ORDINANCE 158 - REVERTING THE EXISTING ZONE DESIGNATION OF RESIDENTIAL MULTIPLE FAMILY WITH PLANNED DEVELOPMENT #6 TO PRIOR ZONING DESIGNATION OF RESIDENTIAL SINGLE FAMILY, 1. 5 TO 2.5 ACRE MINIMUM LOT SIZE (FIRST READING) Community Development Director Henry Engen reviews this item' s history, which caused it' s original zoning to be changed, and why staff is now recommending the zoning be reverted back to it' s original designation. The applicant has informed staff that he will be unable to attend tonight's meeting, but will re-review possible development alter- natives of this parcel with staff at a later date. There is no public comment on this item. MOTION: Councilmember Bourbeau moves to read Ordinance 158 by title only; Councilmember Mackey seconds; Motion carries unanimously MOTION: Councilmember Mackey moves to adopt Ordinance 158 as a first reading; Councilmember Bourbeau seconds; motion carries unanimously B-2 GENERAL PLAN AMENDMENT 2C-87 AND ZONE CHANGE 6-87 9300 EL BORDO - MC CASLIN/HAWKINS - PUBLIC HEARING RESOLUTION 105-87 - APPROVING AMENDMENT OF THE GENERAL PLAN FROM LOW DENSITY SINGLE FAMILY TO HIGH DENSITY MULTIPLE FAMILY ORDINANCE 59 - AMENDING THE OFFICIAL ZONING FROM RSF-Z TO RMF-16 (PD-7) (FIRST READING) Community Development Director Henry Engen states that this pro- posal relates to two one-acre non-conforming lots, adjacent to a mobilehome park. After project revision from 12 to 8 units on each lot, the Planning Commission approved the 16 lot re-design. Applicant Mark Ashland states that the area is developed with. high density projects with a few single family residences. He feels that this project would offer low-cost housing on inex- pensive lots. 3 David Cathrina, adjacent property owner , objects to additional densities proposed with units on 3, 000 square foot lots. Councilmembers discuss concerns regarding densities proposed. Councilmember Handshy supports Planning Commission recommendation for approval, as he feels there is not overwhelming reasons for denial. MOTION: Councilmember Bourbeau moves for denial of Resolution 105-87 and Ordinance 159; Councilmember Borgeson seconds; Motion carries 4-1 (Councilmember Handshy opposed) B-3 PROPOSED ZONE CHANGE 12-87 - 8750 EL CAMINO REAL - GENZONE PUBLIC HEARING ORDINANCE 161 - REVISING INDUSTRIAL PARK ZONING DESIGNATION TO COMMERCIAL SERVICE (FIRST READING) Community Development Director Henry Engen states that this project, adjacent to the Lucky' s Shopping Center, is presently an apartment complex. Present zoning splits the parcel in Commercial Service and Industrial Park . The applicants are pro- posing a 75 room hotel with restaurant fronting E1 Camino, and request the whole parcel be zoned Commercial Service. Plannig Commission voted unanimously to approve the proposal. Sandra Jenzone, Applicant, feels their proposal will revitalize this area and provide a nice project for the community. No public comment given on this item. Discussion continues regarding spot zoning in this area between commercial and industrial uses. It is determined that since the property is divided between two zoning designations, it is only appropriate to amend the zoning to one designation. MOTION: Councilmember Bourbeau moves to read Ordinance 161 by title only; Councilmember Borgeson seconds; motion carries unanimously MOTION: Councilmember Mackey moves to Approve Ordinance 161 as first reading; Councilmember Bourbeau seconds; Motion carries unanimously B-4 ZONE CHANGE AND TENTATIVE PARCEL MAP 10-87 - 6875 TECORIDA WOODGLEN LTD/CUESTA ENGINEERING - PUBLIC HEARING ORDINANCE 160 - AMENDING EXISTING ZONING OF RMF/16 (FH) TO • RMF 16 (FH (PD7) ALLOWING CREATION OF A PLANNED DEVELOPMENT OVERLAY FOR SMALL LOT SUBDIVISION CONSISTING OF SUBDIVISON 4 • OF 1.2 ACRES INTO 9 LOTS OF VARYING SIZES FROM 3 ,968 TO 7,074 SQUARE FEET AND ESTABLISHMENT OF "LOS ARBOLES" AS A PRIVATE STREET NAME (FIRST READING Community Development Director Henry Engen clarifies to Council that the site is 1. 2 acres and not 2.1 acres. The proposal is a planned development of 9 lots with a private road. The applicant originally requested a higher density, but has since been redesigned with special reports completed addressing soils, archaeology, and traffic. It is noted that the density presently proposed is less than the existing zoning with planned develop- ment would allow. Council is instructed to address the zone change proposal prior to addressing the tract map proposal. Mike Busey reviews the project, and feels that it will provide affordable housing in Atascadero and that the overlay proposal will benefit the community. Due to this site being in the Tecorida Flood Plain boundaries, the applicant is proposing to increase the site elevation with fill material to 3 feet above the documented flood zone. These units are proposed to be sold in the high $80 , 000 range, unless conditions impact proposed development costs. Sarah Gronstad, Atascadero resident, questions building any type of structures in documented flood zone areas. Sharon Morin, Atascadero resident, feels the project can be an asset to the community and would provide affordable housing. Council discusses concerns of development of the proposed site with it' s swamp-like conditions. MOTION: Councilmember Handshy moves to read Ordinance 160 by title only; Councilmember Bourbeau seconds; motion carries unanimously MOTION: Councilmember Handshy moves to approve Ordinance 160 as a first reading; Councilmember Mackey seconds; motion carreies 4-1 (Councilmember Borgeson opposed) MOTION: Councilmember Bourbeau moves to continue action of Tentative Parcel Map 10-87 till after approval of the second reading of Ordinance 160 ; Councilmember Borgeson seconds; motion carries unanimously B-5 FISCAL YEAR 1987/88 FIRST QUARTER BUDGET STATUS REPORT JULY - SEPTEMBER • Administrative Services Director David Jorgensen presents an overview of the budget thus far , showing a deficit of $473 , 205. A deficit showing at this time of the year is acceptable as major tax receipts will not be received by the City till December and 5 April. All department expenditures look acceptable. • Due to revenue sources not coming in as expected, some major projects may be put on hold till more is known on funds. No public comment was given to this item. MOTION: Councilmember Mackey moves to accept the First Quarter Budget Report for Fiscal Year 1987/88; Councilmember Bourbeau seconds; motion carries unanimously C-1 MAYOR SELECTION SURVEY - SURVEY STATUS City Clerk Boyd Sharitz provides the recent survey totals with 72 votes to retain current practice (Council appointment) and 253 to change current practice to a citizen elect process. Council agrees to accept the survey and not to act on this item, as it appears not to be a significant issue with the public due to poor voting response. Council will again review this issue at a future Council .Workshop. City Attorney Jeff Jorgensen suggests keeping the votes received on file for approximately 6 months. D-1 CONSIDERATION REGARDING APPOINTMENT OF CITIZEN MEMBER TO TRAFFIC COMMITTEE Public Works Director Paul Sensibaugh states that there is a vacanty on the Traffic Committee, as Bill Heath' s position is up for reappointment. It is noted that citizen appointments are for two year terms with no consecutive terms allowed. Council recog- nizes Bill Heath and the hard work he has given to the Committee and commends him for his efforts. There are presently 1 City Council member , 3 staff, and 2 citizen appointments on the Traffic Committee. Council determines that the City Clerk' s Office will advertise the vacancy through the newspaper , with applications presented to Council for consideration of appointment. Council appointment to the committee is a one-year term, but can be reappointed consecutively. Mayor Barbara Norris appoints Councilmember Mackey as the Council representative to the Committee, replacing the Mayor . An alter- nate Council representative will be appointed at a later date. . 6 • MOTION: Councilmember Mackey moves to authorize advertise- ment through local newspapers of the citizen vacancy existing on the Traffic Committee; Councilmember Borgeson seconds; motion carries unanimously MOTION: Councilmember Bourbeau moves to appoint Council- member Mackey as the Council representative on the Traffic Committee; Councilmember Borgeson seconds; motion carries unanimously D-2 AWARD OF 1987/88 ROAD RESURFACING PROGRAM BID TO MADONNA CONSTRUCTION COMPANY - $423 ,105 ,84 Public Works Director Paul Sensibaugh recommends Council award of this year ' s road resurfacing program to Madonna Construction. It is noted that of the $423,105.84 bid, there is $365,000 budgeted. Staff proposes utilization of carryover funds or interest earnings to provide additional funds needed and not reducing the proposed project boundaries. Regarding Llano Road reconstruction, due to adjacent developers Drake and Davis providing grading, road widening, fine grading, . and base work, the City will now be able to widen the road cul- vert and resurface the road to Santa Lucia. No public comment is given to this item. MOTION: Councilmember Borgeson moves to approve the 1987/88 Resurfacing Bid to Madonna Construction at $423 ,105.84, and to transfer funds reflect additonal funds needed; Concilmember Mackey seconds; Motion carries 4-0 (Councilmember Bourbeau exempts himself from voting on this item. ) D-3 RESOLUTION 106-87 - AMENDING RESOLUTIONS 21-85 AND 112-86 CITY MANAGER TERMS AND CONDITIONS OF EMPLOYMENT AGREEMENT City Manager Michael Shelton gives an overview of proposed changes to his contract, which provides for a 4.9% salary/benefit increase for fiscal year 1987/88. George Highland, Carmelita resident, feels that the City Manager , due to past actions, should not be granted an extension of his employment contract. Joe Nyle, Atascadero resident, questions the City Manager ' s past actions related to ignoring Dial-A-Ride legislative mandates, and feels the City Manager should be replaced. 7 Councilmember Borgeson discusses the need for additonal public • comment and information regarding this issue. MOTION: Councilmember Borgeson moves to contnue this item to the November 10, 1987 Council Meeting; Mayor Norris seconds; Motion carries 3-2 (Councilmembers Mackey and Handshy opposed) D-4 RESOLUTION 103-87 - ADOPTING A SALARY/CLASSIFICATION SCHEDULE AND BENEFITS FOR MANAGEMENT EMPLOYEES City Manager Shelton states that staff is presenting position equity adjustments for the Parks and Recreation Director , Administrative Services Director, Communty Development Director, and Chief of Police ranging from 4.45% to 5. 