Matters are considered by the Council in the order of the printed Agenda. Copies of the staff reports or other documentation relating to each item of business referred to on the Agenda are on file in the office of the City Clerk and are available for public inspection during City Hall business hours at the Central Receptionist counter and on our website, www.atascadero.org. An agenda packet is also available for public review at the Atascadero Library, 6850 Morro Road. Contracts, Resolutions and Ordinances will be allocated a number once they are approved by the City Council. The minutes of this meeting will reflect these numbers. COMMUNITY FORUM: Esteban Andrade led those present in prayer. Steve Martin, Atascadero Main Street Executive Director, expressed his appreciation for the development at the Sunken Gardens and spoke about holiday events downtown. Jim Katen thanked Council, staff and the contractor for the improvements to the Sunken Gardens and for having it ready for Colony Days. Joanne Main, Atascadero Chamber of Commerce Executive Director, spoke about the Women in Business group, a new program at the Chamber. Vivian Michelle, downtown property owner, spoke about the need for more lighting in the downtown. Maria Hooper spoke about downtown zoning, and of the need to rezone for successful revitalization and to compete with projects outside of the downtown. Steve Martin explained that the Main Street Economic Restructuring and Design Committees are analyzing the issue of first floor zoning and will make a recommendation to the Board as to whether the city should be asked for a reconsideration. There was Council consensus to bring back the issue of rezoning the downtown after Main Street makes a recommendation. Mayor Scalise closed the Community Forum period. PRESENTATION: 1. Certificate of Appreciation presentation to the California Conservation Corps (CCC). Mayor Scalise announced that this item would be postponed until members of the CCC could be present. A. CONSENT CALENDAR: 1. City Council Meeting Minutes —September 13, 2005 ■ City Clerk Recommendation: Council approve the City Council meeting minutes of September 13, 2005. [City Clerk] 2. Temporary Road Closure - Los Osos Road ■ Fiscal Impact: None. ■ Recommendation: Council approve a request from the Public Works Department for the temporary road closure of Los Osos Road for two weeks to complete a culvert replacement project. [Public Works] 4. Atascadero Corporation Yard Relocation Project — Rejection of All Bids (City Bid No. 2005-030) ■ Fiscal Impact: $1,000,000.00 budgeted in FY 2005-2007. ■ Recommendation: Council reject all bids for the Atascadero Corporation Yard Relocation project. Employee Salary Schedule and Modification to Labor Organization Agreements ■ Fiscal Impact: The costs for the proposal are contained within the Annual Operating Budget. ■ Recommendations: Council: 1. Approve modifications to labor agreements for Service Employees International Union, Local 620 (SEIU) and Mid-Management and Professional Employees; and, 2. Approve Addendum to City Manager Employment Agreement; and, 3. Approve the revised Salary Schedule, effective July 1, 2005. [City Manager] Items pulled: Eric Greening, Item #A-2. Item #A-2: Eric Greening asked that his comments at the bottom of Page 1 of the Minutes of September 27, 2005 be changed from "War Memorial" to read "Veteran's Memorial." MOTION: By Council Member Luna and seconded by Council Member Clay to approve Items #A-1, 2 as amended, 3, 4 and 5. Motion passed 5.0 by a roll-call vote. (Item #A-5 Contract Nos. 2005-038, 2005-039) B. MANAGEMENT: 1. Oak_Ridge Estates (3-F Meadows) Intersection State Route 41 and Los Altos Road Improvements ■ Fiscal Impact: None. ■ Recommendation: Council find that the proposed improvements for the intersection of State Route 41 (Morro Road) and Los Altos Road meet the requirements of the Atascadero Municipal Code. [Public Works] Public Works Director Steve Kahn gave the staff report and answered questions of Council. Christine Rogers, Castle Rock Development, stated they concur with the findings of Cal Trans and city staff. PUBLIC COMMENT Ursula Luna questioned if there will be vegetation removal connected with this plan and if so what mitigation would be required. CC Draft Minutes 10/25/05 Page 4 of 7 10 Mitch Paskin stated he lives near this project and expressed concern with the right turn lane. He suggested this item be carried over to the next meeting so the neighborhood can study the proposed improvements. Eric Greening questioned traffic routes and usage, and asked about drainage proposals to prevent runoff of oil from motor vehicles going directly into the wetland. Brian Mall stated he takes this turn every day and is concerned that just an increase of shoulder will not be adequate. He would like to see a better intersection design. Mitch Paskin explained that the population of Oak Ridge Estates is not a young one and as such will be an aging population that will need that right turn lane in the future. Eric Greening recommended a wider alternative analysis regarding signalizing the intersection. He was concerned with the developer putting the community on the hook for unanticipated environmental impacts. Mayor Scalise closed the Public Comment period. Christine Rogers addressed issues raised during the Public Comment period. Ms. Rogers answered questions of Council. There was Council discussion regarding the safety of the proposed improvements, environmental impacts, neighborhood notification