City Manager 4 ` P R O C L A M A T I O N "Honoring the 75th Anniversary of the United States Naval Reserve" WHEREAS, the Naval Reserve Center (NAVRESCEN) , Santa Barbara, has diligently served the Naval Reservists of the area and pays tribute to the patriotism, pride and professionalism of our citizens; and WHEREAS, NAVRESCEN, Santa Barbara is recognized this day as the official site of the Commodore Robert Field Stockton Memorial- -a tribute to sailers; and WHEREAS, since 1896 , the Naval Reservists of Santa Barbara and the area have kept that Navy spirit and tradition alive for nearly 150 years; and • WHEREAS, NAVRESCEN, Santa Barbara, exists today as it did nearly half a century ago for the purpose of training our citizens for readiness--a tribute to freedom; and WHEREAS, the Naval Reserve Center has continued to prove its civic leadership with the open arms policy it has in support of the many schools and civic organizations that make use of the facili- ties; and WHEREAS, NAVRESCEN, Santa Barbara, is recognized as home of one of the most beautiful and exciting liberty ports on the west coast for our sailers; and WHEREAS, the Naval Reserve Center is recognized as a local and state historical treasure and should continue to serve the Naval Reservists as it has in the past. In accordance with the Surface Mining and Reclamation act of 1975 (SMARA) the DMG has conducted a resource classification of lands in the counties of San Luis Obispo and Santa Barbara that are threatened by uses which would be incompatible with or would preclude mining. The purpose of this study was to identify mineral deposits which will be needed by future generations and provide you • with an objective mineral resource data base to assist you in future local land-use decisions. Your jurisdiction is one of many selected by the State Mining and Geology Board (the Board) for mineral land classification. The completed report is titled "Special Report 162, Mineral Land Classification of Portland Cement Concrete Aggregate and Active Mines of All Other Mineral Commodities in the San Luis Obispo-Santa Barbara Production- Consumption Region. " Classification, under SMARA, is a geologic inventory of selected mineral commodities in a defined study region. Major objectives of a classification study are: 1) to identify the market area of the commodity 2) to project the future (50-year) need for the commodity within the study region 3) to geologically classify the lands within the study region as to the presence or absence of the commodity under study. The major mineral commodity selected for classification in San Luis Obispo and Santa Barbara counties is Portland cement concrete (P.C.C. ) aggregate. Besides P.C.C. aggregate, the study also identified all other active mines that have deposits of significance as defined by the State Mining and Geology Board. The report has been accepted by the State Mining and Geology Board and a copy was officially mailed to you by the Board on April 16, ! 1990. Within 12 months of this date you must, under SMARA and in • accordance with state policy, establish mineral resource management policies to be incorporated in your general plan which will: 1) Recognize mineral information classified by the State Geologist and transmitted to you by the Board. 2) Assist in the management of land use which affect areas containing significant aggregate resources. 3) Emphasize the conservation and development of identified aggregate mineral deposits. Prior to the adoption of the proposed mineral resource management policies, they must be submitted to the State Mining and Geology Board for review and comment. Nothing in the report or SMARA precludes your local land-use authority, and all decision making power remains in your hands. Costs incurred by local government in complying with SMARA may be recoverable under the provisions of SB 90 (Russell) , "State Mandated Local Programs". Following classification, the State Mining and Geology Board may choose to designate lands within your jurisdiction. Designation is the formal recognition by the Board of areas containing mineral • deposits of regional or statewide significance. The objective of the classification and designation process is to insure, through appropriate lead agency policies and procedures, that significant mineral deposits are available when needed. A-1 MINUTES ATASCADERO CITY COUNCIL MAY 8, 1990 The Mayor called the meeting to order at 7: 04 p .m. The Pledge of Allegiance was led by the Director of Public Works, Mr . Greg Luke. ROLL CALL: Present : Councilmembers Lilley, Mackey, Borgeson, Shiers and Mayor Dexter . Staff Present : Henry Engen, Community Development Director ; Grey Luke, Public Works Director ; Andy Takata, Director of Parks, Recreation and moo ; Art Montandon, City Attorney; Mark Joseph , Administrative Services Director ; • Lieutenant Bill Watton, Police Department ; Lisa Schicker , City Arborist and Lee Dayka, City Clerk . CITY COUNCIL COMMENTS: Councilman Lilley noted there were many present to watch Girl ' s Softball on the new Traffic Way Ballfields and thanked the Department of Parks and Recreation and the California Conservation Corps for their efforts. Councilwoman Borgeson reported that she had sent a memorandum to the City Manager asking him to contact CALTRANS regarding the "mutilation" of plantings along E1 Camino Real and added that CALTRANS also be asked to re-plant . Introduction of Stephen Hicks, New Building Official Henry Engen introduced Mr . Stephen Hicks as the new Building Official . Mr . Engen reported that Mr . Hicks has a degree from Cal Poly together with certifications from the International Conference of Building Officials , has had extensive private experience in construction and was formerly a building official for the City of Grover City. Mayor Dexter welcomed Mr . Hicks. • CC5/8/90 Page 1 Proclamations: Mayor Dexter read the following proclamations: "Peace Day" , May 20, 1990 "Head Start Month" , May, 1990 - Biz Steinberg , Executive Director of Head Start , accepted the proclamation. "National Nursing