The meeting was called to order at 7 :30 p.m. with the Pledge
of Allegiance. Mayor Mackey gave the invocation.

PUBLIC COMMENTS
• _ 1. Jim Hahn commented that there are many areas .in which weeds
have not been cut down. Ile requested that Council consider
extending the weed abatement period and, if necessary, to place the
bill on the 1984 tax rolls.
Fire Chief Hicks stated that there has been a problem in cutting
weeds in some areas because of steep terrain and that he was cautious
about placing equipment into areas of high fire hazard because of the
possibility of starting a fire.
Council requested Staff to bring back a revised weed abatement '
program to achieve a higher degree of clearing and compliance.
COUNCIL COMMENTS
1. Councilman Nelson asked for status of the septic tank failure
on Vinado. Mr. Warden replied that the matter is being looked
into but identification of the source of the problem is difficult.
Council requested a status report at the next meeting.
2 . Mayor Mackey reviewed a letter from Eric Seastrand regarding
a Park and Recreation grant to pay for lights at South
Atascadero Park.

MOTION: Councilman Nelson moved to adopt Resolution No. 36-83. The
motion was seconded by Councilman Stover and carried on the

3. Public hearing on and Resolution No. 37-83 establishing the
formation of a maintenance district to levy and collect
assessments - Sonora/Pinal Avenues
Mr. Warden noted that an objection had been received from Bruce
Rogers protesting the formation of a street maintenance district on
Sonora/Pinal Avenues.
MOTION: Councilman Nelson moved to overrule the protest of Bruce
Rogers. The motion was secondedby Councilman Wilkins and
unanimously carried.
MOTION: Councilman Wilkins moved to adopt Resolution No. 37-83.
The motion was seconded by Councilman Stover and carried on

Mr. Warden stated that Resolution No. 35-83 cannot be adopted
until Ordinance No. 69 becomes effective in 31 days. He stated
that he will present it to Council again at that time.

E. ATASCADERO COUNTY SANITATION DISTRICT
MOTION: Councilman Wilkins moved that the Council recess and convene
as the Atascadero County Sanitation District Board of Dir-
ectors. The motion was seconded by Councilman Nelson and
unanimously carried.
1. Resolution No. 38-83 approving the Atascadero County Sanita-
tion District Budget for the 1983-84 Fiscal Year and appropri-
ating funds therefor
MOTION: Director Wilkins moved to adopt Resolution No. 38-83. The
motion was seconded by Director Stover and carried on the
following roll call vote :
AYES : Directors Nelson, Stover, Wilkins and President Mackey 0

MOTION: Director Nelson moved that the Board of Directors adjourn
and reconvene as the City Council. The motion was seconded
by Director Wilkins and unanimously carried.

a. Mr. Warden stated that time constraints made it inadvisable
to place the police facility issue on the November special election
ballot. He recommended that Council place the matter on the June
ballot and agree to submit a request for proposals for a financial
consultant to help put the issue together.
MOTION: Mayor Mackey moved to look into the possibility of a June
election for the police facility and for Staff to bring back
a proposal for a financial consultant. The motion was seconded
by Councilman. Nelson and unanimously carried.
b. Mr. Warden requested a closed session to discuss labor
relations and potential litigation. He stated that there may be a
possible announcement after the closed session.
The meeting adjourned at 8 :12 p.m. to closed session and returned
to regular session at 9 : 15 p.m.
• MOTION: Councilman Nelson moved to approve the MOU for SEIU Local 660
Clerical and SEIU Local 660 General Services for FY 1983-84 .
The motion was seconded by Councilman Wilkins and unanimously
carried.
MOTION: Councilman Nelson moved to extend to all general employees
who are non-Union/Association members a total package increase
of 4 . 990 . The motion was seconded by Councilman Wilkins and
unanimously carried.
MOTION: Councilman Nelson moved that the City Manager and Department
Heads be given a total package increase of 40 . The motion
was seconded by Councilman Stover and unanimously carried.
MOTION: Councilman Wilkins moved to effect conversion from the merit
program to a new personnel program containing three categories :
Trainee, Qualified, and Fully Qualified, effective July 1,
1983. The motion was seconded by Councilman Nelson and
unanimously carried.
MOTION: Councilman Stover moved to reclassify the Recreation Director
to a salary of $2, 340 a month, which would include 7% payment
by the city of the employee ' s contribution to PERS, to be
effective July 1, 1983. The motion was seconded by Council-
man Wilkins and unanimously carried.

MOTION: Councilman Wilkins moved to increase automobile car allowances
within the FY 1983-84 budgets as follows:
City Manager $181. 50
Public Works Director 152 . 50
Planning Director 96 . 50
Recreation Director 96 . 50
The above increase was based upon the requirement that each
recipient carry $100,000/$300, 000/$100, 000 liability coverage
on their private vehicle used for city business. In addition,
the Council approved the payment of not more than the first
$250 of the deductible provisions of insurance claims in the
event the employee was not at fault for the accident. The
motion was seconded by Councilman Stover and unanimously
carried.
MOTION: Councilman Nelson moved that the City Attorney' s contract be
amended effective July 1, 1983 , to pay $2, 210 a month on the
basic contract for a total 3% increase to include absorption
of the now existing $150 a month car allowance. In addition,
litigation expenses to be increased from $65 to $70 per hour.
The motion was seconded by Councilman Wilkins and unanimously _
carried.
MOTION: Councilman Stover moved to extend the retroactivity provisions
adopted by Resolution No. 27-83 to August 22, 1983 , provided
that signed Memorandum of Understanding are received by that
date. The motion was seconded by Councilman Wilkins and
unanimously carried.