and the need for a letter from Cal Trans confirming that this is as safe or safer than a right hand turn pocket. Council Member Clay stated the loading lane should be included regardless of how Cal Trans responds. MOTION: By Council Member Luna and seconded by Mayor Scalise to contact Cal Trans to determine if they can come up with a compromise alternative or reassure the city that this is a safe alternative. Motion passed 4:1 by a roll-call vote. (Clay opposed) 2. Atascadero Short Ranae Transit Plan ■ Fiscal Impact: None. However, if farebox recovery ratio does not rise to 20% within the next two years, state and federal funding will be in jeopardy. ■ Recommendation: Council receive an update on the Atascadero Short Range Transit Plan, adopt public transportation service goals, review concepts for public outreach and direct staff to move forward with public input as outlined. [Public Works] CC Draft Minutes 10/25/05 Page 5 of 7 Assistant City Manager Jim Lewis gave the staff report and Public Works Director Steve Kahn spoke about pubic outreach for this plan; both answered questions of Council PUBLIC COMMENT Eric Greening spoke in favor of retaining Route 9 local stops and suggested it would be better to schedule city local stops 1/2 hour apart from the Route 9 local stops to reduce service redundancy. Mayor Scalise closed the Public Comment period. MOTION: By Mayor Pro Tem O'Malley and seconded by Council Member Luna to receive the update on the Atascadero Short Range Transit Plan, adopt public transportation service goals, review concepts for public outreach and direct staff to move forward with public input as outlined. Motion passed 5:0 by a roll-call vote. C. COMMITTEE & LIAISON REPORTS: Council Member Pacas 1. City / Schools Committee: The Superintendent hopes to reopen the high school pool this summer. The Superintendent also suggested that the school might be interested in a joint project with the City which would entail applying for funds together, the school providing property and the city providing maintenance and upkeep. D. INDIVIDUAL DETERMINATION AND/OR ACTION: City Attorney City Attorney Patrick Enright discussed the adult business ordinance he has prepared, reported on the Dorsey hearing, and asked Council to contact him if they have questions regarding the work list and city attorney's report he has provided. City Manager City Manager Wade McKinney reported on the joint Parks and Recreation Commission / Planning Commission / City Council meeting proposed for November 291h, the annual Strategic Planning session scheduled for January 27th and 28th , the League Leadership Conference in Sacramento from January 11 th to the 13th, and the free trash day in Atascadero on October 29th CC Draft Minutes 10/25/05 Page 6 of 7 12 E. DISCUSSION: Tentative Tract Map 2004-0054 / Tract 2640 was approved by the City Council on September 28, 2004. The subdivision approved the creation of twenty-six single family residential lots. Pursuant to California Government Code Section 66440 the approving legislative body (City Council) cannot deny a final map that is consistent with an approved tentative map. The legislative body is also required to accept, accept subject to improvement, or reject on behalf of the public, any real property offered for dedication for public use in conformity with the terms of the offer of dedication. Staff recommends rejecting the offers of dedication for streets, open space recreation easements, public drainage easements, and public utility easements without prejudice to future acceptance. Staff also recommends accepting the offer of dedication for Public Access Easement, to allow legal access to adjoining properties. DISCUSSION: On Friday, December 2, 2005, City staff is proposing the closure of East Mall and West Mall (from EI Camino Real to Lewis Avenue) and Palma Avenue (from East Mall to Entrada) to conduct scheduled events. The three events, which will be coordinated by the Atascadero Main Street Association and the City of Atascadero's Community Services, Police and Public Works Departments', include the Sunken Gardens Park Dedication, the Annual Holiday Lighting Ceremony and Winter Wonderland. This year's events will be located in and around the Sunken Gardens Park, requiring the closure of three streets: East Mall, West Mall and Palma Ave. The times that the individual street closures are proposed to occur are: • East Mall from Palma Ave. to Lewis Ave. - 1:00 p.m. to 11:00 p.m. • East Mall from EI Camino Real to Palma Ave. - 3:30 p.m. to 11:00 p.m.. • Palma from East Mall to Entrada - 3:30 p.m. to 11:00 p.m. • West Mall from EI Camino Real to Lewis Ave. - 3:30 p.m. to 11:00 p.m. FISCAL IMPACT: None. This is a non-profit event co-sponsored by the Atascadero Main Street Association and the City of Atascadero, a governmental agency. The event will cover Sits direct costs and a large portion of its indirect costs. The event provides economic benefits to many Atascadero businesses. DISCUSSION: On Saturday, December 3 2005 City staff is proposing the closure of Marchant Avenue (from Pismo Street to Santa Rosa Road) and Lakeview drive (from Santa Rosa to Portola Road) from 5:00 p.m. until 11:00 p.m. to conduct the annual "Holiday Musical Walk Around the Lake". The annual Holiday Musical Walk Around the Lake includes performers intheLake Pavilion, activities in the park, as well as festivities at various residences and locations around the Atascadero Lake. The event will be sponsored and conducted by the Lake