DRAFT MINUTES: Council meeting draft minutes are listed on the Consent Calendar for approval of the minutes. Should anyone wish to request an amendment to draft minutes, the item will be removed from the Consent Calendar and their suggestion will be considered by the City Council. If anyone desires to express their opinion concerning issues included in draft minutes, they should share their opinion during the Community Forum portion of the meeting.) 1. City Council Draft Action Minutes – January 12, 2016  Recommendation: Council approve the City Council Draft Action Minutes of the January 12, 2016 City Council meeting. [City Clerk] 2. City Council Draft Action Minutes – January 19, 2016  Recommendation: Council approve the City Council Draft Action Minutes of the January 19, 2016 City Council special meeting. [City Clerk] 3. December 2015 Accounts Payable and Payroll  Fiscal Impact: $ 1,950,009.59  Recommendation: Council approve certified accounts payable, payroll and payroll vendor checks for December 2015. [Administrative Services] 4. PLN 3099-0829 - Carrizo Road Tract 2625 Project Redesign and Amendments - 5310 Carrizo Road (5310 Carrizo LLC / Eddings)  Fiscal Impact: A standard condition of approval has been included requiring emergency services and facility maintenance costs to be 100% funded by the project by annexing into the City’s Community Facilities District. The proposed Annexation into the CFD will occur in February and April of this year.  Recommendation: Council adopt on second reading, by title only, Draft Ordinance A approving amendments to Zone Change 2004 -0078 / Zone Change 2004-0078 that includes a zoning mapping change from RSF-X / PD-17 (Residential Single-Family with Planned Development Overlay #17) to RSF-X / PD-32 (Residential Single-Family with Planning Development Overlay #32) on APN 049-105-001 through 012. [Community Development] 5. Combination Vacuum/Hydro-Jetting Sewer Cleaning Truck Purchase  Fiscal Impact: The purchase of the Combination Vacuum/Hydro-Jetting Sewer Cleaning Truck will result in the expenditure of $384,824.52 in budgeted wastewater funds. These funds were authorized in the 2015/2016 fiscal budget.  Recommendation: Council authorize the purchase of a Combination Vacuum/Hydro-Jetting Sewer Cleaning Truck from Atlantic Machinery, Inc. for $384,824.52. [Public Works] 6. CalRecycle Funding Application and Signature Authorization  Fiscal Impact: Funding will continue to be managed by IWMA with no fiscal impact to the City of Atascadero.  Recommendation: Council adopt Draft Resolution A authorizing the City of Atascadero to submit an application to CalRecycle for any and all payment programs and authorizing the City Manager or his/her designee, as Signature Authority, to execute all documents necessary to imp lement and secure payment. [Public Works] 7. Atascadero Tourism Business Improvement District (ATBID) Board Appointment of Board Member to Fill Vacancy  Fiscal Impact: None.  Recommendation: The ATBID Board recommends: Council appoint Lindsey Ridgeway to fill the vacant ATBID Board term to expire June 30, 2017. [City Manager] UPDATES FROM THE CITY MANAGER: (The City Manager will give an oral report on any current issues of concern to the City Council.) COMMUNITY FORUM: (This portion of the meeting is reserved for persons wanting to address the Council on any matter not on this agenda and over which the Council has jurisdiction. PUBLIC HEARINGS: None C. MANAGEMENT REPORTS: 1. Reimbursement Agreement – Santa Rosa Interchange Signals (Establishment of Reimbursement Fee / Approval of Reimbursement Agreement)  Fiscal Impact: The Mitigation Fee Act allows for the City to collect 2% of the reimbursement fee amount to cover administrative costs. This fee will be deducted for all fees collected pursuant to the reimbursement agreement.  Recommendations: 1. Council authorize the City Manager to execute a Reimbursement Agreement for traffic signal improvements located at the Santa Rosa / US 101 interchange; and, 2. Council adopt Draft Resolution A establishing a reimbursement fee, in accordance with the Mitigation Fee Act, for the installation of signals and associated public improvements at the Santa Rosa / US 101 interchange. [Public Works] 2. Timeline to Consider Amendments to AMC 9-6.186, to Allow Limited Personal Medical Marijuana Cultivation  Fiscal Impact: Any potential ordinance amendment may impact staff resources, however it represents a continuation of existing enforcement policies regarding medical marijuana facilities, so there would be no change in the fiscal impact for the City.  Recommendation: City Council provide direction to staff regarding the process to follow for potential revisions to the medical marijuana ordinance. [City Manager] 3. Public Relations and Marketing Services For Atascadero Tourism Business Improvement District (ATBID)  Fiscal Impact: $160,000 from the ATBID budget for Public Relations and Marketing Services.  Recommendations: The Atascadero Tourism Business Improvement District (ATBID) Advisory Board recommends: 1. Council authorize the City Manager to amend the contract with Verdin for ATBID Public Relations and Marketing Services through June 30, 2017 at an amount not to exceed $160,000 for the period March 2016 through June 30, 2017. AND Staff recommends: 2. Council authorize the City Manager to execute future amendment(s) to the contract with Verdin for ATBID Public Relations and Marketing Services extending the term and amounts if recommended by the ATBID Advisory Board prior to expiration of the contract. Matters are considered by the Council in the order of the printed Agenda. Regular Council meetings are televised live, audio recorded and videotaped for future playback. Charter Communication customers may view the meetings on Charter Cable Channel 20 or via the City’s website at www.atascadero.org. Meetings are also broadcast on radio station KPRL AM 1230. [Administrative Services] Mayor O’Malley pulled Item #A-1 for clarification. Item #A-1: City Clerk Torgerson explained that the minutes for the Item B-1 for the December 8, 2015 Council meeting shows how the motion was stated. However, after discussion with the City Manager and City Attorney, she felt that the Council’s intention was not clear. She asked for clarification from the Council. Fiscal Year 2015 Annual Road Report  Fiscal Impact: Distribution of the 2015 Community Road Report is estimated to cost approximately $3,500 in budgeted General Funds.  Recommendations: The Citizens’ Sales Tax Oversight Committee recommends Council: 1. Approve the Fiscal Year 2015 Annual Road Report; and, 2. Approve the Fiscal Year 2015 Community Road Report. INDIVIDUAL DETERMINATION AND / OR ACTION: City Council Mayor O’Malley stated that a few Council Members have asked him to request clarification from staff about the need for a Special Joint meeting with the Planning Commission next week on Eagle Ranch when the EIR is not ready for review. There was Council discussion on this issue as to the pros and cons of holding the meeting without the Draft EIR available for review. MOTION: By Council Member Kelley and seconded by Council Member Sturtevant to cancel the Joint Meeting of the Planning Commission and the City Council scheduled for January 19, 2016 at 6:00 p.m. regarding Eagle Ranch. Ordinance Repealing Chapter 5-13 Regarding Medical Marijuana Facilities and Adding Section 9-6.186 to Title 9 of the Atascadero Municipal Code Prohibiting Marijuana Cultivation Facilities, Marijuana Dispensaries, Commercial Cannabis Activities, and Medical Marijuana Deliveries  Ex-Parte Communications:  Fiscal Impact: None  Recommendation: ITEM NUMBER: A-2 DATE: 02/09/16 Atascadero City Council January 19, 2016 Page 2 of 2 The Planning Commission recommends: Council introduce for first reading, by title only, the Draft Ordinance repealing Municipal Code 5-13 regarding Medical Marijuana Facilities and adding Section 9-6.186 to Title 9 of the Municipal Code prohibiting marijuana cultivation facilities, marijuana dispensaries, commercial cannabis activities and medical marijuana deliveries. [Community Development] Community Development Director Phil Dunsmore gave the staff report and answered questions from the Council. Mayor O’Malley stated he wanted to take a detour on the agenda, and have the City Clerk, who recently retired from her full-time Deputy City Manager position, introduce her replacement and explain how the duties will be coordinat ed. City Clerk Torgerson stated that Lara Christensen has been hired to replace her as Deputy City Manager - Assistant City Clerk, and as City Clerk she will be responsible for the Council’s records, elections, FPPC filings, etc. Ms. Christensen will be ma naging the day to day operations of the City Clerk, along with her Deputy City Manager duties. PUBLIC COMMENT: The following citizens spoke on this item: Debra Macrell, Charles Doster, Lacey Fortman, Kim Porter, and Margaret Day Spring. Mayor O’Malley closed the Public Comment period. MOTION: By Council Member Kelley and seconded by Council Member Sturtevant to introduce for first reading, by title only, the Draft Ordinance repealing Municipal Code 5-13 regarding Medical Marijuana Facilities and adding Section 9-6.186 to Title 9 of the Municipal Code prohibiting marijuana cultivation facilities, marijuana dispensaries, commercial cannabis activities and medical marijuana deliveries. DISCUSSION: The proposed project consists of replacing an existing Planned Development Overlay Zone at 5310 Carrizo Road (APN 049-105-001) with a new project specific Planned Development Overlay Zone (PD-32) for consistency with approved master plan of development. On January 26, 2016, the City Council conducted a public hearing to consider an application for the amendments to the planned development overlay zone. At that meeting the Council voted 5-0 to introduce the zone change for first reading. As part of the discussion, the Council suggested staff work with the applicant team to determine the historic significance of the residence on lot 1 and to allow the residence to be demolished and a new house to be constructed on the site if it is determined that the house does not meet significance criteria. Staff is currently working with the applicant team on this issue. If it is determined the house does not qualify for listing as a historic resource, than the ordinance will have to be amended to remove the historic overlay zone that is currently noted in the ordinance for lot 1. ITEM NUMBER: A-4 DATE: 02/09/16 FISCAL IMPACT: Based on findings from the Taussig Study, revenue from new residential development, including property tax revenues, vehicle licensing fees, sales taxes, and other revenues , is insufficient to cover the maintenance and emergency services costs of new development. Based on the revenue projections from the Taussig Study, the City has developed standard conditions of approval for new development projects that require the cost of maintenance and emergency services to be funded by the project. A standard condition of approval has been included requiring emergency services and facility maintenance costs to be 100% funded by the project by annexing into the City’s Community Facilities District. ITEM NUMBER: A-5 DATE: 02/09/16 Atascadero City Council Staff Report – Public Works Department Combination Vacuum/Hydro-Jetting Sewer Cleaning Truck Purchase RECOMMENDATION: Council authorize the purchase of a Combination Vacuum/Hydro-Jetting Sewer Cleaning Truck from Atlantic Machinery, Inc. for $384,824.52. DISCUSSION: Combination Vacuum/Hydro-Jetting Sewer Cleaning trucks (sewer cleaning trucks) are a fundamental maintenance tool used in wastewater operations. They facilitate routine and preventative maintenance of the wastewater collection system’s infrastructure, such as removing sewer main blockages and debris from lift station wet wells. This maintenance plays a crucial part in mitigating pump failures and overflows. As part of the budget process, staff analyzed th e cost-effectiveness of purchasing a sewer cleaning truck as opposed to continuing to contract for this service. Annually, the City spends approximately $40,000 on contracted services for sewer maintenance. In addition to eliminating this annual cost from the budget, the truck will also facilitate faster response times to wastewater emergencies whereby reducing the potential for ground contamination and expensive related cleanup costs. Staff researched different sewer cleaning truck makes and models, in addition to contacting other local agencies for firsthand feedback. It was determined that the Vac- Con Combination Sewer Cleaning Truck has the best service support, reliability, and features needed to maintain Atascadero’s wastewater infrastructure. On January 15, 2016, the City received a contract through National Joint Powers Alliance for the combination vacuum/hydro -jetting sewer cleaning equipment. The contract is under the 2015/2016 budgeted $385,000.00 amount and complies with the City purchasing policy, entitled Section II – General Supplies, Materials and Equipment. ITEM NUMBER: A-5 DATE: 02/09/16 Summary: Complete Unit Price F.O.B. Atascadero, CA $356,319.00 8.0% Sales Tax 28,505.52 Total $384,824.52 FISCAL IMPACT: The purchase of the Combination Vacuum/Hydro-Jetting Sewer Cleaning Truck will result in the expenditure of $384,824.52 in budgeted wastewater funds. ITEM NUMBER: A-5 DATE: 02/09/16 ATTACHMENT: 1 ITEM NUMBER: A-6 DATE: 02/09/16 Atascadero City Council Staff Report - Public Works Department CalRecycle Funding Application and Signature Authorization RECOMMENDATION: Council adopt Draft Resolution A authorizing the City of Atascadero to submit an application to CalRecycle for any and all payment programs and authorizing the City Manager or his/her designee, as Signature Authority, to execute all documents necessary to implement and secure payment. DISCUSSION: In 1988, California enacted a program to place a deposit on b everage containers. The deposit is currently five cents for small beverage containers and 10 cents for large beverage containers. CalRecycle is responsible for this state program. CalRecycle each year provides funding to jurisdictions to enhance the beverage container program. In San Luis Obispo County, the funding ranges from a minimum of $5,000 for small cities to $12,000 for the largest city. For the last 13 years, the San Luis Obispo County Integrated Waste Management Authority (IWMA) has worke d with Member Jurisdictions to apply for the funding. The IWMA has used the funding for projects such as providing technical assistance and recycling bins to businesses to start or expand their recycling. The IWMA has also provided CalRecycle with the required program and financial reporting. Effective this year, CalRecycle is now requiring each jurisdiction to adopt a resolution that must be submitted as part of the application package. Without a resolution, it will not be possible to apply for the funding from CalRecycle. Pierik, City Attorney ITEM NUMBER: A-7 DATE: 02/09/16 Atascadero City Council Staff Report – City Manager’s Office Atascadero Tourism Business Improvement District (ATBID) Board Appointment of Board Member to Fill Vacancy RECOMMENDATION: The ATBID Board recommends: Council appoint Lindsey Ridgeway to fill the vacant ATBID Board term to expire June 30, 2017. DISCUSSION: In 2013, the lodging businesses in Atascadero requested the Council establish a Tourism Business Improvement District (TBID) in order to levy annual assessments that would fund tourism promotions and marketing programs to promote the City as a tourism destination. The City Council did establish the Atascadero Tourism Business Improvement District (ATBID), appointed board members, and the assessments began June 1, 2013. When the initial Advisory Board was appointed, it was comprised of three members serving three-year terms, and two members serving two-year terms. In June 2015, the Council, based on the recommendation of the lodging representatives, appointed Michael Wambolt from the SpringHill Marriott to one of the two vacant two- year positions. In September 2015, Mr. Wambolt resigned from the ATBID as he left his position with SpringHill Marriott causing a vacancy on the Board. The Atascadero Municipal Code § 3-16.07 (b) states that membership on the ATBID Board is limited to lodging business owners or other representatives named in writing as an empowered designee by a lodging business owner within the ATBID area. To sponsor a member on the ATBID Advisory Board, each lodging business must have fully paid its ATBID assessment at the time of appointment, and remain fully paid during the term of that representative’s membership on the Board. In order to fill the vacant board position, the nomination process for ATBID board members was followed. A letter was mailed out to each lodging business on January ITEM NUMBER: A-7 DATE: 02/09/16 11, 2016, notifying them of a lodging representative meeting for the purpose of making nominations for the vacant ATBID Board seat. At that meeting, held on January 19, 2016, lodging representatives nominated an eligible candidate and a written ballot election was held to determine the nominee to be recommended to the City Council. The lodging owners recommend Lindsey Ridgeway from SpringHill Suites by Marriott to fill the vacant ATBID Board term to expire on June 30, 2017. FISCAL IMPACT: None ALTERNATIVES: The Council may decide to not proceed with approval of Lindsey Ridgeway to the Atascadero TBID Advisory Board and refer it back to the lodging owners for an alternate recommendation. Council authorize the City Manager to execute a Reimbursement Agreement for traffic signal improvements located at the Santa