This agenda is prepared and posted pursuant to the require- ments of Government Code Section 54954 . 2 . By listing a topic on this agenda, the City Council has expressed its intent to discuss and act on each item. In addition to any action identified in the brief general description of each item, the action that may be taken shall include: A referral to staff with specific requests for information; continuance; specific direction to staff con- cerning the policy or mission of the item; discontinuance of consideration; authorizationto enter into negotiations and exe- cute agreements pertaining to the item; adoption or approval; and, disapproval . Copies of the staff reports or other documentation relating to each item of business referred to or. the agenda are on file in the office of the City Clerk, available for public inspection during City Hall business hours . The City Clerk 'will answer any questions regarding the agenda. RULES OF PUBLIC PARTICIPATION: * Members of the audience may speak on any item on the agenda. MOTION: By Councilwoman Borgescn and seconded by Councilman Mimmo to continue the minutes of the City Council meeting of June 12, 1990; all voted in favor . Discussion of the following Consent Calendar items was as (allows: CC6/26/90 Page 4 5. ACCEPTANCE OF FYBB-89 FINANCIAL AUDIT Councilman,. Shiers reported that he had pulled this item to specifically note that the auditor ' s had given a much improved write up from previous_ year . He reported that in 1999, Council had approved a new position, assistant Finance Director and added that the hiring of Rudy Hernandez appears to have paid off. Councilman Shiers quoted a portion of the staff report giving credit to Mr . Hernandez and noted that he was impressed and pleased with the audit . Mark Joseph also commended Mr . Hernandez for a ,lob well done. Mr . Joseph added that if Council so desired , he could have the auditors make a presentation at the next meeting . Mayor Lilley commented that he was happy to see the City get such an excellent report card . Mayor Lilley recognized and acknowledged former City Treasurer , Sere Sittach , by thanking him for his service and wishing him well . Mr . Sibbach thanked the Council for their confidence and -voted that it was a pleasure to have worked with Councilwoman Mackey. 7. TENTATIVE PARCEL MAP 2-87, 9384 VISTA BONITA - Consideration of time extension (Metchik/Cental Coast Engineering) Councilman Nimmo stated that he had requested this item be pulled from the Consent Calendar because he had , at one time, been an owner of this property. He clarified that while the property had been sold in October of 1999, he did still retain a trust deed interest in the property. Mr . Nimmo stepped down from discussion on this item. The City Attorney concurred with this action. MOTION: By Councilman Dexter and seconded by Councilman Shiers to accept time extension for TPM 2-99 to April 26, 1991 ; motion carried 4 :0 MOTION: By Councilman Shiers and seconded by Mayor Lilley to accept the Audit findings for the Fiscal Year ending June 3 30, 1999; motion unanimously carried by voice vote. 8. TENTATIVE PARCEL MAP 4-90, 4400 OBISPO ROAD - Division of one 10.53 acre parcel into two lots of 4.00 and 6.53 acres (Brimfield/Cuesta Engineering) Mr . Engen noted that Condition No . 5 of Exhibit H had been modified by the Planning Commission at suggestion by staff. He ..06,'26,'90 Page 5 e:<piained that the phrase that states " . . .and a 100% Labor and "iatei-ial Bond" had been deleted , but that the City Attorney had advised against the deletion. Mr . Engen recommended restoration of the lariguaee and indicated that the engineer for the applicant did not have a problem with this action. MOTION: By Councilman Shiers and seconded by Councilman Dexter to approve TPM 4-9C restoring language originally deleted ; unanimously passed . 14. RESOLUTION NO. 74-40 - AUTHORIZING THE MAYOR TO EXECUTE PROGRAM SUPPLEMENT NO. 008 TO LOCAL AGENCY/STATE AGREEMENT No. 05-5423 - GARCIA ROAD BRIDGE REPLACEMENT PROJECT OVER A TRIBUTARY OF GRAVES CREEK Mr . Luke gave background and staff report . He indicated that the Z).eliminary engineering has been completed and the City is ready to enter- into a contract with CALTRANS for a 80/20 cost sharing arrangement to proceed with the design and construction of the nl` dge. He sated that It is well and appropriate for the neighbors to have an opportunity to speak to the subject . tMayor Lilley asked the Public Works Director how much choice the City has in the design of bridges of this type. Mr . Luke explained that CALTRANS is in the business of building bridges and staff has very little exercise of authority. Pub i i z Comment Lee Bradley, 3.36.5 Garcia Road , stated that he has over 300 feet of rros-tage along the road , which will be affected the construction of the bridge. He acknowledged the need for the replacement , but voiced conger-n for the proposed height of the bridge. Mr . Bradley indicated that the bridge would be 18" above his driveway which may cause drainage problems on his property. In addition, Mr . Bradley spoke with concern for the proposed removal of five trees and speed/traffic control . He asked Council to come out and see the situation. Mr . Lul:e answered specific questions regarding recommended speed in the area of the bridge. There was Council concurrence that there was a need for a citizen committee to address the concerns and act as a liaison between the City and CALTRANS would be appropriate. Mayor Lilley asked Mr . Luke to approach CALTRANS regarding citizen input for mitigation. CCb/26/90 Page 6 The City !Manager- advised that Council should move ahead with the resolution in order to keep the relationship ocing with CALTRANS . MOTION: By Councilman Dexter and seconded by Councilwoman Borgeson to adapt Resolution No . '74-90 authorising the Mayor to execute Program Supplement No . 009 to Local Agency/State Agreement No . 