City Council Draft Action Minutes – March 24, 2015  Recommendation: Council approve the City Council Draft Action Minutes of March 24, 2015. [City Clerk] 2. City Council Draft Action Minutes – April 14, 2015  Recommendation: Council approve the City Council Draft Action Minutes of April 14, 2015. [City Clerk] 3. March 2015 Accounts Payable and Payroll  Fiscal Impact: $2,235,192.00  Recommendation: Council approve certified City accounts payable, payroll and payroll vendor checks for March 2015. [Administrative Services] 4. Proposed Inclusive Special Needs Playground Name  Fiscal Impact: None.  Recommendation: Council authorize the naming of the proposed inclusive special needs playground at the Colony Park Community Center as “Joy Playground.” [Police] 5. PLN 2007-1243 / CFD 2014-0003 - Community Facilities District 2005-1 - Annexation No. 13 - Atascadero Triangle  Fiscal Impact: The establishment of Annexation No. 13 into the CFD is intended to mitigate the fiscal impact of residential development on the City, and would provide up to $7,128.88 annually, based on the current rates, to fund the expansion of Police, Fire, and Park Se rvices.  Recommendation: Council adopt on second reading, by title only, Draft Ordinance A, authorizing the levy of special taxes in Community Facilities District 2005-1 for certain annexation territory. [Community Development] 6. Amendments to Municipal Code Relating to the Planning and Parks & Recreation Commissions - Second Reading of Ordinance  Fiscal Impact: None.  Recommendation: Council adopt on second reading, by title only, the Draft Ordinance, amending Section 2-9.02 and Title 2 Chapter 13 of the Atascadero Municipal Code relating to the Planning Commission and the Parks and Recreation Commission. [City Clerk] 7. Weed/Refuse Abatement Program  Fiscal Impact: The City recovers costs for administering this program through the 150% administrative fee, which is placed on the San Luis Obispo County Special Tax Assessment for the fiscal year 2015 -2016 Tax Roll.  Recommendation: Council adopt the Draft Resolution, declaring vegetative growth and/or refuse a public nuisance, commencing proceedings for the abatement of said nuisances, and placing all abatement fees on the San Luis Obispo County Special Tax Assessment for the fiscal year 2015-2016 Tax Roll. [Fire] 8. Historic City Hall Conference Room 104 - Facility Use Agreement - Atascadero Veterans Memorial Foundation  Fiscal Impact: A potential loss of rental fees the conference room might otherwise generate and a potential impact to front counter staff time.  Recommendations: Council: 1. Adopt Draft Resolution authorizing specified organizations to use City facilities in a manner specified in written agreements regarding use of City Facilities; and, 2. Authorize the City Manager to execute a Facility Use Agreement with the Atascadero Veterans Memorial Foundation. Matters are considered by the Council in the order of the printed Agenda. Regular Council meetings are televised live, audio recorded and videotaped for future playback. Charter Communication customers may view the meetings on Charter Cable Channel 20 or via the City’s website at www.atascadero.org. Meetings are also broadcast on radio station KPRL AM 1230. PUBLIC HEARINGS: None C. MANAGEMENT REPORTS: 1. Report on Insurance Services Offices (ISO) - Public Protection Classification Summary  Fiscal Impact: There is no direct fiscal impact for the City. However, there is potentially a significant fire insurance savings for property owners.  Recommendation: Council receive and file the Insurance Services Office (ISO) Public Protection Classification Summary Report. General Plan & Housing Element - Annual Progress Report 2014 - (PLN 2006-1133)  Fiscal Impact: None.  Recommendation: The Planning Commission recommends: Council authorize submittal of the attached 2014 Annual General Plan and Housing Report to the State of California. [Community Development] Assistant Planner Alfredo Castillo gave the staff report and answered questions from the Council. PUBLIC COMMENT: The following citizens spoke on this item: Dale Gustin. Mayor O’Malley closed the Public Comment period. MOTION: By Council Member Fonzi and seconded by Council Member Kelley to authorize submittal of the attached 2014 Annual General Plan and Housing Report to the State of California. Motion passed 4:0 by a roll-call vote. 3. Nominate Representatives to the Water Resources Advisory Committee  Fiscal Impact: None.  