PRESENT: Councilmen Mackey, Molina, Stover , Wilkins and Mayor Nelson ABSENT: None Mayor Nelson noted that the meeting had been called for the pur- pose of interviewing applicants for the open _positions on the Parks and Recreation Advisory Board. Because of the number of applicants , half of them would ;be interviewed this evening and the other half be- fore the Council's regular meeting on July 26, 1982. Council interviewed John Harris, Sylvia Murphy, Gayle Pierce and David Graham. Nellie Livingston and Peggy ,Stoneking of the Overcoming Word of Faith Center gave the invocation. ROLL CALL PRESENT: Councilmen Mackey, Molina, Stover , Wilkins and Mayor Nelson ABSENT: None PUBLIC COMMENT (1) Bruno Adamoli asked if the roads put in by Tennaco, Corp. had been approved by the City. Mr . McPherson said that the plans had been approved, by the City, but that the roads had not yet been accepted into the City systema The Fire Chief stated that fifteen more fire hydrants needed to be installed. (2) Virginia Virgil, representing Hospice, spoke in favor of Hos- pice' s request for funds from the City. (3) Howard Marohn suggested that Council adopt a resolution rec- ognizing the accomplishments of George, Highland as City Councilman. (4) Councilman Mackey stated that the week of July 12-17 is Clean-Up Week. Jolley's has agreed to pick up any appli- ances, heavy junk, or anything else and haul it away during this week. A. MOTION: Councilman Wilkins moved for the approval of the Consent Calendar . The motion was seconded by Councilman Stover and unanimously carried. B. HEARINGS, APPEARANCES AND REPORTS 1. Public hearing on General Plan Amendment GP820330:1, 3555 El Camino Real, Wallace Dunn, to change the General Plan land use designation from Suburban Single Family Residential to High Density Multiple Family Residential and to change the zoning from A-1 to R-4 Larry Stevens, Planning Director , reviewed this application for Council and stated that the Planning Commission had denied the amend- ment based on findings that it would encourage development inconsis- tent with the policies set in the General Plan since it would not be compatible with surrounding land uses and densities. Mr . Dunn, the applicant, stated that there has been a lot of mis- understanding about the project. He withdrew his application for the project site, but inidicated that the project itself was still de- sired. He would continue to try to find a suitable location for the project; he emphasized the need for low cost housing in Atascadero. Ethel Hagen also spoke to the need for low cost housing for Atasca dero' s seniors. Mr. Anderson, an adjacent property owner, thanked 2 0 MINUTES - ATASCADERO CITY COUNCIL - JULY 12, 19* everyone involved with this project. As there were no' other comments, the hearing was closed. No ac- tion was taken since the matter had been withdrawn. Mr . Warden sug- gested that Council have the Planning Commission look into senior housing as a part of their consideration of the Housing Element. Council agreed. 2. Report regarding 3-F Meadows petition for street maintenance Mr . Warden reviewed this matter stating that there were two alter- natives to the maintenance and construction of some non-dedicated and dedicated streets in the City. One is an assessment district and the other is a maintenance district. From a property owner ' s standpoint, the the maintenance district seems the most feasible because the prop- erty owners themselves would decide the level of maintenance. The City would act as a service agency in meeting the property owner de- termined standards. Comments were heard from Joe Carminati , John White, Howard Marohn, and Goldie Carminati. Council was in favor of having the Staff develop more definitive costs for consideration and having a public hearing on the matter to see what the property owners in the area favor . MOTION: Councilman Wilkins moved that Staff develop costs for both options and bring the matter back for further consideration. The motion was seconded by Councilman Mackey and unanimously carried. 3. Recreation Department Quarterly Report Skip Joannes, Recreation Director , reviewed class attendance for Recreation Department programs. He stated that the Recreation Depart- ment is 75% self-sufficient and only his salary and a portion of the clerk's salary come out of the General Fund. He reviewed the progress on the grants. He stated that the one thing the department needs is additional staff and he was looking forward to having an additional full time person after the budget is passed. Mr . Warden reviewed the status of the park consultant selection. He stated that at the present time there are no monies budgeted. $10,500 will have to be allocated by the Council , so he will bring the matter back to them at their meeting on July 26th for approval. Mayor Nelson stated that Skip was doing a great job with limited resources. C. UNFINISHED BUSINESS 1. Resolution No. 31-82 approving amendment to the General Plan Land Use Map along the south side of Morro Road between Pismo Avenue and Santa Rosa Road including approval of General Plan Amendment GP820331:1 (Klowgard) 3 • MINUTES - ATASCADERPICITY COUNCIL - JULY 12, 1982 MOTION: Councilman Wilkins moved that Resolution No. 31-82 be read by title only.. The motion was seconded by Councilman Mackey and unanimously carried. Mayor Nelson read Resolution No. 31-82 by title only. MOTION: Councilman Wilkins moved for the adoption of Resolution No. 31-82. The motion was seconded by Councilman Mackey and unanimously carried. 