ROLL CALL All Present : Councilmembers Dexter , Lilley, Mackey, Shiers and Mayor Borgeson. Staff Present : Ray Windsor , City Manager; Henry Engen, Community Development Director , Paul Sensibaugh , Public Works Director ; Chief Bud McHale, Police Department ; Jeff Jorgensen, City Attorney; Chief Mike Hicks, Fire Department ; Boyd Sharitz , City Clerk ; Georgia Ramirez , Deputy City Clerk . COUNC I L COMMENT • Mayor Borgeson reminded those in the audience if they haven ' t voted , please do so . COMMITTEE REPORTS SLO AREA COORDINATING COUNCIL - Mayor Borgeson reported that she had been called by the San Luis Area Coordinating Council Secretary and the meeting that was scheduled for December 7th is rescheduled to December 14th . SOLID WASTE MANAGEMENT COMMITTEE - Councilwoman Mackey said she missed the meeting last week but received a thick book to read on it . The main thing they talked about was recycling . They are hoping that they can get people to recycle 25% of what would normally go to the dump . BUSINESS IMPROVEMENT ASSOCIATION - Kirk Pearson, BIA President , stated he was there to announce the Third Annual BIA General Meeting on Thursday, November 10th at 7:30 p .m. at the Prather Building . The agenda will include; recap of the underground utility process which is going on right now in the downtown area. Wayne Cooper from PG&E and will bring the members of the BIA up to date as far as the time table for the hookups are concerned . The project is about 60 days ahead of schedule. The trees will • be covered on the agenda --- - final phase of the tree planting that will go along E1 Camino Real . Also to be addressed will be the parking , and Christmas Promotion. Ray Windsor , City Manager , will address the BIA.- He also said that his term as president will be ending soon so he wanted to thank the Council and Staff for giving him the opportunity to serve in this capacity. • COMMUNITY FORM Pete Bunesar from the audience said that he had attended the meeting Cal Trans meeting regarding the 41 realignment . He said there are concerns that affect the residents of that area and may be impacted tremendously but the whole town needs to look at what will happen once that ' s in place. The traffic will be funneled into E1 Camino and Highway 41 intersection. 44It will impact traffic coming off the freeway into Atascadero not only at E1 Camino but at Traffic Way. It will impact people trying to use the Century Federal Savings and Plaza who would like to turn left off of 41 along with those trying to turn left into the Von ' s Shopping Center . 27,000 vehicles use that intersection. What is going to happen when Curbaril is no longer a route for people to go East? 4,500 vehicles per day use that route. He stated he didn ' t believe that it was ever talked about routing 41 north on 101 to 46, east on 46 to where 41 takes off of 46. This would eliminate about 500 vehicles a day on Curbaril , it would minimize the destruction of the rural atmosphere of Atascadero and it would definitely prevent the uprooting of 17 families that are going to have their life styles changed drastically. Mayor Bergeson responded that the City Council and Planning • Commission will have a joint meeting on the 29th of November . At that time one of the items that will be discussed is the circulation element of the General Plan. She urged those concerned to attend that meeting and express their concerns. She also asked that they address their comments to Cal Trans before the deadline of the 10th . A. CONSENT CALENDAR: 1 . October 25, 1988 CITY COUNCIL MINUTES 2. RESOLUTION 107-ee - ACCEPTING THE PENAL CODE REQUIREMENTS RELATING TO THE SELECTION AND TRAINING STANDARDS OF PUBLIC SAFETY DISPATCHERS. City Manager . Ray Windsor , said Item 7 should be removed from the Consent Calendar . It will have to be brought back with the proper documentation to make it an Ordinance instead of a Resolution. Motion: By Councilwoman Mackey, seconded by Councilman Shiers to approve Consent Calendar Items A 1-6. Passed unanimously by roll call vote. B. HEARINGS/APPEARANCES/REPORTS: 1 . PRELIMINARY REVIEW OF GENERAL PLAN AMENDMENT CYCLE 1-89 (Review & authorization to refer to Planning Commission for Public Hearing ) Henry Engen, Community Development Director , gave staff report . Glenn Lewis representing the Colombo family stated "historically he didn ' t know why the Colombo property was left out of the Urban Services Line because he understands property south of there was included . The reason for the application by the Colombo family is solely because the last will and testament of their mother bequeathed the 10 acre piece of property among 9 different children and a majority of the children would like to occupy this particular property" . Motion: By Councilman Lilley, seconded by Councilman Dexter , to direct staff to prepare an analysis and bring to public hearing the General Plan Amendment study areas recommended by the Planning Commission. Passed unanimously. 2. SEWER EXTENSION REIMBURSEMENT AGREEMENT (MACCORKLE) Staff report was given by Paul Sensibaugh , Public Works Director . There was no public comment . . Motion: By Councilwoman-Mackey, seconded by Councilman Shiers to approve the attached Sewer Extension Reimbursement Agreement between the City and Mr . and Mrs. MacCorkle. Motion passed unanimously by roll call vote. -3- 3. REQUEST BY ACTION FOR ANIMALS ' RIGHTS (AFAR.) REGARDING SPAY/ NEUTER ASSISTANCE PROGRAM. Ray Windsor , City Manager , gave staff report . Daphne Fahsing , President of AFAR, said this would be an expansion of the program. It would not restrict any of the certificates at all , but is intended to get some of the stray cats taken care of. Council comments followed . Council concurred with using some of the $12,000 in a pilot program to spay and neuter the stray and wild cats. C. UNFINISHED BUSINESS: 1 . CONVERSION OF x.50 DEVELOPMENT MITIGATION TAX TO A FEE AND EXPANDING THE BOUNDARY FOR THE LEWIS AVE. BRIDGE FEE (Cont ' d from 10/11/88 and 10/25/88) A. Resolution No . 