Recommendation: Council nominate a member and alternate member to represent the City of Atascadero on the Water Resources Advisory Committee (WRAC) and direct City Manager to forward nominations to the County Board of Supervisors for confirmation. [Public Works] Public Works Director Nick DeBar gave the staff report and answered questions from the Council. PUBLIC COMMENT: None MOTION: By Council Member Kelley and seconded by Mayor Pro Tem Moreno to nominate Council Member Roberta Fonzi as our representative, Public Works Director Nick DeBar as the alternate member to represent the City of Atascadero on the Water Resources Advisory Committee (WRAC), and direct the City Manager to forward nominations to the County Board of Supervisors for confirmation. County Mayors Round Table – The Mayors continue to evaluate the issue of rail safety with oil transport, and they will continue to review the issue of a Marine Sanctuary. Mayor Pro Tem Moreno 1. TBID – They are looking at the variety of logos currently being used in Atascadero. Also, the Visit Atascadero website and its use is a question the TBID Board wants to pursue. Council Member Fonzi 1. Air Pollution Control District (APCD) – Council Member Fonzi asked for input from her fellow Council Members. They will be reviewing a new program that would assist cities in their monitoring of the implementation of their Climate Action Plans. This would be grant funded the first year, and the cities would be asked to pay for the service after that. There was Council consensus that they are not interested in the APCD’s assistance, and prefer Local Control. E. INDIVIDUAL DETERMINATION AND / OR ACTION: None F. Proclamation Recognizing April 2015 as “Month of the Child” and “Child Abuse Prevention Month” The City Council presented the Proclamation to Cindy Cipres from Little Bugs Child Care and Raechelle Bowlay-Sutton from Community Action Partnership of SLO County (CAPSLO). 2. SLO Regional Rideshare & Bike Month Update by Peter Williamson Peter Williamson, SLO Regional Rideshare, gave a brief presentation focusing on Bike Month. 3. Sexual Assault Awareness Month Proclamation presented to RISE The City Council presented the Proclamation to RISE Executive Director, Jennifer Adams, and Board Member, Charles Bourbeau. A. CONSENT CALENDAR: 1. State Route 41 West Corridor Study  Fiscal Impact: The action will result in the expenditure of $180,000 in RSHA Competitive Grant Funds.  Recommendation: Council authorize the City Manager to execute a professional services agreement for a maximum fee of $180,000 with Whitlock & Weinberger Transportation, Inc. (W -Trans) to perform professional services for the State Route 41 West Corridor Study. [Public Works] 2. Amendment & Restatement of a Cooperative Agreement Between San Luis Obispo County Fire Departments for the Regional Hazardous Materials Team  Fiscal Impact: Funding for the City of Atascadero to participate on the Team is an additional $4,000 annually from the General Fund.  Recommendation: Council adopt the Draft Resolution amending and restating the San Luis Obispo Regional Hazardous Materials Cooperative Agreement. Historic City Hall Project Change Order: ACH-13 Exterior Lighting Installation  Fiscal Impact: The fiscal impact of the exterior lighting project change order is $28,103 of City Hall Repair and Rehabilitation Project Funds.  Recommendation: Council authorize the City Manager to execute a change order with Rob Reynolds Construction in the amount of $28,103 for the fabrication and installation of custom shields for the exterior lighting fixtures and the replacement of the LED light modules at the column up lights for the Atascadero City Hall Exterior Lighting Project. [Public Works] 4. Lighted Crosswalk Upgrades Supplemental Funding Request  Fiscal Impact: This action will result in the expenditure of $45,000 in previously allocated Prop 1B funding and $7,000.00 in gas tax funds, for a total expenditure of $52,000.  Recommendations: Council: 1. Authorize the purchase of lighted crosswalk modules and signs in the amount of $48,360 from Silicon Constellation; and, 2. Authorize the Director of Administrative Services to appropriate $7,000.00 of Gas Tax Funds for the El Camino Real Safety Upgrades Projects. [Public Works] 5. Alcoholic Beverage Control (ABC) License - On-site Sale of Beer - PLN 2015-0021 2015-1544 - 5985 Traffic Way “Socrates Coffee House” - (Wysong / Campbell)  Fiscal Impact: Slight positive fiscal impact expected from increased sales tax.  Recommendation: Council adopt Draft Resolution “A” finding that a public convenience would be served by allowing the issuance of an on -site sale of beer license for the Socrates Coffee House, a new business, located at 5985 Traffic Way. February 2015 Accounts Payable and Payroll  Fiscal Impact: $1,522,781.58  Recommendation: Council approve certified City accounts payable, payroll and payroll vendor checks for February 2015. Community Facilities District 2005-1 Annexation No. 13 Atascadero Triangle (People’s Self Help Housing)  Ex-parte Communications:  Fiscal Impact: The establishment of Annexation No. 13 into the CFD is intended to mitigate the fiscal impact of residential development on the City, and would provide up to $7,128.88 annually, based on the current rates, to fund the expansion of Police, Fire, and Park Se rvices.  