2. Resolution No. 32-82 approving amendment to the General Plan Land Use map within the Montecito - ElCaminoReal Study Area, including approval of General Plan Amendment GP820204: 1 (Maxwell, Eddy, Hixson) MOTOIN: Councilman Wilkins moved that Resolution No. 32-82 be read by title only. The motion was seconded by Councilman Mackey and unanimously carried. Mayor Nelson read Resolution No. 32-82 by title only. MOTION: Councilman Stover moved for the adoption of Resolution No. 32-82. The motion was seconded by Councilman Molina and unanimously carried. 3. Resolution No. 33-82 approving General Plan Amendment GP820419:1 (Planning Commission) amending the text of theft Lane Use Element of the General Plan eliminating specific standards for the keeping of animals MOTION: Councilman Wilkins moved that Resolution No. 33-82 be read by title only. The motion was seconded by Councilman Mackey and unanimously carried. Mayor Nelson read Resolution No. 33-82 by title only. MOTION: Councilman Wilkins moved for the adoption of Resolution No. 33-82. The motion was seconded by Coucilman Stover and unanimously carried. 4. Resolution No. 34-82 denying General Plan Amendment GP820330:1 concerning a change in land use designation from Suburban Single Family Residential to High Density Multiple Family Residential MOTION: Councilman Wilkins moved that Resolution No. 34-82 be read by title only. The motion was seconded by Councilman Molina. Mr . Stevens stated that since Mr . Dunn had withdrawn his applica- tion in B-1 above, it is not necessary to adopt this resolution. The motion was withdrawn. 5. Ordinance No. 56, Health and Sanitation - second reading and adoption 4 • MINUTES - ATASCADERO CITY COUNCIL - JULY 12, 1982 • MOTION: Councilman Wilkins moved that Ordinance No. 56 be read by title only. . The motion was seconded by Councilman Molina and unanimously carried. Mayor Nelson read Ordinance No. 56 by title only. MOTION: Councilman Wilkins moved that this constitute the second reading of Ordinance No. 56 and that it be adopted as amended. The motion was seconded by Councilman Mackey and unanimously carried by roll call vote. D. NEW BUSINESS 1. Request of the City of Seal Beach for consideration of adopt- ing a resolution requesting the State to fund certain por- tions of the costs of the 911 Emergency Telephone system Mr . Warden stated that the City of Seal Beach is asking every city in the State to support their request for State reimbursement of ex- penses connected with the 911 Emergency Telephone system which may not have been specifically required by the State. MOTION: Councilman Wilkins moved that the Council take no action on this request. The motion was seconded by Councilman Mackey and unanimously carried. E. ATASCADERO COUNTY SANITATION DISTRICT BUSINESS 1. Appointment of Allen Grimes as Attorney for the Sanitation District Board 2. Appointment of Mayor as President of the Sanitation District Board MOTION: Councilman Molina moved that Council recess and convene as the Atascadero County Sanitation District Board of Directors. The motion was seconded by Councilman Stover and unanimously carried. MOTION: Director Wilkins moved that the Board appoint Allen Grimes as Sanitation District attorney effective June 1, 1982, and that the Mayor be appointed President. The motion was seconded by Director Stover and unanimously carried. MOTION: Director Wilkins moved that the Board adjourn and reconvene as the City Council. The motion was seconded by Director Stover and unanimously carried. F. INDIVIDUAL DETERMINATION AND/OR ACTION 1. City Council Council had nothing. 2. City Attorney 5 MINUTES - ATASCADEROCITY COUNCIL - JULY 12, 1982 Mr . Grimes had nothing. 3. City Manager (a) Mr. Warden stated that there was a problem concerning the MOU signed with the Firefighters and Fire Captains about paying for dependent insurance. The MOU states that the City will pay all dependent insurance. He asked for Council authorization to continue to pay this until negotiations are finalized. MOTION: Councilman Mackey moved that the MOU continue until negotia- tions are completed. The motion was seconded by Councilman Wilkins and unanimously carried by roll call vote. (b) Mr . Warden advised that the League of California Cities Channel Counties Division quarterly meeting will be held on August 6 and 7, 1982 at Vandenberg. (c) Mr. Warden requested a closed session to discuss labor negotiations. He does not anticipate that there will be any announcement at the conclusion of the meeting, however , Council will adjourn to Tuesday, July 13, 1982, at 7: 30 p.m. in Room 304 for a study session to consider a variety of organizational matters. Councilman Nelson brought up the matter of a resolution honoring George Highland and Staff was directed to prepare one. The meeting adjourned at 9: 05 p.m. Recorded by: BARBARA NORRIS, City Clerk By: Ardith Davis Deputy City Clerk 6 MINUTES - ATASCADERO CITY COUNCIL Adjourned Regular Meeting July 13 , 1982 7: 30 p.m. Atascadero Administration Building The meeting was called to order at 7: 30 p.m. by Mayor Nelson. PRESENT: Councilmen Mackey, Molina, Stover , Wilkins and Mayor Nelson ABSENT: None Mayor Nelson stated that the meeting was called for the purpose of having a study session on the various items listed on the agenda. He stated that he would like the meeting to adjourn by 10: 00 p.m. and, if all agenda items were not discussed, another study 'session could be scheduled. 