COMMUNITY FORUM
The City Council values and encourages exchanges of ideas and comments
from you the citizen. To increase the effectiveness of Community
Forum, the following rules of public participation will be strictly
enforced:
* A maximum of 30 minutes will be allowed for Community Forum,
unless Council authorizes an extension.
* All remarks shall be addressed to Council as a whole and not
to any individual member thereof.
* No questions shall be asked of a Council Member or City Staff
without permission of the Mayor
* No person shall be allowed to make slanderous, profane, im-
pertinent, or personal remarks against any Council Member.

warding to Council prior to the Council Meeting nine (9) copies to
the City Clerk by 5:00 p.m. on the Wednesday preceeding the

The regular meeting of the Atascadero City Council was called to order
at 7:30 p.m. by Mayor Mackey.
ROLL CALL
Present: Councilmembers Borgeson, Handshy, Molina, Norris and

COUNCIL/STAFF COMMENTS
Councilwoman Borgeson extended thanks to former City Attorney, Robert
Jones, and suggested Council present him with a proclamation extending
the City' s appreciation.
Councilman Molina noted the receipt today of the first installment of
permit fees from VandenBerghe Construction project, which fees will
contribute largely to several capital improvement projects in the City
over the next five years (i.e. , new fire station, begin new police
station, central business district, to name a few)
.Newly appointed City Attorney, Jeffrey Jorgensen, took the oath of
office from City Clerk, Boyd Sharitz.
Mike Hicks, Fire Chief, introduced new firefighter , Tom Way, who
joined the department in November .
Bud McHale, Police Chief, introduced new police officer, John Harwood,
who joined the department on Nov. 17, 1986.
COMMUNITY FORUM
Virginia Rohde, resident and past member of Atascadero High School
PTSA, made prepared comments expressing opposition to alleged sexist
comments by Councilman Handshy recently to the school' s political sci-
ence classes.

Maureen & Roy Luebbers, who reside on Ferrocarril, expressed concer
regarding the need for an acceptable, supervised off-road motorcycli*
area, noting several hazardous occurrences and destruction of the
roadway by cyclists. Responding comments came from Mike Shelton, City
Manager, and Chief McHale, APD, who have discussed the issue. Jeff
Jorgensen, City Attorney, noted problems which might arise in terms of
(1) site selection & control, and (2) enforcement.
Terril Graham, 6205 Conejo, read prepared comments expressing dissent
with several "circumstances continuing in Atascadero" . He alleged
that public hearing procedures continue to be violated and that the
architectural review board called for in the General Plan has been
stifled by special interests. He urged adherence to the Gen. Plan,
suggesting that Atascadero be divided into six districts and a blue
ribbon committee be formed, comprised of residents from those areas,
to review both current and proposed Gen. Plan standards.
Pat Renshaw, representing the San Luis Obispo Chapter of the Natl.
Organization for Women, also addressed the alleged comments of Coun-
cilman Handshy to Atas. High political science classes (relating to
Mrs. Rohde' s comments, above) .
Councilwoman Norris expressed opinion that, if the allegations against
Councilman Handshy are true, he should resign.

9. Proclamation Supporting Drunk and Drugged Driving Awareness Week
Councilwoman Borgeson requested Item A-7 be pulled for discussion.
Regarding Item A-2, Councilman Molina expressed he would - like for
Council (in the near future) to discuss the policies of MOU' s, recom-
mending a settlement deadline be adopted affecting retroactive pay.
MOTION: By Councilman Handshy to approve Items Al-9, minus A-7, sec-
onded by Councilman Molina; passed by unanimous roll-call.
Councilwoman Borgeson asked for additional information on this item
regarding the amount of money involved, how N. Coast Engineering was
selected and contract information, to which Mr . Sensibaugh, Public
Works Director , responded. Councilwoman Borgeson further expressed
desire to see items pertaining to money expenditures in another place
(rather than the Consent Calendar) on the agenda in order to allow
public input; Mike Shelton, City Manager, responded that this item was
placed under Consent since it involves funds within the budget. Jeff
Jorgensen, City Attorney, noted changes in the Brown Act (eff. 1/1/87)
which will allow public to have input on any item on the agenda.
MOTION: By Councilwoman Borgeson to approve A-7, expressing she
hopes her comments will be given consideration, seconded by
Councilman Handshy; passed by 4:1 roll-call, with Council-
woman Norris opposed.
Mayor Mackey directed that similar items be put under New Business in
the future.

mously.

2. Request by VandenBerghe Construction to Allow Creation of Priva
Road Names to the Bordeaux Apartment Development Project

No public comment.
MOTION: By Councilman Handshy to approve names submitted (as per
staff recommendation) , seconded by Councilman Molina; passed
4:1, with Councilwoman Norris opposed.
C. UNFINISHED BUSINESS
1. Ordinance 142 - Amending the Meeting Times of the City of Atas-
cadero City Council to 2nd and 4th Tuesdays of Each Month, and
Planning Commission to 1st and 3rd Tuesdays of Each Month (SECOND
READING) (Cont'd from 11/24/86)
MOTION: By Councilman Molina to read Ord. 142 by title only, seconded
by Councilman Handshy; passed unanimously. Mayor Mackey read
Ord. 142 by title.
MOTION: By Councilman Molina that this constitutes the 2nd reading
and adoption of Ord. 142, seconded by Councilman Handshy;
passed by 3:2 roll-call, with Councilmembers Borgeson a
Norris opposed.
D. NEW BUSINESS
1. Committee Reports - Council Members
City/Schools Committee - Councilman Molina reported that this com-
mittee (Mayor Mackey, Councilman Molina, Henry Engen, Mike Shelton,
AUSD Boardmembers Leslie Haynes and Carl Brown, Dr. Avina and Ernie
Taylor) is working well together . The committee is discussing many
things, one of which is the concept of a JPA for the purpose of
using school facilities for Recreation Dept. purposes (which is
anticipated to take several months) . Mayor Mackey added that the
school representatives are being kept aware of Gen. Plan changes,
new school sites are being looked for, and the need for sidewalks
around schools is also being researched. This committee is current-
ly meeting once a month.
Underground Utilities Committee - Councilman Molina reported that
this committee has met once, which meeting was informational; he
noted that, over the past 4-5 years, the City has amassed (through
PG&E rates) approx. $730 ,000 to continue on a program of under-
grounding utilities. Paul Sensibaugh, Pub. Works Director, and Don
Smith, PG&E, have accumulated literature for review, and the commit-
tee plans to meet again in January. Mayor Mackey urged public
provide input as to where underground utilities might be installed