Home Week", May 13-190 1990 - Mayor Dexter explained that he would present the proclamation to nurses and staff at the Danish Convalescent Home on May 14, 1990. Mayor Dexter announced that one other proclamation, "Public Scrutiny of Unsafe Conditions at Atascadero State Hospital " , had been prepared and presented to him to be read . He called upon Jay Salter , Chairperson of the Associated Unions of Atascadero , who explained that this coalition of seven unions represents appro>timately 1 ,700 employees working at Atascadero State Hospital . Mr . Salter- read a prepared statement (see Exhibit A) regarding the hospital , its employees and present turmoil following the • recent murder of a much-loved employee at the hands of a patient . He explained that this incident has brought to the surface many concerns which the employees have felt about the safety conditions in the hospital . The spokesman asked the Council to adopt a resolution calling for legislative investigations into safety conditions at Atascadero State Hospital . Mayor Defter asked Mr . Salter to clarify whether it was a proclamation or a resolution that he was requesting ; to which he responded that it was a resolution he was seeking . The City Attorney advised that consideration of a resolution would have to be placed on a regular agenda for full Council discussion. By common consent , the item was scheduled for the next meeting of the Council . COMMUNITY FORUM: Marty Kudlac , 4740 Del Rio Road , acknowledged the on-going investigation regarding the problems Atascadero State Hospital is now facing and addressed excessive privileges of inmates stating that they are given too many rights. He indicated that he hoped the current study would point out where corrections are needed and added that staff have become the victims. Mayor Dexter thanked Mr . Kudlac and asked that further comments regarding this issue be held until the May 22, 1990 meeting . • CC5/e/90 Page 2 Larry Sherwin, 22755 Campc Road , congratulated Andv Takata and the Department of Parks and Recreation or, the completion of the Girl ' s Softball fields. MOTION: By Councilwoman Borgeson and seconded by Councilwoman Mackey to approve the Consent Calendar with the exception of Item #8; passed unanimously by roll call vote. Discussion followed : S. STATUS REPORT OF CREEKWAY MAPPING COMMITTEE - TIMEFRAME/ RESOURCES • Councilman Lilley referenced the Public Works Director ' s memo and asked if the Council was being asked for budgetary assistance in this project . Mr . Luke responded that the committee would be CC5/8/90 Page 3 � meeting again on May 17, 1990 and that at a later date, he would be better prepared to give a cost estimate and time schedule. By common consensus, Council accepted the Status Report . B. HEARINGS/APPEARANCES: 1 . RECONSIDERATION OF HERITAGE TREE REMOVAL REQUEST, 14400 EL MONTE (Ranallette) (Cont ' d from 4/10/90) Henry Engen gave staff report and background . He indicated that the applicants and their architect had readjusted the home, but that the trees were still in the footprint of the house. Lisa Schicker , City Arborist, responded to Council questions regarding the leach field , driveway and attempts made to re-design the home. Alfred Clarke, 7805 Santa Ynez , addressed the Council stating that he was the architect , was representing the Ranallettes and would be available to answer questions. Mayor Dexter commented that he himself lived in this neighborhood and expressed dissatisfaction with the lack of vehicular access to the back of his own lot . He noted that the Ranallette ' s home may have the same problem and suggested that the house or driveway be repositioned in such a way to allow better access. Mr . Clarke responded to the Mayor ' s comment and answered specific questions from Council with respect to the leach field and its ' 100 foot setback from the creek . Councilman Lilley asked the architect if, at the onset of designing this project , he had checked with the City as to conditions and procedures regarding trees. Mr . Clarke indicated that he, the engineer and the arborist were all keenly aware of the importance of the trees in this area and that prior to the design process, the only direction City staff had given the Ranallettes was a handout with a list of certified arborists. Discussion followed regarding the condition of the trees. Mr . Clarke reported that the arborist hired by the Ranallettes had not certified that the trees were dead and recommended removal with a 4 : 1 replacement . Mr . Clarke clarified that two smaller trees on the plan were not on site, but rather proposed . Councilwoman Mackey stated that the two heritage trees are an asset to the lot and cannot be replaced. Public Comment• Steve Casler , 14500 E1 Monte, opposed the homesite, location of the septic system and made suggestions for shifting the house. He offered to donate some of his land to the Ranallettes to CC5/8/90 Page 4 accommodate the leach field . Chris Lantzel from Sierra Madre explained that he owned adjoining property and stated that he could not see any reason why the Ranallettes would want to forfeit those trees. Dennis Bryant , 7410 Sombrilla, supported the applicants ' request and stated that homeowner ' s rights should prevail in this situation. Mr . Clarke, architect , addressed comments made by Mr . Casler and supported the data compiled by the engineer . He gave additional justification for the driveway turn-around and indicated that the Ranallettes had hired licensed contractors. Mr . Clarke added that the proposed plan was the third solution for the Ranallette ' s dream home. Lengthy Council discussion followed. Councilwoman Mackey stated that it was a beautiful lot , that the two trees were the only good ones on the lot and she could not vote to take them down. Councilman Lilley concurred with Ms. Mackey ' s comments, but alluded to the "short-sidedness" of the Tree Ordinance. He further stated that a pre-design consultation could have helped avoid the hardships endured by the Ranallettes but that the City cannot hold them accountable