1. General meeting procedures Mayor Nelson stated that he would like Council to consider meeting on Tuesday nights rather than Monday nights. He felt that this would give Council additional time to study their agenda packets. He would also like to have study sessions before Council meetings to discuss any agenda items Council feels need additional study. Council members discussed this matter and decided to leave the meetings on Monday . nights for the time being. Mr . Warden stated that if Council felt it needed additional time, it could be arranged to have the agenda pack- ets come out a day early. Mayor Nelson suggested a time for Council to speak on items not on the agenda at the beginning of the meeting. Mr .. Warden stated that a time after Public Comment would be set aside for Council on the agen- da. Mayor Nelson also suggested that Council suggest items for the next Council meeting at the end of the meeting. 2. Clerk & Treasurer Barbara Norris , City Clerk, reviewed the way she felt the City Clerk' s office should be run. She stated that she wanted an office independent of the City Manager ' s office and needed to staff that of- fice with people she has confidence in. She sees the City Clerk' s office as an information and public relations center . She sees this operation evolving over a period of six months. She also stated that she would like to purchase the new City Clerk' s Handbook which will be coming out soon at a cost of $100; also, she would like to attend some workshops. Mrs. Norris felt that the distribution and/or opening of the mail should be handled by the City Clerk's office to some extent. Council discussed these matters and the handling and distribution of the mail at length. Mr. Warden took issue with the fact that the memo from the City Clerk and attachments thereto given to the Council were not provided to him by the City Clerk. He pointed out several inaccuracies in Mrs. Norris' memo. Also he did not see how the mail MINUTES - ATASCDERO&TY COUNCIL - JULY 13 198 situation would be better - served by Mrs . Norris' handling of it- as opposed to the way it is currently being handled. Comments were heard from Kathleen Daly, John Daly, George Highland, and Ed Halliday. A majority of the Council decided that the Clerk' s office would be an independent function with no staff at this time, however , they would reevaluate the situation at the Council' s second meeting in Oc- tober . Regarding the mail, it was decided that it would continue the way it is; the City Clerk' s mail will go to the City Clerk, individual Councilmembers mail will go to them, and the rest being handled as it currently is being handled: Mr. Rizutto.' reviewed his activities with the Finance Department indicating that thingswere working very well. He requested that Council review Ordinances No. 7 and 49 and make a determination as to whether those ordinances describe the job as they want it done. He requested a time on the Council agenda to make a comment and also that a place be provided for him at the front of the meeting room. He would like additional clarification so he knows absolutely when to give the money to the Director of Finance. Mayor Nelson stated that Council would pick up with this matter at their next study session. The zoning is A-1 and the General Plan designation is Suburban Single Family. Staff review has determined that all conditions of approval have been met. On July 19, 1982 the Planning Commission reviewed the matter and recommended acceptance of the Final Map. On June 21, 1982 and July 6, 1982 the Planning Commission conducted a public hearing on the subject matter and denied the request on a 4-3 vote (Commissioners Lilley, LaPrade and Carroll dissenting) , based on the Findings set forth in the attached memorandum dated July 6, 1982. The attached Staff Report dated June 21 contains additional material on the request including Findings and Conditions in support of the Planning Department recommendation to approve the project. There was considerable ,discussion among the Commission on this pro- ject, including discussion of the revised site plan and drainage in- formation presented at the July 6 hearing. Major concerns raised by the Commission in its discussion included the effect of traffic on the residential neighborhod, drainage problems in the area, the appropri- ateness of the scale of the proposed building in relation to its sur- roundings, objections raised by many of the residential neighbors of the proposed church facility and the overall compatibility of the pro- ject with the rural atmosphere of the neighborhood. Concerns raised by the Commission were both pro and con, but it was their consensus to deny the project. They indicated concurrence with the Staff recommenda- tion to approve subject to conditions. They did question the drainage acceptance letter required in Condition #7b. At the July 6 hearing, they presented the revised plan described in the July 6 memo request- ing its approval. On June 21, 1982 the Planning Commission conducted a public hearing on the above-referenced matter and directed Staff to prepare findings to deny the project. Those findings are as follows: 1. Traffic generated by the proposed church facility exceeds that which is desirable for the surrounding rural residential neighbor- hood and could result in potentially negative effects on that area. . 