■ City Clerk Recommendation: Council approve the City Council
meeting minutes of October 26, 2004. [City Clerk]
2. Atascadero Lake Park Walkway Project (Bid No. 2003-009)
■ Fiscal Impact: $267,722.70
■ Recommendations: Council:
1. Accept Sansone Company, Inc.'s work as complete.
2. Authorize the City Manager to sign and file the Notice of
Completion.
3. Authorize the Administrative Services Director to release the
Retention to the Contractor. [Public Works]
3. Award Contract for Two (2) Fire Engines
■ Fiscal Impact: $745,500. $559,100 from vehicle replacement and
$186,400 Fire Facilities Impact Fees.
■ Recommendations: Council:
1. Award contract to Pierce Manufacturing Inc. for the construction and
purchase of two (2) fire engines at a cost of $372,750.00 each; and
2. Authorize the City Manager to execute the appropriate agreement; and
3. Authorize the Director of Administrative Services to appropriate
$559,100 in Vehicle Replacement Funds and $186,400 in Fire Facilities .
Impact Fee Funds for the purchase of the two fire engines. [Fire]

• B. MANAGEMENT:
1. Offer of Dedication of Via Tortuga and Calle Refugio
• Fiscal Impact:
1. If the offer of dedication is rejected, there is no fiscal impact.
2. If the offer of dedication is accepted without maintenance
funded the fiscal impact would be $22,097.00 to repair road
surface road and annual impact of $8,248.00 to keep the
maintenance up.
■ Recommendation: Council reject the request to accept the offers
of dedication of Via Tortuga and Calle Refugio, until a road
maintenance district is in place. [Public Works]

WELCOME TO THE ATASCADERO CITY COUNCIL MEETING
*e City Council meets in regular session on the second and fourth Tuesday of each month at 7:00 p.m., at 'the
Atascadero Pavilion on the Lake, 9315 Pismo St., Atascadero. Matters are considered by the Council in the order of-the
printed Agenda.
Copies of the staff reports or other documentation relating to each item of business referred to on the Agenda are on file
in the office of the City Clerk and are available for public inspection during City Hall Annex business hours at the Central
Receptionist counter and on our website, www.atascadero.org. An agenda packet is also available for public review at
the Atascadero Library, 6850 Morro Road. Contracts, Resolutions and Ordinances will be allocated a number once they
are approved by the City Council. The minutes of this meeting will reflect these numbers. All documents submitted by the
public during Council meetings that are either read into the record or referred to in their statement will be noted in the
minutes and available for review in the City Clerk's office.

City of Atascadero Proclamation
"National Hospice Month"
November, 2004
WHEREAS, last year, approximately 885,000 terminally ill patients and their families
relied on end-of-life care provided by the 3,200 volunteer and licensed hospice agencies located
in communities throughout the United States;
WHEREAS, hospice care allows patients and families to receive professional medical
services, pain and symptom control,'emotional, spiritual, and practical support without
hospitalization;
WHEREAS, hospices create a compassionate atmosphere, where patients are able to die
with dignity, wherever they call home, surrounded and supported by loved ones,familiar
friends, and committed caregivers;
WHEREAS, professional,and compassionate hospice staff and volunteers—including
physicians, nurses, social workers, bereavement counselors, therapists, home health aides and
clergy.—provide comprehensive care and attend to the particular needs and wishes of each
patient, and family members and friends also receive counseling and bereavement care that
help them cope with the loss of a loved one;
WHEREAS, the dedicated men and women who provide hospice not only help terminally
ill patients to face natural death without feeling alone or unprepared, but they also help
patients'families cope with emotional suffering and loss; and
WHEREAS, Hospice Partners of the CentralCoastand Hospice of San Luis Obispo
Ifunty provide hospice care and bereavement counseling, respectively, within the City of
tascader'o;
WHEREAS, this observance is an opportunity to encourage, honor, and support the
professionals, volunteers, and family caregivers who take on the challenge of caring for
patients at the end of life;
WHEREAS, providing hospice care reafirms our belief in the essential dignity of every
person, regardless of age, health, or social status, and that every stage of human life deserves
to be treated with the utmost respect and care;
NOW, THEREFORE, BE IT RESOLVED, I, George Luna, the Mayor of the City of
Atascadero on behalf of the City Council, do hereby proclaim November 2004 as Hospice
Month, and encourage all citizens to increase their awareness of the importance and
availability of hospice services within San Luis Obispo County.