AGREEMENT
I
This Agreement, dated � J! , 1983 , is made and en-
tered into by and between the City of Atascadero, a municipal
corporation, hereinafter referred to as "City, " and the Action
for Animal Rights (AFAR) , Atascadero, California, hereinafter
referred to as "AFAR. "
The City has provided $4 ,000 .00 as part of the Fiscal Year
1983-84 Budget, per the request of AFAR, for operation of the
spay/neuter certificate program within the City of Atascadero.
The City will advance AFAR $2,000. 00 for the first six months'
activity upon execution of this Agreement, and the remaining
$2,000. 00 after receipt of the first six months' activity report.
All funds provided by the City will be expended within the City
for veterinarian services to the AFAR Spay/Neuter Assistance Pro-
gram and will be used to help defray the costs of spaying or neu-
tering dogs or cats. The certifcate program is considered to be
an inducement for owners to spay or neuter their dogs or cats in
order to achieve the long-term objective of controlling the dog
and cat population within the City of Atascadero.
AFAR will provide the City semi-annual reports presenting ac-
tivities of AFAR in `operating the Spay/Neuter Assistance Program
within the City of Atascadero. Such reports will be due as of
December 31, 1983, and June 30 , 1984 , and shall be received by no
later than January 15, 1984 and July 15, 1984 , respectively. The
report shall contain at least the following information:
• a. The number of certificates issued to residents of Atas-
cadero for dogs and cats located within the City who
have been serviced by this program.
b. Total amounts paid to veterinarians for spay/neuter cer-
tificate services provided within. the City.
C. Amount and sources of additional funding if required to
support this program within the City.
This Agreement shall terminate as of June 30 , 1984. Requests
for continuation of existing support or the consideration of ad-
ditional support beyond the termination date of this Agreement
shall be submitted in writing to the City by April 1, 1984 , in
order to be included in the succeeding Fiscal Year budget consi-
derations.

MEMORANDUM OF UNDERSTANDING
BETWEEN THE CITY OF ATASCADERO AND
• THE ATASCADERO FIREFIGHTERS ' BARGAINING UNIT
This Memorandum of Understanding is entered into between the Em-
ployee Relations Officer of the City of Atascadero, hereinafter re-
ferred to as "City, " and the Firefighters' Bargaining Unit of the Fire
Department Employees Association, hereinafter referred to as "Unit, "
and made pursuant to California Government Code Sections 3500 et seq,
City of Atascadero Ordinance No. 24', dated July 14 , 1980 , and the City
of Atascadero Resolution No. 12-80, dated July 14, 1980 and subsequent
amendments thereto.
The parties have met and conferred in good faith regarding employ-
ment terms and conditions for members of the Unit as recognized by the
City of Atascadero on April 13 , 1981, and, having reached an agree-
ment, as herein set forth, submit this memorandum to the City Council
with a joint recommendation that that body resolve to adopt the terms
and conditions and take such other additional actions as may be neces-
sary to implement its provisions.
Section 1. Purpose.
1. 1 It is the purpose of this Memorandum of Understanding, here-
inafter referred to as "MOU, " to promote and provide for continuity of
operation in employment through harmonious relations, cooperation and
• understanding between Management and employees covered by the provi-
sions of this MOU and to set forth the understanding reached between
the parties as a result of good faith negotiations on matters set
forth herein.
1. 2 This MOU shall replace and supersede the Memorandum of Under-
standing (MOU) reached between the Unit and the City, effective July
1, 1982 adopted October 11, 1982, and earlier Memoranda between the
Atascadero Firefighters' Association and the Board of Directors of the
Atascadero Fire Protection District.
Section 2.0 Full Understanding, Modifications, Waiver.
2.1 This MOU sets forth the full and entire understanding of the
parties regarding the matters set forth herein. Any other prior or
existing understanding or agreement by the parties, whether formal or
informal, regarding any such matters, are hereby suspended or termin-
ated in their entirety, if in conflict with this Memorandum.
2. 2 - No agreement, alteration, understanding, variation, waiver or
modification of any of the terms or provisions contained herein shall
in any manner be binding upon the parties hereto unless made and exe-
cuted in writing by both parties hereto and, if required, approved and
implemented by the City Council.