2. There are existing drainage problems in the vicinity of the sub- ject property and development of the site as proposed will in- crease the volume of drainage run-off to an unacceptable level even with the use of a retention basin. 3. The size and scale of the proposed church facility is out of char- acter with that of the surrounding single family residences. 4 . The proposed use will not be compatible with existing and future rural residential uses in the surrounding area. 5. Proposed plans cannot be reasonably revised to mitigate concerns raised regarding the compatibility of the church with the sur- rounding area. The Commission should review and revise these suggested findings as deemed necessary. ' The applicant has submitted the attached revised plot plan with the intention of trying to address some of the physical development con- cerns of the surrounding property owners. The following is a summary of those changes: 1. The developed portion of the site is 15 feet narrower . 2. The structure has been moved 17 feet to the northwest. S3. Parking has been reduced from 216 spaces to the minimum required 114 spaces. 0 Conditional Use PeAt U820521:1 (Church of L.D.S. ) 4 . Side lot line landscaping has been increased from the previous five foot width to 20 feet. . 5. The previous retention basin design of 10 feet of landscaping and 41 feet of asphalt parking area has been revised to a 65 foot deep landscape area. These changes do not affect the previous conditions of approval pre- sented in the Staff Report, except the approval should reference the revised plan. The applicant has also provided comments (attached) relating to on-site traffic, noise, appearance and lighting. The applicant has expressed one additional concern - that of obtain- ing a drainage acceptance letter from affected property owners as set in Condition #7b. Staff feels that the revised plans do provide a more effective visual buffer through the increased landscaping, and that the amount of drainage run-off will be reduced by decreasing the impermeable surface area. These revisions should be given favorable consideration. It is also my understanding that the applicant is also preparing a more de- tailed analysis of the drainage, but that study has not yet been submitted. RECOMMENDATION The Planning Department recommends approval of Conditional Use Permit U820521:1, subject to the Findings and Conditions in the attached June 21 Staff Report, except that the revised site plan should be approved. The Planning Director recom- mended approval of the revised site plan. Jerry Hurley, tepresenting the applicant, responded to the com- ments and concerns raised at the previous meeting and gave a pre- sentation on the revisions that have been proposed with the re- vised site plan. Dennis Bethel, engineer for the applicant, discussed a grading and drainage plan that had been prepared and addressed mitigation mea- sures that would help alleviate some of the drainage concerns. Roger Keep, member of the L.D.S . Church, spoke in support of the request and cited some traffic statistics that had been taken along Atascadero Avenue for the driving members of the Church for Sunday services, and commented on alternatives involved if the church could not utilize the subject site. Carl Brown, Santa Rosa Road resident, stated that the Findings for denial were more than adequate in denying the project and felt the plans could not be revised in such a manner as to result in a change in these findings. Rick Ward, Old Santa Rosa Road resident, noted his major concern in opposition to the project related to the traffic problems and felt the site would be more compatible if homes were built instead. Robert Cheung, Atascadero Avenue resident, spoke in opposition to the project and disagreed with the applicants that the church facility would not be utilized heavily. Lee Monson, area resident and member of the church, spoke in favor of the proposed project and stated that there would be several social activities at the church. Mr. Monson also spoke on the ef- forts made in trying to locate a suitable piece of property and felt that the project conforms with the zoning requirements. Jack Bray, Atascadero Avenue resident, spoke in opposition to the project and also concurred that residential homes would be much more compatible. Clara Cheung, Atascadero Avenue resident, also voiced her objec- tion to the project noting the area is predominantly single family residential and the proposed church was a high density use. Mrs . Cheung also felt the property values in the neighborhood would be affected if the church were allowed to be built. • • Minutes - Planning Commission. - Regular Meeting - 7/6/82 Ramona Phillips, area resident and member of the Church, spoke in support of the request stating she has worked at Santa Rosa School for many years and did not feel that traffic would be a significant problem. Betty Anderson, Portola Road resident, spoke in favor