Interim City Attorney Tom Gibson announced that no reportable action was
taken.

Mayor Luna called the meeting to order at 7:07 p.m. and Mayor Pro Tem Scalise led the
Pledge of Allegiance.

COMMUNITY FORUM:
Pastor Tom Farrell, Atascadero Bible Church, led those present in prayer.
Ann Ketcherside thanked several businesses for donating to the Teen Rally, requested
the City provide a local citizen with a dumpster, and asked Council to reconsider the
disposition of Dove Cemetery.
Mayor Luna and Council Members O'Malley and Clay stated they would contribute
toward the dumpster for Mrs. Herd.
Dennis Broders spoke about the impacts to his property from a solar tracking system his
neighbor installed and asked Council's help in dealing with it.
Council asked staff to review the document submitted by Mr. Broder and report back at
the November 23rd meeting.
Steve Martin, Executive Director of Atascadero Main Street, requested that planning for
an overall parking strategy for downtown Atascadero be given_a high priority.
Richard Shannon requested Council reconsider their denial of the West Front Village
project.
Mr. Shannon also spoke about a subdivision in Atascadero he represents, expressing
his concern with the maintenance of the roads. A packet regarding this issue was
distributed to Council for their review. (Exhibit A)

Kevin Campion expressed concern about hazardous conditions on Atascadero Avenue,
and requested a mechanism to address those conditions.
Eric Greening suggested police officers park their vehicles on Atascadero Avenue while
writing up their reports, stating their presence might affect driving behavior.
Hal Carden addressed parking problems in the downtown and the need for a
comprehensive plan, and spoke in support of the West Front project.
Jim Stecher, Superintendent of Schools for Atascadero School District, spoke about the
bomb scare at the high school and commended those in the City who came to their aid.
Police Chief John Couch spoke about the incident at the high school.
Mayor Luna closed the Community Forum period.

MOTION: By Mayor Pro Tem Scalise and seconded by Council Member
O'Malley to approve-the agenda.

COUNCIL ANNOUNCEMENTS AND REPORTS:
Council Member O'Malley asked the City Attorney for direction regarding Mr. Shannon's
request. City Attorney Tom Gibson indicated Council could direct staff to arrange a
future study session or public hearing at which time Council could rescind its denial of
the project and then consider it at a future Council meeting.
There was Council consensus to bring the West Front project back for a Council
study session and if there is an action to proceed staff would notice the item and
have a regular public hearing process before the City Council.

5. Request to Place Memorial Bench at Atascadero Lake Park
Fiscal Impact: None. The,requesting family will cover all related costs for
the purchase and installation of the memorial bench.
■ Recommendation: Council approve a request by Sandy Boneso to install
a Memorial Bench at Atascadero Lake Park in honor of her husband.

6. EI Camino Real/Principal Avenue Mixed-Use/ZCH 2003-0070, ZCH 2004-
0083 MestPac Investments, Inc.)
■ Fiscal Impact: The project is conditioned to fund all of its tract
maintenance costs and contribute to the funding of emergency services.
As conditioned the project is projected to be revenue neutral to the City.
■ Recommendations: Council:
1. Adopt on second reading, by title only, Draft Ordinance A, approving
Zone Text Change 2003-0070 establishing a PD-24 overlay district; and,
2. Adopt on second reading, by title only, Draft Ordinance B approving
Zone Change 2004-0083 based on findings. [Community Development]
7. Authorization to Apply for the California Recreation Development Grant
Program for Park Lighting
■ Fiscal Impact: Approval of this resolution will allow the City Manger to
apply for $228,000 from the State of California Recreation Development
Grant Program.
■ Recommendations: Council:
1. Approve the draft Resolution authorizing the City Manger to apply for
$228,000 from the California Recreation Development Program.
2. Direct staff to allocate these funds to the Paloma Creek Park Little
League and Alvord Field (Babe Ruth) Lighting Project. [Community
Services]