84%, effective January 1, 1988 and January 1, 1989. Salary and benefit increases, without equity adjustment, will be a total increase of 6.61% over, present budget for fiscal year 1987/88. It is noted that this is a quasi-two year agreement, with issues defined with the exception of unknown cost of living figures for fiscal year 1988/89. No public comment is given on this item. Councilmember Bourbeau feels the City' s Department Heads have done a superb job and are worthy of the proposed salary and bene- fit increases. MOTION: Councilmember Bourbeau moves to approve Resolution 103-87; Councilmember Borgeson seconds; Motion carries unanimously D-5 RESOLUTION 104-87 - ADOPTION OF A SALARY/CLASSIFICATION SCHEDULE AND BENEFITS FOR CONFIDENTIAL EMPLOYEES City Manager Shelton states that the City' s three Confidential employees are considered exempt from the "Meet and Confer" bargaining process. Staff reviews a recent study of cities with- in San Luis Obispo County who do acknowledge and compensate Confidential status employees over non-confidential employees. Staff suggests grouping two Confidential employees with the S.E. I.U. Clerical bargaining unit, to receive salary/benefit increases they receive, with an additonal 5% increase, phased over 2 years. The other Confidential employee, being mid-manage- ment oriented, is suggested to be placed in the Mid-Management negotiating group without additional benefits given, as the Mid- Management package allows for additional benefits over S.E. I.U. Clerical. 8 0 Brad Humphrey, Atascadero resident, urges Council to consider this proposal carefully, as it is an issue causing great concern among other City staff, and creating a morale issue. He feels that that being exempt from bargaining should not provide a 5% differential. Council discusses provision of differential compensation to Confidential employees, exempt from negotiating, a possible need for a separate classification showing their additional responsi- bilities, and employee concerns. Mayor Norris reviews the status of positions in question and Administrative Services Director Jorgensen clarifies the employees in the positon and their qualifications. MOTION: Councilmember Bourbeau moves to adopt Resolution 104-87, with the exception of Section 2 (Confidential Compensation) ; Councilmember Borgeson seconds; motion caries 4-1 (Councilmember Handshy opposed) E-1 PROPOSED BORDEAUX HOUSE SANITARY SEWER BYPASS - FINANCING Public Works Director Paul Sensibaugh reviews the limits of the study Cost of the project is over proposed estimate by $65,000. MOTION: Councilmmber Bourbeau moves to proceed with the southside sewer project, as proposed, and approve additional construction funds from annexation fees; Councilmember Mackey seconds; motion carries unanimously E-2 AWARD OF SEWER CLEANING (I & I) BID TO MILTON SIMON - $54 ,012. 80 Public Works Director Paul Sensibaugh requests Council to award the sewer cleaning portion of the proposed bid to Milton Simon, and to continue action of awarding the t.v. monitoring portion of the bid to the next Council Meeting. This is not considered a line extension, as nobody except the San Gabriel School can connect to the extension outside the Urban Services boundary line. No public comment is given on this item. MOTION: Councilmember Bourbeau moves approval of Resolution 109-87; Councilmember Borgeson seconds; Motion carries unanimously E-4 RESOLUTION 110-87 - SEWER SERVICE EXTENSION TO LOTS 10, 11, 12, 13, 14 , 15, 24, PORTIONS OF LOTS 6 & 7 OF TRACT 5 AND PARCELS 1, 2, AND 3 OF PARCEL MAP AT 81-281 (EL BORDO AVENUE) Paul Sensibaugh, Public Works Director , requests a continuation of this item as an environmental statement presented to the Planning Commission for Spanish Ridge Development does not cover this annexation. BACKGROUND: Tentative Parcel Map AT 821118:1 was approved at the City Council meeting of March 14, 1983. This map was never finaled. In June, 1985 a tract map proposal of 15 commercial lots was submitted to staff. This map was sent out to the various agencies and utilities, but was withdrawn on July 30, 1985. This three lot commercial parcel map re- places the 15 lot subdivision. • Notice of public hearing was published in the Atascadero News on Aug- ust 9, 1985 and all owners of record property located within 300 feet were notified on that date. At the Planning Commission meeting of August 19, 1985, the item was presented to the Commission but continued in order to gather more in- formation and prepare final conditions. A. "South Mall Extension" presently extends Tentative Parcel Map 22-85 (El Camino Associates) from Santa Ysabel to Atascadero f Creek and has a 40 foot wide right-of-way. 6. Environmental Status. . . . . . . . .Negative Declaration C. ANALYSIS: There is no minimum lot size in the CR (Commercial Retail) zone. Staff review will focus on the relationship between this proposed parcel map and the future development of Century Plaza., as pro- posed in Conditional Use Permit 26-84. The previous owner of Plaza del Camino shopping center obtained approval of a tentative parcel map dividing the existing developed half of the site from the undeveloped remainder. This map was never finaled. This new map basically achieves the same goal, that of separating Phase I from Phase II. However, in this case, the Happy Steak restaurant will comprise its own separate parcel (Parcel 2) . Parcel l consists of the existing shopping center, the area of the additional two proposed theaters, future retail space (Building K) , future office space (Building J) , and an addi- tion to Building H (Building I) (see Exhibit D) . Parcel 3 is the remaining undeveloped land. This map will accomplish the finan- cing and ownership objectives of the applicant. However, by a design, easements, parking agreements, development standards and other methods the building and parking complex will function as a unified whole. Many questions of staff have been answered with the submittal of more information shown on the map. The existing parking area in the northwest corner of the site is still mostly a part of Parcel 3. Staff felt that it should be a part of Parcel 1. However, it is has been determined that parking demand for Phase I is met without this parking area. Staff recommended that a driveway ac- cess from South Mall Extension be provided which would connect to 2 a W Tentative Parcel Map 22-85 (E1 Camino Associates) the driveway in front of the theater and hence to E1 Camino Real. This would provide for adequate circulation for Phase I of the project. The map presented shows this through access as a part of Parcel I; however, the complete connection is shown to be achieved in Phase II of the project. Staff continues to feel that this through access shall be accomplished during Phase I. Build- ing K presents no problem in its phasing (Phase II) ; however, its associated circulation is fundamental to Phase I functioning on its own (Exhibit D) . Related to this theme of auto circulation is the need for a pedes- trian link from the civic center through the entire Century Plaza to implement the City' s General Plan. The proposed location of the pedestrian bridge needs to be shown on the final map to insure that a pedestrian crossing is achieved. The area subject to inundation (100 year storm) as well as the existing and proposed easements are now shown on the map as staff had requested. Drainage and sewer easements are still needed to be offered for dedication and_ shall be reviewed by the Public Works Department. The applicant has proposed a culvert system for Phase I, which allows for the natural flow of the drainage for the remainder of the land (Phase III) . This portion of the drainage swale (Santa Ysabel Creek) will be culverted at the time of future development. The alignment of South Mall Extension and Lewis Avenue is not shown, however , on the tentative map. This will help determine if the sight distance along South Mall Extension is adequate. In sum, staff agrees that the parcel configuration does not con- flict with City policies or regulations, and will be consistent with the existing and future development of the site. D. RECOMMENDATION: Staff recommends approval of Tentative Parcel Map 22-85 based on the findings and conditions contained in Exhibit A. The proposed lot lines shall be altered to provide the proper Uni- form Building Code setback for a building without a fire wall; or the . existing building located on the proposed property line shall be brought into conformance with Uniform Building Code wall pro- tection requirements, or the building shall be moved or relocated to satisfy this requirement. 2 Tentative Parcel Map 2- -85 (Bill Carroll) Creek. . 11. Environmental Status . . . . . . . . .Negative Declaration C. ANALYSIS: In the IP zone, there are no minimum lot size standards under pro- visions of the zoning ordinance. Current lot line configurations show the existing meat packing plant to occupy the two smaller lots which front on Traffic Way. One of these existing buildings is built across this property line. The proposed parcel map would eliminate the property line which bisects the building. The current back parcel is a flag lot which slopes down to Atas- cadero Creek. The proposed parcel map would provide the back parcel a larger workable building area. The submitted parcel map shows a 35 foot access easement across the front parcel to the back parcel. Staff, and particularly the Fire Department, has concerns with this representation on the map. A site check reveals that there is a utility pole, gas pump and parking strip obstructing this proposed access at this time. If the accessory building located along the proposed property line i does not conform to Uniform Building Code wall protection require- ments, staff would have concerns regarding its location. The creation of two lots where three previously existed ensures that the existing buildings will not be located on any lot lines and that any new use will be on a separate legal lot. The Commission' s discussion was focused on the configuration of the resultant lots, which would create two flag lots and would necessitate excessive grading to develop the two uphill lots (see Minutes Excerpts - 9/1/87) . This item was continued to the October 6, 1987 meeting, with a suggestion to the applicant that he return with a redesign of his project. In response to the Commission' s action, the applicant submitted a re- vised map with all three lots having frontage on Sombrilla which would allow for the development of a single family dwelling on the lower portion of each, while maintaining the steeper slopes in an open state. After much discussion (see Minutes Excerpts 10/6/87) , the Commission recommended approval of TPM 27-87 subject to the findings and conditions contained in the staff report, with modification to Condition #12 as follows: "12. The area of the site located above the existing 950 foot contour line as shown on the revised tentative map dated September 24 , 1987 shall be placed in a scenic easement wherein no building construction or placement shall occur . Said scenic easement and building restrictions shall be shown and noted on the final map. ANALYSIS: The application before the Commission proposes the subdivision of one parcel containing 1. 