the Atascadero Municipal Code relating to the Council's relationship

WELCOME TO THE ATASCADERO CITY COUNCIL MEETING
The City Council meets in regular session on the second and fourth Tuesday of each month at 7:00 p.m., at the City Hall
Council Chambers, 6907 EI Camino Real, Atascadero. Matters are considered by the Council in the order of the printed
Agenda.
Copies of the staff reports or other documentation relating to each item of business referred to on the Agenda are on file
in the office of the City Clerk and are available for public inspection during City Hall business hours at the Central
Receptionist counter and on our website, www.atascadero.org. An agenda packet is also available for public review at
the Atascadero Library, 6850 Morro Road. Contracts, Resolutions and Ordinances will be allocated a number once they
are approved by the City Council. The minutes of this meeting will reflect these numbers. All documents submitted by the
public during Council meetings that are either read into the record or referred to in their statement will be noted in the
minutes and available for review in the City Clerk's office. Council meetings are recorded and may be reviewed by the
public. Copies of meeting recordings are available for a fee. Contact the City Clerk for more information (470-3400).
In compliance with the Americans with Disabilities Act, if you need special assistance to participate in a City meeting
or other services offered by this City, please contact the City Manager's Office or the City Clerk's Office, both at (805)
470-3400. Notification at least 48 hours prior to the meeting or time when services are needed will assist the City staff in

Members of the audience may speak on any item on the agenda. The Mayor will identify the subject, staff will give their
report, and the Council will ask questions of staff. The Mayor will announce when the public comment period is open and
will request anyone interested to address the Council regarding the matter being considered to step up to the podium. If
you wish to speak for, against or comment in any way:
• You must approach the podium and be recognized by the Mayor
• Give your name and address (not required)
• Make your statement •
• All comments should be made to the Mayor and Council
• No person shall be permitted to make slanderous, profane or negative personal remarks concerning any other
individual, absent or present
• All comments limited to 5 minutes (unless changed by the Council)
• No one may speak for a second time until everyone wishing to speak has had an opportunity to do so, and no
one may speak more than twice on any item.
If you wish to use a computer presentation to support your comments, you must notify the City Clerk's office at least 24
hours prior to the meeting. Access to hook up your laptop to the City's projector will be provided. You are required to
submit to the City Clerk a printed copy of your presentation for the record. Please check in with the City Clerk before the
meeting begins to announce your presence and turn in the printed copy.
The Mayor will announce when the public comment period is closed, and thereafter, no further public comments will be
heard by the Council.

REGULAR SESSION: 7:00 P.M.
Mayor O'Malley called the meeting to order at 7:00 p.m. and Kaila Norton led the
Pledge of Allegiance.
ROLL CALL:

COMMUNITY FORUM:
Pastor Dennis Richards led those present in prayer.
Steve Martin, Executive Director Atascadero Main Street, spoke about activities and
events scheduled for the holiday season in the downtown.

Tracy Di Vita Baas requested the Council consider creating a public art policy for
Atascadero and that it be in place before any decisions are made regarding placing art
in public areas.
David Baumgarten, representing SLO County Public Access television, requested the
Council release the city's P.E.G. funds.
Tom Colemeyer, Oppose Wal Mart, thanked Council Member Luna and community
activists for their support during the recent election and spoke about the organization's
future plans.
Maria Hooper asked several questions regarding the deed restrictions for the Printery
building and inquired about the RFP process and the status of a Preservation
Committee. Speaking for Atascadero Main Street she asked the status of their requests
for removal of the under 10,000 sq ft exemption for Planning Commission approval and
the issue of 1 st floor zoning.
Mayor O'Malley and Community Development Director Frace responded to issues
raised during the Community Forum period.
Steve Martin stated that the Main Street Board of Directors has declined to take a
survey of property owners regarding 1St floor zoning and has asked for a City Council
study session on the issue.

COUNCIL ANNOUNCEMENTS AND REPORTS:
Mayor O'Malley and Council Member Clay spoke about local radio personality Joe
Bensen and wished him a speedy recovery from his recent illness.

B. PUBLIC HEARING:
1. Amendment of the Cardroom Ordinance to Increase the Number of
Tables in a Cardroom
■ Fiscal Impact: None.
■ Recommendation: Council introduce for first reading, by title only, the
Draft Ordinance amending the City's Cardroom Ordinance, with any
revisions desired by the Council. [City Attorney]
City Attorney Patrick Enright gave the staff report and answered questions of Council.
PUBLIC COMMENT— None
MOTION: By Council Member Luna and seconded by Council Member
Clay to introduce for first reading, by title only, the Draft
Ordinance amending the City's Cardroom Ordinance.
Motion passed 4:0 by a roll-call vote.
2. Interim Urgency Ordinance Establishing a Moratorium on the Approval
of Recordation of Site Condominium Plans
■ Description: Temporary Ordinance establishing a moratorium for the
approval of recordation of Site condominium plans.
■ Fiscal Impact: None.
■ Recommendation: Council hold a public hearing on the extension of the
urgency ordinance, and adopt the attached interim urgency ordinance