8. Authorization to Apply for the California Recreation Development Grant
Program for Wading Pool Improvements_
■ Fiscal Impact: . Approval of this resolution will allow the. City Manger to
apply for $75,000 from the State of California Recreation Development
Grant Program.
■ Recommendations: Council:
1. Approve the draft Resolution authorizing the City Manager to apply for
$75,000 from the California Recreation Development Grant Program.
2. Direct staff to allocate these funds to the City of Atascadero's
Community Services Department 2005 Aquatic Program and the
Atascadero Lake Park Wading. [Community Services]

Item #A-5: Mayor Pro Tem Scalise spoke about the Boneso family and thanked them
for their many contributions to the community.
MOTION: By Mayor Pro Tem Scalise and seconded by Council Member
Clay to approve Item #A-5.
Motion passed 5.0 by a roll-call vote.
Item #A-6: Mayor Luna stated he pulled this item to vote no, and requested clarification
on how the $1,500 landscape buffering would be handled. Community Development
Director Warren Frace stated the developer would be responsible for installing up to
$1,500 worth of landscaping per parcel on neighboring parcels with the cooperation of
the neighbors.
PUBLIC COMMENT
Carol Florence, representing Westpac, agreed with Director'Frace's restatement of the
landscaping condition and stated they are working to revise the site plan based on
comments made at the last council meeting.
Eric Greening commented on the percentage of commercial in this project and stated
his concern that commercial property should be revenue positive to the city.
Geri Mackey expressed concern about the two story houses in this project and the
resulting loss of privacy.
Carol Florence answered questions of Council and addressed issues raised by the
previous speakers.

Geri Mackey stated she was still concerned with the line of sight from the second story
windows.
Eric Greening observed that the applicant is making substantial changes to the site
plan, and perhaps it is premature to have a second reading on a plan that may change.
Carol Florence;stated she did not feel the site changes would need to come back to
Council.
Mayor Luna closed the Public Comment period.
MOTION: By Mayor Pro Tem Scalise and seconded by Council Member
Clay to approve Item#A-6.

B. COMMITTEE & LIAISON REPORTS:
Mayor Luna Dance and reward to city that wins. October 29th at McCarthy's
Mayor Luna announced the Council has been invited to a dance on October 29th
at McCarthy's, and the city that wins the dance contest will receive a $1,000
reward.
Mayor Pro Tem Scalise
1. S.L.O. Council of Governments (SLOCOG)/S.L.O. Regional Transit Authority
(SLORTA): Meets next week with a large agenda planned.
Council Member O'Malley
1. Air Pollution Control-District: Reached a substantial fee increase agreement
with PG&E.
2. League of California Cities - Grassroots Network: Council Member O'Malley
announced that he has applied to be on State Policy Committee for
community services. Channel Counties meeting will be held November 19th in
Carpentaria. Atascadero was one of two top cities that raised support for
proposition 1A.
3. Economic Vitality Corporation, Board of Directors (EVC): Recruiting for new
Executive Director.

