WELCOME TO THE ATASCADERO PLANNING COMMISSION MEETING
The Planning Commission meets in regular session on the first and third Tuesday of each month at 7:00 p.m. at City
Hall, Council Chambers, 6500 Palma Avenue, Atascadero. Matters are considered by the Commission in the order of
the printed Agenda.
Copies of the staff reports or other documentation relating to each item of business referred to on the Agenda are on
file in the office of the Community Development Department and are available for public inspection during City Hall
business hours at the Front Counter of City Hall, 6500 Palma Avenue, Atascadero, and on our website,
www.atascadero.org. All documents submitted by the public during Commission meetings that are either read into
the record or referred to in their statement will be noted in the minutes and available for review in the Community
Development Department. Commission meetings are audio recorded, and may be reviewed by the public. Copies of
meeting recordings are available for a fee. Contact the City Clerk for more information (470-3400).
In compliance with the Americans with Disabilities Act, if you need special assistance to participate in a City

Project Description: An application to amend the Master Plan of Development for the Home Depot shopping center. The
north west parcel in Phase I (adjacent to Staples) was previously approved for an 18,000 sq. ft. retail
building, which has not yet been constructed. The Amendment proposes reducing the size of the
retail building to 10,000 sq. ft. and adding a 4,500 sq. ft. drive-through restaurant. A Tentative
Parcel Map is proposed to subdivide the existing lot into two (2) parcels.

The proposed Amendment is consistent with the Mitigated Negative Declaration which was prepared

Amendment to the Home Depot Master Plan of Development (CUP 2000-0014) and the proposed

3. PLN 2006-1133 ANNUAL GENERAL PLAN / HOUSING REPORT
The State of California requires all cities to file an Annual General Plan / Housing Report to the Department of
Housing and Community Development (HCD) and the State Department of Office Planning and Research
(OPR). The purpose of the Report is to monitor the implementation of the City’s General Plan Housing Element
and progress toward meeting the City’s Regional Housing Needs Allocation (RHNA), as well as review the
General Plan to ensure the City is meeting the goals and objectives established by the Plan.
Assistant Planner Alfredo Castillo gave the staff report and answered questions from
the Commission.

ANALYSIS:
The proposed project is located on 8360 El Camino Real, in in the Food 4 Less parking
lot. An application has been submitted by the owner for the removal of one (1) native
Live Oak tree to avoid the potential risk associated with the dead tree. Proposed native
tree removal is one (1) Live Oak totaling 52-inches DBH.
The tree is located in the parking lot of the grocery store, Food 4 Less. As noted by the
applicant’s arborist, Robert Schreiber, the health of the tree proposed for removal is
dead and/or dangerous. The tree contains three major supportive branches.
In addition to apparent rotting of one of the branches, another branch contains evidence

of an extensive ant infection. The weight of the three co-dominant branches is
disproportioned, leaving the, “Majority of the weight positioned over parking spaces
under the tree.” (Attachment 4)
The City’s arborist, Michael Bova, inspected the tree on February 25, 2015, and reports
the tree is not dead, nor does it warrant an emergency removal permit, but recommends
removal due to significant decay and the tree’s declining health (Attachment 5).
Tree Mitigation
The Atascadero Municipal Code requires mitigation for all trees approved for removal.
The Tree Ordinance allows for either replanting of new native trees, or payment of
mitigation fees to the tree fund. Given the location of the proposed removal, staff
recommends that the applicant mitigate by replanting new trees on the lot and the
applicant has indicated that it is his preference to mitigate through planting.
Based on the 52-inch DBH size of the Live Oak tree to be removed required replanting
would be seventeen (17) 5-gallon oak trees. Equivalent box tree replanting may be
done, based on recommendations from the Arborist and the City’s native tree
guidelines. Additional the applicant may choose to pay a total fee of $866.67 for
removal or a combination of replanting and fees.

The replacement trees will need to be watered for the first several years in order for the
new native trees to become established. A condition has been included as a part of
resolution requiring irrigation to be provided for the native tree replanting area. Staff
recommends that the Planning Commission direct the applicant to replant, where
feasible, to mitigate the loss of the oak tree at a minimum 15-gallon box tree(s).

FINDINGS:
In considering any tree removal request, at least one of the required findings must be
made. Staff has identified the following finding as appropriate for the application
request.
(i) The tree is dead, diseased or injured beyond reclamation, as certified by a tree
condition report from an arborist;
CONCLUSIONS:
Two certified arborists have determined that the subject one (1) 52-inch DBH Live Oak
is to not be in good health, and presents a potential hazard to persons and property.
The subject tree should be removed upon approval of the resolution.
ALTERNATIVES:
1. The Commission may approve the project with additional or revised project
conditions.
2. The Commission may deny the project if it is found that the required findings cannot
be made. The Commission’s motion to deny must include a finding basis for denial.
3. The Commission may continue the hearing and refer the item back to staff for
additional information or analysis. Direction should be given to staff and the
applicant on required information.

WHEREAS, an application was received from Romaldo and Janice Martin c/o Dart
Browning, P.O. Box 12010, San Luis Obispo, 93406, (Property Owner) and by Robert Schreiber,
Arbor First, 170 Terra Street, Morro Bay, 93422 (Arborist), for a Tree Removal Permit to
remove one (1) Live Oak totaling fifty-two (52) inches DBH.
WHEREAS, the Planning Commission reviewed the proposed Tree Removal Permit
application on March 3, 2015, at 7:00 p.m. and considered testimony and reports from staff, the
applicants, and the public; and,
NOW THEREFORE, the Planning Commission of the City of Atascadero, California
takes the following actions:
SECTION 1. Findings for tree removal. The Planning Commission finds as follows:

1. The approval of this application shall become final, subject to the completion
of the conditions of approval, fourteen (14) days following the Planning
Commission approval unless prior to the time, an appeal to the decision is
filed as set forth in Section 9-1.111(b) of the Zoning Ordinance.

2. The applicant and/or subsequent owners shall defend, indemnify, and hold
harmless the City of Atascadero or its agents, officers, and employees against
any claim or action brought to challenge an approval by the City, or any of its
entities, concerning the proposed development.

3. The applicant shall mitigate the tree removal by replanting the number of
Native Trees, pay the mitigation fee, or a combination thereof as shown in
Exhibit B. Applicant must work with City staff and arborist for sites to
replant trees, if the applicant chooses to replant on-site. Larger box trees
may be substituted for five-gallon replacement trees per the Atascadero
Native Tree guidelines. Native tree replanting must be completed prior to
within 60-days of removal.

4. The applicant / owner must provide irrigation to tree replanting sites.
Irrigation shall be drip irrigation. Irrigation or water to the proposed
replanting must be provided.