establishing a moratorium on the approval or recordation of site
condominium plans. This action extends the moratorium for ten (10)
months and fifteen (15) days. [City Attorney]
City Attorney Patrick Enright gave the staff report and answered questions of Council.
PUBLIC COMMENT— None
MOTION: By Council Member Luna and seconded by Council Member
Clay to adopt the attached interim urgency ordinance
establishing a moratorium on the approval or recordation of
site condominium plans, and extending the moratorium for
ten (10) months and fifteen (15) days.
Motion passed 4:0 by a roll-call vote. (Ordinance No. 502)
C. COMMITTEE & LIAISON REPORTS:
Mayor O'Malley
1. County Mayor's Round Table: Discussed financial ramifications to cities that
did not go for an increased sales tax, and asked the City Manager to look into
options. City Manager Wade Mc Kinney reported the Mayors had discussed
attempting to get a California Transportation Commission ruling or legislative
action to allow development impact fees to be the same self help issue as a
sales tax increase. There was Council agreement for writing a letter in
support of this action.
2. Air Pollution Control District (APCD): Mayor O'Malley reported that he will not
be carrying on with this appointment, so the Council must appoint another
representative.
3. Economic Vitality Corporation, Board of Directors (EVC): A sub committee is
looking into the multiplier effect of the wine industry in the north county.
4. Economic Opportunity Commission (EOC): Mayor O'Malley will not continue
to participate on this commission and a new representative must be
appointed. He stated his concern for locating an alternate site for the
Homeless Shelter, and will continue to work on this issue.
5. SLO Council of Governments (SLOCOG) / S.L.O. Regional Transit Authority
(SLORTA: Passage of Proposition 1A and B will mean $280,000 funds
available per year for local roads, and $850,000 one time funds for local
roads.

1. Student Representative for Parks and Recreation Commission: Ryan Carden
has been selected to serve as a second Student Representative for the
Commission.

Council Member Clay
Council Member Clay thanked Mayor O'Malley for his participation in so many
committees during his term in office and congratulated him, Mike Brenler and
Ellen Beraud for their election to the City Council.
Council Member Luna
1. Finance Committee: Discussed how to pay for the cost overrun on the Lewis
Avenue Bridge.
Council Member Luna thanked Mayor O'Malley for all his committee work.
D. INDIVIDUAL DETERMINATION AND/OR ACTION:
City Council
Council Member Clay reported he had received a letter of resignation from
Planning Commissioner Bob Kelley and stated he will appoint another
Commissioner in the next week or two.
E. ADJOURNMENT:
Mayor O'Malley adjourned the meeting at 7:57 p.m. to the next regularly scheduled
meeting of the City Council on November 28, 2006.

Reciting the Fact of the Special Municipal Election
Held on November 7, 2006
RECOMMENDATION:
Council adopt the Draft Resolution, reciting the fact of the Special Municipal Election
held on November 7, 2006, declaring the result and such other matters as provided by
law.
DISCUSSION:
The Special Municipal Election was held on November 7, 2006. California Elections
P P
Code §10262 states that the City Council shall meet to declare the results of the
election upon certification of results by the County Election Department. The California
Elections Code §10262 & 10264 also states that the Council shall adopt a resolution
reciting the fact of the election, including a statement of the results.
Total voter registration for the City of Atascadero was 16,221, which is 739 less than
the total voter registration for the year 2004. Atascadero voters were asked to vote for
one Council Member; the final official results are attached to this report.
FISCAL IMPACT: None.

DRAFT RESOLUTION
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ATASCADERO, CALIFORNIA
RECITING THE FACT OF THE SPECIAL MUNICIPAL ELECTION
HELD ON NOVEMBER 7, 2006, DECLARING THE RESULT
AND SUCH OTHER MATTERS AS PROVIDED BY LAW
WHEREAS, a Special Municipal Election was held and conducted in the City of
Atascadero, California, on Tuesday,November 7, 2006, as required by law; and
WHEREAS, notice of the election was given in time, form and manner as provided by
law; that voting precincts were properly established; that election officers were appointed and
that in all respects the election was held and conducted and the votes were cast, received and
canvassed and the returns made and declared in time, form and manner as required by the
provisions of the Elections Code of the State of California for the holding of elections in general
law cities; and
WHEREAS, pursuant to Resolution No. 2006-067 adopted June 27, 2006, the County
Election Department canvassed the returns of the election and has certified the results to this City
Council,the results are received, attached and made a part hereof as "Exhibit A.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ATASCADERO,
CALIFORNIA,DOES RESOLVE,DECLARE,DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. That the whole number of ballots cast in the precincts except absent voter
ballots and provisional ballots was 4,841.
That the whole number of absent voter ballots cast in the City was 5,52Q making a total
of 10,361 ballots cast in the City.
SECTION 2. That the names of persons voted for at the election for Member of the City
Council are as follows:
Mike Brennler, Robert M. Jones,Becky Pellett Pacas.
SECTION 3. That the number of votes given at each precinct and the number of votes
given in the City to each of the persons above named for the respective offices for which the
persons were candidates and for and against the measure were as listed in Exhibit"A" attached.
SECTION 4. The City Council does declare and determine that: Mike Brennler was
elected as Member of the City Council for the full term of four years.
SECTION 5. The City Clerk shall enter on the records of the City Council of the City, a
statement of the result of the election, showing: (1)The whole number of ballots cast in the City;
(2) The names of the persons voted for; (3) For what office each person was voted for; (4) The