Equal Opportunity Commission (EOC) - Councilwoman Norris reported
that it has been brought to the commission' s attention that Planned
Parenthood might be moving into SLO County, which might duplicate
services provided by County Family Planning. The pros and cons are
being discussed, and a decision is expected to come in- the next
month. She commented on So. Calif. Gas Co. ' s low-income weatheri-
zation refunding proposal (which involves a contract to weatherize
1400 low-income, single and multi-family structures) , noting So.
Calif. Gas is the mainstay of the EOC' s energy conservation program.
Further , Councilwoman Norris summarized 3 programs administered by
EOC during the year : alternative payment program, resource and ref-
erral services and respite care. Also, an infertility clinic is now
available to couples.
Ordinance 24 Committee - Councilwoman Borgeson noted this committee
has not met yet but is scheduled to meet on Wed. , 12/10/86, at 1:30
P.m.
Downtown Redevelopment Committee - Councilwoman Borgeson (who serves
on this committee with Mayor Mackey, Mike Shelton, Henry Engen, Dave
Jorgensen, Kirk Pearson and Eric Hagan (BIA members) and Maggie Rice
(C of C) ) , downtown parking has been the focus of discussion. Joe
Grisanti, Grisanti Hdwe. , presented the merchants' viewpoint for
parking solutions. Also discussed were tree planting and downtown
beautification, underground utilities and architectural standards.
SLOCOG - Councilwoman Borgeson reported that she will be attending
a meeting on Thursday to discuss unmet transit needs of the County
and will report back.
Mayor Mackey commented on the downtown parking proposal, noting it
will be on the Council's agenda in January. Mayor Mackey also report-
ed that the Traffic Committee, at their last meeting, favored adoption
of no parking one night a week for street cleaning purposes.
Traffic Committee - Paul Sensibaugh, Pub. Works Director, summarized
the activities of the Traffic Committee over the past year , noting
they have compiled approximately 75 issues.
2. Resolution 133-86 - Appropriating Council Contingency Reserves
in the Amount of $25,000 as Matching Funds for Atascadero Lib-
rary
Mike Shelton, City Manager, gave staff report, requesting that Council
delay this item so he may have the opportunity to meet with County
representatives and report back outcome.
Public Comment
Sarah Gronstrand, representing Friends of the Library, relayed the
group' s feeling that the City will be poorly served if Council
approves alternative #2 and urges support of alternative #3, summar-
izing, at length, the reasons for such recommendation; she also
expressed that it' s hoped the public may participate in final discus-

sions on this issue.
MOTION: By Councilwoman Borgeson to continue this item until the
meeting of 1/12/87, seconded by Councilman Handshy; passed
unanimously.
COUNCIL RECESSED FOR TEN MINUTES AT 9 :15 P.M.
3. Authorization for City Manager to Enter into Agreement with Bob
Fielding to Provide Contractual Building Inspection Services from
12/29/86 - 6/30/87
Concurring that this is a personnel matter, Council adjourned to an
immediate closed session discussion in the Club Room at 9:28 p.m.
Mayor Mackey called meeting back to order at 10 :00 p.m.
MOTION: By Councilman Molina to continue this item to the meeting of
1/12/87 , seconded by Councilwoman Borgeson; passed unanimous-
ly.
E. PUBLIC FORUM
Joe Grisanti, Grisanti Hdwe. , requested Council comments on the pro-
posed parking plan (from last meeting) ; Mr. Sensibaugh, Pub. Works
Director , responded that staff doesn' t, at this time, have enou�
information to respond. Councilwoman Borgeson noted that this iss
does involve the possible acquisition of land, and a report from the
Planning Commission would be required prior to Council determination.
Mr. Shelton, City Mgr. , stated that the committee is moving as expedi-
tiously as possible on this issue.
Tom McNamara, resident, indicated he had intended to speak on Item
D-3. In view of the acoustics, he offerred $1, 000 toward improvement
of the public address system in the Rotunda Room. Mr. Shelton, City
Mgr. , responded that staff is in the process of determining where the
Council chambers will be (in the Admin. Bldg. renovation) , has re-
ceived a professional acoustical report and has budgeted monies for
.enhancing the acoustics.
Douglas Nix, resident, expressed concern regarding proposed installa-
tion of underground utilities, urging full public notice; Mayor Mackey
noted that any such installation would be along a busily travelled
street rather than residential street. Mr. Nix also urges that res-
idents be individually surveyed and that a 2/3 residents' majority
determine approval (due to potential costs) .
F. INDIVIDUAL DETERMINATION AND/OR ACTION
City Council - Councilwoman Borgeson responded to various concerns
expressed by earlier speakers (i.e. , concerns regarding committ�
actions, parking proposal of Mr. Grisanti, public noticing concern
and comments of Mrs. Rohde regarding Councilman Handshy) .

Councilman Handshy expressed that he' s abashed by allegations made
against him (see Community Forum) , indicating his talk to Atas. High
political science classes focused on the subject of local govern-
ment.
Councilman Molina expressed he's baffled by allegations regarding
Councilman Handshy, saying he hopes everyone will read Chap. 1 of a
political science book.
Councilwoman Norris stated she had received calls from several Atas.
High political science students who made comments similar to those
of Mrs. Rohde ' s. Also, she suggested public notices be put out to
bid to other local newspapers who might be able to improve/increase
noticing publications; City Clerk Boyd Sharitz asked that Council
not trespass on the jurisdiction of his office.
Councilman Handshy made mention of correspondence given him by Mayor
Mackey regarding a committee on the bicentennial of the U.S. Consti-
tution. Mayor Mackey stated she would appoint him as Atascadero' s
representative if he is interested; he would have to go to Los An-
geles in January.
City Attorney - Jeff Jorgensen stated he looks forward to represent-
ing the Council in a fair and impartial manner . He said he will
prepare a counsel' s report (to include recent legislation and liti-
gation) for the Council' s information.
City Clerk - Boyd Sharitz noted the Dec. 15th deadline for cash
payment of sewer assessments for properties in the Separado/Cayucos
assessment district. Mr. Sensibaugh, Pub. Works Director, made
added comments, noting the issue of sale of bonds will be on the
Council' s agenda for the Dec. 18th special meeting. Mr. Sharitz,
further, expressed regret for the allegations toward Councilman
Handshy, noting such charges should not be made in a public forum
but in writing, sworn to and submitted to the City Clerk' s office.
City Manager - Mike Shelton commented on earlier public comments
regarding Brown Act amendments, noting he has discussed a draft pol-
icy statement (in view of said amendments) for the City Council with
the City Attorney, Mr. Jorgensen; both feel the policies can be re-
viewed with Mayor Mackey, and the information will be forwarded to
the full Council to insure they are in compliance with the new laws
by their first meeting in January.
Mayor Mackey announced the cancellation of the Dec. 22 Council meet-
ing, and the next regular meeting is scheduled for Jan. 12, 1987 .

The special meeting of the Atascadero City Council was called to order
at 5:30 p.m. by Mayor Mackey.

Antonia Dolar, Orrick, Herrington & Sutcliffe (OH & S) , reviewed the
formation of Assessment District No. 4 and summarized the proposed
actions before the City Council tonight, noting changes and insertions
to the proposed (draft) Res. No. 134-86. Discussion with Council &
staff ensued.
Councilman Molina expressed concern with regard to former City Attor-
ney, Robert Jones, being the attorney of record in this agreement.'
Mr. Shelton, City Manager , clarified that Mr. Jones has agreed to act
as attorney of record, subsequent to discussion with current City
Attorney, Jeffrey Jorgensen, noting both concurred it is not appropri-
ate for Mr. Jorgensen to be attorney of record because of a possible
conflict of interest on his part, and because of Mr. Jones' s involve-
ment in the formation of this district. Councilman Molina requested

documentation on this issue. Discussion ensued regarding Mr. Jones
further potential involvement in these district proceedings.
Ms. Dolar responded to question from resident Doug Lewis (in audience)
regarding payment obligations of property owners.