for the ordinance ' s short-comings. Councilman Shiers agreed that the request was tough to address. He stated that the purpose of the Tree Ordinance is to ensure sensitive design and that development should encourage preservation of trees . Mr . Shiers indicated that considering the open space that exists on the lot and Mr . Casler ' s offer to allow extension of the leach field onto his property, he would not be in support of the heritage tree removal . Councilwoman Borgeson ' s comments echoed those of Councilman Shiers and Councilwoman Mackey. Mayor Dexter expressed concern for neighborhood peace and reiterated his thoughts on vehicular access to the rear of the home. He stated that the applicants have fulfilled all the requirements asked of them and that he could not deny them the privilege to build their home , particularly with the recommendation of a 4: 1 replacement . Councilman Lilley indicated that , pending the adoption of the revised Tree Ordinance, Council has an obligation to direct staff to advise applicants that the Council will exercise its ' discretion to deny and urge applicants to consult with the City Arborist and the Planning Department prior to proceeding with design. Councilwoman Borgeson added that architects and arborists involved with building homes in this area must become CC5/9/90 Page 5 responsible and read the Tree Drdinance. MOTION: By Councilwoman Mackey and seconded by Councilwoman Borgeson to deny the request to remove two heritage trees; passed 3:2 with Councilman Lilley and Mayor Dexter opposing . Henry Engen confirmed that the applicants have the right to come back to the Planning Department with alternate plans. Mayor Dexter clarified that this action does _. not deny the applicants privilege to build on their lot . 2. TENTATIVE PARCEL MAP 22-139 APPEAL OF PLANNING COMMISSION DENIAL, 7900/8000 SANTA CRUZ (Long/Knowles) (Cont ' d from 3/27/90) Henry Engen gave staff background on this appeal indicating that staff ' s recommendation had been to approve, but that the Planning Commission had recommended denial . Councilwoman Mackey asked for the City Attorney ' s determination on the applicability of the ordinance with respect to determining average slope. Mr . Montandon advised that staff ' s interpretation of the ordinance was correct . Brief Council questions followed regarding lot size and flag lot findings. Henry Engen, reported that there would be no tree- taking or any new driveways proposed in this development . Public Comment : Alan Volbrecht , agent for the applicant , gave additional background information and comments to support the appeal . He stated that he had not been given specific reasons for the findings and believed the denial to be based more on feelings of dislike for the flag lot situation. Council discussion followed . Councilwoman Borgeson stated that she would find it hard to deny based on the City Attorney ' s determination. Councilman Lilley expressed his concern over "feelings vs. findings" at the Planning Commission level . Councilwoman Mackey commented that there were no trees being taken, the views are beautiful and that these lots are the best flags lots the City can get . Councilman Shiers stated that he shared the same concerns as Commission Lopez-Balbontin in that lots created would be smaller than the average size lot in the immediate neighborhood. Mayor Dexter concurred with other councilmembers by stating that he saw no real problem with project and although he was not normally in favor of flag lots, saw this one as an improvement . CC5/8/90 Page 6 MOTION: By Councilman Lilley and seconded by Councilwoman Mackey to approve TPM 22-89 and adopt the findings and conditions of approval as set forth in the staff report of February 20, 1990; passed 4 : 1 with Councilman Shiers voting against the appeal . 3. TENTATIVE PARCEL MAP 19-89 - APPEAL OF PLANNING COMMISSION DENIAL, 7675 BELLA VISTA (Gearhart/Sierra Pacific Engineer- ing ) Henry Engen gave staff report indicating that the Planning Commission had denied the lot split on April 3, 1994. He reported that Planning Commissioner Highland had filed an appeal and that staff ' s recommendation was to uphold the decision and deny the appeal . He noted public policy implications and asked Mr . Luke to expand upon his memorandum to Council . The Public Works Director gave additional staff recommendation to deny based on the condition of the road which he described as extremely substandard . He added that staff is working toward a universal road standard in the City, but that process has just begun and policy has not yet been established . Councilwoman Mackey asked the Public Works Director if the present lots could be built upon. Mr . Luke responded that the lots, as they stand , are buildable but that splitting the lot would aggravate an already bad situation. Councilwoman Mackey and Councilwoman Borgeson concurred that City policy seems to be inconsistent with regard to roads . Mayor Dexter agreed that policy, because of the rural nature of Atascadero , is indeed sometimes inconsistent . Lengthy discussion followed regarding substandard roads . Councilwoman Borgeson referred back to Mr . Luke ' s memorandum and implied that the grounds for denial of the lot split are based on more than just the road. Councilman Lilley stated that he was uncomfortable with the Commissions ' s findings for denial and recommended referring the matter back to the Planning Commission for their focus on land use issues, separate from the road policy. Public Comments : George Highland , 7275 Carmelita Road , stated that his appeal was based on procedural grounds and that the minutes and tapes from the Planning Commission meeting would indicate that staff • concerns were not considered . He added that the Commission became consumed with the road situation and urged Council to send CC5/e/90 Page 7 the matter back to the Planning Commission. Bob Nimmo , 7375 Bella Vista, stated that it was his understanding that Bella Vista Road was an adopted City street and is maintained by the City. He exclaimed