05-5425, Garcia Road Bridge Replacement Project ; motion carried 5:0 by roll call . The City Manager asked Mr . Bradley to leave knowing that the City will be back in touch with him and that staff has been directed to address his concerns . B. HEARINGS/APPEARANCES: 1 . APPEAL OF PLANNING COMMISSION'S RECOMMENDATION FOR DENIAL OF DIVISION OF ONE PARCEL CONTAINING APPROXIMATELY 3.4 ACRES INTO TWO LOTS CONTAINING 1 . 1 AND 2.3 ACRES EACH AT 7503 CARMELITA - THOMAS BENCH (Cont 'd from 4/24/90) Henry tngen noted that staff had requested a continuance on this ;tem, but after reviewing the various alternatives was recommending going ahead with the appeal . Mayor Lilley asked the applicant , Mr . Bench , if he was prepared to proceed with the appeal . He stated that r;e was . The Community Development Director Gave staff ,`ecr"t giving background and outlining the characteristics or the ,property. Mr . Engen reported that the Planning Comrrtissiori h-gid --ecommer;ded denial and summarised the concerns to be proximity to the creek , 3: 1 depth to width ratio of proposed parcel number two , and, appropriateness of the land to be subdivided for an additional single family home site. in addition, he reported that the site was not suitable for the proposed density of development and that the design would impede ' upon the recreational easement on the property. Mr . Engen gave a status report on the work completed so far by the Creekway Mapping Committee, and indicated that information on Mr . Bench ' s prcperty is not yet available. Concluding his report , Mr . Engen outlined alternatives and answered questions from Council . Councilman Shiers referrer.' to testimony from Planning Commission minutes relating to the creation of a flag lot if subdivision was granted . CITY COUNCIL COMMENT: . Mayor Lilley stated that , upon further reflection, it was in the best interest of the City and the City Council that Councilwoman Borge=_on act as the representative to the San Luis Obispo County Area Coordinating Council . He noted a need for continuity, commitment and thorough knowledge of the ongoing matters of SLOACC and stated that as Mayor he would work with other mayors in an effort to support the work of SLOACC. Mayor Lilley related that Councilwoman Borgeson had graciously accepted the appointment and confirmed that Councilman Shiers would act as alternate. Henry Engen introduced Gary {kaiser as the newly-hired Assistant Planner . Mayor Lilley extended welcome on behalf of the Council . UNION (CLERICAL) FOR FY1991-FY1993 Councilwoman Borgeson asked for clarification on Item #8-A, the City Treasurer pulled Item #5 and the City Clerk asked that the Minutes of the June 26, 1990 meeting be continued ( Item #2) . Ken Waage, 7450 Balboa, asked if the proposed stops on San Anselmo Road at Monterey Road were on the Consent Calendar . Mayor Lilley stated that the matter was listed as Item #11 and asked Mr . Waage if he wanted to pull it . Mr . Waage said that he did not wish to address it indicating support of the resolution designating those stop signs. • MOTION: By Councilman Nimmo and seconded by Councilman Dexter to approve the Consent Calendar with the exceptions of Items #2, 5 and B-A. Motion carried 5:0. MOTION: By Councilman Dexter and seconded by Councilman Nimmo to continue the minutes of June 26, 1990; motion unanimously passed . Discussion of the following items ensued : 5. RESOLUTION NO. 93-90 - ADOPTING ANNUAL APPROPRIATION FOR FY1990-91 The City Treasurer asked the Administrative Services Director for clarification on some of the figures. Mayor Lilley asked that the Treasurer avail herself of the opportunity to discuss with the Finance Director discrepancies before the matter comes before the Council . He noted that the City was currently operating under an interim resolution and proposed that Council proceed with adoption of the resolution. Additionally, the requested that Mr . Joseph report back to Council on the specific issues raised by the Treasurer . CC7/ 10/90 Page 3 4 : MOTION: By Councilwoman Borgeson and seconded by Councilman Shiers to adopt Resolution No . 9=-90 ' with provision that the Finance Director will report back to Council at the next City Council meeting ; unanimously passed by roll call vote. B. ESTABLISHMENT OF VARIOUS STOP INTERSECTIONS: A. RESOLUTION NO. 77-90 - TRAFFIC WAY a CITY YARD Councilwoman Borgeson questioned the wording in Resolution No . 77-90 and suggested that the words "exit of" ( the City Yard ) be substituted for the words, "entrance of" ( the City Yard ) . Council and the Public Works Director were in concurrence of the suggested amendment and the following motion was made: MOTION: By Councilwoman Borgeson and seconded by Councilman Shiers to adopt Resolution No . 77-90 as amended ; motion carried . B. HEARINGS/APPEARANCES: 1 . TREE REMOVAL HEARING: A. INTERIM TREE REPLACEMENT STANDARDS (See Item C-2) • Henry Engen gave background and staff report with the recommendation to accept a base replacement ratio of two for one same species, 15 gallon planted and maintained tree; or an " in lieu" contribution of $200 per tree. The City Arborist , Lisa Schicker availed herself for questions. Public Comments : Eric Greening , 7375 Valle, expressed concern about timing for re- planting asking that applicants be encouraged to plant in the fall season. Jim Patterson, 9312 N. Santa Margarita Road in Atascadero , stated that he had polled a number of local landscape maintenance workers and indicated that tree replacements costs range from $250 to $1 ,000. He urged Council to take into account these costs adding that the $200 figure is still too low. George Luna, 100600 San Marcos, questioned the use of the word , "base" in the staff recommendation stating that if $200 is a minimum amount, how will additional value be determined . CC7/10/90 Page 4 Virginia Powers, 7505 Carmelita , read a prepared statement ( see Exhibit A) stressing that the T-200 cost per tree is too low. !