee . After the second reading, staff will be submitting the repeal for several ordinances and resolutions associated with the old development fees . JORGENSEN Director of Public Works City Attorney City Engineer M E M O R A N D U M • TO: City Manager Ray Windsor and City Council Members FROM: Chief of Police SUBJECT: Anti-Loitering Ordinance - Proposal (Ordinance No. 189) DATE: January 16, 1989 RECOMMENDATION/COUNCIL ACTION REQUESTED Enact the attached ordinance adding Chapter 6 to Title 5 of the Atascadero Municipal Code relating to loitering by minors during certain hours. BACKGROUND During the past two years, the issue of juveniles loitering about, unsupervised at late and unusual hours, has been a topic of concern within various city organizations and merchants groups. As Council may recall, in October, 1988, the Atascadero Unified School District Board of Education adopted a resolution (attached) in support of the enactment of anti-loitering measures for our community. Additionally, in April, 1988, the Atascadero Chamber of Commerce Board of Directors unanimously supported a measure as follows: "Representing the business community, the Chamber of Commerce endorses the concept of an anti-loitering/curfew law in Atascadero. . . • It is believed that this would help to curtail loss of business due to loiterers, prevent littering, enable police officers to question loiterers and help to curtail malicious behavior causing vandalism and property damage." Other groups offering support for this ordinance include: 1. Atascadero Junior Women's Club 2. Atascadero Safehomes Organization 3. Atascadero Police Officers Associations 4. Atascadero Bible Church 5. Action for Animal Rights The comments offered by our Chamber of Commerce echo my philosophy well and are, I believe, reflective of community sentiment to a large degree. This material was compiled by City Attorney Jeff Jorgensen and myself, with the final ordinance being written by Jeff. The proposed statute is a composite of information obtained from various other municipalities which have similar anti-loitering ordinances in place. In preparing this ordinance, individual constitutional rights were carefully considered so as to insure a reasonable approach. In terms of enforcement, our police department will implement d utilize this measure in a reasonable and equitable fashion so as to serve or commu ity in the best possible manner. • FISCAL IMPACT No additional funding will be required for implementation of this ordinance. MEMORANDUM City of Atascadero January 12 , 1989 TO: R. H. Bud McHale, Police Chief FROM: Jeffrey G. This ordinance has been drafted in an attempt to avoid the problems experienced by the City of Long Beach, whose ordinance was recently invalidated due to vagueness. Please feel free to contact me at your convenience if you have questions or comments concerning the ordinance. If not, please present it to the City Council as you consider appropriate. As you will recall, these examples were collected in keeping with Council direction a few weeks ago. A few comments/concerns relating to this issue follow: 1. There seems to be a consensus that we wish to de-emphasize the use of the term "curfew". 2. We wish to establish an enforceable, useable and reasonable ordinance which recognizes appropriate constitutional guidelines. 3. In terms of specific hours of enforcement, I would recommend 11:00 pm. to 5:00 am. seven days per week. 4. I believe the ordinances used by ismo Beach, Arroyo Grande, and Corcoran are the closest to our o ective. The penalty section needs to be massaged and brought into our format. Probably g g Y some sort of graduated penalty needs to be considered for multiple offenses. Also, we'll have to deem this a misdemeanor inasmuch as in-custody arrests may result. In terms of a time frame for implementation, I told Ray Windsor I'd endeavor to prepare this for the Council Meeting of 1-24-89. Thank you for your assistance. RICHARD H. Box 2237 Atascadero, CA 93423 November 17, 1988 TO: Atascadero City Council FROM: Families for Alcohol and Drug Free Youth RE: Anti- loitering Curfew Law In March. 1988. Families for Alcohol and Drug Free Youth--Sponsors of Atascadero Safehomes initiated a proposal to establish an Anti-Loitering curfew law for the City of Atascadero and Unincorporated Areas. Letters regarding this proposal were sent to several community agencies. The letters outlined the following reasons we desire a curfew law be put into effect : 1 . To reduce unsupervised, unauthorized, and unchaperoned youth activities in the late evening and early morning hours. 2. To support parental control and family sponsored activities. 3. To provide guidelines for parents on reasonable hours. 4. To help parents and law enforcement personnel deal with alcohol and drug use . 5. To give law enforcement agencies authorization to question , investigate , and monitor youth activity after curfew hours. 