The City of Atascadero’s Zoning Hearing Officer will hold a public hearing
at 4:00 p.m. or later on Wednesday, May 10, 2017, at City Hall, 6500
Palma Ave., Atascadero, to consider the following:
1. 5890 TRAFFIC WAY, PLN 2017-1646; The applicant proposes to paint a
total of 800 sf wall mural(s) for non-commercial messages (art mural).
The project is categorically exempted from CEQA as a Class 11
Exemption. Staff recommendation is for the Hearing Officer to
approve the AUP. (The Artery) (Alfredo Castillo, Associate Planner)
2. 9190 SAN DIEGO WAY, PLN 2017-1640; The applicant proposes to
construct (3) neighborhood identification signs. The project is
categorically exempted from CEQA as a Class 11 Exemption. Staff
recommendation is for the Hearing Officer to approve the AUP.

3. 5510 DEL RIO ROAD, PLN 2017-1643; The applicant proposes to
construct (2) temporary off-site Real Estate signs, in addition to two
(2) temporary on-site subdivision signs. The project is categorically
exempted from CEQA as a Class 11 Exemption. Staff
recommendation is for the Hearing Officer to approve the AUP.

4. 8570 EL CORTE, PLN 2017-1644; The applicant proposes to construct (2)
temporary off-site Real Estate signs, in addition to two (2) temporary
on-site subdivision signs. The project is categorically exempted from
CEQA as a Class 11 Exemption. Staff recommendation is for the

PLEASE NOTE: Any court challenge to the actions taken at the public
hearing may be limited to considering only those issues raised at the public
hearing described in this notice or in written correspondence to the City of
Atascadero at, or prior to, the public hearing.
Any decision of the Hearing Officer is final unless a ppealed to the Planning
Commission within 14 days of the action. Any person aggrieved by the
decision may file an appeal. Appeal forms are available in the Community
Development Department or on the City’s website (www.atascadero.org).
The fee for filing an appeal is $721 and must accompany the appeal
documentation.

SITUATION: The applicant is proposing an art mural sized 50’ x 15’ at 5890 Traffic
Way, also known as The Artery. The proposed art mural will be facing Palma Ave. The
Atascadero Municipal Code allows non-commercial messages that are painted on walls
or facades, subject to an Administrative Use Permit (AUP fee is exempt).
EVALUATION: City policy allows art and murals in all zoning districts with approval of
an AUP to ensure that the message is non-commercial in nature and does not create
any safety issues related to distractions or reflective elements. The proposed art mural
will cover the building façade facing Palma Ave. There have been previous murals at
this location and they are repainted regularly to display new local art. The size and
location will not pose any safety hazards in terms of distraction to drivers. The proposed
artwork does not depict a commercial message or advertisement for the business and
therefore meets the criteria for AUP approval.
RECOMMENDATION: Staff recommends the Administrative Hearing Officer approve
PLN 2017-1646 allowing the art mural at The Artery, consistent with the attached
exhibits.

Findings
1. Modification of the applicable standard will not result in a project that is

ordinance standards are being requested. There are no conflicts with the
policies set forth in the City’s General Plan.

2. Modification of the applicable standard will not result in a project that is
inconsistent with the character of the immediate neighborhood or cont rary to its
orderly development;
Art murals are governed by City policy; therefore, no modifications to zoning
ordinance standards are being requested. The property requesting to display
the art mural is located in Downtown and supports pedestrian downtown activity.
The proposed mural will face other business uses.
3. Modification of the applicable standard will not result in a p roject that is not in
compliance with any pertinent City policy or criteria adopted by ordinance or
resolution of the City Council;
Art murals are governed by City policy. The proposed mural is consistent with
that policy.
4. Modification of the applicable standard will not result in the authorization of a
use not otherwise allowed;
No new or modified uses are proposed.
5. The proposed art display is non-commercial in nature; and
The proposed artwork does not display a commercial message.
6. The size, location, and/or medium used will not pose any safety risks to drivers.
The proposed mural faces Palma Ave and other commercial businesses. No
reflective media are proposed. The size, location, and colors do not pose a
safety risk to drivers or downtown patrons.

PROJECT ADDRESS: 9190 San Diego Way (Southside Villas)
SITUATION: The applicant is requesting an Administrative Use Permit to install three
(3) temporary for-sale signs at the Southside Villa project entrances.
EVALUATION: The Atascadero Signage Ordinance limits temporary for -sale signs at
maximum signage area of 6 square feet. Additionally, only one (1) sign is permitted per
street frontage. Two of the three requested signs are located along the San Diego Way
frontage. All signs are proposed to exceed the AMC size limitations. Sign #3 i s
proposed to be double sided with 21 square-feet per sign face.
The proposed signs have been designed to mimic the aesthetic theme of the
development to provide for visually attractive signage along the project edges. The
applicant proposes the temporary for-sale signs at three different places:
Sign # Nearest Intersection Square Footage
Sign #1 El Camino Real & Pamplona Way 26 sq ft
Sign #2 San Diego Way & Cuervo Way 12.75 sq ft
Sign #3 San Diego Way & Seville Lane (new footing) 21 sq ft (double sided)
RECOMMENDATION:
Staff recommends the Administrative Hearing Officer approve PLN 2017-1640, allowing
three (3) temporary for-sale signs for the residential development known as Southside
Villas.