that the if the street is as unsafe as suggested by Mr . Luke, then the City has a responsibility to do something with regard to the road . Mr . Nimmo referred to the road standard recently adopted by the City and warned against staff creating policy by determining that those standards be retroactive. He stated that he had no particular feeling one way or another on this lot split request and added that the potential for lot splits in the area is very limited. Tom Bench , 7503 Carmelita, stated that he did not have any objections to the lot split or any comments on the road issue, but noted that he believed one of the lots to be non-conforming . Mr . Bench stated that he did object , however , to the fact that a planning commissioner does not have to pay an appeal fee and can use position to get items to Council . Michael Sherer , 8405 Alta Vista, spoke in support of the lot split and stated that he believed it to meet the criteria of the Zoning Ordinance and the General Plan. He stated that he was willing to improve that portion of Bella Vista to new City standards, but that the existing road is city-maintained . He added that the Planning Department has given its ' approval and urged Council for approval . George Highland , adding to his previous comments, referred to a 1999 court decision regarding municipalities and the maintenance of roads within its ' jurisdiction. Additional Council discussion followed regarding other lot splits and the cumulative impact on the area and road . Councilman Lilley stated that he was uncomfortable with adopting findings that he believed to be deficient . Tentative Parcel Map 26-89 - Approving Findings and Conditions of Approval for Tentative Parcel Map The Community Development Director summarized the request giving recommendation to approve. Mr . Engen added that the reason a zoning change is required is that the lots proposed are less than 1/2 acre and that the tentative map cannot go forward unless the ordinance is approved to allow for the smaller lots. He noted that the Planning Commission had added a condition of approval restricting the development of the lofts into bedrooms. Mr . Engen responded to Council questions regarding trees, setbacks, staff calculations and traffic concerns. Mayor Dexter stated , if approved , density would actually be reduced . The architect , Richard Mitsuoka, gave support for the planned unit development (PUD) and reiterated that the project does not meet strict criteria of affordable housing . Public Comment : Charles Voorhis, owner/applicant , spoke in favor of the request and asked Council for their approval . Lengthy Council discussion followed . Councilwoman Borgeson voiced apprehension stating that the concept of the PUD is to provide amenities in exchange for smaller lots. She added that she believed this project would increase the density and that the homes would not be affordable. CC5/B/90 Page 9 Councilman Lilley debated that PUD ' s should not be competing with single family houses and that the PUD is a land use device, not a bargaining unit . Mr . Lilley also stated his concern for the possibility of the loft being turned into a bedroom, but acknowledged that the City does not have an ordinance addressing that issue. Council concurred that there is a need for policy determination of minimum lot size for PUD ' s. Councilwoman Mackey commented that the lots were small and that children need a place to play, but indicated she would vote for this project because there was no current policy. Councilman Shiers stated that although he felt a mix of PUD ' s, condos and apartments was good, he was concerned over the density standards. He suggested to staff that when a loft is proposed , that it overlook the living room allowing it to remain a loft only without the potential of being converted into a bedroom. Luke responded that the drainage area and the creek have been subject to study by FEMA (Federal Emergency Management Administration) . I 'm the chairperson of the Associated Unions of Atascaaero wnicn is a coalition of the seven unions representing nearly 1700 employees working at Atascadero State Hospital. I 'm here, tonight, as the spokesperson for these employees wno need your help and support. But beiare 1 tell you why they need your help -- and now you can help -- let me say something about Atascadero State Hospital and the people who work there. I like to think of the hospital and the job we do there as a measure of the moral character of our society. 1 believe that societies are judged in large part by the way they care ior their worst outcasts. The people we care +or at Atascadero Hospital are some of the most damned, cursed, doomed and loathed people our society is able to produce. Very +ew citizens care to even think about them. Some would simply cast them into the void. But they are human beings alter all. Ana ii we want to call ourselves a decent, civil society, then we must care -tor these doomed people in a decent, humane fashion-- and in a decent humane setting. Atascadero State Hospital is that humane setting. And its stair are those decent, humane care givers. In short, they are heron, because their dedication to the di++icult and dangerous work they do helps keep us all civilized. Now let me talk about now you can help us. As you know, the hospital has been experiencing considerable turmoil following the recent murder of a much loved employee at the hands of a patient. This incident has brought to the surface many, many concerns which the employees have ions felt about safety conditions in the hospital. The great majority of these concerns are legitimate. And, in the main, they focus on lack: of enough trained staff to provide effective therapy. Lack of enough staff to handle the mountains of Paperwork: the hospital now generates. Lack of enough staff to provide the necessary security that 'Keeps the Place safe, therapeutic, and business-lit::e. And 'lack_ of enough engineers, food service workers and maintenance People to 'Keep it a humane setting. This lack: of staff is a direct result of