100-88 - Establishing a development fee for all developments within the incorporated area of the City of Atascadero pursuant to Urgency Ord . 183. B. Urgency Ord . No . 183 - An Urgency Ordinance of the City Council superseding Chapter 8 of Title 3 of the City ' s Municipal Code relating to development impact fees and repealing Ordinances 111 , 118 and 119. Paul Sensibaugh presented the staff report noting that the City Attorney advised that Ordinance No . 103 cannot be acted on in its present form; therefore only Resolution 100-88 (as amended today) is ready for action. Motion: By Councilman Dexter , seconded by Councilwoman Mackey to approve Resolution No . 100-88. Passed unanimously by roll call vote. 2. PROPOSED ORDINANCE PROHIBITING ABANDONMENT OF WATERFOWL AT ATASCADERO LAKE (Requested by Council 9/ 13/88) A. Ordinance No . 1S2 - Amending Title 4 of the Atascadero Municipal Code, entitled Animals, relating to the abandonment of waterfowl at Atascadero Lake (First reading ) Staff report was gi-ven by Ray Windsor , City Manager . Council comments followed . -4- • • Daphne Fahsin.g , Prp5ident of AFAR, asked how are you going to stop the people from dropping off the ducks? Is there much use in having an ordinance that you can ' t enforce? What would be the penalty? Mayor Borgeson said she hoped with this Ordinance it will have some impact on those dropping off fowl at the Lake . Jeffrey Jorgensen, City Attorney, stated it would be an infraction and probably would be a $50 fine. Motion: Made by Councilman Dexter , seconded by Councilwoman Mackey, to wave reading of the Ordinance in full , a read by title only. Passed unanimously by roll call vote. 3. AWARD CONTRACT FOR CLASSIFICATION AND SALARY STUDY Staff report was given by Ray Windsor , City Manager . Motion: Made by Councilman Lilley, seconded by Councilman Shiers to approve the awarding of the bid of $6,800 to Comp Plus for the Classification and Salary Study. Passed unanimously by roll call vote. D. NEW BUSINESS 1 . RESOLUTION NO. 105-88 - AUTHORIZATION FOR CITY TO ENTER INTO MEMORANDUM OF AGREEMENT (MOA) RELATIVE TO MEASURES TO MITIGATE THE IMPACT OF HIGHWAY 41 EXTENSION ON HISTORICAL RESOURCES. Ray Windsor , City Manager , gave the staff report . Motion: By Mayor Borgeson, seconded by Councilwoman Mackey to postpone item until the joint meeting on the 29th of November . Passed unanimously . 2. ATASCADF_RO UNIFIED SCHOOL DISTRICT RESOLUTION 9 - ANTI LOITERING MEASURES IN CITY OF ATASCADERO. Ray Windsor , City Manager , asked Council, not to act on this item tonight so that staff, City Attorney and he can give input in writing to council so that council could digest the information before they act on this item. • There was no public comments. -5- Motion: By Councilwoman Mackey, seconded by Councilman Lilley, to refer to staff to bring back a report to Council . Passed unanimously. 3. ESTABLISHMENT OF A LOCAL UMMET TRANSIT NEEDS HEARING City Manager , Ray Windsor , gave the staff report . Council comments followed . Consensus of Council was that a public hearing should be held preferably early enough so that people using Dial A Ride could attend the meeting . This will be discussed further at meeting of November 9th . 4. ESTABLISHMENT OF COUNCIL SUB-COMMITTEES Ray Windsor , City Manager , gave staff report . Council discussion followed . Mayor- Borgeson stated that Councilmen Shiers and Lilley had agreed to serve on the sub-committee for fiscal matters . For Tree Preservation Councilmen Dexter and Shiers agreed to serve on the sub-committee. Land-Use (General Plan Update) - Mayor Borgeson that at the Planning Commission Level she recommended George Luria . City Manager Ray Windsor stated that the Planning Commission should discuss it and for the Chairman to appoint or concur with this appointment . Marge Mackey and Mayor Borgeson will serve on this sub-committee. E. INDIVIDUAL DETERMINATION AND/OR ACTION 1 . City Council Councilwoman Mackey said she had received a phone call regarding the tree management section of the tree ordinance. Mayor Borgeson said they had looked at steps in the body of the ordinance and then there was going to be street planting , and then the tree management plan. Councilman Lilley stated he would like to submit for consideration of the council the creation of a committee to explore the possible feasibility of the outdoor amphitheater in Atascadero . • -6- Ray Windsor , City Manager , suggested that council may want to defer- the appointment of such a sub committee until the next meeting in order that staff know exactly what council ' s priorities are. This will be discussed more on 11/9/88. 2. City Clerk Boyd Sharitz , introduced Georgia Ramirez , Deputy City Clerk . 3. City Manager A. Request to change regular Council Meeting Time to 7:00 p .m. Ray Windsor will have the City Attorney work up the modification to the Ordinance. Consensus of the Council was to direct the City Manager to follow up . B. League of CA Cities City Council /City Manager Leader- ship Team Workshop , January le-20, 1989 . Ray Windsor , asked that as many Council Members as possible attend this meeting . C. V Yay VVKJbSOR City Manager • M E M O R A N D U M TO: City Council November 22, 1988 VIA: Ray Windsor, City Manager FROM: Henry Engen, Community Development Director SUBJECT: TENTATIVE PARCEL MAP 17-88 LOCATION: 11200 Santa Ana Road APPLICANT: Kamm & Dohan Partnership (Twin Cities Engineering) REQUEST: To subdivide three existing vacant parcels totaling 17 . 