2. 3 The waiver of any breach, term or condition of this Agreement '
by either party shall not constitute a precedent in the future en-
forcement of all its terms and provisions. •
Section 3 .0 Sick Leave.
Unit members shall earn and use sick leave subject to the provi-
sions of Section 9. 5 of Resolution No. 12-80, dated July 14, 1980.
Sick leave credited from either District or City service may be used
as available and needed subject to the City's Personnel Rules and Reg-
ulations, except that any sick leave used shall first be deducted from
the credited amount carried over from District service until such
credits are exhausted. It is agreed that nothing herein shall be con-
strued as providing any vested right, monetary or otherwise, to any
unused sick leave existing at time of discharge or voluntary separa-
tion from City service, or at time of retirement in accordance with
the City' s Public Employees Retirement System contract.
Section 4.0 Vacation.
4. 1 Vacation leave shall be credited, computed and used as speci-
fied by Section 9 .0, Employee Benefits, of. ,Resolution No. 12-80, dated
July 14 , 1980.
4. 2 It is agreed and understood that the taking of vacation shall
be as scheduled by the Fire Chief subject to the needs of the City.
Section 5. 0 Salaries. •
5. 1 Effective as soon as possible and retroactive to July 1, 1983
the City will implement a new salary plan. The plan will have three
designations: Trainee, Qualified, and Fully Qualified. Salary rates
for the Qualified and Fully Qualified shall be 10% apart, with the
Trainee position up to 10% less than the Qualified rate depending upon
the qualifications of the applicant. Initial appointments to a clas-
sified position for those meeting all of the basic qualifications for
that position will be at the Qualified level. Eligibility for ad-
vancement to the Fully Qualified level will be after the completion of
three years of uninterrupted satisfactory service at the Qualified
rate in the classification. Advancement to the Fully Qualified level
will require that the employee' s overall performance is fully satis-
factory, as evidenced by the recommendation of the Department Head.
Applicants not meeting the basic qualifications for a position at
time of hire or promotion to a higher classification will be desig-
nated as Trainees and paid at the Trainee rate. Advancement to the
Qualified designation and pay rate may take place whenever the em-
ployee meets the basic qualifications for the position, as evidenced
by the recommendation of the Department Head, but must take place by
-the end of the employee' s probationary period. Thereafter, advance-
ment from the Qualified designation and pay rate shall be as set forth
above.
Atascadero Firefighter' Bargaining Unit MOU
If, upon promotion to a higher classification at the Qualified- pay
rate, the new classification would result in an employee receiving
less than a 5% gross wage increase, the employee will be placed at
that exact salary level which will provide for a 5% gross increase
over his/her previous gross salary level. Additional adjustments will
be made, if necessary, to maintain the minimum 5% gross pay differen-
tial over the employee' s gross pay if he/she had remained in his/her
old classification. Such adjustments, however, cannot exceed the
Fully Qualified pay rate for the new classification.
5.2 Salaries under the new salary plan shall be as set forth in
Exhibit I, attached hereto. Salaries set forth in Exhibit I shall
become effective for Unit personnel on August 6 , 1983 modified by the
following: (a) Unit personnel advancing to the Fully Qualified rate
pursuant to paragraph 5.1 above, prior to August 6, 1983, will have
their salary computed in accordance with the Maximum Rate of the Fis-
cal Year 1982-83 Salary Plan; (b) Unit personnel who do not qualify
for the Fully Qualified designation or did not receive a merit equiva-
lency pursuant to paragraph 5.3 below, will continue at their Fiscal
Year 1982-83 Base Salary rate until August 6, 1983; (c) Unit personnel
advancing subsequent to August 6, 1983 will do so in accordance with
the Fiscal Year 1983-84 Salary Plan (Exhibit I) .
5.3 Effective June 30 , 1983 the Merit Salary Program is termin-
ated, and all merit pay shall cease. Any employee, however, who would
receive a decrease in their gross salary on that date as a result of
changing to the new salary plan will continue to receive the equiva-
lent of their Fiscal Year 1982-83 merit adjustment until such time as
rate adjustments under the new salary program result in gross pay
equal to or greater than the merit pay. Thereafter, the equivalent
payment shall cease.
5.4 The Association acknowledges that numerous Personnel Rule
amendments will be necessary to implement the salary plan changes. A
copy of all proposed changes will be provided to the Association prior
to their adoption. Upon request, the City will consult with the Asso-
ciation regarding them.
5. 5 For purposes of police-fire comparison Fire Captain shall be
compared to Police Sergeant, Fire Engineer shall be compared to Police
Officer with no comparable basic fireman vs. police classification.
Section 6.0 Medical/Dental Benefits.
City agrees to pay for all medical and dental benefits for each
Unit member at the rate and coverage prevailing under the City' s medi-
cal and dental program as now exists through City' s participation in
the Central Coast Cities Self-Insurance Fund, known as the Self-Insur-
ance JPA. It is agreed that the City will pay for Fiscal Year 1983-
- 84 , dependent medical and dental coverage Up to $68 . 00 per month. For
those employees without dependents or who do not choose to enroll
their dependents in the City plan, the $68. 00 shall be paid to the
employee as an addition to his/her regular salary.
Atascadero Firefighos' Bargaining Unit MOU .
Section 7.0 Overtime.
City agrees to pay all Unit members overtime, upon certification
by the Fire Chief using authorized time card forms, for any overtime
worked in excess of the established 56 hour work week. (This is equi-
valent to 121.33 shifts per year. ) Such overtime shall be computed
using the rate of time and one-half applied to the 56 hour work week
hourly wage scale for the individual concerned.
Section 8.0 Holiday Time.
Unit employees shall receive five and 13/100 (5.13) shifts time as
Holiday time for the term of the Agreement. Holiday time will be
credited at eleven (11) hours per month.
Section 9 .0 Term Life Insurance.
City shall maintain a term life insurance policy for each unit
member in a total amount of Fifteen Thousand Dollars ($15,000 .00) and
shall pay all premiums for such policy during the term of this Agree-
ment.
Section 10 .0 General Benefits.
It is agreed that compensatory time off (CTO) , retirement and any
other benefits and conditions of employment shall be as specified by
City Resolutions No. 12-80 and 52-82, and City Ordinance No. 24.
Section 11.0 Retirement.
Effective January 1984, the City shall make available the 1959
survivors Benefit for all unit employees.
Section 12.0 Probationary Period.
Effective July 1, 1983, the probationary period for newly hired
employees shall be increased to eighteen months. The probationary
period for employees promoted to a higher classification shall be
twelve months in the new classification.
Section 13.0 Effective Date.
It is understood and agreed that the provisions of this MOU shall
be effective as 0001 a.m. , July 1, 1983, and shall remain in effect,
unless modified by mutual agreement, until midnight June 30, 1984.
Section 14. 0 Implementation.
14.1 This MOU constitutes a mutual -recommendation to be submitted
to the Atascadero City Council. It is understood that this MOU shall
not be binding upon the parties either in whole or in part unless and
until said City Council: (a) acts, by a majority vote, formally to
approve and adopt said MOU, (b) and acts in a timely manner to appro-
priate the funds necessary to implement the provisions of this MOU
which require funding.
14. 2 Notwithstanding the foregoing, . in the event the City Council
fails to take all of the actions necessary for timely implementation
of this MOU, either party may request the renewal of the meet and con-
fer procedure.
Section 15. 0 Provisions of Law.
15.1 This MOU is subject to all current applicable federal, state
and local laws, regulations and resolutions. All ordinances, rules
and regulations enacted by the City Council shall be subject to the
appropriate revisions, amendments and deletions necessary to conform
with the purpose, intent and application of the 'provisions of this
Agreement.
15 . 2 If any part or provision of this MOU is in conflict or in-
consistent with such applicable provisions of federal, state or local
laws or regulations, or is otherwise held to be invalid or unenforce-
able by any tribunal of competent jurisdiction, such part shall be
suspended and superseded by such applicable law or regulations, and
the remainder of this MOU shall not be affected.
Section 16 .0 A plicability of Other MOD' s, Rules and Regula-
tions.
It is agreed that all provisions of any- existing or prior MOU' s,
understandings or personnel policies, customs, practices and actions
not specifically included in Ordinance No. 24 and associated rules and
regulations adopted by the City Council of the City of Atascadero,
shall be superseded by the provisions of this MOU.
Section 17 . 0 Management Rights.
The authority of the City includes, but is not limited to the ex-
clusive right to determine the mission of its constituent departments,
commissions and boards; set standards of service; determine the proce-
dures and standards of selection for employment and 'promotion; direct
its employees; take disciplinary action for "just cause" ; relieve its
employees from duty because of lack of work or for other legitimate
reason; maintain the efficiency of governmental operations; determine
the methods, manning and personnel by which governmental operations
are to be conducted; determine the content of job classifications;
take all necessary actions to carry out its mission in emergencies;
excercise complete control and discretion over its organizations and
the technology of performing its work; provided, however, that the
exercise and retention of such rights does not preclude employees or
their representatives from consulting or raising grievances over the
consequences or impact that decisions on these matters may have on
wage, hours and other terms of employment.
Section 18 . 0 Peaceful Performance Clause.
The parties to this memorandum of Understanding recognize and ac-
knowledge that the services performed by the City employees covered by
this Agreement are essential to the public health, safety and general
welfare of the residents of the City of Atascadero. Association