number of votes given at each precinct to each person; (5) The total number of votes given to
each person.
SECTION 6. That the City Clerk shall immediately make and deliver to each of the
persons so elected a Certificate of Election signed by the City Clerk and authenticated; that the
City Clerk shall also administer to each person elected the Oath of Office prescribed in the
Constitution of the State of California and shall have them subscribe to it and file it in the office
of the City Clerk. Each and all of the persons so elected shall then be inducted into the
respective office to which they have been elected.
SECTION 7. That the City Clerk shall certify to the passage and adoption of this
resolution and enter it into the book of original resolutions.

Reciting the Fact of the General Municipal Election
Held on November 7, 2006
RECOMMENDATION:
Council adopt the Draft Resolution, reciting the fact of the General Municipal Election
held on November 7, 2006, declaring the result and such other matters as provided by
law.
DISCUSSION:
The General Municipal Election was held on November 7, 2006. California Elections
Code §10262 states that the City Council shall meet to declare the results of the
election upon certification of results by the County Election Department. The California
Elections Code §10262 & 10264 also states that the Council shall adopt a resolution
reciting the fact of the election, including a statement of the results.
Total voter registration for the City of Atascadero was 16,221, which is 739 less than
the total voter registration for the year 2004. Atascadero voters were asked to vote for
two Council Members, City Clerk and City Treasurer; the final official results are
attached to this report.

A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ATASCADERO, CALIFORNIA
RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION
HELD ON NOVEMBER 7, 2006, DECLARING THE RESULT
AND SUCH OTHER MATTERS AS PROVIDED BY LAW
WHEREAS, a General Municipal Election was held and conducted in the City of
Atascadero, California, on Tuesday, November 7, 2006, as required by law; and
WHEREAS, notice of the election was given in time, form and manner as provided by
law; that voting precincts were properly established; that election officers were appointed and
that in all respects the election was held and conducted and the votes were cast, received and
canvassed and the returns made and declared in time, form and manner as required by the
provisions of the Elections Code of the State of California for the holding of elections in general
law cities; and
WHEREAS, pursuant to Resolution No. 2006-069 adopted June 27, 2006, the County
Election Department canvassed the returns of the election and has certified the results to this City
Council, the results are received, attached and made a part hereof as "Exhibit A.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ATASCADERO,
CALIFORNIA,DOES RESOLVE, DECLARE,DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. That the whole number of ballots cast in the precincts except absent voter
ballots and provisional ballots was 4,841.
That the whole number of absent voter ballots cast in the City was 1520, making a total
of 10,361 ballots cast in the City.
SECTION 2. That the names of persons voted for at the election for Member of the City
Council are as follows:
Tom O'Malley,Ellen Beraud, Bob Kelley, and Ann Ketcherside.
That the names of the persons voted for at the election for City Clerk are as follows:
Marcia McClure Torgerson
That the names of persons voted for at the election for City Treasurer are as follows:
Joseph Modica Jr.

SECTION 3. That the number of votes given at each precinct and the number of votes
given in the City to each of the persons above named for the respective offices for which the
persons were candidates and for and against the measure were as listed in Exhibit "A" attached.
SECTION 4. The City Council does declare and determine that: Tom O'Malley was
elected as Member of the City Council for the full term of four years; Ellen Beraud was elected
as Member of the City Council for the full term of four years; Marcia McClure Torgerson was
elected as City Clerk for the full term of four years; and Josh Modica Jr. was elected as City
Treasurer for the full term of four years.
SECTION 5. The City Clerk shall enter on the records of the City Council of the City, a
statement of the result of the election, showing: (1)The whole number of ballots cast in the City;
(2) The names of the persons voted for; (3) For what office each person was voted for; (4) The
number of votes given at each precinct to each person; (5) The total number of votes given to
each person.
SECTION 6. That the City Clerk shall immediately make and deliver to each of the
persons so elected a Certificate of Election signed by the City Clerk and authenticated; that the
City Clerk shall also administer to each person elected the Oath of Office prescribed in the
Constitution of the State of California and shall have them subscribe to it and file it in the office
of the City Clerk. Each and all of the persons so elected shall then be inducted into the
respective office to which they have been elected.
• SECTION 7. That the Cit Clerk shall certify to the passage and adoption of this