COUNCIL ACTION REQUESTED:
Declare listed property as surplus in keeping with applicable Government
Code statutes and authorize the sale of the two inoperable vehicles.
BACKGROUND:
The property offered for sale includes one 1978 Pontiac which was de-
stroyed as the result of an' engine fire and one 1982 Chevrolet patrol
car which had been rammed/wrecked by an auto thief who was later arrested.
Both of these vehicles have in excess of 100,000 miles on them, thus
reconditioning/rebuilding is not financially adviseable.
FISCAL IMPACT:
The $377.00 which is the best bid, will be deposited into the General
Fund.

C. ANALYSIS:
The property proposed for subdivision is located in the RS (Resi-
dential Suburban) zone. Minimum lot size in this zone ranges be-
tween 2.5 and 10.0 acres depending upon the "score" of various
performance standards. For this site, the minimum lot size cri-
teria are:

Minimum lot size: 3. 26 acres
The lot sizes proposed (17. 85, 3.27, 3. 27 acres) are equal to or
larger than the minimum sizes that would be allowed.
Each of the proposed lots has an adequate building, site. Proper
siting of building pads and driveways could result in a minimal
amount of required grading. Any grading that is required for
driveways or building pads on slopes in excess of 20% will require
a precise plan review and approval. Precise plan review is done
at staff level and is dictated by the California Environmental
Quality Act (CEQA) and this City' s guidelines for its
implementation.
San Marcos Road is paved to City standards in this location and
has a 40 foot right-of-way. The site has frontage on Highway 41
(Morro Road) . All access to state highways will require addition-
al approval from CalTrans. Contact from utilities nindicate that
adequate facilities are available to serve the site.
Adequate building sites are available and access is good. Proper-
ly designed septic systems should provide adequate waste disposal.
Finally, the density proposed for the property appears to be ap-
propriate for the site and surrounding areas.
D. RECOMMENDATION:
Staff recommends conditional approval of Tentative Parcel Map
31-86 based on the Findings in Exhibit C and the Conditions of
Approval in Exhibit D.

Findings for Approval
December 15, 1986
FINDINGS:
1. The creation of these parcels conforms to the Zoning Ordinance
development standards and the General Plan land use element mini-
mum lot size and policies.
2. The creation of these parcels, in conformance with the recommended
conditions of approval, will not have a significant adverse effect
upon the environment. The Negative Declaration prepared for the
project is adequate.
3. The site is physically suitable for the residential type of devel-
opment that is proposed.
4. The site is physically suitable for the density of development
that is proposed.
5. The design of the subdivision and the proposed improvements will
not cause substantial environmental damage or substantially and
avoidably injure fish and wildlife or their habitat.
6. The design of the subdivision and the type of improvement will not
conflict with easements acquired by the public at large for access
through or use of property within the proposed subdivision; or,
substantially equivalent alternate easements are provided.
7. The proposed subdivision complies with Section 66474. 6 of the
State Subdivision Map Act as to methods of handling and discharge
of waste.

Conditions of Approval
December 15, 1986
CONDITIONS OF APPROVAL:
1. Water shall be obtained from the Atascadero Mutual Water Company
and water lines shall exist at the frontage of each parcel or its
public utility easement prior to recordation of the final map.
2. All existing and proposed utility easements, pipelines and other
easements are to be shown on the final map. If there are other
building or other restrictions related to the easements, they
shall be noted on the final map.
3. Grading, drainage, and erosion control plans, prepared by a regis-
tered civil engineer , shall be submitted for review and approval
by the Community Development and Public Works Departments prior to
issuance of building permits in conjunction with installation of
driveways, access easements, or structures.
4. Plan and profile drawings of proposed individual driveways and
driveway easements shall be submitted for approval by the Commu-
nity Development and Public Works Departments in order to deter-
mine average grade and appropriate improvement requirements. This
shall appear as a note on the final map.
5. All development fees and/or assessments in effect at the time of
building permit application shall be paid at the time of building
permit issuance. This shall appear as a note on the final map.
6. Access approval to Highway 41 (Morro Road) shall be obtained from
the State of California (CalTrans) if access is planned to Highway
41.
7. The applicant shall upgrade the existing fire hydrant at the water
tank on San Marcos Road to City standards. Design and location
shall be approved by the Fire Chief. Work shall be completed
prior to recording the final map.
8. An offer of dedication shall be made to the public for the Public
Utilities Easements.
9. Offers of dedication shall be completed and recorded prior to or
simultaneously to recording the final map.
10. A final map drawn in substantial conformance with the approved
tentative map and in compliance with all conditions set forth
herein shall be submitted for review and approval in accordance
with the Subdivision Map Act and the City Lot . Division Ordinance
prior to recordation.

B. ANALYSIS:
The application before the Commission proposes the subdivision of
one parcel containing 8.3 acres into three parcels containing 5. 65
acres, 1. 89 acres, and 0 .84 acres. The property proposed for sub-
division is located in a commercial retail (CR) zoning district.
There is no minimum lot size established by the Zoning Ordinance
for parcels located in this district. Minimum lot sizes in com-
mercial zones are determined by market conditions and development

constraints (e.g. parking requirements, site configuration, etc. ) .
Development of the subject property was approved under the precise
plan (PP 2-86) process on May 21, 1986 (see Exhibit C for the pre-
cise plan conditions of approval) . Construction is now underway
on a 67, 000 square foot Kmart store and an additional 18, 000
square rG44 "of commercial space. Provision is also made for addi-
tional commercial development on an "out-lot" at the corner of E1
Camino Real and San Anselmo Road. The proposed subdivision of the
property generally conforms with the physical development approved
for, and occurring, on the site.
A majority of the planning issues and conditions of approval for
the development of the site were addressed during consideration of
the precise plan application. A new issue raised by the proposed
subdivision is the provision of access and adequate parking for
each of the resultant parcels. Notes on the tentative map indi-
cate that reciprocal parking, access, and utility easement agree-
ments will be established affecting each of the three lots. Ap-
proval of the tentative map will be conditioned upon recordation
of such reciprocal agreements.
A second concern relative to the tentative parcel map involves
access to proposed Parcel 3. During the precise plan review, it
was recognized that additional curb cuts along either El Camino
Real or San Anselmo to serve future development on this parcel
would not be appropriate. The precise plan approval was condi-
tioned, in part, on access restrictions to this parcel. Access to
Parcel 3 from the other driveways serving the site is adequate and
is supported by the traffic study prepared for the Kmart project.
The final map for the proposed subdivision will provide an appro-
priate vehicle for recording access restrictions along Parcel 3
and along the frontage of . the property on U.S. Highway 101.
It should be noted, in conclusion, that all other conditions of
approval of Precise Plan 2-86 will be made applicable as condi-
tions of approval of the subject tentative parcel map.
C. . RECOMMENDATION:
Staff recommends conditional approval of Tentative Parcel Map
33-86 based on the Findings in Exhibit D and Conditions of Approv-
al in Exhibit E.