Recommendations: Council: 1. Conduct a public hearing on the proposed annexation; and, 2. Adopt Draft Resolution A, authorizing the territory identified in City Council Resolution 2015-012 to be annexed into the Community Facilities District No. 2005-1, authorizing the levy of a special tax and submitting the levy of a special tax to qualified electors; and, 3. Direct the City Clerk to conduct a landowner vote of annexation and collect and count the ballots. Adopt Draft Resolution B, declaring the results of a special annexation landowner election, determining the validity of prior proceedings and directing the recording of an amendment to the notice of special tax lien; and, 5. Air Pollution Control District (APCD) – Special meeting this Thursday evening regarding the recent Superior Court ruling regarding the Oceano Dunes and Dust Rule. Parents for Joy was able to work with a playground manufacturer to produce concept designs for the playground. The design was approved by Council at the City Council meeting on July 24, 2014. Parents for Joy is currently working with a local area contractor and architect/engineer to complete the plans for building the playground to the design standards. At the City Council meeting of July 24, 2014 representatives from Parents for Joy were asked by Council if they had decided upon a name for the playground. At the time , the group had not decided on a name to be associated with the playground. Following direction from Council, the group met to discuss possible options for a name. Parents for Joy decided upon the name “Joy Playground” as it was in keeping with the repea ted theme of joy that the group has used since its inception. Parents for Joy is currently raising money to cover the costs associated with the building of the playground. Money is being raised through local area fundraisers and through grant applications. The group has expressed that it would be helpful to have an officially approved name for the playground to use as part of their fundraising efforts. Parents for Joy has asked staff to seek approval from Council regarding the naming of the park. In 1995, the City Council adopted a policy for the Naming of Public Buildings, Parks, and Other Public Facilities. The Colony Park Community Center, where the playground will be located, has already been named in keeping with City Council Policy. The name of the Community Center will not be affected by the adoption of a name for the ITEM NUMBER: A-4 DATE: 04/28/15 playground. The naming of a playground at an existing facility/park is not easily categorized in the existing policy, therefore Council direction is requested. FISCAL IMPACT: None. ALTERNATIVES: 1. Council may decide not to authorize the naming of the playground. 2. Council may direct staff to work with Parents for Joy to come up with a different name for the playground. ATTACHMENT: 1. CITY OF ATASCADERO COMMUNITY SERVICES DEPARTMENT POLICY ON THE NAMING OF PUBLIC BUILDINGS, PARKS, AND OTHER PUBLIC FACILITIES I. PURPOSE To establish a uniform policy for naming public buildings, parks and other facilities. II. POLICY A. Public buildings will be named by their function. For instance, a city hall will be called a city hall, and a recreation building will be called a recreation building. B. Public facilities will be named by their location in the City, either by proximity to a geographical feature, location in an identified area in the City (such as a street, neighborhood, subdivision, etc.). C. The name of a park or recreation facility should, if possible, have geographic, botanical, zoological, agricultural, or historical significance generally recognized and known through the City or local area. D. A public building, park, or other city facility should not be named after a person, unless one or more of the following exceptions apply: 1. The facility was acquired by means of a substantial gift or donation of funds by an individual, family or corporation. Consent of the donor to naming the facility will be required. 2. The individual made a substantial contribution in terms of volunteer services providing a broad public benefit to the residents of the City of Atascadero. 