insufficient budgeting for the state hospital system. - - By its budget-making decisions, the legislature says, in effect: "There isn 't enough money_ to make the hospital safe. There's only enough money to make it appear to be safe. Well, the recent murder has stripped away the appearance. The hospital isn 't safe. We. who live in this community now know that. Leaders of all of the seven unions have pone to Sacramento time • and time again to testify about safety conditions before the legislature and to ask for more staff. invariably, we have been turned away empty handed. So, what is to be done? Well, we 've decided to follow a new game plan. We have decided to return to basics. instead of startlnq at the top in this process of getting money from the legislature, we've decided to begin at the bottom -- at the crass roots. We know that the legislature is influenced by voters. And we 'Know that if the voters understand what is going on at Atascadero State Hospital, they will respond and support their legislators when they risk voting for increased funds for Atascadero Hospital . We begin our program to build voter awareness here toni4_ht. We are asking you, members of the City Council , to lay the foundation for a groundswell of support for more staff at Atascadero. if we get your support, we will then move to Faso Robles City Council. It should not, however, be adopted into the General Plan except as recommendations at this point. Much more work on specific issues must be done before it is locked into stone. It is recommended that a Task Force be immediately appointed with a city staff member assigned as coordinator liaison. The Task Force should con- sist of representatives from the following : Business Improvement Assoc . , Chamber of Commerce, a business owner •• not representative of the BIA, a business property owner, and a member at large not affiliated with any organization and has no business or financial interest in the downtown area. We believe that establishment of the Task Force to be the number one priority. Circulation Improvements It is recognized that the recommended improvements listed and prioritized on page 40 are of the utmost importance. Most of the unwanted downtown traffic cannot be eliminated without highway 41 relocation and highway 101 Traffic Way ramp improve- ments . Parking Plan 1 . Entrada Avenue On Street Parking. This seems reasonable as little else seems possible at this time. 2 . Traffic Way Parking Lot This should be completed quickly to show that something is being accomplished and encourage other projects. 3 . Mid-Block Parking Lots These areas should provide the best showcase for a PARKING IMPROVEMENT DISTRICT! A parking district would enable the (cont` d) PAGE TWO selling of bonds to turn these open areas to landscaped parking zones. The district could also provide funds to restructure the rear of these businesses as a "second front" of the stores , so as to add .to the convenience of shoppers . Also could provide funds for signing on street entrance to let people know where parking is ! 4 . Lewis Avenue Parking We disagree to the purpose of acquiring parking this far from most businesses unless the underlying reason is to provide parking for overflow city and fire department employee parking. 5 . Revised Downtown Parking Standards We state the remarks of an Atascadero business owner which we believe accurately reflects the problem and proposes a solution: "In my opinion, to say these are reduced standards is to say "Dr. Gobbels" was the tooth fairy! First, most of the downtown buildings have no or little parking other than street parking. Most of the old buildings along El Camino Real have almost no parking on site. As an example, I owned at one time, 5800 El Camino Real , 3000 square feet of building. It has been a dry goods store, a sporting goods store, a bank, a T.V. Video Store, and lately , an antique store. It is now vacant, and for sale or lease. Under this downtown parking requirement, ten (10) car spaces will be required to open it for retail business . It has no legal parking. Three stack parking spots are in a dirt alley alongside the building that will not pass code! There is no parking available anywhere near. The market refuses to share parking as he needs it all for his market and office upstairs . This same problem exists up and down El Camino Real in the downtown center, and both sides of the street. The only way to allow these buildings to stay viable is to create parking districts and access the entire area to pay to create parking that will adequately service their businesses . " The fill in of the small vacant lots in the C.B .D. cannot even be considered until parking requirements are mitigated. To impose these parking requirements, as proposed, will keep most stores empty when they change owners or tenants. (cont 'd) PAGE THREE 6 . Signage Signage and parking are very important to the vitality of downtown and must be addressed specifically early on. The requirements as presented in the Master Plan are entirely too restrictive. This would serve to further stifle downtown business . The signage portion of the plan should be a high priority of the task force particulary that which deals with freeway signage. The Chamber recognizes that many of the downtown improvements cannot be accomplished without a funding mechanism. We recommend that the already established Redevelopment Agency be activated to determine a study area for project consideration as soon as possible. In conclusion : One of the few incentives the city can provide to downtown revitalization is to make a commitment to downtown by adopting a long range capital improvements program to include a govern- ment center to meet the needs of "a city of 32, 000. If- we continue to disperse to other areas on an expediency basis , such as been done with the Police Dept. and Library , there will never be a centralized downtown. However, caution must be exercised in it's implementation. The plan as presented is very complicated; not only doe it affect the vitality of the downtown, but it