6. To curtail malicious behavior and reduce vandalism to private and business property. We feel that youth activities should be a community concern . We need to show our youth that we do care by setting down limits and guidelines for them to follow. We know there are those who will disagree with a curfew law citing an enfringement of personal rights. But when a situation is out of control , unmonitored, and potentially dangerous, the rights of individuals, families and the community are all being jeopardized. The two hundred Safehome families and other individual endorsements represented by Families for Alcohol and Drug Free Youth are joining the following agencies in supporting the passage of an Anti- Loitering/Curfew Law. - Atascadero Junior Women's Club - Atascadero Police Officers Association - Atascadero Board of Education - Atascadero Bible Church - Action for Animal Rights - Atascadero Chamber of Commerce Please notify us when this issue will be an agenda item for a council meeting. Sensibaugh, Director of Public Works/City Engineer Subject : Request Partial Abandonment-Sewer Easement Date : January 16, 1989 Recommendation : Staff recommends that Council adopt Resolution 2-89 which sets February 14 as a public hearing date for the consideration of the abandonment of a portion of the sanitary sewer within the Century Plaza parking lot (detail "B") , the abandonment of a portion of the Public Utility Easement (PUE) within the Century Plaza parking lot and the Capistrano right-of-way (detail "A: ") , and the abandonment. of a portion of a sewer and water easement in Capistrano right-of- way (detail "C" , parcel 1 and parcel 2) . Note : The Resolution of Vacation will be presented at the February 14 Public Hearing to be passed at that time if there are no objections from the public . The Resolution of Vacation will indicate that a public hearing was held and that the `acts are as stated in the Resolution of intention 2-29 above . Background: Century Plaza has requested an encroachment into the existing sanitary sewer easement, the PUE and a proposed sewer and water easement, which they granted the City for the development of the theater expansion project and Brookhill Restaurant . The latter two portions of easements do not actually affect any utilities but are included in the public "nearing so that the most conservative approach is taken with respect to the abandonment . The corner of proposed building "J" will protrude into the sewer easement if that construction is permitted. Therefore, it is necessary to request abandonment of a portion of the easement to accomodate the same . Exhibit B is the indemnity agreement that controls the above building near the easement . Exhibit A (1-10) is the attachment to the agreement that contains the sketches and descriptions for all three easement abandonment requests . • Discussion: • Since the building will not be directly over the sewer line, but within two feet of it, and since the building will be designed in such a manner that no bearing pressure will affect the sewer trench, staff is willing to accept the proposal based upon the signing of the attached Indemnity Agreement prepared by the City Attorney. Fiscal Impact : There is no cost associated with this request since no money was given for the easement at the time of formation. • • RESOLUTION 2-89 A RESOLUTION OF THE COUNCIL OF THE CITY OF ATASCADERO CONSIDERING THE INTENTION TO VACATE A PORTION OF A SANITARY SEWER EASEMENT IN THE CENTURY PLAZA PARKING LOT AND TO VACATE A PORTION OF A P.U.E. IN THE CENTURY PLAZA PARKING LOT AND CAPISTRANO RIGHT-OF-WAY AND TO VACATE A PORTION OF A SEWER AND WATER EASEMENT IN THE CAPISTRANO RIGHT-OF- WAY PURSUANT TO CHAPTER 3, SECTION 8320, ET . SEQ. . OF THE STREETS AND HIGHWAYS CODE. NOW, THEREFORE. the Council of the City of Atascadero resolves as follows : 1 . It is the intention of the Citv of Atascadero to consider abandoning (1) a portion of the sanitary sewer easement in the Century Plaza parking lot , (2) a portion of a public utility easement (PUE) in the Century Plaza parking lot and the Capistrano richt-of-Wav, and (3) a portion of a sewer and water easement in the Capistrano right-of-way, as shown on attached Exhibit A (paaes 1-10) and subject to the agreement shown as Exhibit B, pursuant to Chapter 3, Section 8320 et . sea. of the Streets and Hig_hways Code . 2 . The proposed abandonment is categorically exempt from the provisions of the California Environmental Qualitv Act . (Class 5 : Section 15305) 3 . Copies of the map showing the particulars of the proposed abandonments are on file in the Community Development Department and the Public Works Department . 4 . The Citv Council shall hold a public hearing at the reaularly scheduled Citv Council meeting to be held February 14 , 1989 at 7 : 00 p .m. or later . in the City Council Chambers . Administration Building. 6500 Palma Avenue . Atascadero . The public hearing will consider a Resolution of Vacation at which time all persons interested in the proposed vacation may be heard. 5 . The Citv Clerk shall cause the notice of this public hearing_ to be published in the same manner as other Resolutions of the Council . 6 . The Director of Communitv Development shall cause to be posted, conspicuous notices of vacation in compliance with Streets and Hiahways Code Section 8322 . s 0 0 This Resolution was passed and adopted on January 24 , 1989. DATE : January 6, 1989 RECOMMENDATION/COUNCIL ACTION REQUESTED: Adopt Ordinance # 190, amending Ordinance #135, the "Emergency Organization or finance of Atascadero" ; and adopt, in whole, Resolution 6-89 to conform with the requirements of the California O.E.S . and the federal F.E.M.A. for organizational structure. • BACKGROUND: Ordinance #135, the "Emergency Organization Ordinance of Atasca- dero" was originally passed by the City Council on July 14 , 1986 . That ordinance did not specify the structural position of "Coordinator of Emergency Services" . In October 1988 , the City of Atascadero applied to the Federal Emergency Management Agency (F.E .M.A. ) for federal matching funds for the position of Coor- dinator of Emergency Services . As a result of that application, the City was informed by F.E .M.A. that the position of Coordina- tor needed to meet the following requirements : 1 . That the position of Coordinator of Emergency Services be created and established within the organizational structure of the emergency service organization. 