1. All construction shall be in conformance with Exhibit B (site
plan) , Exhibit D (conditions of approval) , and shall comply with
all applicable codes and ordinances. Any modification to these
plans shall require review and approval by the Community Develop-
ment Department.
2. Complete landscape and irrigation plans shall be submitted to and
subsequently approved by the -Community Development Department
prior to issuance of building permits (Section 9-4.124) . Gener-
ally, the submitted preliminary plans meet the intent of the ordi-
nance; specifically freeway screening and landscaping of the park-
ing area. Shade trees need to be provided approximately 30 feet
on-center . Irrigation methods will need to be shown.
3. Both buildings shall be fully sprinklered. Two new fire hydrants
are required as shown .on the site plan:
a) Landscaped area at the northernmost entrance off E1 Camino
Real.
b) Landscaped area opposite the front end of the store.
4. A soils report shall be submitted as part of the building permit
application, focusing on compaction and the grading and filling
work previously done.
5. This precise plan does not approve the proposed future building
and separate plot plan approval is required for its design, park-
ing, use, and circulation. This area shall be maintained in a
clean and orderly manner and shall not be used for outdoor storage
unless adequate screening in conformance with the Zoning Ordinance
is provided. Development of the corner lot shall be consistent
with the architecture and landscaping of the shopping center . No
additional curb cuts will be allowed for the corner lot.
6. Signage shall be reviewed and approved prior to the issuance of
any sign permits. A conditional use permit may be required.
7. Provide road improvement plans, prepared by a registered civil
engineer, acceptable to the Director of Public Works in confor-
mance with the recommendations of the traffic study prepared by
Associated Transportation Engineers dated April 8, 1986 which in-
clude the following:
a. Widen San Anselmo site frontage six feet between El Camino
Real and northbound freeway ramps to provide two 12 foot
southbound lanes and a two foot raised median.
b. Realign San Anselmo road (east leg) to bring the westbound
approach into E1 Camino Real at a right angle which includes
acquiring sufficient title or interest in the offsite private
land to allow such realignment.
C. Construct traffic signal at San Anselmo Road (west leg) and
El Camino Real. Signal shall be installed and operational
prior to final building inspection. Kmart Development shall
contribute 55% of the total cost of signal installation.
Kmart shall fund entire signal improvements and enter a re-
imbursement agreement, acceptable to the City Attorney and
Public Works Director, which will guarantee pay-back for
costs exceeding the 55% contribution.
d. Construction of road improvements shall be completed (or
bonded for) prior to final building inspection.
8. Prior to approval of the improvement plans by the Public Works
Director, either the developer shall acquire sufficient title
or interest in the off-site land to allow the improvements to be
made as required by these conditions; or the City Council, upon
request by and at the expense of the developer , shall have made
all appropriate findings and adopted a Resolution of Necessity as
required by law so that the City may exercise its power of
Eminent Domain.
9. Obtain an encroachment permit from the Public Works Department.
Sign an inspection agreement and a curb and gutter agreement,
guaranteeing that the work will be done and inspections paid for,
prior to issuance of a building permit, and construct improvements
as directed by the encroachment permit prior to final building
inspection. Improvement- and traffic signal plans, prepared by a
registered civil engineer and registered traffic engineer , shall
be submitted and approved by the Director of Public Works prior to
issuance of building permits.
10: Secure a drainage acceptance letter from CalTrans stating they
have reviewed the Drainage Plan and find it acceptable prior to
the issuance of building permits.
11. Grading and drainage plans, prepared by a registered civil engin-
eer, must be submitted to and approved by the Public Works and
Community Development Departments prior to issuance of building
permits.
a. All lot grading and drainage improvements shall require writ-
ten certification by a registered civil engineer that all
work has been completed and in full compliance with the ap-'
proved plans.
b. All drainage improvements shall be completed (or bonded for)
prior to final building inspection. Drainage facilities
shall be constructed to City standards as approved by the
Public Works Director.
12. Install all traffic delineation devices, striping, warning, regu-
latory signs, and other - similar devices where required by the
Public Works Director . Signs shall be in conformance with the
Public Works Department standards and the current State of Calif-
ornia Uniform Sign Chart. Installation of traffic devices shall
be subject to review and modifications after construction. Fire
apparatus strobe lights for controlling the required traffic sig-
nal shall be provided by the developer.
13. The applicant shall make an offer of dedication to the City of
Atascadero for the following easement for drainage purposes with
the offer to be consented to but rejected without prejudice: 10
feet each side of existing storm drain centerline, proposed storm-
drain, or drainage swale. Offers of dedications shall be com-
pleted and recorded prior to final building inspection.
14. A drainage maintenance agreement, in a form acceptable to the City
Attorney and Public Works Director , shall be recorded prior to
final building inspection to guarantee maintenance of private
storm drain system.
15. Wastewater disposal shall be by connection to public sewer . A
sewer connection fee of $20. 50 per fixture unit shall be due prior
to issuance of a building permit in addition to the regular tap-in
fee of $250 .00.
16 . Construct improvements 'as required by CalTrans if deemed necessary
by the Director of Public Works prior to final building inspec-
tion. An encroachment permit shall be obtained from CalTrans for
any work within their right-of-way.
17. An offer shall be made to the City of Atascadero for an additional
right-of-way for the corner rounding (minimum 20 ' radius) at the
corner of San Anselmo and E1 Camino Real.
18: This precise plan is approved for a period of one year from the
date of final approval (May 21, 1986) .

CONDITIONS OF APPROVAL:
1. Water shall be obtained from the Atascadero Mutual Water Company
and water lines shall exist at the frontage of each parcel or its
public utility easement prior to recordation of the final map.
2. All existing and proposed utility easements, pipelines and other
easements are to be shown on the final map. If there are other
buildings or other restrictions related to the easements, they
shall be noted on the final map.
3. All conditions of approval required by Precise Plan 2-86 shall be
completed prior to recording the final map or as directed by the
Public Works Director for road improvements.
4. The applicant shall acquire and make an irrevocable offer for ded-
ication to the City of Atascadero the following rights-of-way:
a. Street Name: San Anselmo
b. Limits: 60 feet from the centerline along the entire proper-
ty frontage, including corner rounding at the inter-
section of San Anselmo and El Camino Real for

C. ANALYSIS:
The applicant has submitted this map for final check and comple-
tion of the conditions is imminent. However, to ensure that the
map would not expire on January 14 , 1987, a time extension was
applied for on November 25, 1986 . As stated in Exhibit A, there
have been no changes which would effect this approval. Staff sees
no problem in granting this time extension.
D. RECOMMENDATION:
Staff recommends approval of the time extension request based on
the findings in Exhibit A and the conditions set forth at the time
the map was originally approved. Approval of this one year time

C. ANALYSIS:
Staff' s main concern is the 35% slopes of this parcel. The sewer
is available for these sites which alleviates the problem of sew-
age disposal since septic systems are not allowed on slopes over
30%. Parcel B will require a sewer easement in order for it to
connect to the system.
Grading for a driveway and residence on either of these two lots
will require a conditional use permit since the slopes are in ex-
cess of 30% . The applicant may want to examine the possibility of
a sloping lot adjustment. This could possibly allow for a private
garage to be located as close as five feet to the street property
line, pursuant to Section 9-1.112 (Adjustment) .
D. RECOMMENDATION:
Staff recommends approval of Tentative Parcel Map 29-84 based upon
the findings and conditions of approval contained in Exhibit A.