affects the lives of the many individuals who depend on the downtown for their livlihood and survival The BIA recommends that the plan be accepted in concept as presented; that the Council immediately appoint the suggested Downtown Task Force and that they hire the suggested full-time Downtown Coordinator as soon as possible. The Task Force should consist of the following: o The Downtown Coordinator o A BIA Representative o A Chamber of Commerce Representative o A downtown business owner who is not active in the BIA . o A downtown business property owner o A citizen of the city who has no business, financial or political interest in the downtown The Task Force should then be charged with the responsibility of implementing the various segments of the plan through the Planning Commission and City Council. Specific areas of immediate concern with the proposed plan are sign and parking requirements. They are too restrictive as presented. The lifeblood of a small business is advertising and promotion. Signs are a critical part of a business' ability to attract customers. Atascadero as a city does not attract customers; so it is very critical that businesses be given every opportunity to attract customers through signs. Atascadero is not a tourist attraction; therefore, a pedestrian oriented downtown with restricted signs will not be beneficial to the local business person until such time as the City takes the necessary steps to make Atascadero a tourist attraction. Freeway sign requirements in particular need additional thought and consideration. Parking requirements as presented in the plan are far too restrictive and prohibit new business from opening in the Downtown area which in turn affects the general vitality of the area. We should follow San Luis Obispo's lead by establishing a system of in-lieu fees. Downtown San Luis Obispo managed to survive nicely with less than required parking until they were able to solve their problem by building parking garages. In conclusion, caution must be exercised in the implementation of any plan. Not only should Atascadero be a good place to live, but it should be a good place to do business and to earn a living. We must be careful not to be too theoretical or academic. Environmental Status. . . . . . . . .Negative Declaration posted April 10, 1990 ANALYSIS: The application before the Commission proposes to subdivide two existing lots containing a total of 17. 19 acres into three lots containing approximately 5.7 acres each. Some mention of the history of this case is first warranted to establish a foundation for the current proposal. An application for subdivision at this site was first submitted August 19, 1989 (Exhibit F) . At that time several factors, among them being the proposed house • location and grading that would be required (especially on proposed lot 2) prompted staff to recommend a denial of the . application. The applicant' s representative then requested a continuance of the Planning Commission meeting to explore other alternatives in the design of the subdivision. A second proposal was submitted on February 7, 1990 proposing a different lot configuration and house location for parcel 2, however, staff again advised the applicant that a recommendation for denial was likely, based on excessive grading that would be required to facilitate future construction (Exhibits G, H) . The current submittal was received on April 3, 1990 and proposes a return to the lot configuration originally proposed, however a new house site is proposed for Lot 2. The General Plan designation for this site is Suburban Single Family and the Zone designation is RS (Residential Suburban) . The property is currently vacant, however an easement exists for a PG&E gas line that traverses proposed lots 2 and 3 in a southwest-northeast direction. Minimum lot size in the RS zone is 2. 5 to 10 acres depending upon the minimum lot size determination using performance standards established by the Atascadero Zoning Ordinance. Staff has determined that the minimum lot size for this site is 4. 53 acres. Lot size factor Distance from Center (20, 000'+) 0. 90 Septic Suitability (55. 6 min/inch avg. ) 1. 00 Average Slope (26-30 %) 1. 25 Access Condition (Paved road, <15% slope) 0. 40 General neighborhood character (4. 90 acres) 0. 98 Minimum lot size. . . . . . . . . . . . . . . . . . . . . . . . . . . . . 4.53 acres The proposed lot size of 5. 7 acres meets the minimum lot size requirement under the Residential Suburban zone. The septic suitability of the site is approximately 56 min/inch and is classified as "slow" ; engineered septic systems would be required. Additionally, approval of the Regional Water Quality Control Board would be necessary for at least one system (proposed on slopes in excess of 30%) . Although staff has, in the past, recommended against creation of lots with this situation, in this case the proposed building and leachfield location represents the only practical building site on existing Lot 11. Another concern related to this case is that the depth to width ratio of the proposed lots exceeds 3 to 1 as mandated by the Atascadero Subdivision Ordinance. Section 11-8. 