46 acres into three (3) parcels containing: Lot 1 - 22, 600 sq. ft. , Lot 2 - 21,000 sq. ft. , Lot 3 - 20, 000 sq. ft. The property proposed for subdivision is located in an RSF-X zoning district. The minimum lot size in this zone is 20, 000 square feet where sewers are available and 0. 5 acres where sewers are not available. Because sewers are available to the property the 20, 000 square foot minimum lot size is allowable under the current ordinances. Staff would like to point out to- the Commission that the proposal is allowable under the ordinance, but that staff feels the site does have several major problems. The cross slope of the site is over 35% for Lots 2 and 3. There are several large oak trees that could possibly be lost if the access road is constructed as proposed. Lots 2 & 3 will be subject to Precise Plan approval when dwellings are built on the sites. The site was divided in 1982 under AT 820309:2 and the two existing lots were created. One of the conditions of approval was that the existing "illegal" grading on site be corrected; this has not yet been accompolished. This map will, therefore, be conditioned to require the grading to be corrected prior to recordation of the final map. C. DeCamp, Senior Planner /40 DATE: October 6, 1987 RE: TPM 27-87 (Brink) At your meeting of September 1, 1987, the Commission considered the application of Ralph Brink for the resubdivision of two (2) parcels containing 1. 46 acres into three (3) lots ranging in size between 20,000 square feet and 22, 600 square feet. The discussion at that meeting was focused on the configuration of the resultant lots. The applicant' s proposed map would create one lot along the property frontage on Sombrilla with two lots extending up the hill behind the existing house on the site. This configuration would result in the creation of two flag lots and would necessitate excessive grading to develop the two uphill lots. The location of homes on this hillside would not be in keeping with the general development pattern throughout the remainder of the neighborhood. At the conclusion of the discussion, the Commission voted to continue the item to the October 6, 1987 meeting with a suggestion to the applicant that he return with a redesign of his project which would be more in keeping with the character of the surrounding neighborhood. In response to this action, the applicant submitted a revised map on September 24, 1987. The revised map would result in the creation of three lots ranging in size between 20, 000 square feet and 23, 100 square feet (see Exhibit B) . Each of these lots would have frontage on Sombrilla and would allow for the development of a single family dwelling on the lower portion of each, while maintaining the steeper slopes in an open state. The applicant has agreed to the imposition of building restrictions on the upper portion of each lot to guarantee such open space. As submitted, this revised map eliminates most of Staff' s earlier objection to the proposal. The revised tentative map proposes lots which exceed the maximum three-to-one width-to-depth ratio provided for in the City' s current subdivision ordinance. This provision of the ordinance precludes the development of overly long and narrow lots which have proven difficult to develop, utilize, and maintain. The ordinance does, however, provide for a waiver of this standard . where circumstances or site characteristics warrant. In the present case, Staff has determined that special circumstances (excessively steep slopes and an open space reservation) do exist which would allow for a waiver of the three-to-one standard. Tentative Parcel Map 27-87 • October 6, 1987 Page 2 RECOMMENDATION: Based on a waiver of the three-to-one width-to-depth ratio, Staff recommends conditional approval of Tentative Parcel Map 27-87 (as revised September 24, 1987) based on the Findings for Approval contained in Exhibit C of the Staff report dated September 1, 1987 and the Conditions of Approval in Exhibit D of that Staff report as revised October 6, 1987. Tentative Parcel Map 27-87: Request initiated by Ralph Brink (Cuesta Engineering) to al- low resubdivision of two parcels containing 0.73 acres into 3 lots containing approximately 20 ,000 square feet each. Sub- ject site is located at 7565 Sombrilla Avenue; legal descrip- tion being Lot 3 of Block E in Atascadero Colony. In presenting the staff report, Mr. DeCamp pointed out that this subdivision request is a resubdivision of two existing legal par- cels so only one additional building site on the property would be considered. He further added that although the application meets the very minimum requirements of the General Plan and Zoning Ordi- nance, there are major constraints associated with this property, and that a higher level of review may be appropriate in this case. There was discussion by the Commission concerning the original division of the site in which the map was finaled without the existing "illegal" grading on the site being corrected. There was also discussion concerning the actual buildability of a . lot versus the desirability of a buildable lot; it was noted that the Commission can have an additional level of review to make sure all mitigating factors are taken care of. There was discussion concerning the Fire Department' s concerns with regard to access • and the site 's steep slopes. 4 0 Minutes - Planning Commission - September 1, 1987 Ralph Brink, applicant, spoke in support of the request and noted he has arranged to have all utilities undergrounded. He assured the Commission that with regard to the aesthetic aspects of the site, he would do everything he could to make sure that the site is developed in compatibility with the neighborhood. In response to question from Commissioner Lopez-Balbontin, Mr. Brink noted that he purchased the property a year ago and was not aware of the grading problem. John Falkenstien, engineer on the project, referenced condition #16 concerning the driveway slope and assured that the driveway could be put in under a 20% slope. He added he did not see any- thing unusual or extreme with development of the site that mitiga- ting conditions could not take care of. Mr. Falkenstien also pointed out that Mr. Brink intended to have CC&Rs in place with the project, even though they are not required. Linda Schaff, 7585 Sombrilla, presented the Commission with a pe- tition consisting of 22 signatures stating the reasons for their opposition to the proposal (lack of privacy, drainage problems, angle of lots, increase in traffic, concern with decrease in prop- erty values) . She stated that the neighborhood wants to maintain the ruralness and openess of the land with its beauty and sur- . rounding hills. Ms. Schaff concluded by saying that whatever. spe- cial considerations are given, it is still going to change. the aesthetics of the hillside. Barbara Reiter, 10150 San Marcos, stated her opposition to the project for the following reasons: creation of two flag lots, and the proximity of building site locations. She spoke on the Plan- ning Commission' s discretion to deny the application if it is deemed inappropriate. Vince LaVorgna, 9170 Santa Barbara Road, spoke about the proposed conditions in relation to the concerns which were raised by the Commission and in public testimony. Mr . DeCamp clarified that the conditions attempt to mitigate what impacts are possible as a result of the lot split. Commissioner Bond felt that this application would result in the creation of two flag lots; the slopes on this property are too steep; certain trees may have to be cut down with this proposed site plan; and he did not feel this application meets the intent of the 20,000 square foot criteria. Commissioner Hatchell stated there are many flag lots that exist in Atascadero and pointed out that right across the street from this site there is RMF/10 zoning. Commissioner Kidwell expressed concern with the site ' s terrain being so steep, and felt that this is not the best area suited for 20,000 square foot lots. 5 • • Minutes - Planning Commission - September 1, 1987 • MOTION: Made by Commissioner Bond and seconded by Commissioner Kidwell to direct staff to bring back findings for denial for Tentative Parcel Map 27-87. In response to question from the Commission concerning his feel- ings about a redesign, Mr . Brink replied that he would have to confer with his engineer to see if this is possible. Mr . Falken- stien clarified his understanding of the motions and noted what possible course of action the applicant may take. Discussion ensued concerning the proper procedures for further consideration, study, appeals of the decision, etc. Commissioner Michielssen modified the motion to leave out the bringing back of a redesign and to just continue the hearing for further study on October 6, 1987. Tentative Parcel Map 27-87 : Request initiated by Ralph Brink (Cuesta Engineering) to allow resubdivision of two par- cels containing 1.46 acres into 3-- lots containing approxi- mately 20,000 square feet each. Subject site is located at 7565 Sombrilla Avenue; legal description being Lot 3 of Block E in Atascadero Colony (CONTINUED FROM COMMISSION MEETING OF SEPTEMBER 1, 1987) . In presenting the staff report, Mr. DeCamp reviewed the background from the previous hearing and noted that a revised map had been submitted in which each of the three lots would have frontage on Sombrilla and would allow for the development of a single family dwelling on the lower portion of each, while maintaining the ste- eper slopes in an open state. Mr . DeCamp also pointed out a 3:1 width-to-depth ratio on this tentative map which is being re- quested to be waived due to special site characteristics and cir- cumstances. Mr. DeCamp noted a modification to Condition #12 which would in- clude language for a scenic easement and would appear as a note on the final map. The reasoning for this change would be to assure that there would not be any confusion that the open space reserva- tion was any type of a dedication of open space. Discussion fol- lowed concerning other similar cases where this was used. (7:42 p.m. - Commissioner Lopez-Balbontin is now present. ) Ralph Brink, applicant, stated he considered the neighbors ' objec- tions when he revised the map. He noted that no trees would be cut down, there would not be any excessive grading, and there would not be any creation of flag lots on the site. He felt that since the map conforms to the necessary requirements, that the application should be approved; he had no objections to the condi- tions; however, he did ask for clarification of Condition #5. John Falkenstien, engineer for the applicant, spoke in support of the request. He referenced the CC&Rs which the applicant would incorporate with the project even though they are not required; and wanted to be sure that he would have the ability to bond for some of the requirements. Mr . Falkenstein responded to questions from the Commission. Alden Shiers, 7515 Sombrilla, appreciated the changes which have been incorporated within the revised map, but still doesn' t feel this request is compatible with the neighborhood. He spoke about the narrowness of the street with regard to the increase in traf- fic which will result and was opposed to the increase in density. Linda Schaff, 7585 Sombrilla, referenced three letters she had from adjacent neighbors (Ellen Columbo, Belva Little and Charles and Nancy Buck) citing their reasons for opposing this project. Mrs. Schaff reiterated her concerns from the last hearing noting how the neighborhood character would be changed with this divi- sion; the increase in traffic; and the lack of privacy the new homes would create. 