B. ANALYSIS:
The subject property is located in the RS (Residential Suburban)
zone. Minimum lot size in this zone ranges between 2. 5 and 10 .0

larger than the minimum lot size allowed by the zone.
The proposed lot line adjustment will be conditioned to result in

B. ANALYSIS:
The subject property is located in the RS (Residential Suburban)

Recommendation:
The Traffic Committee recommends establishing a No Parking area
on E1 Camino Real between the driveway to Villa Margarita and
the driveway to Mira Vista Apartments.
Background:
As stated previously, sight distance at driveways are a pro-
blem on E1 Camino Real. This condition is exagerated at this location
due to the downgrade just south of the park.

Discussion:
Staff and some members of the Council have received complaints
from the residents of Villa Margarita about the difficulty experienced
pulling out onto E1 Camino Real from the park. The complaints have
been investigated and proved to be valid.
Fiscal Impact:
The cost for this improvement will be approximately $75.00
to be paid out of the street budget.

Recommendation:
The Traffic Committee recommends that Council adopt Resolution

Background:
The Traffic Committee has received requests for this stop
sign from various residents in the neighborhood. The location has
been observed by the committee and a stop sign determined to be
. appropriate at this location.
Discussion:
At the point where Alamo Avenue intersects with Honda,
traffic traveling on Alamo is going down a slight grade into
Honda which, without a stop sign, creates a hazard due to the
inadequate sight distance to the left and right.
Fiscal Impact:
The cost to the City is approximately $75 and can be paid out
of the 1986-87 Fiscal Year Budget - Capital Improvement ($. 50 tax)

West Front Street

Recommendation:
The Traffic Committee recommends that Council pass Resolution
No. 2-87 reducing the speed limit on West Front Street between
San Gabriel and San Diego Road from the current 55 MPH to 30 MPH.
Background:
This item was included on the Traffic Committee Agenda at the
request of residents in the area.
According to statute, an unmarked road in that location is governed
by a 55 MPH speed limit. This is a residential area and a speed
limit of 55 MPH is inappropriate.
Discussion:
Committee and staff members visited the location and have based
their approval on observation. It should also be noted that a
bicyclist was injured at the San Rafael intersection with West
Front Avenue in 1984.
Fiscal Impact:
The cost for this improvement including signs, paint, labor
and equipment will be approximately $75 to be paid out of the
street budget.

conditions.

BACKGROUND:
In 1985, the city approved Zone Changes 7-85 and 8-85 creating a rec-
reational zoning district with a planned development overlay for a
proposed waterslide project. The project has evaporated and one of
the two property owners now wishes to revert the zoning back to the
previous residential zoning. On December 1, 1986, the Planning Com-
mission expanded the area covered by the proposed zone change to cover
the entire project area including property owned by the Atascadero
Mutual Water Company.
Notice of public hearing was published in the Atascadero News on Fri-
day, December 5, 1986 and all property owners of record located within
300 feet of the subject site were also notified on that date.

B. ANALYSIS:
The City has received and expanded a zone change application to
cover the entire PD5 overlay area to revise the present L(PD5)
zoning to a single family residential zoning designation. The
applicants note their reason for the request being failure of the
previously proposed project to materialize (waterslide) , and a
desire to return the area to single family residential.
The City previously reviewed and approved Zone change 7-85 and
8-85 creating a recreational zoning district with a planned devel-
opment overlay for a proposed waterslide. The initial submittal
covered approximately 3.15 acres owned by the Atascadero Mutual
Water Company. With the first approval, concern was expressed
with respect to parking and impacts on adjoining residential
areas. A second application was submitted expanding the original
zone change to cover two additional acres owned by the Jensens
with an L(PD5) zone.
In February of this year, the City received a letter from the rep-
resentatives of the proponents of the project noting that problems
had occurred concerning the project' s ability to secure insurance
(Exhibit C) . A phone call to the proponents on November 24, 1986
noted that the insurance problem still exists and cannot be re-
solved in the near future.
Contact with the Atascadero Mutual Water Company indicates that
the applicant has withdrawn their request to secure the property.
The City' s General Plan land use element shows the area as being
designated for Low Density Single Family (1 1/2 to 2 1/2 acre min-
imum lot size) . During the previous zone change requests, the
site was determined to be recreational. This was due to an inter-
pretation of the General Plan land use map using a "wavy line"
concept for the adjoining recreational designation.
The proposed rezoning will reduce potential impacts in the area.
Traffic generation and potential visual impacts from the previous-
ly proposed project will be reduced substantially. As a part of
the rezoning, the planned development text requirements will also
have to be eliminated from the zoning text (Section 9-3. 649) .

WHEREAS, the proposed zoning map amendment is consistent with the
General Plan as required by Section 65860 of the California Govern-
ment Code; and
WHEREAS, the proposed amendment is in conformance with Section
65800 et seg. of the California Government Code concerning zoning reg-
ulations; and
WHEREAS, the proposed amendment will not have a significant ad-
verse effect upon the environment, and preparation of an environmental
impact report is not necessary; and
WHEREAS, the Atascadero Planning Commission held a public hearing

3. The proposal will not result in any significant adverse en-
vironmental impacts, and preparation of an environmental im-
pact report is not necessary.
Section 2. Zoning Map Change.
Map Number 19 of the Official Zoning Maps of the City of Atasca-
dero on file in the City Community Development Department is hereby
amended to reclassify Lots 27, 28, 29, 30 and 31 of Tract No. 5 as
shown on attached Exhibit "A" which is hereby made a part of this
ordinance by reference.

Section 3. Zoning Text Change.
Section 9-3. 649 of the Zoning Ordinance text for the Establishment
of Planned Development Overlay Zone No. 5 (PD5) shall be deleted from
the Zoning Ordinance.
Section 4. Publication.
The City Clerk shall cause this ordinance to be published once
within fifteen (15) days after its passage in the Atascadero News, a
newspaper of general circulation, printed, published and circulated
in this City in accordance with Government Code Section 36933; shall
certify the adoption of this ordinance; and shall cause this ordinance
and certification to be entered in the Book of Ordinances of this
City.
Section 5. Effective Date.
This ordinance shall go into effect and be in full force and ef-
fect at 12: 01 a.m. on the thirty-first (31st) day after its passage.

RECOMMENDATION:
Council adopt Alternative 2 or 3 authorizing expenditure of ad-
ditional funding to rebid library.
BACKGROUND:
Staff requested at the December `8, 1986 Council Meeting that the
Library Bid item be continued to the Janaury 12, 1987 Council
Meeting to allow further research into acquiring additional fund-
ing to rebid the library.
A subsequent meeting was held on December 19, 1986 with County
representatives who conceded to contractural obligations (City/
County Property Tax Agreement) providing for interest earnings on
the City' s $295,000 library share since agreement adoption on
December 3, 1985. Interest due to the City to date is $24,000.
Additional interest, based on a July-August start of construction
and January, 1988 completion date, is estimated by the County to
provide an approximate additional interest earning in the amount
of $15,000. Also, the Friends of the Library have undertaken a
new fund raising effort and have pledged $18,500.
ALTERNATIVES:
Updated information was further clarified as to alternative sce-
narios:
Alternative 2 (requiring an additional $50,000) will build the
same size building, as originally designed and programmed by the;
architect, at $88 per square foot.
Alternative 3 (requiring an additional $_135,000) is the same as
Alternative 2 except cost per square foot is $97. With the ad-
ditional funds under Alternative 3, more of the original archi-
tectural features will be maintained; however , specific design
features (columns, windows, and overhang) will not be included
for certain until the building is redesigned and rebid.
Mr. Bob Botta, Building Facility Manager, County General Services
Department, will be available at the January 12th Council Meeting
to answer any rebid or design questions you may have.