=red Frank , 5615 Ardilla, asked what the objective was of the proposed interim policy. He stated that if it is to promote the objectives of the Tree Ordinance, flexibility is needed . Discussion came back to Council . Councilman Nimmo reiterated that his initial intent of asking for an interim policy was to bring fairness and consistency; and made the following motion: MOTION: By Councilman Nimmo and seconded by Councilman Dexter to accept the staff recommendation of a 2: 1 replacement or $200 per tree; motion unanimously carried . H. HERITAGE TREE REMOVAL REQUEST - GARCIA ROAD EXTENSION ( Cont ' d from 6/26/90) Henry Engen summarized this request and gave staff recommendation to approve the removals and accept the applicants ' proposal to donate to the Tree Replacement Fund in an amount of up to $15,000. Lisa Schicker answered Council questions regarding possible road location adjustments which may save additional trees. Ms. • Schicker indicated that these modifications would be made on-site as in-field work changes with the Public Works Director overseeing those adjustments . Mr . Luke reported that his department could accommodate minor adjustments, asserting that preservation of the minimum road standards would be maintained . He added that it could be very costly to require the developer to build retaining walls. Councilwoman Borgeson commended the applicant , Don Vaughn, for his cooperation during the field visit. The Public Works Director responded to questions from Councilman Nimmo regarding road construction. Additional discussion ensued regarding the emergency exit road located at the end of the proposed extension and possible future extension through to the freeway. The Community Development Director indicated that the basic concept was good, but that an e;<isting property owner has objections. CC7/10/90 Page 5 � r Councilman Nimmo expressed concern that a safety hazard may be created by allowing construction of the emergency exit at an 1B ' width . Chief Hicks spoke in support of the road , clarifying that it would be for emergency access only and that it would have gates with break-away posts on both ends. He reported that the Fire Department has a particular interest in the area as it relates to circulation. He stated that the road could serve as a great aid for evacuation purposes or as a backup to the Garcia Road Bridge. Further discussion regarding the additional surveying costs the developer may incur resulting from any modifications made during the construction of the road . Mr. Luke recapped estimated costs and indicated that there seems to be no other way than to re— survey. Councilwoman Borgeson stated that the added costs could be off-set by the monies the developer would be save in tree removal costs. Councilman Nimmo stated that while he had no objections, if Council was authorizing the construction of sub-standard roads, either by not extending it out to the end of the property or narrowing the shoulders to save trees, the matter should be made clear to all . The Public Works Director clarified that he has been given no authorization to lessen the width of the shoulders and reiterated • that discretion will be used to save trees if the road can be slightly adjusted . Councilman Dexter remarked that staff, during the development , should look into the possibilities of opening up the road all the way through . Mr . Luke stated that if the Council was leaning in that direction, a condition could be added which would require design work for the extension to be prepared and submitted at the same time. Mayor Lilley asked the City Attorney if right-of-ways could be designed for future expansion of roads across properties not yet acquired . Mr . Montandon reminded Council that the issue before them was the tree removal application, but responded to Mayor Lilley ' s question as it related to condemnation. The City Attorney stated that condemnation would be the only route to acquire such access for a roadway and an improvement on the contiguous property, and further suggested re-focusing on the tree removal request . CC7/10/90 Page 6 r ' Public Comments: The applicant , Don Vaughn 76950 El Camino Real , was present and availed himself for questions. Council thanked him for his cooperation and for showing them the site. The mayor asked the applicant if he would have an objection to the City crediting him for any additional survey costs as a result of as-builts against the in-lieu tree fee. The applicant responded that he did not . Jack Brazeal of Paso Robles, spoke in support of the request and stated that the applicant has made every effort to save as many trees as possible on this project . Marjorie Kidwell , 9980 Old Morro Road East , urged Council to put safety as the number one priority when constructing new roads and asked why roads have to be constructed only to minimum standards. Whitey Thorpe, 8025 Santa Ynez , expressed concern for moving a road to save a tree and asked that Council look first to the safety of the people. Dennis Bryant , 7410 Sombrilla, questioned the accounting for the maximum replacement fee of $15,000. • A young resident of Atascadero spoke up asking if it is legal and cost-effective to construct pavement around the trees as he has seen in some parking lots. The Public Works Director noted that these "turf blocks" are for the purpose of watering the trees. Sarah Gronstrand , 7620 Uel Rio Road , stated that minimum standards are acceptable. Additional staff and Council discussion followed . The City Arborist advised that the topography is flat and proposed road is relatively straight . Mayor Lilley asked the Public Works Director to clarify as-built changes and whether any such deviations would jeopardize safety. Mr . Luke responded that the roads will be designed and built according to the minimum road standards and if the road alignment can be slightly adjusted , yet still maintain the level of safety those standards reflect , such a shift will be made. He stressed that there will no lessening of the criteria and that there is no authority to do so . He stated -that the authority given would be to make minor modifications to the alignment of the road in order to preserve a tree in the field . Councilman Nimmo clarified that Council was then objecting to CC7/10/90 Page 7 verbiage in the staff report relating to minor adjustments in the widths of road shoulders. Mr . Luke confirmed this. MOTION: By Councilman Nimmo and seconded by Councilman Dexter that the tree removal request be approved for the Garcia Road Extension, subject to a maximum contribution of $15,000 to the Tree Replacement Fund with the nigh-t to credit costs for additional surveys as a result of as-builts in the field , and with further understanding that this motion does not indicate any departure from the standard width requirements for the construction of the roadway; motion carried 5:0 on a roll call vote. 2. RESOLUTION 68-90 - CONSIDERATION OF REQUEST TO ABANDON A PORTION OF THE COROMAR AVENUE RIGHT-OF-WAY AT 7350 COROMAR (Road Abandonment 1-90) (Charlesworth ) Henry Engen gave staff report with the recommendation to approve the resolution, noting specific requirements of the applicant . There was no public testimony. MOTION: By Councilman Dexter and seconded by Councilman Nimmo to approve Resolution No . 