3. ITEM NUMBER: A-4 DATE: 04/28/15 ATTACHMENT: 1 ITEM NUMBER: A-5 DATE: 04/28/15 Atascadero City Council Staff Report - Community Development Department PLN 2007-1243 / CFD 2014-0003 Community Facilities District 2005-1 Annexation No. 13 Atascadero Triangle RECOMMENDATION: Council adopt on second reading, by title only, Draft Ordinance A, authorizing the levy of special taxes in Community Facilities District 2005-1 for certain annexation territory. DISCUSSION: This action consists of authorizing the levy of special taxes in Community Facilities District 2005-1 to newly annexed area number 13, known as the Atascadero Triangle. This is a 2nd reading of the proposed ordinance. On April 14, 2015 the City Council held a public hearing on annexation of area 13, the Atascadero Triangle. After the close of the public hearing, the City Council adopted a resolution on a 5-0 vote authorizing an annexation of this area into CFD 2005-1. A landowner election was held, and the owners elected to auth orize a special Community Facilities District (CFD) tax and approve the annexation. The Council then introduced, by title only, Draft Ordinance A; and on a 5-0 vote, authorized a levy of a CFD fee to all future property owners residing in the Atascadero Triangle Project. The Special Tax levied against Single-Family Residential parcels for Fiscal Year 2013- 2014 was $650.08 per parcel ($54.17 per month), which is subject to an annual escalator, to pay for the service expansion needed to serve these additiona l residential units. The money collected can only be used to fund new public services authorized to be funded by the State Mello-Roos Act and identified within the Rate and Method of Apportionment, and cannot be used to support existing services. Adoption of this ordinance by 2nd reading, will complete the CFD process and allow for the Final Map to be recorded. Division 2, Title 5 of the Government Code of the State of California (the “Act”) and the City of Atascadero Community Facilities District No. 2005-1 (Public Services) Ordinance enacted pursuant to the powers reserved by the City of Atascadero under Sections 3, 5, and 7 of Article XI of the Constitution of the State of California (the “CFD Ordinance”) (the Act and the CFD Ordinance may be referred to collectively as the “Community Facilities District Law”), to establish the City of Atascadero Community Facilities District No. 2005-1 (Public Services) (the “District”) for the purpose of financing police services, fire protection and suppression services, and park services (the “Services”) as provided in the Act; and WHEREAS, the rate and method of apportionment of special tax for the District is set forth in Exhibit B to the City Council Resolution entitled “A Resolution of the City Council of the City of Atascadero, California, For the Formation of Community Facilities District No. 2005-1 (Public Services” (the “Resolution of Formation”), which was adopted on May 24, 2005; and WHEREAS, the City has conducted proceedings to annex territory into the District and, with respect to the proceedings, following an election of the qualified electors in the territory proposed for annexation (the “Annexation Territory”), the City Council, on April 14, 2015, adopted a Resolution entitled “Resolution of the City Council of the City of Atascadero, California, Declaring the Results of Special Annexation Landowner Election, Determining Validity of Prior Proceedings, and Directing the Recording of an Amendment to Notice of Special Tax Lien.” NOW, THEREFORE, the City Council of the City of Atascadero, does hereby ORDAIN as follows: SECTION 1. The above recitals are true and correct. SECTION 2. All of the collections of the special tax shall be used as provided in the Community Facilities District Law and in the Resolution of Formation, including, but not limited to, the payment of the costs of the Services, the payment of the costs of the City in administering the District, and the costs of collecting and administering the special tax. SECTION 6. The special tax shall be collected in the same manner as ordinary ad valorem taxes are collected and shall have the same lien priority, and be subject to the same penalties and the same procedure and sale in cases of delinquency as provided for ad valorem taxes; provided, however, that the City Council may provide for other appropriate methods of collection by resolution(s) of the City Council. The Administrative Services Director of the City is hereby authorized and directed to provide all necessary information to the auditor/tax collector of the County of San Luis Obispo in order to effect proper billing and collection of the special tax, so that the special tax shall be included on the secured property tax roll of the County of San Luis Obispo for Fiscal Year 2015-16 and for each fiscal year thereafter until no longer required to pay for the Services or until otherwise terminated by the City. If for any reason any portion of this Ordinance is found to be invalid, or if the special tax is found inapplicable to any particular parcel within the District, including the Annexation Territory, by a court of competent jurisdiction, the balance of this Ordinance and the application of the special tax to the remaining parcels within the District, including the Annexation Territory, shall not be affected. DISCUSSION: The Parks & Recreation Commission has met once a month for many years. In recent years, due to a lack of items to bring to them, the Parks & Recreation Commission meetings were frequently cancelled. The City Council, during their Strategic Planning Workshop in January 2013, suspended the Parks & Recreation Commission meetings until further notice, due to the lack of issues to bring to the Commission. Since then, there have been a few issues that the City Council wanted the Commission to review, and meetings were scheduled. The City Council asked staff to bring an ordinance to them amending the section pertaining to the Parks and Recreation Commission. The purpose of the amendments is to clarify the appointment process for the Commissioners and how often they are to meet. In 2013, the City Council adopted an Ordinance that amended the appointment process for the Planning Commission members. Staff recently noticed an error in that amendment, and is proposing clean-up language in the proposed Ordinance. At their April 14, 2015 meeting, the Council introduced for first reading, by title only, the Draft Ordinance included with this report. If adopted, the Ordinance will go into effect in 30 days. DISCUSSION: The Municipal Code, Section 6-13.03, addresses the abatement of vegetative growth and/or refuse, which constitute a hazard. Adoption of the proposed Resolution is the first step in this annual program, which requires City Council action. The Fire Department conducted its initial inspection during the month of April. There are approximately 11,165 parcels within the City. The list of parcels identified to have vegetative growth and/or refuse, which are or may become a public nuisance, is available for review in the Office of the City Clerk and the Atascadero City Fire Department. FISCAL IMPACT: The City recovers costs for administering this program through the 150% administrative fee, which is placed on the San Luis Obispo County Special Tax Ass essment for the fiscal year 2015-2016 Tax Roll. Abatement requirements shall remain in effect in waterways where flood preparation measures and emergency flood control mitigation is necessary. 1) This exemption applies whether the land or water are held in fee title or any lesser interest. The Fire Chief has established the following requirements: CLEARANCE REQUIREMENTS OF VEGETATIVE GROWTH (NOXIOUS WEEDS) a) Maximum height of 4 inches; b) Located within 100 feet of any building or structure, or to the property line, whichever is nearer; c) Located within 50 feet from the edge of any improved roadway; d) Located within 50 feet from each property line; e) Located within 10 feet on each side of driveways. EXEMPTIONS: a) Animal pastures and agricultural fields growing hay or grains. The interior portion of fenced pastures where the quantity of livestock significantly reduces the vegetative growth, therefore bringing the parcel into compliance. Agricultural fields must be cut at harvest time. Uncut hay and grain is subject to abatement. b) Habitat for endangered or threatened species or any species that is a candidate for listing as an endangered or threatened species by the State of California or Federal Government. c) Land kept in a predominantly natural state as habitat for wildlife, plant, or animal communities. d) Open space lands that are environmentally sensitive parklands. e) Other lands having scenic values. Abatement requirements shall remain in effect in waterways where flood preparation measures and emergency flood control mitigation is necessary. 1) This exemption applies whether the land or water are held in fee title or any lesser interest. This exemption applies to any public agency, and private entity that has dedicated the land or water areas to one or more of those purposes or uses, or any combination of public agencies and private entities making that decision. 2) This section shall not be construed to prohibit the use of properly authorized prescribed burning to improve the biological function of land or to assist in the restoration of desired vegetation. 3) In the event that any lands adjacent to land or water areas, as described above, are improved such that they are subject to this chapter, the obligation to comply with Section 6 -13.04 shall be with the person owning, leasing, controlling, operating, or maintaining the occupied dwelling or occup ied structure on the improved lands. All maintenance, activities, and other fire prevention measures required by Section 6-13.04 shall be required only for the improved land, and water areas as described above. Adopt Draft Resolution authorizing specified organizations to use City facilities in a manner specified in written agreements regarding use of City Facilities; and, 2. Authorize the City Manager to execute a Facility Use Agreement with the Atascadero Veterans Memorial Foundation. DISCUSSION: Background: Representatives of the Atascadero Veterans Memorial Foundation (AVMF) have requested the use of a conference room one evening per month to hold their monthly Board meetings. In order to minimize costs to the City, the AVMF has asked to use the conference room on the fourth Tuesday of the month during City Council meetings. In 1952, Atascadero’s historic Colony Administration building was designated by San Luis Obispo County as the Atascadero Veterans Memorial Building . It came to be known by some in the community as the Veterans Memorial Building. When the City incorporated in 1979, the building once again became the Administration Building and then Atascadero City Hall. The representatives of the AVMF have expressed that it is appropriate for the Council to allow them to designate one conference room in City Hall be made available to the AVMF for their monthly board meetings at no cost to them. The purpose of AVMF was to build and now maintain the world class Faces of Freedom Veterans’ Memorial located near Alvord Field/Atascadero Lake Park. Because AVMF is dedicated to ITEM NUMBER: A-8 DATE: 04/28/15 maintaining this now City asset, and in light of the dedication in 1952, AVMF feels that it is appropriate to allow the AVMF to use the conference room at no charge. Analysis: Historic City Hall rental rates and policies were established and adopted by the City Council in October, 2013 with the adoption of the Historic City Hall Meeting Reservations Policy (“Reservations Policy”), copy attached. The Reservations Policy includes rental rates and policies of the first floor conference rooms. The Reservation Policy established that non-profit groups would be allowed to reserve conference rooms within City Hall for two hour meetings on an occasional basis “(no more than 4 times per year by the same organization)” at no charge, and that additional rental time would be charged at the rate of $25.00 per hour. The Reservation Policy did not allow for evening rentals. The Council may wish to consider that not only would the City not be collecting a rental fee for the use of the room one day per week , but there is a possibility that the City will incur costs for this use, that would otherwise not be incurred . The Council should also be aware that some may feel that this is a precedent and that other non-profit organizations may request the use of the building at no charge. While there are several conference rooms in City Hall, they are often in use and the City has limited ability to accommodate all those wishing to use the building. The policy adopted by Council in October of 2013, allowing non-profit organizations to use the facility for limited times is a sound policy and granting this request by the Atascadero Veterans’ Memorial Foundation should be considered a specific exception for the “Veterans Memorial Building.” FISCAL IMPACT: A potential loss of rental fees the conference room might otherwise generate and a potential impact to front counter staff time. FACILITY ROOM USE INFORMATION A. The Organization will be allowed full use of a conference room in Atascadero’s City Hall free of charge in the following instances: 1) Any 4th Tuesday night of each month when a Council meeting is occurring. The use may start no earlier than 5pm and the Facility must be vacated at the time that the Council meeting is completed or within 15 minutes thereafter. 2) If there is no scheduled Council meeting on the 4th Tuesday or it is expected that the 4th Tuesday night Council meeting will be too short to accommodate a meaningful Organization board meeting, the Organization may contact the City Manager to arrange use of a conference room at another mutually agreeable time when the Facility is already scheduled to be open to the public and staffed. In no instance, will the City open the Facility and/or staff the Facility for the sole purpose of accommodating the Organization’s need for a conference room. 3) In addition to the above use, the Organization may schedule the use of a conference room subject to availability for up to four (4) additional days per year during normal City business hours (Monday – Friday 8:30 am – 5:00 pm). The Organization shall contact the City and schedule use of the conference room through the City’s normal room reservation process. 4) Any additional use of City Hall facilities will be subject to the City’s Historic City Hall Facility Use and Rental Policy. B. The specific conference room assigned the Organization shall be at the City Manager’s discretion; however it is anticipated that in most instances it shall be a conference on the first floor. 4. CONDITIONS OF USE A. A certificate of insurance is required and endorsement are required pursuant to Section 6 of this Agreement. B. The Facility shall be used for the purpose stated in this Agreement and no other use will be permitted. C. The Organization shall not use the City’s name to suggest endorsement or sponsorship of the event without prior written approval of the City Manager or his/her designee. The Organization’s publicity of the event shall clearly and accurately identify the name of the sponsoring organization or individual. D. Under no circumstances shall the Organization sublease or allow any other organization or individual to use the Facility for the period for which Organization has contracted. The Organization is an independent agent and is not the agent or employee of the City of Atascadero. F. The Organization is responsible for setting up the room in their desired configuration. The Organization shall also be responsible for general cleanup of the room after use. G. The Organization understands and agrees that certain areas of the Facility will be locked off and not available to the Organization. This may mean that although the conference room is on the first floor, the nearest available restroom may be on the fourth floor. H. There has previously been established an Agreement by and between the City of Atascadero and the Atascadero Historical Society wherein the public display cases in the public meeting rooms are under the control of the Atascadero Historical Society. If the Organization wishes to make use of a display case, it will be necessary for the Organization to obtain permission of the City and the Atascadero Historical Society in order to do so. 5. FEES A. Regardless of the City’s previously established Facility Use and Rental policy, the Organization shall be allowed use of a conference room as specified above at no charge to the Organization. An exception is being made to the City’s Historic City Hall Facility and Rental Policy in this instance for this Organization only. B. In the event the Facility is left damaged, the Organization shall be charged for any and all janitorial and/or repair fees incurred by the City as a result of same and these fees shall be billed to the Organization. 6. INDEMNIFICATION AND INSURANCE A. The Organization shall indemnify, defend, and hold harmless the City of Atascadero, its officers, employees, and agents from any and all losses, costs, expenses, claims, liabilities, actions, or damages, including liability for injuries to any person or persons or damage to property arising at any time during and/or arising out of or in any way connected with Organization’s use or occupancy of the Facility and adjoining property, unless solely caused by the gross negligence or willful misconduct of the City, its officers, employees, or agents. The Organization shall procure and maintain general liability insurance against any and all losses, costs, expenses, claims, liabilities, actions, or damages, including liability for injuries to any person or persons or damage to property arising at any time during and/or arising out of or in any way connected with its use or occupancy of the City’s facilities and adjoining property in the amount of $1,000,000 (one million dollars) per occurrence. Such insurance shall name the City of Atascadero, its officers, employees, and agents as additionally insured, and shall be delivered to the City prior to the implementation of this Agreement. If a copy of the insurance certificate is not on file with the City, the City may deny access to the Facility. C. The Organization shall report any personal injuries or property damage arising at any time during and/or arising out of or in any way connected with its use or occupancy of the Facility and adjoining property to the City Manager or his/her designee, in writing and as soon as practicable. D. The Organization waives any right of recovery against the City, its officers, employees, and agents for fires, floods, earthquakes, civil disturbances, regulation of any public authority, and other causes beyond the their control. E. The Organization waives any right of recovery against the City, its officers, employees, and agents for indemnification, contribution, or declaratory relief arising out of or in any way connected with the Organization’s use or occupancy of the Facility and adjoining property. 