Neighbors Association and coordinated, in part, by the City of Atascadero's Community Services and Public Works Departments. FISCAL IMPACT: None. DISCUSSION: Background: This agenda item is continued from the October 25t" City Council Meeting. At this meeting, the staff report was given, public testimony was heard and the Council discussed the item. The Council and public expressed concern that the widened shoulder for right hand turns, in place of a right hand turn pocket, would not be adequate for future increased traffic volumes. The Council requested that Caltrans attend a future meeting to discuss this. Caltrans will attend this meeting to discuss the issues and answer questions. Analysis: Oak Ridge Estates (also known as 3-F Meadows) is a 111 lot planned development on the west side of Atascadero. The public improvements and homes for Phase 1 are under construction. The developer, Castlerock Development, has also begun the work on construction documents for Phases 2 thru 4. The conditions for development for this project are listed in the Atascadero Municipal Code section 9-3.656 "Establishment of Planned Development Overlay Zone No. 11: (PD 11)". One of the conditions requires the construction of improvements at the intersection of State Route 41 and Los Altos Road. The improvements consist of a left turn lane, a right turn lane, a vehicle refuge lane, signage and sight distance requirements. The conditions are listed in section 9-3.656 (c) (3) (v) thru (ix). These improvements were required based on comments by Caltrans to the 3-F Meadows Environmental Impact Report (See Attachment "A"). 24 ITEM NUMBER: B 1 DATE: 11/22/05 The project Civil Engineer, R. Thompson Consulting, has begun the design of the improvements to this intersection. Padre Associates has produced a Natural Environmental Study (NES) for the area affected by the construction. The NES has found that the construction of a right turn lane will have environmental impacts to the south east corner of the intersection. The impacts are caused by the relocation of a creek, removal of vegetation and loss of wetlands. (See Attachment B) The specific impacts, according the NES, are: • Loss of mixed willow series, a community of special concern • Removal of 3 coast live oak trees and substantial encroachment on 4 coast live oak trees • Possible take of birds protected under the Migratory Bird Treaty Act, as a result of construction activities • Temporary fill and permanent fill in waters of the U.S. • Temporary fill and permanent fill in jurisdictional wetlands • impacts to CDFG defined wetlands The project Civil Engineer and environmental consultant looked for ways to reduce the environmental impacts of the improvements, while complying with the conditions of development listed in PD-11. They found that if they reduced the right turn lane into a widened shoulder for right hand turns that the impacts were substantially reduced, as follows (See Attachment C): • Avoid the loss of mixed willow series, a community of special concern • Reduce possible take of birds protected under the Migratory Bird Treaty Act, as a result of construction activities • Reduce temporary fill and permanent fill in waters of the U.S. • Avoid impacts to jurisdictional wetlands The project Civil Engineer forwarded the two plans to Caltrans for their review and comment. Caltrans responded as follows: "Although we initially indicated that a right turn channelization was desired, upon further evaluation we have determined that reconstructing the intersection to conform to the standard public road approach intersection, as shown in figure 405.2 of the Caltrans Highway Design Manual, will serve the traffic needs of this intersection while minimizing impacts to the creek." (See Attachment D). The developer of Oak Ridge Estates, Castlerock Development, Has requested that the improvement be constructed with a widened shoulder for right hand turns. Staff is looking for Council determination that the widened shoulder for right hand turns will meet the intent of PD-11. Following is the text from the Atascadero Municipal Code concerning the right hand turn requirement. 25 ITEM NUMBER: B - 1 DATE: 11/22/05 (ix) Designated right-turn lanes shall be constructed on State Highway 41 for westbound traffic entering both Los Altos Road and the driveway serving Lots 109-112. Improvement plans for the right-turn lanes shall be submitted,for review and approval by Caltrans and the City Engineer prior to approval of the Master Development Plan. The right-turn lane for Los Altos Road shall be constructed when the ADT on Los Altos Road reaches five hundred (500) vehicles per day, with the development of the twenty- seventh lot in Phase 1, or within three (3) years of the issuance of building permits for Phase 1, whichever is earlier. Conclusion: Staff has visited the site, discussed the issue with Caltrans and recommends the project be built with a widened shoulder for right hand turns. The original Caltrans recommendation was made without the benefit of a field review, detailed site design or Natural Environmental Study (See Attachment E). ALTERNATIVES: 1. Do not find proposed improvements for the intersection of State Route 41 (Morro Road) and Los Altos Road meet the intent of the requirements of the Atascadero Municipal Code. The developer would be required to construct the improvements with a right hand turn pocket. This would have increased environmental impacts. 2. Continue the item for more information or revised project design.