2 . The Coordinator of Emergency Services be appointed by the Director of Emergency Services to manage the day- to-day operations of the emergency services organiza- tion. 3 . That the Coordinator of Emergency Services be required, in time of emergency, to report directly to the Direc- tor. • Revisions to Ordinance, #135 to meet the above requirements: SECTION 4-4 . 04 : DISASTER COUNCIL MEMBERSHIP C. The Coordinator of Emergency Services as appointed by the Director of Emergency Services . • SECTION 4-4 .06 : DIRECTOR, ASSISTANT DIRECTOR AND COORDINATOR OF EMERGENCY SERVICES C. There is hereby created the office of Coordinator of Emergency Services, who shall be appointed by the Director. SECTION 4-4 . 07 : POWERS AND DUTIES OF THE DIRECTOR, ASSISTANT AND COORDINATOR OF EMERGENCY SERVICES D. The Coordinator of Emergency Services, shall under the supervision of the Director, manage the day- to-day operations of the Atascadero civil defense/ emergency services program. In time of an actual emergency, the Coordinator of Emergency Services shall report directly to the Director. SECTION 4-4 . 09 : EMERGENCY PLAN The Coordinator of Emergency Services, at the direction of the City of Atascadero Disaster Council, shall be responsible • for the development and continual updating of the City of Atascadero Emergency Plan, which plan shall provide for the effective mobilization of all of the resources of this City, both public and private, to meet any condition constituting a local emergency, state of emergency, or state of war emergency; and shall provide for the organization, powers and duties , services and staff of the emergency organization. Such plan shall take effect upon adoption by resolution of the City Council . It was also required by F.E .M.A. that the City adopt a ' Signature Resolution' in order that the signatures on the various required forms submitted to F.E .M.A. be able to be verified as official . The requested resolution is presented as Resolution Number 6-89 . FISCAL IMPACT: There is no foreseen fiscal impact to the City; however, the adoption of these changes and resolution will enable the City to receive federal matching funds for the position of Coordinator of Emergency Services . The latest bids on this project were received November 10, 1988 . Under the terms of the bid, we were allowed 30 days in which to award or reject same. When we realized that there would be a problem because of the amount of the low bid, we met with the company and asked for additional time in which to consider pos- sible alternatives for Council consideration. I am pointing this out because a decision, one way or another, must be made at your meeting of the 24th in order to meet the terms and conditions of the bidding process and our agreement with the low bidder. This is, perhaps, unfortunate because it does not give us an opportunity to look at the additional funds being requested as part of your overall mid-year budget review in February. However, in light of the history of this project and of our conviction that rebidding and/or redesigning will not bring the total price down, Paul and I are convinced that it would not be in our best interests to delay it any longer. I truly regret whatever inconvenience this will create for the Council, but I feel just as strongly that to delay this project further w' r ill only end u Gostin us more and more dollars . I Y P g know that Council is acutely aware of the issues involved here, so I will not re-hash the rationale for the various improvements covered in the upgrading and renovation project. I, therefore, urge that you accept Paul ' s recommendation, the result of which will, obviously, impact our contingency fund and will have to be factored into the budget review in February. But, in my opinion, the alternatives and their ultimate conse- quences are far worse, both financially and in terms of public perception and employee morale. RW: cw MEMORANDUM • To: Honorable Mayor and City Council Through: Ray Windsor, City Manager From: Paul M. Sensibaugh, Director of Public Works/City Engineer Subject : Heating, Ventilating and Air Conditioning—City Hall Date : January 16, 1989 L mendation: Staff recommends that the project be awarded to R. P. Richards he amount of $558,475 and that an additional $80, 000 be priated from the general fund balance to cover the bid amount nspection and system balancing costs . History: In October of 1980 the City first received bids on the Administration Building Renovation project . At that time it was • anticipated that the entire project (which has changed scope over the years) could be done under one contract . The low bid at that time, $722 , 000, was well above the $400, 000 budgeted. The engineer ' s (Stephenson, not Schott at that time) estimate was about $395, 000 and the engineering cost was $50, 000 . It was decided at that time to proceed with the project in phases and to hire Schott & Assoc. to do the engineering. Phase I consisted of office renovations on the first and second floors, restroom renovation on the first and second floors, and counters for reception and dispatch. The cost of that phase was $145, 777 and was completed in July of 1981 . The balance of the money has been carried over but not disturbed until the grant was obtained in 1985 . Since 1985 two other phases have been completed. Background: Bids for the above project were received on November 10, 1988 . The work includes Removal and Sealing of asbestos insulation around piping within vertical pipe chases and piping in basement ($54, 000) , Construction of mechanical pad and brick masonry unit enclosure at parking lot ($58, 000) , Mechanical Renovation (HVAC system) including soffit work ($345, 000) , and Architectural Renovation including the 3rd Floor restroorns and painting and carpeting in some offices ($101 ,476) . • Following is the bid summary which includes all items bid. (Above figures reflect low bidder' s itemization. ) R. P. Richards, Inc .