68-90; motion unanimously carried. C. REGULAR BUSINESS: • 1 . CONSIDERATION OF PROPOSED FINDINGS FOR DENIAL FOR PROPOSED DIVISION OF PARCEL CONTAINING APPROXIMATELY 3.4 AC. INTO TWO LOTS CONTAINING 1 . 1 AND 2.3 ACRES AT 7503 CARMELITA (Bench ) (Cont ` d from 4/24 and 6/26/90) Henry Engen presented the Findings for Denial and recommended adoption. There was no public testimony. Councilwoman Borgeson referred to her previous vote on the appeal and asked the City Attorney whether or not she needed to specify which finding (s) for denial she was in opposition to when she cast her vote. He indicated that she did not. MOTION: By Councilman Nimmo and seconded by Councilman Dexter to adopt the Findings for Denial for TPM 2-89 (Bench ) ; motion carried 4: 1 with Councilwoman Borgeson voting against adoption. CC7/10/90 Page 8 2. PROPOSAL FOR INTERIM TREE REPLACEMENT STANDARDS See item #B-1 . Mayor Lilley called for a recess at 8:33 P.M. The meeting reconvened at 8:50 p.m. 3. RECEIVE CITY COUNCIL'S TREE SUB-COMMITTEE'S DRAFT RE-WRITE OF THE TREE ORDINANCE FOR REFERRAL TO THE PLANNING COMMISSION FOR HEARING AND RECOMMENDATION Mayor Lilley introduced the matter noting that the revision to the Tree Ordinance would be referred to the Planning Commission for public hearing before coming back to the Council for adoption. The City Manager referred to Sec . 9-11 .02 db > of the revised ordinance noting that the word "native" should precede the word "trees" . Council acknowledged the work of the Tree Committee. Mayor Lilley announced that Council ' s action of referring the ordinance to the Planning Commission does not indicate total support nor condemnation. Mr . Windsor added that the purpose of sending the re-write to the Planning Commission is to obtain the public ' s input . Public Comments: Dale Cradduck , 4925 Navidad , asked if he could see a copy of the draft . Mr . Windsor answered that the public will have access to the document . MOTION: By Councilman Shiers and seconded by Councilwoman Borgeson that the City Council refer the revised Tree Ordinance and the referenced "Tree Standards and Guidelines" to the Planning Commission for public hearing . Discussion of the motion followed: Councilman Nimmo noted in the text of the proposed ordinance there are references to the "Tree Standards and Guidelines" to be adopted by resolution and suggested that the matter be continued until those guidelines have been completed . The City Manager advised that , given the time delays already CC7/10/90 Page 9 experienced , Council go forward with its ' referral to the Planning Commission and stated that this would allow for the completion of the guidelines before public hearing . Councilman Nimmo asserted that he could note vote for the referral to the Planning Commission without first seeing the "Tree Standards and Guidelines" . Mayor Lilley asked the City Arborist if it was possible to have a copy of the guidelines by the next regular meeting . She indicated that it would not be ready by then adding that it is 70% completed at present . Ms. Schicker reported that the rough draft is available for Council review. Councilman Shiers asked for affirmation that before the matter is heard before the Planning Commission, the "Tree Standards and Guidelines" will be completed and available to the public before— hand . The City Manager recognized the concern and confirmed that the guidelines will be distributed ahead of time. - He added that he was in support of going ahead with the referral to minimize further delay. Councilman Nimmo reiterated his concern. Mayor Lilley called for the vote. Motion to refer the revised Tree Ordinance and the "Tree • Standards and Guidelines" to the Planning Commission for the purpose of public hearing was passed 4 : 1 ; with Councilman Nimmo voting in opposition. 4. LETTER FROM FRIENDS OF THE PAVILION RE: FUNDRAISING ACTIVITIES The City Manager read the letter received from Sarah Gronstrand of the Friends of the Lake Pavilion asking for Council endorsement of a fundraising concept to designate rooms in the name of large contributors. Mr . Windsor recommended that Council give official support to the committee to better enable them to approach possible donors. By common consensus, Council gave such endorsement . 5. COUNCIL COMMITTEES, COMMISSION AND BOARDS — YOUTH REPRESENTATIVES The City Manager gave staff report recommending youth representation on the following committees/commissions: Traffic Committee, Parks & Recreation Commission and the Recycling CC7/10/90 Page 10 Committee. Mr . Windsor outlined the criteria and discussion followed . Councilman Dexter suggested advertising for applicants, noting the need to involve all students , not just those who attend the local high school . Public Comments: Eric Greening , 7375 Valle, spoke in support of youth involvement and encouraged opening up the opportunity to everyone. Mr. Greening opposed the age limitation and shorter term lengths. Nathan Coran, 7375 Valle, responded in support and asked that the age limit be lowered. James Patterson, member of the Recycling Committee, noted that this committee had the pleasure of the participation of a High School representative and urged Council to encourage youth participation. Micki Korba, 10905 Santa Ana, stated that she did not approve of limiting it to just high school students; noting that some 16 and 17 year olds are in college. SMOTION: By Councilwoman Borgeson and seconded by Councilman Shiers to adopt staff recommendation to supplement the following groups by an ex-officio youth member of high school age: Traffic Committee, the Parks and Recreation Commission and the Recycling Committee; motion unanimously carried . The City Manager indicated that he would come back with a new resolution setting forth method of selection. 