206 of the Ordinance states: "Lots with a ratio of depth to width greater than three shall not be permitted unless there is adequate assurance that deep lot subdivision will not occur or that deep lot subdivision and subsequent development will be accomplished without detriment to adjacent properties. " To authorize an exemption from this standard the City Council must make the following findings based upon recommendation by the Planning Commission: 1. That the property to be divided is of such size or shape, or is affected by such topographic conditions, that it is impossible, impractical or undesirable, in the particular case, to conform to the strict application of the regulations codified in this title; and 2 That the cost to the subdivider of strict or literal compliance with the regulations is not the sole reason for granting the modification; and, 3. That the modification will not be detrimental to the public health, safety and welfare, or be injurious to other properties in the vicinity; and, 4. That granting the modification is in accord with the intent and purposes of these regulations, and is consistent with the General Plan and with all applicable specific plans or other plans of the City. Staff feels that these findings can be made; the minimum allowed lot size at the site dicates that further lot splits are not possible (without general plan and zone district changes) . Furthermore, the proposed homesites are along Santa Ana and Garcero Roads and slopes on the rear, or southerly portions of the lots propose a formidable barrier to development in those areas. Finally, staff has proposed the establishment of a scenic easement on the lower one-half of the lots to preserve this area (Exhibit E) . Another issue of importance is that of fire protection. Because of the distance from existing fire stations, the City fire chief is requiring as a condition of approval, the installation of full coverage residential fire systems in future residences. The major concern of this case involves the actual revision of the parcel map from earlier designs. This proposal essentially boils down to the creation of a third building site on the two existing lots. Staff believes that the revision in the location of the proposed homesite (on lot 2) presents a much more workable solution for the development of the site. The proposed house site on lot 2 has been moved out of the swale up to the required • 50 foot CC&R setback and adjacent to the PG&E easement. Driveway grading plans presented by the applicant indicate that grading would be significantly reduced, in comparison to previous proposals (Exhibit D) . As a condition of approval, staff is recommending that the proposed house sites shown on the tentative map be shown on the final map with notations restricting future building to these locations. Furthermore, Precise Plan review would likely be required when construction is proposed, which would afford staff the opportunity for further review (and possible reduction) of proposed grading. A final issue concerns the downslope portion of the lots, consisting of steep slopes cloaked with heavy oak cover. As previously mentioned, staff is proposing that a scenic easement be established, covering roughly the lower one-half of the site (Exhibit E) to assure preservation of this area This project has been reviewed by the City' s Fire Department and the Engineering Division of the Public Works Department. Both Departments have provided recommended conditions of approval which are included in Exhibit J. With these conditions, neither Department has any objection to the approval of the proposed subdivision. CONCLUSIONS: Staff feels that this latest proposal can be looked upon favorably. Negotiation with the applicant has resulted in a proposal that is more sensitive to the site than previous design submittals. The required findings can be made to allow for an exemption from the lot width to depth ratio specified in the City' s Subdivision ordinance. No detrimental effects should occur as a result of the exemption. Finally, staff believes that the design of the proposed subdivision is in conformance with the City' s General Plan and Zoning ordinance. The modification will not be detrimental to the public health, safety and welfare, or be injurious to other properties in the vicinity. 5. Granting the modification is in accord with the intent and purposes of these regulations, and is consistent with the General Plan and with all applicable specific plans or other plans of the City. TENTATIVE PARCEL MAP 20-89 : Application filed by Atascadero Highlands (Volbrecht Surveys) for subdivision of two existing lots of 17 . 19 acres into three lots containing approximately 5 .7 acres each. Subject site is located at 14205 Santa Ana Road and 9800/9850 Garcero Road. Karl Schoettler presented the staff report and summarized the background of a previous submittal for this map. Staff is, recommending approval subject to 11 conditions . Commission questions and discussion followed. Commissioner Highland said it was his understanding that the Water Quality Control Board does not grant exemptions for leach fields on 30% or greater slopes. Mr. DeCamp replied that the WQCB requires their review and approval before granting any permit on slopes over 30;. He stressed that the only lot that would be affected by WQCB' s requirements is one MINUTES EXCERPT - PLANNING COMMISSION - MAY 15, 1990 PAGE TWO that already exists and would be subject to these requirements regardless of whether the subdivision if approved or not. In response to question from Commissioner Luna, Mr. DeCamp explained that the third lot which would result from this subdivision would not be subject to WQCB' s requirements . Commisioner Lopez-Balbontin inquired how the septic suitability is established. Alan Volbrecht, agent for the applicant, thanked staff for their efforts in working with this application which has been an 8 month process . He expressed concern with condition ##4a (road improvements for Santa Ana Road) . He pointed out the lots are unique in that they have double frontage. It was the applicant' s intent to build out Garcero Road only since it has the best access to the three building sites . He asked that ##4a be deleted. He then responded to questions from the Commission. Mr. Sims addressed condition ##4a stating it was the intent to have some shoulder work completed and possibly hydroseeding slopes that have been recently graded there. He commented he would like to see some minor improvements along the existing road frontage to control drainage and prevent future erosion. Discussion followed. Mr. Volbrecht noted that the applicant would be willing to work with Engineering in mitigating those concerns. Commissioner Highland commented on the 2 1/2 to 10 acre zoning in this area noting the General Plan' s concept that the lots would get larger as they got near the edge of the Colony, yet the lot sizes seem to be getting smaller. He asked when there will be ten acre lot sizes . Mr. DeCamp commented that the Zoning Ordinance is fairly well crafted in that it responds to changes in community and neighborhood, and it is the existence of the smaller lots in the subject area (some of which are original Colony lots ) that drive the lot size down to the 5 acre size. Commissioner Luna stated that he has previously calculated maximum lot size with the performance factors, and 8 . 