—Coleta. . . . . . . . . . $558,476 Young Brothers Const .—Atascadero. . . . . $583, 950 Wysong Construction—Atascadero. . . . . . . $608, 069 Spiess Construction—Santa Maria. . . . . . $624, 005 Engineer ' s Estimate—(November 30) . . . . $557,400 There is always a chance of positive change orders, but in the case of this project we actually expect negative change orders due to the fact that some of the cosmetic work such as painting and carpeting has been done by the Buildings Division. The room renovation and the restroom work, however, were bid lumped together and negotiations will have to take place in order to decide the amount of actual reduction to the bid. Any positive or negative change orders are unknown at this time and the following discussion will consider them as zero. Attached are several pieces of correspondence regarding the bids and the attempt to reduce the costs to the budget figure. Also included are the November 27, 1985, January 7, 1986 , March 6, 1986 and November 30, 1988 cost estimates (which does not include the T— bar ceilings or lighting) , the February 27, 1987 grant rejection, the April 17, 1987 Historic Preservation Office letter demanding the Historic Structure Report, and December 2, 1987 cost estimate for HVAC redesign based upon the HSR. Discussion: The several cost estimates are confusing at best since the project has been broken up into phases over the last three years and costs have increased. Of the $570, 000 originally budgeted ($300, 000 grant and $270, 000 general fund) , expenditures include : $11 ,490— Asbestos Removal in 1st Floor Ceiling, $110,721-4th Floor Structural work, $8, 500—Historic Structure Report, and $84, 950 for Design. (All figures above are after the grant was obtained in 1985) . The balance for the 1988-89 budget was approximately $384, 000 . This was an anticipated amount not having the benefit of any knowledge of an audit or interest earned. The latest cost estimate at that time for the work actually bid was $337, 200 . Asbestos removal (which ranged from $16, 000 to $54, 000) was not an issue at budget time but was raised later due to testing of materials and recent asbestos regulation changes . Allowing 9% cost index increase as indicated in the latest estimate the project without contingencies should be about $367, 550 . It was anticipated at the time that the the remaining funds would be used for construction inspection . Note that the 1985 estimate was an "installed" price and, therefore the Contractor ' s Fee shown in the latest estimate should not be included. Fiscal Impact : Despite the above budget rationalization and the after-the-fact engineer's estimate, the reality is that the low bid is $548,475 and construction engineering will be about $15, 000, dependent upon the inspection time desired on the project and the cost of the HVAC Balance . Additionally, the Ceiling work and lighting has not been bid due to objections and revisions from the Office of Historic Preservation. That work is now estimated at approximately $40, 000, plus about another $4500 for additional engineering and/or inspection. The original grant was $300, 000, the maximum allowable . As we expend funds we request reimbursement from the State . This has been done twice for a total amount of reimbursement of $182, 951 . Therefore, the State still has $117, 049 for us and our cash on hand is $366,482 . This gives us $483,531 available to the project , not including interest earned on the account . Over the last three and one half years the original $270, 000 general fund appropriation (over and above the $300, 000 grant) would have earned over $84, 000 in interest that should be allotted to this project . This does not include interest from 1981 to 1985, which would be over $100, 000 . However, the difference in the amount of cash available in the general fund/revenue sharing and the amount actually appropriated appears to reflect recovery of that money. Original Work Comp . Available Needed ' Grant $300, 000 $138, 000 $162, 000 Gen.Fund $270, 000 $ 9,706 $260, 293 Rev. Shar $ 0 $ 23, 004 $106, 189 Totals $570, 000 $215, 661 $483, 531 $563, 000 Therefore, an appropriation from the fund balance of $80, 000 would complete the project as bid, subject to change orders. It should be noted that the City applied for an additional grant in 1986 but was turned down since we already had received a maximum grant . Since we completed the Historic Structure Report any new grant monies received must be used to bring the building back to its original status, including taking out all of the lowered ceilings . The money could not be used for the work allowed in the present grant until other cosmetic work is completed. Options : Staff is recommending that the City appropriate anticipated interest money to complete the work as bid, before prices esculate again, and to hold the remaining work until the next budget session since the State has not given the nod for the lighting and ceilings at this time . 