6. CREATION OF A DOWNTOWN TASK FORCE TO IMPLEMENT THE MASTER PLAN The City Manager introduced the matter , noting that John Himes, President of the BIA was present . Lengthy discussion followed regarding the matter of hiring a Downtown Coordinator . Councilwoman Borgeson and Councilman Shiers expressed support in the hiring of such a coordinator . Mayor Lilley noted that there was not a slot in the budget for such a position. The City Manager advised that staff would research the issues and come back to Council with a CC7/10/90 Page 11 i 0 f recommendation. He added that he did not envision the Downtown Coordinator to be a full-time employee, but rather an extension of the BIA and clarified that the City needs to maintain some kind of control if it is to be involved with the funding .. Public Comments : John Himes, 118210 Carmelita, stated that time is of the essence and urged the formation of the Task Force. He voiced support for hiring a coordinator , if it can be done within a reasonable time frame. Brief discussion followed regarding possible assistance from the Main Street Programa The City Manager indicated that funding was no longer available. Mr . Joseph reported that he understood that while Atascadero could no longer be a "test city" , it could buy some of the experiences of the program. Mr . Himes warned the Council that the downtown revitalization program will be expensive to implement adding that sometimes you need to spend money to make money. He reiterated that the City ' s investment in the future of the downtown will eventually come back to the City. Dennis Bryant , 7410 Sombrilla, stated that he had a business located at 5925 Entrada. Mr . Bryant asserted that no consultant or coordinator is needed and urged Council to talk with downtown merchants and residents. He added that he did not believe the BIA fully represents those that live and work in the downtown. Robert McNew, 4830 E1 Verano , cautioned Council when giving freedom to the Task Force in dealing with architecture so as not to discourage development of downtown. ITEM: B-2 MEMORANDUM TO: Planning Commission FROM: Doug Davidson, Senior Planner RE: Appeal of Precise Plan 74-89 Conditions of Approval Hazard/Fisher/Washburn DATE: July 3, 1990 RECOMMENDATION: Staff recommends denial of the appeal. BACKGROUND: Precise Plan 74-89 (Exhibit D) was approved on April 24, 1990 with eleven (11) Conditions of Approval. Condition #4 required the approval of engineered plans for curb, gutter, sidewalk, and paveout along the property frontage and construction of these improvements prior to final inspection. Condition #5 required the corresponding performance and maintenance bonds. As contained in Exhibit A, the applicant requested a waiver from the City Engineer of the requirement for public improvements. The City Engineer denied the request based on the reasons provided in Exhibit B. Consequently, the applicant filed an appeal of the Precise Plan conditions for Planning Commission consideration (Exhibit C) . ANALYSIS: Precise Plan 74-89 established the development standards for the construction of two single family residences on a lot containing an existing single family home. The subject site is located at 5160 Palma Ave. in the RMF/10 zone. In this Low Density Multiple Family zone, curb, gutter, and sidewalk may be required if the pedestrian, vehicular, and use characteristics of the site and surrounding area justify the improvements. Zoning Ordinance Section 9-4. 159 (d) contains three possibilities for exceptions from public improvement requirements: 1. Incompatible Grade: The improvements may be waived or modified by the City Engineer if the finish grades of the project site and adjoining street are incompatible for accommodating the improvements. 2. Incompatible Development The required improvements may be waived by the Community Development Director and City Engineer when they determine that such improvements are incompatible with the ultimate development of area given the zoning districts, existing land uses in the vicinity, and projected needs for drainage and traffic control. 3. Premature Development: The required improvements may be delayed when the City Engineer determines that they would be premature to the development of the area. In this case, performance guarantees are posted and time lmits for construction are established. Curb, gutter, sidewalk, and paveout are not incompatible with the existing terrain or development pattern in the area. The installation of public improvements is not premature, in fact just the opposite - the City cannot postpone these necessary improvements any longer. As the City Engineer states, the additional paveout and sidewalk are necessary to accommodate the increase in automobile and pedestrian traffic. While at first glance the area appears fully developed, many of the properties in the neighborhood are underdeveloped. In addition to the subject site, many lots in the area contain one single family residence with potential for multiple family dwellings. Staff is currently reviewing the adjacent lot, under same ownership, for a similar development plan. Also, curb and gutter are needed to maintain the drainage flow within the public right-of-way. Lastly, pavement widening could enable Palma Ave. to serve as a alternate bike lane to El Camino Real. The following are some of the main reasons we feel the CG&S are not necessary. 1 . Presently Palma Ave. has no CG&S. Recently and in the past the construction of multi-family dwellings on Palma have been granted waivers for building CG&S. 2 . Palma will never have a complete CG&S system because of the large percentage of existing multi-family dwellings that have been allowed to be built without CG&S. One example, of many, being Amapoa Ave. 3 . Esthetically, Palma, as with many streets in Atascadero, adding CG&S would take away from the rural atmosphere already created. 