RECOMMENDATION:
Council approve.City Council meeting schedule for 2007.
DISCUSSION:
The City Council, pursuant to Chapter 2, Section 1.01 of the Atascadero Municipal
Code, meets the second and fourth Tuesday of each month. On occasion, the Council
will hold special study sessions and/or joint meetings with one or both of the
Commissions on a fifth Tuesday. Generally, in the summer months, the Council meets
once a month and avoids conflicts with major holidays. Staff has prepared the attached
schedule for the year 2007 to help in the coordination of these meetings with personal
schedules.

Utility Easement on behalf of the public.
DISCUSSION:
Tentative Tract Map 2004-0050 /Tract 2522 was approved by the City Council on June
7, 2005, and approved the amendment thereto on June 6, 2006. The subdivision
created an eight lot office development.
Pursuant to California Government Code Section 66440 the approving legislative body
(City Council) cannot deny a final map that is consistent with an approved tentative
map. The legislative body is also required to accept, accept subject to improvement, or
reject on behalf of the public, any real property offered for dedication for public use in
conformity with the terms of the offer of dedication. Staff has determined that the Final
Map is consistent with approved Tentative Tract Map.

DISCUSSION:
Tentative Parcel Map 2005-0072 was approved by the City Council on May 2, 2006.
The Tentative Parcel Map approved the division of 3.37 acres into three lots ranging in
area from 1.22 to 1 acre.
Pursuant to California Government Code Section 66474.1 the approving legislative
body (City Council) cannot deny a parcel map that is in substantial conformance with
the previously approved tentative map. Also, Pursuant to California Government Code
Section 66477.1(a), at the time the legislative body approves a parcel map, the
legislative body shall also accept, accept subject to improvement, or reject any offer of
dedication.
Staff has determined that the Parcel Map is in substantial conformance with approved
Tentative Parcel Map.

RECOMMENDATIONS:
Council:
1. Introduce for first reading, by title only, Draft Ordinance which amends the
Atascadero Municipal Code relating to the Council's relationship with Staff, and the
Commissions' relationship with Staff; and,
2. Adopt Draft Resolution, amending the Council Norms and adopting Norms for the
Planning Commissioners and Parks and Recreation Commissioners; and,
3. Review and give staff direction on Draft Ethics Policy.
DISCUSSION:
Draft Ordinance
Council Relations with Staff
The City's Municipal Code section 2-4.18 explains the basic relationship between
Council and Staff in establishing that the Council shall deal with the administrative
services of the City only through the City Manager, except for inquiries. This is set forth
in subsection (a) to the Draft Ordinance. The Draft Ordinance adds subsections (b)
and (c). Subsection (b) provides that Council Members shall not attempt to coerce or
influence staff in the making of appointments, the awarding of contracts, the selection
of consultants, the processing of development applications, or the granting of City
licenses or permits. Subsection (c) prohibits Council Members from attending internal
staff meetings or meetings between City staff and third persons unless invited by City
Staff or directed by Council.

Commissioner Relations with Staff 40
The City's Municipal Code has no provisions concerning what the relationship should
be between Commissioners and staff. The Draft Ordinance addresses this issue by
adding a section under Chapter 9 of Title 2 concerning Planning Commissioners and
Chapter 13 of Title 2 concerning Parks and Recreation Commissioners concerning the
relationship between commissioners and staff. There are four subsections to both
sections:
(a) The relationship between the Commission and Council
(b) The relationship between the Commission and staff, specifically the
Department Heads for each commission, i.e. the Community Development Director for
Planning and the Community Services Director for Parks and Recreation.
(c) Prohibits commissioners from attempting to coerce or influence staff.
(d) Prohibits commissioners from attending internal staff meetings or meetings
between City staff and third persons unless invited by City staff or directed by the
Council.
The language provided in the Draft Ordinance may be revised or modified as deemed
necessary by the Council
Draft Resolution on Norms
In 2003, the City Council adopted Council Norms for the Council and the Norms have
been amended from time to time. There are no Norms that have been adopted for the
Commissioners. Pursuant to the direction of the City Council, this office reviewed the
Council Norms and drafted Norms for each of the Commissions. To assist in reviewing
the Norms and the proposed changes, this office included a copy of the current Council
Norms, the revised Council Norms, and a compare-rite version.
Council Norms
The changes to the Council Norms would be as follows:
Number 3 - Added language to state that the process in selecting the Mayor and
Mayor Pro Tem was revised in August 2006. That revision prohibits a Council Member
from being Mayor during their first year on the Council
Number 14 - This provision concerns ex parte contact and the revised language
elaborates on the current requirements for ex parte communications. The requirement
for ex parte communication arises when the Council is sitting as a quasi-judicial vs.
legislative role. Therefore, the requirement applies when the Council is hearing an
application, normally a planning application, like a subdivision map, conditional use
permit or variance. It would also apply if the Council was hearing an appeal on a code
enforcement issue or some other matter where the Council is adjudicating on an
individual's property or conduct. Another way to look at it is the Council is applying the
laws, ordinances and policies to an individual situation. It does not apply to policy or