20 acres into four parcels containing 4 .3 acres each. • BACKGROUND: On November 1, 1988, the Atascadero Planning Commission conducted a public hearing on the above-referenced subject. On a 5 : 2 vote (with Commissioners Luna and Brasher dissenting) , the land divi- sion request was approved subject to the revised conditions of approval ( specifically, deletion of condition #11) . There was considerable discussion on this matter as reflected in the attached minutes excerpt. RECOMMENDATION: Approval of Tentative Parcel Map 17-88 per the Planning Commis- sion' s recommendation. ANALYSIS: The applicant proposes to subdivide 3 (three) existing parcels containing 17. 20 acres into 4 (four) parcels containing 4. 3 acres each. Two of the existing parcels having frontage on Cebada Road are developed with single family residences. The third parcel " is undeveloped. Proposed Parcels 1 & 2 will have direct access to Cebada Road. Parcels 3 & 4 will have direct access to Santa Ana. Overall the proposal is for the creation of one new lot. The subject property is located in the RS (Residential Suburban) zone. Minimum lot size in this zone ranges between 2. 5 and 10 1 • II I • • acres depending on the "score" of the various performance • standards. The site includes a ridge line along Santa Ana Road and a creek bottom along the Cebada Road frontage. The intervening slope, which exceeds 20%, is partially covered with native oak trees. Two residences have been constructed along Cebada Road. Two building sites are proposed along Santa Ana Road. One existing site can currently be used, the second to the south would be the new site. The creation of the new parcel would provide a building site within 75'-0" of Santa Ana Road, and within 150' -0" of the existing site to the north. Construction will extend a row of home sites along the highly visible ridge line. The selected sites will not require the removal of any native trees. Peculation tests have been provided showing that all proposed sites have adequate areas for septic systems. The new site' s tests are relatively high but a system can be designed for the site. Comments were received from several outside agencies. Our Fire Department noted no problems with the proposed map. The Building Division noted some concern with the potential septic systems on the site but noted that the concerns could be overcome through the design process. The Southern California Gas Company has noted that the site can be served by existing 3 inch mains in Cebada and San Pedro Roads. The Public Works Department has noted the need for offers of dedication and drainage improvements along Cebada Road C. Staff is recommending approval subject to certain conditions . -1- • • MINUTES EXCERPT - PLANNING COMMISSION - NOVEMBER 1 , 1988 0 Commissioner Brasher inquired as to how staff determined the minimum lot size. She explained that she took measurements of the property with regard to the distance from the center (of town) and came up with 12, 500 which would change the factor from 0 .30 to 0 .40. Mr. Moses noted the minimum lot size calculations were also determined from a previous parcel map just south of this site. He referenced a map which reflects a concentric circle basis and explained how determining a site' s distance from the center of town is achieved. Commissioner Luna concurred with Commissioner Brasher' s statements adding that he also measured the distance and came up with a performance factor of 0 .40 . He did not see how this particular subdivision meets the minimum lot criteria and, therefore, did not feel this matter should be considered at this time. In response to question from Commissioner Brasher, Mr. Moses explained the three methods utilized in determining the slope of a property. Discussion followed relative to the previous lot split in- volving a portion of land which is being considered for this particular map and what affect the minimum lot size calcula- tions for the earlier map now has on the subject lot split. Also discussed was the "bulls-eye" map and the difficulty in determining its accuracy with regard to the distance from center factor. Tom Vaughan with Twin Cities Engineering, representing the applicant, noted that his firm has utilized the minimum lot size map has been a standard for over four years . He ex- plained that two' of the proposed four parcels are already developed and that this map also involves a lot line adjust- ment to alleviate certain encroachments . He pointed out that Cebada Road is not an original Colony road. Cebada Road was offered and accepted by an earlier lot line adjust- ment. Mr. Vaughan indicated that he had reviewed proposed conditions of approval with Paul Sensibaugh that afternoon and that he had concurred in some changes . Mr. Vaughan asked that condition ##11 (scenic easement) be deleted noting where the proposed home sites will be located. He expressed opposition to ##5 (drainage easements) as this requirement appears to be redundant (noting the previous subdivisions) . With regard to #10 (road improve-ments along Cebada Road) , it was pointed out that this requirement should have been taken care of through the prev-ious lot line adjustment. In response to questions from the Commission, Mr. Vaughan explained the background involved with the previous lot -2- • i MINUTES EXCERPT - PLANNING COMMISSION - NOVEMBER 1 , 1988 split involving a portion of the subject property, and spoke on utilization of the "bulls-eye" map and procedures his firm uses in calculating the minimum lot sizes. William Dohan, applicant, explained the background