TIMING CONSIDERATIONS:
Start of construction under Alternative 2 or 3 will be approx-
imately the same due to anticipated water table level problems.
To commence construction prior to site de-water process (natural
drying out) may require an additional expense of $10,000 to
$15,000. Assuming favorable ground water conditions, Alternative
3 (requiring less architectural re-programming) may result in
, construction starting earlier.
COUNTY STAFF RECOMMENDATIONS:
County staff proposes Alternative 2 as the most cost effective
building using more common design materials. However, under the
very favorable cost sharing formula, if Council desires the bene-
fits of Alternative 3, County staff will support Council's de-
sire. It is anticipated County recommendations, mirroring the
Council's choice, will be made at the County Board of Super-
visor ' s January 20, 1987 meeting.
FISCAL IMPACT:
Alternative 2: None —Additional cost ($25,000) to the City to
be funded by interest earnings from 1985 Property Tax Agreement,
due to delay in construction. Council Action: By motion, recom-
mended Alternative 2 for County consideration.
Alternative 3: The following probab13 funding scenario, if no
additional private funds are acquired, would require the City to
contribute an additional $10,000 from City Council Contingency
Funds.

Over the week end we received a gratifying increase in donations
for the new Atascadero Library. ._/; r
As you know, low bid for the new Atascadera( was $'92,000. This
morning I called the county General Services Dept. and was told
that the cost of self-opening doors is between $15,000 and $20,000.
Mindful of the importance of a quality library for the second
largest city in the county and desiring to expedite building of
the library, Friends of the Library propose that the library be
built as designed, minus the self-opening doors. Assuming the
least credit of $15,000 for self-opening doors, the resulting
cost is $777,000.
We suggest the following distribution:
Major sum available for the building $625,000
County contribution 3i of $135,000 for Alternative 3 $679500
Interest (result of tax dispute settlement % on $295,000) $3 000
Contribution requested of city 20,500
Contribution by Friends of the Library
Total $777 9000
This would give us a library as designed, minus only the self-
Opening doors. Architectural modification should require a shorter
time period, since only the doors will have to be modified. And
we will have a library as it was designed - a show place, a much
needed attraction in the city.
During the council meeting on Dec. 8, staff recommended that
$259000 be appropriated from Contingency Funds for Alternative 2 -
a redesigned library to be built sometime in the future. $20,500
which we are asking from the city now is $4,500 less than the
original $25,000 the city was willing to contribute for Alternative
The commitment of $20,500 is certainly a far better example of
fiscal responsibility.
And finally, an excellent library is not a luxury which may be
postponed again and again. An excellent library is a necessity,
and the need is now

BACKGROUND:
The Building Division employs two part-time building inspectors
on an hourly rate basis of $12.37 and $12.50 per hour, respectively.
This rate has not increased since 1984. It is recommended that
their employment agreements be changed to $13.67/hour to parallel
that for permanent employees , but without fringe benefits.
ANALYSIS:
The fiscal impact of this proposed increase would be approximately
$2,000 over 6 months. No budget adjustments would be required as
funds have accrued in the salary account due to our inability to
fill the position of senior building inspector. Further, revenues
have exceeded budget expectations by 60%. This increase would
provide for greater equity between employees performing the same
function.
RECOMMENDATION:
Authorize the City Manager to revise the employee agreements to
reimburse part-time building inspectors at the rate of $13.67/hour,
effective January 3, 1987. Adopt Resolution No. 6-87.

SUBJECT: Budget/Personnel Request : Building Division, Community
Development Department - "Permit Services Coordinator"
BACKGROUND:
On April 14th, 1986, the City Council approved Resolution No.
28-86 incorporating a Senior Building Inspector job description
into the City salary plan and authorizing recruitment for said
position. To date, we have not been able to recruit acceptable
candidates for this position, which was intended to provide for a
combination plan checker, counter information person, and special
field inspector. As an alternative to this approach, we are rec-
ommending that a new position, Permit Services Coordinator, be
created which will allow career growth within our own ranks, while
responding to demands for more assistance by Building Inspectors
at the counter and in facilitating interdepartmental responses.
ANALYSIS :
The attached job description for Permit Services Coordinator
borrows heavily from that of the Senior Building Inspector with
the exception of plan checking responsibilities . The proposed
salary range is midway between that of Building Inspector($1988.54/
month - Step C) and the advertised position of Senior Building In-
spector ($2187.40/month - Step C) .
This person, under the supervision of the Chief Building Inspector,
would accept permit applications and evaluate materials for com-
pleteness and expedite permit processing by acting as a single
input source for all documentation required. He would assist con-
tractors , architects , engineers , owner-builders and the public
with information on construction requirements , fees , etc. , and co-
ordinate the routing of plans for interdepartmental response,
together with outside plan checkers. One of the key suggestions
made in the recent Building Division User' s Survey was to have a
Building Inspector available more frequently during day time hours
at the public counter. Absent our ability to successfully recruit
for a Senior Building Inspector, we feel that we can respond to
this legitimate need through establishment of this position.
Creation of this position would also free up planning staff time
from review of single family projects for zoning compliance, to-
gether with allowing the Chief Building Inspector more time to
. monitor field inspection practices and standards.

FISCAL IMPACTS•
Fiscal impact over the next six (6) months would be a theoretical
savings in salary of approximately $600.00. However, given the
fact we are proposing internal recruitment and advancement of our
current Building Inspector at Step E to theosition it would
actually incur added costs of approximately $510.00 to fill a po-
sition at Step E. Filling the Senior Building Inspector' s authori-
zation in effect with a Permit Services Coordinator would generate
a need to also fill the vacated position of full time Building
Inspector, which would result in a small savings.
The attached organizational chart reflects the proposed staffing
change.
RECOMMENDATION:

A RESOLUTION OF THE COUNCIL OF THE CITY OF ATASCADERO
AUTHORIZING A NEW POSITION OF "PERMIT SERVICES COORDINATOR",
AND APPROVING JOB DESCRIPTION AND SALARY SCHEDULE
WHEREAS, the Council of the City of Atascadero wishes to expedite
efforts to strengthen the City' s ability to provide a timely service
for building and planning services.
NOW, THEREFORE, the Council of the City of Atascadero resolves as
follows :
Section 1.
Instruct the Administrative Services Director to incorporate the
attached job description for Permit Services Coordinator (Exhibit A)
into the job descriptions of the City of Atascadero.
Section 2.
Authorize the Administrative Services Director to fund the posi-
tion from monies authorized for the unfilled position of Senior Building