2 0 0 Minutes - Planning Commission - October 6, 1987 Mr. Falkenstien addressed concerns raised by the previous. speakers. Additional comments in opposition were addressed by Mr . Shiers and Mrs. Schaff. Mr. Brink stated he had listened to the neighbors' concerns but emphasized that this project is in confomance with the existing General Plan and Zoning Ordinance regulations. Commissioner Bond stated he was opposed to the first map design, but felt the revised map complied with the necessary criteria. He suggested that the word "existing" be added before the " . . . . . . . 950 foot contour line. . . . " in Condition # 12. MOTION: Made by Commissioner Bond, seconded by Commissioner Hatchell and carried 6 :0 on a roll call vote to approve Tentative Parcel Map 27-87 subject to the findings and conditions contained in the staff report, with modifica- tion to Condition #12 as follows: "12. Sensibaugh, Director of Public Works/City Engineer Subject : Revise of Rotunda Rental Policy Date : October 19, 1987 Recommendation: Staff recommends that Council approve . Resolution that will place the rental responsibilities and fee collection in the Department of Public Works instead of the Parks and Recreation Department and which will correct the fee to be charged. Backround: The policy for the above was established this summer and was set •up on such a basis that administrative changes could be made after feedback was given from renters . Only one rental was made—that for a Doll Show. Marge Mackey coordinated the show and made helpful notes for improvements to the system The first observation was that not all of the Lounge facilities worked and that the fee charged was not as she had remembered in the Council discussions . (The plumbing, etc . has been scheduled for corrections and the fee is addressed in the attached resolution—from $50 to $35 . ) The second observation was that the custodian on hand should assist in the set up and take down for the renter. That idea will be on trial during the next rental as long as the renter does the majority of the work. Discussion: The attached resolution essentially takes the Rotunda rental from the Recreation fee resolution and forms a seperate resolution. This will provide a one stop service to the people and will allow for a smoother internal procedure when assigning hired help . Fiscal Impact : No appreciable change . BACKGROUND: At their regular meeting of October 6 , 1987 the Planning Commission voted 5 :1 to deny the above-referenced Conditional Use Permit. There wasconsiderable discussion regarding traffic and safety issues, and several neighbors spoke in opposition to the project. • RECOMMENDATION: Uphold the Planning Commission' s denial of Conditional Use Permit 5-87 to establish a private Elementary School by concurring in their Find- ings for Denial. ALTERNATIVE: The October 6 , 1987 staff report contains findings for approval and conditions of approvel for the use for one year. Box 927 Atascadero, CA 93423 October 9, 1987 Atascadero City Council P. 0. Box 747 Atascadero, CA 93423 RE: Conditional Use Permit 5-87 Dear Council Members, I appeal the decision of the Atascadero Planning Commission to deny Conditional Use Permit 5-87 for Santa Lucia School.. I believe the Council should reverse the decision of the Planning Commission and approve this permit for the following reasons: 1. Traffic safety, the main concern of neighbors opposing this permit, was addressed by the Planning Department and the Public Works Department. Their analysis is that even maximum traffic that could be generated from this project would be within the safe capacity of all roads providing access to the project. Their findings are based on fact. 2. There is no eveidence that our offer to carpool, thus reducing traffic further, was given the slightest consideration. 3. People involved in this project are child oriented. The safety and well-being of all children, those attending the school as well as those living in the neighborhood, is our top priority. We will be safety conscious, thcuahtful neighbors. 4. The project site has been historically used as a school . Our maximum enrollment of 32 would be 2/3 of the previous enrollment. We would operate 4 instead of 5 days per week. 5. The permit would expire in one year. The permit would be re-evaluated at that time. 6. The service we offer is desired and would benefit the community as a whole. Thank you for your consideration. Sincerely, y 0-0 Janet Thompquist Director • i EXHIBIT I - Findings for Denial Conditional Jse Permit 5-87 Santa Lucia School October 20, 1987 FINDINGS: 1. The proposed use would be a regional facility located within a local neighborhood and is not consistent with the General Plan land use designation of the site and policies; and 2. The establishment and subsequent operation and conduct of the the use could, because of the circumstances, be detrimental to the health, safety and welfare of the general public and persons re- siding in the neighborhood of the use; and 3. The proposed use will be inconsistent with the character of the immediate neighborhood; and 4. The proposed use will generate a volume of traffic beyond the safe . capacity of roads providing access to the project and beyond the normal traffic volumes of the surrounding neighborhood that would result from full development in accordance with the Land Use Ele- ment. i • CITY OF ATASCADERO Item: B,5 STAFF REPORT FOR: Planning Commission Meeting Date: Oct. 6,1987 BY: Joel Moses, Associate Planner File No: CUP 5-87 SUBJECT: Conditional Use Permit to establish a private Elementary School (kindergarten to sixth grade) for a maximum of 32 students. BACKGROUND: In 1981 the City of Atascadero approved Conditional Use Permit U:810203; 1 for Steve and Jeanne Salayon to allow for the establishment of a Day Care/Pre-school on the site. The approval limited the number of children on the site to 20. An appeal of the approval was made by two of the neighbors to the City Council. The appeal was denied, an additional condition was added to the approval requiring the reduction of the number of animals on the site to levels approved by the Zoning Ordinance. In 1982 the City of Atascadero reviewed and approved Conditional is Permit U: 821020; 1 requested by the Salayons. The Use Permit requested the expansion of the allowed number of children on the site from 20 to 48 children. The expansion was approved. The Salayons have sold the property and the use has been discontinued for more than 6 months. In being closed for more than 6 months, the use has lost its approval status for the Day Care/Pre-School use. The proposed use of the site would thus require the approval of a Conditional Use Permit to establish the use. The use would be categorized the same as the previous use as a "school". A. ANALYSIS: The zoning Ordinance allows for the establishment of a school within the RSF (Residential Single- Family) Zone subject to the approval of a Conditional Use Permit and development standards (Sec. 9-3. 153b & Sec. 9-6. 125 Exhibit G) . The approval would be subject to the required findings listed in the Zoning Ordinance for CUP' s (Sec. 9-2. 109) . These six findings cover standard areas • of concern and potential impacts caused by a proposed use. The findings require that the use or project conform to the General Plan, the provisions of the Zoning Ordinance, and the established City Policy and Criteria. In reviewing the project, the use conforms to these requirements. The use meets the required parking standards and location standards set by the ordinance. The proposed use conforms to the General Plan Land Use designation for the site and the Policies concerning the site. Two additional findings are standard findings noting that the use would not be inconsistent with the surrounding neighborhood and would not, during the operation of the use, be detrimental to the public health, safety or welfare. The site has previously been used for a "School" and has operated without dramatic impact on the neighborhood. The site and other "schools" have operated within residential neighborhoods without detrimentally affecting the neighborhoods, or the general public. The proposed school while smaller is a regional facility and sound planning would encourage a location on a collector road and not in the middle of a residential neighborhood. The final required finding address the question of traffic generation from the site or use. The finding requires "that the • • Conditional Use Permit 5-87 Oct. 6, 1987 Page 3 . use or project not generate a volume of traffic beyond the safe capacity of all roads providing access to the project. . . or beyond the normal traffic volume of the surrounding neighborhood that would result from full development in accordance with the Land Use Element" . In reviewing the project's traffic generation, the staff reviewed the project with the Public Works Department. It was noted that the proposed use would generate approximately 70-80 trips per day. This would be a reduction from the previous Day Care/Preschool use that would have generated traffic in the area of 120-130 trips per day. It was also noted that the use would generate different peak hour demands. The previous use would have peak arrivals and departures that coincided with the peak morning and evening hours, where the proposed use would be off hour (8: 30am & 3:30pm) . The access roads were noted as being able to accommodate the proposed traffic. The applicant has noted in a letter to the neighbors the use of carpooling (Exhibit H) that would reduce any potential traffic impacts. The proposal should be encouraged but the enforcing of any condition would be difficult at best. The applicant has stated that the proposed use would be temporary. Relocation would occur in about one year, (after June 1988) . The staff notes that the use of the site would and should be addressed as a permanent use not as a temporary use. • The applicants are seeking to build a new school building outside the City. The problem is that the site is fully developed with a structure that has been previously developed and approved by the City for the use as a school. Comments were received from outside agencies. Comments noted the need for the structure to conform to all Building and Safety Code regulations, and State permit procedures. Also noted was a concern from the Fire Department over the name of the school. The possibility exists of confusing the school' s name (Santa Lucia School) with a location on