0 0 Other options would be to (1) reject all bids and re-bid again, (2) delete a portion of the work, which action would surely result in the forfeit of a bid bond of about $34,500 or a refusal of both the low bid and the bid bond (the next low bid is $104, 602 greater for the HVAC item, therefore, the taking of the bid bond would still not accomplish our goal ) , (3) reject all bids and not bid again. RICHARD KOPECKI SUBJECT: ATASCADERO ADMINISTRATION BUILDING--MECHANICAL SYSTEMS DESIGN DEAR RICHARD: AS DISCUSSED, TWO DIFFERENT MECHANICAL SYSTEMS FOR THE ADMINISTRATION BUILDING HAVE BEEN DESIGNED. THIS HAS TAKEN PLACE OVER THE LAST SIX YEARS. EITHER SYSTEM WILL ADEQUATELY FULFILL THE PROJECT REQUIREMENTS AS DESIGNED. UNDERSTANDABLY, THE CLIENT HAS SOME QUESTIONS AS TO WHY A THIRD MECHANICAL SYSTEMS DESIGN FOR CONDITIONING THE BUILDING HAS BEEN PROPOSED. THE PURPOSE OF THIS LETTER IS TO RECOUNT THE HISTORY OF THE PROJECT AND TO CLOSE WITH THE OPTIONS FOR MEETING THE PROJECT'S MECHANICAL NEEDS. AS IT STANDS, THE EXISTING STEAM SYSTEM IS INADEQUATE TO SERVICE THE BUILDING. THE PIPING IS OLD AND LEAKING. MUCH OF THE INSULATION IS EITHER NON-EXISTANT OR IN POOR SHAPE. CORROSION HAS FOULED MUCH OF THE PIPING AND HEAT EXCHANGERS. BASICALLY, THE EXISTING SYSTEM IS CLD AND UNABLE TO MEET THE BUILDING DEMANDS. IT HAS PROBABLY BEEN QUITE A MAINTENANCE AND OPERATING TASK TO KEEP THE HEATING SYSTEM Ov-LINE. APPROXIMATELY SIX YEARS AGO, IT WAS DECIDED TO RENOVATE THE ADMINISTRATION BUILDING. THE BASIC REQUIREMENT FOR THE MECHANICAL SYSTEM WAS TO DESIGN AN INSTALLATION FOR HEATING THE BUILDING WITH THE PROVISION FOR ADDING AIR CONDITIONING AT A LATER DATE. A FEW SELECTED AREAS, SUCH AS DATA PROCESSING, WERE TO RECEIVE AIR CONDITICONIING DURING THIS DESIGN PHASE. THE FOURTH ST11RY AREA WAS NOT INCLUDED IN THE WORK; AND A MAJOR PORTION OF THE WORK INVOLVED THE COMPLETE RENOVATION OF THE BASEMEIT WHICH WAS TO BE THE NEW POLICE DEPARTMENT. THE BUILDING HAS AMPLE PIPE CHASES FOR THE EXISTING STEAM SYSTEM. ADDITIONALLY, AT THE TIME, THE EXISTING BOILER WAS FAIRLY NEW AND COULD BE RETAINED. THE LOGIGAL CHOICE FOR THE HEATING (AND LATER AIR CONDITIONING) THE BUILDING WAS A 'HYDRONIC' SYSTEM UTILIZING HOT WATER FOR HEATING AND WITH THE PROVISION FOR THE INSTALLATION OF FUTURE CHILLED WATER COOLING. SUCH A SYSTEM CIRCULATED HOT WATER THOUGH-OUT THE BUILDING. THE HOT WATER IS SUPPLIED THROUGH FAN COILS IN EACH ZONE WHICH PROVIDES FOR FORCED AIR HEATING. THE FAN COILS WERE SPECIFIED WITH BOTH HEATING AND COOLING COILS BUT THE CHILLED WATER PIPING SYSTEM WAS NUT DESIGtiED FOR THIS PHASE OF THE PROJECT. SUCH A SYSTEM IS EASILY EXPANDABLE AND ,PROVIDES FOR COMPLETE THERMOSTATIC CONTROL IN ALL MAIN OFFICE 935 Riverside. THE BASEMENT AND PERIMETER AREAS OF THE FIRST THREE FLOORS WERE INCLUDED IN THE DESIGN. THE PRESENT MUSEUM AREA AND ENTIRE FOURTH FLOOR, AS STATED, WERE TO BE INCLUDED AT A LATER DATE. LATER, THE SCOPE OF THE PROJECT WAS GREATLY REDUCED. A DECISION WAS MADE TO PLACE THE POLICE DEPARTMENT ELSEWHERE AND THE ENTIRE MECHANICAL SYSTEM FOR HEATING AND VENTILATING THE BASEMENT BECAME OBSOLETE. APPARENTLY, THE AVAILABLE FUNDS WERE APPLIED FIRST TO THE ARCHITECTURE AND INTERIOR DESIGN OF THE NEW OFFICE LAY-OUT. THE RENOVATION OF THE BUILDING'S PLUMBING SYSTEMS WAS INSTALLED AS DESIGNED BUT THE HEATING SYSTEM WAS TO BE SIGNIFICANTLY MODIFIED. THIS OFFICE WAS REQUESTED TO FORMULATE PLANS FOR THE LEAST EXPENSIVE SOLUTION TO THE EXISTING HEATING PROBLEM, WITHOUT REGARD FOR CENTRAL AIR CONDITIONING. OUR DESIGN RETAINED THE MAIN PIPING AND BOILER ROOM ADDITIONS FROM THE ORIGINAL DESIGN BUT COMPLETELY ELIMINATED ALL THE FAN COILS, DUCTING, AND CONTROLS AS ORIGINALLY DESIGNED. IN PLACE OF THIS EWIPMENT, SELF REGULATING HOT WATER BASEBOARDS WERE CHOOSEN AS THE LEAST COSTLY ALTERNATIVE. THIS WORK WAS COMPLETED APPROXIMATELY ONE YEAR AGO. APPARENTLY, F=S HAVE BEEN MANE AVAILABLE FOR BOTH HEATING AND -AIR CONDITIONING A SIZABLE PORTION OF THE BUILDING. THE BASEMENT, WITH THE EXCEPTION OF A FEW AREAS TO BE HEATED, IS NO LONGER A MAJOR PORTION OF THE '1. WORK. THE FOURTH FLOOR COUNCIL AREA HAS BEEN ADDED TO THE PROJECT. IF A MECHANICAL SYST&i IS TO BE INSTALLED WHICH HAS COMPLETE AIR CONDITIONING AND HEATING SERVICES, A SUBSTANTIAL SAVINGS CAN BE REALIZED BY UTILIZING A 'WATER-SOURCE HEAT PUMP' INSTALLATION. ALL DESIGN WORK TO DATE DOES NOT INCLUDE CENTRAL PLANT AIR CONDITIONING. AIR CONDITIONING CAN BE DESIGNED WITH THE ORIGINAL WORK, AND THE PLANS CAN BE EXPANDED TO INCLUDE THE FOURTH FLOOR CAND DELETE THE BASEMENT). THE FINAL INSTALLATION WILL BE EXPENSIVE, HOWEVER. A 'ROUGH' ESTIMATE FOR THE INSTALLED COST FOR THE HYDRONIC-FAN COIL INSTALLATION IS ABOUT $265,000. THE PROPOSED WATER SOURCE HEAT PUMP SYSTEM UTILIZES TWO UNINSULATED "WATER PIPES INSTEAD OF THE FOUR INSULATED PIPES REQUIRED FOR THE FAN-COIL INSTALLATION. ADDITIONALLY, THE SIZE AND COMPLEXITY OF THE CENTRAL MECHANICAL PLANT AND CONTROLS ARE GREATLY DECREASED. WHILE THE WATER SOURCE HEAT PUMP SYSTEM IS MORE EXPENSIVE THAN THE ORIGINAL DESIGN DUE TO THE REQUIREMENT FOR AIR CONDITIONING, THE INSTALLATION WILL BE LESS EXPENSIVE WHEN BOTH HEATING AND AIR CONDITIONING ARE REQUIRED. A ROUGH ESTIMATE FOR THE INSTALLED COST OF THE WATER SOURCE HEAT PUMP INSTALLATION IS $195,000. ADDITIONALLY, ENERGY USE WILL BE MUCH BETTER WITH THE NATER SOURCE HEAT PUMP SYSTEM. THE INSTALLATION HAS THE ABILITY TO USE ENERGY REJECTED FROM ONE ZONE TO HEAT OR COOL A DIFFERENT AREA. IT IS ESTIMATED THAT THE WATER SOURCE INSTALLATION WILL REQUIRE ABOUT 20-30 PERCENT LESS ENERGY THAN THE STANDARD FOUR-PIPE HYDRONIC INSTALLATION. IN SUMMARY, THE ORIGINAL WORK CAN NOW BE EXPANDED TO INCLUDE CENTRAL PLANT AIR CONDITIONING. ALSO, THE WORK CAN BE REVISED TO SERVICE THE FORTH FLOOR, THE INTERIOR PORTIONS OF THE STRUCTURE, AND TO DELETE THE 'WORK IN MOST OF THE BASEMENT. HOWEVER,IF A FULL HEATING AND AIR CONDITIONING PLANT IS NOW REQUIRED, THE OPTION OF THE WATER SOURCE HEAT PUMP INSTALLATION IS A BETTER CHOICE. BOTH THE 'FIRST-COST' AND OPERATING COST FOR THIS SYSTEM ARE BETTER. BOTH OPTIONS WILL REQUIRE THE INSTALLATION OF A MECHANICAL PLANT IN SOME AREA ADJACENT TO THE BUILDING. FOR ADEQUATELY HEATING AND AIR CONDITIONING THE BUILDING, BOTH- SYSTEMS DISCUSSED WILL BE APPROPRIATE. EITHER INSTALLATION