involved with the purchase of this property noting he contacted staff concerning the feasibility of being able to split said property. Based on representations by the City, he proceeded with the property purchase and subsequent lot split request. Mr. Dohan added that it is not fair to deny this request based on the invalidity of the "bulls-eye" map as this map meets the minimum lot size standards and other applicable City codes and regulations. The lot split corrects other problems previously created; no tree removal will be necessary. He explained his reasons for objecting to condition #10 but added that he would be willing to comply with #5 . He then responded to questions from the Commission relative to ridge top development in relation to the scenic easement, etc. In response to question from the Commission, Mr. Engen stated that input from Public Works is needed before any recommendations on deletion of Conditions #5 and #10 could - be made and a continuance would be in order. Mr. Vaughan asked that in lieu of a continuance, that the map be approved with the conditions as presented. Dorothy McNeil asked if prospective buyers of property are made guarantees that property they buy would be assured of lot splits. Mr. Moses responded. Commissioner Waage disagreed with the "target" map but did not feel that the applicant should be penalized because of this . He also indicated he would not have a problem with deleting condition #11 (scenic easement requirement) . Commissioner Luna stated his primary objection is that the creation of the proposed parcel does not conform to the Zon- ing Ordinance and the minimum lot size is 4 . 4 (rather than 4 .3 ) , therefore, he would not be able to approve this request. Commissioner Highland noted he is uncomfortable with condi- tion #10 as a question has been raised as to whether this condition was part of a lot split that was not met. This should have been determined before the condition was placed on this map. He agreed with Commissioner Waage that in this case, there is no practical use for a scenic easement. He added that prospective buyers of property are influenced by minimum lot sizes that can be created, but that those who do wish to split to the minimum should not be prevented to do SO. A14ALYSIS: The applicants have submitted a parcel map to subdivide property an- nexed to the City and previously zoned. The property is zoned for several types of uses : Commercial, Residential and Recreational. The site is also covered by several waterways (Graves Creek, Paso Robles Creek and the Salinas River) . Access to the site is gained by way of El Camino Real. Access from the freeway is not permitted. The site is currently used for a residence and agricultural use. The site is somewhat isolated due to the freeway and the waterways. The proposed annexation and zoning were reviewed in public hearings by the City and an E.I.R. certified for the sites proposed zoning and development. During the process, extensive public comment was given as to access to the site and zoning. The project was revised and the current zoning configuration approved. In reviewing the proposed Parcel Map, the staff has been concerned with the site' s access and internal circulation. After a meeting with CALTRANS (State of California) , who controls access location and design, it was determined that final access design and improvements would be held until the time of development of any of the parcels . To maintain options , large easements have been provided along the front of Parcels 1 & 2. The site is also split by the railroad. This presents an access problem that under the EIR was solved by the proposed construction of a grade separation (bridge) over the railroad tracks . As an interium solution, the applicant is provid- ing a private crossing. Ultimate development of higher density uses beyond this access point, will require the grade separation. The City' s General Plan and State Law provides for access and use of waterways for recreational uses. Since the site contains several waterways , General Plan conformity would require the establishment of access rights . D. Please be advised that this District is severely impacted by the addition of any new dwelling units within the school district's boundaries. The schools of TUSD are already overcrowded, and the County Board of Supervisors has approved the District's request to levy Developers' Impact Fees, effective 11/23/86. due to the Board of. Trustees' findings of overcrowding within the District schools. In addition, there is new legislation recently signed which would allow the District to levy up to $1 .50 per square foot of habitable living space, including any fees levied under SB201 . Developers' Impact Fees. It is anticipated that the Templeton Unified School District Board of Trustees will implement such fees effective as soon as legally possible following 1/1/87, the effective date of such legislation. At the point of conversion to fee collection under the new law, SB201 fees would probably be discontinued by the County, and the new fees would be levied directly by the schools' Board of Trustees. If the TUSD does implement these new fees, Issuance of building permits - - - by any agency -so charged would be dependent on a "sign-off" from the. school district attesting to the mitigation of the Impact of the development by payment of .these fees. Although we were unable to respond by the October 6 Planning Commission meeting, we do wish these comments to be noted for development within the boundaries of the TUSD. The creation of these parcels conforms to the Zoning Ordinance and the General Plan. 2. The creation of these parcels , in conformance with the recommended Conditions of Approval, will not have a significant adverse effect upon the environment. An Environmental Impact Report was prepared for the project and was certified. 