Santa Lucia Road, rather than its actual site on Palomar. C. San Luis Obispo County. The school proposes to lease the site at 9148 Palomar Ave. for the 1987-1988 school year to accomodate a projected enrollment of 32 students, grades K through 6. The school will operate between the hours of 8:30am and 2:30pm, Monday through Thursday, with childcare available before and after school hours. The school will employ two accredited teachers and two teachers aides, plus an art teacher one day per week. The parents and teachers will carpool daily. The site has been .used historically as a day care center/preschool, licensed for 48 children in December, 1982. Originally a single family residence, the property was converted for use as a preschool in 1981, after receiving its conditional use permit March 16. The school remained operational until April of 1986. • The Santa Lucia School is in the process of obtaining its Countv Land Use Permit for a site in "Templeton which was purchased earlier this year. Due to delays in receiving approvals and the expected time for building permits and remodeling, the school does not anticipate occupancy until 1988. Therefore, our request is for a Conditional Use Permit at 9148 Palomar Ave. for a 12 month period, beginning in th Pall of 1987. • EXHIBIT G Zoning Ord CIT Y OF ATASCADERO CUP 5-87 9148 Palomar CA COMMUNITY DEVELOPMENT Santa Lucia School O ZZQ DEPARTMENT Schools: An institution or establishment that provides a program of instruction and teaching services. Conditional Use Permit 5-87 : Request initiated by Santa Lucia School (Susan Cook) to es- tablish a private elementary school for 32 students on a 2.07 acre site. Subject site is located at 9148 Palomar ; legal description being Lot 1, Block 10 in Atascadero Colony. At this point, Steve DeCamp excused himself from the proceedings due to a possible conflict of interest. Chairman Nolan noted that the Planning Commission has received several letters from adjacent neighbors opposing the project. Mr. Moses presented the staff report recommending approval of the request. He pointed out that the use is a temporary one as the applicants are planning to relocate their facilities in Templeton by 1988. It was also noted that the Fire Department had indicated a concern with the name of the school (Santa Lucia School) in re- lation to Santa Lucia Road. Mr. Moses then responded to questions from the Commission. Sue Cook, applicant and coordinator of the school, spoke in sup- port of the request and noted that the use of this site was tem- porary in nature. She stated the school has purchased a location in Templeton in which they hop to be able to locate in 1988 and indicated that the adjacent neighbors were contacted concerning this application. She addressed Condition #5 concerning the name of the school and noted that a constant contact with the Fire De- partment could help mitigate their concern with the name of the school. Neil New, 9141 Palomar , commented on the 20 letters with 35 signa- tures from people opposed to the use permit. He spoke about the previous approvals with the preschool and noted his opposition to the request. 5 • • Minutes - Planning Commission - October 6, 1987 Larry Dubrul, owner of the subject site, stated he had run a pre- school until excessive insurance rates forced him to close the school. He did not think there would be a problem with the name of the school. Linda Smith, 7955 Valle, noted her opposition to the project as she did not feel the traffic increase would benefit the neighbor- hood. Richard Louder, 7955 Castano, spoke in opposition to the project. He felt that the findings were abitrary in nature and that insuf- ficient data was given to adequately address the full impacts this type of project would have on the neighborhood and talked about the possible need for an E.I.R. Mildred Peresig, 9101 Palomar, expressed her opposition to the project citing the roads being too narrow, the high number of speeding cars on the street, etc. Chuck Smith, 7955 Valle, clarified that Palomar is very steep where the site is located and noted that many people use Valle as a primary access through to Curbaril. He felt cautionary signs should be posted along the road. Jan Tompquist, Director of Santa Lucia School, addressed some of. the concerns expressed by the neighbors and emphasized that safety of the children is their highest priority. She indicated her wil- lingness to post safety signs and noted that a great deal of car- pooling would take place with the students. She asked the Commis- sion that the project be judged not on speculation of what could happen but what the Commission has before them. There was discussion among the Commission concerning adequate no- tification to the neighbors on this hearing, traffic and safety issues in the area, etc. MOTION: Made by Commissioner Bond and seconded by Commissioner Copelan to deny Conditional Use Permit 5-87 . The motion carried 5: 1 with a roll call vote: AYES : Commissioners Bond, Copelan, Lopez-Balbontin, Copelan, and Nolan NOES : Commissioner Hatchell C. PUBLIC COMMENT Ther was no comment this time. D. INDIVIDUAL C N AND/OR DETERMINATION: 1. Pl ning Com"', o ' ssion Community Development Director City of Atascadero In response to the proposed Santa Lucia School. we would like to add some of our own thoughts regarding the potential impact in the surrounding area. We feel very strongly about the increased traffic flow that would inevitably result with the operation of the school. As was pointed out in the other letter. the streets that would be effected are not well-marked and have no sidewalks. As it is right now. we feel discouraged from taking our 2 year old daughter out .for walks since it has been our experience that most drivers tend to drive too fast and are not looking for pedestrians. This. coupled with the fact that the - roads are narrow and winding to begin with, makes the Castano. Palomar. and Valle streets very dangerous for pedestrian traffic. Still. what one must keep in mind is that this is a residential area and there. are many families with children that play in the streets. We're very concerned that it Just a matter of time- before there is an accident that will involve a vehicle and a child. . The additional traffic flow from the proposed school. in our opinion,. is unacceptable for the safety and very nature of the area that we live in. Thank you for your time and consideration. Duane and Ingrid Inclish 7685 Castano St. Atascadero. Ca. 466-8376 Octob91 1987 To : Community Development Director City of Atascadero RE : Proposed Santa Lucia School/ Negative Impact on Palomar Avenue Dear Sir : I have lived on Palomar Avenue since February of 1982 . I have witnessed a dramatic change in traffic pattern since the closing of the preschool located at 9148 Palomar Avenue . We no longer have to contend with hurried parents dropping off their children in the mornings and afternoons . It has been a welcome relief for those of us that use Palomar for residential related use . For instance , whether Ehey should or not , neigh- borhood children do play in and adjoining the roadway . This is particularly true of the 8900 block of Palomar . Furthermore , the children MUST use the roadside in the mornings and after- noons to come and go to the city school bus stop on Palomar near El Camino Real . I personally u•se the roadside for daily morning walks . As it is , I can easily hear and avoid approach- ing traffic even if I cannot yet see. the vehicle . Where the road is narrow with steep banks , even now this can be challeng- ing . In the case of such increased traffic as the proposed 32 student school would certainly create , I feel that the road side would no longer be safe for walking . I know of at least four other people who use the road for a daily walking regimen who would be adversely affected by the new use . I do not feel that we should be forced to give up our safe use of the road to satisfy the interest of Ms . Cook .' Should any one of my neighbors be harmed as a result of their legal pedestrian use of Palomar Ave . by the staff or clientel of the proposed Santa Lucia School , it is my opinion that the City of Atascadero would be , to some extent , respons- ible for allowing the hazardous traffic copdition =to be cre= ated . Please do not create this situation in my neighborhood . Thank you for your time , Linda Gf'one Smith 9031 Palomar Ave . Signed Address '973 y MEETING J AGNDA DATC Z/ ITEM —Z • MEMORANDUM To: Honorable Mayor and City Council Through: Michael Shelton, City Manager From: Pau M. Sensibaugh, Director of Public Works/City Engineer Subject : Public Hearing—Boundary Resolution—Undergrounding Project Date : October 19, 1987 Recommendation: The Undergrounding Advisory Committee recommends that public input be taken regarding the proposed boundary but that the resolution not be considered until the November 23 Council meeting. Backround: The above committee has recommended the attached boundary subject to modifications along West Mall from Olmeda to Atascadero Creek. A Public hearing is required since the owners will have to make new connections to their private facilities . There will be a BIA general meeting on November 18, the agenda for which will include the Undergrounding project. Another Public Hearing and potential passage of the final resolution is anticipated on November 23. Atached is the proposed time table presented earlier which anticipates this Public Hearing right on schedule . Discussion: The project will pay for the entire Public improvements and the first 100 feet of the service lines . In the case of the downtown area which is proposed, no properties are expected to require more than the alloted footage . Therefore, there will be no assessments and thus a Protest hearing is not necessary. Since, however, some property owners may face connection costs greater than the amount of their Perceived benefit, they will have the opportunity to give input on at least three ocassions. • The boundary generally runs from E1 Camino Real to Olmeda and • from Atascadero Creek to just west of Traffic Way. PG&E is checking the cost of including the West Mall portion from Olmeda to Atascadero Creek. Besides beautification of the downtown the project is significant due to the safety aspects of underground utilities versus overhead utilities . Furthermore, when the tree program is realized in the BIA area future conflicts with overhead wires will not be an issue . Fiscal Impact : The project will be supported by the Rule 20—A PG&E . Undergrounding funds which to 1990 will amount to about $730,000 for Atascadero. All private reconnection costs will be the burden of the property owner. s • RESOLUTION NO. Cuesta Engineering CITY OF ATASCADERO Item: B-3 STAFF REPORT FOR: Planning Commission Meeting Date:Sept. 15, 1987 BY: Joel Moses , Associate Planner File No: ZC: 9-87 & TTM: 10-87 SUBJECT: Zone Change 4-87 and Tentative Tract Map 10-87 initiated by Woodglen Development Ltd. to rezone property at 6875 Tecorida Ave from RMF/16 (FH) to RMF/16 (FH) (PD-7) to allow for the development of the 1. 