WILL REQUIRE SUBSTANTIAL ALTERATION OF THE EXISTING DRAWINGS. IT IS FELT THAT THIS WORK WOULD BE BEST APPLIED TO A MECHANICAL SYSTEM WHICH BEST MEETS THE PROJECT REQUIREMENTS AS THEY ARE NOW DEFINED. HOPEFULLY, THE ABOVE INFORMATION WILL BE HELPFUL TOWARDS COMPLETING THE PROJECT. YOUR QUESTIONS OR COMMENTS WILL BE APPRECIATED. INCE ;Y, i J A.F. NIBECKER PE AFN/BT f FRED H . We requested a written statement from him that outlines the history of the various mechanical improvement plans prepared over the past 5 or 6 years and a cost comparison of the most recently designed mechanical system versus the proposed "water source heat pump" system. We have enclosed a copy of Mr. Nibecker's letter to us for your use and information. We emphasize that the "rough" estimates for the "hydropic-fan coil" system and the "water-source heat pump" system should be considered for relative comparisons only. Until a new system is designed and drawings prepared so that material quantities can be determined, it is impossible for Mr. Nibecker to give us* anything more than a very rough estimate of mechanical costs. If you feel it desireable, Mr. Nibecker could be present at the next City Council meeting when the Phase IIC improvements are discussed. He can answer any specific questions that the Council might ask regarding the mechanical design work. If you concur, please advise us as soon as possible so we may notify him well in advance. In order to avoid any future confusion, we have elected to reorganize our identification of the different improvement phases to the City Administration Buildings. Phase IIA will be divided into Phase IIA and IIB. The new Phase IIA will include only asbestos removal work. The new Phase IIB will include all improvements to the third floor public restrooms, structural bracing of high and low " fourth floor parapet walls and 22 ' high unreinforced masonry walls at' the fourth floor, and reinforcement FRED H . I regret to inform you that we were unable to include this project in the list recommended to the Legislature for funding this year. We received 130 applications for a total of $18 million. The $3 million allocated for this year's program has 32 projects recommended for funding, most of them for amounts less than requested. The competetive ranking for this program was such that many good projects ranked lower than others. Your project was not reachable with available funds. Staff in the Office of Historic Preservation at (916) 445-8006 will be glad to discuss your application for possible modifications for resubmittal in the next funding cycle. Sensibaugh Director of Public Works City Engineer P.O. Box 747 Atascadero, CA 93423 Dear Paul : Atascadero City Hall Bond Act Grant Project Please excuse the delay in my sending a written confirmation of our discussion of January 8, during my on-site inspection. I have been in telephone contact with the project architect, Mark Moore, and reaffirmed the issues which we discussed at our meeting. - { The Office of Historic Preservation administers the Historic Preservation Component: California Park and Recreational Facilities Act of 1984 for the purpose of preserving the most significant resources in the State of California. The highly competitive and limited funds available under this program are distributed for the purpose of assuring that the architectural and historical integrity of these significant resources is preserved in perpetuity. These are not "public works" grants, these funds should make the difference between a standard public works project and a quality preservation project. They are to be used in combination with local public funds already budgeted for the rehabilitation of a civic building. The Atascadero City Hall project application met these goals and therefore received the highest award possible under the 1984 Bond. It is for these reasons that vie are committed to working with you to design the most sympathetic preservation project possible. We are aware that the City acquired the building from the County after they had done some very intrusive work. However, to continue in the same incremental fashion would not be in the best interest of the resource and will only acerbate the mistakes which have already been made. Therefore, it would be inappropriate for either the City or this office to initiate any further increment of work on this important civic building without understanding the overview for the entire preservation of the resource. For these reasons. I recommended at our meeting and have reaffirmed to Mr. Moore that a Historic Structures Report be compiled as soon as possible. An outline for such a report is enclosed. The documentation for a fine report exists within Mr. Paul M. Sensibaugh Page 2 ; Ap ri 1 17, 1987 the museum on the first floor of the buildings. Volunteer work in coordination with the architectural work from Mr. Moore could develop a useful document that would serve to guide the City Council , the architect, and this Office, and could be developed into a sale publication for the museum as well . Based on the Historic.Structures Report, schematic drawings of the overall restoration of the building for a multi-phased project for several years, if need be, could be developed. Out of these selected working drawings for the increments of work for which funds are available from a variety of sources, including the 1984 Bond, should be developed as those funds become available. The first priority, from the City's point of view, could be the mechanical system to make the building more comfortable. The heating and mechanical systems, however, should not be installed in an incremental fashion which might preclude the best and most economical design solutions for the