Rosa / US 101 interchange; and, 2. Council adopt Draft Resolution A establishing a reimbursement fee, in accordance with the Mitigation Fee Act, for the installation of signals and associated public improvements at the Santa Rosa / US 101 interchange. DISCUSSION: Background: The City Council approved the West Front Village project in September 2005 , with construction beginning in 2006. A traffic analysis for the project, completed in May 2005 by Omni-Means during the environmental review process, concluded that project traffic would trigger the need for improvements at the Santa Rosa / US 101 overpass consisting of signal installation, geometric improvements, and synchronization at both the northbound (East Front Road) and southbound (West Front Road) ramps . The City’s impact fee study identified full interchange reconstruction and replacement at the Santa Rosa / US 101 overpass, and therefore, the signal installation was considered to be an interim improvement and was not covered by City impact fees. Because the West Front Village project required that the signals be in place to mitigate project impacts at the time of project construction, the project developer const ructed signals at both the southbound and northbound on -ramps and completed all required intersection modifications associated with the signal installation. The project was conditioned to allow the developer to apply for reimbursement of a portion of the c osts associated with the signal installation that exceeded direct project impacts through a reimbursement agreement, but set no specific timetable for that to occur . ITEM NUMBER: C-1 DATE: 02/09/16 Analysis: Reimbursement agreements are commonly used when a parcel constructs “oversized” public improvements that provide more benefit than what is needed for that parcel. In order to be reimbursed, there needs to exist other unimproved or underutilized parcels that will benefit from the oversized public improvement. A common example is a sewer reimbursement district where the sanitary sewer trunk main is extended to service a new dwelling by the dwelling owner, and future dwellings that connect to that segment of extended sewer pay a benefitted share of the sewer extension cost back to t he dwelling owner who constructed the sewer extension. The City enters into an agreement with the developer who constructs the oversized public improvements and collects the reimbursement fee from future developments who benefitted from the oversized public improvements. Once collected, the City sends the collected reimbursement fee to the original developer and collects a 2% administrative fee. Reimbursement agreements have set terms, typically between 10 and 20 years, after which the reimbursement fee no longer applies to the benefitted undeveloped parcels. In order to establish a reimbursement agreement, the developer must provide : (1) a full accounting of the actual construction costs of the public improvements ; (2) submit a traffic analysis detailing the Area of Benefit; and (3) justification for application of the fee to under-developed parcels within the defined Area of Benefit. Accounting of Reimbursable Costs: The applicant has submitted receipts and invoices totaling $491,483.71 related to work to design and construct the signals and associated improvements . These reimbursable project costs have been reviewed by city staff. Determination of Area of Benefit: A supplemental traffic analysis was required by the City and prepared by Associated Traffic Engineers (ATE) to determine the Area of Benefit. ATE established an Area of Benefit based on a methodology which looked at the shortest distance traveled to determine which development areas would utilize the interchange. ATE’s Area of Benefit memo, dated December 21, 2015, details the methodology used to develop the Area of Benefit, and is attached for reference (Attachment 1). Justification for Application of Fee: After determining the Area of Benefit, ATE completed a n analysis to determine total trip generation potential for all vacant and under-utilized parcels within the defined boundaries. Land uses within this area include commercial, single -family, and multi- family parcels. Community Development staff determined the development potential of each vacant and under-utilized parcel within the Area of Benefit, and ATE assigned standard Institute of Transportation Engineers (ITE) trip generation rates to each undeveloped and underutilized parcel based upon development type, including West Front Village parcels (TAZ #3). ATE’s Trip Generation Worksheet is attached for ITEM NUMBER: C-1 DATE: 02/09/16 reference (Attachment 2) and includes Average Daily Trips (ADT) and P.M. Peak Hour trips. West Front Village Benefitted Costs: The ATE Trip Generation Worksheet determined the percentage of project costs attributable to the West Front Village project as described below. The worksheet and methodology was reviewed by Public Works staff . Recommendations are as follows: 1. Total project trips generated during the P.M. Peak Hour was adjusted from 285 trips (2005 Omni-Means study) to 211 trips (ATE Trip Generation Worksheet). This revised trip number reflects the actual final land uses for West Front Village and is a more accurate representation of the final project traffic impacts at the two intersections. 2. Total traffic increases used to determine project impact percentage at the two intersections will remain as calculated in the Omni-Means study (subtracting the reduced project trips). City staff has determined that the Omni -Means study more closely reflects local traffic patterns, since it is a City-wide model. This analysis is based upon the Caltrans Guide for Preparation of Traffic Impact Studies, Appendix B, “Methodology for Calculating Equitable Mitigation Measures”. This approach results in the following costs attributable to the West Front Village project: a. Santa Rosa Road / Southbound US 101 Ramps: 36.3% b. Santa Rosa Road / Northbound US 101 Ramps: 25.3% c. Combined / Full Signalization project: 30.9% ($151,868.47) Future Development Benefitted Costs: The remainder of project costs not attributable to the West Front Village project ($339,615.24) and attributable to serving future development should be split amongst vacant and under-utilized parcels within the identified Area of Benefit. The fee applies to all permits within the Area of Benefit issued on or after the agreement date and finaled after the fee effective date. This includes projects for which entitlements have been granted, but for which the building permit falls under the parameters above. All current developments for which permits have already bee n issued or completed are exempt. ATE’s Trip Generation and Fee Calculation memo, dated January 29, 2016, details the methodology used to develop the fees, and is attached for reference (Attachment 3). Essentially, fees are charged depending upon the expected traffic to be generated during the P.M. Peak Hour as a result of the development type. For land uses which generate higher volumes of vehicular traffic, a higher percentage of the reimbursable project costs have been assigned, and are factored using Dwelling Unit Equivalents (DUE). The resulting reimbursement fees were determined to be as follows based upon a total of 629 P.M. The term of the agreement is 15 years from the effective date of increased fees, which begins 60 days from the date of resolution adoption. Conclusion: The conditions of approval for the West Front Village allows for its developer to request a reimbursement agreement for the oversized public improvements associated with the traffic signals constructed at the intersections of Santa Rosa Road with West Front Road and East Front Road. West Front Village, LLC has been working with the Public Works and Community Development departments for a number of years to get the reimbursement agreement worked out. City staff have reviewed the methodology and determination of the reimbursable fee schedule and applicable properties and recommend its approval. ALTERNATIVES: The City Council may decide to not authorize the City Manager to sign the Reimbursement Agreement and refer the item back to staff and the applicant for additional analysis. FISCAL IMPACT: The Mitigation Fee Act allows for the City to collect 2% of the reimbursement fee amount to cover administrative costs. Summary The final reimbursement cost for the improvements at the U.S. 101/Santa Rosa Road interchange was determined to be $339,615.24. The traffic impact fee was calculated by dividing the total costs of the transportation improvements by the 629 peak hour trips that are projected to be generated by new developments within the Area of Benefit. The calculation results in a fee rate of $539.93 per peak hour trip. The $539.93 per peak hour trip rate was then converted to standard development measures (e.g. per dwelling unit, per 1,000 SF on commercial, etc.) using trip rate data contained in the ITE Trip Generation manual. Background The traffic impact fee is calculated simply by dividing the total cost for the improvements by the total new trips forecast for the new developments within the Area of Benefit. The final reimbursement cost for the improvements at the U.S. 101/Santa Rosa Road interchange was determined to be $339,615.24. The cost per trip were calculated by determining the trip generation potential for the future developments. Trip generation forecasts for the future development of vacant and under-utilized parcels within the Area of Benefit were calculated using rates contained in the current version of the Institute of Transportation Engineers (ITE) Trip Generation manual.1 The trip generation estimates determine 1 Trip Generation, Institute of Transportation Engineers, 9th Edition, 2012. In this case, DUEs per fueling position for gas stations and DUEs per guest room for hotels are also used. Developer has developed certain property within the boundaries of the City, commonly referred to as West Front Village located at the intersection of West Front Road and Portola Road (the “Property”) with a mixed use development pursuant approving General Plan Amendment Resolution No, 2003-0005, Zoning Change Resolution No. 2003-0088, Conditional Use Permit Resolution No. 2003-0108 and Tract Map 2621 Resolution No. 2005-089 (collectively, the “Project”); and 2. Condition of Approval No. 24 of Resolution No. 2005-089 provides: “The project applicant may apply for a reimbursement map for off-site circulation improvements made to the Santa Rosa/US 101 interchange and frontage roads. The amount of reimbursement credit based on actual construction costs subject to the review and approval of the Public Works Director and Administrative Services Director. The reimbursement area and reimbursement amounts shall be determined by an additional traffic study that demonstrates a nexus for all parcels included in the reimbursement area.” 3. Developer has recorded a final map for the Project, completed construction of the offsite circulation improvements to the Santa Rosa/US 101 interchange and frontage roads referred to in Condition of Approval No. 24 (the “Circulation Improvements”), and dedicated them to the City. 4. The Circulation Improvements will benefit adjacent landowners as shown in Exhibit A hereto (the “Area of Benefit,” and each property a “Benefited Property”), as provided in the rules and regulations of the City. 5. A description of the Circulation Improvements is attached hereto as Exhibit B. 6. The Developer’s cost descriptions in construction of the Circulation Improvements are described on Exhibit C hereto (“Costs”) 7. The City will reimburse Developer for part of Developer’s costs in constructing the Circulation Improvements from adjacent landowners as herein provided. The total reimbursement to the Developer shall not exceed $316,108.24, which represents total ITEM NUMBER: C-1 DATE: 02/09/16 ATTACHMENT: 4 project expenses less Developer Benefit (see Attachment C), Administrative Fee (as defined below), and the encroachment permit fee (as described below). NOW, THEREFORE, in consideration of the mutual conveyance contained herein, Developer and City Agree as follows: 1. Term The term of this agreement shall be for 15 years from the effective date it is approved by the City Council of City. 2. Rate of Reimbursement During the term of this Agreement, the City will reimburse Developer for its costs in constructing the public interchange improvements out of funds collected from Benefited Properties pursuant to the fee schedule described in Exhibit D (the “Reimbursement Fee”). The Parties agree that Project’s prorata share of the Costs for completion of the Circulation Improvements is 30.90% as to the Santa Rosa/US 101 interchange (the “Developer Benefit”). 3. Administrative Costs Two percent (2%) of all monies collected pursuant to this agreement shall accrue to the City as administrative fees (the “Administrative Fee”). 4. Conditions of Reimbursement City’s obligation to reimburse Developer is conditioned on the following, all of which conditions the City hereby acknowledges and agrees have been met: 4.1 Developer has completed the Circulation Improvements in substantial conformance with the plans and standard improvement drawings submitted to the City. 4.2 The Circulation Improvements have been inspected and approved by City. 4.3 Applicable easements have been offered and accepted by the City, if any were required by the City. 4.4 Developer has provided the City with a detailed accounting, satisfactory to the City of the amounts expended for the construction and installation of the Traffic Improvements, which accounting has been reviewed and approved by the Public Works Director and Administrative Services Director. Obligation of City If, for any reason, the Reimbursement Fee is or becomes legally uncollectable, the City shall not be responsible in any way for collecting the Reimbursement Fee and/or reimbursing the Developer for the Costs of the Circulation Improvements. Reimbursement shall be made only when the City collects money from the owners of Benefited Properties at the time any building permit is issued. The Reimbursement Fee shall apply to the Benefited Properties, effective on the date which is sixty (60) days after approval of this Agreement by the Cit y. All land use permits approved for the Benefited Properties from and after the Effective Date shall be conditioned upon the project’s payment of the Reimbursement Fee, which fee shall be due and payable prior to final of any associated permit. Projects which do not require land use permits shall likewise pay the Reimbursement Fee prior to building permit final. The parties agree that the Reimbursement Fee shall not apply to existing commercial uses and residential structures, or demolished and replaced structures of the same use type and/or square-footage, and shall only apply to additional/new square footage for commercial properties, and to new multi-family or single family residential construction. For example, no fee shall be charged in connection with the remodel of an existing single family residence, but it would be charged at the time of issuance of a building permit for a new single family residence on a vacant lot. The parties further agree that the Reimbursement Fee shall not apply to projects which have submitted a building permit application prior to the date this Agreement is approved by the City, but shall apply to projects which apply after the date of this Agreement, even if the building permit application is submitted within the sixty (60) day period immediately after the approval of this Agreement by the City, for so long as the permit is not “finaled” within said 60-day period. The parties further agree that in order to correct a prior error in the issuance of the encroachment fee for the initial construction of the Circulation Improvements and collection of the related encroachment fee permit, that the $16,714.69 permit fee included in the Costs, shall be recovered by the City as follows: a) The portion of the encroachment permit fee not attributable to the Developer is 69.10%, which equals $11,549.85, or 3.4% of the total Costs. Therefore, 3.4% of each Reimbursement Fee collected by the City shall be retained by the City until the City has retained a total of $11,549.85; and b) The Developer’s Benefit, or share, of the encroachment permit fee is 30.90%, which equals $5,164.84. The City shall retain the balance of all Reimbursement Fees collected under this Agreement, after deduction for the 2% admin fee and the 3.4% for reimbursement of the encroachment fee described in ITEM NUMBER: C-1 DATE: 02/09/16 ATTACHMENT: 4 paragraph (a) above, until the City has retained a total of $5,164.84. 6. Place of Payment The City shall make payment to Developer at: West Front Village, LLC 1301 Chorro St. San Luis Obispo, CA 93401. Developer may change its address at any time by providing written notice to the City of said change. 7. Successors and Heirs This Agreement shall be binding on and shall inure to the benefit of the heirs, executors, administrators, successors, and assigns of the parties hereto. 8. Severability Shall any provision of this Agreement be held by a court of competent jurisdiction to be either invalid, void, or unenforceable, the remaining provisions of this Agreement shall remain in full force and effect unimpaired by the court ruling. 9. Captions The captions of the Sections of the Agreement are for convenience and reference only. They shall not be construed to define or limit the provisions to which they relate. 10. Indemnity Developer agrees to save, indemnify and hold harmless, the City of Atascadero, its officers, employees and agents, from all liabilities, judgements, costs and expenses, due to any and all activities related to the implementation of the rights and privileges granted in this agreement, except for liabilities, judgements, costs and expenses due to the City’s negligence, breach of this Agreement and/or failure to comply with any applicable law or regulation in the adoption or implementation of this Agreement. DISCUSSION: Background At the regular January 26, 2016 City Council meeting, the Council voted to adopt an ordinance that responds to State AB 243, thereby continuing the City’s prohibit ion on all medical marijuana facilities, including dispensaries and deliveries. The new ordinance will be in effect on February 25, 2016, and also includes a ban on all forms of Marijuana cultivation. The reason for the Council’s timely action on this ordinance was to retain local control with the understanding we may wish to revisit the issue at a later date with additional analysis. As part of the January 26th meeting, the Council also indicated a desire to revisit the issue and have staff bring it back at some point. After Council discussion, it was agreed to have staff bring back a potential timeline for a change to the ordinance. At the meeting there were several scenarios/potential processes discussed by the Council. An outline of a process and timeline is discussed for each of the four options listed below: 1. Begin a public process immediately and move forward with a meaningful public process and analysis irrespective of a potential ballot measure in November. 2. Adopt an ordinance that allows personal cultivation at a level consistent ITEM NUMBER: C-2 DATE: 02/09/16 with what is currently allowed by the Compassionate Use Act of 1996 as a place holder until we know what might happen as a result of a potential November ballot measure. 3. Leave the ordinance just adopted in place until afte r the potential November ballot issue is decided by the voters. At some point after the November election, Council would evaluate the policy based on local desires and the legislation in place at the time. 4. Since the January 26th hearing, staff has learned that Assembly Bill 21 is continuing to move forward through both the Assembly and the Senate and as of January 29th was on the Governor’s desk for signature. AB 21 would remove the requirement to have an ordinance in effect addressing marijuana cultivation prior to March 1, 2016 in order to retain local control. A fourth timeline is provided for potential direction to repeal the cultivation ban and re-adopt the City’s previous medical marijuana ordinance. Staff is asking for direction on which process or combination of processes Council would like to see on adopting a meaningful medical marijuana ordinance. Analysis Option #1 The timeline outlined below begins the process of analyzing the medical marijuana issue immediately and allows time for staff to research and analyze the issues and gather technical data. It would also allow staff to conduct an extensive public outreach process to hear from community members on the needs and issues related to medical marijuana. This timeline is intended to provide for a long-term solution that takes into account any potential changes that may arise from a November ballot initiative. 1. Begin staff research on marijuana legislation, both local, state and federal (Feb - March 2016) 2. Gather technical data on marijuana cultivation including indoor and outdoor grow cycles (March 2016) 3. Evaluate zoning and land use implications of cultivation (March-April 2016) 4. Hold community meetings to hear concerns from citizens on marijuana cultivation (April-June 2016) 5. Provide an update to City Council on information learned from research and community meetings. Provide Council with any available data on potential November ballot measure data and pending legislation (July or August 2016) ITEM NUMBER: C-2 DATE: 02/09/16 6. Provide an update to City Council on pending ballot measure (September or October 2016) 7. Await the November election to return to Council with a recommendation, or if the Council chooses, return sooner with proposed ordinance amendments. This option will take a significant amount of staff time in calenda r year 2016 and may delay other potential work programs included in the City’s action plan. Staff are also slated to work on a business advocate program, downtown open program, re -focus of OED, commercial broker meetings, zoning code update, model construction code outreach, affordable housing program reform, monument sign program, revision of sign ordinance, and processing of planning applications. Option #2 Option 2 would allow marijuana cultivation by primary caregivers and qualified patients at a level consistent with existing state law criminal immunities for medical marijuana. Under the Compassionate Use Act of 1996 (CUA) and Medical Marijuana Program Act, patients and caregivers have immunity from criminal prosecution for certain state law offenses. However, they can only have up to 8 ounces of dried marijuana or cultivation up to 6 mature or 12 immature marijuana plants PER PATIENT. A patient or caregiver may possess a greater amount if he or she can demonstrate the amount is consistent with the patient’s needs. Medical marijuana cards that recommend many more than the 6 mature and 12 immature plants are common. Under AB 243, a patient does not have to obtain a state cultivation license if he or she cultivates marijuana for his or her own personal use, limits the growing area to no more than 100 square feet, and does not distribute the marijuana to any other person. A caregiver does not have to get a state cultivation license if he or she grows marijuana in an area no greater than 500 square feet, cultivates for no more than 5 patients for whom he or she is the actual primary caregiver, and does not receive any payment other than reimbursement of actual costs. Atascadero Municipal Code Section 9-6.186 that takes effect on February 25th will prohibit all forms of cultivation, as cities are allowed to do under AB 243 and existing case law. Violation of this zoning code will be a category 3 (lowest priority) code enforcement case, unless three or more neighbors file a written complaint. It would then be considered a category 2 code enforcement complaint. If the City chooses, we may adopt alternative local legislation that allows some form of cultivation. In order to fast track ordinance amendments the City Council could follow the typical process t hat includes the following steps: 1. Planning Commission Review (potential date of March 1) 2. City Council review (potential date of March 22) ITEM NUMBER: C-2 DATE: 02/09/16 3. City Council second reading (potential date of April 12) However, any form of cultivation should be evaluated for land use compatibility, neighborhood preservation, and general public health and safety and should not be an uninformed, quick decision. The timeline above would result in a relatively quick decision, with little analysis and should be considered a stop gap measure. Several cities in our County have chosen to allow some level of cultivation as part of their recent code updates in response to state legislation. For example, in Morro Bay, the City Council has decided to allow cultivation as follows: “With the exception of personal individual cultivation by a primary caregiver or qualified patient for use of medical marijuana, as permitted by the Compassionate Use Act of 1996, marijuana cultivation by any person, including primary caregivers and qualified patients, collectives, cooperatives and dispensaries, is prohibited in all zones throughout the City.” Although this fairly simple amendment is also a possibility in Atascadero, staff suggests that we look to a more customized approach that reduces potential neigh borhood impacts and considers potential loopholes created by the state legislation. For example, under the Compassionate Use Act, a single property may be used to supply multiple patients with medical marijuana, thereby resulting in a very large cultivatio n facility. This is just one of many details that will need to be considered as part of an ordinance amendment. While this option provides for little analysis and community outreach, it will take some staff time and attorney time to draft the ordinance as directed, prepare staff reports and notice the meetings. This effort would not significantly delay the other projects that staff is working on, but may require significant staff work in the future to provide a long-term solution. Option #3 There are several recreational marijuana initiatives that are being circulated for next November’s ballot. The leading initiative is the Parker Initiative. While this initiative would largely preserve local control over marijuana establishments, there are some provisions that would likely require the City to revisit its marijuana regulations. Option #3 would be to wait until after the California electorate decides on recreational marijuana to begin the process. The City bans on both dispensaries and mobile dispensaries, which have been in place for a number of years, would remain in place until something is decided. The ban on cultivation that would go into effect February 25, 2016, would also remain in place until after the November decision on recreational marijuana. Between now and whatever the City decides after the November decision, staff would enforce the dispensaries and deliveries ban as they always have. They would also enforce the cultivation ban as a zoning code violation through the code enforcement complaint system. If the City receives a complaint regarding the cultivation of marijuana, it will be handled as a category 3 (lowest priority) code ITEM NUMBER: C-2 DATE: 02/09/16 enforcement complaint. If the City receives written complaints from 3 or more neighbors, it will be treated as a nuisance category 2 complaint. Based on the outcome of any potential recreational marijuana ballot initiatives, staff will develop a timeline that is appropriate to the legislation. This option would require the least staff time, as it does not require the City to adopt both a short-term solution now and then potentially change the ordinance if inconsistent legislation is passed in November. Option #4 AB21 has recently been passed by both the Assembly and the State Senate and is currently on the governor’s desk for signature. AB 21 would remove the requirement to have an ordinance in effect prior to March 1, 2016 in order to retain local control of medical marijuana. This opens up a fourth option to the Council, which would involve repealing the marijuana cultivation ban and waiting until the November to election to revisit the cultivation issue or until such time as the Council desires to address the issue. Since the second reading has already been completed, the Council’s action on January 26th cannot be amended or rescinded without following the normal procedure of adopting a new ordinance. This would require staff and the City Attorney to draft a new ordinance with similar restrictions to what was in place prior to February 25, 2016. The new ordinance would have to be noticed, heard by the Planning Commission, then approved at two separate City Council meetings. The new ordinance would go into effect 30 days after the second reading. 1. Planning Commission Review (potential date of March 1) 2. City Council review (potential date of March 22) 3. City Council second reading (potential date of April 12) While this option provides for little analysis and community outreach, it will take some staff time and attorney time to draft the ordinance as directed, prepare staff reports and notice the meetings. This effort would not significantly delay the other projects that staff is working on, but may require significant staff work in the future to provide a long -term solution. Conclusion Staff is asking for Council input prior to returning with ordinance amendments or a new ordinance that rescinds and replaces the ordinance adopted on January 26 th. Council may combine one or more options. ITEM NUMBER: C-2 DATE: 02/09/16 Prior to Ordinance adoption on January 26 th, the City did not have express regulations regarding marijuana cultivation, but consistently has taken the position that the Zoning Code prohibits all medical marijuana businesses, either expressly under Chapter 5 -13 or under permissive zoning principles. An amendment could allow some limited cultivation in specific zones of the City, subject to certain performance standards, and at the discretion of the City Council. However, adopting an ordinance without research, analysis and public outreach may result in unintended consequences. FISCAL IMPACT: Any potential ordinance amendment may impact staff resources, however it represents a continuation of existing enforcement policies regarding medical marijuana facilities, so there would be no change in the fiscal impact for the City. ALTERNATIVES: 1. Continue the item with specific direction for staff to return with additional information or alternative solutions. 2. Take no action. This would leave the complete ban in place and staff would provide updates to Council as state legislation moves forward. 3. City of Atascadero Adopted Ordinance language, effective February 25, 2016 ITEM NUMBER: C-2 DATE: 02/09/16 ATTACHMENT: 1 Attachment 1 Excerpt from E-mail from City Attorney regarding existing and pending state laws The following is a summary of existing state laws on medical marijuana: - In 1972, California added Chapter 6 to the state Uniform Controlled Substances Act, commencing at Health and Safety Code section 11350, which established the state’s prohibition, penalties, and punishments for the possession, cultivation, transportation, and distribution of marijuana. - In 1996, the voters approved Proposition 215 (Health and Safety (H&S) Code Section 11362.5). This was a very limited act; it only provided criminal immunity for patients and caregivers from prosecution for possession and cultivation and it shielded doctors who made recommendations for marijuana. It did not address how marijuana gets distributed or cultivated on a commercial level, so the CUA led to much confusion among law enforcement, the courts, cities, and marijuana advocates. - In 2003, the Legislature enacted the Medical Marijuana Program Act (MMPA), which commences at H&S Code section 11362.7. The purpose of the MMPA was to clarify the scope of the Act, establish a voluntary program for identification cards issued by counties for qualified patients and primary caregivers, and provide additional criminal immunity to qualified patients and primary caregivers for certain activities involving medical marijuana, including the collective or cooperative cultivation of medical marijuana. The courts have consistently held that the MMPA, despite its broad intent language, was a very limited measure and only provided criminal immunity to specific people (patients and caregivers) from specific state laws. - The MMPA’s immunity for collective and cooperative cultivation led to significant litigation, with cities arguing that they could still ban dispensaries, collectives, and cooperatives, and marijuana advocates arguing that the immunity preempted local bans. The Supreme Court agreed with the cities’ position in City of Riverside v. Inland Empire Patients Health and Wellness Center, Inc. (2013) 56 Cal.4th 729, holding unanimously that cities and counties have a right to ban all medical marijuana distribution establishments under their constitutional police power and zoning authority. In Maral v. City of Live Oak (2013) 221 Cal.App.4th 975, the Third District Court of Appeal held, based on Inland Empire, that there was no right to cultivate medical marijuana and that a city could implement and enforce a complete ban on this activity, including a ban on personal cultivation. The Fifth District Court of Appeal reached the same conclusion in Kirby v. County of Fresno (2015) 242 Cal.App.4th 940. ITEM NUMBER: C-2 DATE: 02/09/16 ATTACHMENT: 1 On October 9, 2015, Assembly Bills 243 and 266 and Senate Bill 643 (collectively, the “Medical Marijuana Regulation and Safety Act” or “MMRSA”) were enacted to create a state regulatory and licensing system governing the cultivation, testing, and distribution of medical marijuana, the manufacturing of medical marijuana p roducts, and physician recommendations for medical marijuana. The new law also recognizes a range of medical marijuana businesses referred to as “commercial cannabis activities,” including cultivation businesses, marijuana product manufacturers, marijuana distributors and transporters, marijuana testing laboratories, and dispensaries, and provides immunity to marijuana businesses operating with both a state license and a local permit. The dual licensing scheme is one of the key features of the new legisla tion. ALL marijuana businesses must have (1) a local license, permit, or other authorization and (2) a state license. With regard to marijuana cultivation, the local license, permit, or other entitlement must “specifically” permit cultivation. A marijuana cultivator cannot apply for a state license without a local permit and cannot apply for a state license if the proposed cultivation would violate a local ordinance. It is important to understand the distinction between local zoning authority, the criminal immunities for patients and caregivers and the licensing exemptions for patients and caregivers. o Under the CUA and MMPA, patients and caregivers have immunity from criminal prosecution for certain state law offenses. However, they can only have up to 8 ounces of dried marijuana or cultivation up to 6 mature or 12 immature marijuana plants PER PATIENT. A patient or caregiver may possess a greater amount if he or she can demonstrate the amount is consistent with the patient’s needs. o Under AB 243, a patient does not have to obtain a state cultivation license if he or she cultivates marijuana for his or her own personal use, limits the growing area to no more than 100 square feet, and does not distribute the marijuana to any other person. A caregiver does not have to get a state cultivation license if he or she grows marijuana in an area no greater than 500 square feet, cultivates for no more than 5 patients for whom he or she is the actual primary caregiver, and does not receive any payment other than reimbursement of actual costs. o Under the constitutional police power authority, which the new state laws preserve expressly, a city may ban all marijuana activities completely, including cultivation by a patient or caregiver. AB 243 inadvertently included a provision that requires local agencies to have a marijuana cultivation regulation or ordinance in place by March 1st, 2016, or cede ITEM NUMBER: C-2 DATE: 02/09/16 ATTACHMENT: 1 licensing authority to the state. This provision has prompted cities throughout the state to adopt cultivation bans or regulations. The author of AB 243, Assemblyman James Wood has introduced urgency clean-up legislation, AB 21. This bill prompted opposition from the ACLU. The League of California Cities and the ACLU worked out a compromise a week and a half ago and the bill is no moving unopposed through the Legislature. AB 21 deletes the March 1st deadline and some language regarding cities’ ability to ban private cultivation by patients and caregivers. The cultivation language was replaced with a sentence that recognizes the existing police power authority over land uses. Although some cities are not entirely happy with the trade-off, the League’s position is that there was strong political pressure, including from the Governor’s office, to compromise and that the final version of AB 21 maintains the legal status quo under which Maral and Kirby were decided favorably for local agencies. Barring some unforeseen development, we expect that the Governor will receive it for signature by next week. There are several recreational marijuana initiatives that are being circulated for next November’s ballot. The leading initiative is the Parker Initiative. While this initiative would largely preserve local control over marijuana establishments, there are some provisions in that would likely require the City to revisit its marijuana regulations. We will continue to monitor this development very closely. ITEM NUMBER: C-2 DATE: 02/09/16 ATTACHMENT: 2 ATTACHMENT 2 9-6.186 Medical Marijuana Facilities. (a) Purpose. The purpose and intent of this section is to prohibit marijuana cultivation facilities, medical marijuana dispensaries, medical marijuana deliveries, and commercial cannabis activities, as defined below, within the city limits. It is recognized that it is a Federal violation under the Controlled Substances Act to possess or distribute marijuana even if for medical purposes. Additionally, there is evidence of an increased incidence of crime-related secondary impacts in locations associated with marijuana cultivation facilities and medical marijuana dispensaries and in connection with medical marijuana deliveries, which is contrary to policies that are intended to promote and maintain the public’s health, safety, and welfare. (b) Definitions. (1) “Commercial cannabis activity” shall have the meaning set forth in Business and Professions Code section 19300.5(k). (2) “Cultivation” means any activity involving the planting, growing, harvesting, drying, curing, grading, or trimming of marijuana. (3) "Establish" or "operate" a marijuana cultivation facility, medical marijuana dispensary, or commercial cannabis activity (as defined in this section) means and includes any of the following: a. The opening or commencement of the operation of a marijuana cultivation facility, medical marijuana dispensary, or commercial cannabis activity; b. The conversion of an existing business, facility, use, establishment, property, or location to a marijuana cultivation facility, medical marijuana dispensary, or commercial cannabis activity; c. The addition of a marijuana cultivation facility, medical marijuana dispensary, or commercial cannabis activity to any other existing business, facility, use, establishment, property, or location. (4) "Marijuana" means all parts of the plant Cannabis, whether growing or not; the seeds thereof; the resin extracted from any part of the plant; and every compound manufacture, salt, derivative, mixture, or preparation of the plant, its seeds or resin. It includes marijuana infused in foodstuff, and concentrated cannabis and the separated resin, whether crude or petrified, obtained from marijuana. It does not include the mature stalks ITEM NUMBER: C-2 DATE: 02/09/16 ATTACHMENT: 2 of the plant, fiber produced from the stalks, oil or cake made from the seeds of the plant, any other compound, manufacture, salt, derivative, mixture, or preparation of the mature stalks (except resin extracted therefrom), fiber, oil, or cake, or the sterilized seeds of the plant that are incapable of germination. (5) "Medical marijuana" is marijuana used for medical purposes where that medical use is deemed appropriate and has been recommended by a physician who has determined that the person's health would benefit from the use of marijuana in the treatment of acquired immune deficiency syndrome ("AIDS"), anorexia, arthritis, cancer, chronic pain, glaucoma, migraine, spasticity, or any other serious medical condition for which marijuana is deemed to provide relief as defined in subsection (h) of Health and Safety Code § 11362.7. (6) “Marijuana cultivation facility” means any business, facility, use, establishment, property, or location where the cultivation of marijuana occurs. (7) "Medical marijuana dispensary" means any business, facility, use, establishment, property, or location, whether fixed or mobile, where medical marijuana is sold, made available to, delivered to and/or distributed by or to three or more of people. "Medical marijuana dispensary" shall include the definition of “dispensary” set forth in Business and Professions Code section 19300.5(n). A "medical marijuana dispensary" does not include the following uses, as long as the location of such uses are otherwise regulated by this Code or applicable law: a clinic licensed pursuant to Chapter 1 of Division 2 of the Health and Safety Code, a health care facility licensed pursuant to Chapter 2 of Division 2 of the Health and Safety Code, a residential care facility for persons with chronic life-threatening illness licensed pursuant to Chapter 3.01 of Division 2 of the Health and Safety Code, a residential care facility for the elderly licensed pursuant to Chapter 3.2 of Division 2 of the Health and Safety Code, a residential hospice, or a home health agency licensed pursuant to Chapter 8 of Division 2 of the Health and Safety Code, as long as any such use complies strictly with applicable law including, but not limited to, Health and Safety Code § 11362.5 and following. (c) Medical marijuana dispensaries, marijuana cultivation facilities, commercial cannabis activities, and medical marijuana deliveries prohibited. (1) Medical marijuana dispensaries are prohibited in all zones in the city and shall not be established or operated anywhere in the city. (2) Marijuana cultivation facilities are prohibited in all zones in the city and shall not be established or operated anywhere in the city. (3) Commercial cannabis activities are prohibited in all zones in the city and shall not be established or operated anywhere in the city. ITEM NUMBER: C-2 DATE: 02/09/16 ATTACHMENT: 2 (4) No person may own, establish, open, operate, conduct, or manage a medical marijuana dispensary, marijuana cultivation facility, or commercial cannabis activity in the city, or be the lessor of property where a medical marijuana dispensary, marijuana cultivation facility, or commercial cannabis activity is located. No person may participate as an employee, contractor, agent, volunteer, or in any manner or capacity in any medical marijuana dispensary, marijuana cultivation facility, or commercial cannabis activity in the city. (5) No use permit, site development permit, tentative map, parcel map, variance, grading permit, building permit, building plans, zone change, business license, certificate of occupancy or other applicable approval will be accepted, approved or issued for the establishment or operation of a medical marijuana dispensary, marijuana cultivation facility, or commercial cannabis activity. (6) No person and/or entity may deliver or transport medical marijuana from any fixed or mobile location, either inside or outside the city, to any