4 . Requiring CG&S on this lot will divert water run off to the neighboring properties . We have talked with the neighboring property owners. They have expressed extreme concern over the diversion of water on to their property and the damage that will occur from this. A few of these neighbors have threatened with a lawsuit as an answer to resolve any water problems created by the construction of this CG&S. We personally don't want to be a part of a lawsuit due to a requirement of the city. In conclusion, the only way to resolve this requirement of CG&S is to waive it entirely or get the city to fund and construct the CG&S for the entire street at one time. The site contains an existing single family dwelling which is to remain. The proposed site is zoned RMF/10 (Residential Multiple Family Low Density) and the proposed use is allowed as defined as a single family dwellings (Section 9-3. 172 (a) . The surrounding properties are zoned the same as the subject site, with the exception of property to the south which is zoned CR (Commercial Retail) . A review by the Community Development Director of the environmental description form and application, along with other background information, shows that the project will have no detrimental effect upon the environment; therefore, a Negative Declaration has been prepared. The Director has also found the project, as conditioned, to be in compliance with the provisions of the Zoning Ordinance. The proposed Precise Plan is approved as shown on attached Exhibit B (site plan) , Exhibit C (grading plan) and subject to the conditions of approval in Exhibit E. Final approval becomes effective on May 151 1990, unless appealed. The proposed project or use is consistent with the General Plan. 2. The proposed project or use satisfies all applicable provisions of the Zoning Ordinance. 3. The establishment, and subsequent operation or conduct of the use will not, because of the circumstances and conditions applied in the particular case, be detrimental to the health, safety, or welfare of the general public or persons residing or working in the neighborhood of the use, or be detrimental or injurious to property or improvements in the vicinity of the use. 4. EXHIBIT E - Conditions of Approval Precise Plan 74-89 5160 Palma Ave. (Fisher/Washburn/Hazard) CONDITIONS OF APPROVAL 1. All construction shall be in conformance with Exhibit B (Site Plan) , Exhibit C (Grading Plan) , Exhibit E (Conditions of Approval) , and shall comply with all City Codes and Ordinances. Any modification to this approval requires approval by the Community Development Department prior to implementing any changes. 2. All relocation and/or alteration of existing utilities shall be the responsibility of the developer. 3. Grading and drainage plans, prepared by a registered Civil Engineer, shall be resubmitted to the Community Development Department for review and approval by the Community Development and Public Works Departments prior to the issuance of any building permits. Drainage calculations shall be submitted to justify the proposed detention basin. All required drainage work shall be constructed to City standards and completed prior to final building inspection. 4. The developer shall obtain an encroachment permit from the City of Atascadero Public Works Department. Plans shall be prepared by a Registered Civil Engineer and be submitted to the Community Development Department for review and approval by the Community Development and Public Works Departments, prior to issuance of any building permit. Plans shall include, but not be limited to: a. Curb, gutter, sidewalk and paveout 15 feet from centerline of the right-of-way along entire property frontage. b. Signing an inspection agreement guaranteeing that the work will be done in conformance with approved plans and that inspection fees shall be paid. C. Construction of the public road improvements shall be completed prior to the final inspection. 5. All public improvements shall be covered with a 100% Performance Bond and a 100% Labor and Material Bond until construction is approved and by a 10% Maintenance Bond until one year after construction approval. 1 6. Plans shall be approved by the Fire Department prior to issuance of building permits, particulary the widening of the access driveway to 20 feet from Palma Ave. to the point where the driveway veers to the right. 7. No parking shall be permitted along the street frontage of the project. 8. Each unit shall contain 100 square feet of storage space, exclusive of closets. The proposed new units comply with this requirement, however, this pertains to the existing unit as well. 9. The handicapped parking space shall be redesigned to avoid backing directly out into the street. The driveway shall be widened and an adequate turn-around area provided. 10. Landscape plans shall be submitted to and approved by the Planning Division prior to issuance of building permits. These plans shall incorporate the recommendations of the certified arborist (Exhibit D) . 