15 acres seems to be about the largest lot size. Discussion continued. Commissioner Hanauer noted that as land costs continue to rise, the lot size will be become smaller. Commissioner Brasher concurred. The works of improvement and maintenance performed within Maintenance District 86-3 shall be performed pursuant to law, and the County Auditor shall enter on the County Assessment Roll , the amount of the assessment , and said assessment shall then be collected at the same time and in the same manner as the County taxes are collected. After collection by said County, the net amount of the assessment shall be paid to the City Treasurer of the City . Section 5 The City Treasurer shall place all monies collected by the Tax Collector into the special fund known as "City of Atascadero Maintenance District 86-3 Aguila Avenue" pursuant to the provisions of this resolution and law, and said transfer shall be made and accomplished as soon as said monies have been made available to the City Treasurer . BACKGROUND: The conditions of approval for Parcel Map 44-87 (Russ Johnson, 1909 Traffic Way, February 16, 1988) included the following • requirement. 7.a. "Obispo Road: Design shall meet all City development standards for a Private Road 16 ' -0" wide paved surface with 2'-0" shoulders. Plans shall include measure to preserve and protect existing trees on the site and in the Public right-of-way, as approved by the Community Development and Public Works Departments. " Since this condition was applied the City has adopted minimum road standards for the construction of new roads. This section of Obispo road is currently under construction in conjunction with a neighboring project. DISCUSSION: The Department of Public Works is recommending that the City participate in the construction of Obispo road for the following reasons. 1. There is no way that the City can impose the requirement to construct the extra four feet of road width on the Developer because the conditions for this project have already been adopted. • 2. The completion of Obispo Road is important for circulation. 3. A 16 foot wide paved surface is clearly too narrow for two way traffic. It is not recommended that the City allow the construction of a substandard new road if it can be avoided. 4. To participate in a private construction project, administered by the developer, is likely to be cheaper than having the City contract for the widening at a later date. The construction contractor is already working at the site. 5. The newly constructed section of road, if widened to 20 feet, will be eligible to become a "City maintained" road. It should be noted that the current policy for the conditioning of new roads requires the developer to construct the full road section according to the City' s minimum road standards, except where the opposite side of the road has already been constructed. FISCAL IMPACT: Mr. Russ Johnson received two separate bids for the road construction along his frontage. Each bid delineates the difference in cost between building a 16 foot road with two foot wide shoulders compared to a 20 foot road that would meet the City' s minimum road standard. WHEREAS, the City Council approved Owners' Parcel Map No. AT87-261 on February 6, 1988 for real property on Obispo Road; and WHEREAS, the original map was conditioned upon the installation of a sixteen foot (161 ) wide paved roadway which has yet to be constructed; and WHEREAS, it has been subsequently determined by City that a i twenty foot (201 ) wide road would enhance the traffic safety of the roadway; and WHEREAS, Owners have solicited bids for the proposed construction and received responsible bids; NOW, THEREFORE, in consideration of the covenants and conditions contained in this Agreement, City and Owners mutually agree as follows: 1. BACKGROUND: In 1986 the City Council initiated the process of securing Federal grant money under the Federal Highway Administration Bridge Replacement Program for the replacement of Sycamore Road bridge across Atascadero Creek. For the Atascadero area the Bridge Replacement Program is administered through the California Department of Transportation' s District 05 office in San Luis Obispo and the Division of Structures in Sacramento. John L. Wallace & Associates, located in San Luis Obispo, is the design consultant for this project and Moore & Taber, located in Bakersfield, is the geotechnical consultant. DISCUSSION: The City currently has a State approved construction administration plan that obligates the City to hire an experienced bridge construction inspector to oversee the daily construction activity. The Department of Public Works is proposing that John Grindstaff from Bakersfield be hired as a contract employee to serve as the City' s inspector. Gary Sims , the City' s senior engineer, will be the resident engineer for the project. The City of Atascadero has received authorization from the District 05 Office to bid this project. Once the bids have been received, the City must first obtain approval from Caltrans to award the project for construction. It is the Department of Public Work' s intent to advertise this project for a 21 day period rather than a 30 day period. The shorter bid time is recommended because it allows the contractor additional construction time prior to October 31, when the State Department of Fish and Game requires the termination of construction activities in Atascadero Creek. We are requesting that the City Manager be authorized to execute additional agreements with the State or the Federal Highway Administration as necessary in order to avoid delays prior to the award of the contract.