3. The site is physically suitable for the type of development that is proposed. 4. The site is physically suitable for the density of development that is proposed. 5. The design of the subdivision and the proposed improvements will not cause substantial environmental damage or substantially and avoidably injure fish and wildlife or their habitat. 6. CONDITIONS OF APPROVAL: 1. All development fees and/or assessments in effect at the time of building permit application, shall be paid at the time of building permit issuance, to the City of Atascadero and the Templeton Unified School District. 2. Public recreation easements covering the three water courses (Graves Creek, Paso Robles Creek and Salinas River) and areas 25-0" back from the top of the bank shall be shown on the final map. A 25.0" public access easement shall be provided from El Camino Real to Graves Creek on an alignment acceptable to City of Atascadero. 3. Prior to the residential or commercial development of Parcels 3 and 43, a grade separated railroad crossing shall be approved and con- structed to City and State Standards. A single residential struc- ture may be constructed on Parcels 3 and 4 if the structures are equiped with fire sprinkler systems as per N.F.P.A. #13d. A note so stating shall appear on the final map. 4. Public Improvements Plans , acceptable to both City of Atascadero and State of California (CALTRANS) , shall be reviewed and approved prior to the issuance of any permits for development of Parcels 1 and 2. Said improvements shall be installed along entire frontage of El Camino Real at the time of development of either parcel. This shall appear as a note on the final map. 5. Access rights along State Freeway R/W are relinquished and shall be addressed on final map along entire frontage. Submit proof of acceptance by CALTRANS for use of existing encroachment and speci- fying terms of agreement for said use. 6. Submit recorded grant of easement for encroachment within S.P.R.R. easement prior to construction of access road or recording final map , whichever is first. 7. Obtain encroachment permit from CALTRANS and construct encroachment for access road to their standards and specifications . 8.- Access road shall be constructed to serve all parcels , including structure-r,egaiired to cross Graves Creek to serve Parcel 4 and rail- road crossing or provide alternate access acceptable to the Depart- ment of Public Works and the Community Development Department (or bond for said improvements) prior to recording final map. 9. Plan and profile drawings of access road shall be submitted for approval by the Department of Public Works and the Community De- velopment Department prior to start of construction. An Offer of Dedication for future street may be required and shall be determined upon review of this plan. Dedication would be along the southerly subdivision boundary. 12. Area subject to inundation in 100year storm shall be delineated on final map and elevation of high water noted. 13. Three Benchmarks shall be set, spanning length of subdivision between the easterly and westerly boundaries, to be used as future reference points for determining limits of flood hazard zone prior to development. Location and elevation of each point shall be shown on final map. 14. Show location of all creeks and rivers on final map. 15. Prior to recording the final map, a soils investigation (as re- quired by the Map Act) shall be submitted, recommending corrective action which will prevent structural damage to each structure pro- posed to be constructed in the area where soils problems may exist. The date of such reports , the name of the engineer making the report, and the location where the reports are on file shall be noted on the final map. 16. Road improvement plans. prepared by a registered civil engineer must be submitted to and approved by the Public Works Department prior to recording the final map. 17. An offer of dedication shall be made to the public for the Public Utilities Easements . 18. Offers of dedication or easements shall be completed and recorded prior to or simultaneously to recording the final map. 19. Install all street signs , traffic delineation devices , warning and regulatory signs , guardrail, barricades , and other similar devices where required by the Public Works Director as per approved site plan. Signs shall be in conformance with the Public Works Depart- ment standards and the current State of California uniform sign chart. A final map drawn in substantial conformance with the approved tentative map and in compliance with all conditions set forth herein shall be submitted for review and approval in accordance with the Subdivision Map Act and the City Lot Division Ordinance prior to recordation. a. Monuments shall be set at all new property corners created and a registered civil engineer or licensed land surveyor shall indicate, by certificate on the final map, that corners have been set or shall be set by a date specific and that they will be sufficient to enable the survey to be retraced. b. A recently updated preliminary title report shall be submitted for review in conjuction with the processing of the final map. c. A preliminary subdivision guarantee shall be submitted for review in conjunction with the processing of the final map. 22. Approval of this tentative parcel map shall expire two years from the date of final approval unless an extension of time is granted pursuant to a written request prior to the expiration date. . Sensibaugh , Director of Public Works SUBJECT Establishment of Stop Intersection DATE November 4 , 1988 Recommendation : The Traffic Committee recommends that Council adopt the attached resolution establishing a stop intersection on Cabrillo at its intersection with Ensenada Avenue. (Resolution No. 108-88) Background: • This intersection is currently uncontrolled and the sign will provide a safe intersection. The Traffic Committee is also requesting that the Police Department patrol this area as frequently as possible since speed complaints have been recorded along Ensenada which is posted 25 MPH. Fiscal Impact : The cost of this improvement will be approximately $50 to be paid out of 1988/89 budgeted funds . RESOLUTION NO. 108-88 RESOLUTION OF THE COUNCIL OF THE CITY OF ATASCADERO DESIGNATING A STOP INTERSECTION ON CABRILLO AVENUE AT ENSENADA AVENUE WHEREAS, Section 4-2 . 