11. This Precise Plan shall expire one year from the date of final approval (May 15, 1990) . APPEAL OF PRECISE PLAN 74-89 (CONDITION OF APPROVAL) : Appeal filed by Jim Hazard/Robert Fisher/Paul Wash urn appealing the . requirements for public improvements. Subject site is located at 5160 Palma Avenue. Chairperson Lochridge stated since he is in a business arrangement with one of the applicants, he will chair the meeting but will not participate in discussion and will abstain from voting. Mr. Davidson presented the staff report noting staff' s recom- mendation to deny the appeal . Commission questions followed. MINUTES EXCERPT - PLANNING COMMISSION - JULY 3, 1990 Bob Tartaglia, representing the appellants, stated his engineering company did the on-site grading and drainage plan. He presented some handouts to the Commission and discussed reasons in opposition to installing curb, gutter, and sidewalk, adding that the major problem on the street is the difference in grades. He suggested that the City do a master plan to develop curb grades for the entire street. He then responded to questions from the Commission. Judy McKrell stated she owns a property directly to the south of the subject site and expressed concern if the improvements are put in, this may create significant drainage problems for her. Kris Hazard, appellant, spoke in support of the appeal adding there are other undeveloped properties that are single family but the only way they'd be developed is if the residence was completely, raised because the house that' s on the property does not leave enough room to go to the back for any further development. She stated she has no problems with curbs, gutters, and sidewalks, but if there is one small chunk of Palma that has curbs and gutters, it is not going to be consistent with the rest of the neighborhood and will create a hopscotch effect. She recommended that the City assess the entire street and put them in but she could not see where she should agree to a bond that says in one year we' ll do it as long as there is not a guarantee from the City as to when the City would take care of the remaining street. Mr. Sims responded that when the site was reviewed, it looked like one of the more level lots . The major issue involved is the question of premature development and when do you begin requiring curbs and gutters . He added that the City is reaching a buildout but public improvements are not being installed. Mr. Sims suggested some mitigation measures for carrying the water from the property and noted that he did not see matching grades in the future as a problem; the more segments that are put in, the easier it is to do the engin- eering. Commissioner Hanauer indicated his feeling that it will be a long time before the total length of street develops to the extent that the curbs and gutters will be put in there. Mr. Decamp pointed out that as property develops, that is the traditional time that cities require improvements along the property frontages. It is important to have guarantees at this point that the developer will contribute to the improve- ment of that road. NOW, THEREFORE, BE IT RESOLVED that the report of abatement cost is confirmed as presented; and BE IT FURTHER RESOLVED that the costs of abatement constitutes a special assessment against the described parcels and shall be lien on the property in accordance with Government Code Section 39577 ; and BE IT FURTHER RESOLVED that the City if hereby directed to transmit to the proper officials of the County a certified copy of the report for filing. The oaks are located in the vicinity of the proposed construction REE:C►)MMATION Based, on the arborist',s report, the condition of the trees and the existing Tree Ordinance, recommend approval of the heritage tree and one of the -18" dbh Q. lobate (Tree #1 and #4 on the attached site plan) and denial of the other two trees. BACKGROUND The Tree Ordinance. specifies` that live native trues 2011 or greater dbh' (measured' four , foot above grade) are 4eemed heritage trees and cannot be removed unless approved by the. City Council following a public hearing. The site has been posted and the building footprints and -driveway have recently been staked. Trees proposed for removal are marked with flagging tape. The trees wore inspected by ISA certified arborist 'D.O. Denney and the City 'Arborist on separate occasions. AXALYSIS This lot has been approved as buildable, reasonable use, 'allowsfor some amount of single family residential construction. I visited the property with K. .Kellogg, ,the contractor/designer of the proposed home to discuss the siting of the buildings., The , ,,hertage oak stands in the middle of the building pad and after, discu ting many alternatives, it appears impossible to build this modest sized home without removing this tree. One of three trees standing adacent to the proposed garage is almost completely dead: and should also be removed. It is unnecessary to remove the two trees `adjacent to theporch because they are not in the way of the proposedconstruction, are relatively healthy and should. survive construction activity. It has survived -quite well for many years in it's natural state. However, when building, we sever its roots that are needed for anchorage and absorption of water and nutrients. We pave and compact the soil around them, hindering the oxygen and water supply to the roots. You purchase the property because of the beautiful trees, only to witness many of your trees declining soon after or even some years after you have built your home. Who is to blame? Did the Architect, City Planner, the Arborist, and/or Contractor add to the -demise of the tree? Is your building plan detrimental to the trees on your property? Your City or County Planner have codes and regulations to follow to preserve and protect your trees. Even trees that are in excellent health sometimes cannot tolerate. . the transition from natural (growing in a desirable natural condition) to semi-natural (severing the roots, compacting the soil , and building within the drip line) to the unnatural (paving all the way around the trees causing disturbances in air and water exchanges in soil as well as many other major changes. ) Many changes can take place in the soil during construction. Changes in grade, new paving, trenching, soil compaction, can all affect the soil 's ability to support life. Almost all building and landscape development will involve some grading and excavation. The consequences of these changes can be immediately detrimental to trees or they can effect the trees in years to come. Soil aeration is a critical factor because roots must receive adequate oxygen. Trees can also suffer from moisture related problems, either not enough or too much moisture. Now that you are aware that trees are sensitive living things, we all must put measures into effect that will protect them. i Protective measure needs to be applied : Yes No During construction, trees on the property outside the immediate