legislative decisions, like the consideration of ordinances (including zoning) or policies
of the City that apply either Citywide or to a class of individuals.
Number 18 - Revised this to state that Council may, but are not required to,
clarify votes when voting. Certainly a Council Member can not be required to clarify
their vote on a matter, but they may if they so desire.
Number 22 - Added this number to state that the Council Members will comply
with the section in the Municipal Code on the relations between Council and staff.
Number 23 - Changed "annually" to "periodically."
Commissioner Norms
In drafting Commissioner Norms, we reviewed the Council Norms and revised in
accordance with the different relationship between the Council who adopt the policies
and the Commissions who implement the policies and may advise the Council on
certain subjects. With that in mind, the Norms are the same, except for the following
revisions:
Number 3 - Revised to reflect that the Chairperson and Vice-Chairperson are
selected each January.
• Number 4 - Deleted as Commissions do not appoint standing
commissions/committees.
Number 10 - Revised slightly to reflect that Council is the policy maker.
Number 15 - Deleted as Commissioners would not have confidential information.
Number 16 - Deleted as it requires Council Members to get Commission
agendas, staff report etc.
Number 17 - Deleted, authorizes Council to arrange for periodic presentations
from Staff.
The revisions to the Code and the adoption of Norms for Commissioners are the two
items that the Council directed this office to review and draft. Certainly the Council may
amend them as the Council desires, in adding, deleting or revising provisions.
Ethics Policy
In reviewing the above ordinance and Norms, I also considered what other vehicles
there may be for the Council to address the relationship between council and staff and
the public, and what the Council could do to address the issue. Some cities are
adopting Ethics Policies that address some of the same issues, and usually expand on
them. I have attached a draft Ethics Policy that the Council may desire to consider at
some time in the future.

Conclusion
The City Council may adopt any of the proposed changes to the Ordinance Code and
the Norms, and may amend as the Council deems appropriate.
FISCAL IMPACT: None
ALTERNATIVES:
1. The City Council may make modifications to the proposed text amendments to
the Municipal Code and Resolutions.
2. The City Council may determine that more information is needed on some
aspect of the Draft Ordinance and/or Resolution and may refer the item back to
staff to develop the additional information.
3. The City Council may decide to not amend the Municipal Code concerning the
relationship between council/commissions and staff, and the amendment to the
Council Norms and the adoption of Commissioner Norms.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ATASCADERO AMENDING SECTION 2-4.18 AND ADDING SECTIONS
2-9.11.05 AND 2.13.11.05 TO THE ATASCADERO MUNICIPAL CODE
RELATING TO THE RELATIONSHIP BETWEEN COUNCIL
AND COMMISSIONERS TO STAFF
WHEREAS, the City Council of the City of Atascadero has previously adopted
Atascadero Municipal Code section 2-4.18 concerning the relationship between the council and
staff; and
WHEREAS, the City Council desires to adopt similar provisions for the relationship
between the Planning Commission and the Parks and Recreation Commission and staff; and
WHEREAS, the City Council of the City of Atascadero finds that the following changes
to the Atascadero Municipal Code are reasonably necessary to promote the health, safety and
welfare of the citizens of Atascadero.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ATASCADERO does ordain
as follows:
Section 1. The City Council hereby adopts the recitals contained above as findings to support
• the adoption of an ordinance concerning the relationship to the council members and
commissioners to staff.
Section 2. Section 2-4.18 of the Atascadero Municipal Code is hereby amended to read in full as
follows:
2-4.18 Relations to Council.
(a) The City Council and its members shall deal with the administrative services of the City only
through the City Manager, except for the purpose of inquiry, and neither the City Council nor
any member thereof shall give orders to any subordinates of the City Manager. The City
Manager shall take his orders and instructions from the City Council only when sitting in a duly
convened meeting of the City Council, and no individual Council member shall give any orders
or instructions to the City Manager. The City Council shall instruct the City Manager in matters
of policy. Any action, determination or omission of the City Manager shall be subject to review
by the City Council. The City Council may not overrule, change or modify any such action,
determination or omission except by the affirmative vote of at least three (3) members of the City
Council.
(b) Council Members shall not attempt to coerce or influence staff in the making of
appointments, the awarding of contracts, the selection of consultants, the processing of
development applications, or the granting of City licenses or permits. Commissioners shall not
. attempt to change or interfere with the operating policies and practices of any City department.