agrees that under no circumstances will the Association recommend,
encourage, cause or permit its members to initiate, participate in,
nor will any member of the bargaining unit take part in, any strike,
sit-down, stay-in, sick-out, slow-down or picketing (hereinafter col-
lectively referred to as work-stoppage) , in any office or department
of the City, nor to curtail any work or restrict any production, or
interfere with any operation of the City. In the event of any such
work stoppage by any member of the bargaining unit the City shall not
be required to negotiate on the merits of any dispute which may have
given rise to such work stoppage until said work stoppage has ceased.
In the event of any work stoppage, during the term of this Memor-
andum of Understanding, whether by the Association or by a Member of
the bargaining unit, the Association by its officers, shall immediate-
ly declare in writing and publicize that such work is illegal and un-
authorized, and further direct its members in writing to cease the
said conduct and resume work. Copies of such written notice shall be
served upon the City. If in the event of any work stoppage the Asso-
ciation promptly and in good faith performs the obligations of this
paragraph, and providing the Association has not otherwise authorized,
permitted or encouraged such work stoppage, the Association shall not
be liable for any damages caused by the violation of this provision.
However, the City shall have the right to .discipline, to include dis-
charge, any employee ;who instigates, participates in, or gives leader-
ship to, any work stoppage activity herein prohibited, and the City
shall also have the right to seek full legal redress including dam-
ages, as against any such employee.