C. INDIVIDUAL DETERMINATION AND/OR ACTION:
City Council
Mayor Luna commended the Police, Fire, Public Works departments for their
work on the bomb scare at Atascadero High School.
City Manager
City Manager Wade McKinney updated Council on progress for the Youth Center
and asked for direction with respect to processes. Decision points to consider
are:
1. How will the location of the new facility be decided
2. Who/how will the approval of the conceptual plans be completed
Community Services Director Brady Cherry reviewed the decision made by the Parks
and Recreation Commission.
There was Council deliberation on the discussion points as well as the roll of the Parks
and Recreation Commission in the decision making process for the Youth Center.
PUBLIC COMMENT
Eric Greeningstated his support for Council meeting with the Parks and Recreation
Pp 9
Commission then being prepared to make a decision at the next Council meeting.
Steve Martin, Main Street Executive Director, suggested making the Parks and
Recreation Commission the point committee to take the lead with this and charge them
with bringing forward three concepts for the Youth Center at a specific date.
Jay Sechrist, Parks and Recreation Commissioner, agreed with Council Member Clay
that special meetings are necessary at this point.
Mayor Luna closed the Public Comment period.
There was Council consensus to have staff gather facility and site information for
the top two sites.(Lake Park and corp yard) and then call a special meeting of the
City Council to make the decision and to notice the Parks and Recreation
Commission, Planning Commission and public to be present for their input.
D. ADJOURNMENT:
Mayor Luna adjourned the meeting at 9:14 p.m. to the next regularly scheduled meeting
of the City Council on November 9, 2004.

Atascadero Lake Park Walkway Project
(Bid No. 2003-009)
_RECOMMENDATIONS:
Council:
1. Accept Sansone Company,Inc.'s work as complete.
2. Authorize the City Manager to sign and file.the Notice of Completion.
3. Authorize the Administrative Services Director to release the Retention to the

DISCUSSION:
Background: Bids were received and publicly opened on October 9, 2003 for this
project. Sansone Company, Inc. submitted the lowest responsive bid. Council awarded
the project to SansoneCompany, Inc. on November 25, 2003. This project has been
satisfactorily completed.
The project was divided into three phases, with Sansone Company, Inc. completing
Phase II and the California Conservation Corps completing Phases I and III under a
Joint Powers Agreement. Work consisted of construction of a 6' to 8' decomposed
granite pedestrian path around the perimeter of Atascadero Lake. Additional
improvements include drainage facilities, signing and striping, and paving.

Staff Report -Fire Department
Award Contract for Two (2) Fire Engines
RECOMMENDATIONS:
Council:
1. Award contract to Pierce Manufacturing Inca for the construction and purchase of
two (2) fire engines at a cost of$372,750.00 each; and,
2. Authorize the City Manager to execute the appropriate agreement; and,
3. Authorize the Director of Administrative Services to appropriate $559,100 in
Vehicle Replacement Funds and $186,400 in Fire Facilities Impact Fee Funds for
the purchase of the two fire engines.
DISCUSSION:
Staff is proposing to purchase two (2) new fire engines. This is a "Piggy-back purchase
on the Los Angeles City apparatus purchase. Los Angeles City solicited bids using the
competitive sealed bid process. Purchasing in this manner as opposed to going out to
bid, gives the City the opportunity for quantity purchasing at a reduced cost, while
enjoying the benefits of a reputable manufacturing firm with an excellent track record of
longevity and performance. A vehicle committee of five members, including the Fire
Chief, has worked for the past year investigating numerous fire apparatus
manufacturers. The Committee considers Pierce Manufacturing:the best company to
build two fire engines that would most suit this City's unique needs. The advantage of
buying two (2) engines gives the City the quantity purchase option as well as a
reduction in parts costs, i.e., valves, filters, belts, etc.
The Fire Department's current first-out engines are scheduled for replacement and have
served in excess of their life cycle. Upon delivery, the Fire Department's existing two
(2) engines will be at their 18 and 21 year service mark and would be sold as surplus
equipment.