CLASS TITLE: PERMIT SERVICES COORDINATOR
GENERAL STATEMENT OF DUTIES :
Under general supervision, accepts building permit applications and
evaluates submittals for completeness . Serves as a single input
source for all documentation required to expedite permit processing.
Assists contractors , architects , engineers , owner-builders and the
public with information, construction requirements , fees , etc; co-
ordinates the efforts of all City departments and outside plan checkers ,
who review building permit applications for compliance with ordinance
requirements , to assure accurate and expeditious permit processing;
performs site checks , reviews single family projects for zoning com-
pliance; may make field inspections when supplementary staff is needed
and do related work as required.
EXAMPLES OF DUTIES PERFORMED:
(Any one position may not include all duties listed, nor do the exam-
ples listed cover all the duties that may be performed.)
Reviews building and grading plan applications for completeness ; routes
completed plans to City departments and outside plan checkers , and
facilitates timely response to enable complete plan checks ; interprets
and explains construction codes and regulations to contractors , public
officials and others ; makes site inspections to identify construction
issues that need to be resolved in the plan check process.
EMPLOYMENT GUIDELINES:
Knowledge of•
Uniform Building Code, Uniform Plumbing Code, Uniform Mechanical Code,
National Electric Code and related uniform codes ; applicable federal
regulations governing building construction and practice ; state build-
ing code and other applicable state regulations ; City development
regulations ; proper methods of construction work and inspection.
Ability to :
Deal tactfully, diplomatically and persuasively with the public; in-
terpret codes and ordinances ; read and interpret plan specifications ;
analyze situations accurately and to adopt an effective course of

Desirable Education and Experience:
Equivalent to completion of the twelfth grade. At least three years

SUBJECT: Budget/Personnel Request : Building Division, Community
Development Department - "Permit Services Coordinator"
BACKGROUND:
On April 14th, 1986, the City Council approved Resolution No.
28-86 incorporating a Senior Building Inspector job description
into the City salary plan and authorizing recruitment for said
position. To date, we have not been able to recruit acceptable
candidates for this position, which was intended to provide for a
combination plan checker, counter information person, and special
field inspector. As an alternative to this approach, we are rec-
ommending that a new position, Permit Services Coordinator, be
created which will allow career growth within our own ranks, while
responding to demands for more assistance by Building Inspectors
at the counter and in facilitating interdepartmental responses.
ANALYSIS :
The attached job description for Permit Services Coordinator
borrows heavly from that of the Senior Building Inspector with
the exception of plan checking responsibilities. The proposed
salary range is midway between that of Building Inspector($1988.54/
month - Step C) and the advertised position of Senior Building In-
spector ($2187.40/month - Step C) .
This person, under the supervision of the Chief Building Inspector,
would accept permit applications and evaluate materials for com-
pleteness and expedite permit processing by acting as a single
input source for all documentation required. He would assist con-
tractors , architects , engineers , owner-builders and the public
with information on construction requirements, fees , etc. , and co-
ordinate the routing of plans for interdepartmental response,
together with outside plan checkers. One of the key suggestions
made in the recent Building Division User' s Survey was to have a
Building Inspector available more frequently during day time hours
at the public counter. Absent our ability to successfully recruit
for a Senior Building Inspector, we feel that we can respond to
this legitimate need through establishment of this position.
Creation of this position would also free up planning staff time
from review of single family projects for zoning compliance, to-
gether with allowing the Chief Building Inspector more time to
monitor field inspection practices and standards .

FISCAL IMPACTS :
Fiscal impact over the next six (6) months would be a theoretical
savings in salary of approximately $600.00. However, given the
fact we are proposing internal recruitment and advancement of our
current Building Inspector at Step E to the osition it would
actually incur added costs of approximately $S 10.00 to fill a po-
sition at Step E. Filling the Senior Building Inspector' s authori-
zation in effect with a Permit Services Coordinator would generate
a need to also fill the vacated position of full time Building
Inspector, which would result in a small savings.
The attached organizational chart reflects the proposed staffing
change.
RECOMMENDATION:
Approval of Resolution 1-87 incorporating a Permit Services Co-
ordinator Job Description into the City Salary Plan and establish-

Recommendation:
Staff recommends that Council approve the attached Traffic
Signal Maintenance Contract with Lee Wilson Electric of Arroyo
Grande.
Background:
In the past, traffic signal maintenance has been done by
Caltrans on a contract basis. Caltrans discontinued this service
at the beginning of the 1986/87 fiscal year due to manpower limi-
tations. Lee Wilson Electric Company has done signal repair work
for the City in the past and is qualified to maintain traffic
signals. This Company has been maintaining our signals since
July 1, 1986 when the Caltrans maintenance program ended.
Fiscal Impact:
Contract costs are $1800 per year plus an hourly rate for
emergency call-outs. The approximate cost of State service was
$2400.00 per year. Funds for this maintenance are available in
the 1986/87 budget.

THIS AGREEMENT, made and entered into this first day of July
1986 by and between the City of Atascadero a municipal corporation of
the State of California, hereinafter referred to as the CITY and Lee
Wilson Electric Company, hereinafter called and referred to as the
"Contractor" .
WITNESSETH:
Whereas, the City of Atascadero has considered a proposed
contract tendered by the contractor for traffic signal maintenance
including the furnishing of all labor , service, materials and equip-
ment, and
WHEREAS, the City Council of the City of Atascadero does find an*
determine it would be in the best interest of the city that the pro-
posed contract be accepted and executed.
NOW, THEREFORE FOR AND IN CONSIDERATION OF THE MUTUAL
COVENANTS AND PROMISES OF THE PARTIES HERETO AND UPON THE EXPRESS
TERMS AND CONDITIONS HEREINAFTER SET FORTH, IT IS AGREED BY AND
BETWEEN THEM, AND EACH WITH THE OTHER, AS FOLLOWS:
FIRST All contract documents are intended to be
coordinated so that any work called for in any one, and not mentioned
in the other is to be performed the same as if mentioned in all con-

tract documents.
SECOND The said Contract agrees to furnish all tools,
equipment,apparatus, facilities, labor,service and materials, and per-
form all work necessary to maintain traffic signal facilities in good
workmanlike manner. It is understood and agreed that all said labor,
services,materials and equipment shall be furnished and said work per-
formed and completed by the Contractor as an independent contractor,
subject to the inspection and approval of the City, its Director of
Public Works, or inspectors or their representatives.
THIRD the Contractor agrees to inspect, clean, adjust
and make a routine inspection of each control unit once per month.The
Contractor agrees that he will maintain a record in each controller
cabinet showing date and time checked. Controller units shall not be
replaced,except temporarily for repair, withoutPP
rior approval of the

City.
FOURTH Contractor agrees to replace or repair any
and all defective or worn out parts in the signal system which cause a
signal failure or malfunction as the occasion arises.
FIFTH Contractor agrees to replace all lamps in all
signals using an eighty percent depletion curve, but not to exceed 12
months, using standard traffic signal lamps. Contractor shall be
entitled to receive and shall be paid by the City the sum of $540.00
per year for each signalized intersection.
SIXTH Contracter agrees to clean, polish and inspect
all lenses and reflectors at the time the traffic signals are re-

lamped. At this time all broken or deteriorated parts will be ra
placed or changed as necessary,and parts except lamps, will be billed
on a seperate invoice.
SEVENTH Contracter agrees to maintain a 24 hour per
day emergency service for the replacement of burned out lamps or con-
troller malfunctions. In the course of traveling to and from the
locations of the equipment to be serviced, Contractors representative
shall observe the traffic signals at other designated intersections
for possible malfunctions. The replacement of burned out lamps need
not be on an emergency basis provided there are at least two indi-
cations still operative for each direction of travel. In such case,
replacement shall be handled as soon as possible in a routine manner.
EIGHTH Contractor agrees to provide the same servic

for the repair of other equipment and appurtenances such as safet
lighting, pedestrian signals, and detector devices which the Con-
tractor may be called upon from time to time by the City to repair ,
replace,or refurbish
NINTH (a) For and in consideration of furnishing said labor ,
services, materials and equipment under paragraphs THIRD,FOURTH,
SIXTH, and SEVENTH, excepting when such repairs are necessitated by
obsolescence or accidental damage such as collision, acts of God and
vandalism, Contractor shall be entitled to receive and shall be paid
by the City the sum $75 .00 per month for each signalized intersection,
Traffic Way and E1 Camino Real,and El Camino and Curbaril, or each
newly signalized intersection.