of the project stating she has lived next to a Mormon church for many years and never encountered any problems. Henry Adams, Atascadero Avenue resident, spoke in opposition to the request and asked how emergencies would be handled because he felt the street width was inadequate to handle emergency type vehicles. Theresa O'Bannon, Atascadero Avenue resident, stated her property shares the subject site' s property line and voiced her concern over a church of such a large size being built there as it would greatly effect her present view of the area. Warren Sudley, Cascabel resident and member of the church, noted the Church' s efforts in trying to find a location for several years and felt that churches are compatible in residential neighborhoods. Mike Goodman, Olmeda resident, stated there are three churches within a block of his home and noted there were no significant changes in traffic patterns due to the church activities. Eugene English, Santa Rosa Road resident, pointed out that the neighborhood is one of low density with scenic views and felt that a church of this size was totally incompatible with the neighborhood. Loren Bee , San Anselmo resident, spoke in support of the church stating that Atascadero Avenue was updated around three to four years ago to 20 feet in width with a proper base, but noted the drainage in this area has always been a problem. CHAIRMAN MOORE CALLS A TEN MINUTE BREAK FROM 8: 45 TO 8: 55 P.M. Upon recovening, Richard Andres and Carl Brown summarized the comments and concerns that were voiced by those in support and in opposition of the project. Tom O'Brien and Eugene English, Santa Rosa Road residents , voiced their concern on the drainage that runs from Santa Rosa School and felt this problem would only be increased if the church is built. Dennis Lockridge, Atascadero Avenue resident, agreed with the previous testimony given by the area residents and felt that the present road width was inadequate to carry the increased traffic that would be generated by the church. Mr . Hurley noted the use of the church during the week would be minimal and would not be in direct conflict with the school with regard to traffic. Dr. Robinson stated he understood the concerns expressed by the area residents and noted he had looked over all available prop- erties in Atascadero and felt the Atascadero Avenue site was most • appropriate for the facility. There was considerable discussion among the Commission concerning the main issues raised in the public testimony given which in- cluded appropriate drainage mitigation measures, increased traf- fic, as well as whether or not another piece of property could be located within the City which would adequately serve the church' s needs. Warden P.O. Box 747 Atascadero, CA 93422 Dear Mr. Warden: This letter is in reference to an item that will be on the July 26th City Council agenda. As you are probably aware the Church of Jesus Christ of Latter Day Saints is attempting to purchase land and construct a building in Atascadero. After a 3 year search, a site has been chosen and is avail- able for purchase. It is located at 9240 Atascadero Avenue directly across from Santa Rosa School . This particular property is in accordance with the general plan of the City of Atascadero and conforms to the requirements of the Church. The Church applied to the Planning Commission for a use permit and was turned down on a 4-3 split vote at the July 5th Planning Commission meeting. We feel this vote was based on the emotional feelings generated by a few neighbors who are opposed to the project. We are now appealing to the City Council the decision made by the Planning Commission. This appeal is being made for the following reasons. 1. We feel the project was denied arbitrarily. 2. The property and the proposed building conform to the 1980 general plan of the City of Atascadero and meet all require- ments of the City planning staff. A. The property is a R-A, moderate density residential zone which allows for churches. B. The property is located on, and serviced by, two undivided arterial roads , Atascadero Avenue and Santa Rosa. Itis also within 2 blocks of the freeway. C. The property is within the urban services area. 3. The project is supported by the professional planning staff of the City of Atascadero. Even after being directed by the Planning Commission to find reasons to deny the use permit, the staff publicly expressed that they did not support those findings and are still in support of the proposed project. Mr. Warden July 13, 1982 Page 2 4. The majority of the Churches within the city proper are located in, and compatible to, single family resident- ial areas. Churches are not compatible in commerical or industrial areas, nor should be confined to out of town locations. 