801 et seq, of the Atascadero Municipal Code allows the City Traffic Engineer to determine the location of STOP intersections , and to place and maintain appropriate signs or markings indicating the same; and WHEREAS , the Atascadero Traffic Committee has recommended that establishing a STOP intersection on Cabrillo Avenue at Ensenada Avenue will improve a hazardous traffic situation . Under the terms of the contract referenced by Attorney Betty • Sanders in her letter to the City, dated 8/30/88, " . . .Contractor may appear before the City Council of the City at any time after each two (2) years of service under this agreement and request an additional two ( 2 ) year contractual period" . As indicated by Mrs . Sanders, Wil-Mar is requesting an additional two-year ex- tension, which, if approved, would become effective in January 1989 . In our meeting with Mrs . Sanders and Bill Gibbs, President of Wil-Mar, it was stated, for the record, that the extension of the agreement would permit Wil-Mar to move ahead with plans to purchase two additional pieces of capital equipment (rolling stock) . Staff is not aware of any major problems with the trash service, and I have not personally received any negative comments about Wil-Mar. In reading the existing contract, I note that it calls for an annual clean-up effort in conjunction with a City-wide program, and I would just like to say that I strongly urge the City to initiate this in the Spring of 1989 . With respect to the requirement of Wil-Mar to provide various insurances , we have checked the records and find that everything is in line with the terms and conditions as outlined. RECOMMENDATION That Council authorize a two-year extension of the contract with • Wil-Mar for solid waste collection and authorize the City Attor- ney to draw up the necessary resolution. The term of this Agreement shall January 1, 1986. extend for five (5) years f r o m ithW)Wa/W/qV I/1/S/ However , Contractor may appear before the City Council of the City at any time after each two (2 ) years of service under this agreement and request an additional two (2) year contractual period . The granting of an additional two (2 ) year contractual period shall be discretionary with the City. The length of contract shall not exceed five (5) years at any time of contractual period . 3 . Performance. Contractor shall provide a minimum of weekly regular collection for its customers with collection hours limited to 6 : 30 A.M. to 7: 00 P.M. in residential areas and 6 : 00 A.M. to 9: 00 P.M. in commercial areas . Contractor shall insure that cans or bins are returned to the same location from which removed to dump contents into the collection truck . 4 . Cleanup Efforts . Contractor agrees to participate in official City cleanup efforts and may be required to provide trash bins or trucks at convenient locations for use by the public at no charge to City. This requirement may not be imposed for any longer than one week, once during the calendar year . 5 . Free Services to City Facilities . Contractor agrees to provide solid waste disposal to City facilities , as well as to service public trash receptacles in the business district , at no charge . Such City facilities shall include , but not be limited to , the 5/8/85 2 - Administration Building, the Fire Department , the Corporation Yard on Traffic Way, the Sanitation Division, the City Park and Zoo, Alvord Field, Henderson Field, South Atascadero Park, and any other additional City facilities . This condition does not apply to construction debris or any other solid waste generated off the public facilities premises . Trash receptacles used for City facilities and those lcoated on sidewalks within the business district shall be serviced once per week or sooner if required. 6 . Rates for Service . Contractor agrees to perform such collection services at the rates established by resolution of the Council . 7 . Maintenance of Equipment. A. Trucks . All trucks shall be kept in good condition regularly by steam cleaning , and oil leaks shall be eliminated . All trucks shall pass a California Highway Patrol (C.H.P. ) safety inspection annually. B. Commercial Bins . Commercial bins shall have lids , * be watertight , cleaned and painted regularly, a minimum of once per year . 