ROLL CALL: Present: Councilmembers Bewley, Borgeson, Luna and Mayor Nimmo Absent: One Seat Vacant Also Present: Muriel "Micki" Korba, City Treasurer and Lee Price, City Clerk Staff Present: Andy Takata, City Manager/Director of Community Services; Henry Engen, Community Development Director; Art Montandon, City Attorney; Russ Scotten, Interim Finance Director; Mike McCain, Fire Chief; Bud McHale, Police Chief; Lt. Bill Watton, Police Department; Steve Sylvester, City Engineer and John Neil, Assistant City Engineer PROCLAMATIONS: Mayor Nimmo presented the proclamation for "Boy Scouts Anniversary Week", February 6-12, 1994 to Richard Scheider, District Commissioner. Also present were local scout leaders Ken Gouff and Dyan Railsback and scouts Brad Jorgenson and Jacob Johnson. The Mayor also read a proclamation honoring Atascadero youth participating in Annual CC 02/08/94 Page 1 Cuesta College Youth Chamber Music Adjudication & Festival. Charles Buck and local musicians were present to accept. COMMUNITY FORUM: o Police Facility art mural project presentation: Janine Kirkpatrick (Santa Lucia School) and Linda Wargo (A.S.H. Art Program Director) Chief McHale provided the introduction and indicated that staff was looking for Council consensus to move forward with an art mural project proposed for the retaining wall along EI Camino Real at the Police Facility. He noted that the project was a joint effort sponsored by local community groups, Santa Lucia School and the Atascadero State Hospital. Linda Wargo, State Hospital Art Program Director, commended local community groups for their involvement and participation associated with the project. Janine Kirkpatrick, artist, displayed children's art work and summarized the details of the project. Chief McHale remarked that the art work would be on display in the Library for all to see. Individual Council expressions of appreciation and endorsement followed. o Presentation by the Atascadero Land Preservation Society Marge Mackey, Geraldine Brasher and Lindsey Hampton presented the City with a check for $2,000 representing a donation towards the purchase of Pine Mountain Stadium Park for City recreational use. Ms. Mackey announced the date for the next fund-raising meeting. Tom Bench, 8205 Carmelita, reported that the community had recently hosted a soccer tournament at which there was a large turnout. He mentioned that there had not been any City officials present and suggested that there should have been a formal welcome by the City. Eric Greening, 7365 Valle, announced that there would be a show of art work by local photographer, Joe Schwartz, at Cal Poly and recommended attendance. He also noted that he had received information he had requested regarding Non-TDA funds and thanked staff. Regarding this matter, Mr. Greening commented that Council of Government staff was looking into the possibility of pooling TDA money for Route 9 un-met needs and explained that a report would be coming in June or July about this matter. Bill Zimmerman, 6225 Lomitas, encouraged the City Council to give clear direction about what stand the City will make relating to housing. He urged the preservation of the community's character and asked the Council to be mindful of the provisions CC 02/08/94 Page 2 of the General Plan, despite State housing mandates. Individual Council comments - foltowed -Mayor Nimmo-indicated that there was no willingness on the part of the City Council to disregard the City's General Plan in order to meet State mandates that will adversely affect the community. Councilman Luna agreed, stating that the City will not acquiesce to the State at the expense of the General Plan. Councilwoman Borgeson remarked that she, too, would continue to abide the General Plan. Ray Jansen, 6655 Country Club Drive, read the proposed, "Fair Housing Resolution" submitted as part of his testimony relating to fair rental housing at the meeting of January 25, 1994. A. COMMITTEE REPORTS (The following represent ad hoc or standing commit- tees. Informative status reports were given, as follows.): 1. S.L.O. Council of Governments(COG) - Mayor Nimmo reported that COG had reviewed a revised salary/benefit package for COG staff in closed session at their meeting of February 2, 1994. He indicated that there had been no action taken and there would be more sessions to follow. 2. County Water Advisory Board - Councilwoman Borgeson reported that the Board had met February 6, 1994 at 1 :30 in the afternoon at 2156 Sierra Way in San Luis Obispo. She announced that the board had elected new officers and mentioned that Susan Mullen of Morro Bay had been selected as chairperson. Agenda items included a status report on the Nacimiento Water Feasibility Study and discussions regarding by- laws and committee direction. 3. Economic Round Table - Henry Engen announced that the next meeting would be February 16, 1994 at 7:30 a.m. in the Club Room, City Hall. 4. Liability Claims Review & Finance Committee - Councilman Luna mentioned that the committee had met on Thursday, February 4 in the City Manager's Office. The committee conducted a preliminary review of the mid-year budget. B. CONSENT CALENDAR: 1. CITY COUNCIL MINUTES - January 25, 1994 2. CERTIFICATE OF COMPLETION: LAUREL ROAD IMPROVEMENTS CC 02/08/94 Page 3 Public Comments: Bob Gann, Garcia Road resident, spoke in support of the boxed culvert solution and explained that a representative from the State Fish & Game Department told him that they would have no problem with the culvert solution. Mr. Gann remarked that he was concerned about the impact to the neighborhood because of the five-ton limitation on the Garcia Road and the road construction project scheduled to begin soon on San Gregorio Road. He argued that area residents would have no way in or out of the area during the road construction and asked the City Council to postpone the construction contract until after the rains, or at least until a solution has been reached about the bridge. He also noted that his children could not longer use Dial-A- Ride because the buses cannot cross the bridge. Marcia Torgerson, 6200 Llano Road, asked for additional clarification from staff regarding a funding option proposed. Henry Engen explained that the City can choose which failed roads it wishes to repair and suggested that the City Council may want to re-evaluate the priorities. ---End of Public Testimony--- Brief Council questions followed. There was general support for the boxed culvert solution and consensus to continue further discussion regarding the matter until the meeting of February 22, 1994. D. REGULAR BUSINESS: 1. ORDINANCE NO. 275 - Adding Chapter 12 to Title 3, authorizing bingo games (Recommend (1) motion to waive reading in full and read by title only, and (2) motion to introduce on first reading by title on/y) Art Montandon provided background and recommendation to introduce the ordinance. There were questions from Council and no comments from the public. MOTION: By Councilman Luna, seconded by Councilman Bewley to waive the reading in full of Ordinance No. 275; motion carried unanimously. MOTION: By Councilman Luna, seconded by Councilman Bewley to introduce Ordinance No. 275 on first reading; motion carried unanimously by roll call vote. CC 02/08/94 Page 5 2. ORDINANCE NO. 276 - Adding Section 4-2.1008 to Article 10 of Title 4, regulating skateboarding on private property (Recommend (1) motion to adopt on second reading by title only Andy Takata noted that the ordinance had been introduced on first reading at the meeting of January 25, 1994 and recommended adoption. MOTION: By Councilwoman Borgeson, seconded by Councilman Luna to adopt Ordinance No. 276 on second reading; motion carried 4:0 by roll call vote. E. INDIVIDUAL DETERMINATION AND/OR ACTION: 1. City Attorney Art Montandon added two matters of pending litigation entitle, O'Keefe v. City and McMeans/Torgerson v. City and one item relating to personnel matters. 2. City Treasurer Micki Korba reported that the interest rate on the Orange County Investment Pool for January remained at over 7.7%. 3. City Manager Andy Takata announced that the City Council would meet at 6:00 p.m. on the 22nd of February for mid-year budget review and provided an overview of other agenda for the evening. CLOSED SESSION: At 7:59 p.m., the City Council adjourned to a Closed Session for purposes of discussion regarding personnel negotiations, personnel matters and pending litigation.