future. We are-aware of the City Council 's concern that they may have involved themselves in a .program which requires the expansion of the project scope beyond their original intentions. However, the purpose of this grant program and its requirements were clearly outlined in the grant application, procedural guide, and project agreement. If, after reading this letter and understanding the goals and objectives of the Office of Historic Preservation and the 1984 Bond Act, the City Council chooses to withdraw from the rest of the program, the Office of Historic 0 (, Preservation will be happy to revise the scope of work in the project agreement to that already completed. The City would be absolved from further obligation upon return of the remaining money. Please understand, however, that by entering into the contract agreement in the first place and having received funds from this Office., you have committed to this Office's review in the future. We are concerned that all work done on this property whether incremental or interrelated be done according to the Secretary of the Interior's Standards. If you have any further questions, do not hesitate to contact me at the above number. CMI&STRUCTURAL ENGINEERING•LAND PLANNING&ARCHITECTURE November 16, 1988 Mr. Paul Sensibaugh, Director of Public Works City of Atascadero P. 0. Box 747 Atascadero, CA 93423 Subject: Atascadero City Hall Renovation IIC Bid Recommendation Dear Paul: Four prime contractors submitted bids on November 10, 1988 for the Atascadero City Hall Renovation IIC; they are as follows: , 1. Young Brothers Construction. . . . . . . . . . . . . . . . . . $583,950 2. Wysong Construction. . . . . . . . . . . . . . . . . . . . . . . . 608,069 3. R. P. Spiess Construction. . . . . . . . . . . . . . . . . . . . . . . 624,005 After extensive review of the bids received and with consideration of the limited funds available, it is our recommendation that the City delete Item 7 on the Bid Proposal Form (revised 11/04/88), Architectural Renovation, and enter into a contract for Items 1, 3, 4, and 6. The.low bidder for these items is R. P. Richards at $457,000. The second low bidder is Young Brothers Construction at $484,107. The third low bidder is Wysong Construction at $492,528. The fourth low bidder is Spiess Construction at $508,315. There are two.other alternatives available to the City, but we do not believe they would be in the best interest of the City. These alternatives are as follows: 1. The City could accept the low bidder for each of the 4 Items. This results in a theoretically possible low contract cost of $379,505. If the two contractors agreed to the splitting of the work, it would result in having to contract with two contrac- tors who would have to cooperate with the City as well as their competitors. The bids each have given in their respective Items are uncharacteristically low leading us to believe each would withdraw their bid. This is an alternative we strongly recommend against. 2. The second alternative would be to reject all bids. Three of the four bids received contain addition errors constituting just reason for rejection. We do not recommend this alternative as the City has worked 5 years to get to this point. Costs have steadily risen and -rill continue to rise. Therefore, we feel rejection of the bids would be counterproductive. We recommend that the City accept the overall low bid of R. P. Richards, Inc. and enter into a contract with them. We are in receipt of the bid summary as developed by yol:r firm (see attached) whic:-1 indicates the cost breakdowns -for line items numbers 1-7 . A review of the bid summary indicates our firm, R.P. Richards Construction is the apparent low bidder with a low bid of 554 , 476.00 . As I expressed to you earlier, the bid for this project was very complicated due to the seven line items that were required in the contract documents . During bid day the pricing by the subcontractors was very sporadic and intermittent, which we believe was due to the quantity of line iters indicated. As the bid time approached, we were experiencing some difficulties in the tabulation of our numbers which unfortunately did not allow us sufficient tire to review in detail to ensure that all of the lire items received proper distribution of general conditions , profit, and overhead. we are aware the City of Atascadero does reserve the right to award or delete in any combination thereof , any of the line items as indicated in page two of the bid proposal form. Referring once again to the bid summary form, we did experience some difficulties in the distribution of our costs for the line iters , specifically line item number 6 . The City of Atascadero is a community of 23,000 which was master planned between 1913 and 1917 by a design team put together by E.G. Lewis . The historic downtown area and civic center were done in Beaux-Arts style, with the overall City developed according to the Garden City concept: The Atascadero "residen- tial district plan" - comprising the central area of this 24 square mile city - qualifies for inclusion in the National Registry of Historic Places. The City' s planned downtown area was undermined by lack of subse- quent planning _ and by the 1954 location of Highway 101 paralleling the City' s main street, E1 Camino Real. This alignment led to strip development and a decline in the fortunes of the downtown, which was most recently evidenced by the departure of a number of businesses which had anchored the area including Beno' s, Western Office Products, Montgomery Wards Catalogue Store, and the recent move of the U. S. Post Office to a larger site outside of the downtown. The City - which incorporated in 1979 - is committed to revital- izing the downtown area. A Business Improvement Association has been established representing the downtown study area (see attached map) . Undergrounding of overhead utilities is well under way and should be completed by this spring. In addition, a • $20,000 Street Tree Program (paid for jointly by the City and the BIA) has been completed. In March 1988, the firm of Economics Research Associates completed a two volume study entitled Economic Base Analysis and Downtown Revitalization: Volume I, and Volume II Findings and Policy Recommendations. Included in 0 . 