(b) For and in consideration for furnishing said labor , services,
materials and equipment under paragraph SEVENTH when such repairs are
necessitated by obsolescence or accidental damage as defined above and
under paragraph EIGHTH, Contractor shall be entitled to receive in
addition to the monthly sum above, Labor costs at Contractor ' s pre-
vailing standard rates. As follows:

(c) The cost for services provided for herein may be negotiated
each year following the anniversary date of this agreement, and will
be subject to the approval of the City. Any insurance increases may
also be negotiated.
TENTH: The Contractor shall carry public liability and property
damage insurance in an amount not less than $500,000.00 for injuries,
including accidental death, for any one person, and subject to the
same limit for each person in an amount not less than $1, 000, 000. 00 on

any one accident, and property damage insurance in an amount not leo
than $50, 000 .00. The contractor shall also maintain during the life
of this contract, Worker ' s Compensation insurance covering all of his
employees on the project, and shall furnish to the City, certificates
issued by such companies showing that all of the above mentioned in-
surance has been issued and is in full force prior to commencing work.
(a) The Contractor shall likewise obtain public liability and
property damage insurance to cover vehicles used or maintained by him
in the performance of the work, with liability limits of not less than
$500, 000.00 for any one person and $1,000,000 .00 for any one accident,
and property damage of $50 ,000 .00 .
ELEVENTH: This contract shall extend for a period of one (1)
year from hereof. However, either party in its discretion shall hav
the right to terminate at any time sooner by giving sixty (60) day
advance written notice.
TWELFTH: If the Contractor should neglect to prosecute the
work property or fail to perform any provisions of this contract the
City, after three (3) days written notice to the Contractor , may with-
out prejudice to any other remedy it may have, make good such defici-
encies and may deduct the cost thereof from the payment then or there-
after due to the Contractor.
THIRTEENTH: Except for the manufacturers factory warranty, the
Contractor disclaims all warranties with respect to materials supplied
hereunder , and further disclaims any and all liability for failure to
perform or delay in performance hereunder where the same is due in

whole or in part to any cause beyond Contractors reasonable control,
such as, but not limited to fire, flood earthquake, lighting, strike,
or other labor difficulty.
FOURTEENTH: Contractor shall not be liable for damages
arising out of injury to person or damage to property of a customer or
any third party unless the same was due to Contractors fault or act.
(a) City further agrees to indemnify to the extent authorized
by law, and save free and harmless Contractor against negligent acts
or omissions caused by City, its agents or employees, and any costs
and expenses incurred by the respective parties on account of any
claim therefore. Contractor agrees to indemnify and save free and
harmless City and its authorized representatives and employees against
negligent acts or omissions caused by Contractor, his agents or
employees, and any cost and expenses incurred by the par-
ties
respective ar-
ties on account of any claim therefore.
(b) It is agreed by the parties that this indemnity agreement is
not limited in any way by the extent of any policy of insurance cur-
rently in force and held by either party.
Nothing herein contained shall be construed as limiting in any
way the extent to which the Contractor may be held responsible for
payment of damages to persons or property resulting from his operation
or any operations of any subcontractors under him.
IN WITNESS WHEREOF, the City Council of the City has caused this
agreement to be subscribed by its Mayor and City Clerk and said Con-
tractor has agreed or caused this agreement to be executed by his

Dear Mr. Sensibaugh:
It is necessary for Caltrans to reduce services provided to local
agencies. Caltrans has been maintaining two signals for the City of
Atascadero, but we will not be able to provide this service after
July 1, 1986. This reduction is necessary because of our increasing
inventory and the limitation on our resources.
The two signals we have been maintaining are:
1. El Camino Real and Curbaril Avenue
2. El Camino Real and Traffic Way
I hope this notification will give you sufficient time to make other
arrangements for your signal maintenance. The City of Salinas and
the City of Paso Robles have their signal maintenance done by
contract. I understand that Lee Wilson Electric of Arroyo Grande
may be involved in signal maintenance work.
We will also discontinue our signal maintenance service to the City
of Grover City (4 signals) and the City of Arroyo Grande (3
signals) . Perhaps the three agencies may be able to make a joint
arrangement for signal maintenance.
We can, if necessary, provide emergency response on your signals.
If your agency would screen the trouble calls to see that a response
is truly necessary. If you are unable to provide through your
forces or through a contract response the necessary emergency
corrective work, we can respond if personnel are available.
Permanent repair would be your agency's responsibility.
The current maintenance agreement will be terminated July 1, 1986.
I hope that your agency will be able to make this adjustment in the
time provided.

BACKGROUND:
Attached is a request from John Falkenstien, Cuesta
Engineering, for inclusion of property on Musselman Avenue into
the boundaries of Improvement District #1. Staff has reviewed
this request and have determined that the criteria for annexa-
tion has been met.
ALTERNATIVE:
Denial of the annexation request eliminates the option of
sewer service. The applicant is then limited to an on-site septic
system which may or may not be feasible for the type of develop-
ment proposed. It should also be noted that this is a former
Cease and Desist area. "
FISCAL IMPACT:
There is no cost to the District as properties annexing into
the Improvment District pay for any line extension as well as
applicable annexation and connection fees.

A RESOLUTION OF THE ATASCADERO COUNTY SANITATION DISTRICT
APPROVING EXTENDING PUBLIC SEWER SERVICE TO
LOT BLOCK
APN 30-461-03 AND INCORPORATING THE AREA
CONCERNED INTO THE BOUNDARIES OF THE
IMPROVEMENT DISTRICT NUMBER 1
WHEREAS, the Atascadero County Sanitation District is empowered
by Section 4834 of the Health and Safety Code to annex territory
already a part of the County Sanitation District to the improvement
district of that County Sanitation District; and
WHEREAS, Mr. Norman Norton owns the property described
in Exhibits A and B attached to this resolution; and
WHEREAS, said property, located on Musselman Avenue
is contiguous with the existing improvement district; and
WHEREAS, said property is within the Urban Services Line on
the City' s Land Use and Circulation General Plan Map and is con-
sistent with the General Plan; and
WHEREAS, it is in the interest of Atascadero County Sanitation
District to provide sewer service when consistent with the
General Plan; and
WHEREAS, the proposed project has received a Negative Declaration
pursuant to the provisions of the California Environmental Quality
Act;
NOW THEREFORE, BE IT RESOLVED by the Directors of the Atascadero
County Sanitation District as follows:
Section 1. The Board finds that the territory described in
this resolution will be benefitted by such sewer service (Health
and Safety Code section 4830) ;
Section 2. The Board approves the extension of public sewer
service to the following parcels, subject to the payment of
appropriate fees as listed in the Atascadero County Sanitation
Code:
