WELCOME TO THE ATASCADERO PLANNING COMMISSION MEETING
The Planning Commission meets in regular session on the first and third Tuesday of each month at 7:00 p.m. at City
Hall, Council Chambers, 6500 Palma Avenue, Atascadero. Matters are considered by the Commission in the order of
the printed Agenda.
Copies of the staff reports or other documentation relating to each item of business referred to on the Agenda are on
file in the office of the Community Developmen t Department and are available for public inspection during City Hall
business hours at the Front Counter of City Hall, 6500 Palma Avenue, Atascadero, and on our website,
www.atascadero.org. All documents submitted by the public during Commission meetings that are either read into
the record or referred to in their statement will be noted in the minutes and available for review in the Community
Development Department. Commission meetings are audio recorded , and may be reviewed by the public. Copies of
meeting recordings are available for a fee. Contact the City Clerk for more information (470-3400).

Description:
The project consists of an application for an 86 unit affordable housing, multi-family
development to be built in two phases. The project area is approximately 3.9 acres with a slope of
2.5% in a northwestern direction away from El Camino Real. Currently, the site is partially
developed with one vacant single-family residence that will be demolished as a part of the
proposed project.
The applicant is proposing the following as a part of the proposed project:
86 total apartment units including a mix of 1, 2, 3 and 4 bedroom apartments;
Two corridor style buildings 2-stories in height (24-feet) with two (2) 32-foot tall mechanical /
staircase shafts with decorative architectural features;
One (1) corridor style building 3-stories in height (37-feet, 4-inches) with two (2) 43-foot tall

Commissioner Bourbeau had questions about the project and went over them with staff
prior to this meeting.
Commissioners Anderson and Dariz reviewed this project at the DRC.
Commissioner Schmidt visited the site.
Assistant Planner Castillo reported that this project went before the Design Review
Committee. Mr. Castillo gave the staff report and he and Interim Director Lewis
answered questions from the Commission.
PUBLIC COMMENT
The following members of the public spoke during public comment : Jake Lingo (who
gave a presentation on the project), Mike Zappas, and Ben Martin. Mr. Lingo answered
questions from the Commission.

DIRECTORS REPORT
Interim Director Lewis stated that the Fitness Evolution gym (PLN 2015-1545) approved
at the Planning Commission hearing on April 21, 2015 has been appealed , and will go
to City Council on May 26, 2015. Interim Director Lewis stated that the next Planning
Commission hearing may be cancelled, and then he gave an update on the Springhill
Suites.

Background
The subject site is located within the Hotel Park business complex, located between
Capistrano Avenue and Highway 41. The office development was originally established
in 1987 through a Master Plan of Development, which approved approximately 70,000
square feet of office/retail space. The site includes five (5) two-story office buildings
which are divided into suites. The Hotel Park Master Plan of Development also includes
the new San Luis Obispo County Library building, two (2) vacant parcels adjacent to
Highway 41, and a shared parking lot.
The subject site of the proposed Conditional Use Permit (CUP) is located at 5955
Capistrano Avenue, Units A-D. The space was previously occupied by the San Luis
Obispo County Assessor and County Recorder, and has been vacant since the County
offices moved into the new library building last year. The proposed lease space is
approximately 3,000 sq. ft. and includes the entire first floor of the fourth office building
adjacent to Capistrano Avenue.
ANALYSIS:
The proposed application consists of a Minor Conditional Use Permit to locate a small
church within the Downtown Office zoning district. The applicant, Crossroads Church,
has been operating for the past few years at a facility on Highway 41 near Santa Rosa
Road; however, their current lease is expiring and they are looking for a new space.
The church is currently proposing to occupy an existing office space at 5955 Capistrano
Avenue, which was previously used as the County Assessor’s office.
No exterior building or site modifications are proposed with the CUP. Building
occupancy within the existing 3,000 sq. ft. space is limited to a maximum of 50 people
based on Building Code standards for the proposed use . Adequate parking for the
proposed use is located on-site within the shared parking lot. Church services will be
held on Sundays, and therefore, will not conflict with the surrounding office uses within
the complex, which primarily operate from 8am to 5pm on weekdays. During the week,
the church will utilize the space for church offices with set hours. Church meetings and
small groups will use the space in the evenings. The church would operate a backpack
exchange program, which sends non-perishable food and supplies into the community
via volunteers. The site will not be used as a shelter, on-site service of any meal
program, or for any other social service type activities for members of the public.
In May of 2015, Crossroads Church approached the City regarding the potential to
locate at 5955 Capistrano Avenue. Based on the nature of proposed church activities
and limited congregation size, the Interim Community Development Director determined
that based upon the characteristics of the use and as provided by AMC 9-1.10(d), the
proposed church was most similar and comparable in use to a “school.” Based on this
determination, the proposed church may be permitted within the Downtown Office (DO)

General Plan Consistency
The proposed project is consistent with the following General Plan Land Use Element
Goals and Policies:
Land Use Program 1.1.7: Within the Urban Core, encourage infill development or
revitalization or reuse of land already committed to urban development where utili ties
and public services exist.
Land Use Policy 13.1: Facilitate convenient location of goods and services needed by
local residents.
Goal LOC 14: Retain and expand existing business and attract new businesses to
improve the availability of goods and services.
Conditional Use Permit Findings
The CUP process provides the opportunity for the public and the Planning Commission
to review the specifics of land use proposals, such as the appropriateness of use, site
design, and specific standards of the Zoning Ordinance. The Planning Commission
must make the following six findings in order to approve the proposed CUP Amendment
within the commercial park zone:
1. The proposed project or use is consistent with the General Plan, as well as the City’s
Appearance Review Manual and any pertinent City policy or criteria adopted by
ordinance or resolution of the City Council.
Staff Comment: The proposed church use at this location is consistent with the
Downtown land use designation of the General Plan and the General Plan Land Use
Element Goal LOC 14, Policy 13.1 and Land Use Program 1.1.7.
2. The proposed project or use satisfies all applicable provisions of the Title (Zoning
Ordinance).
Staff Comment: As conditioned, and based the interpretations of allowable use
provided by AMC section 9-1.109, the project satisfies the provisions of the
Atascadero Municipal Code. Based on the limited nature of proposed church
activities and limited congregation size, the Interim Community Development
Director determined that the proposed church was most similar and comparable in
use to a “school,” and therefore may be conditionally permitted in the Downtown
Office zoning district. The existing parking is adequate to serve the proposed use.
3. The establishment, and subsequent operation or conduct of the use will not,
because of the circumstances and conditions applied in the particular case, be

detrimental to the health, safety, or welfare of the general public or persons residing
or working in the neighborhood of the use, or be detrimental or injurious to property
or improvements in the vicinity of the use.
Staff Comment: City staff has reviewed the proposed use and has determined that
the operation of the use of a church at the above address will not be detrimental to
the health, safety, or welfare of the general public, or persons residing or working in
the surrounding neighborhood of the proposed use. The proposed projec t will not be
detrimental or injurious to property or improvements as proposed.
4. That the proposed project or use will not be inconsistent with the character or the
immediate neighborhood or contrary to its orderly development.
Staff Comment: Based on staff’s review of the proposed project, the use will not be
inconsistent with the character of the immediate neighborhood or contrary to its
orderly development because the proposed use and related church activities would
take place primarily during non-business hours (8am to 5pm) and conditions have
been included to limit the proposed congregation size, based on Building Code
regulations. The proposed use would fill a vacant space located in an existing
business complex at Hotel Park. The conditions of approval limit activities permitted
on site in order to ensure neighborhood compatibility.
5. That the proposed use or project will not generate a volume of traffic beyond the
safe capacity of all roads providing access to the project, either existing o r to be
improved in conjunction with the project, or beyond the normal traffic volume of the
surrounding neighborhood that would result from full development in accordance
with the Land Use Element.
Staff Comment: The proposed project will not generate a volume of traffic beyond
the safe capacity of all roads providing access to the project. The proposed use, as
conditioned, is consistent with the traffic projections and road improvements
anticipated within the General Plan.
6. That the proposed project is in compliance with any pertinent City policy or criteria
adopted by ordinance or resolution of the City Council.
Staff Comment: The proposed use is consistent with all pertinent City policies and
criteria adopted by the City Council.
Based on staff’s analysis in the preceding sections, all of the required findings for
approval of CUP 2015-0292 can be made.

ENVIRONMENTAL DETERMINATION:
This project qualifies for a Class 1 Categorical Exemption under CEQA Section 15301,
Existing Facilities, specifically interior alterations involving such things as interior
partitions, plumbing, and electrical conveyances.
CONCLUSION:
The applicant has submitted a proposal to locate a small church at 5955 Capistrano
Avenue within the Hotel Park business complex. The church is proposed to occupy
approximately 3,000 square feet in the Downtown Office zone. No exterior building or
site modifications are proposed. Building occupancy is limited to a maximum of 50
people. Adequate parking for the proposed use is located on-site. The proposed church
has been determined to be similar and comparable in use to a school based on the
nature of proposed church activities and limited congregation size, and therefore may
be conditionally permitted in the Downtown Office zone. Based on the above analysis
and incorporated conditions, staff believes that the findings for approval of the CUP can
be made.
ALTERNATIVES:
1. The Commission may include modifications to the project and/or conditions of
approval for the project.
2. The Commission may determine that more information is needed on some
aspect of the project and may refer the item back to the applicant and staff to
develop the additional information. The Commission should clearly state the type
of information that is required and move to continue the item to a future date.
3. The Commission may deny the project. The Commission must specify the
reasons for denial of the project and make an associated finding with such
action.

WHEREAS, an application has been received from Roger Williams and Crossroads
Church, PO Box 2356, Atascadero, CA 93423 (Applicant) and Glen R. Lewis, PO Box 1980,
Atascadero, CA 93423 (Owner) to consider a project consisting of a Conditional Use Permit to
allow a 3,000 square foot church, with a maximum occupancy of 50 people and limited on-site
activities, at 5955 Capistrano Avenue Suites A-D (APN 029-363-011); and,
WHEREAS, the site’s current General Plan Designation is Downtown (D); and
WHEREAS, the site’s current zoning district is Downtown Office (DO); and
WHEREAS, the proposed use of the site (church) is not specifically listed in the zoning
district, and the Planning Director has reviewed the proposed use and, based upon the
characteristics of the use, determined that a use listed in the land use description (school) is
equivalent in nature and intensity to that proposed, consistent with Atascadero Municipal Code
section 9-1.109(d)(1); and
WHEREAS, the proposed equivalent use (schools) requires approval of a conditional use
permit, consistent with Atascadero Municipal Code section 9-3.262; and
WHEREAS, the laws and regulations relating to the preparation and public notice of
environmental documents, as set forth in the State and local guidelines for implementation of the
California Environmental Quality Act (CEQA) have been adhered to; and
WHEREAS, a timely and properly noticed Public Hearing upon the subject Conditional
Use Permit application was held by the Planning Commission of the City of Atascadero at which
hearing evidence, oral and documentary, was admitted on behalf of said Conditional Use Permit;
and
WHEREAS, the Planning Commission of the City of Atascadero, at a duly noticed
Public Hearing held on July 7, 2015, studied and considered Conditional Use Permit 2015-0292;
and

NOW, THEREFORE, the Planning Commission of the City of Atascadero takes the
following actions:
SECTION 1. Findings of Environmental Exemption. The Planning Commission finds
as follows:
1. The proposed project has been found Categorically Exempt under Class 1, Section 15301,
Existing facilities, of the California Environmental Quality Act.
SECTION 2. Findings for approval of Conditional Use Permit 2015-0292. The
Planning Commission finds as follows:
1. The proposed project or use is consistent with the General Plan based on the

The proposed church use at this location is consistent with the Downtown land use

The proposed use of the site (church) is not specifically listed in the Downtown
Office zoning district; however, in accordance with Atascadero Municipal Code

and based upon the characteristics of the use, determined that a use listed in the land
use description (school) is equivalent in its nature and intensity to that proposed. The

The subject site is one of only five Downtown Office zoned parcels located within the
City of Atascadero. Four of the five parcels are located within the Hotel Park Master
Plan of Development. Based on the characteristics of the property and the
surrounding area, which is used primarily as office, the zone is very similar to the
Commercial Professional zone, which would allow churches as a conditional use;
and,
The proposed church use on the subject site has been determined to be similar to a
school use due to the limited size of the congregation, which is capped by a maximum
occupancy of 50 people, as limited by the Building Code for the subject space. In
addition, the church proposes limited on-site activities, which include church
services, offices, and small group meetings. Auxiliary uses that are often present at
churches, such as shelters, meal service, and other social services, are not proposed or
allowed on the subject site. The church is proposed to locate within an existing office
space on the subject site; no exterior building modifications are proposed. Sufficient
parking is located on site to service the proposed use, and the peak hours of use will

not conflict with other office uses in the center; and
3. The establishment, and subsequent operation or conduct of the use will not, because
of the circumstances and conditions applied in the particular case, be detrimental to
the health, safety, or welfare of the general public or persons residing or working in
the neighborhood of the use, or be detrimental or injurious to property or
improvements in the vicinity of the use based on the following:

8. Permitted on-site activities shall include church services, church offices, and
group meetings. Church services shall be held only on Sundays in order to
avoid parking conflict within the business complex. Group meetings with more
than 10 people shall take place after 5:00 pm.
The church is permitted to operate a backpack exchange program, which
sends food and supplies into the community via volunteers. The site will not be
used as a shelter, for on-site service of any meal program, or for any other on-
site social service type activities for members of the public.