0 the study' s recommendations was a proposal to proceed to the next logical step of preparing a plan for the downtown area to provide for specific guidance and coordination of public and private development. In addition, as part of the City' s General Plan, a plan for the Atascadero Creekway has been adopted which seeks to capitalize on this natural feature of the downtown while allowing for connections between the Century Plaza shopping center to the southeast and the historic downtown to the northwest. The City is in the process of designing a vehicular bridge connecting Lewis Avenue and Santa Ysabel Avenue and a pedestrian bridge across Atascadero Creek, which aligns with Palma Avenue. It is envisioned that the Master Plan document would be adopted by resolution as an element of the City' s General Plan. At this point a budget of $25,000 has been earmarked. Should your proposal exceed this amount, it would be useful to indicate what changes could be made in the scope of work to come in at this amount. Your proposal should be submitted to the Community Development Department no later than 5 :00 p.m. on , 1989 . If you have any questions about the RFP, please call Henry Engen, Community Development Director at (805) 466-8000, • extension 129 . Sincerely, Henry Engen Community Development Director City of Atascadero HE:ph Enclosure: Scope of Work BIA Boundary Map SCOPE OF WORK DOWNTOWN MASTER PLAN City of Atascadero PURPOSE: The purpose of this study is to provide a draft element for the City of Atascadero's General Plan which will guide both private and public development in a manner which achieves specific down- town goals and objectives. The plan would be prepared to include the Atascadero Creekway Plan, which is a vital element of the study area, and implement the recommendations of the Economic Research Associates ' Findings and Policy Recommendations (March 1988) . STUDY OUTLINE: A. Introduction. The Introduction would provide a statement of the historical background of the downtown area and its natural and man-made characteristics and issues being addressed including: circulation, parking, land use, image, function, urban design, school sites, and civic center. B. Downtown Master Plan. General goals and policies to enhance the City' s downtown would be stated, followed by specific goals and policies for each of the following component categories: 1 . Circulation - graphically portraying and describing proposed circulation system improvements with emphasis on both pedestrian and vehicular linkages to connect the Century Plaza with the historic downtown area, and to the proposed pathway system along Atascadero Creek. 2 . Parking - utilization of the City' s 1983 parking study to analyze general parking needs and provide recommendations for an off-street parking strategy, off-street parking district, and an in-lieu parking program through zoning. 0 0 3. Land Use - recommend land use and development standards for subareas included within the downtown planning area, e.g. , civic center, Atascadero Creekway, school lands, historic downtown, shopping centers, highway commercial, residential, etc. 4 . Urban Design - evaluate and make recommendations on the urban design elements of the study area, including: Administration Building, Sunken Gardens, historic downtown, sections of E1 Camino Real and the Atascadero Creekway. Important urban design issues include: theme `_ entranceways, identification, beautification, appearance review standards, historic buildings, building height to street width ratios, publicway treatments, landscaping, trees, street furniture, public art, landscaped medians, lighting, and signs . C. Implementation. Phased program of implementation of both public and private activities to implement the plan to be developed, including: downtown image strategy, development review process, capital improvement program, parking and land use regulations, and general fiscal sources for financing will be identified to implement public/private funding requirments . D. Meetings . City Staff will coordinate appropriate meetings with the downtown steering committee and, subsequently, the Planning Commission and City Council. It is expected that there would be a minimum of four (4) steering committee meetings and one (1) meeting to present the final report to the City Council and Planning Commission. E . Reports. Thirty (30) copies of the administrative draft report and one hundred ( 100) copies of the final report will be required. The final report will be based on the consultants professional evaluation of input received in review of the administrative draft. F. Principal in Charge/Experience: Indicate the principal representative from the consulting firm, together with others assigned to the work. The consultants experience performing similar work in similar communities would be an important consideration. G. Fees. The proposal should indicate a "lump sum" fee or upset price for the work cited, together with costs which would be charged for unforeseen study activities (e.g. , additional meetings, report copies, etc . ) . F. Time Schedule. Indicate the timeline for completion of the work.