construction zone will be barricaded off with bright color flagging. No parking, storage of materials and dumping of excavated or building material will be permitted. Trees within 2-o feet of the construct- ion zone will a protected by installing a light colored protective fence (temporary) around the drip line area of the trees. Trees within �_ feet of construction zone will have their trunks barricaded to minimize damage caused by construction equipment. No parking of equipment, storing of equipment, disposing of gasoline, paint, thinner or any other foreign material will be permitted in and around this property unless so noted in report. _ Trenching for utilities is required. Line will run feet from base of tree. Hand dig un er or above major anchorage roots. If a major root is encountered in direct line of utility, a Certified Arborist will be consulted before severing it. No grade changes will be made around the tree unless (1 ) a protective measure is applied, (2) and it is so noted in the Certified Arborist's report. Factors have been used to determine the tree condition before construction begins. _ This report has been reviewed by all people involved in this project. Diligent care will be applied to protect the trees. i REPLANTING GUIDELINES 1 . Choose 15 gallon - sized native trees (Q. lobata) for the trees to be removed. 2 . Inspect the trees for encircling roots (roots that wrap around the pot have a poorer chance of straightening out and growing right in the ground. 3 . When planting, make sure that the roots have been untangled, straightened and loosened as much as possible. 4 . Plant in a hole at least twice as big as the pot, and use native soils in the hole. 5 . Provide the tree with deep watering - meaning a slow, gradual and long watering (which encourages downward root growth to anchor the tree) . Provide one deep watering in late spring and two in the summer. If drip irrigation is used, do long, slow watering, applying 10-20 gallons over a three-four hour period. 6 . Protect the young trees from wildlife or vandalism with some kind of fencing - both above and below ground if possible; welded wire fencing of at least 4 feet in height above ground and one- two feet below ground (I can provide some specs if needed) . It would be appropriate to plant these new trees in areas where th would not conflict with each other or with overhead power lines as th le grow and mature. The applicant shall provide the City with a signed statement that attests to the planting of these trees which should be planted within the first year. The phrase "TOP" appears in several places on the map. Topping trees, especially oaks is not an acceptable standard in the care of trees . These trees should not be topped, if that is what this note is referring to. The tree protection notes and specs mentioned on this plan also do not adequately protect the trees or comply with the standards set forth in the Tree Ordinance. The ordinance states that tree protection fencing should extend and encircle the dripline of the trees, and it is not evident from this map where, in relation to the dripline, the fencing will be. I did notice, however, that most of the trees to be protected fall within the cut and fill lines on the banks of the road; it is not known for sure if these trees will even survive; it has been known that a grade change of no more than 2" can sometimes kill trees . If at all possible, the soil within the dripline of the trees should not be disturbed, even in these cut and fill areas . Therefore, all of these trees that appear endangered by grading shall also be replaced if they don' t make it. According to the ordinance, if these trees die within the next three years, the builders are to be held responsible and be required to replace any trees that did not make it. In regards to tree protection, then, three recommendations : 1 . Identify and label all trees to be protected (within 20' of construction, including areas to be graded) and delineate the areas to be fenced on the plan (most of this has been done) . In order to specify tree protection to comply with the ordinance requirements; plans should read something to the effect of a 5 ' high fence at the dripline of the trees (or at the line of encroachment with the road) - fence types suggested include welded wire, snow fence, chain link or safety fence - all staked so as not to fall in on themselves or the tree. 2 . Change the plan note that refers to the tree replacement ratio to reflect the decision of City Council after public hearing. 3 . Require a written agreement between City and Applicant to have Applicant replace the trees to be removed and the transplanted trees and those affected by the cut and fill areas of the proposed driveway if they die during a three year period after construction. Choose 15 gallon - sized trees for each tree to be removed. 2 . Inspect the trees for encircling roots (roots that wrap around the pot have a poorer chance of straightening out and growing right in the ground. 3 . When planting, make sure that the roots have been untangled, straightened and loosened as much as possible. 4 . Plant in a hole at least twice as big as the pot, and use native soils in the hole. 5 . Provide the tree with deep watering - meaning a slow, gradual and long watering (which encourages downward root growth to anchor the tree) . Provide one deep watering in late spring and two in the summer. If drip irrigation is used, do long, slow watering, applying 10-20 gallons over a three-four hour period. 6 . Protect the young trees from wildlife or vandalism with some kind of fencing - both above and below ground if possible; welded wire fencing of at least 4 feet in height above ground and one- two feet below ground ( I can provide some specs if needed) . It would be appropriate to plant these new trees in areas where the could provide shade to parking lots and buildings and provide aestheti relief for the commercial buildings as viewed from Highway 101 . The applicant shall provide the City with a signed statement that attests to the planting of these trees which should be planted within the first year.