Currently, neither of the Fire Department's two fire engines will achieve or pass a pump
test. Estimated repairs necessary to make it possible for the two (2) engines to pass a
pump test are quoted to be between $8,000 and $20,000, for each vehicle. Pump tests
are considered standard practice in the industry. Such pump tests are conducted
annually and performed to test the engine's ability to pump its rated capacity as the
apparatus was originally designed.
The newer of the two engines has had one engine rebuilt, two suspension overhauls,
two pneumatic fan clutch replacements, and-, has battled a host of fuel and
throttle/Governor problems. It is more fiscally responsible to purchase new equipment
and modern technological improvements, including increased crew safety (via enclosed
cab for all personnel), enhanced performance, and greater reliability, than to spend
funds for old equipment.
FISCAL IMPACT:
$745,500, $559,100 from vehicle replacement and $186,400 Fire Facilities Impact
Fees.
ALTERNATIVES:
n
1. Do not award contract or award contract to alternate company through the bid
process.
2. Continue to use current equipment, making repairs as needed and fund as
necessary.
3. Postpone purchase. Staff does not recommend this alternative as the City could
loose the ability to piggy back onto the Los Angeles City Contract. Price increases
are expected to range from 3% and 6% per year. Dramatic cost increases are
related to escalating steel costs.

Offer of Dedication ofViaTortuga and Calle Refugio
RECOMMENDATION:
Council reject the request to accept the offers of dedication of Via Tortuga and Calle
Refugio, until a road maintenance district is in place.
DISCUSSION:
The original owner of Via TortugaiCeile Refugio (Tract 1753) has requested that the
City Council consider accepting the offers of dedication of the subdivision streets.
Background: Tentative Tract Map 14-89 was approved by the City Council in 1989
(see Attachment "A"). This is a 23 lot, residential subdivision between Atascadero Ave
and Coromar Road. The subdivion has two interior streets, Calle Refugio and Via
Tortuga. The street right-of-way width is 40 feet with 28 feet from curb to curb for two
10 foot travel lanes and one 8 foot parking lane.
The Final Map was approved by the City Council on June 10, 1997 (see Attachment
"B"). The Owner of the subdivision, Ernest Clark Iverson, offered the streets for
dedication to the City on the Final Map and the City Council rejected the offer. The
reason for the rejection was the City Council policy of not accepting additional streets
for maintenance when the City can not fund is the existing backlog of street
maintenance. The City Council is currently rejecting all offers of dedication for streets
when there is not a funding mechanism in place to maintain the streets.
The original "Conditions of Approvals" of the Tentative Tract Map 14-89 did address the
acceptance of the streets as follows:
`The new roads shall be constructed to City Standard and shall be accepted into the
City maintained mileage after the required one year maintenance period, as determined
by the City Engineer."

This condition was written before Council had adopted a policy of not accepting offers
of dedication for streets when there is not a funding mechanism in place to maintain the
streets.
Analysis: City Staff is working with neighborhoods throughout Atascadero in creating
assessment districts to improve and maintain roads. To begin the process a
neighborhood must submit a petition with signatures of 60% of the property owners
showing interest in finding out more about assessment districts. We have 12
neighborhoods that have returned signed petitions. Staff then produces cost estimates
for repairing the road surface, maintenance and administration. The neighborhoods of
Calle Refugio and Via Tortuga submitted a petition and staff has completed the cost
estimate for improvements. The costs are as follows:
Construction cost to repair road surface: $22,097.00
➢ Estimated annual maintenance costs: $8,248.00
➢ Estimated annual administrative costs: $3,210.00
➢ Estimated annual assessment per household: $633.00
Notes:
1. Construction cost to repair road surface are based on slurry seal, repair road subsidence and curb
painting
2. Estimated annual maintenance costs are based on alternative slurry seals and overlays every five
years, road cleaning and curb painting.
3. Estimated annual assessment per household is based on 23 households with 10 year financing at
5.25%.
Staff is currently sending out informational fetters to all property owners, in interested
neighborhoods, informing them of the costs and requesting reaffirmation of interest in
continuing in the process.If there is still sufficient interest staff would continue with the
assessment district process._
Conclusion: Acceptance of Calle Refugio and Via Tortuga offers of dedication would be
inconsistent with Council policy of not accepting new road maintenance liabilities
without funding in place.
FISCAL IMPACT:
1. If the offer of dedication is rejected, there is no fiscal impact.
2. If the offer of dedication is accepted without maintenance funded the fiscal impact
would be $22,097.00 to,repair road surface and an annual impact of$8,248.00 to
keep the maintenance up.