MEMORANDUM OF UNDERSTANDING
BETWEEN THE CITY OF ATASCADERO AND
• THE ATASCADERO FIRE CAPTAINS BARGAINING UNIT
This Memorandum of Understanding is entered into between the Em-
ployee Relations Officer of the City of Atascadero, hereinafter re-
ferred to as "City., " and the Fire Captains' Bargaining Unit of the
Fire Department Employees Association, hereinafter referred to as
"Unit, " and made pursuant to California Government Code Sections 3500
et seq, City of Atascadero Ordinance No. 24 , dated July 14, 1980, and
the City of Atascadero Resolution No. 12-80, dated July 14, 1980 and
subsequent amendments thereto.
The parties have met and conferred in good faith, regarding employ-
ment terms and conditions for members of the Unit as recognized by the
City of Atascadero on April 13, 1981, and, having reached an agree-
ment, as herein set forth, submit this memorandum to the City Council
with a joint recommendation that that body resolve to adopt the terms
and conditions and take such other additional actions as may be neces-
sary to implement its provisions.
Section 1. Purpose.
1.1 It is the purpose of this Memorandum of Understanding, here-
inafter referred to as "MOU, " to promote and provide for continuity of
• operation in employment through harmonious relations, cooperation and
understanding between Management and employees covered by the provi-
sions of this MOU and to set forth the understanding reached between
the parties as a result of good faith negotiations on matters set
forth herein.
1. 2 This MOU shall replace and supersede the Memorandum of Under-
standing (MOU) reached between the Unit and "the City, effective July
1, 1982 adopted October 11, 1982, and earlier Memoranda between the
Atascadero Fire Captains' Association and the Board of Directors_ of
the Atascadero Fire Protection District.
Section 2.0 Full Understanding, Modifications, Waiver .
2.1 This MOU sets forth the full and entire understanding of the
parties regarding the matters set forth herein. Any other prior or
existing understanding or agreement by the parties, whether formal or
informal, regarding any such matters, are hereby suspended or termin-
ated in their entirety, if in conflict with this Memorandum.
2. 2 No agreement, alteration, understanding, variation, waiver or
modification of any of the terms or provisions contained herein shall
in any manner be binding upon the parties hereto unless made and exe-
cuted in writing by both parties hereto and, if required, approved and
implemented by the City Council.

2. 3 The waiver of any breach, term or condition of this Agreement
by either party shall not constitute a precedent in the future en-
forcement of all its terms and provisions. •
Section 3.0 Sick Leave.
Fire Captains shall earn and use sick leave subject to the provi-
sions of Section 9 .5 of Resolution No. 12-80, dated July 14, 1980.
Sick leave credited from either District or City service may be used
as available and needed subject to the City' s Personnel Rules and Reg-
ulations, except that any sick leave used shall first be deducted from
the credited amount carried over from District service until such
credits are exhausted. It is agreed that nothing herein shall be con-
strued as providing any vested right, monetary or otherwise, to any
unused sick leave existing at time of discharge or voluntary separa-
tion from City service, or at time of retirement in accordance with
the City' s Public Employees Retirement System contract.
Section 4.0 Vacation.
4.1 Vacation leave shall be credited, computed and used as speci-
fied by Section 9 .0, Employee Benefits, of Resolution No. 12-80, dated
July 14 , 1980.
4. 2 It is agreed and understood that the taking of vacation shall
be as scheduled by the Fire Chief subject to the needs of the City.
Section 5.0 Salaries. •
5.1 Effective as soon as possible and retroactive to July 1, 1983
the City will implement a new salary plan. The plan will have three
designations: Trainee, Qualified, and Fully Qualified. Salary rates
for the Qualified and Fully Qualified shall be 10% apart, with the
Trainee position up to 10% less than the Qualified rate depending upon
the qualifications of the applicant. Initial appointments to a clas-
sified position for those meeting all of the basic qualifications for
that position will be at the Qualified level. Eligibility for ad-
vancement to the Fully Qualified level will be after the completion of
three years of uninterrupted satisfactory service at the Qualified
rate in the classification. Advancement to the Fully Qualified level
will require that the employee' s overall performance is fully satis-
factory, as evidenced by the recommendation of the Department Head.
Applicants not meeting the basic qualifications for a position at
time of hire or promotion to a higher classification will be desig-
nated as Trainees and paid at the Trainee rate. Advancement to the
Qualified designation and pay rate may take place whenever the em-
ployee meets the basic qualifications for the position, as evidenced
by the recommendation of the Department Head, but must take place by
"the end of the employee' s probationary period. Thereafter, advance-
ment from the Qualified designation and pay rate shall be as set forth
above.