2 acre site into a small lot subdivision containing 9 residential lots varying in size from 3968 square feet to 7074 square feet. BACKGROUND: The site has been zoned RMF/16 (FH) (Residential Multiple Family with a Flood Hazard Overlay) since the establishment of the current Zoning Ordinance in 1983. The site has been designated on the current General Plan Land Use Map as High Density Multiple Family since 1980. The property was in a moratorium area for development for several years due to its location within the Amapoa / Tecorida Flood Area . The moratorium on development was only lifted with the establishment of standards for development within a flood area. The area is not designated at this time within a designated 100 year flood area, but is designated by the City in response to studies under taken by the City on flooding in the area. The applicants initially submitted a request to rezone and subdivide an additional parcel to the east of the site as a part of the project. After review by the staff and a determination that an Environmental Impact Report would be needed the applicant scaled down the project and reduced the potential environmental impacts. A. ANALYSIS: The application proposes to rezone the property to allow the re-subdivision of the land into a 9 unit small lot subdivision. The rezoning of the property will be required due to the property' s current zoning of RMF/16 (FH) requiring a minimum lot size of 1/2 acre and the required front yard setbacks of 25'-0" . As a part of that rezoning a specific plan for development and coinciding tract map are being presented for approval ( Exhibits B & C ) . The developer has also submitted a set of proposed development standards for the project (Exhibit D) . The site is currently undeveloped along the south side of Tecorida Road (undeveloped) ( ) east of San Andres Road. The site P contains a drainageway for the Amapoa/Tecorida area and a portion of another drainageway coming from the south. The site and adjoining road area also contain a number of trees. The adjoining propertys are currently zoned RMF/16 (FH) to the south and east . The property' s to the north across Tecorida Road are zoned CR(FH) (PD-3) (Commercial Retail with Flood Hazard and Planned Development overlays) . Across San Andres to the west the zoning changes to LSF-Y (FH) (Limited Single Family Residential, 1 acre minimum lot size with sewer with a Flood Hazard Overlay) In reviewing the project comments and information was acquired from several outside agencies that add to the environmental review of the project. The property is located close to a known archaeological site and a site survey was required as a part of the review. The survey noted no specific finds of archaeological artifacts; if any are found during construction the find would be reviewed at that time. Comments from Caltrans were also received as to the potential impacts of development along Morro Road. These impacts included delays and congestion at the Morro Road /Marchant Ave and the Morro Road/Atascadero Road intersections. Concern was also expressed as to the need for construction of additional drainage facilities. This is due to the design capacities of the existing 36" culverts under Highway 101 that were based on the undeveloped state of the drainage area (Amapoa/Tecorida) when designed and installed. The comments were • • Zone Change 9-87 & TTM 10-87 is Sept. 15, 1987 Page 3 reviewed by the Public Works Director and a traffic and drainage reports prepared for the project It was found that the current development fees and proposed development improvements would mitigate the potential impacts. The site was also reviewed for potential problems with flora and fauna removal. The plans were reviewed by the State Department of Fish and Game. After the review a steam alteration permit was issued under specified conditions listed in the permit. Comments were received from the Building division about the potential concerns as to the soils on the site. A soils report was prepared by a Register Civil Engineer for the site. The report was reviewed by the City' s Engineering division and found adequate to allow for the development of the site. The Fire Department' s review of the project showed no problems. Access was good but standard fire hydrants shall be required. Comments from utility companies requested standard easements and advised that the site can be served from existing facilities. Under the current RMF/16 zoning of the property of the site would fall under the hillside density standards. The application was submitted initially before the standards went into effect but will now have to comply with the new standards. At 16 units per acre the site could have held 19 residential apartments. The City' s current standards based on slope and the number of bedrooms on the site could allow for a varying degree of intensity of development. Densities could range from 16 units per acre for 1 bedroom units to 6 units per acre for 4 bedroom units. This could allow for the development of up to 19, 14, 10 or 7 residential units on the site. Under the developers proposal for 3 bedroom units on 0-10% slope a density of 8 units per acre maybe allowed. This would allow a maximum of 10 units on the site. The proposal is to provide 9 - 3 bedroom residential units on the site and thus would be within the City' s density standards. The proposed density would also be well below the maximum of 19 units possible on the site. The proposed site plan is also seeking to modify the street frontage setbacks that are normally required for this type of development. The normal 25'-0" setback on the front of the proposed lots is proposed to be reduced to 10 '-0" on most of the lots. The design still provides for a 20 '-0" drive to a double car garage for each of the units. The street side yards are shown as being approximately 10 '-0" which would be in conformance with zoning ordinance standards (Sec 9 4. 107 (a) 1) . • ! • Zone Change 9-87 & TTM 10-87 Sept. 15, 1987 Page 4 The Zoning Ordinance in allowing for the establishment of a Planned Development requires special findings (Sec. 9-3. 644) . These four findings deal with the needs and the benefits derived from the modification of the zoning ordinance standards for the project. The proposed projects smaller lots and reduced setbacks can only be approved through the Planned Development Overlay process. The Overlay would promote the orderly and harmonious development of the city by coordinating the development of three 10 parcels of land as opposed to the random development of the properties. The proposal would benefit the City also in the reduction of potential residential density in the area. The proposed project could provide more affordable housing for the community, while reducing the potential density of development on the site. Thus all four finding required by the Ordinance can be made for this proposal. In summary the development has been reviewed for potential impacts and staff finds that the impacts can be mitigated. The project meets the density standard and actually reduces potential development. The project design has been reviewed and • it is recommended that the required findings can be made for the. approval of the project. The proposed street name of Los Arboles has been reviewed with the local emergency response agencies and no problems noted. C RECOMMENDATION: Staff recommends approval of Zone Change 9-87 and Tentative Tract Map TTM 10-87 based on the findings contained in Exhibit E, Findings of Approval and Exhibit F, Draft Ordinance and conditions contained in Exhibit G, Conditions of Approval for Tentative Tract Map 10-87. including the use of Los Arboles Circle as a street name for the project ATTACHMENTS: Exhibit A - Location Map Exhibit B - Site Plan (ZC: 09-87) Exhibit C - Tract Map (TTM: 10-87) Exhibit D - Developers Statement Exhibit E - Findings of Approval (TTM: 10-87) Exhibit F - Draft Ordinance (ZC: 09-87) Exhibit G - Conditions of Approval (TTM: 10-87) , --tom ., I► . ii .. The applicant proposes a single-family residential project rather than multi-family apartment units permitted under the current zoning. The project proposes 15 units (7 units per acre) rather than 33 units (16 units per acre) allowed under current zoning. Single-family detached units are in keeping with the mixed residential uses in the neighborhood. The "PD" overlay zone would allow creation of smaller lots so that the project homes and lots can be individually and privately owned. The "PD" Development Standards will ensure orderly development of individual lots and maintenance of common easements and facilities. The concurrent, planned development of the 4 separate lots will avoid piecemeal work on the drainage areas. A master plan also improves traffic circulation, reducing the number of access points to public • streets by providing one private street rather than four separate driveways with parking lots. "PD" modification of setbacks allows for better useable yards by reducing front yards and increasing rear yards. "PD" control of landscape design and maintenance ensures adequate screening and shading of the project. The attached development standards are proposed to supercede the existing RMF zoning standards. 0 i EXHIBIT E - Findings for Approval • Tentative Tract Map 10-87 6875 Tecorida Road Sept. 15, 1987 FINDINGS 1 . Accepted the report from the Planning Commission, which gives the Council future discretion to dispose of the property as surplus to City needs. 2. Referred the matter to the Parks and Recreation Department for • consideration as a possible recreation site for the neighborhood. The Parks and Recreation Commission has reviewed the matter (refer to attached Memorandum, dated September 14, 1987) . PARKS AND RECREATION COMMISSION RECOMMENDATION: As indicated, the Commission supports the action to declare the prop- erty as surplus, and requests that all revenue received from the sale of property be used to purchase property at Morro Road and Amapoa for the development of a Community Center . The property was not consid- ered of appropriate scale or interest to provide for recreation needs. However , the Planning Commission has recommended that there be a 25 foot access recreational easement crossing the site to connect the neighborhood to the Salinas River area. This would also allow for emergency access in time of flooding. . PUBLIC WORKS DEPARTMENT NEEDS: The Public Works Department has indicated that they will need the property over the next year for access while bridge construction is undertaken. But after that time there would be no public use needed (except for emergency/recreational access) . • RECOMMENDATION: Receive the Parks and Recreation Commission' s recommendation and di- rect staff to dispose of the properties after the Public Works Depart- ment no longer needs it for access. Recommended that City owned property located on Sycamore Road in River Gardens (APN 28-092-09) be designated as surplus property. All revenue received from the sale of this property shall be used to purchase prop- erty in the 8000 Block of Morro Road and Amapoa Avenue for the develop- ment of a Community Center. 