8 . Indemnification, Bond, and Insurance Reauirements . A. Indemnification. Contractor agrees to indemnify, defend , and save harmless , City and its officers , agents , and employees from and against any and all liability , claims , demands , costs , expenses , damages , . judgments , and causes of action in any way arising out of 5/ 8/85 3 - this Agreement , or out of the performance or attempted performance of the provisions hereof , including but not limited to any act or omission to act by Contractor or its agents , employees , or independent contractors directly responsible to Contractor . B. Bond Reauirements . Contractor agrees to furnish a cash or surety bond to City in the sum of Fifty Thousand Dollars ($50 ,000 .00 ) , conditioned upon the faithful performance of this Agreement and the provisions of the City Municipal Code . In lieu of the above, City may, at its discretion , accept some other type of financial arrangement guaranteeing City payment in case of nonperformance under the terms of this Agreement . C. Workers Compensation Insurance. Contractor agrees to procure , carry , and keep in full force and effect during the life of this Agreement , full compensation insurance with an insurance carrier as defined by and in accordance with the provisions of the Labor Code of the State of California . Contractor shall furnish a copy of the certificate of insurance to City. D . Public Liability Insurance. Contractor agrees to procure , carry, and keep in full force and effect during the life of this Agreement , public liability insurance with a carrier agreeable to City to the extent of Five Hundred Thousand Dollars ($500 ,000 .00 ) for the death or injury to one person , and One Million Dollars ( $1 ,000 ,000 .00 ) for the death or injury to more than S 5/8/85 4 - one person , and property damage insurance to the extent of One Hundred Thousand Dollars ($100 ,000 .00 ) upon each of the trucks or vehicles used by Contractor in carrying out the work called for in this Agreement , said insurance to cover both Contractor and City, with City, its officials , and its employees named as additional insureds . Contractor agrees to provide City with a copy of the insurance contract , with a rider attached thereto providing that the insurance contract shall not be cancelled for nonpayment of premium or otherwise , without thirty ( 30 ) days prior written notice to City , sent by certified mail , directed to the attention of the City Manager . 9 . Pavment to Citv. Contractor hereby promises and agrees to pay to City for the rights and privileges herein granted , five percent ( 5%) of the gross cash receipts of the garbage , refuse and rubbish collection business conducted by Contractor within City, said amounts to be payable monthly on or before the fifteenth (15th) day of the ensuing month , and said payment shall cover the gross cash receipts for the month preceding the payment date . The revenue received under this provision shall be placed in City ' s General Fund . Payment not made by the fifteenth ( 15th ) day of the month shall bear interest at the rate of twelve percent (12% ) . 10 . Accounting Records . Within Contractor ' s accounting records , all items of revenue and expense for 5/8/85 5 - ` •( operations pertaining to the services provided by this Agreement shall be complete and clearly defined . The accounting and statistical records of such revenue and expense items shall be adequately segregated to meet the needs of analysis for rate making. Contractor ' s records shall be available for audit at any time during usual business hours . This provision shall be accomplished within one (1) year of the execution of this Agreement . 11 . Identification of Eauioment. Contractor shall clearly identify all refuse trucks and commercial bins with the firm name and telephone number . Contractor shall require its crewmen to wear clean uniforms with a conspicuous firm name and employer identifier on the uniform. 12 . Identification of Violations . Contractor shall attach a tag designating a reason for noncollection to any can or container not being collected because of being overweight or for other violations . 13 . Maintenance of Office. Contractor shall maintain an office within City where bills may be paid, services applied for , and . complaints made , which office shall be equipped with a telephone and shall have a responsible person in charge during usual business hours . 14 . Complaints . A copy of all written complaints and statements of all verbal complaints received by Contractor or its employees shall be maintained by Contractor with a duplicate copy forwarded to City , 5/8/85 6 attention of the City Manager , at least once per month , no later than the fifth ( 5th) calendar day following the month in which the complaint was received . Said records shall be maintained for the term of this Agreement . 15 . Rules and Regulations . Contractor shall , at its expense , mail annually to each subscriber a statement of rules , container limitations , fees , telephone numbers , and other pertinent information. 16 . Failure to Perform. Upon the failure or omission of Contractor to keep , fulfill , or perform any of the terms , provisions , or conditions of this Agreement , or of the City Municipal Code , and the failure of Contractor to remedy or correct any such failure or omission within twenty ( 20 ) days after notice in writing of such failure or omission , this Agreement shall , at the option of City officials by resolution of the City Council , be terminated and ended , and Contractor shall thereafter have no further rights , powers , or privileges as granted by City under or arising through this Agreement . 17 . Assignment Prohibited . This Agreement shall not be assigned or sublet without the approval of the City Council . 18 . Effect of Litigation . In the event that a court of competent jurisdiction declares that this Agreement is void by reason of the application of the Federal Antitrust Law or the California Antitrust Law, then this Agreement shall be of no further force and effect , and City 5/8/85 7 - shall have the right to contract for solid waste collection services from other sources . 