If, upon promotion to a higher classification at the Qualified pay
rate, the new classification would result in an employee receiving
less than a 5% gross wage increase, the employee will be placed at
that exact salary level which, will provide for a 5% gross increase
over his/her previous gross salary level. Additional adjustments will
be made, if necessary, to maintain the minimum 5% gross pay differen-
tial over the employee' s gross pay if he/she had remained in his/her
old classification. Such adjustments, however, cannot exceed the
Fully Qualified pay rate for the new classification.
5. 2 Salaries under the new salary plan shall be as set forth in
Exhibit I, attached hereto. Salaries set forth in Exhibit I shall
become effective for Unit personnel on August 6, 1983 modified by the
following: (a) Unit personnel advancing to the Fully Qualified rate
pursuant to paragraph 5.1 above, prior to August 6 , 1983, will have
their salary computed in accordance with the Maximum Rate of the Fis-
cal year 1982-83 Salary Plan; (b) Unit personnel who do not qualify
for the Fully Qualified designation or did not receive a merit equiva-
lency pursuant to paragraph 5. 3 below, will continue at their Fiscal
Year 1982-83 Base Salary rate until August 6, 1983 ; (c) Unit personnel
advancing subsequent to August 6, 1983 will_ do so in accordance with
the Fiscal Year 1983-84 Salary Plan (Exhibit I) .
5.3 Effective June 30, 1983 the Merit Salary Program is termin-
ated, and all merit pay shall cease. Any employee, however, who would
receive a decrease in their gross salary on that date as a result of
changing to the new salary plan will continue to receive the equiva-
lent of their Fiscal Year 1982-83 merit adjustment until such time as
rate adjustments under the new salary program result in gross pay
equal to or greater than the merit pay. Thereafter, the equivalent
payment shall cease.
5. 4 The Association acknowledges that numerous Personnel Rule
amendments will be necessary to implement the salary plan changes. A
copy of all proposed changes will be provided to the Association prior
to their adoption. Upon request, the City will consult with the Asso-
ciation regarding them.
5. 5 For purposes of police-fire comparison Fire Captain shall be
compared to Police Sergeant, Fire Engineer shall be compared to Police
Officer with no comparable basic fireman vs. police classification.
Section 6.0 Medical/Dental Benefits.
City agrees to pay for all medical and dental benefits for each
Fire Captain employee at the rate and coverage prevailing under the
City' s medical and dental program as now exists through City' s Parti-
cipation in the Central Coast Cities Self-Insurance Fund, known as the
Self-Insurance JPA. It is agreed that the City will pay for Fiscal
Year 1983-84, dependent medical and dental coverage up to $68.00 per
month. For those employees without dependents or who do not choose to
enroll their dependents in the City plan, the $68 .00 shall be paid to
the employee as an addition to his/her regular salary.

Section 7.0 Overtime.
City agrees to pay all Fire Captains overtime, upon certificationi
by the Fire Chief using authorized time card forms, for any overtime
worked in excess of the established 56 hour work week. (This is
equivalent to 121. 33 shifts per year. ) Such overtime shall be com-
puted using the rate of time and one-half applied to the 56 hour work
week hourly wage scale for the individual concerned.
Section 8.0 Holiday Time.
Unit employees shall receive five and 13/100 (5.13) shifts time as
Holiday time for the term of the Agreement. Holiday time will be
credited at eleven (11) hours per month.
Section 9.0 Term Life Insurance.
City shall maintain a_ term life insurance policy for each unit
member in a total amount of Fifteen Thousand Dollars ($15,000.00) and
shall pay all premiums for such policy during the term of this Agree-
ment.
Section 10.0 General Benefits.
It is agreed that compensatory time off (CTO) , retirement and any
other benefits and conditions of employment shall be as specified by
City Resolutions No. 12-80 and 52-82 and City Ordinance No. 24.
Section 11. 0 Retirement.
Effective January 1984, the City shall make available the 1959
survivors Benefit for all unit employees.
Section 12. 0 Probationary Period.
Effective July 1, 1983, the probationary period for newly hired
employees shall be increased to eighteen months. The probationary
period for employees promoted to a higher classification shall be
twelve months in the new classification.
Section 13.0 Effective Date.
It is understood and agreed that the provisions of this MOU shall
be effective as of 0001 a.m. , July 1, 1983, and shall remain in ef-
fect, unless modified by mutual agreement, until midnight June 30,
1984.
Section 14.0 Implementation.
14. 1 This MOU constitutes a mutual recommendation to be submitted
to the Atascadero City Council. It is understood that this MOU shall
not be binding upon the parties either in whole or in part unless and
until said City Council: (a) acts, by a majority vote, formally to
approve and adopt said MOU, (b) and acts in a timely manner to appro-
priate the funds necessary to implement the provisions of this MOU