(c) Council Members shall not attend internal staff meetings or meetings between City staff and

Section 3. Section 2-9.11.05 of the Atascadero Municipal Code is hereby added to read in full as
follows:
2-9.11.05 Planning Commission—Relations to Council and Staff
(a) The City Council establishes policies citywide and specifically as they relate to the duties
of the Planning Commission. The Planning Commission is advisor to the Council except where
the Council has delegated specific authority to the Commission. City Staff administers the
policies of the Council, forwards recommendations of the Commission to the Council and
administers Planning Commission actions on issues delegated to the Commission by the Council.
The Planning Commission may recommend to the Council topics to be included in the City's
work program.
(b) The Commission and its members shall work through the Community Development
Director, except for the purpose of inquiry, in carrying out the Commission's responsibilities.

Section 4. Section 2-13.11.05 of the Atascadero Municipal Code is hereby amended to read in

2-13.11.05—Parks and Recreation Commission—Relations to Council and Staff
(a) The City Council establishes policies citywide and specifically as they relate to the duties of
the Parks and Recreation Commission. The Parks and Recreation Commission is advisory to the
Council except where the Council has delegated specific authority to the Commission. City Staff
administers the policies of the City Council, forwards recommendations of the Commission to
the Council and administers Parks and Recreation Commission action on issues delegated to the
Commission by the Council. The Parks and Recreation Commission may recommend to the
Council topics to be included in the City's work program.
(b) The Commission and its members shall work through the Community Services Director,
except for the purpose of inquiry, in carrying out the Commission's responsibilities.
(c) Commissioners shall not attempt to coerce or influence staff in the making of appointments,
the awarding of contracts, the selection of consultants, the processing of development
applications, or the granting of City licenses or permits. Commissioners shall not attempt to
change or interfere with the operating policies and practices of any City department.

Section 5. All other provisions and sections of the Atascadero Municipal Code in effect on the
days preceding the passage of this ordinance shall remain in full force and effect upon passage of
this ordinance.
Section 6. This ordinance shall not be interpreted in any manner in conflict with controlling
provisions of State law, including without limitation, the Constitution of the State of California.
If any section, subsection or clause of this ordinance shall be deemed to be unconstitutional or
otherwise invalid, the validity of the remaining sections, subsections and clauses shall not be
effected thereby. The City Council hereby declares that it would have passed each section,
subsection, subdivision, paragraph, sentence, clause or phrase thereof irrespective of the fact that
any one or more subsections, subdivisions, paragraphs, sentences, clauses or phrases are declared
unconstitutional, invalid or ineffective.
Section 7. The Mayor shall sign this Ordinance and the City Clerk shall attest thereto and shall
within fifteen (15) days of its adoption cause it or a summary of it to be published,in the
Atascadero News, a newspaper published and circulated in the City of Atascadero; and thereupon
and thereafter this Ordinance shall take effect and be in force according to law.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ATASCADERO ESTABLISHING COUNCIL
AND COMMISSION NORMS
WHEREAS, the City Council in 2003 adopted Council Norms and have amended the
Council Norms from time to time; and
WHEREAS, the Council has never adopted Norms with the Commissions and desires to
adopt Norms for each Commission at this time; and
WHEREAS,the Council also desires to review the Norms established for the Council,and
will amend in accordance with this Resolution.
NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Atascadero
as follows:
Section 1. Purpose. The purpose of this resolution is to revise the Council Norms previously
adopted by the Council, and to enact Norms for the Planning Commission and the Parks and
Recreation Commission.
Section 2. Council Norms. The City Council hereby amends the Council Norms as set forth in
Exhibit A of this Resolution. Any Council Norms previously adopted by this Council are hereby
repealed.
Section 3. Commission Norms. The City Council hereby adopts the Planning Commission Norms
and the Parks and Recreation Norms as set forth in Exhibits B and C to this Resolution.
Section 4. Effective Date. This Resolution shall take effect immediately upon passage by the City
Council.

including disclosing t district attorney or grand jury that are necessary to establish the

confidential information acquired in closed session, concerning the propriety or legality of the
Agency acting in closed session; or(3) disclosing information acquired by being present in a closed

attention of the full Council and City Attorney, to provide the Council an opportunity to cure an
alleged violation and a manager or employee will first bring the matter to the attention of the City

C. A Council Member who willfully and knowingly discloses for pecuniary gain
confidential information received by him or her in the course of his or her official duties may be
guilty of a misdemeanor under Government Code Section 1098.
Section 6. Conflicts of Interest.
A. Council Members, Commissioners, managers emyees will not have a
financial interest in a contract with the City, or be purchaser a by the City or a vendor at a
purchase made by the City, unless their participation was on under Government Code
sections 1091 or 1091.5, or other provisions of law. A Counci embe not participate in the