19 . The Commission adopted the below described standards for agencies which participate in the program which will become effective 1-1-89: -a thorough background investigation; -a medical examination; . -an evaluation of oral communication skills; satisfactory completion of a POST-certified, 80-hour Basic • Complaint/Dispatcher course within 12 months of the date of hire; and -a minimum of 12 months probation. Only participating agencies will be eligible for reimbursement of certain dispatcher training costs. To participate in the Public Safety Dispatcher Program, an agency must submit a letter to the Commission requesting participation, accompanied by a copy of an ordinance pledging adherence to the standards adopted by the Commission. (As you will note, we currently adhere to the program requirements, however, without the ordinance and request to POST, effective 1-1-89, we will no longer be reimbursed for the POST training.) Attached is a proposed ordinance for City Council review and adoption. Once approved, I will forward a copy with a letter to POST. RECOMMENDATION: I request that the attached proposed ordinance, in whatever format is appropriate, be approved by City Council so that our City may continue to participate in POST-funded training programs for our dispatchers. North Coast' s proposal is for $11 . 167 . Higgins is for $10, 100 after taking out the $500 for the timing which is not included in North Coast' s design phase figure, but in their construction estimate . Background: The above intersection has been recently impacted by the new Post * Office facility and southside multiple family residences . It • is- assumed that this intersection will now meet the necessary signal warrants that could not be met prior to the opening of the Post Office . The Planning Commission, City Council and City Staff have all suggested that this project be moved up in the priority ranking once the Post Office opened. Discussion: The design for the above signal will cover any geometric changes or recommendations for median deviders along the E1 Camino Real frontage . The Scope of Services is attached for Council ' s review. This work is not on the Caltrans system but is on the Federal Aid Urban system. Therefore, since we are suggesting FAU funds below, the City will have to use the consultant selection guidelines presented by Caltrans, including encouragement of DBE firms. Fiscal Impact : Contributions from the Bordeaux House project and the Post Office facility amount to $50, 000 or approximately 50% of the cost of a new traffic signal . Another $23, 000 is expected from the Proposed bowling alley project nearby and $2, 000 has been committed by two smaller projects within the area . The remaining funds, aproximately $25, 000, not including median islands if necessary, will come from future Traffic Development Impact Fees . • • Staff suggests that this project be submitted as a Federal Aid - . Urban project which provides 100% funding for signalization work. The current budget shows the City's share of FAU funds for bridges recieving grants, but that money cannot be used to match other federal monies . The above contribution money will go into the Traffic Development Fee fund initially but will have to be transfered to the Bridge Development Fee account at a later date to replace the FAU funds which will be used for the signal . He established the first Capital Improvement Program for the City as well as a computerized records management system. As you may know, the Atascadero Library, which was dedicated in May, 1988, was build jointly by the City of Atascadero and San Luis Obispo County, with Friends of the Atascadero Library participating. Q The responsibility for maintaining the library is now Qntirely the County' s under the direct supervision of Mr. Dale Perkins, County Library Director, and the indirect supervision of the County Board of Supervisors. Our present urgent problem concerns the number of days and hours the library is open for use by the library patrons. Under the present arrangement the library is open Tuesday and 'Wednsday from 10:00 a.m. to 8:00 p.m. ; on 'Thursday, Friday and Saturday the li- brary is open from 10:00 a.m. to 5:00 p.m. The library is closed on Monday. These hours were in :lace before the library moved to • new quarters. It was not satisfactory then. It is not at all satisfactory now. Box 747 Atascadero, CA 93423 Attention: Mr. Ray Windsor, City Manager Re: Proposed Government Center Dear Mr. Windsor: You have asked us for the position of the Atascadero Mutual Water Company with regard to the question as to whether the Water Company will serve the property which is presently under consideration by the County of San Luis • Obispo for use as the North County Government Center. The Water Company understands that this property is located outside the designated boundaries of the Water Company. As such, for the Water Company to make a determin- ation as to whether to serve this property, the Water Company must engage in a very complicated and expensive process which includes dealing with various governmental entities, attorneys and engineers. The Water Company has a number of constraints in dealing with such an issue which include its obligations to properties which it now serves, and obligations to properties located within its boundaries which the Water Company has an obligation to serve upon development in the future. The Water Company understands that the County is considering the total of five sites, one of which is the site referred to above. The Water Company believes that it does not make economic or practical sense to deal with the issue of serving a property outside of its boundaries until it is known that the property in question is the first choice of the County.