which require funding.
14. 2 Notwithstanding the foregoing, in the event the City Council
fails to take all of the actions necessary for timely implementation
of this MOU, either party may request the renewal, of the meet and con-
fer procedure.
Section 15.0 Provisions of Law.
15.1 This MOU is subject to all current applicable federal, state
and local laws, regulations and resolutions. All ordinances, rules
and regulations enacted by the City Council- shall be subject to the
appropriate revisions, amendments and deletions necessary to conform
with the purpose, intent and application of the provisions of this
Agreement.
15.2 If any part or provision of this MOU is in conflict or in-
consistent with such applicable provisions of federal, state or local
laws or regulations, or is otherwise held to be invalid or unenforce-
able by any tribunal of competent jurisdiction, such part shall be
suspended and superseded by such applicable law or regulations, and
the remainder of this MOU shall not be affected.
Section 16.0 Applicability of Other MOD' s, Rules and Regula-
tions.
It is agreed that all provisions of any existing or prior MOU' s, _
understandings or personnel policies, customs, practices and actions
not specifically included in Ordinance No. 24 and associated rules and
regulations adopted by the City Council of the City of Atascadero,
shall be superseded by the provisions of this MOU.
Section 17 .0 Management Rights.
The authority of the City includes, but * is not limited to the ex-
clusive right to determine the mission of its constituent departments,
'commissions and boards; set standards of service; determine the proce-
dures and standards of selection for employment and promotion; direct
its employees; take disciplinary action for "just cause" ; relieve its
employees from duty because of lack of work or for other legitimate
reason; maintain the efficiency of governmental operations; determine
the methods, manning and personnel by which governmental operations
are to be conducted; determine the content of job classifications;
take all necessary actions to carry out its mission in emergencies;
exercise complete control and discretion over its organizations and
the technology of performing its work; provided, however, that the

SUBJECT: Payment of one-time fee for South Atascadero City Park
Lease
DATE: August 17, 1983
One July 1, 1981, the City signed a 20-year lease with the
State of California for the use of approximately 20 acres of
property for the development of the South Atascadero City Park.
This lease required the payment of $750 for a one-time fee and
such funds were included in the Fiscal Year 1981-82 Budget. For
reasons unknown, the State never called for these funds which
have since been included as a carry-over into subsequent budget
• years.
A recent audit by the State of their lease contracts revealed
this oversight and we have discussed this matter with the Atasca-
dero Hospital Administrative Office. We have since received the
invoice (copy attached) .
It is recommended that Council be requested to transfer $750
from the Contingency Reserve to the Parks and Zoo Department so
that this obligation can be satisfied.

Recommendation
It is recommended that City Council award the Street Striping
Bid to Safety Striping Service, Fillmore, CA. in the amount of
$8,835.25. This was the sole bid received for this project.
Background
Street striping is an ongoing maintenance project that has in
• the past been accomplished by San Luis Obispo County road crews.
We have recently been informed that the County will not be available
to perform this function due to equipment problems.
Funds for this project are in account #02-41-2240-0039 - Maintenance
Materials - Street Division.

LOCATION: 9610 Atascadero Avenue (Ptn. Lot 3 , Block 13)
APPLICANT: Cecil Barrett (Contract Survey and Design)
On March 14, 1983 , the City Council approved Lot Line Adjustment LA
830113 :1, which adjusted existing lot 'lines to eliminate building
encroachments, subject to certain conditions and in concurrence with
the recommendation of the Planning Commission.
The zoning is RSF-Y and the General Plan designation is Moderate Den-
sity Single Family Residential. Staff review has determined that all
conditions of approval have been met. On August 15,1983, the Plan-
ning Commission reviewed the matter on its Consent Calendar and rec-
ommends acceptance of the Final Map.

LOCATION: 7383 El Camino Real
APPLICANT: Shirley Butterfield
REQUEST: To establish a card room consisting of three tables.
Section 636. 010 of the Business LicenseOrdinance requires City Coun-
cil approval of a business license for a card rom. The Council may
"limit the number of such licenses which, in its judgement, shall be
for the best interest of the public peace, safety and welfare. " This
particular business license application involves a change of ownership
• of an existing card room.
The Police Chief has conducted a background investigation on the ap-
plicant and finds no reason not to grant the license.
RECOMMENDATION
Staff recommends that a business license for Camino Card Parlour at
7383 El Camino Real be issued to Shirley Butterfield.

SUBJECT: Revenue Sharing public hearing prior to final passage of
Fiscal Year 1983-84 Budget
DATE: August 17 , 1983
Revenue Sharing procedures require that a public hearing be
held prior to the final passage of the annual budget. Purpose of
this hearing is to give citizens the opportunity to comment on
the relationship of revenue sharing funds to the entire budget.
This hearing has been properly noticed for the August 22, 1983
Council meeting.
Your attention is invited to pages 72-73 of the Preliminary
• (Proposed) Budget, Fiscal Year 1983-84 , which contains a listing
of $406 ,250 in capital items utilizing Revenue Sharing Funds.
These Revenue Sharing expenditures are part of the total budget
of $4 ,503 ,875. The total Fiscal Year 198384 budget figures will
have some slight adjustments once our MOUs have been ratified and
the budget resolution is returned to Council for final adoption.