A. The 's the policy for the City. The City Manager has the authority that
is delegated to him or he the Council. The City Manager will install and maintain a system of
auditing and accounting that will completely and at all times show the financial condition of the
City. The Council will retain and periodically review the work of an auditor as an independent
contractor of the City who will report to the Council, to conduct an annual audit of the City's
books,records and financial affairs.
B. The City Manager serves at the pleasure of the Council, pursuant to an
employment agreement. The Council will provide policy direction and instructions to the City
. Manager on matters within the authority of the Council by majority vote of the Council during

duly-convened Council meetings. Members of the Council will deal with matters within the
authority of the City Manager through the City Manager, and not through other City employees.
Members of the Council will refrain from making requests directly to City employees (rather

priority of work assignments. Members of the Council may request non-confidential, factual
information regarding City operations from City employee.
Section 10. Council—Management/Employee Relations

Section 12. Improper Activities and the Reporting o Activities;

Section 14. Violation of Ethics Policy.
A perceived violation of this policy by a Council Member, Commissioner, manager or
employee should be referred to the full Council or in the case of managers and employees to the
City Manager for investigation, and consideration of any appropriate action warranted. A violation

of this policy may be addressed by the use of such remedies as are available by law to the City
• including but not limited to: (a) adoption of a resolution expressing disapproval of the conduct of
the Council Member or Commissioner who has violated this policy, (b)injunctive relief,(c)referral
of the violation to the District Attorney and/or the Grand Jury or (d) proper disciplinary action by
the Council or City Manager.
Section 15. Ethics Training.

Amendment to Municipal Code to Reduce
the Number of Commissioners; Amend Appointment
Process; Revision of Resolution for the Selection of Committee,
Commission and Board Members
RECOMMENDATIONS:
Council:
1. Introduce for first reading, by title only, Draft Ordinance, amending Chapter 9 and 13
of Title 2 of the Atascadero Municipal Code relating to the appointment of Planning
Commission members and Parks and Recreation Commission members; and,
2. City Council adopt Draft Resolution, revising the procedures for the selection of
committee, commission and board members.
DISCUSSION:
General Law
The City Council has broad authority to appoint boards and commissions as part of the
government of the City, unless otherwise limited by state. State Planning Law does
require that the Planning Commissioners consist of at least five members. The powers,
duties, and method of appointment should be established by the City Council
The Council may adopt reasonable methods of selecting members of its boards and
commissions. Appointments must be discussed and made in open session
(Government Code section 54957). The provisions of Government Code section 54970
through 54974 contain requirements for annual preparation of a local appointment list,
and provide for posting notices of unscheduled vacancies on any board, commission or
committee.

Draft Ordinance
The Planning and Parks and Recreation Commissions consist of seven (7) members,
with each Council Member appointing one commissioner to each commission. There
are then two "at large" commissioners who are appointed by a vote of the City Council.
Additionally, any Commissioner may be removed by a majority vote of the City Council.
Draft Ordinance reduces the size of both Commissions to five (5) members, with each
Council Member appointing one commissioner to each commission. The commissioner
appointed by the Council member serves at the pleasure of the Council Member, and
may be removed by the Council Member at any time for any reason. There is no
process for the entire Council to remove a commissioner. I did consider including a
provision that with a 4/5 vote, the Council may remove an individual commissioner.
This is certainly something that the Council could consider, but it is my understanding
that the desire is to have each commissioner serve at the pleasure of the Council
Member who appointed them, and not to the Council as whole.
Resolution
The revised Resolution makes the necessary changes to make it consistent with the
proposed Ordinance amendments.'
Conclusion
The City Council may adopt any of the proposed changes to the Ordinance Code and
the Resolution, and may amend as the Council deems appropriate.
FISCAL IMPACT: None
ALTERNATIVES:
1. The City Council may make modifications to the proposed text amendments to
the Draft Ordinance A and Draft Resolution.
2. The City Council may determine that more information is needed on some
aspect of the Draft Ordinance and/or Resolution and may refer the item back to
staff to develop the additional information.
' A question that may be asked is, "Why does the Council sometimes adopt an ordinance and other
times a resolution?" In the absence of statutory provisions to the contrary, a legislative act may be either
by resolution or ordinance. One court has noted the difference between resolution and an ordinance as
"An ordinance in its primary and usual sense means a local law. It prescribes a rule of conduct
prospective in operation, applicable generally to persons and things subject to the jurisdiction of the city.
Resolution denotes something less formal. It is the mere expression of the opinion of the legislative body
concerning some administrative matter for the disposition of which it provides."