2 . Recommended that City owned property located on Traffic Way (APN-29-091- 06) adjacent to 01 Smokey Meats be designated as surplus property. All revenue received from the sale of this property shall be used to purchase property in the 8000 Block of Morro Road and Amapoa Ave . for the develop- ment of a Community Center. In addition , the Commission recommends either a lot line adjustment or easement prior to sale for the purpose of ingress/egress to the Traffic Way Multi-Purpose Fields , as a driveway is planned for a corner of the property. Some type of slope maintenance should be part of any sale to prevent excessive water runoff. Finally, to provide for the sale of this property the commission recommends this property be re-zoned from Public to Industrial. The decision to recommend surplusing these properties was made more difficult due to the lack of a Master Plan for the department . To make future decisions on properties in the City, it is imperative that the department have a planning document available for guidance . HE:ps City of Atascadero Item: B-7 STAFF REPORT FOR: Planning Commission Meeting Date: June 16 , 1987 BY: Joel Moses, Associate Plannern. Lot Project Address: Sycamore Road P 4 , Blk H, Atas. Colony) SUBJECT: General Plan Conformity Report - City sale of real property located on Sycamore Road north of Hidalgo Road in River Gardens. (APN 28-092-09 Northern ptn. Lot 4, Blk H, Atascadero Colony) (Exhibits A & B) . BACKGROUND: The City of Atascadero acquired the approximate 12,000 square foot property as a part of the recent transfer of properties. The County had previously noted the property as surplus and had contacted the City in 1985 . The City has found no specific public purpose for the • property and now is seeking to have the property declared as surplus property so the property can be disposed of. ANALYSIS: The property is presently vacant. The City presently has no plans to use the property except as a detour route during the reconstruction of the Sycamore Road Bridge. The adjoining property is currently gen- erally developed with single family residential uses. The area to the East is owned by the Water Company and is used for gravel/sand extrac- tion. The area is designated Moderate Density Single Family on the General Plan; the corresponding zoning is RSF-Y (Residential Single Family - minimum lot size of 1 acre with sewer 1 1/2 acre without sewer) . The site is currently not provided with sewer but is within the Urban Service Area. The area to the West is within a leachfield problem area as noted in the City' s sewer study (John Wallace &Assoc- iates) . A review of the General Plan makes no specific statement as to the need for the property. However, a need is noted as to the need for the retention of an easement for emergency access and recreational use. Additional comments made in the General Plan might note the site as undevelopable. The Open Space and Conservation Element notes the site in the inundation and alluvium areas (Maps X-1 and X-2) (Exhibits C&D) and as such falls under the Public Safety Policies (page 84) sta- ting, "that permits shall be denied in the potential inundation areas" . Staff Report W 4C General Plan Conformity Report Page Two RECOMMENDATION: The staff recommends that the property be designated as surplus prop- erty, but maintaining a 25 foot access and recreational easement cros- sing the site connecting Sycamore Road and the Water Company property for access and recreational uses. The action would qualify as a Class 12 categorical exemption (sale of surplus property) from the California Environmental Quality Act pro- cess. The purpose of the request is for ingress/egress to the apartment complex now under construction. The area being requested is seldom used by park staff, as another service entrance is located in the central portion of the park. In discussions with Mr. Jim Spadaro , he has indicated a desire to provide any necessary precautions needed for safety, and the company is willing to provide additional improve- ments to Paloma Park above the requirements already in place relating to the &trooms. ISSUE STATEMENT The area of concern is whether the City should allow a private company to utilize public property for their private use over a prolonged period of time. In this particular case, it could be as long as 7 or 8 months, according to Mr. Spadaro . The Vandenberghe Company is willing to address the issue of safety by provid- ing a chain link fence from the point of entry to their property line, eliminating the potential of vehicles getting into the park area. They are also willing to provide someone for traffic control during any time the City deems necessary. In addition, for rental consideration they are willing to complete some badly needed work in the park -- either completion of all concrete work around the restrooms or paving the service road to the parking lot. This would save the City the expense of materials and labor for one of these projects . RECOMMENDATION Approve a License Agreement with Vandenberghe Construction Company for usage of a service entrance providing the following conditions are met: 1 . A hold harmless clause is included in the agreement, and the City is named as an additional insured. • 2. Hours of Operation: Monday-Friday: 7 a.m. - 5 p.m. ; No Saturday or Sunday entry allowed, except as needed security . Page 2 (Revision made to Rection #7) (Revised - 10/23/87) 7 3. Installation of chain link fence between park and service road for the duration of use. 4. Traffic control employee to be provided during all hours of operatio• 5. Dust control of parking lot and service road to be provided by water truck furnished by Vandenberghe. Water provided at expense of Van denberghe. 6. Paving of service road or concrete work to be completed according to the master plan for the park. All work completed shall be to City code. Completion date : November 30, 1987. 7• Agreement Time Period: October 27 1987 - September 30, 1988.:- Noy° extensibn: of time without authorization of City-.Council. FISCAL IMPACT There would be no fiscal impact to the City. As a result of the usage of this area, the City would benefit by the completion of additional work at the park. • t • Yq • s • LICENSE AGREEMENT TIiIS AGREEMENT, made and entered into this 27th day of October, 1987 , by and between the City of Atascadero, a municipal government of the State of California, hereinafter referred to as "City" , and VANDENBERGHE CONSTRUCTION COMPANY, a private contractor, hereinafter referred to as "VANDENBERGHE" , Witnesseth In consideration of the mutual covenants and upon the conditions hereinafter stated, the parties hereto agree as follows : 1 . MEMORANDUM TO: City Council THROUGH: Mike Shelton, City Manager FROM: -,Atfa ul Sensibaugh , Director of Public Works Valerie Humphrey , Clerical Technician SUBJECT : Weekend and Evening Transit Service DATE: October 16 , 1987 Recommendation : Staff recommends that weekend and evening taxi service is not cost effective and should not be implemented at this time . - Background: Council has previously requested that staff investigate the possibility of providing a weekend ''Taxi Service'' to the citizens of Atascadero . Staff has received requests for expanded transit services . Included in this report is a petition from some of the residents at California Manor requesting service one evening a week and Saturdays Mlany of the requests received mention a desire to attend church on Sunday , therefore this report addresses Saturday and Sunday service along with a per—evening cost for evening service . In this study we have fccused on three scenarios and their cost to implement . Tie scenarios are detailed below and include comments and applicable costs . Discussion : Community Transit Ser rices have been contacted regarding the possibility of adding a weekend service . They feel that this can be accomplished within the current scope of their contact with an "out of contract" agreement at the established hourly rate plus 10" . • Scenario ffi - C'ne Bus , Driver , and Dispatcher In this scenario the system would work much like it does during the .,reek. There would be a dispatcher on duty in the office and one bus with driver available for service on an on-call basis . This alternative would be the least complicated as it is the same system riders have become familiar with during the week . However , the cost of providing this service in relation to the number of riders anticipated on the weekend and evenings would be high . Cost Breakdown : Dispatcher and Driver $ 15 . 30/hour Bus - fuel and maint . 20 . 00/hour TOTAL 35 . 30/hour WEEKEND SERVICE: 8 hrs per day X $35 . 30 X 2 days = 5564 . 80 5564 . 80 X 52 = 529 , 369 . 60 per year EVENING SERVICE (per evening) : (6 p .m. to 10 p .m.) 4 hrs per evening X $35 . 30 = $141 .20 1 evening per week X 52 = 57 , 342 .40 per year _Scenario #2 - Bus Driver - Mobile Phone This alternative would utilize one bus and driver and require the purchase and installation of a mobile telephone . This system would save the cost of the dispatcher . The driver would be required to stay in the bus , except during breaks , to monitor the phone . Customers would be given a separate number to call on weekends for service . Cost Breakdown : Driver $ 7 . 65/hour Bus - fuel , maint . 20 . 00/hour TOTAL 27 . 65 • r WEEKEND SERVICE: 8 hrs per day X $27 . 65 X 2 days = $442 .40 $442 .40 X 52 = $23, 004 . 80 per year EVENING SERVICE (per evening as above) : 4 hrs per evening x $27 . 65 = $110 . 60 1 evening per week X 52 = $5 ,751 .20 per year Mobile Phone - purchase $1700 . 00 Monthly Service Charge $ 40 . 00+ EXAMPLE: Weekend and 1 Evening Service lst Year Cost - $30 . 936 . 00 2nd Year Cost - $29 ,236 . 00 - Scenario-#3 - Advance Reservation Service Service can be provided on an advance reservation • bads . Under this system, riders would call any time during the week to schedule rides on the weekend. This alternative would be the easiest to implement on a trial basis as it does not involve the purchase of additional equipment and can operate the most economically . However , conflict is anticipated at high use times as when several people want to be a different churches at the same time . In this instance the schedule and route may be unsatisfactory , If no rides were booked during the week there would be no cost for that weekend or evening. If only a small number of rides were requested, the driver could be guaranteed a minimum day , say 4 hours , and charge each additional :lour to the nearest half hour . The charge for the bus , of tour- would be Lased on actual time in service . Cost of Driver $ 7 . 65,"k_our Bus , fuel , maint . 20 . 00/hour TOTAL $27 . 65/hour Cost for driver if no reservations = $0 Minimum cost for driver =$30 . 