CONDITIONS OF APPROVAL:
1 . Water shall be obtained from the Atascadero Mutual Water
Co. Water lines shall be extended to the frontage of each
parcel or its public utility easement prior to the recording
of the final map.
2. All existing and proposed utility, pipeline, open space, or
other easements are to be shown on the final map. If there
are building or other restrictions related to the
easements, they shall be noted on the final map. All
relocation and/or alteration of existing utilities shall be
the responsibility of the developer at his sole expense.
All utilities, including cable television, shall be placed
underground and exist at the frontage of each lot prior to
recording of the final map.
3. Grading, drainage, and erosion control plans for .each
proposed lot, prepared by a registered civil engineer, shall
be submitted for review and approval by the Community
Development and Public Works Departments prior to recording
of the final map. Drainage facilities shall be constructed
to City of Atascadero standards and completed prior to
recording of the final map.
4 . Road improvement plans, prepared by a registered civil
engineer, shall be submitted to and approved by the
Community Development and Public Works Departments prior to
recordation of the final map. Plans shall include, but not
be limited to the following:
a. Paveout on Atascadero Ave. to twenty (20) feet from
centerline, including a design for a .five (5) foot
walkway along the property frontage. The paved half
width of Coromar shall be 12 feet. Prior to
recording the final map, a contribution of $1. 75 per
square foot of walkway along the frontage of Atascadero
Ave. and Coromar Rd. and the linear frontage of Via
Tortuga, shall be made to the Routes to School fund.
b. Improvement plans shall show the grading necessary to
achieve the finish sidewalk grades along Atascadero Ave.
and along both sides of the interior streets. During
construction, a five foot wide width shall be graded to
the finished sidewalk grades, in order to avoid the
undercutting of landscaping and yards when the sidewalks
are installed.

c. The new interior roads (Via Tortuga and Calle Refugio)
shall contain a paved roadway width between the face of
curbs of 28 feet, including two 10 foot wide traffic
lanes and one 8 foot wide parking :lane, with curb and/or
gutter as determined by the City Engineer. The center
of the paved width shall be on the centerline of, the
right of way. The new roads shall be constructed to
City standards and shall be accepted into the City
maintained mileage after the required one year
maintenance period, as determined by the City Engineer.
d. The paved cul-de-sac radius shall be 48 feet with a
minimum right of way radius of 54 feet.
5. Construction of the public improvements shall be completed
prior to recordation of the final map.
6. Public improvement plans shall be reviewed and approved by
the Fire Department prior to recording the final map.
7. Sewer improvement plans shall require approval from the
Public Works Department prior to recording of the final map.
All newly created lots shall be connected to public sewer.
All annexation fees shall be paid for the newly formed lots
prior to recording the map. Any sewer extensions for
annexations must be completed within one year after
annexation.
8. The subdivider shall install all street signs, traffic
delineation devices, warning and regulatory signs,
guardrails, barricades, and other similar devices where
required by the Director of Public Works. Signs shall be in
conformance with the Public Works Department sign standards
and the current State of California uniform sign chart.
Installation of traffic devices shall be subject to review
and modifications after construction.
9 . An encroachment permit shall be obtained from the Public
Works Department for all work to be done within the public
right-of-way prior to recording of the final map. Applicant
shall sign an inspection and curb/gutter agreement,
guaranteeing that the work shall be done and inspections
paid for prior to the start of public works construction.
The construction of these improvements, as directed by the
encroachment permit, shall be completed prior to recording
the final map.
10. Prior to recording of the final map, a soils investigation
shall be submitted, recommending corrective measures to
prevent structural damage to each structure where soil
problems exist. The date of the report, name of the
engineer, and the location where the reports are on file
shall be noted on the map.