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ATASCADERO AMENDING CHAPTER 9 AND 13 OF TITLE II OF THE
ATASCADERO MUNICIPAL CODE RELATING TO THE
APPOINTMENT OF PLANNING COMMISSION MEMBERS AND PARKS

WHEREAS, the City Council of the City of Atascadero previously adopted codes for the
appointment of members to the Planning Commission and to the Parks and Recreation
Commission; and
WHEREAS, the City Council of the City of Atascadero finds that the following changes
to the Atascadero Municipal Code are reasonably necessary to promote the health, safety and
welfare of the citizens of Atascadero.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ATASCADERO does ordain
as follows:
Section 1. Atascadero Municipal Code section 2-9.01 is amended to read as follows:
2-9.01 Creation: Composition is
There is created a Planning Commission for the City which shall consist of five (5) members
who shall not be officials or employees of the City, but who shall be residents of the City.
Section 2. Atascadero Municipal Code section 2-9.02 is amended to read as follows:
2-9.02 Members: Appointment: Terms of office.
The City Council shall appoint members of the Planning Commission as follows: The five (5)
members shall be directly appointed by each individual City Council Member in December
following the election at which any City Council member is elected. The terms of appointment
for the directly appointed members of the Planning Commission shall be four years and expire
on December 31, or until the appointing Council Member vacates office. Appointments shall be
made after the commencement of a term to fill a vacancy or removal, in which case the term of
office shall be for the balance of the unexpired term. In the event that a Planning Commissioner
resigns or is removed, the vacancy shall be filled by the individual Council Member that made
the appointment of the resigning or removed Planning Commissioner. All members shall serve
at the pleasure of the City Council and may continue to serve after expiration of the stated term,
with the approval of the City Council, until such time as a successor is selected according to the
procedures set forth the above.
Section 3. Atascadero Municipal Code section 2-9.04 is amended to read as follows:

If any section, subsection or clause of this ordinance shall be deemed to be unconstitutional or
otherwise invalid, the validity of the remaining sections, subsections and clauses shall not be
effected thereby.

FOR THE SELECTION OF
COMMITTEE, COMMISSION AND BOARD MEMBERS
WHEREAS, The Atascadero City Council recognizes that citizen participation in local
government plays an important and active role in the City of Atascadero; and
WHEREAS, The Atascadero City Council has established committees, commissions
and boards to assist in the conduct of municipal affairs; and
WHEREAS, The Atascadero City Council did adopt Resolution No. 35-81 on
November 9, 1981 establishing selection procedures for committees, commissions and boards;
and
WHEREAS, The Atascadero City Council did adopt Resolution No. 23-95 revision
Resolution 35-81, establishing selection procedures for committees, commissions and boards;
and
WHEREAS: The Atascadero City Council did adopt Resolution 23-97 revising
Resolution 35-81, establishing selection procedures for committees, commissions and boards;
and
WHEREAS, The Atascadero City Council did adopt Resolution No. 2003-008 revising
Resolution No. 23-97, adopting revised procedures for the selection of committee, commission
and board members; and,
WHEREAS, The Atascadero City Council did adopt Resolution No. 2004-080 revising
Resolution No. 2003-008, adopting revised procedures for the selection of committee,
commission and board members; and,
WHEREAS„ The Atascadero City Council did adopt Resolution No. 2005-006 revising
Resolution No. 2004-080, adopting revised procedures for the selection of committee,
commission and board members; and,
WHEREAS, The Atascadero City Council desires to update and revise said selection
procedures; and
NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of
Atascadero as follows:
SECTION 1. Purpose. The purpose of this resolution is to revise established procedures
for the Council to follow in recruiting, selecting and appointing members to City committees,
commissions and boards created pursuant to statute or by action of the City Council.
Appointments and replacements will be made pursuant to the provisions of Government Code
Section 54970 et seq., and the following. The Council has ordained that appointments to the
Planning Commission and to the Parks and Recreation Commission are to be made as follows:

Each individual Council Member shall made appoint one member to the Planning Commission
and the Parks and Recreation Commission. For any other committees, commissions and boards
established the Council, the Council shall determine the composition of the committee,
commission or board.
SECTON 2. Recruitment Nomination, and Eligibility. Announcements of openings for
any committee, commission or board to which members are appointed by the Council will be
coordinated by the City Clerk. Any person desiring to be considered for appointment to any City
committee, commission or board may complete an application provided by the City Clerk.
Applications are accepted year-round and shall remain on file for a period of one year from the
date received. Applicants may be considered for future vacancies, for the specific committee,
commission or board for which they applied, should a vacancy occur during the year.
All applicants and nominees shall be a resident and registered voter of the City of
Atascadero, and shall meet any announced additional criteria as established by the City Council.
All appointees are subject to financial disclosure, pursuant to the Political Reform Act.
SECTION 3. Interviews. All applicant and nominees meeting the criteria established in
Section 2 may be interviewed by the City Council during a properly noticed meeting.
Interviews, if held, will be open to the public. An individual council member is not required to
interview candidates for individual appointments,but may do so if they wish.
SECTION 4. Effective Date. This Resolution shall be effective upon the adoption of
Ordinance No. reducing the size of the Commissions and establishing a procedure for the
appointment and removal of Planning Commissioners and Parks and Recreation Commissioners.