5. We feel the neighbors who are opposing the project are concerned about items that have been resolved or do not exist. The attitude they have at the present time makes it impossible for us to help them understand that the Church and building is not a threat to them or their neighborhood. Attached to this letter you will find information which supports the above five points. We request your support in approving the conditional use permit and supporting our appeal of the planning commission decision. One of us will contact you personally, as a representative of the Church. to show you the proposed property, plans for the building and answer any questions you may have. Respectfully, i Bishop Lee Monson Bishop7arry Kessinger i Supporting Information The major concerns expressed by a few neighbors centered around noise, drainage, the amount of use of the building, the size and appearance of building, and traffic. Several of these concerns were also mentioned in the 16 recommendations made in the planning staff report, particularly drainage and appearance. Noise - The only real noise problem that could come from the inside of the building would be from activities in the cultural hall . A look at the floor plan shows 3 separate walls , separated by corridors and classrooms, from the cultural hall to the exterior of the building. This will effectly reduce and eliminate any noise from this area, even extreme level noises. The exterior of the building is masonry, with a tile roof and fully insulated.. The exterior buffer zones , which are heavily landscaped areas, will greatly reduce or elim- inate other outside noises such as vehicles coming and going in the parking area. Drainage - The drainage concerns have been resolved. The water runoff from Atascadero Avenue that spills on the proposed site, plus the drainage from the property itself, will be considerably less than presently exists. Both the engineer hired by the Church and the City Engineer substantiate that the existingdrainage will be greatly improved over the existing conditions. Use of the Building - At least two neighbors were concerned over the amount of use of the building. The following information should help show what the actual use of the building will be. This information is based on the histori- cal building usage. The heaviest use of the building will be on Sunday. On Sunday the building will be used primarily between the hours of 8:30 a.m. to S 4:30 p.m. During the day time the building would be used less than 20 hours a week (excluding Saturday and Sunday) between the hours of 7:00 a.m. and 7:00 p.m. Any day activities are small group (less than 15 people) except for a twice a month Ladies Auxiliary Luncheon which would be attended by approximately 35 ladies. Evening use of the building would be Tuesday through Saturday normally from 7 to 10 p.m. Tuesday and Wednesday evenings the largest group size would be 25. Thursday evening the largest group size would be 50 to 60 people. The Tuesday, Wednesday and Thursday meetings and activities do not meet every week but average twice a month. Friday and Saturday night use would vary greatly depending on the actitivies. Dances (4-5 a year) would draw between 80 to 100 people; a play production (once every 2 years) would attract approximately 250 people; a ward dinner Would attract about 150 people; scheduled basketball games traditionally have about 50 to 60 people attend including the players. None of these activities would go beyond midnight and most would end long before that hour. As you can see the building would be used between 40 to 50 hours per 7 day week at the most. This could not be considered heavy use. We do not rent or lease the Church building or facilities so the hours described above are accurate. • -2- • Size and Appearance of the Building - Concern has been expressed as to the size of the building and t e exterior appearance. During the previous hearing our roposed building was compared to a supermarket. Looking at the elevation views if the building, it obviously does not resemble a supermarket in any way. The height of the building is 31 feet from the ground level to the ridge. Most of the trees on and around the existing property are taller than this. To gain a perspective of the height a two story house is 25 feet high normally. The eave lines of the building are 8 feet high which is the same as a single story house. The front of the building facing Atascadero Avenue is 112 feet long, many of the newer homes in the area are 70 to 80 feet or Tonger. The proposed building physically covers only 10% of the 5 acre parcel . There are no programmed additions to this building. This building is a complete building as shown. The Church's buildings have purposely been designed to fit in residential areas . In fact the greatest majority of the thousands of LDS churches that exist in the United States are found in, and are compatible to, residential neighborhoods. I am sure this is true of most other Churches as well . The existing trees on the property will remain and new landscaping will be done as much as possible with plants that are native to Atascadero. Traffic - The key point relating to traffic is that the Church traffic will not be in competition with the school traffic or traffic caused by people coming or going to work. We have no meetings or activities between 8 to 9 in the morning and 2 to 6 in the afternoon when the school or worker traffic is a problem. We will not contribute to this traffic problem that exists at all . The traffic the Church will generate will be in the evenings or on Sunday which are normally 0,ight traffic times. By actual count the June 27th Sunday morning meeting had 45 cars at the existing LDS Church. building. The afternoon meeting generated 58 cars , most of which already travel down Atascadero Avenue to get to the present Church building. The cars