7. SECURITY A. The Organization is solely responsible for supervising all individuals at the Facility and adjoining property during its use of the Facility. B. Use of the conference room may allow the public to have access to areas of the Facility that are not normally accessible to the public. The Organization agrees, to the best of their ability, to monitor access to those areas and to redirect the public to the areas of the Facility that are open to the general public at that time. C. The City may evict individuals from the Facility if their conduct is not in the best interest of the public or is deemed to be detrimental in any way. 8. SET UP / CLEAN UP / DECORATIONS A. The Organization shall not drive or permit to be driven nails, hooks, tacks, screws, poles, stakes or other forms of fasteners into any part of the Facility and shall not make or allow to be made any alterations of any kind therein. The Organization shall not store any equipment or materials at the Facility or adjoining property without the prior written approval of the City Manager or his/her designee. C. The Organization shall be responsible for any and all damage to the Facility and/or its contents during use. In the event damage occurs or excessive cleaning is necessary, the Organization shall be charged for any and all janitorial and/or repair fees incurred by the City as a result. 9. EQUIPMENT / ACCESSORIES A. The Organization shall not remove, relocate, or take City property outside of the Facility for any reason without the prior written approval of the City Manager or his/her designee. B. The Organization shall not use the City’s equipment, tools, or furnishings located outside of the designated conference room in or about the Facility without the prior written approval of the City Manager or his/her designee. C. The City does not provide audio/visual systems, public address systems, spotlights, floodlights, or projectors. The Organization, at its own cost, may bring these systems into the Facility for their use. D. The Organization shall secure the approval of the City before using public address systems. 10. MISCELLANEOUS A. The Organization shall comply with all local, state, and federal laws and regulations related to the use of the Facility. B. The Organization shall not admit a larger number of individuals than can lawfully, safely, and freely move about the specified conference room and the Facility. C. Gambling of any kind is not permitted at the Facility. D. Smoking is not permitted at the Facility. E. No animals are permitted at the Facility, with the exception of guide dogs. F. The City may impose additional requirements as deemed necessary to protect the health, safety, and/or welfare of the community. G. WARRANTIES AND REPRESENTATIONS The Parties, and each of them, warrant and represent that they are authorized to enter into this Agreement. The Parties, and each of them, agree that this Agreement shall be binding on their representatives, agents, affiliates, owners, heirs, successors and assigns. 12. APPLICABLE LAW This Agreement shall be construed, interpreted and enforced in accordance with the laws of the State of California. 13. ENTIRE AGREEMENT This Agreement constitutes the entire agreement between the Parties hereto, with respect to the subject matter referenced herein. This Agreement is the final embodiment of the Parties’ agreement and shall supersede all prior or contemporaneous discussions, agreements, and understandings among the parties, whether written or oral, express or implied, relating in any way to the subject matter of this confidential settlement agreement. This is a fully integrated document. 14. EFFECTIVE DATE This Agreement shall be effective (“Effective Date”) on the day the Agreement is signed by the City. 15. TERM This Agreement shall remain in force unless and until the Agreement is terminated pursuant to Section 16. 16. TERMINATION This Agreement may be terminated by either party, with or without cause, upon 30 days written notice to the other party. All applications for special events must be received at least 60 days prior to the event. Reservations will be taken on a first come, first serve basis. Saturday and Sunday Rentals: Rental Hours: Saturday and Sunday events rentals include 10 hours maximum use of the space, including decoration time and clean-up time. Events may go as late as 11 pm, with clean-up completed by midnight. Rental Package: Saturday and Sunday rentals include:  A minimum of two facility staff throughout the rental time  Three security guards for four hours. Some events may require additional security. Reservation Process: A completed application and reservation deposit of $1000 is required to reserve a requested date. In the event of a cancellation, the reservation deposit will not be refunded. Security Deposit: A refundable $1000 security deposit is due 30 days prior to the event date. Any damage or additional costs incurred during the event will be taken out of the security deposit.
