ROLL CALL Present: Councilmembers Borgeson, Handshy, Molina, Norris and Mayor Mackey Absent: None ' STAFF Mike Shelton, City Manager ; David Jorgensen, Administrative Services Director;*ffeffrey Jorgensen;-e-ity-Attert;ey; Paul Sensibaugh, Public Works Director ; Boyd Sharitz, City Clerk; Charles Bourbeau, City Treasurer; Cindy Wilkins, Deputy City Clerk; John Wallace and Gary Simms, Wallace & Associates, (Consulting Engineers) ; Cathy Williams, Security Pacific Capital Markets Group (Bond Underwriters) ; Antonia Dolar , Orrick, Herrington & Sutcliffe (Bond Counsel) 1. Proposed Resolution 134-86 - Approval of Unpaid Assessment List, Authorizing Issuance of Bonds, Approval of Official Statement and Approval of Bond Purchase Contract 2. Proposed Resolution 135-86 - Amending Resolution 117-86 - Awarding Construction Contract to Beaver Construction for Sewer Assessment District Number 4 3. Proposed Resolution 136-86 - Amending Resolution of Intention & Eliminating City from Obligation to Pay Delinquent Assessments if Reserve Funds Become Depleted Antonia Dolar, Orrick, Herrington & Sutcliffe (OH & S) , reviewed the formation of Assessment District No. 4 and summarized the proposed actions before the City Council tonight, noting changes and insertions to the proposed (draft) Res. No. 134-86. Discussion with Council & staff ensued. Councilman Molina expressed concern with regard to former City Attor- ney, Robert Jones, being the attorney of record in this agreement. Mr. Shelton, City Manager, clarified that Mr. Jones has agreed to act as attorney of record, subsequent to discussion with current City Attorney, Jeffrey Jorgensen, noting both concurred it is not appropri- ate for Mr. Jorgensen to be attorney of record because of a possible conflict of interest on his part, and because of Mr. Jones' s involve- ment__in__the formation _of _this-district. _ Councilman Molina- requested * Correction noted by Mr. Jorgensen at meeting of 1/12/87. 1 documentation on this issue. Discussion ensued regarding Mr . Jones' s further potential involvement in these district proceedings. Ms. Dolar responded to question from resident Doug Lewis (in audience) regarding payment obligations of property owners. MOTION: By Councilwoman Borgeson to approve Res. No. 134-86, seconded by Mayor Mackey; passed 4:1, with Councilwoman Norris op- posed. Ms. Dolar reviewed proposed Res. No. 135-86, noting (2) corrections, and responded to questions from Council. MOTION: By Councilman Molina to adopt Res. No. 135-86, with changes as noted, seconded by Councilwoman Borgeson; passed 4 :1, with Councilwoman Norris opposed. Ms. Dolar reviewed proposed Res. No. 136-86 and responded to questions from Council. MOTION: By Councilwoman Borgeson to approve Res. No. 136-86 , seconded by Councilman Molina; passed 4:1, with Councilwoman Norris opposed. Cathy Williams of Security Pacific Capital Markets Group commented on the bond interest rates. Mike Shelton, City Manager , summarized this project and thanked all staff who worked on it. Councilman Molina suggested Council issue certificates of appreciation (at the Council' s 1/12/87 meeting) to the Atascadero High Greyhounds Football Team players and coaches for their recent CIF championship.