do not all arrive at the same time, they spread over at least a 30 minute period. This car count on June 27th was a normal Sunday which would be typical for 50 Sundays a year. The 114 space parking lot will easily handle the cars for many years to come. Looking at the number of people that participate in the evening meetings and activities you can see that the traffic to and from the Church in the evenings is also not what could be considered heavy. The only time during any given time of the year that there will be a substantial increase of cars would be at Stake Conference which is conducted twice a year. At the last n 525 people attended the a conference (held in June in San Luis Obispo) p op morning session and 567 attended the afternoon session. If 4 to 5 people were in each car the parking lot would be at capacity at this time. The unused portion of the property could be used for overflow parking if it became necessary in the future for these two Sundays. We do not feel the increased traffic generated by the Church as mentioned above will create a problem. Box 747 Atascadero, CA. 93422 r Dear Members of the City Council: I am writing this letter to express my concern over a recent decision by the Planhing Commission regarding a request by the Church of Jesus Christ of Latter-Day Saints. It is my understanding that the Church has appealed a Planning Commission decision (which was contrary to the Planning Staff recommendations), and the item is on your agenda for July 26. Because of my occupation as a teacher and coach I am somewhat hesi- tant to express my feelings on the situation. (I manage to "stick my neck" out enough during the season.). But as council members you are susceptible to much more critidism than a local athletic coach. For this reason I can appreciate the delicate decision that you have. The main reason why I think the building request should be approved is because it meets all the conditions of the city building codes. To not follow the laws of our owm city government seems contrary to the basic precepts upon which our nation was founded. We have only to read the newspaper to see the ultimate abuse that this type of policy sometimes leads to in other countries. I can understand the concern of local residents (although most of their concerns have been integrated into building revisions-none of which are required), but to establish this type of precedent places compounding implications on future construction in Atascadero. I do truly appreciate your concern for our community by evidence of your service on the council. Regardless of your decision, I know you will consider the interests of all the citizens of Atascadero. Sincerely, D ?1ingoarcy • • M_E M_O_R A_N_D_U M_ TO: City Council FROM: City Manager SUBJECT: Park consultant selection The park consultant selection committee -consisting of Marge Mackey, Bill Stover , Donn Clickard, Mark Jensen, Rich Ivie, Larry Stevens, Larry McPherson and Skip Joannes have completed their task of arriving at a recommendation for selection of a park consultant. Five firms were interviewed and the selection committee unanimously recom- mended the firm of Takata Associates (architects)/Edcon (Economic and Fiscal Planning) . The recommended firm is requesting a fee of $14,000 with the project taking approximately three months to complete. Originally it was believed that the grant money would fund the complete cost of the park consultant; however , subsequent checking with the State grants people has revealed that they will only author- ize from grant monies that amount proportional to the park facility funded by the grant. The $131,000 grant (with the approximate $19,000 City match) really only covers a small portion of the total twenty acres and that is the only portion that the consultant' s fees can be reimbursed from grant funds. We believe that the State will allow 25% of the consultant cost to be debited against the grant, but a final determination of that will not be made until the final audit is com- plete after the grant monies have been expended . Accordingly, we will have to amend our Fiscal Year 1982-83 budg- et to increase the $150 ,000 presently in it for the park development by $10,500. Since the Fiscal Year 1982-83 budget is not yet adopted and it is desired to tet the park planning process underway as soon as possible , the Council, if agreeing, is requested to approve the expen- diture of $14 ,000 from Fiscal Year 1982-83; $10 ,500 being allocated from the General Fund and $3,500 from grant funds. If you approve of this action tonight, you should also approve awarding the park consul- tant bid to Takata Associates and direct the Mayor and City Manager to execute the necessary documents. If you do not approve tonight, then this matter will have to be considered at a date after you have adopted Fiscal Year 1982-83 budg- et. The reason for this is that in order to provide opportunity to further study of the budget, we did not receive approval to expend money on capital projects of which this is one. In addition, a Notice of Public Hearing has been published twice noticing this action. All owners of parcels proposed to be charged for delinquent charges have been notified by U. S. Mail. The total delinquent charges, prior to any charges or payments resulting from this noticing, is $15,823. 45.