60/4 hours Maximum cost for driver =$61 . 30/8 hours Cost for bus - actual service time Minimum cost for bus = $0 Maximum cost for bus = $160 . 00/8 hours • • EXAMPLE: Weekend and One Eveni nix Service Minimum cost per year $0 (:no request for service) Maximum cost per year $28 ,756 . 00 Existing Service : The cost and availability of conventional taxi service has been researched and found to be available from Paso Robles Cab or San Luis Yellow Cab . The standard taxi rate is $4 . 00 for the first mile and $2 . 00 for each additional mile . The customer is charged only for the miles between pick-up and delivery and not for transit miles for the cab between cities . As an example : an average round trip from the south city limits to Williams Brothers and back would cost approximately $14 . 00 . FISCAL IMPACT : Since additional service was not budgeted for under the LTF/STA transit funds , it would be necessary to fund this service using LTF/STA funds previously slated for street maintenance programs . (about $25 , 000 or 1 mile of resurfacing) If it is determined that this service should continue past a trial period, funds could be included in the Community Transit Contract and budgeted for the 1988/89 fiscal year . It is important to note, however, that in order to qualify for LTF/STA Transit Fund: we are required to collect a minimum of 13% of our expenses in farebox revenues . It is possible that if we elect to provide weekend and evening service at a heavily subsidized cost per ride ratio that we could possibly fall below the 13% level required and therefore , be forced to raise overall rates about 2590 or to $1 . 00 . It is possible that a special fare could be established for weekend and evening service to help defray the cost subsidy . Ridership may be approximately assumed at a maximum of 16 individual calls per day (orae every 1/2 hour .) . The cost per ride, therefore , would be about $15 . 00 per customer . r MEMORANDUM TO: City Council THROUGH: Mike Shelton, City Manager FROM: Paul Sensibaugh, Director of Public Works SUBJECT: Dial-A-Ride - ProDosed- 1986/87 Contract Renewal and Consideration of Service Expansion DATE: April 14, 1986 Recommendation: Staff recommends that the Dial-A-Ride contract be renewed with Community Transit Services, Inc. of Santa Ana and that a contract be brought back at a future meeting prior to July 1, and that the level of service by maintained equal or better without expanding services. Background and Discussion: Staff has had inquiries from citizens and council regarding the possibility of expanding the Dial-a-Ride Service to Weekends and/or evenings. Michael Moore, Location Supervisor for CTS has addressed these suggestions in the attached memo. The key points to the memo are; (1) DAR programs do better in this size of community than do fixed route systems, (2) There has not been a strong public desire to expand the service, (3) since revenue allocations are anticipated to decline in the near future, expanded services would most likely be short-lived, and (4) the cost would be approximately $10,000 to run one DAR bus for 8 hours on Saturdays. Staff would like to add that the expanded service, while desirable, would (1) reduce the amount of street resurfacing funds, (2) be difficult to pattern congruent with Atascadero' s spaghetti-like street layout, (3) involve a 2-hour trip to traverse El Camino Real North to South and to the Zoo and back, (4) be under utilized to key points of interest since those in the workplace provide their own mode of transportation and do not generally walk, (5) be needed mainly at the lunch break when the people scatter beyond the grasp of any flexible schedule we could conjur up, and (6) not enhance the needs of the handicapped or elderly (which make up over 60% of the ridership) or school children (which, for the most part, make up the balance) . Mr. Moore ' s memo addressed the need for new buses, saying that three of the five have an excess of 100, 000 miles. Two buses will be replaced in the 1986-87 budget and a third is anticipated in the following fiscal year . The oldest at that time will be a 1984 model. Ik According to the report there is a greater demand than we can accommodate between the hours of 2 PM and 4 PM, and a fourth bus on the road during that period is proposed at the cost of about $21,000 including the adjustment to the transit schedule. Staff agrees with that need, but recognizes the lack of demand for three buses at around 10 AM and 5 PM. (See attahced monthly management report) We, therefore, suggest an adjustment to the proposed time routing chart at no additional cost. The tie to the North Coast Transit would be acknowledged as well. 6:30 10 :30 4 7:30----9 : 00 1. 5 7: 45 12:45 5 10: 30 3: 30 5 11:00 4:00 5 12: 30 4: 30 4 2:30 6:30 4 28.5 The driver of the 10:30 AM to 3 : 30 PM 5 hour shift could take over the 7:30 AM to 9 : 00 AM shift and still be a part-time employee Six (6) drivers would be needed therefore instead of the current seven (7) . Most other hours would still enjoy 3 buses on the road, while transitioning from the light and heavy demand periods. Fiscal Impact: The recommended contract is 6. 5% greater than the previous year , mainly due to a requested $0. 25/hr hike in wages and another jolt in insurance services (incidently, the company has an excellent accident- mileage ratio) . The increase will be a direct reduction in SB325 funds that subsidize the street reconstruction program. It is anticipated the lower gasoline costs will offset this increase. It is further anticipated that since the gasoline tax is not a per- centage, that gas tax revenue may increase due to a greater con- sumption of gasoline across the state, because of the lower gasoline prices. 2 f • MEMORANDUM TO: Paul Sensibaugh FILE: Atascadero Director of Public Works DATE: March 20, 1986 City of Atascadero FROM: Michael Moore Location Supervisor Atascadero Dial-A-Ride SUBJECT: 1985-86 Contract 0_ I-2Waf - .rn6 . S The tentative estimate for the 1986-87 contract year is $157,279,00. This reflects the same level of service for the 1985-86 contract period. This estimate includes a raise for all employees of $.25 per hour ($4.25 starting salary) . Insurance costs have increased more than 50% to $16,175.00. This also is only an estimate, as final insurance costs will not be available until June. If this estimate proves high the balance will be returned to the City. (Community Transit Services underestimated the 85-86 cost by $1,417.00 which was absorbed by the company. ) In figrring the cost of an expansion in service 22.00 Y P ce an estimated cost of $ per flour should give a reasonably accurate figure i.e. 5 hours X 52 Saturdays X $22. 00 x $5,720.00) to add to the base con- tract price. In expanding service it would be wise to consider the following factors. First, it is almost certain that costs in the future will increase: This year ' s contract has increased 6.7% over last year ' s; also, as the fleet gets older maintenance costs will rise (3 of the 5 buses have in excess of 10G,000 0 miles) Although falling gas prices should ameliorate these costs for now. Second, transit subsidies will be declining. Section 18 funds are anticipated to decline 15% - 30% in fiscal year 1987 and their complete phaseout is expected in the next few years. It would be prudent to begin now to establish a tran- sit vehicle replacement fund. The cost of a lift-equipt vehicle is currently around $35 ,000. 00. Third, it is now relatively easy to add service; it will be in the future much more difficult to reduce the level of service to which the community has become accustomed. In considering weekend service it should be pointed out that while bus service would be wonderful it has not been declared an unmet need because most stores and services are available Monday through Friday. It could be argued that the need for transportation on Sun- days to and from church should be and is largely being met by the churches themselves. Morro Bay Dial-A-Ride has discontinued Sunday service because of a lack of ridership. r X11 ` I would only operate for nine months starting in September of 1986. would be expensive = 190 days X 5 hours X $22.00 L- $20,900. 40 It is evident that while requests for increased -service are infinite the funds available are finite. It would be prudent to begin now to consider long range plans about future costs, funding and the principals that will guide transportation services for the City of Atascadero in the coming years. xc: -Mike Shelton Don Leib • 3 i VEHICLE INSURANCE COST SUMMARY u t Y Type of Vehicle # --------------------- ------------------------------------------ V1ue Total - za k%t x Wayne Transet t e 1981 2 $8, 767 $17, 534 i f sem, Bluebird 198111, 37J 11, 37J 1 Chrysler Wide One 1984 1 23, 288 23, 188 Chrysler, Wide;:' One 1979 #t 1 ..9, 000 9, Z+00 ,r YJ ---------- (--- ------- ------------ ----------------- yw ] ------------------------------ I tsYt. _ TOTAL FLEET VALUE X61 097 s } for Prop ty Darn Ins 3. 60% 3 k ?. Sensibaugh, Director of Public Works/City Engineer Subject : Award of TV-Monitoring of the Sanitary Sewer System Date: October 19, 1987 Recommendation: Staff recommends that the Board award the TV-Monitoring portion of the Inflow and Infiltration project to Eagle Cam of San Luis Obispo in the amount of $35, 640 or $0 . 25/foot to be applied to actual quantities . Backround: At the last regular meeting the Sewer Cleaning portion of the I&I project was awarded and at staff 's request no decision was made on the TV-Monitoring until comparison demonstrations could be undertaken. Discussion: TV-Monitoring was performed by the apparant low bidder and the second low bidder on a common sanitary sewer line . The second low bid (Cyclops) had more sophisticated equipment and frills and more experience than the low bidder. This bidder also had a color camera (which was not specified) and on screen graphics . The low bidder had a quality black and white camera and displayed a log format that was easier to follow than the second low. The inexperience of the low bidder is expected to be made up in enthusiam and willingness to serve at our discretion. After viewing both "dirty movies" and at least one "soap opera" staff has determined that the lowest responsible bid belongs to Eagle Cam Although not every aspect of the specifications were met, such as on screen graphics, the intent of the bid as spelled out in the specifications is clearly met by the low bidder. It should be noted that the specifications were patterned after the material obtained from the second low bidder and thus the intent was more important in our selection than the exact letter of the specifications . • Fiscal Impact : • The lowest and best bid is $35,640 or $0. 25/foot versus $44, 193. 60 or $0 .31/foot for the second low bid. The savings of the low bid over the second low bid is over $8, 500. The Engineer' s Estimate for the above work was $52,747 . 20 or $0 .37/foot . A complete bid summary is attached for your reference . •