Findings
The Atascadero Municipal Code 9-15.011 requires the Hearing Officer to make the
following 4 findings:

(a) The need for such signing is based on the purposes set forth in Section 9 -
15.002;
This proposed sign accomplishes three of the required purposes. Secti on 9-15.002(a)
describes the purpose of maintaining and improving “the aesthetic environment and
overall community appearance to foster the City’s ability to attract sources of economic
development and growth.” Section 9-15.002(c) describes the purpose of implementing
“quality sign design standards that are consistent with the City’s General Plan, Zoning
Ordinance and Appearance Review Guidelines.” Finally, Section 9 -15.002(e) describes
the purpose of minimizing “possible adverse impacts of signs on priva te and public
property in order to maintain property values and to maintain a positive City image.”
(b) The opportunity to combine signs for more than one (1) use on a single sign
structure has been considered;
This AUP would be for a temporary for-sale signage and is not applicable.
(c) For freeway-oriented signs, the sign area and height are the minimum needed
to achieve adequate visibility along the freeway due to highway ramp locations
and grade differences; and
This AUP would be for a temporary for-sale signage and is not applicable.
(d) Conformance with all other applicable codes and ordinances of the City,
including, but not limited to, the Zoning Ordinance, General Plan and its several
elements, and the appearance review guidelines. (Ord. 604 § 2, 2016)
This proposed sign conforms with Atascadero Zoning Ordinance, General Plan, and
Appearance Review Guidelines.
Conditions
1. Building permits shall be obtained prior to installation of the signs.
2. No flags, banners, or other decorations shall be affixed to the signs. The signs
shall not be illuminated.
3. Building permits shall show sight distance triangles at proposed intersections to
ensure that signs are placed without any public safety conflicts.
4. No sign shall be placed within public right-of-way.
5. All signs must be removed within 4 days after close of sale of the last unit.

SITUATION: The applicant is proposing two (2) off-site subdivision signs and two (2)
temporary for-sale signs associated with sales for the 13-unit residential development
known as Oak Trail (5310 Carrizo Road). The Atascadero Municipal Code allows off-
site subdivision signs and temporary on-site for-sale signs in excess of 6 sf subject to
Administrative Use Permit approval. The Atascadero Municipal Code (9-15 Sign
Ordinance) sets forth standards for off -site subdivision signs and temporary on-site for
sale signs.
EVALUATION: Each sign is proposed at four (4) feet in height and eight (8) feet in
width with 32 square feet of total sign area. Sign #3 will be double sided displaying 32 sf
for each sign face.
The on-site temporary for-sale signs are proposed at two different intersections:
• Sign 1: near the intersection of Copado Way and Pinon Way
• Sign 2: near the intersection of Carrizo Road and Carrizo Court
The off-site signs are proposed at two different intersections:
• Sign 3: 1535 El Camino Real at the southeast corner of Carrizo Road and El
Camino Real (double-sided sign).
• Sign 4: 5510 Del Rio Road at the northeast corner of Del Rio Road and El
Camino Real.
Each sign will be mounted on a post structure and is conditioned to be a maximum of
six (6) feet in total height. The exact location of the signs shall be determined through
the building permit process to ensure that the line-of-sight is not blocked at intersections
and that all signs are located outside of City’s right-of-way. Consistent with City code,
the signs are conditioned to be removed prior to final occupancy of the last unit in the
tract or after a period of 3 years, whichever is less.
The Atascadero Municipal Code limits off -site subdivision signs to 3 per subdivision.
The applicant proposes two (2) signs in compliance with this code section.

6. Six feet (6’) maximum total height for sign and supporting structure.

SITUATION: The applicant is proposing two (2) off-site subdivision signs and one (1)
temporary on-site for-sale sign for the 7-unit development known as Bella Casa. Each
sign will be 32 square feet in size. The Atascadero Municipal Code allows off-site
subdivision signs and temporary for-sale signs larger than 6 square-feet subject to
Administrative Use Permit approval.
EVALUATION: Each sign is proposed at four (4) feet in height and eight (8) feet in
width with 32 sf of total sign area. Sign #2 will be double sided displaying 32 sf for each
sign face.
The on-site temporary for-sale sign is proposed on 8570 El Corte Rd.
• Sign 1: 8570 El Corte Rd., at near the intersection of El Corte Rd. and La Linia

• Sign 2: 9105 Principal Ave., at the near the intersection of Principal Ave. and El
Camino Real (double-sided sign)
• Sign 3: 9300 Pino Solo Ave., at the corner of Pino Solo Ave. and Principal Ave.
Each sign will be mounted on a post structure and will be required to be a maximum of
six feet (6’) in total height. The exact location of the signs shall be determined through
the building permit process to ensure that the line of sight is not blocked at
intersections. Consistent with City code, the signs are conditioned to be removed prior
to final occupancy of the last unit in the tract or after a period of 3 years , whichever is
less. All three sites are owned by the project applicant.