I trust you recognize that , in light of increasing military
conflict around our world, the dangerous proliferation of nuclear
arms and radically-expanding military budgets, peace-making has
• _ become the most urgent human work of our times. ,
Toward that end , I write to urge you personally and the other
members of the Atascadero City Council to go on record in support
of the Peace Package I introduced in the California Legislature on
'July 15, 1983 (consisting of seven Assembly 'Joint Resolutions -
AJRs 70 through 76) .
I especially ask you to take the lead role in introducing before
your Board a resolution endorsing this Peace Package. Only if all
leaders at all levels of government acknowledge the necessity for
a world at peace and act toward its realization, can we ever hope
to provide a safe and healthy environment in which to raise our
children.
Our continual fear of war drains our energies and funds which
leaves less of both to apply to meeting the needs and solving the
problems of the citizens which you and I were elected to serve.
In a world at peace, vastly greater resources would be available
to provide our children, all our people and ourselves with the
opportunities and support needed for healthy human development.
I urge you to meet the greatest challenge facing us all - both as
elected representatives and as human beings . The time is now. A
difference must, and can, be made. You and I can, and must, make
• that difference - and truly begin our journey toward a peaceful
world. Will you join me in this mission now?

SUMMARY "THE PEACE PACKAGE"
AJR 73 urges the President and Congress to establish a
National Peace Academy--dedicated to facilitating research,
developing curricula, and training government leaders, military
officials, educators and other public leaders from all over the
world in the concepts and practices of conflictresolution and
peace-making. We have employed our best minds and many billions
of dollars in developing the science of war and destruction,
bringing us to the brink of global catastrophe. We must now begin
to invest our heads and our hearts , our talents and our dollars
in positively developing the science and art of peace and
survival. (This proposal is already introduced in Congress in
both the Senate and House of Representatives. )
AJR 75 urges the United States Senate and House of
Representatives to support current legislation (introduced in the
House of Representatives) establishing a United States-Soviet
Union Student Exchange for Peace Program, involving 2 , 000
students from each country living in the other nation for one
year in order to establish a positive force for peace.
AJR 72 urges the President and Congress to establish a
massive peace-making program called "Soldiers for Peace" . Each
year the United States would invite 100 , 000 Russian citizens from
all walks of life into American homes for a year' s stay;
conversely, the Soviet Union would invite 100 ,000 Americans into
Russian homes. The resulting personal exposure would inevitably
break down barriers of distrust, promote mutual understanding of
each other and the other' s culture and further the establishment
of a more peaceful coexistence. Ultimately, building trust is the
only basis for feeling true security and believing, in peace, and
actually making peace.
AJR 74 urges the President and Congress to establish a United
States-Soviet Union Joint Crisis Management Center dedicated to
improving the communication and the decisionmaking ability within
each country during a crisis when nuclear war is threatened. The
Center' s responsibilities would include:: f 1 1 i den,ti -F-, i n g the root
causes of war, (2) developing methods to reduce the risk of
accidental war, (3) developing accurate detection devices for
nuclear detonation, (4) developing standard operating procedures,
standard messages and specific procedures to be used in a crisis ,
and (5) designing realistic steps in conflict reduction and
management. We are growing more aware that the greatest threat to
peace lies not in the U. S.-Soviet military capabilities , but in
our respective incapacity for crisis management and
decision-making.

AJR 76 urges the United States Senate to approve a resolution
calling for an immediate halt to the implementation and
deployment of nuclear weapons , to develop a plan for a verifiable
nuclear weapons freeze, and a reduction in all nuclear weapons
possessed by the United States and the Soviet Union. This
proposal has been introduced in Congress, and,,-, was passed by the
House of Representatives in May on - a vote of 287 to 149.
Californians last November approved Proposition 12 , calling for a
verifiable bilateral nuclear freeze. This resolution furthers
California ' s commitment and adds us again to the several states,
many cities and thousands of persons already actively supporting
the growing international effort for a verifiable bilateral
nuclear freeze.
AJR 70 urges the President and Congress to halt the research,
development, deployment, and funding for the MX missile - a
first strike weapon system which after eight years , $4 . 5 billion
and 30 different basing modes , still has no viable plan for its
implementation.
AJR 71 urges the President and the Congress to halt plans for
the installation in West Germany of the Pershing II missile - a
terrifying destructive , accurate "nuclear war-fighting weapon"
which will have a flight time of only several minutes; it is
perceived as a first strike weapon, and the Soviet Union has
responded that deployment of the Pershing II will result in their
adopting a "launch on warning system" , subjecting the world to an
even greater possibility of nuclear war occurring by a false
alarm.

Whereas, in light of increasing military conflict around our

radically-expanding military budgets, peace-making has
become the most urgent human work of our times , and
Whereas , a continued nuclear arms build-up has the effect of
taking valuable federal dollars away from the city and
weakening domestic employment thereby making it more
difficult to promote the general welfare of city
residents , and
Whereas , only by us acting together and fulfilling our ultimate
responsibility by taking a leading role in positive
efforts toward peace can we hope to secure a peaceful
environment healthy for all human beings , and
Whereas , city council members are elected to represent and
protect the best interests of their constituents ,
providing necessary services , and promoting the
general welfare of the people , and
Whereas , Assembly Joint Resolutions 70-76 , supporting
innovative peacemaking efforts have been introduced
into the California State Legislature, and
Whereas , AJR 73 urges the United States Senate and House of
Representatives to establish a National Peace

members of the California Legislature and the Governor
of California.