person in the city, except that a person may deliver or transport medical marijuana to a qualified patient or person with an identification card, as those terms are defined in Health and Safety Code section 11362.7, for whom he or she is the primary caregiver within the meaning of Health and Safety Code sections 11362.5 and 11362.7(d). (7) Nothing contained in this section shall be deemed to permit or authorize any use or activity which is otherwise prohibited by any state or federal law. (d) Enforcement. The city may enforce this section in any manner permitted by law. The violation of this section shall be and is hereby declared to be a public nuisance and contrary to the public interest and shall, at the discretion of the city, create a cause of action for injunctive relief. ITEM NUMBER: C-3 DATE: 02/09/16 Atascadero City Council Staff Report – City Manager’s Office Public Relations and Marketing Services For Atascadero Tourism Business Improvement District (ATBID) RECOMMENDATIONS: The Atascadero Tourism Business Improvement District (ATBID) Advisory Board recommends: 1. Council authorize the City Manager to amend the contract with Verdin for ATBID Public Relations and Marketing Services through June 30, 2017 at an amount not to exceed $160,000 for the period March 2016 through June 30, 2017. AND Staff recommends: 2. Council authorize the City Manager to execute future amendment(s) to the contract with Verdin for ATBID Public Relations and Marketing Services extending the term and amounts if recommended by the ATBID Advisory Board prior to expiration of the contract. (Contract may not extend beyond March 10, 2020) REPORT IN BRIEF: On March 10, 2015, the Council awarded a contract to Verdin for ATBID and Public Relations and Marketing Services. The contract was awarded to Verdin after an extensive selection process. The awarded contract expires March 10, 2016, and it is the desire of the ATBID Advisory Board (Board) to extend the contract with Verdin without going back through the RFP/RFQ process. The Board formally approved recommending a contract extension through June 30, 2017 and discussed their desire to re-evaluate the contract next year to determine whether they wanted to go out for RFP/RFQ or further extend it at that time. Staff is recommending a n additional contract amendment that would allow the Board to extend the contract beyond June 30, 2017, if they so desired without having to go back through the RFP/RFQ and Council approval ITEM NUMBER: C-3 DATE: 02/09/16 process. The Board could recommend subsequent renewals at their discretion, allowing the City Manager to execute an amendment to the contract at that time . The purchasing policy does, however, require that the contract must go out to RFP/RFQ process at the end of five years. DISCUSSION: In 2013, the lodging businesses in Atascadero requested the establishment of the Atascadero Tourism Business Improvement District (ATBID) in order to levy annual assessments under the Parking and Business Improvement Area Law of 1989. The activities to be funded by the proposed levy of assessments against lodging businesses within the ATBID were tourism promotions and marketing programs to promote the City as a tourism destination. The ATBID assessment would be equal to two percent (2%) of the rent charged by the business per occupied room or space per night for all transient occupancies in lodging businesses. The City Council agreed, and adopted Ordinance No. 568, establishing the Atascadero TBID. The new assessments began June 1, 2013. The 2% additional assessment is placed in the ATBID fund, created by the Council for this purpose. These funds are to be used by the ATBID Advisory Board for: “…tourism promotions and marketing programs to promote the City as a tourism destination and such other tourism related projects, programs, and activities that are directed at increasing transient stays at Lodging Businesses in the ATBID and for such other tourism, branding and marketing purposes as the City and the ATBID Advisory Board may determine.” A budget for the ATBID fund is developed and approved by the ATBID Advisory Board and then is included as part of the City budget for Council approval. In 2014, the ATBID Advisory Board directed City staff to distribute a Request for Proposals (RFP) for Public Relations and Marketing Services. Four Marketing firms responded. The Board directed City staff to create an interview panel for the proposal responses. City staff created a five-member panel who, on September 10, 2014, interviewed the four firms that had responded to the RFP. The panel assessed each firm using a rating sheet that listed the five evaluation criteria from the RFP: 1. Understanding of the nature of services by the ATBID Advisory Board. 2. Strategic depth and overall creativity of proposal. 3. Responsiveness to all elements outlined in the request for proposal. 4. Outline of proposed fees for services and expenses within stated budget. 5. Experience and results in performing the services desired by the ATBID Advisory Board. ITEM NUMBER: C-3 DATE: 02/09/16 Each panelist could give a score under each category of no more than 20 points, with the possibility of a perfect score being 100 points across the five categories. With five panel members rating the presentations, a possible perfect score would be 500. There were two firms that scored very high and close to each other, at 461 and 464. The other firms were in the 300’s and 200’s. Staff felt that since the two firms rated very high, the ATBID should have the opportunity to see their presentations and ask the firms questions before deciding which firm to recommend to the City Council. The Board met with the two firms twice in October 2014; and at their October 22, 2014 meeting, the ATBID Advisory Board selected Mental Marketing as their choice to recommend to the City Council for ATBID Public Relations and Marketing Services. City staff brought the ATBID Advisory Board’s recommendation to the City Council at their January 13, 2015 meeting. The City Council referred the item back to the ATBID Advisory Board, asked them to attend the Council’s Strategic Planning Session in February 2015, and re-evaluate their marketing needs. The City Council and the ATBID Advisory Board held a Special Joint Meeting on February 6, 2015 , where they discussed their responsibilities and roles. There was Council and Board consensus on the following: 1. ATBID Mission Statement, with the removal of the word “Brand.” 2. ATBID Board to come back to the City Council on March 10th regarding the ATBID marketing contract. The Board recommended that the City Council authorize the execution of a contract with Verdin. At the March 10, 2015 Council meeting, the Council authorized a contract with Verdin for ATBID Public Relations and Marketing Services. A one year contract with Verdin was executed on March 10, 2015. The ATBID Advisory Board met on January 19 , 2016, and reviewed the proposal for the next 16 months of work from Verdin. The scope and the dollar amount for services through June 30, 2017 were reviewed. The Board approved recommending an extension through June 30, 2017 in the amount of $160,000. This extension would be considered a change order in excess of 20% of the original contract and therefore requires Council approval. While a formal motion was not made, the Board also expressed a desire to revisit the contract next December (2016) to decide whether they would like to extend the contract for another period or go out through the RFP/RFQ process. Staff is recommending that Council authorize the City Manager to execute future change orders / contract amendments to extend the contract past June 30, 2017, if so directed by the ATBID Advisory Board. This would allow the ATBID future flexibility to determine if they wanted to go out, or negotiate an extension without having to go through the RFP/RFQ and Council approval process. The purchasing policy does not allow contracts that exceed five years, so in no instance could the contract be extended past March 10, 2020. ITEM NUMBER: C-3 DATE: 02/09/16 FISCAL IMPACT: $160,000 from the ATBID budget for Public Relations and Marketing Services. ALTERNATIVES: 1. The City Council may choose to not hire Verdin and to refer this issue back to the ATBID Advisory Board with direction. 2. The City Council could adopt the ATBID Advisory Board formal recommendation to the Council to extend the contract through June 30, 2017. This would mean that the contract expires on June 30, 2017 and the contract would be put out for RFP/RFQ for any future services. 3. The City Council could adopt the ATBID Advisory Board formal recommendation to the Council to extend the contract through June 30, 2017 and direct staff to bring any recommendations by the ATBID Board to extend the contract past June 30, 2017 back to the City Council for approval.
